1 Exiit Qui Seminat

1 Exiit Qui Seminat
2 Nicolaus Episcopus servus servorum Dei.
3 Ad perpetuam rei memoriam.
4 Exiit qui seminat seminare semen suum de sinu Patris in mundum veste scilicet humanitatis indutus Dei Filius Jhesus Christus verbum evangelicum saturus in singulos probos et reprobos, insipientes et gnaros, studiosos et desides, et juxta prophetam colonus futurus in terra semen suum doctrinam evangelican sine deletu despersit in omnes, qui omnia tracturus ad se omne salvare venerat, qui tandem se ipsum Deo Patri pro salute omnium in redemptionis humane pretium immolavit. Licet tamen hoc semen in singulos communicativa Dei caritate dispersum aliud ceciderit secus viam super corda scilicet demonum suggestionibus pervia, aliud inter spinas corda scilicet divitiarum sollicitudinibus lacerata, et ideo unum pravis affectibus conculcatum, aliud aridum, quia gratia carebat humore, reliquum legitur inordinatis sollicitudinibus suffocatum, aliud tamen mite cor et docile terra bona suscepit.
Hii sunt illius sancte regule professores, que evangelico fundatur eloquio, vite Christi roboratur exemplo, fondatorum militantis Ecclesie apostolorum ejus sermonibus actibusque firmatur.
7 4. Nec nos minus attendimus, immo profundius cogitamus, sicut pensare debent subtilius ceteri catholice fidei professores, quod ipse Deus ordinem predictum et ejus observatores inspiciens sic eos ab insurgentibus in ipsos rancoribus salutari presidio preservavit, quod necipsos fluctus tempestuosus allisit nec animos in ordine ipso degentium consternavit, quin potius in vigore regulari concrescant et amplientur in suorum observantia mandatorum. Verumtamen ut ordo predictus quibuslibet precisis aufractibus distincta et pura vigeat claritate, sicut fratres ejusdem ordinis nuper in generali capitulo congregati providerant, dilectis filiis generali et nonnullis aliis provintialibus ejusdem ordinis ministris, qui in capitulo ipso convenerant, in nostra presentia constitutis, cum ad plenam observationem ejusdem regule in vigore spiritus eorum fervere noscatur intentio; visum est nobis mordacibus hujusmodi vias mordendi precludere, aliqua que in ipsa regula videri poterant dubia declarare, nonnulla per predecessores nostros etiam declarata pleniori claritate disserere, in aliquibus etiam regulam ipsam contingentibus puritati eorundem conscientie providere.
9 6. In primis quia, sicut intelleximus, ab aliquibus hesitatur an fratres ejusdem ordinis tam ad consilia quam ad precepta Evangelii teneantur, tum quia in regule predicte principio habetur: Regula et vita Minorum fratrum hec est scilicet Domini Nostri Jesu Christi sanctum Evangelium observare vivendo in obedientia, sine proprio et in castitate, tum ex eo quod in eadem regula continetur sic: finito vero anno probationis recipiantur ad obedientiam promittentes vitam istam semper et rulam observare, tum etiam quia in fine ipsius regule continentur hec verba: paupertatem et humilitatem ac sanctum Evangelium Domini nostri Jhesu Christi, quo firmiter promissimus, obervemus. Licet felicis recordat.
Let the Friars beware of transgressing this obligation even in appearances. 11.
The manner in which the Friars can have recourse to benefactors who have money. 14.
30 Of work and spiritual labors. 19.
Of preaching to the people. 20.

2 Nicholas, Bishop, servant of the servants of God.
3 For perpetual remembrance of the matter.
4 He went forth who sows to sow his seed from the bosom of the Father into the world, namely the Son of God Jesus Christ, the Word, clothed in the garment of humanity, to sow the evangelical seed in each one, both the good and the reprobate, the foolish and the wise, the diligent and the idle, and like the husbandman according to the prophet, he scattered his seed, the doctrine of the Gospel, without exception among all, he who came to draw all things to himself and to save all, who at length offered himself to God the Father as the price of human redemption for the salvation of all. Yet although this seed, dispersed by the communicative charity of God to each one, fell partly by the wayside, namely upon hearts open to the suggestions of demons, partly among thorns, namely upon hearts lacerated by the cares of riches, and therefore one trampled by wicked affections, another barren because it lacked the moisture of grace, the rest read to be suffocated by disordered cares, yet another, a meek and docile heart, received the good earth.
5 2. This is the meek and docile religion of the Friars Minor, rooted in poverty and humility through the blessed confessor of Christ, Francis, which, germinating from that true seed, scattered that germ through the rule into the sons whom he begat for himself and for God through his ministry in the observance of the Gospel. These are the sons who, as James teaches, received the eternal Word, the Son of God, implanted in human nature in the garden of the virginal womb, mighty to save souls in meekness. These are the professors of that holy rule, which is founded upon evangelical utterance, strengthened by the example of the life of Christ, confirmed by the words and deeds of the apostles of the militant Church, its founders. This is before God and the Father a pure and immaculate religion, which, descending from the Father of lights through his Son, delivered exemplarily and verbally to the Apostles, and finally inspired through the Holy Spirit to blessed Francis and those following him, contains in itself, as it were, the whole testimony of the Trinity. This is the religion to which, as Paul attests, no one henceforth ought to be troublesome, which Christ confirmed with the stigmata of his passion, wishing to mark notably the founder thereof with the signs of his passion.
