Instruction on the Rite of the Copts

Instruction of Pope Benedict XIV ·

Egypt, and the other Missionaries of that Mission.
CAP. XIV.

1 POPE BENEDICT XIV, to the Patriarchs, Archbishops, Bishops, and other Clergy and Missionaries in Egypt and the other Missions of that Mission. Health and Apostolic Benediction. In the year of restored salvation one thousand seven hundred and forty-five, in the fifth year moreover of Our Pontificate, both that We might fulfill the duties of Our Apostolic ministry, and also that We might offer a splendid token of the paternal affection of Our mind, and of the love with which We have always embraced, do embrace, and shall always embrace the renowned Coptic Nation, having heard the opinions of grave and prudent men, with Our own labors also and private study joined thereto, We issued a Pastoral Instruction upon certain matters concerning which there was doubt, suited to their rites and customs. § 4. These indeed, which were committed to the press and inserted in Our Bullarium, concerned the Rite of the Copts, by which the Sacrament of Confirmation is conferred by a simple Priest immediately after Baptism; there is treated also of the custom and practice of the same in conferring the Order of Deacon upon children still existing in infancy. Concerning which matters those things which were consonant and opportune were established; yet some matters remained undefined, because before an answer from Us concerning them seemed necessary, it appeared fitting to inquire into several things which were not sufficiently known and ascertained, as may be seen in that same Instruction. Meanwhile We did not omit to apply all care and diligence, that We might obtain knowledge of those things which still were lacking. Then, having collected together such information as seemed necessary, so far as it could be done, on the 12th day of March of the current year 1750, We commanded certain Cardinals of the Holy Roman Church, others Masters in the Faculty of Sacred Theology, and others skilled in Canon Law, to be gathered before Us, after all things had been examined and weighed beforehand by Us. In this Congregation moreover, the doubts which were proposed were divided into two Classes: one of them was those to which no answer could yet be given; the other truly was those to which an answer could then be given, and which seemed opportune to be decided.

2 § 2. Among the doubts which remained undefined in Our Pastoral Instruction of the First Year issued in the year 1745.

3 were.

4 are treated.

