Faculty and privileges granted to the chaplains of his pontifical chapel.
Pope Innocent X, for perpetual remembrance of the matter.

Grateful for the familiar services of obedience, which from the beginning of our pontificate...

chosen Alexander Brunacchius, of the city of Castellana; Horatius Bovius, of Ferentina; Francis Anthony Porticella, master in sacred theology, of Benevento; Sebastian Francus, doctor of both laws, of Anagni; John Dominic of Rubeis, doctor of both laws, of Matera; and John Anthony Barnabaeus, of Perugia, of their respective cities or dioceses, priests, present chaplains of our pontifical chapel and our familiar servants, have hitherto rendered to us and the Apostolic See and continue to render with diligent zeal, and moreover the honesty of life and morals and other1 praiseworthy merits of probity and virtue, by which we have perceived their persons to be supported both by familiar experience and also by trustworthy testimonies of worthy faith, move us to show ourselves liberal toward them in granting grace. § 1. Hence it is that we, wishing to pursue them with abundant special favors and graces, absolving them from any excommunication, suspension and interdict, and other ecclesiastical sentences, censures and penalties, whether from law or from man, imposed for any occasion or cause whatsoever, if they are bound by them in any manner, by the tenor of these presents for the purpose of obtaining the effect of these presents alone, and holding them to be absolved,

and from any excommunication, suspension and interdict, and other ecclesiastical sentences, censures and penalties, whether from law or from man, imposed for any occasion or cause whatsoever, if they are bound by them in any manner, by the tenor of these presents for the purpose of obtaining the effect of these presents alone, and holding them to be absolved,

§ 2. By our own motion, not at the instance of the aforesaid Alexander, Horatius, Francis Anthony, Sebastian, John Dominic, and John Anthony, or any of them, or of others petitioning us on this matter, but from our mere deliberation and certain knowledge, by apostolic authority, by the tenor of these presents, we receive Alexander, Horatius, Francis Anthony, Sebastian, John Dominic and John Anthony aforesaid, and each of them, as our and the Apostolic See's notaries, and counts of the sacred palace and the Lateran court, without prejudice however to the beloved sons, the notaries of the number of participants, and we create and constitute them as Roman nobles, and citizens of the City of Rome and of all and each of the other cities, lands and places subject to the Holy Roman Church mediately or immediately, and we refer and enroll them in the number and fellowship of our other and the same See's notaries, as well as of the palace and court counts, and of Roman nobles, and other citizens of the aforesaid cities and towns, and to them, even if they do not wear the habit and rochet of notaries of the said See according to the decree of the Lateran Council most recently celebrated, or do not inhabit such cities, nor have ever had domicile in the same cities, so that in all and whatsoever privileges, faculties, exemptions, immunities, liberties, favors, graces and indults, by which all our other notaries, even of the number of participants, as well as counts and nobles, and original citizens, even in the acquisition and exercise of dignities, ecclesiastical and secular benefices, even from the persons of Roman originaries becoming vacant, both in the City and in the aforesaid cities, and in others, everywhere in places and nations, as well as session and convention2, use, enjoy and possess, and will be able to use, enjoy and possess in any manner in the future, not only in their likeness, but equally and in the same principal manner, and as if privileges, faculties, exemptions, graces and indults had been issued for them themselves (except however the exemptions taken away by the Council of Trent, so that not only as to criminal matters, but also as to civil matters they are subject to the Ordinaries, and, concerning the faculties of legitimating, of promoting to degrees, and of creating notaries or tabellions, and other such privileges claimed by notaries of the Apostolic See and counts palatine, so that the aforesaid familiar chaplains of ours may in no way use them, and it be null and void, if otherwise it should happen to be attempted concerning these things by anyone, by whatever authority, knowingly or unknowingly), use, enjoy and possess, and in all and each of the apostolic and other letters, instruments and public and private writings hereafter to be drawn up in their name, inscribe themselves as notaries, counts and nobles, and created of noble lineage from both parents, as they shall wish; § 3. And likewise as Romans and citizens of the same cities treated with them, as they shall please, and subscribe themselves to them; and be held as true and not fictitious notaries, counts and nobles, and citizens, and nothing whatsoever it may be with such expressions surreptitious, obreptitious, or invalid, but let that same thing be efficacious in all things and through all things.