6 3. But the ancient enemy has not thus ceased his cunning against the Friars Minor themselves and their rule: rather, striving against them to oversow tares, he has at times stirred up emulators agitated by envy, wrath, and indiscreet zeal, biting the brothers and tearing their rule as if illicit, unobservable, and discriminatory with canine barking, not attending to the fact that this holy rule, as aforesaid, is instituted by salutary precepts and admonitions, strengthened by apostolic observances, confirmed by the Apostolic See, commended by so many divine testimonies, which have been made credible in so many holy men acting in the observance of this rule and ending their days therein, some of whom the same See has caused to be inscribed in the catalogue of Saints from their life and miracles, and most recently, as it were in these days, approved by Gregory, Pope of pious memory, our predecessor, as was declared in the general council of Lyons from evident utility, which the universal Church derives from it.
7 4. Nor do we attend to this less, but rather think more deeply, as others professing the Catholic faith ought to consider more subtly, that God himself, looking upon the aforesaid order and its observers, has thus preserved them from the rancors rising up against them by salutary protection, that neither the tempestuous waves have dashed against them nor have the minds of those dwelling in the order itself been dismayed, but rather they grow in the vigor of the rule and increase in the observance of its commandments. Nevertheless, in order that the aforesaid order may flourish in distinct and pure clarity, free from every crooked deviation, as the brothers of the same order recently gathered in general chapter had provided, to our beloved sons the general and certain other provincial ministers of the same order, who had convened in that chapter, being constituted in our presence, since their intention is known to burn for the full observance of the same rule in the vigor of their spirit; it has seemed good to us to preclude the ways of such biting from biting, to declare certain things which could be seen as doubtful in the rule itself, to set forth with fuller clarity certain things also declared by our predecessors, and in certain matters touching the rule itself to provide for the purity of their conscience.
8 5. We, however, who from tender years have directed our affections toward that order itself, growing up in it with certain companions of that same confessor, to whom his life and conduct were known, have treated frequently through mutual discussion upon that rule and the holy intention of the blessed Francis himself; and finally, having become cardinal and afterwards governor, protector and corrector of that same order through the said See, we have felt the conditions of the aforesaid order through the care incumbent upon us; in the office of apostolate, both from the pious intention of the aforesaid confessor and from those things which contain that rule itself and its observance, from the aforesaid long experience also, we have turned our thoughts to inform those converted to the aforesaid order; and both those things which are known to have been approved and declared by those same predecessors of ours, and also the rule itself and those things pertaining to it, we have discussed with full maturity, and in the present series we have established, declared, more certainly approved, confirmed what was approved, issued and granted certain things, and ordering many things moreover more seriously and clearly, which are more fully expressed in the articles written below.
9 6. First, because, as we have understood, by some it is questioned whether the brothers of that same order are bound both to the counsels and to the precepts of the Gospel, both because in the beginning of the aforesaid rule it is held: The rule and life of the Friars Minor is this, namely to observe the holy Gospel of Our Lord Jesus Christ, living in obedience, without property and in chastity, and because in that same rule it is contained thus: when the year of probation is finished, let them be received to obedience, promising to observe this life always and the rule, and also because at the end of that rule these words are contained: let us observe poverty and humility and the holy Gospel of Our Lord Jesus Christ, which we have firmly promised. Although of happy memory, Pope Gregory the Ninth, our predecessor, declared this article and certain others of that same rule, yet because his declaration, considering the biting insults of those rising up against the brothers and the rule, and the outcomes of many cases emerging afterwards, seemed in some respects obscure, in some incomplete, and in many things contained in that rule insufficient: we, wishing to remove such obscurity and insufficiency through a perfect interpretation and declaration, and to cut away from the minds of all the scruple of any ambiguity through the certainty of fuller exposition, say that when in the beginning of the rule it is placed not absolutely but with a certain modification or determination or specification:
10 The rule and life of the Friars Minor is this, namely to observe the holy Gospel of Our Lord Jesus Christ, living in obedience, without property and in chastity: which three things that same rule pursues with great care and nevertheless adds certain other things, commanding, prohibiting, counseling, warning, exhorting and under other words reducible to some of the aforesaid modes, it can be more openly evident from the intention of the rule that that which in the profession seems to be added almost absolutely: promising to observe this life always and the rule, and that which is subjoined at the end: and the holy Gospel of Our Lord Jesus Christ, which we have firmly promised, let us observe: all of it should be reduced to the modified or determined or specified beginning of that rule itself, namely to the observance of the Gospel, as aforesaid, through that rule itself modified or determined or specified in those three things; since it is not probable that the same holy word, once pronounced by him with a certain modification or determination or specification, although repeated almost summarily, would have wished in its repetition to lack the modification or determination or specification given to it by him without certain cause, and the arguments of both laws teach us that those things which are at the beginning are referred to the middle and to the end; those, however, which are in the middle, to the end and the beginning, and those which are at the end, to both or to one of them often.
