On the Greek Rite of the Melkite Catholics of the Patriarchate of Antioch

Constitution of Pope Benedict XIV ·

POPE BENEDICT XIV.

1 Venerable brethren, greetings and apostolic blessing. Undertaking the care committed to us from heaven, the care of all the churches, at the very beginning of our Pontificate, through circular letters given on the 4th of December in the year 1740 to you venerable brethren, Patriarchs, Primates, Archbishops and Bishops governing the Church of God throughout the whole world, among the other sentiments of our mind which we wished to make known to you, we also exhorted all of you that in whatever matters pertaining to the preservation and increase of Catholic faith and discipline, should it happen that you need our authority and the aid of this Holy See for yourselves and your churches, you should not hesitate to refer them to us with all confidence; and we promised to all those aids which, committed to us by apostolic supreme power and by the solicitude which our pastoral office befits, are most fitting to be brought to the prelates of the lower churches. These things, however, which we publicly promised to the whole assembly of Bishops, since we have always hitherto striven to fulfill them with all care and vigilance even in the midst of the perturbations of most difficult times, the Lord supplying strength; and to all those who, stirred by our exhortations, have come to us concerning their own affairs and those of their churches, we have provided all those things which we judged to conduce both to their own safety and to the safety and benefit of the souls subject to them. We have certainly not deemed it to be neglected, the recourse which the venerable brother Cyril, Patriarch of Antioch, had made concerning matters of no small importance and otherwise to our predecessors of blessed memory Benedict XIII and Clement XII, and recently to us ourselves, who, impelled by ardent zeal for the purity of faith and discipline and the salvation of souls, for which he is known also to have endured illustrious labors and to have undergone great dangers, had brought before the judgment of this Apostolic See, after the manner of his ancestors, many doubts arising in the governance of his own and other churches subject to him, and various petitions concerning matters which seemed to him opportune, so that by the supreme authority of the Roman Pontiff all ambiguity of doubts and occasion of errors might be removed, and the order and tranquility of ecclesiastical governance might be secured in those regions for the salvation of the peoples by providential laws.

2 § 1. And so, desiring to comply with his praiseworthy and just desire, and to satisfy his repeated requests as far as it could be opportunely done, we have resumed the whole matter lying at a long interval, and wishing to examine it through ourselves and to define it accurately, we have considered the aforesaid doubts and petitions one by one with the greatest study and diligence; and having taken into counsel some of our venerable brethren, the Cardinals of the Holy Roman Church, chosen from that assembly which presides over the affairs of the Propagation of the Faith, and also some grave men from the secular and regular clergy distinguished in theological and canonical learning, all of whom we commanded to open their opinions before us once, twice, and a third time concerning the aforesaid matters; we have finally determined and decreed those things which through these letters of ours we declare to you, venerable brethren, to be held and observed by apostolic authority throughout the Patriarchate of Antioch by the Bishops of the Orthodox Greek-Melchite Churches, having the greatest confidence in all of you in the Lord, that you will respond to our paternal charity toward you and our solicitous care for your affairs with complete, prompt, and fitting obedience and observance.

3 § 2. Moreover, from the doubts and petitions proposed by the aforesaid venerable brother Cyril, Patriarch, some pertain to the preservation of the rites and customs of the Greek Church, both of all in general, and of those in particular which relate to the observance of fasts and the celebration of the most holy sacrifice of the Mass; others are concerned with the jurisdiction of the same Patriarch and of the Bishops subject to him, which is asserted to be disturbed on the other hand by Latin missionaries; finally, some regard the discipline of monks and their legitimate subjection to superiors, and also the rule of living of religious women, and their governance and protection.

4 § 2. Moreover, from the doubts and petitions proposed by the aforesaid venerable brother Cyril, Patriarch, some pertain to the preservation of the rites and customs of the Greek Church, both of all in general, and of those in particular which relate to the observance of fasts and the celebration of the most sacred sacrifice of the Mass; others are concerned with the jurisdiction of the same Patriarch and of the Bishops subject to him, which is asserted to be disturbed on this side by Latin missionaries; finally, some regard the discipline of monks and their legitimate subjection to superiors, and also the rule of living of religious women, and their governance and protection.

