Brief on the election of the Roman Pontiff
Pius, Bishop, Servant of the Servants of God. For perpetual remembrance of the matter.
1 Taking thought lest after Our death the Church, in so great a crisis of the times, should be without its Visible Head for a longer period, in the year 1871 on the eighth day before the Kalends of September We issued the Constitution In ac sublimi, by which We made the path of election more expeditious. And since certain matters required clearer explanation, and others were to be added, We perfected this in the year 1874 by the Constitution Zzce£ per Apostolicas, on the sixth day of the Ides of September, both which Constitutions We now also confirm and wish to remain in their full force. But since the condition of the Church becomes daily more perplexed, and is always beset by new snares, We have deemed it expedient to add other matters, and to set forth more clearly certain things already constituted. Wherefore, as in the preceding Constitutions, having earnestly implored heavenly light and sought the counsel of certain Cardinals of the Holy Roman Church, and having weighed the matter with mature examination, We have deliberated to issue these new Apostolic Letters, by which We might embrace the former matters and exhibit those things which We have judged should be added or declared; so that all things may be able to be held under one view.
2 In the former Constitution, having reviewed the causes to be observed and commemorated and confirmed the exclusive right of the Sacred College of Cardinals of the Holy Roman Church alone to elect the Roman Pontiff, excluding and removing any intervention of lay power of whatever grade and condition, to prevent any impediments to the election, by Our own motion and certain knowledge and from the fullness of Our Apostolic power, We have derogated from 115 rules, which by Apostolic Constitutions of the Roman Pontiffs, even in general Councils issued, and by other sanctions whatsoever have been decreed concerning the time and place of conducting the election and concerning the Conclave and its closure, and therefore We have absolved all Cardinals from the bond of the oath by which they promise to observe the aforesaid Constitutions of Our Predecessors, for the election itself, and have declared them to be absolved, not only in the aforesaid prescriptions of those Constitutions regarding the time and place of the Assemblies and the Conclave and its closure, but also in other ceremonies and solemnities of lesser moment, where the observance of these might delay the outcome of the matter. But explaining these things more clearly in the other Constitution We add that although the Cardinals should think it expedient to defer the election even after the ninth day, even in this case the same faculty has been given to them to relax or moderate the laws which pertain to the closure of the Conclave. And We grant to the same Cardinals the faculty all the more of not observing the customary ceremonies and prescriptions, and of making new dispositions concerning the same, especially concerning the custody of the Conclave, or of the place appointed for the election, concerning the provision of things pertaining to sustenance, the quality, endowments and number of persons to be admitted in the aforesaid place, not exceeding the customary number however, and concerning emoluments either to be abolished or moderated, and other such matters. But having regard to the circumstances of the times, We have moreover derogated by name from the Constitution of Gregory X in the Council of Lyons, which begins Ubi periculum, in that part which grants to the Lords and other Rectors and Officials of the city in which the election of the Roman Pontiff is to be celebrated, authority and power to cause the prescriptions given for the aforesaid election to be observed. In like manner We have derogated from the Constitution of Clement V in the Council of Vienne, which begins Ae Roman?, in that part which grants some power to the executors appointed in the aforesaid Constitution of Gregory X. We have finally derogated from the Constitution In Eligendis of Pius IV in that it designates executors, Prelates, Rectors, Officials of the City and others chosen for the custody of the Conclave; and for the effect of all these We have absolved each of the Cardinals from the bond of the oath taken to observe the Constitutions of the Roman Pontiff concerning the election.
3 We have moreover decreed in the former Constitution "that the Cardinals of the Holy Roman Church, who shall be present in the Curia at the next vacancy of the Apostolic See, shall immediately come to Us on the supreme day, even if exequies have not yet been celebrated in suffrage for Our soul, and other Cardinals also as Legates of the Lateran, or absent for any other cause whatsoever, even with permission, or by Our mandate, not awaiting the prescribed space of ten days, shall immediately, the circumstances of the affairs and times of this City being seriously weighed, deliberate whether the assembly for the election of a new Pontiff shall be held in the same City or outside Italy. And We have decreed that the deliberation, whatever it may be, ought to have full effect, into which the greater part of the Cardinals then present shall have consented." Indeed, being favorable to the celerity of the election of the future Pontiff, acting concerning the general Congregation to be held after Our death, of which below, We have also added that "it shall be permitted that the Cardinals, if present, perfect the election of a new Pontiff in the very first assembly." Which however We wish to be understood thus, that, as We shall presently explain more distinctly, the number of those present shall exceed by at least one half the Cardinals then living, and all things which We decree ought to be observed shall be altogether observed. Finally, to remove every cause of delay, and to prevent the dangers of disturbance, We prescribe in the other Constitution that the exequies "the customary apparatus brought in by Constitutions, Ordinances, and Custom shall be omitted; and that they be conducted by the College of Cardinals in modest rite and form in the Chapel of the Vatican Palace, if the Pontiff shall be able to close his last day 101 there."
