Dudum ad Apostolatus

Bolla sulla riforma dell'Ordine francescano

Bolla di papa Clemente V ·

1 atque interim ab obedientia ministri generalis eximit. 7 1310, aprilis 14, Avinioni.

6 10 O piuttosto: dilectum filium nostrum.

7 11 Cognom. A nessuno etc.

Cuius textum cl. Ehrle ex codice Basileen. tomo iu periodici dicti « Archiv fur Litteratur - und Kirchengeschichte des Mittelalters » p. 51-89 accurate descripsit. Id responsum fons uberrimus plurimarum utrimque accusationum evasit. Consiliarios vero ministri generalis, qui a data huius bullae usque ad initium concilii Viennensis (mense oct. a. 1311, v. infra n. 173) in hac controversia et praecipue in defendendo Communitatem a responsis Spiritualium a Clem. V vocatorum consiliis dicti fr.

7 11 Cognom. « Ruffati > seu « Arruffati », nepotem Clem. V, ab eo m. dec. 1305 in ss. 1 and meanwhile exempts him from obedience to the Minister General. 7 1310, 14 April, Avignon.
To our beloved sons .. the Minister General and the other brothers, both prelates and subjects of the Order of Minors, present and future.

2 It was frequently and in secret brought to the notice of our apostolic office, and finally in consistories both secret 1 and public, it was more frequently intimated to the ears of ourselves and our brothers, that there were certain matters to be corrected in your order, 2 which absolutely required the mature and swift file and correction of the apostolic see, since they remained entirely uncorrected through the prelates of that order itself, although they had been solemnly and frequently requested on this matter multiple times. But when we were sitting in public consistory and certain solemn persons of that same order were named by trustworthy men, persons of great and solemn authority and zeal, through whom we could be fully informed, as it was said, on these matters: lest such and so great a burden of business should hang upon our conscience, we determined to descend to inquiring into the truth of the matters proposed, and we caused the general minister of that order itself and the aforesaid persons and certain others of that order known to us, whom we believe to burn with zeal for God in the regular observance of that order, to be summoned to our presence by secret letters: 3 namely our beloved sons brothers Raymond Gaufredi, doctor of sacred theology and formerly general minister of your order, 4 Raymond of Giniaco, formerly provincial minister of the province of Aragon, William of Cornelione, custodian of Arles, Guido of Levis, Ubertino of Casale, Bartholomew Sicardi then diffinitor of the province for the general chapter, William of Agantico, lector at Béziers, Peter Raymond of Cornelione, Peter Malodii, lectors, together with certain other companions of the same. And afterwards we secretly inquired the truth from the minister himself and from the aforesaid others repeatedly in succession. And since we (occupied with various and diverse matters) could not be free in our own person, as we would have wished and as the business required, by the common agreement both of your minister and your companions and also of the aforesaid persons summoned by us, we gave as auditors on that business the venerable brother Peter, bishop of Palestrina, and our beloved son brother Thomas, cardinal priest of the title of St. Sabina; but afterwards, the aforesaid bishop of Palestrina being weakened by bodily infirmity and excusing himself, in that he was not able to attend to the said business, we adjoined as auditors in the said business the venerable brother Berengarius, bishop of Tusculum, and our beloved sons William, cardinal priest of the title of St. Potentiana. — But because the said business had not yet reached its end, we feared the persecutions which were being undergone on this account. This indeed befell at the beginning of the fourteenth century those namely called Spirituals, who dwelt in the convents of Narbonne, Béziers, Carcassonne within the bounds of Provence. On these matters Clement V was informed, both through letters of Charles II king of Sicily (of 5 May 1309) written by the counsel of Arnold of Villanova his physician, and through petitions which the citizens of Narbonne gave to him on behalf of the Spirituals on 18 August 1309. The Supreme Pontiff calls to himself the Spirituals named in our bull and proposes these four things to them: 1. that among the Spirituals there appeared the error of those which is called the "spirit of liberty"; 2. that the state of the order (Min.) had collapsed from the observance of the rule and the declaration ("Exiit qui seminat") of the Supreme Pontiff (Nicholas III) and from the intention and imitation of the first founder and the fathers before; 3. that certain notable grievances were unjustly being inflicted on many brothers (Spirituals by the Community); 4. that certain unsound doctrine was being imposed on the blessed memory brother Peter John (Olivi) and his books had been burned. To these accusations the Spirituals who were called there responded through Raymond Gaufredi. Clement V through brother Vital (of Furno) minister of the province of Aquitaine of the order of Friars Minor, who was afterwards promoted to cardinal of the Holy Roman Church, communicates with John (Minio of Muro Vallium, formerly general minister, then) cardinal of the Holy Roman Church and protector of the order of Friars Minor, and with Gonsalvo, minister of the order at that time. But shortly after brother Ubertino of Casale, called by the Spirituals of the Province from Tuscany to their side, wrote another response, which attacked the Community more gravely. The text of which the learned Ehrle accurately described from a Basel manuscript in volume III of the periodical called "Archiv für Litteratur- und Kirchengeschichte des Mittelalters" p. 51-89. That response became a most abundant source of very many accusations on both sides. On which matter consult the learned Ehrle 1. c. p. 89-195 and vol. II, p. 365-416. Relying on those pamphlets the Council of Vienne decreed those things which are reported below in n. 195 and n. 196. But the counselors of the general minister, whom from the date of this bull until the beginning of the Council of Vienne (in the month of October of the year 1311, see below n. 173) he used in this controversy and especially in defending the Community from the responses of the Spirituals called by Clement V, the counsels of the aforesaid brother Vital of Furno and Alexander of Alexandria, minister of the Land of Labor (afterwards general minister), Aegidius minister of France, Master Martin Alnewik the Englishman, during this council acted besides the aforesaid brothers Vital and Alexander: Alan of Tours, Richard of Conington of England, Peter of England of Upper Alemannia, Ferdinand of Castile, Romeo of Aragon, Gerard of Provence, Alexius of Bologna, Humbert of Burgundy, Thomas of Saxony, Aicard of Milan, John of Apulia ministers and Master James of Ascoli and Raymond of Fronciac, procurator general of the order, who indeed wrote the pamphlets made by the Community against the Spirituals at that time together with brother Bonagratia of Bergamo (see below n. 204).