5 § 3. Concerning the rites and customs of the Greek Church, we have decreed that this must first be established in general: it has not been lawful and is not lawful for anyone, under any title, pretext, or authority, or dignity, even if it shine forth with patriarchal or episcopal rank, to innovate anything or to introduce something that would diminish the complete and exact observance of the same. Hence it is that the deed of Euthymius, formerly Archbishop of Tyre and Sidon, a man otherwise Catholic and most zealous for the propagation of Christian matters, which was once disapproved by this Apostolic See in the year 1596, we are compelled to disapprove again; and the innovation introduced by him, by his own authority and without consulting the Roman Pontiff, of certain customs of the Greek Church, we revoke, and we decree it to have been null and to be null.

6 Nothing is to be innovated concerning the rites of the Greek Church in general.

7 Innovations introduced by the Archbishop of Tyre are disapproved.

8 TUR. PONT. DE P. F. PARS I.

9 The Patriarch is enjoined to provide for the preservation of received customs, etc.

10 The authority of the same and of the Bishops being preserved as to matters indifferent.

11 Concerning certain rites in particular.

12 Concerning the discipline of fasting wrongly instituted.

13 Abstinences customarily observed by the Greeks. We revoke this innovation, and we decree it to have been null and to be null; and we command that all the rites and customs of the Greek Church handed down by the Fathers be altogether observed in the future and by each one; specially enjoining upon our venerable brother the Patriarch of Antioch that he diligently watch over their preservation and provide that no novelty (whence, for the most part, occasion of confusion and scandal) be introduced into them: permitting only to the same Patriarch and to Catholic Bishops in their own dioceses the faculty of correcting and eradicating abuses, if any, which they shall find to have crept in among them through the error of the common people or the deceit of schismatics or the corruption of the age; or even of admitting and approving certain particular exercises of piety, if any which they shall prudently judge in the Lord to be apt and profitable for promoting the religion of the faithful.

14 § 4. Now it is fitting to this general sanction pronounced by us that those customs in particular, which are reported to have undergone some change or detriment, be reduced and restored to their former vigor.

15 § 5. Since therefore the aforesaid Cyrillus, Patriarch of Antioch, in a certain assembly of Bishops held in the year 1636 on Mount Lebanon, thought it necessary to follow in some part the example of the aforesaid Euthymius, Archbishop; being ignorant, as it is asserted, of the decrees of the Apostolic See, which had been issued in the year 1632 at his petition (and whose execution, promised by him in general at the confirmation of his dignity, we are persuaded, given his evident life of piety and office and his constant observance toward this Holy See, he would never knowingly have neglected); he thought it not only lawful for himself but also expedient to change the discipline received in the Greek Church concerning fasts. Considering namely the poverty of many of his Greek-Melchite subjects, inhabitants of the deserted lands of the Arabs, where there is a great scarcity of Lenten foods, and moreover the great severity and long duration of the abstinences which are observed in the Greek Church; where indeed, besides the fast of Lent, which throughout the whole Church precedes the paschal feasts of the Resurrection of the Lord by apostolic institution, a similar forty-day abstinence also precedes the solemnity of the Nativity of Christ, with another of fourteen days before the feast of the Assumption of the Blessed Mary the Virgin observed, and another finally before the feast of the Ss. Apostles Peter and Paul, comprising as many days as intervene from the second feria after the octave of Pentecost to the feast of the same Apostles: considering also the relaxation of discipline which through the decrees of Euthymius had already become prevalent among those peoples, could with difficulty be recalled to the former rigor; dispensing perpetually concerning three such abstinences last mentioned above, as to all the inhabitants of the mountain lands, he restricted each one to a single day immediately preceding the aforesaid solemnities of the Nativity of Christ, the Assumption of the Blessed Mary the Virgin, and the Martyrdom of the Ss. Apostles Peter and Paul.

16 § 6. We, judging such innovation and relaxation and restriction of abstinences to tend greatly to the detriment of the ancient discipline of the Greek Churches, although otherwise, the authority of the Apostolic See being wanting, they ought to be recognized as having no force, yet by our authority we expressly revoke it, and it shall have no effect in the future nor be executed in any way; but all things must be restored to their former state. And moreover throughout the whole territory of the Patriarchate of Antioch we command that the praiseworthy custom, derived from the ancients, of abstaining also on any Wednesday and Friday throughout the year from the eating of fish, which is also exactly observed by other neighboring peoples of the same Greek rite, be indiscriminately observed.

