surense e Camatense.
CLEMENTE PAPA XII.
Venerabili Fratelli, diletti Figli, salute e Benedizione Apostolica.

§ 19. Ai Venerabili Fratelli, Vescovi nel Tenore dei Regni dell'India Orientale di Madurai, Maisore, Sirensi e Carnatesi,

CLEMENTE PP. XII.

17 in simili forma Breve.

18 Venerabili Fratelli, salute e Apostolica Benedizione.

CLEMENT POPE XII.
Venerable Brethren, beloved Sons, greetings and Apostolic Benediction.

1 * The care of the Lord's flock entrusted to Us compels Us especially and with all solicitude to apply ourselves to this end, that from those chiefly who have received a share of this Ministry and have been sent as a light to the Gentiles, filial obedience toward the Holy Faith and Apostolic mandates may be exhibited, and that they themselves retain the dogmas of Faith, the sacred rites of the Church, and may teach others, so that those whom the immense distances of these regions separate far from the See of Peter may nevertheless be joined together by the same Faith in the unity of spirit and doctrine. Therefore, by similar letters of Ours beginning with the date 1744, We have made inquiry and investigation: We have requested Your Fraternities and all the Missionaries with the paternal affection of charity as much as We were able, and We have declared how earnestly We desire that those who in these Kingdoms, recognizing the truth of the Faith of Christ, are converted, should entirely cast off the superstitions and rites of the Gentiles and turn away

2 Another letter of the same, in the form of a Brief to the Bishops and Missionaries, given on 13.

3 May 1739. The beginning with mention of the foregoing letter to the same persons being set forth, lest they themselves be held, in the manner of those who, while worshipping the Lord, also served the gods according to the customs of the Gentiles: and so that in a matter of such importance there should be no occasion of offense, having heard the suffrage of the Theologians and especially of Our Venerable Brethren, the Cardinals, General Inquisitors throughout the whole Christian Republic, We have providently established many things according to the doubts then proposed, and have prescribed them to be observed by the Missionaries; the observance of all these by Us, whether the zeal for increasing the Faith, fills Us with certain hope that with equal effort they will strive to obey according to their strength, nor will there be any who thinks that by detestable indulgence things could be done otherwise, and like unfaithful sons, cause them to commit a great sin: Although indeed by these means We might be persuaded that We have satisfied Our office and should be without solicitude; nevertheless, the observance of the sons and the execution entrusted to them under censure and other penalties

4 Under which it is prescribed to them, that the mind, upon which the purity and integrity of the Faith depend, shall never remove this care from us, unless we always procure remedies more suited to the magnitude of the business. Wherefore to Your Fraternities and to all Missionaries, to whom We have directed the aforesaid Our Letters, whether they be Secular, or Regular of whatsoever Religion, Congregation, Institute, Society even of Jesus, We entrust and command, that all and singular things which are contained in the said Our Letters, you observe wholly, exactly, and inviolably, and cause them to be observed precisely by those whose care pertains to you, with all power of interpreting otherwise utterly removed, in virtue of holy obedience, under penalty of suspension from the exercise of Pontifical functions, Interdict from entering the Church, and respectively excommunication latae sententiae, from which none of you by anyone, except by Us, or the Roman Pontiff existing for the time being, saving only at the point of death, can be absolved, and as regards Regulars moreover deprivation of active and passive voice, incurred even by the fact itself, and without any other declaration. Likewise, under the same penalties and censures, with equal authority We command and decree that all and singular, who from this Holy See, or from your respective Superiors shall be sent to these Kingdoms for sacred Missions to be performed, as soon as you shall be made certain of these Our Letters, or shall have knowledge of them by any other announcement, shall take an oath, wholly, exactly, and in every way to fulfill those things which have been providently established by Us in the same Letters, nor shall you in any part contradict them under any pretext. To those also, who shall at any time undertake this office, We command and prescribe under all the same censures and penalties, that they dare not in any way perform even the least act, unless they first and themselves shall have taken the aforesaid oath, nor even as Secular Priests be appointed by the Ordinaries of Places, or as simple Religious or by any other title and name, receive the Confessions of the Faithful, deliver Sermons, or minister the Sacraments, but be altogether deprived of power; derogating from whatsoever privileges, granted to themselves, or to your respective Religion, Order, Congregation, and Society, even of Jesus, specially or generally by Us and by Our Predecessors for whatsoever cause. The aforesaid oaths We demand that Secular Missionaries take before the Ordinaries of Places, Regulars before their Superiors, or Apostolic Vicars, and the Vicars themselves and Superiors in the hands of Bishops. Nor are they to profess the same by word only, but in writing according to the form prescribed by Us, and noted below, and to sign with their own hand, under the same Censures and penalties. This oath also We command to be taken and require from those who shall have merited promotion to the Episcopate by this Holy See, either on the very day on which they shall be about to make solemn profession of Faith in the hands of Bishops, or in the act of their consecration. Of which oaths the signed copies, with an authentic copy left here in the Archives, are to be transmitted to the Congregation of the Propaganda of the Faith, by the Bishops and Superiors of Regulars respectively. Anno 1744.