3 4 Who died at the same time as the aforesaid Raymundus Gaufridi. 4 [Bishop] of Mirepoix (Mirepoix), who (in the year 1296 together with Peter bishop of Carcassonne and Philip of Thurey was chosen as judge to settle disputes between Roger Bernard count of Foix and John of Levi stoparch of Mirepoix) died at the same time as the aforesaid Raym. Gaufridi and Raym. of Giniaco. 8 Who after the death of the aforesaid Raym. Gaufridi became a notable standard-bearer and defender of the brothers of the "Spirituals". T Surnamed "de Capella", promoted in December 1305 from bishop of Toulouse to the titular church of St. Vitalis as presbyter cardinal and transferred in December 1306 to the bishopric of Palestrina.

4 8 Surnamed "Ioyce", of the Order of Preachers, an Englishman, promoted in the month of December 1305.

5 8 Surnamed "Fredoli", promoted in December 1305 from bishop of Béziers to the titular church of Sts. Nereus and Achilleus as presbyter cardinal and transferred in the year 1309 to the bishopric of Tusculum.

6 10 Or rather: our beloved son.

7 11 Surname "Ruffati" or "Arruffati", nephew of Clement V, promoted by him in December 1305 to the title of Sts. Cosmas and Damian and transferred in 1306 to the title of St. Potentiana or rather St. Pudentiana. came the aforesaid to us summoned, as they said, from probable conjectures that great dangers were threatening them from the prelates and subjects of the aforesaid order; and because that which was done for remedy ought not to be imputed to harm, we by the counsel and assent of our brothers do entirely exempt the brothers Raymond, William of Cornelione, Guido, Ubertino, Bartholomew, William of Agantico, Peter Raymond and Peter Malodii aforesaid from all obedience and jurisdiction of yours, son minister and prelates, and of your successors during the aforesaid matter. But because we do not intend to favor vices from the foregoing nor to close the way to regular observance, we will that, if perchance it should happen that the aforesaid brothers Raymond, William of Cornelione, Guido, Ubertino, Bartholomew and William of Agantico, Peter Raymond and Peter Malodii aforesaid or any one of them, which God forbid, should commit something dishonorable in the meantime, they and each of them be corrected by the same auditors, as shall be fitting and shall seem expedient to them. — And although some brothers of the said order constituted in diverse parts are said to think the same in the aforesaid matter or in things contingent upon it (in whole or at least in part) with the said brothers Raymond, William of Cornelione, Guido, Ubertino, Bartholomew, William of Agantico, Peter Raymond and Peter Malodii, we nevertheless do not will that the brothers thus thinking should on this account enjoy greater liberty nor be subject to greater rigor of correction, by apostolic authority decreeing that the aforesaid brothers in no way be punished or treated more severely by their prelates on account of the aforesaid matter or from other causes under pretext of the same, than if they had in no way adhered to the often-mentioned brothers as aforesaid expressly named in the same matter or what they think the same as aforesaid with them; nor shall they even be excluded from their promotions, consolations or favors of the aforesaid order or even be delayed, unless the apostolic see shall have otherwise ordained upon this. — All the foregoing things we command to be inviolably observed by all and each of the brothers of the said order in virtue of obedience and also under other penalties, which, as the perversity of the disobedient and the presumption of those acting contrary shall have demanded, we shall, with the Lord as author, inflict upon them, decreeing from then on null and void, if anything contrary to these things shall have been attempted by anyone. Wishing moreover to provide for their welfare by a subsequent salutary remedy, we by the authority of these presents more strictly forbid all and each of you both prelates and subjects and whatever officials, that you presume to defame, burden or offend the aforesaid brothers named above called to us by our authority, as aforesaid, on account of the matter of this business or its contingencies or to impede them in any way from the prosecution of this business (now or in the future); nor shall you move them from provinces or custodies or from the same consolatory places, nor deprive them of favors and licenses or other things befitting them according to their rank and accustomed to be given to them and their like in the order by prelates. But if any things contrary to these have been inflicted upon them or any one of them from causes of this kind anywhere after the beginning of this business, we revoke the same and command them to be revoked entirely. Nor shall you presume in any way to impede any one of them from any promotion or study or election to whatever state or office, if otherwise fitness