17 § 7. And nevertheless, renewing the decrees of the particular Congregation of the Propagation of the Faith issued on another day, 22 January of the year 1632, concerning such matters and issued by the aforesaid Patriarch, as is asserted, in ignorance thereof, and taking pity with paternal spirit on the poverty of the faithful inhabitants of Lebanon and Anti-Lebanon and the scarcity of foods for Lent, which is said to be present in most places of that region, on account of which it often happens that they are necessarily obliged to eat meat and animal products, we decree, allowing this, that, the general law concerning fasts and abstinences remaining unharmed even for them, from which it is permitted to no one to grant a dispensation in general, if however at any time true and grave necessity presses for dispensing with some assembly or community, we grant the faculty to our venerable brother the Patriarch of Antioch, that in individual years only, in which he shall have known that necessity to persist, and not otherwise nor in any other manner, he may grant such dispensation to each of the aforesaid communities: The record of these to be attested by the Patriarch.

18 The Patriarch's action is to be annulled: the ancient observance shall be established.

19 Other abstinences of the Greeks throughout the year are confirmed.

20 Faculty is granted to the Patriarch to dispense with individual communities in particular cases.

21 Not omitting meanwhile the necessary precautions, by which he shall have thought it possible to prevent the neglect and oblivion of ancient rites from creeping in gradually, according to his judgment and prudence (1). § 8. In a similar manner we decree that no innovation ought to be made in that which concerns the celebration of the most holy sacrifice of the Mass, which, one only on each day upon any altar, has been handed down by the precept and custom of the ancient holy Fathers of the Greek Church; and for this reason we have deemed that the petition put forward to us by the same Patriarch should in no way be indulged, by which he had requested that, to satisfy the piety of priests and the manifold oblations of the faithful, we would permit the aforesaid rite, commended by antiquity, to be changed and that in the churches of Lebanon and Anti-Lebanon it would be made possible for priests to offer several masses on the same day upon the same altar, and moreover that in the weekdays of Lent (at which time, except on the days of Saturday and Sunday, only the Mass of the Presanctified is celebrated in Greek churches) we would grant the faculty of performing the complete sacrifice. Concerning which matters we command that the ancient rubrics of the Greek Church be altogether observed and their execution be impressed upon priests; yet eliminating from the opinion of the common people the inept credulity, by which some are said to think, rightly corrected, that a priest using the vestments and furnishings which another priest used on the same day breaks the observance of fasting.

22 § 9. We permit, however, according to the decree issued on 31 March 1629 by some of our venerable brothers, the Cardinals of the Holy Roman Church placed in charge of the affairs of the Propagation of the Faith, that other altars may be erected in a suitable place in the church. But if the number of altars does not sufficiently correspond to the multitude of those celebrating and offering, it is permitted for several priests, where such custom prevails, to concelebrate the sacrifice upon the same altar together with the Bishop or another priest performing the sacrifice; yet in such a way that, clothed in sacred vestments according to the manner of those celebrating, each one recites the entire liturgy completely and pronounces the words of consecration, just as if they were confecting the most holy sacrifice individually.

23 § 10. Such sacrifice, however, in individual cases, they may lawfully apply to the intention of those who present voluntary oblations. But if second and further oblations are added for the application of the same sacrifice, the priest who shall have received them is always bound to admonish the faithful offering in a later place of the other oblations accepted for the same purpose; and, unless those same offerors declare themselves to be satisfied with a single Mass celebration, let him know that he will in no way satisfy the will of many by a single sacrifice. We declare that the intention of those who have offered for the sacrifice will never be fulfilled by priests through the mere addition of particles and commemoration, which is customarily made in the preparation of bread before the Sacrifice of the Mass: since the complete concelebration is altogether necessary, unless it be otherwise done by the will of the same offerors.

24 § 11. But in order that the Greco-Melchite priests may observe one and the same order of ceremonies and the same rite in performing the sacred mysteries, and lest any dissimilarity creep gradually into the same, we have commanded that a missal for the use of that Church be printed by the press of the Congregation of the Propagation of the Faith according to the rubrics most firmly established by antiquity; which, after the edition of the sacred books of the Coptic rite which are under the press is completed, we shall take care to be carried out without interruption.