§ 4. Furthermore, with the same persons, so that they may be able to retain offices, and although two or more, or simple ones if they wish, under each of three buildings of any three cathedral churches, even metropolitan ones, or other churches existing, even if one of all these with care, or a dignity, even greater and principal, a canonry and prebend, a personage, an administration, or an office shall have been, and to a dignity, personage, administration or office of this kind someone shall have been accustomed to be assumed by election, and to it care even of jurisdiction over souls shall pertain, if they are otherwise canonically conferred upon them, or elected, presented, or otherwise assumed to them, and instituted in them, to receive, and provided that all those, one excepted, do not require personal residence, to retain together as long as they live;

§ 5. Likewise also, as long as they serve us only, in ecclesiastical benefices, although personal ones, yet not parochial or having care of the souls of parishioners, obtained through them for the time being, even by law, statute, foundation, or privilege requiring personal residence, even if dignities in metropolitan or in cathedral churches be greater, and in collegiate churches of this kind principal, they shall not be bound to reside personally, nor can they be compelled to reside in them for the time being by the Ordinaries of places, or by the chapters of the same churches, or by any others, and all and singular the fruits and revenues of those benefices obtained during the aforesaid service with that integrity (daily distributions only excepted) with which they would perceive them, if they personally resided in the same churches or places, to perceive, exact and levy, provided however by them, that the burdens incumbent on the same dignities and benefices in any way be suitably borne;

§ 6. Likewise, even if they shall have been priests, and shall have obtained dignities and offices, civil laws and rights, even publicly in schools and universities of general studies for five years only, provided that the same shall not have exceeded the thirtieth year of age, to hear, and, if found able and sufficient, even to have themselves promoted to the doctorate degree in such faculty, and the same laws even to teach publicly, and to exercise freely and lawfully the office of judge, advocate and proctor in ecclesiastical and civil causes only, we dispense by special gift of grace.

§ 7. It shall be permitted also to them, and to each of those whose delict for the penalty of excommunication in the case of each, to choose some suitable presbyter approved by the Ordinary of the place, either secular or of any regular Order, as their confessor, who, life accompanying them, them and each of them from any sentences of excommunication, censures and penalties, from law or from man, by any occasion or cause imposed, and incurred by them, and by which it shall have happened that they are ensnared for the time being, even if absolution to us and our successors the Roman Pontiffs for the time being existing be specially or generally reserved, and in the transgressions of any vows and precepts of the Church, casual homicide, violent laying of hands on any persons even ecclesiastical (not however bishops, or other superior prelates) from the past, or the giving of counsel or favor to it, omissions of fasts (not however the recitation of canonical hours and other divine offices), and finally from all and any other their sins, crimes, excesses and delicts, however grave and enormous, even such on account of which the aforesaid See would merit to be consulted, namely those contained in the letters customarily published on the day of Coenae Domini, once only in life and at the article of death, in other matters however reserved in any way to the said See, and in other cases whatsoever, once in a year, their confessions diligently heard, yet without prejudice to any, by the aforesaid apostolic authority to absolve, and to enjoin upon them for those committed a salutary penance according to the measure of the fault,