5 oath to be taken concerning the faithful fulfillment of all things contained therein.

6 No one henceforth in any

7 wise title shall involve himself in the exercise of Mission, unless he shall have taken an oath of this kind. The same is to be observed by Bishops.

12 P o » T. hinus, from which to the S. Office they shall be remitted, A. V., so that they may be obedient toward Us, and our commands, monuments of purity and integrity of your Faith, and so that no one from the bearers of Our Letters under the aforesaid style from 24 August 1734, as well as of the present ones, shall be able to allege ignorance of them, We exhort your Fraternities, and in the Lord beseech you, that as soon as you shall have received those and the present ones, you immediately transmit them to each individual Missionary, whether Bishops and Regulars, or Regulars, living under your respective Jurisdiction. This We command to the present Apostolic Vicars, and other Superiors of Regulars; those acting contrary, or being negligent, We declare to incur by that very fact the penalty of suspension from the exercise of Pontificals and interdict from entrance into the Church; Regulars moreover excommunication latae sententiae, and privation of Offices, and of active and passive voice. The Formula of the oath, as is premitted, to be taken by Missionaries, is that which follows, namely. "I, N., of the Order N. or of the Society of Jesus, Missionary to the Kingdom N. or to the Province N. in the East Indies, sent or assigned by the Apostolic See, or by my Superiors according to the faculties granted to them by the Apostolic See, obeying the precept of Our Most Holy Lord Pope Clement XII, by Apostolic Letters in the form of a Brief given on 13 May in the year 1739, enjoined upon all Missionaries in the said Missions, to take the oath of faithfully observing the Apostolic disposition concerning the Malabar rites according to the form of the Apostolic Letters in the form of a Brief of the same Most Holy Lord Our on 24 August 1734, beginning Compertum, explored and ascertained: to me through the complete reading of the same Brief, well known; I promise that I shall fully and faithfully obey, and shall exactly, integrally, absolutely, and inviolably observe it, and shall fulfill it without any evasion, and according to the form of the said Brief shall instruct the Christians committed to me both in sermons and in private instructions, and especially Catechumens, before they are baptized, and unless they promise observance of the said Brief, and its dispositions and prohibitions, I shall not baptize them, as also I shall take care with all study as I am able, and with all diligence, that the ceremonies of the Gentiles being removed, those rites which the Catholic Church piously prescribed shall be received and retained by Christians. But if (which God forbid) I shall have acted contrary in whole or in part, as many times as I shall have done so, I acknowledge and declare myself subject to the penalties imposed by Our Most Holy Lord in the Decree or Apostolic Letters, as above, upon the taking of this oath, known to me through the complete reading. Thus touching the Holy Gospels I promise, vow, and swear. So may God help me, and these Holy Gospels of God." I, N., by my own hand.

13 The formula of the oath to be taken by Bishops, as above stated, is as follows, namely: "I, N., Bishop of the City of N., mindful of the oath taken by me in the act of my solemn Consecration, by which I promised faith, subjection, and obedience to the Roman Pontiff, and moreover of those things which prudently ordained Clement XII, Supreme Pontiff, concerning the Malabar rites in Apostolic Letters in the form of a Brief, transmitted to Bishops and Missionaries up to the day 24 August 1734, obeying the mandates of His Holiness by other similar Letters on 13 May in the year 1739 enjoined, so that as a token of my obedience toward the Apostolic See no less than of filial respect, I bind myself by the religion of an oath, I swear and promise that I shall fully and faithfully execute those same Apostolic Letters under the said day 24 August 1734, and that I shall observe exactly, entirely, absolutely, and inviolably those things which are prescribed in them, and I shall likewise take care, insofar as it shall be in me, that all those who are Missionaries and Priests in my Diocese, or shall be in the future, shall keep and execute those Letters in the same manner in all respects, and against the disobedient, if there shall be any, I shall proceed according to the form of the Brief under the day 13 May in the year 1739, so that at length, with the ceremonies of the Gentiles removed, there may be received by Christians those rites which the Catholic Church piously prescribes and continually observes. And so that there may exist a perpetual monument of this my will, oath, and filial obedience toward the Roman Pontiff and his mandates, I subscribe with my own hand."