5 Doubts then left in suspense.

6 Of these some could not yet be defined.

7 4745, one matter was: Whether there is any hope that some Bishop might return to sincere unity with the Catholic Church. The other, truly: Whether and how the abuse of conferring Orders before the legitimate time might be removed and rooted out, and the observance of the age of those to be ordained according to the decrees of the Council of Trent, which in a similar case, for the protection of the Catholic Faith and the increase of ecclesiastical discipline, Gregory XIII greatly commended to the Patriarch of the Maronites. These two doubts, however, were placed in the aforesaid last Congregation in their class, since from those things which have most recently been reported to Us, no near hope shines forth that any of the Bishops of the same Nation, having abjured, might return to the bosom of the Catholic Church. In the matter of the Minister and in what manner it was left in the aforesaid Instruction mentioned above, there is found that: Whether, with things remaining in the state in which they are today, it would be expedient to grant to one or more Presbyters an extraordinary faculty; to whom or to which the said faculty might be delegated by title, so that they might be anointed chiefly with Sacred Chrism those born of Catholic Parents after heresy abjured, and washed in Sacred Baptism at least by a Latin Priest. And also that: Whether in the case of the granting of such a faculty, it would be expedient to admonish Priests not to abuse it by administering Confirmation to infants immediately after Baptism (unless in case of necessity), but only at that age in which the one to be confirmed might be able to perceive the virtue of the Sacrament with his mind. These last two doubts, however, were placed in the class of those to which a response could not yet be given. Finally, the Prefect of the same might have the extraordinary faculty of conferring with Chrism, however, blessed by the Bishop, the Sacrament of Confirmation to those who have received Baptism from Latin Priests. Let the Prefect, however, beware of administering this Sacrament to those (to be confirmed) unless perhaps danger of death were imminent, lest, as the disease worsens, they depart without this Sacrament. Finally, His Holiness understands that the faculty is to be granted only so long as necessity demands it. § 3. Similarly, among the doubts which were placed in the last Congregation in the class of those to which a response could not yet be given, there is that concerning the administration of the Sacrament of Confirmation. § 4. And so, their examination having been undertaken, by the counsel and opinions of the Prefects and the Congregators, a Decree was made in this manner: The Most Holy Father judged it fitting to delegate to the Prefect of the Missions of Egypt the faculty of conferring, who has not yet reached the seventh year of age; namely, until such time as some Catholic Bishop might be had in Egypt. § 5. This Decree is also confirmed by Us in the present: since in all things and throughout it is fitting and consonant both with those things which had been set forth in Our preceding Instruction of the year 1745, as far as concerns the first; and also with those things which have been treated at length by Us in Our Work on the Diocesan Synod printed in the Year 1748, where in c. 7 it was treated of the custom of Greek Presbyters of imparting the Sacrament of Confirmation immediately after Baptism and of the Bishop, who is the ordinary Minister of this Sacrament; and in c. 8 of the necessity which a Latin Priest has, if he be constituted by the Supreme Pontiff Minister extraordinary of the Sacrament of Confirmation, of using Chrism blessed by the Bishop; and in c. 9 concerning the tolerance which the Apostolic See proffers, and in which regions of the Greeks the custom might have place, by which their Priests confer the Sacrament of Confirmation upon the Faithful immediately upon being washed in the Sacred Laver; so that nothing else need be added here except that the same faculty which was given to the Guardian of the Holy Sepulchre be granted by Us to the Prefect of the Missions of Egypt, who by the beneficence and grace of the Apostolic See, during his Office, where Latin Bishops residing in their Dioceses are not present, confers the Sacrament of Confirmation in the Places of the Holy Land; namely, the faculty of conferring this Sacrament with Oil and Chrism, even ancient, if new cannot be obtained, blessed by a Catholic Prelate having the grace and communion of the Apostolic See: just as anyone may read in Our Constitution, which is the tenth in the first Volume of Our Bullarium: For although, according to those things which are prescribed in the Roman Pontifical, the Sacred Chrism ought to be renewed each year on the fifth Feria in Coena Domini, nor is it permitted to use Chrism consecrated in the preceding year; this, however, does not hold if either Chrism cannot be received except from a Bishop who is separated from the communion of the Apostolic See, or also if some Bishop be present living in communion with the Catholic Church, yet there be such a distance of places or some other impediment intervene, so that new Chrism cannot be received from him; then indeed it is held to be permitted to use old Chrism blessed by a Bishop having the grace and communion of the Apostolic See, so long as the entire matter is exposed; concerning the foundations of this faculty, by reference.

8 It is declared that the Prefect is able to use a Chrism that is old, even an ancient one, if he is unable to have a new one blessed by a Catholic Bishop.

9 Concerning the age of those to be confirmed, rules are set forth.

10 Concerning the celibacy of those who have been promoted to the Diaconate as children, and in that state as adults and celibates minister.

11 It is decreed, through these before the year of age sixteen.

12 completed, no one is held to have had a valid Ordination.

13 An example, from Religious Profession, which is either express or tacit.

14 Catholic Bishop in preceding years blessed, just as by Us it has been extensively demonstrated in Our Notification 44. Tom. 4, Bonon. edit. when in that City dwelling Archbishops we were performing the office.

15 § 6. Now as to what pertains to the age at which the Sacrament of Confirmation ought to be given, or is permitted to be conferred even upon those who are not yet by age capable of properly and well perceiving the force and value of the Sacrament, that which has been answered agrees most fully with those things which by Us have been collected and extensively set forth in the aforesaid Our Treatise on the Diocesan Synod, l. 7. c. 40.

