Brief restoring the Catholic hierarchy in the Netherlands
Pope Pius IX.
To the perpetual memory of the matter.
1 From that day when by the secret counsel of divine providence we were called to the height of the Apostolic See, mindful of our duty and reflecting upon it, we immediately, as the ministry enjoined upon us demanded, directed all our cares and efforts toward providing for the spiritual salvation and welfare of the faithful of Christ existing everywhere. And after the work of restoring the episcopal hierarchy in the most flourishing kingdom of England, already begun by our predecessor of happy memory Gregory XVI, was granted to us to complete with the blessing of the Lord, we turned our studies and solicitudes to another chosen part of the Lord's vineyard, namely to the renowned regions of Holland and Brabant, which we understood could be informed by these same salutary institutions and greatly desired it. For there was constantly before our eyes the condition of those regions from the earlier centuries of the Church; for when in the course of the seventh century the Christian religion was brought into them through the holy Clement Willibrord, a man inflamed with apostolic spirit, and the evangelical ministers chosen by him as companions, all ancient monuments testify that it bore the most abundant fruits, so that shortly after, namely in the year 696, our predecessor St. Sergius I erected the church of Utrecht, and decorated the same Willibrord, designated to govern it, with sacred insignia by his own hands. It would indeed be long to pursue and recount all those things which both the aforesaid bishop and St. Boniface, who succeeded him, deservedly called the Apostle of Germany, and the other subsequent bishops, some of whom were inscribed in the roll of saints, gloriously accomplished and to commemorate the labors expended by them for spreading the Catholic faith through the aforesaid regions until the year 1639; in which year it was found that the faith had so flourished there that our predecessor Pope Paul IV deemed an ecclesiastical province to be established in those regions and by apostolic letters beginning Superuniversas given on 8 May, enriched and declared the see of Utrecht itself with the rights and privileges of a metropolitan, 1
HIERARCHY OF HOLLAND.
2 with five suffragan churches added and erected, namely Haarlem, Deventer, Leeuwarden, Groningen and Middelburg.
3 But when from that time the hope was cherished that this beloved vineyard of the Lord, more firmly guarded and fortified with stronger defenses, would produce greater fruits day by day, it was deplorable that not long after an enemy man wished to lay it waste, overturn and deform it with every effort. And indeed it is established how great and how many damages and disasters the Calvinist heresy inflicted upon those most flourishing churches; and to such an extent did the force and assault of heretics prevail that the Catholic name in those regions was nearly extinguished, and there seemed to be scarcely any means remaining for repairing such great losses. Nevertheless it is certain that the Roman Pontiffs left nothing untried in order to meet and remedy the many evils that were pressing in as best they could. Hence, after the pastors were driven out, struck down or killed, the most illustrious Gregory XIII of blessed memory appointed to gather the remnants of the scattered flock a most approved man and one inflamed with zeal for the divine name, namely Sasbold Vosmeer, as his apostolic vicar, who afterwards, being invested by Clement VIII with the title and character of Archbishop of the Philippines, when he had obtained no small supply of sacred workers from the best institutes and regular societies, labored not without favorable success, with God's help, to restore the collapsed religion.
4 The same cares were also exercised by the successors of the Roman Pontiffs, namely Alexander VII, who, at the beginning of the Jansenist schism, vigorously opposed himself to that evil and plague, and did not cease to restrain and break its force; likewise Innocent XII, Clement XI, Benedict XIII and XIV, and all our other predecessors, gave every effort that the Catholics of Holland and Brabant, whom so cruel and atrocious a storm had reduced to extremity, whether through apostolic vicars invested with episcopal dignity or through the nuncios of the Holy See, might be raised up and restored by pastoral assistance, so that finally, through the mercy of the Lord, those churches might be recalled to their pristine glory and form.
5 "And the Father of mercies and God of all consolation has granted through the labors and cares of the Roman Pontiffs, by His kindness, the desired fruit at length, so that what they themselves intended may now be brought to completion, and for this We render the greatest thanks from Our heart to God, the giver of all good things. For indeed, although Gregory XVI of glorious memory, with the compliance of that most serene king, wisely accomplished many things and strove to restore ecclesiastical discipline completely in the aforesaid regions, and having initiated negotiations in the year 1841 concerning the restoration of the episcopal hierarchy, nevertheless, having weighed the circumstances of the times, he judged the work not then to be pressed, and having clothed with the episcopal character vicars apostolic of Brabant and others suitably constituted to prepare the way for the desired restoration, he deferred so important a matter to be determined at a more opportune time. Having therefore before Our eyes such illustrious examples of Our predecessors, and wishing to pursue with such favors as We can that beloved portion of the Lord's flock, We have proposed to Ourselves that We increase the advantages of the Catholic religion in the aforesaid kingdom as much as lies within Our power."