§ 9. And also to these same persons, and to each of them individually, that whosoever local Ordinaries, or canons of metropolitan1, or other cathedral churches, or persons constituted in ecclesiastical dignity, both in the said court and outside it, even to be chosen or chosen for this purpose by them or by each of them before a notary and trustworthy witnesses, may cancel and extinguish whatsoever annual pensions assigned to them and to each of them individually upon the fruits, revenues, proceeds, rights, emoluments and distributions, even daily ones, of abbatial, episcopal, or archiepiscopal tables, or of any other ecclesiastical benefices, with cure and without cure, secular and of any Orders of regulars, even of St. John of Jerusalem, howsoever and in whatsoever manner qualified, or in place of those fruits, proceeds, rights, emoluments, distributions and emoluments now and for the time being assigned and reserved to them at any time, together or successively, in whole or in part, up to the sum of one hundred ducats of gold of the camera, with the consent of the same chaplains or of any one of them, in whole or in part, even at the point of death, and after they have been cancelled and extinguished, may assign other similar annual pensions upon the fruits, revenues, proceeds, rights, emoluments, distributions, or in place of those, fruits, revenues, proceeds, rights, emoluments and emoluments of this kind, even up to the aforesaid sum, to one or more other persons, even to be named by the same chaplains and by each of them, even to those holding, expecting, or wishing to be marked with the clerical character whatsoever, whatsoever and of whatsoever kind ecclesiastical benefices, similarly to them as long as they shall live, or to their legitimate procurators, in the same manner and form in which they were assigned to the same chaplains, or were granted or conceded to be reserved or assigned, even without the consent of those who ought to pay the same pensions, and pensions and fruits, revenues, proceeds, rights, emoluments, distributions and emoluments of this kind, even if cancelled multiple times and newly assigned, up to the aforesaid sum and quantity, and otherwise with all and whatsoever exemptions, privileges, decrees, clauses, cautions, bonds, obligations and safeguards, and also censures and penalties granted and contained in prior reservations of this kind, to be paid in full, we reserve, constitute and assign, § 10. And also, that the same chaplains and each of them may dispose by will of all and singular houses, lands, possessions, territories and places, even jurisdictional ones, and other goods immovable and movable (which however are not of the altar or altars of the churches committed to the ministry of our aforesaid chaplains, or specially appointed to the divine worship or use of any of the same churches) and moving things, of whatsoever quality, quantity, value, kind, price and condition existing, and rights and actions pertaining to them by reason of churches, even cathedral and metropolitan ones, monasteries, priories, prepositorships, dignities and any other ecclesiastical benefices whatsoever, with cure and without cure, secular and of any Orders of regulars, which they have obtained and obtain and shall obtain from any apostolic concessions and dispensations in title, commenda, administration, and otherwise in any manner, and of ecclesiastical fruits, revenues and proceeds in place of annual pensions, and of annual pensions upon similar fruits, revenues and proceeds reserved and assigned to them, and to be reserved and assigned, which they have received, receive and shall receive in the future, as well as of emoluments of whatsoever offices of the Roman court, and otherwise pertaining and belonging in any manner, and also of the said fruits, revenues, proceeds and annual pensions, as well as acquired and to be acquired by their industry and labour in any manner and from any