1 To our venerable brethren, the Archbishop of Rouen, &c., the Bishop of Chartres, and our beloved son the Abbot of the Monastery of Marmoutier near Tours, greeting and apostolic blessing. Today, for the preservation and most salutary increase of our beloved sons, the Rector, the University, the Doctors, Masters, Licentiates, Bachelors, and Scholars of the University of Angers, and also at the supplication of our most dear son in Christ, Louis, the illustrious King of Sicily, we have granted by our other letters of certain tenor, whose tenors and forms we wish to be held as expressed in these presents, by apostolic authority and from certain knowledge, certain privileges, graces, immunities, exemptions, and indults to endure perpetually. And among other things, that henceforth no Rector, Master, Doctor, Licentiate, Baccalaureate, or Scholar residing and persisting in the aforesaid University of Angers, whether present or who shall be for the time being, by virtue of whatsoever apostolic letters or any others whatsoever, and by whatsoever authority, of whatsoever tenor they may be, making full and express mention, word for word, of this indult, can be summoned outside the walls of the city of Angers before any judge, whether ordinary or delegated, or any other (saving only beneficial cases) in any manner whatsoever, provided that he shall have offered to respond before the Conservator of the said University of Angers or his locum tenens to those complaining of him in any manner, and also to stand to law, these letters notwithstanding, as well as apostolic constitutions, indulgences and privileges and other things to the contrary in no way standing in the way. Likewise, that the Rector, Masters, Doctors, Licentiates, Bachelors and Scholars aforesaid, and each of them, either by themselves or through their proctors, concerning personal actions, injuries, damages, monies, debts, or interest, whether by reason of benefices, things, and goods, or monies owed to them from their patrimony, or otherwise, their injurers and adversaries, up to six days' journey reckoned from the city of Angers, can be summoned before the Conservator of the aforesaid University or his locum tenens at Angers, and there such causes can be terminated with due process. Likewise, that henceforth no Rector, Master, Doctor, Licentiate, Baccalaureate, or Scholar persisting in the study of letters in the aforesaid University of Angers, whether present or who shall be in future times, by reason of parochial churches or any feudal benefices of ecclesiastical benefices, whether regular or secular, requiring sacred orders, by persisting in this University, shall be bound to have himself promoted to the orders of Deacon or Priest commonly or separately up to seven years; provided that they shall have sought license to reside in the said University, even if they shall not have obtained it from their superiors, and within the first year from the day of obtaining peaceful possession of their benefices shall have had themselves promoted to the order of Subdeacon. Likewise, that the Rector, Masters, Doctors, Licentiates, Bachelors, and Scholars themselves existing in the said University, whether present or future, that in benefices which they hold, and in the future shall hold, whether they be canonicates and prebends, dignities also in cathedral churches after the greater pontificals, or in collegiate churches principal personates, administrations or offices of the same churches or parochial churches or other ecclesiastical benefices with or without cure, whether regular or secular; so long as they persist in the said University, they are not able to be compelled to reside personally, or to appear personally in the synods of their dioceses. And that meanwhile the fruits of such benefices and of each of them with that integrity with which they would perceive them, if in the same churches or benefices, daily distributions only excepted, they resided personally and made their first residence, they are able to perceive. Provided that parochial churches and other ecclesiastical benefices which they hold and in the future shall hold are not defrauded of their due services meanwhile, and the care of souls, if any falls upon them, is in no way neglected, but is laudably served in them, strictly forbidding the ordinaries of places and others to whom it could in any way pertain, lest against this indult they presume to attempt anything whatsoever, decreeing from then on null and void, if otherwise concerning these things by anyone whatsoever by any authority knowingly or unknowingly should happen to be attempted. Likewise, that if any of the same Rector, Masters, Doctors, Licentiates, Bachelors and Scholars constituted or shall be in the future in the priesthood or hold dignities, personates, or parochial churches, or any other benefices to whose persons it is held by canonical prohibition to be forbidden to read or study laws, obtain or in the future shall obtain, so that each of them is able freely and licitly to study, read, dispute such laws, and exercise any other scholastic and doctoral acts in the same University, and also to receive in them the degrees of Baccalaureate and Licentiate to the insignia of Doctorate also according to the laudable custom and use hitherto observed on this matter in the University and University aforesaid: the Lateran and Lyons Councils notwithstanding, as well as those of our predecessor of happy memory, Pope Honorius III, and other apostolic constitutions and ordinances, as well as statutes also issued in provincial or synodal councils, as well as the customs of churches and places in which such dignities or personates or other benefices perhaps may be, even confirmed by oath, apostolic confirmation, or any other firmness, and all other things to the contrary notwithstanding whatsoever. Provided however that churches and benefices of this kind, which those not promoted do not peacefully hold previously and shall hold for the time being, are not defrauded of their due services and the care of souls in them, which fell upon them, is in no way neglected, we have deemed it right to grant, as is more fully contained in our other letters in these matters. We, wishing that the indults, graces, privileges, immunities and exemptions of this kind and all and singular contained in our letters shall have their effect, so that the Rector, Doctors, Masters, Licentiates, Bachelors, and Scholars of the said University, whether present or who shall be for the time being, may henceforth be able to persist more quietly