4 Considering indeed the nature, vicissitudes and dangers of the present times, which are most evident to all, we cannot but earnestly desire that the place where the election is to be held be designated outside the borders of Italy. And while we openly declare this desire of Ours, we also most earnestly commend it to the Cardinals of the Holy Roman Church. But if for reasons which we cannot foresee, they themselves should judge otherwise, and should decide that the assembly for the election is to be held here in the City, or elsewhere in Italy, we will absolutely and command that in the case of any injury whatsoever inflicted upon the Conclave as to place or persons, whether it should happen from the act of public authority or of private persons, but much more if hands should be laid upon any one of the Cardinals, or if any one of them should suffer in any way whatsoever or should be prevented from access to the Conclave, the assembly shall immediately be dissolved, and transferred to a safer seat outside Italy; and this even if the voting shall have already begun. And in designating the limits of the faculties granted, we decreed in the former Constitution: "In other matters, however, which do not hinder the swift election of the new Pontiff, which we most earnestly desire, especially in matters with a clause rendering the election otherwise made null and void, and moreover those things from which we have expressly derogated, we command that the Constitutions themselves be observed also on this occasion — And in another Constitution we say more explicitly — We declare, however, that nothing has been changed, either by the general sanction of the Canons, that nothing be changed during a vacant See, or by special Constitutions, by which it has been provided that that power and jurisdiction which belonged to the Pontiff while living shall not pass to the College of Cardinals; that the College may not in any way dispose of the rights of the Apostolic See and the Roman Church; and at the same time it is declared that the aforesaid College ought to guard and defend those rights, but in no way can diminish them. Although, however, we trust in the Lord, having perceived the religion and faith of those same Cardinals, that neither the College nor any one of them will fail in this office, to which they are bound also by solemn oath, yet according to the duty of our office, we admonish all and each of the Cardinals, and by admonishing command them, that they adhere to canonical rules and neither directly attempt to detract anything from the rights of the Apostolic See and the Roman Church, nor indirectly, through the appearance of connivance, namely, or through dissimulation of crimes perpetrated against those rights, appear to attempt it". Considering also that it is possible that we might die outside the City, we have mandated in the former Constitution what we now confirm: "But so that the Cardinals may more easily assemble, we will that in the aforesaid case: from that place outside the Curia where almighty and most merciful God shall will us to depart from this life, whatever Cardinal is present, or if there be more, the more dignified of them, or, if all are absent, the Apostolic Nuncio, and in his default, the Ordinary of the place, or a Prelate, or any other person distinguished by ecclesiastical dignity (to whom indeed we shall take care to make known this command of Ours beforehand, God willing) shall as quickly as possible inform the Dean of the Sacred College of Cardinals and the other Cardinals, of whose see he is informed, of the death of the Pontiff, so that they may immediately prepare themselves to carry out the assembly. But the Dean Cardinal, or if he be hindered, another Cardinal of greater dignity, as soon as he shall have received such a message, or in any other way shall certainly know of the vacancy of the Apostolic See, together with three senior Cardinals from each Order, and with the Cardinal Camerlengo of the Holy Roman Church, if they shall be together at the same time, or, if they be absent, with such other Cardinals as there may be, or finally he himself alone, if the rest be entirely absent, shall choose that place of whatever region which to them, or to him shall seem more opportune for holding the assembly. Hence, with no delay interposed, the same Dean Cardinal, or if he be hindered, another Cardinal, as above, shall signify to the other Cardinals the vacancy of the Apostolic See and shall call them to the election of the new Pontiff, and shall inform them of the place in which it was decided that it should be carried out. But to all the Cardinals we command and mandate in virtue of holy obedience, that unless they be detained by legitimate impediment, they ought to obey the letters of convocation and immediately betake themselves to the place designated to them for completing the election of the Pontiff. Moreover, in whatever other place rightly predetermined the Cardinals shall have assembled, as we have above decreed and determined, the election of the new Pontiff shall altogether be held to be legitimate, canonical and valid, provided that in that place so many Cardinals shall have been gathered together as exceed by one half the Cardinals then living, and that they shall have fulfilled those things which are required for effecting a valid election, excepting those things from which we have expressly derogated. But whatever we have above decreed by these letters for the former case to accelerate or to make easier the election of our Successor, we extend to this second case; and so all and each of those things which in the former part of these letters we have indulged, commanded, commended, we will to be held in the same manner, and we declare, as if for this second case also they had been specially indulged, commanded and commended."
