2 Const. Bened. PP. XIV. 12 Sept. 1744.

2 Const. Bened. PP. XIV. 12 Sept. 1744.

Quod quidem a se editum decretum a Missionum illarum Provincialibus et Superioribus sub poena excommunicationis latae sententiae, a caeteris vero subditis missionariis sub poena suspensionis a divinis ipso facto incurrendae, inviolabiliter observari, et executioni mandari praecepit, donec aliter Apostolica Sedes provideret.

1 mixing lawful feasts with forbidden ones, as was defined in the fourth petition.

2 Const. Bened. PP. XIV. 12 Sept. 1744. — Of all the cares which have been entrusted to Us, by divine counsel altogether and by no merit of Our own, constituting the most grave and formidable burden of the supreme and universal Pastor beyond measure, that which is chiefly potent and which more greatly stirs Our mind and keeps Us perpetually anxious and troubled is this: that We preserve intact and undefiled the deposit of Faith committed to Us; and therefore We direct all Our study and effort to this end, that the streams of heavenly doctrine flowing widely over the face of the earth be corrupted by no mud of corruption or poisoned by the venom of error, and while the evangelical light is diffused on all sides, it be not perchance obscured by any gentile superstition; and that those whom merciful God, having drawn from the power of darkness, breaking the iron fetters of infidelity, called into His admirable light and raised to the hope of eternal salvation and inheritance, believing with their heart unto justice and proving by their works what they believe, and exhibiting themselves as worthy members of the mystical Body of Christ, which is the Church, may say the same thing which the Apostle ardently desired, and be perfect in the same mind and in the same judgment. Hence, when it first pleased the Most High to raise Our humility to the summit of the supreme Apostolate, We resolved never to spare any labour which We perceived would be profitable and necessary, not only for propagating throughout all the earth the knowledge of Faith and salvation, but also for fostering and confirming the unity of spirit and doctrine among the faithful everywhere, or, where it should be necessary, for reconciling and establishing it, with God's help.

3 But since for this reason We directed the gaze of Our mind even to the uttermost regions of the earth, and fixed it particularly upon those new shoots of Christianity which, divine grace watering them, have long since sprouted in the new churches of the Kingdoms of Madurai, Maisur, and Carnatic, We feared that no small matter of labours and cares would be brought to Us from thence, while We recalled to mind how much and how long the industrious effort of Our Apostolic Predecessors had laboured, that from the churches of the aforesaid Kingdoms, newly coalescing, they might root out utterly the tares of vain observances and rites abhorrent from Christian religion, and might compose and eliminate the troublesome controversies arising among the very sacred workers of those regions in so grave a matter, and, what was more to be lamented, persisting even in Our own times through the work of the enemy of mankind. Yet placing Our confidence in the Lord, who bends human minds, where He wills, mightily and sweetly; especially since, when arguments having been brought to Us of filial obedience, by which most of the missionaries of those parts professed that they receive the decrees of this supreme Apostolic See, it was set forth to Us that, finally, to settle all the controversies concerning these matters and to compose and establish the state of the aforesaid churches, nothing else remained save that to certain petitions which were proposed to Us on the part of some such workers, fitting resolutions and responses should proceed from Apostolic authority; We were raised to great hope that, the doubts proposed being removed through opportune rescripts, and finally Our definitive mandates and precepts of this Apostolic See being issued and promulgated, a desired end might at length be put to the long and troublesome dissensions which, infecting the fruit of evangelical preaching once disseminated in the aforesaid Kingdoms, and agitating the very offspring of the new churches with violent tempest of discord, had brought matters to such a pass that so many distinguished heralds of God's word seemed to have laboured without cause and to have poured forth abundant sweat and even blood in vain.

4 For, to pass over many things which have occurred in this matter in times past; the more serious controversies which we have alluded to broke out, or rather were renewed, at the very beginning of this century, when there was sent by our predecessor of happy memory, Pope Clement XI, to the Coromandel Coast, the blessed Charles Thomas, then Patriarch of Antioch with the power of Legate a Latere in the East Indies, Commissioner and Apostolic Visitor, afterwards called Cardinal Turnonius of this Holy Roman Church. For when he had arrived there, having called to account certain ceremonies which were observed by some missionaries, or permitted, but by others were rejected as not at all conformable to the spirit of Christian piety, whence arose seeds of discord and most disastrous disputes, having investigated with the diligence which was fitting the facts and circumstances, he judged it to be expedient for Christian matters, and his office required, to proscribe and condemn by grave interdict many such ceremonies, and having issued an edict or decree, to prescribe a certain norm for the missionaries, which all should observe in cultivating that Lord's field, so that the seed of the divine Word, with the tares and thorns cut away, might strike deep roots and be propagated most happily. This decree issued by him he commanded to be inviolably observed and carried into execution by the Provincials and Superiors of those Missions under penalty of excommunication incurred by the very fact, and by the other subject missionaries under penalty of suspension from the divine offices incurred by the very fact, until the Apostolic See should provide otherwise. An example of such a decree is, namely, this:

5 "Charles Thomas Maillard de Tournon, by the grace of God and the Apostolic See, Patriarch of Antioch, Domestic Prelate of His Holiness Lord Clement, by divine providence Pope XI, and assisting at his Pontifical Throne, and also Consultant of the Holy Roman and Universal Inquisition against heretical depravity, and in the East Indies, and the Empire of China, and the neighboring islands, Commissioner and Apostolic Visitor with the faculty of Legate a Latere, etc. Among the graver cares by which we are pressed in the office of Apostolic Visitor enjoined upon us, although unequal to so great a burden, that one is surely chief, since we consider that we have been sent here to cleanse the Lord's field of tares suffocating the tender shoots of Christ, and we shall have to render an account for the sins of others, whom we justly fear the eternal vengeance of God for our own never sufficiently expiated sins. Wherefore as soon as we arrived at these shores of the Indies, turning the eyes of our mind through those vast eastern regions, while our body was held back by a persistent illness, we took care to inquire everywhere into the needs of the Missions, so that we might provide them with fitting remedy as far as we were able. And indeed, among the first matters which came to our attention were the new vineyards of the Lord in the Kingdoms of Madurai and Maysur, and more recently Carnatic, planted by the evangelical workers of the Society of Jesus, Portuguese and French, by almost the same laws and equal labor, where amid the persecutions of pagans and gentiles, and amid so many hardships of life, the green shoots of the Gospel flourish, irrigated by the constant labors of the missionaries. We would indeed have wished to be there, no less partakers of labor than of joy in Christ Jesus, had not a prolonged infirmity prevented us. But what we were not permitted to obtain by our own immediate presence, was opportunely supplied to us and to the Apostolic See by the obedience shown by the Fathers Venantius Bouchet, Superior of the Carnatic Mission, and Charles Michael Barthold, missionary of Madurai, men distinguished by learning and zeal for the propagation of the Faith. For indeed, when from them, versed as they are from long experience of life in the customs, language, and religion of these regions, we learned more certainly many things which render these shoots weak and barren of fruit, inasmuch as they cling more to the vanities of the gentiles than to the vine, which is Christ, in much experience of tribulation our joy was abundant. Therefore, matters having been submitted to mature examination, and the said Fathers having been heard at length both orally and in writing, and the aid of God having been implored by public prayers, so that we might salutarily consult in the Lord for the purity of the Faith and the spiritual increase of Christians, and so that the offering of the gentiles may be acceptable and sanctified in the Holy Spirit, we have come to the present Decree by Apostolic authority, even with the faculty of Legate a Latere."

6 "And beginning with the administration of the Sacraments, we strictly prohibit that in baptizing both children and adults of whatever sex and condition, the sacramentals be omitted, but all shall be openly employed, and especially saliva, salt, and insufflation, which the Catholic Church has received from Apostolic tradition, and on account of the hidden mysteries of divine goodness toward us in these sacred ceremonies, has kept holy and inviolably; the decree of the Holy Universal Roman Inquisition made in the year 1056 for the Chinese, on account of various reasons and circumstances, notwithstanding in no way." Likewise we command that according to the custom of the Church a name of some Saint described in the Roman Martyrology shall always be imposed upon the one being baptized by the one baptizing, with names of idols or of false religion altogether forbidden, by which the pagans are accustomed to use, and neophytes have been accustomed to be called hitherto, before they were reborn through Baptism to divine grace. Nor is it permitted to parish priests or missionaries under any pretext to change the names of the Cross, of Saints, and of sacred things by translation, nor to explain them in another language, except Latin, or at least in the Indian language, insofar as the Indian words of the region correspond clearly and precisely to the Latin signification."