11 And even if it were said absolutely: 'I promise to observe the holy Gospel,' unless the one making such profession intended to bind himself to the observance of all counsels, which he could scarcely or never be able to observe to the letter; for which reason such a promise would seem to ensnare the soul of the one professing, it would clearly appear that such a promise ought not to bind to another understanding without the intention of the one promising, except that the observance of the Gospel be, as it is found handed down by Christ, namely that the precepts be observed as precepts and the counsels as counsels by those professing. Which understanding also the blessed Francis himself showed plainly to have had in the series of his rule, when he indicates certain evangelical counsels as counsels under the words of warning, exhortation and counsel, but certain things under prohibition and the word of precept: by which it is evident that it was not the intention of the speaker that the brothers from profession of that rule should be bound to all counsels as to the precepts of the Gospel; but only to those counsels which in that same rule are expressed preceptively or prohibitively or under equivalent words.
12 Wherefore, in order to set at rest fully the consciences of the brethren of the same order, we declare that from the profession of that same rule the brethren themselves are bound to observe only those evangelical counsels which are expressed in that rule by precepts or prohibitions or by equivalent words. But to certain other counsels given through the Gospel they are bound more, according to the requirements of their state, than other Christians, inasmuch as through the state of perfection which they have assumed by such profession, they have offered themselves as a holocaust to the Lord, refined through contempt of all worldly things. But to all things which are contained in that rule itself, both precepts and counsels and other matters, they are bound by the vow of such profession in no other way than in that manner in which they are handed down in the rule itself; that is to say, they are bound to the observance of those things which are introduced to them in that same rule under binding words: but the observance of those things which are contained under monitory, exhortatory, informatory and instructory words or any others whatsoever, it is fitting for them to pursue all the more in good conscience and equity, inasmuch as, having become imitators of so great a Father, they have chosen more strictly the paths of Christ.
13 7. Moreover, since that rule itself expressly contains that the brethren appropriate nothing to themselves, neither house nor place nor any thing, and it has been declared by that same predecessor Gregory, the ninth pope, and certain others that this ought to be observed both in particular and also in common, and since the senseless cunning of some has corrupted with poisonous detraction so strict a renunciation, lest the clarity of the perfection of those same brethren be torn by the senseless words of such ignorant persons, we say that the renunciation of property of all things both in particular and also in common for the sake of God is meritorious and holy, which Christ also, showing the way of perfection, taught by word and confirmed by example, and which the first founders of the Church militant, as they had drawn from that same source, derived through the channels of their teaching and life to those willing to live perfectly. Nor let anyone think that this is hindered by the fact that it is sometimes said that Christ had a purse; for thus Christ himself, whose works are perfect, exercised in his acts the way of perfection, so that sometimes condescending to the imperfections of the weak and exalting the way of perfection, he did not condemn the weak paths of the imperfect; thus Christ assumed the person of the weak in the purse, thus also in certain other things assuming the infirmity of human flesh, as the Gospel history testifies, he condescended to the weak not only in flesh but also in mind; for thus he assumed human nature that, existing perfect in his own works, he became humble in ours, remaining exalted in his own. Thus also by the dignity of supreme charity he is drawn to certain acts conformed to our imperfection, so that he is not turned from the rectitude of supreme perfection. For Christ both acted and taught the works of perfection, he also both acted and infirm things, as sometimes appears in flight and in the purse; but existing perfectly perfect in both, so that he might show the way of salvation to both perfect and imperfect, whom he had come to save, he who then willed to die for both.
14 8. Nor let anyone rise up erroneously from these things thinking that those who thus renounce all property for the sake of God commit themselves to the peril of living as murderers of themselves or tempters of God: for thus they commit themselves to Divine providence in living so that they do not scorn the way of human provision, but are sustained either from those things which are offered freely or from those things which are begged humbly or from those things which are acquired through labour; which threefold way of living is provided expressly in the rule. Truly, if according to the promise of the Saviour the faith of the Church shall never fail, by consequence neither shall works of mercy be withdrawn, from which all reason of any diffidence seems to be removed from the poor of Christ. And indeed, if (which is in no way to be presumed) all these things should fail, just as neither to others so neither to the brethren themselves is the way precluded by right of heaven in the article of extreme necessity to provide for the sustenance of nature by the way conceded to all those held by extreme necessity, since extreme necessity is excepted from every law. But let no one think that such renunciation of property induces an absolute renunciation of the use of things; for since in temporal things it is to be considered that ownership is principal, possession, use, usufruct, the right of using and simple factual use, and lastly as necessary, although mortal life can lack the first things, there can be no profession whatsoever which excludes from itself the use of necessary sustenance; but it was fitting to condescend to that profession which has voluntarily devoted itself to Christ poor in such great poverty, to renounce the dominion of all things and to be content with the necessary use of things conceded to itself.
