Brief on the Malabar Rites controversy and the decrees of Cardinal de Tournon
apostolic
CHAPTER III. ON SUPERSTITION
1 « To the Venerable Brethren and beloved Sons, the Bishops and Apostolic Missionaries in the Kingdoms of the East Indies, Madura, Maisur and Carnatic. Pius, Clement by the grace of God, XII. Venerable Brethren, beloved sons, greeting and Apostolic benediction. — We do not doubt that it is known and established with you that Charles Thomas, of blessed memory, then Patriarch of Antioch with the power of Legate a latere, Apostolic Commissioner and Visitor, and afterwards Cardinal of this Holy Roman Church, sent by our Predecessor of happy memory Clement XI to China in the year 1702, first arrived at the fortress of Pondicherry, so that he might opportunely provide for the grave and urgent necessities of the Missions in the Kingdoms of Madura, Maisur and Carnatic to be most healthfully directed, issued on the 23rd day of the month of June in the year 1704 certain decrees, which he promulgated on the 8th day of the month of July of the same year. But when some of the Venerable Brethren and beloved Sons, the Bishops and sacred workers of the East Indies, not acquiescing in certain matters contained in those same decrees, had protested, our aforesaid Predecessor Clement XI by Letters in the form of a Brief to the Bishop of Meliapore given on the 17th day of the month of September in the year 1712, required and commanded obedience to and observance of those same decrees until this Apostolic See, with the matters of the case faithfully reported and more carefully examined, should enter upon those ways and measures of its providence which it should know to be more consonant with justice and more suited to the propagation of the Christian faith. Benedict also XIII, of happy memory, likewise our Predecessor, providently adhering to the mandates, declarations and footsteps of Clement XI, by Letters also in the form of a Brief given on the 12th day of the month of December in the year 1733, similarly fortified the aforesaid decrees of Cardinal Tournon with the strength of confirmation. We, however, who undeservedly have succeeded to those same Supreme Pontiffs in Apostolic service, desire nothing more earnestly than that the most sacred faith of Jesus Christ be advanced more each day, and we take care with all effort that if perchance great impediments to its increase and propagation should occur, they be completely removed (God granting our prayers). Therefore, after the necessary and more certain examination by our theologians and the venerable Brethren our Cardinals of the Holy Roman Church, the Generals of the Inquisition throughout the whole Church, and after those things which the same Cardinals have decreed to be confirmed by us have been brought before us, and in certain matters have been decided by us, from the decrees inserted below you will fully recognize them. »
2 « On the day of the decree of the Most Eminent, illustrious and of blessed memory, R. P. D. Charles Thomas Maillard de Tournon, Patriarch of Antioch, afterwards Cardinal of the Holy Roman Church, issued at Pondicherry on the 23rd of June 1704, proposed in the General Congregations of the Office, held in the Convent of St. Mary above the Minerva before the Most Eminent and Most Reverend Lords, Cardinals of the Holy Roman Church, Generals of the Inquisition, with the Consultors written below present, on the days below: concerning which doubts the same Most Eminent ones set forth their opinion, as follows, namely:
3 Wednesday, the 21st day of January 1733.
4 » First Doubt — Whether, and in what manner, the decree of the late most eminent Cardinal de Tournon should be executed in that part which is of the following tenor: — We strictly forbid that in baptizing, whether children or adults of whatever sex and condition, the sacramentals be omitted, but all should be administered openly, and especially saliva, salt, and insufflation, which the Catholic Church has received from Apostolic tradition, and on account of the mysteries of divine goodness toward us hidden in these sacred ceremonies, has kept holy and inviolably; the decree of the Holy and Universal Inquisition made in the year 1656 for the Chinese, on account of various reasons and circumstances, notwithstanding in no way. » The Most Eminent Cardinals said — The decree of Cardinal de Tournon should be confirmed, but the Most Holy Father should be consulted, that he grant to the missionaries of the kingdoms of Madurai, Maisur, and Carnatic a dispensation to last for ten years, to omit saliva in the conferral of Baptism, and to use insufflations secretly, in particular cases, however, and in which grave and proportionate necessity presses, upon which the conscience of the missionaries is burdened: provided that they do not labor under the error of holding saliva and breath as matter unfit or incapable of serving for the sacramental ceremonies in Baptism, as being altogether incapable of Baptism; and the missionaries are to be enjoined that they apply due instruction and all other possible diligence, that the aversion of the peoples from saliva and insufflation be removed, and concerning the instruction and other diligences applied they inform the Holy See within the space of ten years. » Moreover, the missionaries are to be admonished concerning grave negligence in not having recourse to the Holy See for obtaining the faculty of dispensing, and the Bishops acted badly in granting such dispensation, without consulting the Apostolic See.