14 I, N., Bishop of N.

15 Exhortation Although We have great hope in you, Venerable Brethren, and in all your Missionaries, that you will receive our voices and admonitions carefully and carry them out with filial obedience, and that you will take great care and solicitude so that you may be a help both to the purity and integrity of the Orthodox Religion and to the salvation of the Gentiles, and that you will devote all your labors and efforts to this one matter, which is indeed of the greatest importance, so that finally those who embrace the Faith of Christ may turn away from superstitious rites and may receive and retain only those which the Catholic Church piously prescribes and continually preserves; nevertheless, by reason of the duty of Our Pastoral Office and the impulse of Paternal Charity, We do not cease to admonish you again and again, lest We be judged by the Prince of Pastors to have been less vigilant in the custody of His Flock; and We impart to you in the meantime as an auspice of all good things the Apostolic Blessing. Given at Rome at St. Mary Major under the Fisherman's Ring on the 13th day of May in the year 1749, in the ninth year of Our Pontificate.

16 § 12. The same Clement XII. Other Letters followed, written to the Bishops of those aforesaid Regions in particular, in which the same Pontiff both made known the grief conceived in his mind and the fact that he had not yet received certain and desired notice of the due observance of the Apostolic mandates, and revealed this in grave words, and took care to stir up the zeal and piety of those Bishops, so that they themselves, going before by example and diligence, might carefully promote the obedience of the others. An example of such Letters is this.

§ 19. To the Venerable Brethren, the Bishops in the Eastern Indian Regions of Madurai, Malabar, Sirensi, and Carnatensi,

CLEMENT PP. XII.

17 in similar form Brief.

18 Venerable Brethren, health and the Apostolic Blessing.

19 We cannot restrain Our lips from addressing you, Venerable Brethren, with an Apostolic voice; We bear it with difficulty, indeed heavily, that We have not yet received certain notice of what finally has come to pass regarding Our Letters, which We gave to you and to the Missionaries dwelling there on the 24th of August, 1734. Surely this silence is a cause of care and anguish to Our paternal love toward you, and especially because, although uncertain, scattered reports have reached here that these Our Letters and Decrees have not been made public by all, nor have they been carried out exactly as they ought to be, and that there are not lacking some who, thinking and speaking otherwise, lead disciples after them. Wherefore first We earnestly beseech your Fraternities that you report to Us as soon as possible how matters stand there, lest a longer delay bring Us more bitter vexation; then We are led by firm hope that, God impelling you, you will rise up with Us in sound doctrine against those who contradict, so that, mindful of the office to which they have devoted themselves, they may carefully beware and diligently provide that the fault be not theirs: These Gentiles fear the Lord, but nevertheless also serve their Idols. For this reason We have sent other Letters to your Fraternities and to the Missionaries, in which under graver penalties We command that they obey the senses of Our will and Decrees and fulfill them in deed. But lest, as heretofore, one accuse another, and We, who although present in spirit, absent in body, be kept in suspense by uncertain reports for a long time,

20 He signifies the sense of the foregoing Letter and stirs up the zeal of the Bishops for the fulfillment of all that has been commanded.

21 408 Benedict XIV.

22 We have deemed it necessary to require an oath to be signed by each one of the Missionaries with his own hand, by which each one professes that he will render prompt and exact obedience to Our commands, as is more fully contained in those Letters. Although We may safely promise this for the piety and religion of all, yet the authority of your example will be of great weight, whenever you understand that the same oath, as a testimony of your obedience toward the Holy See and toward Us, has been taken and sent to Us, as We beseech you again and again in the Lord. Moreover, We do not doubt that you will easily recognize that this is the one way of uncovering the truth, one safeguard for closing the mouth of iniquitous speech; wherefore you will bind the Pontifical will, which is otherwise inclined toward you, more and more to yourselves, if you add force to your industry, thought, and study by example; nor do we fear that you will not more clearly explain at this opportune occasion that reverence which, upon receiving the Episcopal office, you promised to this Holy See and to the Apostolic mandates, so that those whom We bind to come to you to take the oath, may be more tightly impelled by your deed also to obey Our precepts, and to you, Venerable Brethren, as a pledge of Our love in perpetuity, We impart the Apostolic blessing with affection. Given at Rome