15 9. Nor is it to be inferred from the fact that he appears to have renounced ownership and dominion of any property for himself, that all use of things has been renounced by a simple renunciation—which use, I say, bearing the name not of right but of fact only, yet in the using provides to those using it nothing of right; rather, the necessary use of things both for the sustenance of life and for the execution of the duties of their state, except for what is set forth below concerning money, a moderate use according to their rule and complete truth has been granted to the brothers; which things the brothers may lawfully use, during the license of the one granting, and according to what is contained in the present ordinance. Nor is it found to oppose this that civil provision in human affairs has established among men, namely that use or usufruct cannot be separated from perpetual ownership; which, lest ownership become useless to owners with use always departing, in establishing this decreed with regard only to temporal utility. For the retention of ownership of such things made with the granting of use to the poor is not unfruitful to the owner, since it is meritorious unto eternal things and suited to the profession of the poor, which is reckoned so much more useful to him, as it exchanges temporal things for eternal. Truly it was not the intention of the confessor of Christ who instituted the rule; rather, the contrary is written in the rule itself, the contrary he preserved in living; since he himself made use of temporal things for necessity and in many places in the rule he makes clear that such use is permitted to the brothers: for he says in the rule that clerics perform the divine office, from which they will be able to have breviaries: from this plainly intimating that his brothers would have use of the breviary and books, which are suited to the divine office; in another chapter also it is said that ministers and custodians for the needs of the sick and other brothers to be clothed should exercise careful attention through spiritual friends according to places and times and cold regions, as they see fit for necessity; elsewhere also exhorting the brothers through suitable exercise of labor to avoid idleness, he says that from the wages of labor they receive for themselves and their brothers the necessities of the body; in another chapter also it is contained that brothers go forth for alms with confidence. It is also found in the same rule that in the preaching which the brothers perform, their discourse be examined and chaste for the utility and edification of the people, announcing to them vices and virtues, punishment and glory. But it is established that these presuppose knowledge; knowledge requires study, and the exercise of study commonly cannot be had without the use of books: from all which things it is sufficiently clear from the rule that use of necessary things for food, clothing, divine worship, and scholarly study has been granted to the brothers.
16 10. It is therefore clear to those who understand rightly from the aforesaid that the rule concerning such renunciation is not only to be observed, possible and lawful, but meritorious and perfect; and all the more meritorious in that through it the professed members thereof are more removed from temporal things for the sake of God, as is aforesaid. Moreover, since the brothers themselves acquire nothing in particular for themselves or are given anything, if the one offering, granting or donating does not express otherwise, it is to be believed with probability that such was the intention of the one offering, granting or donating the thing, that he would perfectly grant, donate and offer it, renounce it from himself, and desire to transfer it to others for the sake of God; nor is there a person into whom in place of God the dominion of such a thing might more fittingly be transferred than the aforesaid see or the person of the Roman Pontiff, the Vicar of Christ, who is the Father of all and of the Friars Minor in particular, lest the dominion of such things appear to be under uncertainty, since a son acquires to his father in his own way, a servant to his master, and a monk to his monastery things offered, granted or donated to him; the ownership and dominion of all utensils and books, and of their movable property present and future, which and whose use it is lawful for the said order or the brothers themselves to have, which also the blessed Pope Innocent IV, our predecessor, is known to have done, we receive into ourselves and the Roman Church by apostolic authority, and we have decreed by this present Constitution, to be valid in perpetuity, that it pertains fully and freely to us and the same Church. Let the Friars beware of transgressing this obligation even in appearances. 11. Furthermore, places purchased from various alms and offered or granted to the brothers under whatever form of words, although the brothers ought to take care that they do not use in such words language incompetent to their state from various persons, or those possessing in common or having certain shares in the same places in which those possessing in common or having certain shares have reserved nothing to themselves in the offering or granting of such; similarly we receive into the right and dominion and ownership of ourselves and the aforesaid Church by the same authority. But places or houses for the habitation of the brothers to be granted or even offered to the brothers by an individual or college in their entirety, if it should happen that the brothers inhabit such things by the will of the one granting, they shall inhabit them persevering only in the will of the one granting; and those, freely except for the church and oratories destined for the church and the cemetery, which both present and future we receive into the right and ownership of ourselves and the aforesaid Roman Church in like manner and by the same authority, let them leave when the will of the one granting is changed and made known to the brothers themselves. In the dominion or ownership of which places we retain nothing at all for ourselves or the aforesaid Roman Church, unless they are received by us or the same Roman Church with special assent; and if in the same places the one granting shall have reserved for himself dominion in granting on account of the habitation of the brothers, such dominion shall not pass into the right of the aforesaid Church but rather shall remain fully free to the one granting.
17 12. Moreover, neither utensils nor other things, the use of which is not for necessity and the execution of the duties of their state—for they ought not to have the use of all things, as has been said—to any superfluity, riches or abundance, which would derogate from poverty or hoarding or with the intention that they distribute them, or sell them, shall they receive, nor under the color of providence for the future nor for any other occasion; but rather in all things let there appear in them as regards dominion a complete renunciation and in use necessity. But these things, according to the requirement of persons and places, let the ministers and custodians together and separately in their administrations and custodies dispose with discretion, since sometimes the quality of persons, the variety of times, the condition of places and certain other circumstances require that provision be made more or less and otherwise. Let them do these things in such a way that always in them and their acts holy poverty may shine forth, as is found enjoined upon them from their rule.
18 13. Furthermore, since in the same rule it is prohibited under the strictness of precept that the brothers receive for themselves or through others money or funds in any way, and the brothers desire to observe this in perpetuity and as if enjoined must fulfill it, lest their purity in the observance of this precept be stained in any way or the consciences of the brothers be pricked by certain stings, we take up this article on account of the bites of detractors more deeply than our predecessors have done, and pursuing it with clearer determinations, we say first that the brothers themselves abstain from contracting loans; since it is not lawful for them to contract a loan, their state being considered, they can however, for the satisfaction of their necessities which may occur from time to time, when alms, by which satisfaction could not conveniently be made at that time, cease, without any bond of obligation, say that through alms and other friends of the brothers they intend to labor faithfully for the payment of such.