5 » Second Doubt — Whether, and in what manner, the decree should be executed in that part which is of the following tenor: — Likewise we command that, » according to the praiseworthy » custom of the Church, » a name of some Saint described in the Roman Martyrology should always be imposed on the one being baptized by the one baptizing, with names of idols or of false religion altogether forbidden, names which the penitents, whom the gentiles use, and the neophytes have been accustomed to be called hitherto, before they were reborn by Baptism to divine grace. » The Most Eminent Cardinals said: — The decree should be moderated, with the word We command deleted, with the clause — Let them take care as much as possible; the prohibition remaining firm regarding the names of idols and of false religion of the penitents. Friday, the 22nd day of April, 1733.
6 » Third Doubt — Whether, and in what manner, the said decree should be executed in that part which is of the following tenor: — Nor is it permitted to parish priests or missionaries under any pretext to change the names of the most holy Cross, of Saints, and of sacred things by translation, nor to explain them in another language, except Latin, or at least Indian, insofar as Indian words of the region correspond clearly and exactly to the Latin signification. » The Most Eminent Cardinals said: — That the decree of the Most Eminent de Tournon be observed, and it be declared that it does not apply to words and names already commonly received from the institution of the Mission, which, however, by this declaration are neither approved nor disapproved.
7 » Fourth Doubt — Whether, and in what manner, the said decree should be executed in that part which is of the following tenor: — And because we have heard that the Baptism of infants born from Christian parents is, on account of the negligence of the same, very often protracted for a long time, not without the greatest danger to the salvation of the said infants, we admonish the evangelical workers that, mindful of the sacred canons, they set before the parents a shorter term than is possible, having regard to the circumstances, gravely burdening their conscience, unless they bring their sons within the prescribed time to the Church to be washed in the Sacred Font. » The Most Eminent Cardinals said: — The decree of the Most Eminent Cardinal de Tournon should be observed.
8 » Fifth Doubt — Whether, and in what manner, the aforesaid decree should be executed in that part which is of the following tenor: — Moreover, since it is the custom of such a region that infants of six or seven years, sometimes also at a more tender age, by the consent of their parents, contract an indissoluble marriage of the present by the imposition of the Taly, or golden nuptial token hanging from the wife's neck, we command the missionary that he not permit such invalid marriages to be made among Christians, nor allow the spouses thus joined to cohabit, until, having reached lawful age and their consent having been ascertained, in the face of the Church, in the form prescribed by the Sacred Council of Trent, they shall have contracted a true and canonical marriage.
9 » The Most Eminent Cardinals said — It is to be executed, etc. » the decree of the Most Eminent de Tournon; with » declaration, however, that the form » prescribed for marriages by the Sacred Council of Trent » is to be observed in places in which the decrees » of the said Council in cap. first sess. 24 on the » form of Matrimony have been published, and henceforth » will be published, nor is its observance » impossible; and the missionaries shall take care, as much as » it can be done, that in all places of the Missions » of those parts the said decree of the Council be » published.
10 » Sixth Doubt — Whether, and in what manner the » said decree is to be executed in that part » which is of the following tenor; — And since » among the more learned followers of that impious religion » the writers, namely, the Taly presents an image, although » misshapen of the pulley or pylleiaris idol placed before » nuptial ceremonies, and since it is unbecoming for » Christian women to wear such an effigy around the neck as a sign of matrimony: we strictly forbid » that henceforth they dare to wear the Taly with » this effigy around the neck; and lest unmarried wives » appear, they may use another Taly, » or of the Most Holy Cross, or of the Most Holy » Lord our Jesus Christ, or of the Blessed Virgin » or any other religious image adorned. » The Most Eminent Cardinals said: — The » Decree of the Most Eminent de Tournon is » to be observed, although the missionaries assert » that they never permitted the wearing of the said Taly.
11 » Seventh Doubt — Whether, and in what manner the » aforesaid decree is to be executed in that part » which is of the following tenor; — And since » a cord composed of one hundred and » eight threads is not free from superstition, and stained with saffron juice, by which many wear the said Tuly, we also forbid » the number of the said threads and the anointing.