6 "Hence, considering the entire state of Catholic affairs in the same kingdom, its progress and the very great number of Catholics, and observing that those impediments which were greatly adverse to the safety and prosperity of the Catholic religion are being removed day by day, We trust that they have been almost entirely removed through that reform of fundamental laws introduced by the moderators of government with equity and justice, and finally, knowing well the benevolent disposition of the most serene king toward that class also of most faithful subjects who profess the Catholic faith, We have judged that the time has come when the form of ecclesiastical government in the kingdom of Holland could be restored to that mode in which the faithful enjoy it among other peoples, among whom no special cause intervened on account of which they are governed by that extraordinary office of vicars apostolic or by any exceptional ministry. Meanwhile, petitions have been presented to Us again and again by means of which not only the beloved sons of Our order, inhabitants of those regions, but also the vicars apostolic themselves and the universal clergy were requesting this very thing from Us, and Our paternal love and charity could not resist their wishes. "Wherefore, moved by these and other most grave causes, having held, as the gravity of the matter demanded, deliberation with Our Venerable Brothers, the Cardinals of the Holy Roman Church placed over the propagation of the faith, to whom We entrusted careful examination of the whole business, and who confirmed Us more and more in Our suspected counsel, having lifted Our eyes to the mountain whence comes all help from the Almighty, having implored the aid of the Mother of God the Virgin, and having obtained the intercession of the holy Apostles Peter and Paul and of the other saints of heaven who especially illuminated the Church of Holland by their blood shed for Christ, We have at length deemed it fitting to put Our hand to so salutary a work."
7 "Accordingly, by Our own motion, with certain knowledge and mature deliberation of Ours, and from the fullness of apostolic authority, for the greater glory of God Almighty and the advantage of the holy Catholic Church, We constitute and decree that in the kingdom of Holland and Brabant, according to the common rules of the Church itself, the hierarchy shall flourish again of ordinary bishops who are named from sees, which by these Our letters We erect and establish as an ecclesiastical province."
8 "Moreover, We decree that five sees are to be erected at present and We will them to be established, namely the see of Utrecht, Haarlem, 's-Hertogenbosch, Breda and Roermond. However, turning over in Our mind the illustrious monuments of the Church of Utrecht, and having perceived the particular suitability of places, and having weighed other reasons, We cannot but raise this once illustrious see, as if buried, to the dignity of a metropolitan or archiepiscopal rank, to which dignity it was indeed honored by Paul IV of most illustrious memory, Our predecessor, and to it We assign four of the aforesaid sees as suffragans, just as by the tenor of these letters and by Our apostolic authority We assign, add, and attribute them."
9 We assign to the aforesaid archiepiscopal or metropolitan see of Utrecht the provinces as follows, namely the province of Utrecht itself, from which it takes its name, as well as Groningen, Gelderland, Friesland and Drenthe, which formerly constituted the greater part of the properly so-called Dutch mission. To the suffraganean Church of Haarlem we assign other provinces or regions of Holland and Zeeland, which in like manner were called the Dutch mission and were subject to its superior or vice superior up to this time. As regards the other Churches, we will and decree that each one shall enjoy those provinces or districts or comital regions which it has hitherto enjoyed, just as the aforesaid episcopal and suffraganean churches of Boscoducensis, Breda and Roermond shall remain within those same boundaries within which each has hitherto been placed under the designation of apostolic vicariates of Bois-le-Duc, Breda and Limburg, and as is declared in the apostolic letters of the second day of June 1840 beginning Universalis Ecclesiae, and of the ninth day of March 1841 beginning Universi Dominici gregis. Thus in the whole kingdom of Holland and Belgica there shall be one single and distinct ecclesiastical province composed of one archbishop or metropolitan bishop and four suffraganean bishops, by whose zeal and pastoral solicitude we trust in the Lord that the Catholic religion there shall be strengthened more and more and flourish with better growth; and therefore we now reserve to ourselves and to our successors in the apostolic See the right to divide that province into more parts, should it be necessary, and to increase the number of dioceses, to change the boundaries, and to do freely whatever else shall seem opportune and expedient in the Lord. Moreover, what we perceive will be of great benefit to these same churches and bishops, we will and command that the aforesaid bishops continue to transmit reports on the state of their sees and their flocks to our congregation for the propagation of the faith, which has hitherto exercised particular and careful concern for these regions, and that they keep it informed through the same