19 In which case it should be procured by the brothers that he who gives alms, either by himself or through another not to be named by them, if it can be done, but rather to be assumed by him according to his own good pleasure, should make such satisfaction in whole or in part, as the Lord shall inspire him. If, however, he himself should be unwilling to do this or unable to do so, either because his departure is imminent, or because he does not have knowledge of faithful persons to whom he might wish to commit this, or for any other occasion or cause, we declare and say that in no way is the rule of purity infringed or its observance in any way blemished, if the brothers themselves take care to give notice of some person or persons to themselves, or name or even present one or more persons to whom, if it should please the one making the alms, the execution of the aforesaid could be committed; and his assent shall be had upon the substitutions written below: provided, however, that with the giver as lord, the ownership and possession of the money itself with free power of recalling the money itself to himself shall always remain fully, freely and entirely until its conversion into the thing appointed, the brothers shall have absolutely no right in the money itself nor administration or dispensation, nor against the person named by them or not named, of whatever condition he might be, in judgment or outside any action, prosecution or any other right whatsoever, in whatever manner the aforesaid person might conduct himself in this commission.
20 It shall be permitted, however, to the brothers to intimate and specify or set forth their necessities to the aforesaid person and to beseech him that he pay them. They may also exhort the same person and induce him to conduct himself faithfully in the matter committed; and to provide for the salvation of his soul in the execution committed to him, provided, however, that from all administration or dispensation of the same money and action or prosecution against the aforesaid person, as aforesaid, the brothers abstain entirely. But if it should happen that such a person, named or not named by the brothers, is prevented from being able to execute by himself what is aforesaid through absence, infirmity, will or distance of places to which he would be unwilling to go, in which the payment or satisfaction should be made, or by some other impediment, it shall be permitted to the brothers with purity of conscience, as far as substituting one other person for the aforesaid in naming and in other respects, if they cannot or will not have recourse to the first giver, to do with this person as we declare above it is permitted to them to do.
21 For since the ministry of the first of the two persons by way of substitution, as has been said, appears to be able to suffice more commonly and generally in the execution of the aforesaid, since the aforesaid satisfaction is presumed to be able to be expedited quickly. If, however, sometimes on account of the distance of places in which the satisfaction should be made and other conditions or circumstances of the case should emerge in which the ministry of several substituted persons should appear opportune, it shall be permitted to the brothers in this case, according to the quality of the matter, the aforesaid manner being observed, to assume, name or present several persons to execute this ministry. And because it is necessary and expedient that the necessities of the brothers be provided for not only those for which payment or satisfaction should already be made, as has been said just above, but also those impending, whether such necessities arising should be impending which can be expedited in a short time, or such as, though few comparatively, whose provision necessarily requires time, as in books to be written, churches or buildings to be constructed for their habitation, books and cloths to be bought in remote places, and other similar things, if any should occur, with the moderation aforesaid to be provided for salutarily; thus in these necessities we clearly distinguish, thus in them we declare the brothers to be able to proceed safely and with sound conscience, namely that in an impending or imminent necessity, which can be expedited in a short time or which sometimes from certain circumstances cannot be so quickly, as has been said in the case just above, as much regarding the one giving alms as regarding the one named or substituted in all things, and through all things as in the article of payment for necessities past to be made we have declared just above, let it be proceeded.
22 In that necessity, however, which presses upon them in whatever way at the present time, which nevertheless has a period of time attached to it by reason of its nature, as aforesaid, because in that case it is probable that both on account of the distance of places, which the expedition of the necessity itself would require by its condition, and also the reason of the circumstances of the necessity itself being weighed, cases would frequently occur in which, for the expedition of such necessity, it would be necessary that money designated for such necessity pass through diverse hands and persons, of all which persons it would be almost impossible for the principal lord designating money for the same necessity, or even for a substitute appointed by him, and a third also appointed by that substitute if such a case should occur, to have knowledge afterwards, we declare and say that in this matter, besides the aforesaid two modes in necessities past and pressing which can be expedited in a brief time, or sometimes not in a brief time, as is expressed above, as we have aforesaid to be observed, in order to preserve the complete purity of the rule itself and of its professors, that if the giver of such alms or his messenger be at hand, who can do this, it is expressly declared to him by the friars that it please him that the dominion of such money with free power of recalling the money itself to himself remain always with him, until the conversion of the same into the thing designated, freely remaining, as has been said in the other two cases above, through however many hands the money or alms itself be handled, or persons named by him or by the friars, all proceeds by his consent, will and authority, which assent being given by him to the aforesaid, the friars can securely use the thing purchased or acquired from that money by whomsoever according to the manner noted above.
23 For greater clarity moreover of all the aforesaid, by this provision valid in perpetuity we declare that the friars, by the aforesaid modes, as is aforesaid, concerning money in supporting their past and pressing necessities observed, are not understood nor can be said by themselves or through an interposed person to receive money against the rule, or the purity of their order's profession, since it manifestly appears from the premises that the friars themselves are not only removed from the reception, ownership, dominion or use of the money itself, but also and from any dealing whatsoever of the same and are entirely alien from it. The manner in which the Friars can have recourse to benefactors who have money. 14. In that case indeed when, before the money itself is converted into a lawful commerce of having or using the thing, it should happen that the one granting the money dies, if the granter in granting shall have said or expressed that the person designated would expend the money itself in necessary use of the friars, whatever should happen concerning the granter living or dying, whether the granter of this kind left an heir or not, the friars can have recourse to the designated person, notwithstanding the death of the granter or the contradiction of the heir, for that money to be expended just as they could to the lord granter himself.