12 » The Most Eminent Cardinals said; — The decree » of the Most Eminent de Tournon is to be observed. | » Eighth Doubt — Whether, and in what manner the » said decree is to be executed in that part which is of the following tenor: — The nuptial ceremonies also according to the custom of these regions » are so many, and so laden with » superstition, that no safer remedy can be applied » than by forbidding them altogether, since » they are full of the harmful stain of paganism, and it is » very easy for them to be purged of superstitions » by the superstitious. But truly, so that we may indulge » the easier convenience of conversions » and of neophytes, as much as it can be done » in the Lord, we » and especially to the Superiors of the Missions we » urge, that with new diligence applied, and » careful reckoning, all superstitious elements from the said ceremonies be expunged, so that nothing remains » unclean, which offends Christian piety — or, » smells of gentile superstition, » namely, besides those which we have heard already » established in this matter by the same missionaries » reforms, the branch of the Aresciomara tree be altogether removed; the number of dishes be varied no less than the prescribed quality of food; the circles over the heads of the spouses for warding off evil be omitted; and what we have said of the dishes, of the earthen vessels used there we declare and forbid it to be understood by us. » The Most Eminent Cardinals said: — The decree » of the Most Eminent Cardinal de » Tournon is to be observed.
13 Wednesday, 23 July 1733.
14 » Ninth Doubt — Whether, and in what manner the » said decree is to be executed in that part » which is of the following tenor: — The fruit also » commonly called Cocco, from the breaking of which » the gentiles rashly draw omens » of prosperity or misfortune, either be altogether » omitted from Christian » nuptials, or at least; if they wish to » eat it, not publicly, but secretly, and » outside the solemnity be opened by those who, taught » by evangelical light, are immune » from such delusion of omens.
15 » The Most Eminent Cardinals said: — Granted. » The Tenth Doubt — Whether, and in what manner, the aforesaid decree should be executed in that part, which is of the following tenor: — No one who is rightly and sufficiently disposed should be barred from the Sacrament of Penance, and especially women suffering from menstrual infirmity, not regarding the days of purification according to the custom of the gentiles; since this sacramental true purification of the soul, and no other, should be observed by the Christian faithful, and by their Pastors, to whom moreover it is not permitted either by themselves, or through catechists, or through any others whatsoever, to prohibit the said women from access to the church, or to the confessor, during the said infirmity, and during the time of the said purification. ? The Most Eminent Cardinals said: — The decree should be observed. The Most Eminent Cardinal de Tournon, - cs I The Eleventh Doubt - Whether, and in what manner the said decree should be executed in that part which is of the following tenor: — It is also unbecoming to the honor of a virgin laboring for the first time, to make known to her relatives, neighbors, and friends, and shamelessly after the manner and rite of the gentiles, in gatherings collected, concerning so sordid a matter. Wherefore we forbid such solemnities to be observed by orthodox maidens, and we enjoin missionaries not only to prevent them, but also their parents » How discordant with the laws of virginal modesty is such an obscene custom, which appears to have been introduced by the impudence of the gentiles, so that thus, with the modesty of maidens undermined, they might be able to provoke them immoderately to lust. » The Most Eminent Cardinals said: Let the missionaries take care to abolish the feast under the title of menstrual, but permit it only under the title of nuptials.
Wednesday, 0 September 1733.
16 » The Ninth Doubt aforesaid, proposed on 22 July but not resolved: — Whether, and in what manner, the aforesaid decree should be executed in that part, which is of the following tenor: — The fruit also commonly called Cocco, from the breaking of which the gentiles rashly draw omens of prosperity or misfortune, should either be entirely rejected from Christian nuptials, or at least, if they wish to eat it, let it be opened not publicly, but secretly, and outside the solemnity by those who, instructed by evangelical light, are immune from such divination nonsense.
17 » The Most Eminent Cardinals said: — The decree of the aforesaid Most Eminent Cardinal de Tournon should be observed.
18 » The Twelfth Doubt: — Whether, and in what manner, the decree of the aforesaid Most Eminent Cardinal de Tournon should be executed in that part, which is of the following tenor: — We cannot bear that by spiritual physicians for the salvation of souls those offices of charity should be denied, which gentile physicians, even of noble birth or chaste rank, do not disdain to render for the health of the body to the infirm, even though of abject and lowest condition, commonly called Parreas. Wherefore we strictly command the missionaries that, as far as in them lies, no one of the Christian sick, however much a Parreas, and of viler rank if such existed, should be left without the desired provision of a confessor in infirmity; and lest, with diseases growing worse, with the gravest danger to bodily life, they be forced to provide for the eternal, we enjoin the same missionaries not to wait to carry such infirm of this condition to the church, but more prudently to seek their homes, where they are sick, to the best of their ability to visit them, and to refresh them with pious discourse and prayers, and with the food of the Sacraments, and finally to anoint them when constituted in the final peril of life with the holy Oil of the Infirm, without respect of persons or sex, expressly condemning any practice contrary to this office of Christian piety.