should favor him. And that all things may be briefly comprehended, in all things we will and command that you have toward them in exhibiting consolations and avoiding troubles, as you would have had, if nothing whatsoever had been said or done by them concerning the aforesaid matters and their contingencies. But because from these, as aforesaid, we do not intend to favor vices nor to close the way to regular observance, if perchance, which God forbid, it should happen that any one of the brothers, who think the same in diverse parts of the order, be legitimately found in some crime, we will that, as other brothers can be corrected and punished by prelates without calumny according to the equity of justice and the institutes of the order: so however that on account of the aforesaid matter and its contingencies in no way shall anyone's fault be aggravated nor be punished or judged more severely or harshly or be inquired against by other means or precautions, than would probably have been done otherwise, if this matter had never occurred; nay rather on account of this, for reverence of the apostolic see and to avoid all suspicion, you ought to deal more mercifully with them. — To this, because greater danger might threaten the brothers expressed above for the prosecution of the aforesaid matter, lest under the color of justice anything be attempted against them in the future, we command and more strictly forbid that none of them on account of any fault past, present or future, truly or falsely imposed or to be imposed, for which he would be punishable by notable penalty, can be punished by anyone or be judicially sued for such things, unless before us or our successors or the aforesaid auditors or others to be appointed by us, we take the same under our protection and defense and exempt them from all other superiority, so that they cannot be impeded in any way in the prosecution of this business. — But that all the foregoing things may be integrally observed, you and all and each of the prelates and subjects and whatever officials of your order, who in the present or in the future shall presume to come knowingly against the foregoing under whatever occasions or colors sought, we from now decree to be subject to the sentence of excommunication, which we pronounce against all and each doing the contrary, the absolution of the same being specially reserved to us and our successors. And nevertheless, whatever shall have been attempted against the foregoing or any part of it, we decree null and void and to the brothers, against whom in the foregoing anything grave shall have been presumed on account of these causes, we grant free faculty of recourse to the aforesaid see without the license of any superior of theirs being sought or obtained. — But because we intend to terminate this business, which we bear in our heart, according to the honor of God, we will that from the brothers named above or from those adhering to them in the aforesaid four or six at the aforesaid see there remain with suitable companions, to whom we impart authority and license of the same intention with them to freely prosecute the aforesaid business, who also by the license of the aforesaid assigned auditors or any one of them, to whom they shall have recourse, can be changed and dismissed for their necessity and others be substituted for them and more be called, as the aforesaid auditors or any one of them, to whom they shall have recourse, shall see expedient for the prosecution of the said business. — And lest anyone of the aforesaid should allege ignorance in acting against the foregoing, we command through you, general minister, or the procurator of the order to the provincial ministers and through them to the other brothers the tenor of these presents to be faithfully published without any delay, and we command these letters presented to you and to one of yours to be returned whole and unharmed in virtue of holy obedience and under the aforesaid penalty of excommunication without delay to the aforesaid brothers, in whose security the aforesaid provision of ours was issued, and to be preserved with them, as shall seem expedient. Notwithstanding etc. To no one etc. Given at Avignon, on the 14th day of May, in the fifth year of our pontificate.

The matter was chiefly about poverty, so that finally two parties came to exist. One of them, and the larger in number, was called the "Community," the other obtained the name of the "Spirituals." For those (whether supported or not by the permission of the Apostolic See) indulged in ever more lenient poverty, while these increased their protests and accusations that the followers of the Community had departed from the very path of the rule. But the Spirituals themselves, who not only strove for the genuine life of the Minors, but also devoted themselves to the apocalyptic dreams of Joachim, Abbot of Fiore, were accused of heresy by the Community and faced grave