24 Because indeed we zealously guard the purity of the order itself with the intimate affection of our heart, since in the aforesaid cases when money is granted to a determined necessity, as is aforesaid, by someone, the granter of money can be asked by the friars that if anything of that money, the determined necessity being had, should remain over, he consent that the remainder of the aforesaid money be converted into other things for other aforesaid necessities of their friars; which not consenting to the aforesaid, the remainder itself, if there be any, shall be restored to him. Let the friars nevertheless take care that they diligently adapt themselves so that they do not knowingly consent that more be granted than can be reasonably estimated the necessary thing for which the money itself is granted will be worth. And because in the serious exposition of the aforesaid an error could easily be made by the giver or receiver, so that more clearly to the utility of the givers, to the purity of the order of some simple ones, to the salvation of souls on both sides more securely it may be consulted, that understanding which is sufficiently perceived in this case by one who understands soundly, by the series of this constitution present and valid in perpetuity we make clear, wishing that understanding to be brought to common knowledge, namely that always when money is sent or offered to the friars themselves, unless expressly by the sender or offerer something else be expressed, it is understood and sent by the aforesaid modes entirely offered.
25 For it is not probable that someone would wish to prefigure the mode of his alms without expression, by which both the giver meritoriously or those whose necessities are intended to be provided for by such gift are defrauded either of the effect of the gift or of the purity of his conscience.
26 15. Since certain things are sometimes bequeathed to the brothers themselves in final wills under various forms, and it is not expressly contained in the rule or in the declarations of our predecessors what is to be done concerning these matters, providing lest they should have cause to doubt hereafter, and taking precaution for the consciences of the brothers and those making bequests, we declare, ordain and say that if the testator expresses in bequeathing a manner according to which the brothers, their condition being considered, would not be permitted to receive, such as if he should bequeath to the brothers a vineyard or field to be cultivated, a house to be let out, or should use similar words in similar cases or observe similar modes in leaving property, the brothers shall abstain from such a bequest and its reception in every way. But if the testator shall have expressed in bequeathing a manner lawful for the brothers, such as if he should say: I bequeath money to be expended for the necessities of the brothers, or a house, field, vineyard and similar things for this purpose, that through a certain person or persons suitable they be sold and the money received from these things be converted to building or other necessities of the brothers, or if in bequeathing he should use similar modes or words, in this case we decree that in all respects and through all things, their necessities and the aforesaid moderation being considered, what was declared by us above concerning pecuniary alms granted to the brothers shall be observed. Let both the heirs of testators and executors show themselves generous in paying these bequests, and likewise prelates and also secular persons to whom this provision should belong by law or custom, when it shall be expedient, let them show themselves ready from their office to fulfill the pious wishes of the deceased. For we also intend through modes lawful and agreeable to the rule of the brothers to provide that neither the pious intention of the deceased be destitute, and the cupidity of heirs be struck with legitimate blows, and the poor brothers themselves not be defrauded of opportune assistance. But if something shall be bequeathed to the brothers themselves generally without expression of mode, we will and in perpetuity by the present constitution command that this in a bequest thus left indeterminate be understood and observed in all respects and through all things, namely what we willed and expressed above concerning money or alms indeterminately offered or sent to the brothers, that is, that under a mode lawful to the brothers it be understood to be left, so that neither the one bequeathing merit nor the brothers themselves in effect be defrauded of what is left.
27 16. Since the ownership of books and other movables, which both the order and the brothers use, which nevertheless are not the property of others, is known to pertain specially to the aforesaid church, and it sometimes happens or is expedient that such books and movables be sold or even exchanged, wishing to provide for the utility of the brothers or their consciences, by the same authority we grant that the exchange of such things and to those things whose use is lawful for the brothers to have may proceed from the authority of the general and provincial ministers in their administrations jointly or severally, to whom we also grant to ordain concerning the disposition of the use of such things. But if such things should happen to be sold at an estimated price, since it is not lawful for the brothers themselves to receive money through themselves or through another, the rule forbidding it, we ordain and will that such money or price be received and expended in a lawful thing whose use is lawful for the brothers to have through a procurator to be appointed by the aforesaid See or by the cardinal governing through the same See of the same order according to the mode ordained above concerning past and impending necessities. Concerning vile movables however or of little value, it shall be lawful from the present grant of ours for the brothers, from a motive of piety or devotion or for another honest and reasonable cause, having first obtained permission of their superiors concerning this, according to what shall have been ordained among the brothers in general or provincial chapters both concerning these vile things or of little value, and their value and the aforesaid permission, namely from whom and in what manner it is to be had, to bestow upon others within and outside the order.
28 17. Although it is contained in the rule that the brothers have one tunic with a hood and another without a hood, and it might appear that this was the intention of the one instituting that they not use more than one when necessity ceases, we declare that the brothers may, with the permission of the ministers and guardians jointly and severally in the administrations committed to them, when it shall seem good to them, the necessities being weighed and other circumstances which according to God and the rule appear to be to be considered, use more than one, nor by this shall they appear to deviate from the rule, since it is also expressly said in the rule itself that the ministers and guardians exercise careful concern for the necessities of the infirm and for clothing the brothers according to places and times and cold regions.