19 » The Most Eminent Cardinals said: — The decree of the Most Eminent de Tournon should be observed: Furthermore, the missionaries should be admonished that they admit to Baptism no Indians who are in the opinion that Parreas are reprobated by God and therefore can hope for no salvation, unless they have laid aside that opinion. »
20 P vov »
21 The Thirteenth. Doubt — How and in what manner the said decree is to be executed in that part which is of the following tenor: — Not without the greatest sorrow of our heart have we learned that Christian drummers, flute-players, or players of any other musical instrument whatsoever are summoned to the festivals and sacrifices of idols, to play, and sometimes even compelled, on account of a certain servitude toward the public contracted by them through the exercise of such an art, and that it is not easy for missionaries to turn them away from this detestable abuse. Wherefore, considering what a grave account we should render to God if we did not recall such Christian faithful from the honor and worship of demons with all our might, we forbid them, that they dare not henceforth, neither in pagodas nor outside them, whether on the occasion of sacrifices or of any solemnities imbued with superstitious worship, to sound or sing, under penalty of excommunication latae sententiae, since in no way is it lawful for the servants of Christ to serve Belial; and therefore missionaries shall be bound not only to admonish them of the aforesaid prohibition, but also to commit it entirely to execution, and to expel from the Church those who act contrary, until they repent from their heart and amend the scandal perpetrated by public signs of penance.
22 The Most Eminent Cardinals said: — The decree is to be observed. The Most Eminent Cardinal de Tournon. The Fourteenth Doubt — Whether and how the said decree is to be executed in that part which is of the following tenor: — We declare moreover that the Pontifical Constitution of Pope Gregory XV, beginning — Romanae Sedis Antistes, — issued at the petition of the Fathers of the Society of Jesus, by which baths are permitted to native Christian faithful by the Apostolic See for no other occasion and purpose than to refresh the body and to cleanse it from natural filth, interdicted as to the time and manner in which they are used by gentiles, equally affects evangelical workers, to whom therefore it is not lawful under any other cause and purpose, even for the effect that they might be thought Samias or Brahmans more than others devoted to such ablutions, to use them, especially at their appointed hours, and before or immediately after any sacred function. The Most Eminent Cardinals said: — The decree of the Most Eminent Cardinal Tournon is to be observed. Wednesday, 16 September 1703. The Fifteenth Doubt — Whether and how the decree of Cardinal de Tournon is to be executed in that part which is of the following tenor: — Likewise, ashes made from cow dung and smelling of the impious penance of the gentiles instituted by Rutren, to bless, and to apply them to the forehead anointed with Sacred Chrism, or any other signs of white or red color, which the Indians, most superstitious, use on the forehead, or on the breast, or on any other part of the body, we forbid; commanding that the custom of the Holy Church and the pious rite of blessing ashes and signing with them the head of Christians with a cross, to recall the memory of human weakness, be religiously observed, at the time and in the manner prescribed by the Church, namely on Wednesday of Ashes, and not at other times.
23 The Most Eminent Cardinals said: — The decree of the Most Eminent Cardinal de Tournon is to be confirmed, with the Constitution of Gregory XV issued on 31 January 1523, which begins Romanae Sedis Antistes, being observed in all respects. Moreover, the Most Eminent Cardinals said: — Let a decree be made, by which it is imposed on missionaries,
24 of whatsoever Order, even of the Society of Jesus, dwelling in the lands of the infidels, that they dare not permit the rites or customs proper to the gentiles, nor change them or those by their own judgment into rites or customs of the Christian religion, without consulting the Holy See; and let missionaries remember the precept of Alexander VII in his Constitution beginning Sacrosancta, expressed in the following words: — Lest, on account of defect of instruction, those who are initiated by sacred baptism profane the immaculate law of Christ with profane and gentile institutions through ignorance, and confound idolatry with orthodox faith, as has often been reported to happen there, let those who are charged with instructing them take care that henceforth no one be admitted to Baptism who has not entirely put off gentile ways and is not sufficiently instructed in the faith.
26 » The sixteenth and final Doubt — Whether, and in what manner, the said decree is to be executed in that part, which is of the following tenor: — And finally, because from the reading of books treating of false religion, and of obscene and superstitious matters, poison, for the most part, is wont to creep into the hearts of the faithful, by which the purity of Faith is no less offended than morals are corrupted, greatly commending the zeal and study of missionaries, who have translated into the Malabaric or Tamil language books containing the sacred doctrine of the Catholic Church and monuments of sacred things for the instruction of Christian Indians, or have composed new ones for their convenience and instruction, to those same Christian faithful we expressly forbid fabulous books of the gentiles, and we prohibit them from reading and retaining them, under penalty of excommunication incurred by the very fact, unless first having obtained permission from the parish priest, or from the missionary exercising the care of souls, to whose prudence we commit the »
27 » faculty of dispensing in this matter, and of selecting books, if any happen to be free from harmful superstition and containing nothing contrary to good morals, for the use of Christians, and of permitting their reading."