5 Wishing indeed to remove the difficulties which might still subsist after the election of Our Successor, We added: "Finally, although We are raised to good hope that Our Successor will enjoy better times, and will sit long in this supreme Chair of Peter; yet that We may also provide, which God forbid, for the contrary event, by Our own motion and from the fullness of Apostolic Authority, We extend all things which in these Letters are sanctioned and established for either case to the first conclave to be held after Our death, and in like manner We decree them for another election to be carried out after the death of Our Successor, if namely Our Successor should die without any new law having been issued by Us concerning these matters.".
6 And in the other Constitution We said: "The faculties which We have granted to the College of Cardinals through these and Our previous Letters, We will that they exercise their force in the manner and form stated therein, not only for the immediately forthcoming election of the Pontiff, but also for the next following one, unless they shall have been revoked by Us or by Our Successor." Concerning the manner of election itself, innovating nothing as to the number of votes, We decreed in the former Constitution: "Therefore, in place of the Councils, the Cardinals of the Holy Roman Church may carry out the election of a new Pontiff, whether in the Curia itself or outside it, by secret ballot, with two-thirds of the Cardinals present consenting to the same person in the scrutiny or scrutiny and access, or by compromise, or as it were by inspiration, observing in these matters the customary necessary form.... He therefore, who by the Cardinals, as above, present, in the manner which We have established, is duly elected in Our place, shall be altogether a legitimate and true Pontiff, the Vicar of Christ, and the Successor of Blessed Peter, and as such ought to be recognized and held by the whole Church."
7 Pontiff of Rome. 453 Commending Our soul to God and to the Mother of God, We added: "Our Venerable Brethren, the Cardinals of the Holy Roman Church, who shall survive Us when We are called from this wretched life to the eternal peace which We hope for, We most earnestly beseech and implore through the bowels of the mercy of Jesus Christ, that, setting aside all human consideration and looking only to the glory of God, with most harmonious minds and will they apply themselves most diligently to this one care, lest the barque of Peter, tossed by so many and such great tempests, be longer without its Helmsman, and the flock of the Lord be deprived of its Shepherd by so many wolves rushing in from all sides; having this purpose before them, that from the best and speedy election of the Supreme Pontiff depend both the tranquility of the Church and the salvation of the faithful people, especially in these most difficult and harsh times, and that they themselves are to be punished by the most severe judgment of God, if through their fault and negligence it should come to pass that in such a critical state of affairs this Apostolic See should be vacant for a longer time than is fitting." Treating again of this most grave matter in the other Constitution We said: "While indeed We permit the material enclosure of the Conclave, or place of election, to be relaxed for more expeditiously reaching the proposed end, We do not relax in any way the obligation of keeping secret in all things which pertain to the election of the Roman Pontiff, and in those things which are done in the Conclave, or place of election. Therefore in the same manner and form and under the penalties imposed by the Constitutions of Our Predecessors We again command and order that that secret be most carefully kept, and be caused to be kept by others, and indeed the more carefully and strictly, the more grave the difficulty of the times shows itself to be. But first of all We admonish and earnestly beseech in the Lord the Cardinals, that they proceed to the election moved by no inclination of mind or aversion, inclined to no one's favor or service, not moved by the intercession of the powerful in the world, but with eyes fixed solely on the glory of God and the utility of the Church, they strive to elect more quickly him whom they shall judge to be worthy above all others and a diligent Shepherd of the whole flock of Christ." Finally, concerning the sense and interpretation of Our Constitutions, after We explained the derogations made by Us, and recalled which things had not been derogated, We said in the former Constitution: "If any doubts should arise in this matter, or concerning any other chapter of this Constitution of Ours, We grant to the Cardinals themselves full faculty by which they may interpret Our Constitution and declare those doubts. In which matter, as in the rest concerning which it may fall to deliberate according to the course of this Constitution of Ours regarding the business of election (excepting namely the election act itself), it will be altogether sufficient if the greater part of the Cardinals gathered as above consent to the same opinion." In the other Constitution however We decreed: "It is the sole right of the College of Cardinals, or its greater part, and not of others, to judge concerning the necessity and opportuneness of the case of all or some only of the faculties granted by Us."
8 454 Pontiff of Rome.
9 tuniteness of the case of all or some only of the faculties granted by Us."