29 18. And although the aforesaid rule contains that concerning the clothing of brothers and the necessities of the sick, the ministers alone and the guardians shall exercise careful attention, and that expression seems at first sight to restrict thus the ministers and guardians in this care so as to exclude the others from it, nevertheless, because it behooves us to consider carefully both the time when the rule was instituted, when the brothers themselves were few in comparison to the present, and perhaps the ministers and guardians then seemed sufficient to be able to provide for these things, and notwithstanding the multiplication of brothers and the quality of modern times, nor is it likely that blessed Francis the founder of the rule wished to impose upon the said ministers and guardians a yoke of impossibility, or from the consequence of that impossibility to wish the brothers themselves to lack their necessities, we grant that these same ministers and guardians may exercise such care through others. Moreover, the other brothers also ought to exercise such care as is chiefly incumbent upon the aforesaid ministers and guardians according to the rule, when it shall have been committed to them by those, diligently.
30 Of work and spiritual labors. 19. It is also contained in the rule that brothers, to whom the Lord has given the grace of working, shall work faithfully and devoutly so that, with idleness the enemy of the soul excluded, they do not extinguish the spirit of holy prayer and devotion. Because, however, from this word some have hitherto improperly attempted to censure the brothers themselves for idleness of life and transgression of the rule, we, repressing such wicked biting, declare that, having considered the aforesaid words and the form or manner of speaking under which the brothers are induced to such exercise, it does not appear to have been the intention of the founder that those occupied in study or in performing divine offices and ministries should be subjected to manual labor or operation, or that he constrained them to this, since by the example of Christ and many of the holy Fathers, this spiritual labor so far outweighed that which is corporeal as the things of the soul are preferred to corporeal things. To the others, however, who do not exercise themselves in the aforesaid spiritual works (unless such are occupied in the lawful services of other brothers), lest they live idly, we declare the aforesaid words to extend, unless such were of so excellent and notable contemplation and prayer that they would merit not to be withdrawn from so great and pious an exercise.
31 For brothers, however much not occupied in study or divine ministries, but devoted to the services of other brothers occupied in study or in other divine offices and ministries, ought to be sustained with those same by whom they serve, which is confirmed by that equitable law sanctioned, by which that valiant warrior David justly decreed, namely that the portion of those descending to battle and of those remaining with the baggage should be made equal. Of preaching to the people. 20. But because it is expressly contained in the rule that brothers shall not preach in the bishopric of any bishop, when he shall have forbidden it to them, we in this matter both deferring to the rule and nevertheless preserving the authority of Apostolic fullness say that the aforesaid word shall be observed to the letter, as the rule itself set forth, unless by the Apostolic See something else shall have been granted or ordained concerning this for the utility of Christian people, or in the future shall be ordained or established.
32 And because in the same chapter of the rule it is immediately subjoined that no one of the brothers shall dare to preach to the people at all, unless he shall have been examined by the minister general and also approved and the office of preaching shall have been granted to him by him, we, both attending to the past state of the order in its fewness and the modern state in the enlarged number of brothers and the utility of souls as is fitting, grant not only that the general examine, approve the brothers about to preach to the peoples and grant to them license to preach, insofar as the fitness of the person and the office of preaching the license itself should regard, as is contained in the rule, but also that the provincial ministers may do this in the provincial chapters with the definitors, which also is said to be observed today and to be contained in the privileges of the brothers: which license the aforesaid ministers may revoke, suspend and restrict, as and when it shall seem to them expedient.
33 21. But since in our desires this is carried out so that to the glory of God the salvation of souls may advance and the said order, through which the affection of Christian religion is continually kindled to the love of God, may justly be increased in number, we grant and by the present statute confirm that it is permitted not only to the general but also to the provincial ministers to receive into the brotherhood persons fleeing from the world, which license of the provincial ministers may be restricted by the general himself, as he shall see fit. The vicars truly of the provincial ministers shall know from their office that this license is forbidden to them, unless by the ministers themselves, to whom we decree it is permitted to commit this power to vicars and others, it be specially committed to these same vicars. Let the provincial ministers themselves take care, however, that they commit this not indiscreetly, not indiscriminately but so considerately, and so support those to whom this happens to be committed with faithful counsels that all may proceed discreetly; nor let all be admitted indifferently to the order but only those who, being aided by literacy, fitness or other circumstances, can be useful to the order, and can profit themselves through the merit of life and others through example.
34 22. Moreover, to the brothers of the aforesaid order doubting whether, because it is said in the rule that upon the death of the general minister the election of a successor shall be made by the provincial ministers and custodians in the chapter at Pentecost, the multitude of all custodians must come together to the general chapter or, so that all things may be treated with greater tranquility, it may suffice that some from each province, who have a voice for others, be present, we respond thus: namely that the custodians of each province shall constitute one from among themselves, whom with their provincial minister they shall send to the chapter for themselves, committing their voices or proxies to the same, which also when they shall have constituted by themselves, we have deemed such a statute worthy of approval, which also the same predecessor Gregory IX is said to have responded to in such a case.
35 23. Finally, because it is contained in the aforesaid rule that brothers shall not enter the monasteries of nuns except those to whom a special license shall have been granted by the aforesaid See, although the brothers have believed this ought to be understood more carefully of the monasteries of poor enclosed nuns, since the aforesaid See has special care of them, and such understanding is believed to have been declared in the general chapter by the provincial ministers through a certain constitution given at the time when the rule was living with the blessed Francis still alive, the same brothers nevertheless petitioned to be assured whether this is to be understood of all generally, since the rule excepts none, or of the monasteries only of the aforesaid nuns. We indeed respond that it is generally prohibited of all convents of nuns whatsoever, and by the name of monastery we wish to be understood the cloister, the inner houses and workshops, for the reason that to other places where secular men gather, brothers can go there for the sake of preaching or seeking alms, to which it shall have been granted them by their superiors according to their maturity or fitness, always excepting the aforesaid enclosed monasteries; to which no one is given the faculty of entering without the special license of that same See: which also the same predecessor Gregory IX is said to have responded to in that case.