28 » The Most Eminent Cardinals said: — The decree is to be observed. The Most Eminent Cardinal de Journon."
29 « To which doubts and their resolutions, reported to Us by Our Venerable Brother the Archbishop of Damietta, Assessor of the Congregation of the Holy Office, fully approving those resolutions, We have respectively confirmed, moderated, declared, and in some matters remitted all those things which according to their tenor seemed to be confirmed, or moderated, or declared, and in some matters remitted. Wherefore, Venerable Brethren, beloved sons, We enjoin and command you, that with singular reverence toward Us and this Holy See, whatsoever by these Our Letters from the fullness of Apostolic authority has been confirmed, or decreed, or prescribed, you shall most holily observe, and shall most diligently take care that it be observed by all: beseeching you in the Lord through the bowels of the mercy of our God, that with controversies now removed and utterly eradicated, cheerful and in accord with our sentiments, you may apply your studies and labors to the salvation of souls, which is the most excellent end of your vocation, to the best of your ability. And to you, Venerable Brethren, beloved sons, We most lovingly impart the Apostolic blessing. — Given at Rome at St. Mary Major under the Fisherman's Ring on the 24th day of August 1734, in the fifth year of Our Pontificate."
30 After a long and careful discussion of the facts and reasons on both sides, and finally after so solemn a judgment of the case, the Apostolic See had come into great hope that, just as an end had been put to litigation in Rome, so at last in the Indies an end would be made to discord and abuses; especially since those who had impugned the Decree, either having learned of its equity, or having already obtained moderations, declarations, and relaxations, considering themselves sufficiently satisfied, not only received it with equanimity, but also pledged their faith that they would entirely endeavor to ensure that whatever had been prescribed in the Apostolic Letters would be carried out completely. To this was added the fact that the Apostolic See had been informed not merely by rumor, but by certain and most weighty testimonies, that the Pontifical Letters had already been published and subscribed by all the missionaries, and that the bond of perfect communion and concord between the parties, which had been interrupted among them for many years not without great damage to the Missions, had been restored.
SUPERSTITION,
31 But the joy conceived from such happy beginnings soon vanished; for a most sorrowful report was brought with all speed to the Apostolic See, namely that the missionaries who had impugned the decree of Cardinal Tournon, notwithstanding the Apostolic Letters of Clement XII, accepted and published by them in solemn form, had nevertheless condemned those rites and ceremonies and were asserting that they could not be abolished according to the prescription of those same Letters, and took such liberty upon themselves as not to hesitate still to permit and retain them in use. And when the report of their so long delayed obedience to this grew daily, the aforesaid Pope Clement XII, in order to vindicate the obedience and observance due to Pontifical mandates and to render certain in the future the execution of those things which were commanded in the aforesaid Pontifical Letters, issued another Brief in similar form given on the 12th day of May in the year 1739, repeating to the Bishops and missionaries the command of the Apostolic Letters, and imposing also more severe penalties, so that they not only should most exactly observe what was commanded in his aforesaid Letters, with all faculty of interpreting otherwise removed, but should immediately bind themselves to it by solemn oath interposed, according to the formulas respectively prescribed to them. The Letters in the form of a Brief are of the following tenor:
32 "To the Venerable Brethren and Beloved Sons, Bishops and Apostolic missionaries in the Kingdoms of the Eastern Indies of Madurai, Maisur, and Carnatic. — CLEMENT PP. XI. — Venerable Brethren, beloved sons, greetings and Apostolic benediction. — The care of the Lord's flock entrusted to Us continually urges Us, and We apply Ourselves with the greatest diligence especially to this end, that from those chiefly who have received a share of this ministry and have been sent as a light to the nations, filial obedience toward the Holy See and Apostolic mandates be shown, and that they themselves retain the dogmas of the Faith and the sacred rites of the Church inviolate, and teach others, so that those whom the immense distances of places separate far from the See of Peter may nevertheless be joined together by the same faith in the unity of spirit and doctrine. Accordingly, by similar Letters of Ours dated 24 August 1734, beginning "It has been ascertained and verified," We have sought Your Fraternities and all missionaries with the greatest paternal affection of charity of which We were capable, and have declared how earnestly We desire that those who in these Kingdoms, recognizing the truth of Christ's Faith, are converted, should entirely cast off and turn away from the superstitious rites of the gentiles, lest they be held and themselves