10 Regarding the promulgation of these same Constitutions, in the earlier one We said: "We command that these Apostolic Letters, witnesses of Our will, on the very day of Our death, if time permits and grave difficulties do not stand in the way, be read in their entirety in a particular Congregation of Cardinals of any Order and rank, and then their reading, even if it has been made, be entirely repeated before the other Cardinals present in that place in the first general Congregation, whether ordinary or extraordinary to be convened. To which Cardinals indeed, according to what We have established in these letters, it shall be free, observing what We command to be observed, to complete the election of a new Pontiff either in the very first assembly." In the other Constitution We said: "What We commanded to be done regarding Our preceding Constitution of the Year 1871, the same We also prescribe for this one, namely that it be read beforehand in the particular, then in the general Congregation of Cardinals, to whom it shall be the right to interpret and explain whatever doubt may arise in the execution of either Constitution."
11 cum illa in particulari, deinde in generali Cardinalium Congregatione, quibus jus erit interpretandi ac explicandi quidquid dubii occurrere valeat in utriusque Constitutionis executione.
12 Now what We have commanded regarding the promulgation of the preceding Constitutions We extend to this one in the same manner, yet so that the General Congregation be held immediately after Our death in the Apostolic Palace of the Vatican, and there the promulgation of the three Constitutions take place, with the reading of the same also omitted in the particular Congregation of Cardinals of any Order and rank.
13 [19] Moreover, what We have commanded regarding those Constitutions, the same We decree regarding the present Constitution, and in the same words, for indeed "We confirm the same Letters and all faculties granted therein from the fullness of Our power," except only those which in the present Constitution have been neither sanctioned nor mentioned, "and likewise all derogations of Apostolic Constitutions in the manner and form expressed therein, and at the same time We forbid that doubts be raised concerning their force and efficacy, whether because the public order does not appear to be disturbed during the time of the vacancy of the Apostolic See, or because dangers are thought to be absent, or for any other pretext whatsoever; for We will that they remain in their strength, and obtain their full effect, until they shall have been revoked by Us."
14 [20] These things therefore, having gravely considered the perils of Our times and the whole matter at issue, and being moved also by the examples of Our Predecessors Pius VI, Pius VII, and Gregory XVI, We establish, prescribe, grant, decreeing that these present Letters and whatever is contained in them, even from the fact that anyone in the foregoing matters has had or pretended to have interest, and has in no way consented to them or been called to or heard regarding them, or from any other causes whatsoever, can in no way be impugned, but that the same shall always and perpetually be firm, valid and efficacious, and shall obtain and secure their full and complete effects, and shall avail those to whom it pertains and shall pertain in time, and ought to be respectively and inviolably observed by them, and shall be null and void if anything contrary to these things shall happen to be attempted by any authority whatsoever, knowingly or unknowingly. Notwithstanding, insofar as it may be necessary, without prejudice to acquired rights, and Our other rules and those of the Apostolic Chancery, and likewise the Constitutions and Apostolic Ordinances issued regarding the election of the Roman Pontiff both by Alexander III, Gregory X, Clement V, Pius IV, Gregory XV, Clement XII, and other Roman Pontiffs Our Predecessors, and also by Us, whose tenors We have present, as fully and sufficiently and word for word inserted herein, and the same to all and each of them for the effect of the foregoing only, while those remaining in them shall remain in their value, We derogate most widely and most fully, and likewise to all others deserving individual and most special mention and derogation, and to all things contrary whatsoever. We will moreover that copies or exemplars of these present Letters, even printed, subscribed by the hand of some Apostolic Notary and furnished with a seal, shall have the same force with persons constituted in ecclesiastical dignity as these present would have if they were exhibited or shown. Let no man therefore be permitted to infringe this page of Our permission, dispensation, faculty, ordinance, decree, mandate, will, derogation, or to dare to act contrary to it. If anyone, however, shall presume to attempt this, let him know that he shall incur the indignation of Almighty God and of the Blessed Apostles Peter and Paul. Given at Rome at St. Peter's on 10 October in the Year 1877, in the thirty-second year of Our Pontificate.

Pius Episcopus Serous Servorum Dei. Ad perpetuam rei memoriam.
1 Consulturi, ne post obitum Nostrum Ecclesia, in tanto temporum discrimine, diutius suo Visibili Capite careat, Anno 1871 decimo cal.
Pari modo derogavimus Constitutioni Clementis V. in Concilio Viennensi, cui initium «Ae Roman?» in ea parte, quae aliquam potestatem concedit executoribus in praedicta Constitutione Gregorii X. deputatis.

9 tunitite casus omnium vel aliquarum dumtaxat e facultatibus a Nobis concessis».