25 § 12. As to the jurisdiction of the aforesaid venerable brothers the Patriarch of Antioch and the Bishops of the Greek-Melchite rite, the preservation of which ought greatly to concern us, we have received with no small sorrow of heart that certain Maronite Bishops, asserting the rights of the aforesaid to themselves, have often, as is asserted, exercised over their subjects a jurisdiction in no way competent to them, absolving those who had been bound by ecclesiastical censures by their own pastors, granting dispensations for marriages in degrees and circumstances not at all permitted in the Greek rites, dispensing also with Greek-Melchite monks concerning the vows of religion, and by various arts drawing the subjects of the Antiochene Patriarch to embrace the Maronite rite. All and each of which things, as is reported, having been done by the said Bishops, are already by themselves null and condemned by pontifical and canonical law, lest they be renewed again to the disturbance of another's jurisdiction and to the fostering of quarrels and discord, by the supreme power which Jesus Christ, Prince of Pastors, bestowed upon the Blessed Apostle Peter and upon us his successors in the Catholic Church, we command all and each of the Maronite Bishops and the Patriarch himself of the nation with the addition of Particulars, since the commemoration before the sacrifice of the Mass cannot have regard for it.

26 Uniformity to be observed in the liturgy.

27 Concerning the jurisdiction of the Melchites disturbed in many ways by the Maronites.

28 By which they are commanded to abstain from this.

29 IUR. PONT. DE P. F. PARS I.

30 Nor let the Greek Melchites draw to the Maronite rite.

31 Likewise let not Latin missionaries disturb the aforesaid jurisdiction.

32 Let the Minorites alone exercise the care of souls in the absence of a Greek pastor.

33 Let the Guardian of the Holy Land minister confirmation to the Greeks only in the absence of a Greek Bishop.

34 of the Maronites and their successors, in perpetuity, in virtue of holy obedience, inasmuch as they rely upon the truth exposed to us, we command that they abstain from such things henceforth; and we further forbid that under any pretext or pretence they dare to interpose themselves in the spiritual affairs of the Greek-Melchite nation, in those things which pertain to the jurisdiction and authority of that Patriarch, Bishops and pastors, or to persuade their subjects to pass from the Greek to the Maronite rite, or to presume to accept those who should wish to pass over of their own accord, unless perchance a special licence of the Roman Pontiff should intervene.

35 § 13. And since we have understood that the aforesaid Patriarch of Antioch and the Bishops subject to him fear lest the Latin missionaries, whom the Apostolic See is accustomed to send into those regions for their aid and relief, and to sustain there not without grave inconvenience and great expense, by using the faculties granted to them, should cause prejudice to their jurisdiction and diminish the number of their subjects, wishing also in this matter to provide for their indemnity and to look to the free exercise of their own authority, we determine first and declare that it is permitted only to the brothers of the Order of Friars Minor of St. Francis of the Custody of the Holy Land to perform parochial duties among the Greeks-Melchites and to administer the sacraments to them in those circumstances of places and times in which there is absolutely lacking the means of having a pastor or another Bishop of the Greek rite: in which case the aforesaid brothers may lawfully receive the emoluments due by legitimate right and shall in no way depend upon the jurisdiction of the Patriarch of Antioch, but shall be bound to him only in that he may request that they deliver each year a list of the souls of the Greek rite existing in that city or place, inasmuch as these in all other respects are understood to be entirely subject to the same Patriarch. Let the Patriarch take care, for the fulfilment of his office, that wherever it shall be necessary, there be an abundance of Catholic pastors, from whom the aforesaid Greeks-Melchites may receive the sacraments according to the Greek rite.

36 § 14. The Sacrament of Confirmation may be conferred by the Father Guardian of the Holy Land in the city of Jerusalem and in those places where a Greek Catholic Bishop does not reside by right and in his own diocese, under the condition that Greeks already confirmed by a simple priest, and asking to be confirmed by him of their own accord, may receive it. But where there is a Catholic Bishop residing, let him not confer such a sacrament except with the consent of the same Bishop; but if he dissent, let him abstain.