be like those who "served the Lord, yet also served other gods according to the customs of the nations"—and that in a matter of such moment there be no occasion of offense, having heard the opinions of theologians and especially of Our Venerable Brethren the Cardinals of the Holy Roman Church, General Inquisitors throughout the Christian commonwealth, We have providently established several things according to the doubts then proposed, and have prescribed them to be observed by the missionaries; the observance of all these things by Us and the zeal for increasing the Faith give Us certain hope that they will strive to obey with equal earnestness to the best of their ability, nor shall there be anyone who would think that by detestable indulgence things could be done otherwise, and, as it were, unfaithful sons, "make them commit great sin." Indeed, although by these means We might be persuaded that We have satisfied Our duty and should be without solicitude, yet the importance of the matter, upon which the purity and integrity of the Faith depends, will never remove this care from Us unless We continually provide more suitable remedies for the magnitude of the business. Wherefore to Your Fraternities and to all missionaries to whom We have directed the aforesaid Our Letters, whether they be secular or regular of whatsoever Religion, Congregation, Institute, Society, even of Jesus, We command and enjoin that you observe entirely, exactly, and inviolably all and singular things which are contained in the said Our Letters, and that you cause them to be observed precisely by those under your care, with all power of interpreting otherwise completely removed, in virtue of holy obedience, under penalty of suspension from the exercise of pontifical functions, interdict from entering a church, and respectively excommunication latae sententiae, from which none of you can be absolved by anyone except by Us or the Roman Pontiff existing for the time being, except only at the point of death; and as regards Regulars, moreover deprivation of active and passive voice, to be incurred even by the fact itself and without any other declaration. Likewise, under the same penalties and censures, by Our authority We command and enjoin that all and singular who have been sent by this Holy See or by your respective Superiors to these Kingdoms for the discharge of sacred missions, as soon as you have been made certain of these Our Letters, or have gained knowledge of them by any other announcement, shall take an oath to fulfill entirely, exactly, and in every way what has been providently established by Us in the same Letters, nor shall you act contrary to them in any part whatsoever under any pretext. To those also who shall at any time undertake this office, We command and enjoin, under all the same censures and penalties, that they dare not in any way perform even the least act unless they have first taken the aforesaid oath, nor indeed as secular priests appointed by the Ordinaries of places, or as simple Religious, or under any other title and name, receive the Confessions of the Christian faithful, deliver sermons, or minister the Sacraments,"
PART III. ON FAITH
AND MORALS
33 but let them be entirely devoid of power, by derogating from all privileges whatsoever granted to themselves or to your respective Religion, Order, Congregation, and Society, especially that of Jesus, or generally by Us and Our Predecessors for any reason whatsoever. We command that the aforesaid oath be taken by secular missionaries before their Ordinaries, by regulars before their Superiors or Apostolic Vicars, and by the Vicars themselves and Superiors in the hands of Bishops. Nor are they to pronounce the same by word only, but in writing, according to the form prescribed by Us and to be noted below, and to sign it with their own hand, under the same censures and penalties. We also command and require that this oath be taken by those who have merited promotion to the episcopal office by this Holy See, either on the very day on which they are about to make solemn profession of Faith in the hands of Bishops, or in the act of their consecration. We wish that signed copies of these oaths, with an authentic copy left here in the Archives, be transmitted by Bishops and Superiors of Regulars respectively to the Congregation of Propaganda Fide, from which they shall be sent to that of the Holy Office, so that they may be monuments of obedience toward Us and Our commands, and of the purity and integrity of your faith. Lest anyone be able to allege ignorance of either Our Letter under the aforesaid date of 24 August 1734 or of the present one, We exhort your Fraternities and beseech you in the Lord that as soon as you have received them and these present letters, you immediately cause them to be published and transmit them to each missionary, whether secular or regular, dwelling under your respective jurisdiction. We command the same to Apostolic Vicars and other Superiors of Regulars. We declare that those acting contrary or being negligent incur by that very fact the penalty of suspension from the exercise of pontifical functions and interdict from entering the Church; regulars, however, excommunication by the very fact of the law, deprivation of offices, and of active and passive voice.