and perfectly in the studies of letters, lucubrations, and vigils; by apostolic writ, by the tenor of these presents, we commit and command to your discretion, that you, or two, or one of you, through yourselves or another or others, to the aforesaid University, Rector, Doctors, Masters, Licentiates, Bachelors, Scholars, and other persons of the said University, assisting with the protection of effective defense, do not permit the University, Rector, Doctors, Masters, Licentiates, Bachelors, Scholars and the same persons, commonly or separately, concerning privileges, indults, immunities, exemptions, and graces of this kind, or any part of them, directly or indirectly, or by any color sought by any persons whatsoever, and by apostolic or ordinary authority, or any other whatsoever, in any manner whatsoever, to be disturbed, disquieted, and molested, or to have grievances, damages or injuries inflicted upon them, in persons, things, goods, monies, spiritual or temporal rights, or jurisdictions of the same, or to be derogated from in any other manner, or these privileges and indults to be violated, infringed, or even impugned in any way: but rather all and singular of these things commonly and separately, where and when and as often as you shall know it to be expedient, or it shall happen to be required, by any of the aforesaid, by whomsoever, of whatsoever status, degree, habit, or condition they may be, ecclesiastical or secular, by the aforesaid apostolic authority cause to be published and inviolably observed. And if by the aforesaid University, Rector, Doctors, Masters, or Scholars, or any of them, or their proctors, you shall be requested in any manner, concerning all the aforesaid matters, in our said letters of consent, and depending upon the same: and concerning the restitution of all things taken from them in general or in kind, occupied, or detained, as well as of rights, jurisdictions, movable and immovable goods, monies also owed to them, and concerning molestations, injuries and damages, and real, personal, and mixed actions, competent and to be competent to the same, in any manner whatsoever, action, or form, in those matters namely which require judicial investigation, and summarily, simply, and plainly, without the tumult and form of judicial procedure; in other matters however, as the quality of the business shall have required, minister the complement of justice: occupiers or detainers, molesters, presumers, and injurers, and others of this kind, as well as any contradictors and rebels, of whatsoever dignity, status, degree, order, or condition they may be, whenever and as often as it shall be expedient, by apostolic authority, by ecclesiastical censure, appeal being set aside, invoking to this end, if need be, the aid of the secular arm. Notwithstanding, both the constitution of our predecessor of happy memory, Pope Boniface VIII, even that which begins, Proinde intendentes, by which the same predecessor prohibited that no province, city, castle, village, place, territory, or district be subjected to ecclesiastical interdict by ordinary or delegated authority, for a pecuniary debt or any sum of money or quantity of money, whatsoever occasion or cause, or by any color sought; especially for the reason that their lords, rectors, or officials, by whatsoever name they might be considered, or the inhabitants, dwellers, or individual persons, by their statutes, or statutes to be made, ordinances, or ordinances to be made, terms of this kind, had not paid or should pay in the future such debt or quantity; as well as other matters in which it is provided that no one outside his city and diocese, except in certain excepted cases, and in those beyond one day's journey from the end of his diocese, be evoked to judgment, or that judges and conservators appointed by the aforesaid see, outside the city and diocese in which they were appointed, presume to proceed against anyone whatsoever, or commit their place to others, or draw certain persons of quality, or any beyond one day's journey from the end of their diocese, as well as concerning two days' journey in a general council, provided that beyond six days' journey no one be drawn by authority of these presents, or that concerning others than manifest injuries, violences and damages, and others which require judicial investigation, penalties be imposed on them, if they act otherwise, and on those procuring it, conservators in no way involve themselves, than by any other constitutions issued by our predecessors, the Roman Pontiffs, both concerning delegated judges and conservators, as well as persons beyond a certain number not to be called to judgment, or others issued which could in this part in any way stand in the way of your jurisdiction or power, and its free exercise, or if to any persons commonly or separately from the aforesaid see it has been indulted that they cannot be excommunicated, suspended, or interdicted, or evoked to judgment outside or beyond certain places, by apostolic letters not making full and express mention, word for word, of this indult, and of their persons, places, orders and proper names, and any other indulgence of the said see, general or special, of whatsoever tenor it may be, by which these presents not expressed, or not wholly inserted, the explanation of jurisdiction in this part may in no way be hindered, and of which, of each, the whole tenor, word for word, shall be had in our letters special mention. For the rest, we will, and by the same apostolic authority decree, that each of you may pursue an article even begun by another, although the same one beginning it shall have been hindered by no canonical impediment, and that from the date of these presents, there be perpetuated to you, and to each of you, in all the aforesaid matters, and their individual parts, begun and not begun, present and future, perpetuated power and jurisdiction attributed, so that by that force, and with that firmness you may, in all the aforesaid matters begun and not begun, present and future, and for the aforesaid, proceed, as if all and singular the aforesaid had been begun before you and your jurisdiction, and that of each of you, in all and singular the aforesaid, by citation, or by another legitimate mode had been perpetuated, the aforesaid constitution concerning conservations, and any other issued to the contrary notwithstanding, enduring for perpetual future times. Given at Rome at St. Peter's, on the fifteenth day before the Kalends of April, in the third year of our pontificate. Thus signed. F. de Monte