37 § 15. Moreover, we expressly forbid all and each of the Melchites, Catholics observing the Greek rite, to pass over henceforth to the Latin rite. And we strictly command all missionaries, under the penalties also expressed below and other penalties to be decreed at our discretion, that they presume not to persuade any of them to such a passage from the Greek to the Latin rite, or even to permit those who should wish to do so, without consulting the Apostolic See.

38 § 16. Concerning those, however, whom they call Latinizers, namely those who, born of Greek parents, with Greek priests being lacking, have been baptized in the Latin rite by Latins down to this day and have hitherto maintained that rite, of whom a great number is said to be found in Damascus, and concerning whom it has not been sufficiently defined hitherto to which rite chiefly they ought to be devoted; we decree and declare that before a person to be appointed by us they ought once to profess in which rite they wish to live; and in that rite, with all faculty of changing removed, they are bound to persevere hereafter.

39 § 17. Sons, however, who shall be born from such parents after the aforesaid declaration has been made by them, as well as those who have already been born but have not yet come to the use of reason, shall follow the condition of their parents, if the spouses have chosen one and the same rite; if not, they shall follow the rite of their father.

40 § 18. Moreover, if it should happen that any Greeks, necessity compelling on account of the lack of a Catholic priest of the Greek rite, receive Baptism or other Sacraments from a Latin presbyter, they shall not on that account be considered to have embraced the Latin rite; but, all doubt being removed, they are bound to observe the Greek rite in which they were born. And indeed, while the aforesaid necessity endures, in all matters in which they can, and especially in the observance of fasts, let them retain it; in other matters, however, let them fully resume and continue it as soon as a Greek Bishop or priest shall arrive.

41 § 19. Finally, to cut off all controversies which are wont to arise on such questions even among the missionaries themselves on account of their diverse opinions and doctrines, and that all contention among the faithful arising therefrom be utterly extinguished, we expressly command the missionaries of whatever Order and institute, even So- Greeks are not to be drawn to the Latin rite.

42 Latinizers once to profess in which rite they wish to live, and in it they ought to persevere.

43 Their sons shall follow the rite of their parents.

44 Greeks baptized in the Latin rite hereafter are to observe the Greek rite.

45 Dissensions on the foregoing among missionaries are to be extinguished.

46 To the same (all the discipline of the Church Gr.

47 These innovations and dispensations on them are to be prohibited, under the penalty of the sanctions of the rule of St. Basil, and the jurisdiction of the Ordinaries.

48 Especially as to the editions of books.

49 Monastery of Nuns in Kesruano of the Society of Jesus, so that they may be solicitous to preserve in all these things the unity of spirit and doctrine: which indeed, faithfully obeying these decrees of ours and other decrees concerning the rites of the Greeks to be observed in the eastern regions issued at another time by the Apostolic See, they will easily accomplish. Let them take care, moreover, that all the praiseworthy institutions of the Greek Church derived from the ancient tradition of the Fathers and confirmed by apostolic approbation remain in their vigor, and be fully carried out in execution by the faithful of this nation; nor let them dare to suggest or persuade anything to them which could bring about contempt and diminution of those institutions; and much less presume by their own authority to innovate anything concerning them, or even to grant or admit any dispensation on the same. Otherwise, besides the strict account which they will render to God, to us, and to their superiors (whom we burden particularly with the urgent observance of this decree), let them know that by the force of these letters they incur ipso facto deprivation of active and passive voice and incapacity for any degree and office in their respective Orders, institutes and congregations.

50 § 20. Finally, as to the regular discipline of monks, we decree that monks of either Congregation, under the invocation respectively of the Most Holy Savior and St. John, observe the genuine rule of St. Basil, to be handed to them by our venerable brothers, the Cardinals of the Holy Roman Church presiding over the affairs of the Propagation of the Faith: and let them abstain from the eating of meat in the sense of the aforesaid rule. Moreover, monks of either of the aforesaid Congregations or of any other institute whatsoever we command to be immediately subject to the Catholic Ordinaries, and mediately to the Patriarch likewise Catholic. But in Dioceses in which there is no Catholic Ordinary, let them be immediately subject to the Catholic Patriarch. § 21. They are able to publish no books or pamphlets of any kind without the prior approval and license of the Bishop of the diocese and of the aforesaid Patriarch; and moreover let them make no book or pamphlet concerning sacred matters public without consulting the Apostolic See. But if it should happen that new editions of books already approved by the same Holy See are made, it shall be the duty of the Patriarch and of the Catholic Bishops to see that they do not in any respect differ from the approved editions.