34 The formula of the oath, as is set forth above, to be taken by missionaries, is as follows, namely: — I, N., of the Order N., or of the Society of Jesus, a missionary sent or assigned to the Kingdom N. or to the Province N. in the East Indies by the Apostolic See, or by my Superiors, according to the faculties granted to them by the Apostolic See, obeying the command of Our Most Holy Father Pope Clement XI through Apostolic Letters given in the Form of a Brief on 13 May in the year 1739, enjoined upon all missionaries in the said Missions, faithfully to take an oath to observe the Apostolic disposition concerning the Malabar rites
CHAPTER III. ON SUPERSTITION
35 » according to the form of the Apostolic Letters in the form of a Brief of the same Most Holy Lord Our Pope » beginning on 24 August 1733. — It has been ascertained » and verified — by me through a complete reading of the same » Brief, well known to me, I promise that I » shall fully and faithfully obey, and shall observe it exactly » entirely, absolutely and inviolably » and shall fulfill it without any evasion » and shall also instruct according to the form of the said Brief » the Christians committed to me, both in sermons » and in private instruction, and » especially catechumens, before they are baptized, » and unless they promise observance of the said » Brief, and its dispositions and prohibitions, » I shall not baptize them, just as » I shall also take care with all study as I am able, and » all diligence, that with the ceremonies of the gentiles removed, » they may be received by Christians and » retained in the rites which the Catholic Church piously » has prescribed. But if (which God forbid) » I should have contravened in whole or in part, as many times » as I shall have done so, I acknowledge and declare myself » subject to the penalties imposed by the Most Holy Lord Our Pope in » the Decree, or Apostolic Letters, as above, upon the taking of this oath, » equally known to me through a complete reading, and I » subject myself and declare. Thus touching the Holy Gospels I promise, vow, and swear. So may God help me, and these Holy Gospels of God. | I, N., by my own hand.
36 The formula of the oath, to be taken by Bishops as above, is as follows, namely: — I, N., Bishop of the city of N., mindful of the oath taken by me in the act of my solemn Consecration, by which I promised faith, subjection, and obedience to the Roman Pontiff, and moreover of those things which Clement XII, Supreme Pontiff, wisely ordained concerning the Malabar rites in the Apostolic Letters in the form of a Brief, transmitted to Bishops and missionaries under the date of 24 August 1734, obeying the mandates of His Holiness enjoined by other similar Letters on 13 May in the year 1739, so that as a token of my obedience toward the Apostolic See no less than of filial reverence, I bind myself by the obligation of an oath, I swear and promise that I shall fully and faithfully execute those same Apostolic Letters under the said date of 24 August 1734, and that I shall observe exactly, completely, absolutely, and inviolably those things which are prescribed in them, and shall likewise take care, as much as lies in me, that all those who are missionaries and priests in my diocese, or shall be in the future, observe and execute them in the same manner in all respects, and against the disobedient, should there be any, I shall proceed according to the form of the Brief under the date 15 May in the year 1739, so that at length, with the heathen ceremonies removed, those rites which the Catholic Church piously prescribes and continually observes may be received by Christians. And that there may be a perpetual record of this my will, oath, and filial obedience toward the Roman Pontiff and his mandates, I subscribe with my own hand. — I, N., Bishop of N. Moreover, although We have great hope that Your Fraternities and all our missionaries will receive Our words and admonitions carefully and execute them with filial obedience, and will take great care and solicitude that you may be a help both to the purity and integrity of so orthodox a religion and to the salvation of the peoples, and that you will all direct your labors and efforts to this one matter, which is indeed of the greatest importance, so that at length those who embrace the faith of Christ may turn away from superstitious rites and receive and retain only those rites which the Catholic Church piously prescribes and continually observes; nevertheless, by reason of the duty of pastoral office and the impulse of paternal charity, We do not cease to admonish you again and again, lest We be judged to have been less vigilant as the Prince of Pastors in the custody of His flock; and meanwhile We impart to you the Apostolic Blessing as an auspice of all good things. — Given at Rome at St. Mary Major under the Fisherman's Ring on the 19th day of May in the year 1739, the ninth year of Our Pontificate.