source, lawfully3 however, and otherwise also of gifts and offices which they have exercised, and it shall happen that they exercise, and other things coming and to come to them on any other occasion or cause or consideration, even if they consist in counted money, and jewels, gems, and other more precious things, both in the said court and outside it, everywhere, even at the benefices themselves (of all which qualities and true even annual values, even if they were such as would not come under the general appellation of goods or furnishings, but would require special terms, being present, as if specifically and individually expressed and denoted, we wish to be held as sufficiently expressed and declared), and also of the proceeds themselves, and pensions due and to be due, and not yet received and collected, even if the term of their payment or receipt has not yet arrived, for that portion which shall be due to them (a declaratory constitution concerning fruits and monies not collected, which perhaps ought to pertain and belong to successors in the same benefices, notwithstanding), also and cumulatively with whatsoever other similar or dissimilar faculties had and to be had, up to the sum of two hundred ducats of gold of the same kind only, both for decent and honest funeral expenses, and also for the remuneration of those who shall have served them while living, even beyond the merit of service, and in favour and use of their blood relations and affines, and of whatsoever pious places, and otherwise for their arbitrium and will absolutely, to make a will, and by testament, codicils, fideicommissa, legacies, donations, both between the living and on account of death, and by any other modes and titles whatsoever, even by writing less solemn, even before two or three witnesses, or even by a note alone written or subscribed by their hand, and otherwise in all things and through all things, as and in the manner as it shall seem good to them, even in the court itself, not however outside their residence, and at the point of death, no mention being made of the present or of other similar faculties conceded to them for the time being, or that they wish and intend to make a will or dispose in virtue of those, once and again and repeatedly to dispose, establish and ordain, so that whatsoever shall have been willed, done, ordained, or otherwise disposed by them, even in virtue of simple distribution, and otherwise, in every better manner may be valid and ought to be observed entirely, and the same testaments, codicils, dispositions, ordinations, donations, legacies and statutes, even repeatedly and as often as it shall seem good to them, to moderate, limit, and also wholly to revoke, and to issue others anew, even freely and lawfully we grant full and free faculty. Establishing nevertheless and ordaining, and likewise indulging to them, that if it should happen that they depart from human affairs intestate, and without any, or with less valid disposition of the aforesaid goods and things, and fruits, revenues and proceeds, in the said court, or outside it, and also under4 benefices or other places owing from them personal residence, even with no cause subsisting, all and singular their goods, things and rights, even as aforesaid qualified, as well as spoils for the said sum, even from the aforesaid and otherwise from any source, shall not pertain to the apostolic camera or to successors in the said benefices, but shall devolve entirely to the heirs of blood of the same, and, those failing, shall be distributed among their familiars, at the arbitrium of the person or persons whom they shall have named in writing for this purpose, unless from that5 disposition or intention of the same it should appear otherwise in writing even less solemn, than then as efficacious the same persons, or others judges, or executors, ought altogether to execute and fulfil, and conform themselves to them in all things and through all things.