51 § 22. Moreover, the Monastery of Nuns in Kesruano erected by the Greco-Melchites for girls of their nation and rite, we declare before all things to have been acquired by the same Greco-Melchite nation by right of property; so that girls of any other rite and nation may in no way whatsoever for any reason be admitted therein hereafter, with any faculty of dispensation on this matter, even to the Patriarch and Bishops, being removed.

52 § 23. Moreover, We receive the aforesaid monastery and nuns under the protection of the Holy Apostolic See and of the Congregation of the Propagation of the Faith; but We decree that its governance, both spiritual and temporal, pertains to the monks of the Congregation of St. John of Soairo, with immediate subjection to the Ordinary Bishop and mediate subjection to the Greek-Melchite Patriarch of Antioch, who also ought to acquire immediate authority over it and them, whenever in future times there should be no orthodox Bishop of that see: but insofar as (which God forbid) neither should be Catholic, for that time only and until one or the other should become Catholic, the aforesaid Monastery shall immediately be subject to the Abbot General of the aforesaid Congregation of St. John as Delegate of the Apostolic See.

53 § 24. The ordinary confessor of the nuns of the aforesaid monastery shall be a professed monk of the said Congregation of St. John, whom the Abbot General himself, having selected and presented him on the recommendation of learning, piety and prudence, the diocesan Bishop shall have approved: and We establish the same concerning the extraordinary confessor, whom the same Abbot General may appoint three times a year, and whenever necessity demands, to hear the confessions of the said nuns: We further grant to the aforesaid Bishop the power, if he should judge it expedient, to appoint any other priest, whether regular even of another institute and of the Latin rite, or even secular of the same rite, as an extraordinary confessor for the said nuns.

54 § 25. We decree that no other rule is to be observed by the aforesaid nuns than the genuine rule of St. Basil, which We indicated above is to be given to the monks. If indeed both the aforesaid monks and the nuns just mentioned should wish to add to this rule certain particular Constitutions, which neither oppose the observance of the same rule nor are contrary to the Greek rites, they shall be bound to exhibit them to the Congregation of the Propagation of the Faith first to be examined and, if necessary, corrected, and to be confirmed by Us with apostolic authority.

63 Praeceptum de observandis praemissis decretis.

64 § 26. In all these decrees, venerable brethren, which We have judged should be established, promulgated and announced to you after previous mature examination, as We have said above, and having heard the counsel of our venerable brethren the Cardinals of the Holy Roman Church and other men of outstanding integrity and learning, We do not doubt in the least that you will recognize that nothing else has been proposed to Us than that both the venerable rites and customs of the Greek Church should persist in their vigor, and that the obedience due to you from the peoples, and your authority and jurisdiction over them, should be preserved intact and secure. Both of these proceed from one and the same equability of mind and judgment; by which, weighing the various institutions and customs of churches with just estimation, We have this one thing alone as our desire, which is altogether necessary for the salvation of souls, namely that all who are everywhere counted by the Catholic name should be held together by the single bond of faith and unity: and, interposing the supreme authority of this Holy See, by which it excels others by divine institution, solely for the promotion of the utility of all churches, We wish that henceforth all your rights and privileges and the free exercise of your jurisdiction for governing the sheep committed to your faith, and directing them through the paths of God's commandments to the goal of eternal salvation, with the help of divine grace, shall remain unimpaired. Hence it is that We are confident that decrees of this kind ought to be received by you and embraced with due devotion and observance. And nevertheless by Our authority We command and enjoin you that you observe all and each of these things, and that you take care that they be carried out and most exactly observed by others to whom it pertains. And We impart Our apostolic blessing to your fraternities from Our heart.

65 Given at Rome, at St. Mary Major, under the Fisherman's Ring, on 24 December 1643, in the fourth year of Our pontificate.

24 § 11. BENEDETTO PP. XIV.

1 Venerabili fratelli, salute e benedizione apostolica.