36 24. Moreover, the confessor of Christ of holy memory Francis is said to have commanded about the end of his life, whose command is said to be his testament: that the words of his rule be not glossed, and to use his own words, that it be understood thus or thus shall not be said, adding that brothers in no way petition any letters from the Apostolic See and inserting certain things which could not be observed without great difficulty, on account of which brothers hesitating whether they were bound to the observance of the aforesaid testament petitioned through the same predecessor Gregory IX to have this doubt removed from their consciences. He, as is asserted, attending to the danger of souls and the difficulties which they could incur on account of this, removing the doubt from their hearts said that the brothers themselves were not bound to the observance of his command, which without the consent of the brothers and especially of the ministers, whom it touched universally, he could not bind, nor did he bind his successor in any way, since he did not have power equal to equal. We, however, concerning the present article have deemed nothing worthy of innovation.
37 25. To this end we have learned that certain of our Roman Pontiff predecessors issued diverse letters concerning the declaration of that rule itself and the rule itself and matters pertaining to it, but neither through this did the biting attacks of the aforesaid against the rule itself and the brothers cease, nor through those letters is the state of the brothers provided for in many matters in which experience of many cases subsequently occurring has shown that provision must be made anew or otherwise. We therefore, lest the diversity of such letters and of the present constitution or disagreement of understanding in the observance of the aforesaid brothers disturb their minds, and that more fully, clearly and certainly their state and observance of the aforesaid rule may be provided for; in all and singular those articles which the constitution itself contains, although they or some of them are contained in the other Apostolic letters aforesaid, this our constitution, declaration, or ordinance alone do we decree to be observed by the brothers themselves precisely and inviolably for perpetual times.
38 26. Since therefore from the aforesaid and other matters discussed by us with great care that rule itself appears to be lawful, holy, perfect and observable, and open to no evident discrimination, we approve, confirm and will it to exist with perpetual firmness by the fullness of Apostolic power, all the aforesaid things established, ordained, granted, disposed, decreed, declared and also supplied by us, in virtue of strict obedience commanding that this constitution, like other constitutions or decretal letters, be read in schools. And because under the colour of what is lawful some might pour forth the poison of their wickedness against the brothers themselves and the rule in reading, expounding and glossing it, and producing the understanding of this constitution itself into diverse and adverse opinions might deprave it by their inventions, and the diversity of opinions and distortion of understanding might involve the pious minds of many and withdraw the hearts of many from entering religion, the necessity of avoiding the perversity of such detractors compels us to close to them the way to the aforesaid and to prescribe a certain manner of proceeding for those reading this constitution.
39 Therefore under penalty of excommunication and deprivation of office and benefice we strictly command that the present constitution, when it happens to be read, be faithfully expounded just as it was pronounced, to the letter, and that concordances, contradictions or diverse or adverse opinions be in no way introduced by readers or expositors, that no glosses be made upon this constitution, unless perhaps by those who might expound the word or the sense of the word or the construction or the constitution itself almost grammatically to the letter or more intelligibly, and that the understanding of it be not depraved by the reader in any way or distorted to anything other than what the letter itself sounds. And lest it be necessary for the aforesaid See to labour further against such detractors, we strictly command all and singular of whatever eminence, condition or status that they dogmatize, know, determine, preach or speak perversely publicly or secretly against the aforesaid rule and state of the aforesaid brothers or against the aforesaid things established, ordained, granted, disposed, decreed, declared, supplied, approved and also confirmed by us.
40 But if any ambiguity should arise with anyone in these matters, let this be brought to the summit of the aforesaid Apostolic See, that from its Apostolic authority the intention in this matter may be made manifest, to which alone it is granted to establish statutes in these matters and to declare those established. But those glossing in writing the constitution itself otherwise than in the manner we have said, doctors moreover or readers, when they teach in public, from certain knowledge and deliberately depraving the understanding of this constitution, making also commentary, writings or booklets and from certain knowledge and deliberately determining in schools or preaching against the aforesaid or any or any one of the aforesaid, notwithstanding any privileges or indulgences or Apostolic letters whatsoever, granted to any dignities, persons, orders or religious or secular places generally or singularly under whatever form or expression of words, which we will not avail anyone in any way in the aforesaid, know themselves to be subject to the sentence of excommunication, which we now pronounce against them; from which by no one except the Roman Pontiff can they be absolved.
41 Moreover both these against whom the sentence of excommunication has been pronounced by us, and others, if there be any, coming against the aforesaid or any of them, we will to be brought to the knowledge of us and the aforesaid See, that whom the mode of equity provided does not restrain, the rigour of Apostolic vengeance may restrain. Let no one therefore absolutely infringe this page of our declaration, ordinance, concession, disposition, suppletion, approbation, confirmation and constitution or dare to contradict it rashly. If anyone, etc. to the incurring thereof. Given at Suria, on 14 August, in the second year of our pontificate.