16 § 7. Proceeding with the examination of doubts, which have been placed in that Class of those to which an answer could then be given, that which follows in order succeeds: Whether, if Deacons ordained in childhood minister as adults in the Order received, and in the state of celibacy, it can be held that they had a valid Ordination before marriage; since it has been ascertained on the testimony of P. Benart, that they from boyhood become accustomed to ecclesiastical functions, and are ordained in great numbers, lest at some time there be lacking those who devote themselves to the ministries of the Church. Since therefore it pleased us to undertake the examination of the prescribed Doubt, after a vote has been cast by each of the Congregated members, a Decree was pronounced by Us in these words: Deacons ordained in childhood, although they ministered before the sixteenth year of age in the Order received, and in the state of celibacy, are nevertheless not held to have had a valid Ordination before marriage, for the reason that the acts which they performed in childhood or before the sixteenth year of age do nothing. This Decree is now likewise confirmed by Us.

17 § 8. But in order that those things which have been decreed may be understood more fully, it is necessary to digress somewhat; for by proceeding in this manner, the way will be prepared so that we may arrive at the proposed end. § 9. No one is ignorant that Religious Profession is made in two ways; or, to speak more accurately, Religious Profession is twofold, one express, the other tacit. Express profession is made when, with the proper solemnities observed, the three vows of Chastity, Poverty, and Obedience are emitted in conceived words, which are prescribed in the Constitutions of the Order in which someone professes he wishes to live. Tacit profession, however, is placed in this, when someone exercises and performs those things from which it is argued that he wished to bind himself to living in some Religion, even if he had not professed it solemnly and expressly. § 10. Tacit Profession was not abolished by the Sacred Council of Trent according to the more common opinion, as Navarrus Consil. 35, de Regul. num. 5, Azorius Insti. part. 1. lib. 12. cap. 4. equ. 6, Sanch. de Matrim. lib. 7. disp. 37. n. 2, Fagnanus in cap. Perlatum de tis, quae vi etc. num. 46 extensively testify. But since in the same Council it was decreed that all Professions which are made in any Religion before the sixteenth year of age of the one professing, and before a full year of probation has been completed, are null and void; hence it is rightly deduced that, even if tacit Profession was not abolished by the Council, it nevertheless has no place if the acts from which it is induced have not been performed after the sixteenth year of age of the one professing, and after the year of probation has been completed; so that by the Council of Trent the disposition has been in great part moderated: Cap. Is, which concerns Regulars, in sexto, and Clementina 2. in the same Title, concerning Regulars.

18 § 44. Following the manner of a Conciliar Disposition established by Us, it has been constituted that Deacons of the Copts ordained in infancy, when they shall have reached the sixteenth year of their age, are to be questioned by the Prefect of Missions whether they wish or do not wish to persevere in the Order undertaken and to fulfill all the obligations annexed to the Order, so that it may thereby be determined what in the future in the remainder of their life is to be observed by them. Just as anyone can see in the frequently praised Instruction of Ours of the year 1745. Therefore, just as it has been established by the Council at the age of the sixteenth year for the emission of a Regular Profession, tacit profession does not take place, even if before the aforesaid age those acts are performed from which, according to Canonical dispositions, tacit profession is understood to be induced, but all those acts are held to be of no account and as nothing for inducing a Regular Profession, unless they shall have been completed after the sixteenth year of age, and after a year of probation has elapsed and an express Profession has not been emitted; so it has been constituted by Us at the sixteenth year of age, when, as has been said, the Prefect of Missions ought to question the Deacons ordained in childhood whether they wish or do not wish to persevere in the Order undertaken and to satisfy the obligations conjoined to the Order from the exercise of the Order performed before the sixteenth year of their age, no tacit ratification—Established by the Council of Trent at the age of sixteen years for validly emitting an express Profession, acts by which tacit profession is induced, performed before that age, are reputed as nothing.

19 Since therefore the aforesaid Deacons, from the prior Decrees, are to be questioned at the same age whether they wish to persevere in the Order and to undergo its burdens.