congregation of all those things which they understand themselves bound to announce and report for the discharge of their office and the spiritual good of the faithful. In other matters which pertain to the pastoral office, the archbishop and bishops aforementioned shall enjoy all the rights and faculties which other Catholic archbishops and bishops of other nations enjoy by virtue of the common sacred canons and apostolic constitutions, and which they can and could enjoy, and they shall be bound by the same obligations by which other archbishops and bishops are bound by the same common and general discipline of the Catholic Church. Whatever therefore, whether from the ancient arrangement of the churches of Holland or in the subsequent condition of the missions from particular constitutions or privileges or particular customs, has been in force, changed now by the nature of the times, shall henceforth produce neither right nor obligation. To remove all ambiguity, we deprive of all binding force and legal effect those same particular constitutions and privileges of every kind and customs introduced and in force from any time, however ancient and immemorial, by the fullness of apostolic authority. Therefore it shall be lawful for the archbishop and bishops of Holland to decree those things which pertain to the execution of common law and which are permitted to episcopal authority from the general discipline of the Church itself. We, moreover, by our apostolic authority willingly stand by them and promise to exert every effort to promote the glory of the divine name and the salvation of souls. To give a more certain token of this our will, we will that the bishops themselves, invested with the name and rights of ordinary bishops, shall not be deprived of those advantages and broader faculties which they formerly enjoyed together with the title of our vicars and of the apostolic See, or which other apostolic vicars enjoy from the liberality of that same holy See. We likewise will that the archbishop of Utrecht and his suffraganean bishops, or the aforesaid, in the exercise of their respective duties, shall possess full freedom and power as is fitting. The suffraganean churches themselves and their territories we subject to the jurisdiction of the metropolitan of Utrecht in such a way that we wholly exempt them from all authority and dependence on any other metropolitan or archbishop to whom perhaps those regions or some of them may have remained subject in the condition of vicariates or missions. To the archbishop of Utrecht we grant the right and power to use all the insignia, honors, ornaments, privileges and prerogatives of metropolitan bishops.
10 "And since the condition of the Catholic religion in the kingdom of Holland is still such that suitable temporal subsidies corresponding to the necessities of pastors and of the episcopal office of each Church are lacking, we cherish an almost certain hope that those beloved sons of ours, the Christ faithful, whose most urgent and repeated prayers for the restoration of the episcopal hierarchy we have willingly received and have complied with their wishes, will not cease to aid with their more generous alms and offerings the pastors whom we shall place over them, by which they may be able to provide for the restoration of episcopal sees and the prosperity of the Catholic religion, and for its increase. Finally, receiving as the author of faith and perfecter Jesus, we humbly beseech Him that those things which we have deemed necessary to be decreed and established for the good and progress of the Catholic Church in the kingdom of Holland, He may deign to strengthen and confirm with His divine aid, and may impart to all those to whom it falls to execute these decrees the virtue of heavenly grace, so that they may more earnestly fulfill the duties and offices entrusted to them for the glory of the divine name."
11 "Decreeing that these letters can never at any time be noted or impugned on the ground of subreption or of any defect of our intention whatsoever, and that they shall always be valid and firm, and must obtain their full effect in all things and be inviolably observed. Notwithstanding apostolic and synodal, provincial and universal council decrees, general or special sanctions, as well as the rights or privileges of the ancient sees of Holland and of the missions and apostolic vicariates established there afterwards, and of whatever churches and pious places, even those strengthened by oath, apostolic confirmation, or any other whatsoever firmness, and all other things contrary whatsoever. For all these, although special mention ought to be made for their derogation, or another form however exquisite be observed, insofar as they stand in the way of the aforesaid, we expressly derogate. We also decree to be null and void, if anything contrary to these should happen to be attempted by anyone whatsoever with any authority, knowingly or unknowingly. We will moreover that copies of these letters, even printed ones, subscribed by the hand of a public notary, and furnished with the seal by a man constituted in ecclesiastical dignity, shall have the same faith as would be had in our expression of will shown by this very document itself."
12 "Given at Rome at St. Peter's under the Fisherman's Ring on the fourth day of March in the year 1853. In the seventh year of our Pontificate."

« Pio papa IX.