37 These Letters of Clement XII were followed by other Letters written specifically to the aforesaid Bishops of those Regions, in which the same Pontiff made known in grave words the sorrow conceived in his mind because he had not yet received certain and desired notice of the due observance of the Apostolic mandates, and took care to stir up the zeal and piety of those Bishops, so that they themselves, going before by example and diligence, might carefully promote the obedience of the others. An example of such Letters is as follows:
38 « To the Venerable Bishops in the Kingdoms of the Eastern Indies, of Madurai, Mysore, and Carnatic. — Clement PP. XII. — Venerable Brethren, greetings and Apostolic benediction. We cannot restrain Our lips from addressing you again, Venerable Brethren, with Apostolic voice, and We bear it with displeasure, indeed with grave concern, that We have not yet received certain notification of what finally became of Our Letters, which We gave to you and to the missionaries dwelling there on 21 August 1734. Truly this silence causes Us care and anguish on account of Our paternal love toward you, and especially because, although uncertain, reports are spread here that these Our Letters and Decrees have not been made public by all, nor carried out exactly as they ought to be, and that there are not lacking some who, thinking and speaking differently, lead disciples after them. Wherefore first We earnestly beseech Your Fraternities to report to Us as soon as possible how matters stand there, lest longer delay bring Us more grievous displeasure; secondly, We are led by firm hope, impelled by zeal for God, to rise with you in doctrine sound against those who contradict, so that, mindful of the office to which they have bound themselves, they may carefully beware and diligently provide, lest through their fault — These peoples are fearing the Lord, but nevertheless also serving their idols. — For this reason We have sent other Letters to Your Fraternities and to the missionaries, in which under graver penalties We command that they obey the sentiments and decrees of Our will and fulfill them in deed. But lest, as heretofore, one accuse another, and We, who although present there in spirit, yet absent in body, be kept in suspense by uncertain reports for a long time, We have deemed it necessary to require an oath from each one of the missionaries, to be signed by his own hand, whereby each one may profess that he will render prompt and exact obedience to Our commands, as is contained more fully in those same Letters. Although We promise this to Ourselves safely on account of the piety and religion of all, nevertheless the authority of Your Fraternities' example will contribute very much, whenever they learn that you have likewise taken the same oath of allegiance, as a testimony of your obedience toward the Apostolic See and toward Us, and have sent it to Us, as We beseech you again and again in the Lord. Moreover, We do not doubt that you yourselves will easily recognize that this is the one way of uncovering the truth, one safeguard for closing the mouth of those who speak iniquity: wherefore you will bind the Pontifical will, otherwise favorably disposed toward you, more and more to yourselves, if you add force to your industry, thought, and study by example; nor indeed do We fear that you will not more clearly explain at this opportune occasion that reverence which, upon receiving the episcopal office, you promised to this Holy See and to Apostolic mandates, so that those whom We have required you to approach for the taking of the oath may be more strictly impelled by your very deed to obey Our precepts; and to you, Venerable Brethren, as a perpetual pledge of Our love, We most lovingly impart the Apostolic benediction. — Given at Rome at St. Mary Major under the Fisherman's Ring on 14 May in the year of Our Lord 1739, in the ninth year of Our Pontificate. »
39 Nor indeed was the same Pope Clement XII, content with these prescriptions, however clearly set forth, but also bound the Superior Generals of the missionaries dwelling in the Eastern Indies, especially those who, as it was reported to the Apostolic See, still refused to show an obedient spirit toward the mandates of that same See, to furnish certain proofs, and subjected them under penalties of suspension from the divine offices, deprivation of active and passive voice, and those more severe penalties reserved to his own discretion,
PART III. ON FAITH AND MORALS
40 of the Apostolic See, by formal precept and juridically promulgated, compelled to transmit to their respective Religious examples of the Apostolic Letters then issued by him and to their publication, and exact, complete, and inviolable observance as far as possible, with this law added, that if any one of the missionaries should be found reluctant to the mandates or should dare to act against them, he should immediately by solemn precept through the Superior General be compelled to depart from the Missions and the province, and to return to Europe. And lest any remedy be left untried in so grave a matter, he established a term of three years, within which the aforesaid Superior Generals should be bound to prove to the Apostolic See by certain authentic documents the full and complete observance of the Decrees and Letters beyond doubt, and especially to exhibit examples of the oath, as aforesaid, to be taken, subscribed by the proper hand of each missionary, of whatever Institute he might be. These things thus established and mandates being obeyed, all the Bishops and Apostolic missionaries of the Kingdoms of Madurai, Maisur, and Carnatic, and namely those who had previously stood against the Decree of Cardinal Tournon, by good faith and with oath interposed, promised exact, complete, absolute, and inviolable observance of the Letters, an example of which was inserted above, and which begins Compertum exploratumque, according to the formulas expressed in other Pontifical Letters, which likewise have already been set forth, and which begin Concredita Nobis Dominici gregis. And that they might prove to Us, elevated to the summit of the Pontificate, their faithful obedience and submission to the Holy See by a certain proof, they took care that examples of the solemn oath, which each one took, should be delivered into our hands.
41 This fruit therefore from the prudent and constant course of action of Our Predecessors, which we have thus far reviewed, it has been given to Us to gather: nor do we now seem rashly to have conceived this hope in our mind, that whatever doubts concerning the execution of those things which we have mentioned were prescribed by the same Predecessors still remain, being resolved, as below, by the proposed questions, they may be entirely removed; and all finally the dissensions and controversies among the sacred workers of these regions may be composed and fall silent; and the Apostolic mandates and decrees, which, grave consideration having been premised, and by the counsel of Our Venerable Brethren in the whole Christian republic in the affairs of the Faith, Generals

CAPUT III. DELLA SUPERSTIZIONE
1 « Ai Venerabili Fratelli e ai diletti Figli, Vescovi e Missionari Apostolici nei Regni delle Indie Orientali, Madurensi, Mayssurensi e Carnatense. Pio, Clemente XII. Venerabili Fratelli, diletti figli, salute e benedizione apostolica.