20 It follows that through acts previously exercised, they are not to be considered as having validly obliged themselves either to perseverance or to the burdens annexed to the Order, except for Dispensations, as it happens concerning Matrimonies contracted in the Order, the faculty of granting which is reserved to the Apostolic See, a renewal of consent is required. It must be argued from prohibition: since at most such acts can import a tacit ratification, if they shall have been performed after the sixteenth year, in which case the Prefects of Missions at the sixteenth year of their age ought to question them, and it has been frequently impressed upon them that this ought to be done by him, if he shall have neglected it.

21 § 12. There remains the ultimate matter from those which We said could be defined in Our Response; that matter is of this kind: Whether a dispensation concerning Matrimony entered into after Sacred Orders will bring more advantage and utility, or rather scandal and detriment to the Catholic cause, having weighed on both sides all the reasons and moments of circumstances. The custom of the Eastern Church having been premised in the preceding Instruction of retaining a wife with the Sacred Order, which however shall have been accepted before the reception of the Order, and the controversy also having been indicated whether Matrimony entered into by Orientals after the Sacred Order is null, or rather merely illicit; a transition was made to another question: whether it would seem right, properly done, and useful, or rather could be a scandal, to dispense someone who has taken a wife after the Sacred Order, so that he might retain her and at the same time perform the Sacred Order and exercise sacred ministries, because such dispensations have sometimes been granted by the Apostolic See; But since those things which seemed necessary for defining the question were not sufficiently known or examined, it pleased Us to defer the matter and meanwhile to inquire what was necessary, so that We might be more fully instructed concerning the whole matter. When, however, those things which We were awaiting had been reported to Our inquiry, having heard the votes of the Congregated Fathers, We were of the opinion that to no one should the faculty of dispensing be granted, but it should be reserved to the Apostolic See; so that, when the case shall have occurred and a dispensation is sought, those things which are necessary to be considered may be maturely weighed, so that the dispensation may either be granted or denied, since a most grave matter and one of great moment is at stake. The Decree, however, was framed in these words: Let them have recourse to the Apostolic See in particular cases in which, if on account of grave causes a Dispensation concerning Matrimony entered into after Sacred Orders should seem to be granted, then let no word be made of a renewal of consent.

22 §43. It is not unknown how great a difficulty arises whenever a dispensation is granted for Matrimony from a diriment impediment with the customary condition that consent be renewed between the spouses: since it can happen, and has sometimes occurred, that a woman not content with her husband, or a husband loathing his wife, in order to vindicate themselves into freedom, one or both of them refuse to give new consent. In the Decree just related, it was not Our intention to exclude the renewal of consent, since the Matrimony is beyond doubt null; but, since that grave controversy, as has been said, still lives on; whether Matrimony in the Eastern Church after the Sacred Order contracted be null in the same way as in the Western Church, or whether this controversy (excepting the Italo-Greeks, whose Matrimonies entered into after Sacred Order have been established to be null and void, as in Our Constitution which begins: Etsi Pastoralis § 7, no. 28: which is the fifty-seventh in the order of Our Bullarium Vol. I.) has been defined by Apostolic authority, although the Tribunals of this venerable City adhere to the opinion of those who consider these Matrimonies null; nevertheless it seemed more prudent that, when the case of granting a dispensation should arise, the condition of renewal of consent should not be expressed. The Decree, however, of which we treat, this also by Us solemnly

23 §14. These indeed are the things which have been established by Us, and which for the right discipline of the Copts and for directing their customs We have deemed it opportune to insert into this Our second Instruction. Hence that illustrious nation, which also in ancient times enjoyed its union with the Apostolic See, which is the center of faith, We embrace in the Lord; and to it, meanwhile, as a pledge of Our charity, We impart the Apostolic Blessing.

24 Given from the Castle of Gandolfo on 19 June 1750, in the second year of Our Pontificate.

CAP. XIV.

1 PAPA XIV,

3 emanata.

4 rimangono.

5 Dubbi allora lasciati sospesi.

5. Azorio Insti. part. 1. lib. 12. cap. 4. num. 6. Sanchez de Matrim. lib. 7. disp. 37. n. 2. Fagnano in cap. Perlatum de iis, quae vi etc. num. 46.