7 And because we have heard that the Baptism of infants born from Christian parents is often and very often delayed by the negligence of the same, not without the greatest peril to the salvation of the said infants, we admonish the evangelical workers that, mindful of the sacred canons, they set before the parents a shorter term than can be done, having regard to circumstances, gravely burdening their conscience, unless they bring their sons within the prescribed time to the church to be washed in the sacred font." Moreover, since it is the custom of this region that infants of six or seven years, sometimes also at a more tender age, by the consent of their parents, contract an indissoluble marriage in the present by the imposition of Jally, or a golden nuptial token, hanging from the wife's neck, we command the missionaries that they do not permit such invalid marriages to be made among Christians nor allow the spouses thus joined to cohabit, until, having reached lawful age and their consent having been ascertained, they shall have contracted a true and canonical marriage in the face of the Church, according to the form prescribed by the Sacred Council of Trent. And since among the more learned followers of that impious religion the Yally presents an image, although unformed, of Pulleyaris, or Pyllaiaris, an idol placed over nuptial ceremonies: and since it is unbecoming for Christian women to wear such an effigy on the neck as a sign of marriage, we strictly prohibit that henceforth they dare to hang the Jally with this effigy on the neck; and lest wives appear unmarried," they may use another Tally, or one adorned with the Most Holy Cross, or of Our Lord Jesus Christ, or of the Most Blessed Virgin, or some other religious image. And since a cord composed of one hundred and eight threads, and anointed with saffron juice, by which many attach the said Tally, is not free from superstition, we also prohibit the number of the said threads and the anointing." The nuptial ceremonies also according to the custom of these regions are so many and so stained with superstition that no safer remedy could be applied than by forbidding them altogether, since they everywhere abound with the harmful stain of paganism, and it is most difficult to purge them of superstitious elements. But truly, so that we may indulge in the Lord, as far as can be done, in an easier way of conversions and for the convenience of neophytes, we enjoin upon the missionaries, and especially upon the Superiors of the Missions, that with new diligence applied and with stricter reckoning, they expunge all superstitious elements from the said ceremonies, so that nothing be left unpunished that offends Christian piety and smells of gentile superstition, and especially, besides those reforms which we have heard have already been established in this matter by the same missionaries, the branch of the Aresciomara tree shall be altogether removed; the number of dishes, no less than the prescribed quality of food, shall be varied; Concerning the celebration and ceremonies of marriages.

Concerning menstruating women not to be excluded from the Sacrament of Penance.

Concerning the sick even of the lowest class to be aided by sacred ministry.

8 circles over the heads of the spouses for the purpose of warding off evil deeds be omitted; and what we have said concerning dishes, let it be understood that we have likewise said and forbidden concerning earthen vessels customarily used there; the fruit also commonly called Cocco, from the breaking of which the pagans rashly draw omens of prosperity or misfortune, let it either be entirely rejected from Christian marriages, or at least if they wish to eat it, let it not be done publicly, but secretly, and outside the solemnity let it be opened by those who, taught by the light of the Gospel, are alien from such divination nonsense. » Let no one who is rightly and sufficiently disposed be barred from the Sacrament of Penance, for the remission of sins, as an instrument of divine mercy instituted by Christ the Lord, and especially women suffering from menstrual infirmity; not regarding the days of purification according to the custom of the pagans, since this sacramental true purification of the soul, and no other » is to be observed by the Christian faithful, and by their » pastors, to whom moreover it is not permitted either by themselves, nor through catechists, nor through any others whatsoever, to prohibit the said women from access to the church, or to the confessor, during the said infirmity, and the said time of purification. It is also unbecoming for a Christian » virgin's modesty to make known the said infirmity, when suffering from it for the first time, to relatives, neighbors and friends, and to publish it shamelessly, and with them, after the manner and rite of the pagans, gathered in her » house, to institute a celebration over so sordid a matter. Wherefore we utterly forbid and abolish such celebrations and rites to orthodox girls, and we enjoin missionaries not only to admonish them, but also their parents, how discordant such obscene custom is with the laws of virginal modesty, which appears to have been introduced by pagan shamelessness, so that thus the modesty of girls being undermined, they might be able to provoke them immoderately to lust. » We likewise cannot bear that spiritual physicians should deny to souls for their salvation those offices of charity which pagan physicians, even of noble birth, or chaste, do not disdain to render for bodily health to the sick, even those of abject and lowest condition commonly called Pareas. Wherefore we strictly command missionaries that, as far as in them lies, no one of the Christian sick, however much a Pareas, and of baser condition if such existed, be left without the desired supply of a confessor in infirmity; and lest, with diseases growing worse, with the gravest danger of temporal life, they be forced to provide for the eternal, we command the same missionaries not to wait for such sick of this condition to be brought to the church, but more prudently to seek their homes, where they are sick, to the best of their ability to visit them, and to refresh them with pious discourse and prayers, and with the food of the Sacraments, and finally to anoint them in the external »

9 distinction constituted in the holy oil of the sick, without respect of persons or sex, expressly condemning any practice contrary to this office of Christian piety. » Not without the greatest sorrow of our heart have we also learned that Christian drummers, flute-players, or players of any other musical instrument are summoned to the festivals and sacrifices of idols, to play, and sometimes even compelled, on account of a certain servitude toward the public contracted by them through the exercise of such art, and it is not easy for missionaries to turn them away from this detestable abuse. Wherefore, considering what a grave account we should render to God if we did not, to the best of our ability, recall such Christian faithful from the honor and worship of demons, we forbid them, that they henceforth dare not, neither in pagodas, nor outside, whether on the occasion of sacrifices, or of any solemnities imbued with superstitious worship, to play or sing, under penalty of excommunication latae sententiae, since in no way is it permitted for the servants of Christ to serve Belial; and therefore missionaries shall not only be bound to admonish them of the aforesaid prohibition, but also to carry it out entirely, and to expel from the Church those who act contrary, until they repent from their heart, and have amended the scandal committed by public signs of penance.