§ 11. And nevertheless whatsoever testaments, donations, legacies, dispositions and other things perchance otherwise made by the same persons, even though supported by no authority or insufficient authority, concerning such goods, rights, actions, fruits, monies, jewels, and other things aforesaid, even in favor of the aforesaid blood relatives and relations by marriage, and otherwise in whatsoever manner made, with all things consequent thereupon, and also those things which shall be made by them in the future in whatsoever manner, from now as from then and conversely, for the said sum of two hundred ducats only, we approve and confirm, and all and singular defects of law and of fact, and of solemnities omitted and to be omitted, as well as substantial and other defects whatsoever, if any have intervened in the same, even if such are or were of such a kind that special and specific mention of them ought to be made, we supply.

§ 12. Notwithstanding the foregoing, and also notwithstanding the Lateran Council even most recently6 celebrated, even concerning a certain fixed number of notaries, even if that number has not yet been reached, to which we do not otherwise intend to derogate by this, and concerning consent to be given in pensions, and any other matters whatsoever, even issued by us and the aforesaid See in any manner and to be issued in the future, to the rules of the aforesaid chancery, and to the style heretofore observed in similar matters, and to the disposition of Pope Alexander VI of pious memory, also our predecessor, that one third of ecclesiastical revenues ought to be owed to the aforesaid camera, among other things, as well as to the same memory of Boniface the predecessor, by which grants of fruits to be received in absence without a fixed term are prohibited, and to any other Roman Pontiffs, even our predecessors, and to any other apostolic constitutions and ordinances, as well as those issued in provincial councils, special or general, as well as to imperial laws and other municipal laws also, both of the City and of any other cities and places, even those in which citizens of original status were created, and to any churches, monasteries, Orders and the aforesaid hospital, as well as to any colleges and offices of the said curia, and kingdoms, provinces and the City, and other cities and places, and the aforesaid camera, even those strengthened by oath, apostolic confirmation, or any other firmness, statutes and customs, establishments, uses and practices, even if the said chaplains themselves or their procurators have heretofore or may hereafter happen to take an oath concerning the observance of these and not seeking apostolic letters against them, nor even obtained from another or others or otherwise granted in any manner whatsoever, privileges also, indults and apostolic letters, granted to the said churches, monasteries, Orders and hospital of St. John of Jerusalem, and to their prelates, or administrators and superiors, and masters, commanders, priors, knights, even ancients, chapters and convents, cities and places, and other persons and particulars, as well as to archbishops, bishops and other local Ordinaries, even cardinals of the same holy Roman Church, and officials of the said curia, and their colleges, under whatsoever tenors and forms, and with whatsoever even derogatory clauses of derogations, and other more efficacious, most efficacious and unusual clauses, irritant and other decrees, granted, confirmed and renewed by whatsoever Roman Pontiffs our predecessors and also by us and the aforesaid See, even in consistory and by the counsel of the cardinals of the same holy Roman Church, and by way of statute and perpetual constitution, and with equal motive and knowledge, and from the fullness of apostolic power, at the instance or in contemplation of emperors, and kings and queens, dukes, marquises and other princes, in general or in particular, or otherwise in any manner whatsoever even repeated times, and to be granted, confirmed and renewed in the future, even if in these and the aforesaid statutes and establishments it be provided expressly or tacitly that the City may be obtained or conferred only upon original Roman citizens and the sons of the same citizens, but benefits of other parts only through illustrious or noble persons, and also original citizens, or otherwise certainly in some manner expressly qualified in them, and that no one may be admitted as a citizen of the City or of such cities, towns, lands and places, or may use their privileges, unless he shall have first dwelt in the said cities, towns, lands and places for a certain time, or also possesses in them goods even stable property perhaps ascending to a certain value, and that the preceptories and any other benefits whatsoever of the said hospital of St. John of Jerusalem, both from its institution and from the disposition of the aforesaid establishments, ought not to be conferred in title of perpetual benefits, but ought to be granted revocably in commendam for life, and thus may not be burdened with pensions reserved by apostolic authority to secular clerics or other persons, and that by the aforesaid establishments and privileges, even by force of implicit derogation7 extended most broadly8, may not be derogated by any apostolic letters whatsoever and any even derogatory clauses of derogations, more efficacious and unusual, nor be deemed derogated, unless such derogation be made by the counsel of the said cardinals, and then only when the master and convents aforesaid expressly accede to it, and the letters of such derogation be also subscribed by the said master, and be intimated to them and the aforesaid convent through various letters in the form of a Brief or otherwise at various times with certain intervals, and not otherwise, nor in any other manner, and always in such letters thus made, even if a clause9 of similar counsel of derogation be appended, that they shall have effect by the consent of the master and convents aforesaid, and not otherwise, differently, nor in any other manner; to all and each of which (even if for their sufficient derogation special, specific, express and individual mention of them and their whole tenors, and word for word, and not through general clauses importing the same, or any other expression ought to be observed for this, and it be provided expressly in them that they may in no way be derogated, and that the clause of implicit derogation appended in a rescript even emanating motu proprio may not be otherwise expressed or extended in letters), holding the tenors of all of them as sufficiently expressed and inserted word for word in the present, on this occasion only, by the tenor of these, in general and in particular, to the effect of the foregoing, sufficiently and expressly, with equal motive and knowledge, we derogate, and decree to be derogated; and all other things whatsoever to the contrary.

§ 13. We will, moreover, that copies of the present document, even if printed, subscribed by the hand of some public notary, and furnished with the seal of some person constituted in ecclesiastical dignity, shall be believed.

the same faith shall be given in judicial and extrajudicial proceedings to such copies as would be given to the present document itself, if it were exhibited or shown;

§ 14. And that, before they are able to enjoy the benefits of the notarial office, they shall be bound to make profession of faith in the hands of some person constituted in ecclesiastical dignity according to the articles formerly proposed by the aforesaid See, and to take completely the customary oath of fidelity.
