Quanta maturitatae, ac diligentia fieri debeat Romani Pontificis electio.
4 § 3. Lapsis vero decem diebus a die obitus Pontificis, ingressus Conclavis nullatenus prorogetur, aut differatur; sed sequenti die Missa de Spiritu Sancto celebrata, sive Cardinales absentes venerint, sive non, qui fuerint praesentes statim Conclave ingredi teneantur, et ingredientes ipsi absque mora aliqua, omissa omnino capitulorum consectione primis diebus fieri solitorum, in electionis negocio procedant, et singulis diebus scrutinium fiat, et in primo scrutinio etiam accedere liceat.
Nolentes ingredi Conclave poenam Gregorianae Constitutionis incurrunt.
Potestas Sacri Collegii Sede vacante ponitur.
9 § 8. Ipsorum autem officium tertia die post Conclavis ingressum omnino expiret, eorumque loco, tres alii sequentes in ordine, quolibet tertio quoque die cum eodem Camerario in eadem potestate succedant.
Cellae Conclavis sorte distribuantur.
Conclavis clausura a Card. deputatis visitari debet.
Numerus servorum Cardinalium diffinitur.
Conclavistae a Cardinalibus approbandi.
Max. reservata, a quo nihilominus pro qualitate delicti, ultra dictam excomunicationis poena puniendi erunt.
Excommissae super Electione Romani Pontificis damnantur.

How much maturity and diligence ought to be employed in the election of the Roman Pontiff.
1 In the election of Church Prelates, to whom both human and divine ministries are entrusted, how much care ought to be taken is testified by the most sacred Constitutions of our Fathers, which they issued with great severity concerning the quality of Bishops and other Prelates: because from good men all good things proceed, namely charity, vigilance, ecclesiastical discipline, and finally the salvation of souls committed to them, but from evil men, on the contrary, nothing but evil can be expected, namely avarice, negligence, pride, and the peril of souls. If such great provision must be made in any Church Pastors, lest anyone unworthy be assumed, certainly greater and more careful diligence ought to be employed in electing the Roman Pontiff, who is to be set over the other Pastors and is to have the care of the entire flock of the Lord.
There are listed the Pontiffs who issued Constitutions concerning the election of the Roman Pontiff.
2 § 1. Moved by this holy meditation, our predecessors, and especially of blessed memory Alexander III, Gregory X, Clement IV, Clement V, and Julius II, enacted certain Constitutions to provide that the elections of the Supreme Pontiffs might be made freely, rightly, and maturely. But since human affairs always tend toward the worse unless there be someone to restrain and preserve them continually, and it is to be feared lest at some time, through transgression of those Constitutions, abuses that have arisen might spread further and advance.
Cardinals who are absent are awaited for ten days, and meanwhile the exequies of the deceased Pontiff are performed, the expenses of which are assessed.
3 § 2. We, desiring as much as we can with God to meet future cases and dangers, renewing, declaring, and supplementing the Constitutions of those same predecessors of ours according to the necessity of things and times, by the unanimous counsel and assent of our Brethren, do define, establish, and declare that when it shall happen that the Pontiff departs from this life, the Cardinals present shall be bound to await the absent Cardinals for only ten days according to the Constitution of the aforesaid Gregory our predecessor issued in the Council of Lyons, and meanwhile let them perform the customary exequies of nine continuous days entirely, and defer them on no pretext whatsoever. And lest anything be an impediment to those exequies being completed on the ninth day, if at any time it should seem to the Cardinals that the office of exequies ought to be interrupted by the observance of some great and principal feast, those days so interrupted shall nevertheless be counted in the number of nine days, and the expense which would have been made in them for the exequies shall be distributed among the poor of Christ. And in order that excessive expenses, which have already grown immensely, may be limited, let the funeral be simpler than has been customary, so that the expense (apart from the regalia customarily provided to the Roman People) shall not exceed the sum of ten thousand ducats in mourning cloths and regalia, computed for the Camerlengo and Clerics and other Camerlengo officials as well as all other Ministers and Officials whatsoever, and all other things entirely. Moreover, this sum of ten thousand, or if it seem good to the College even less, and in no way greater, shall be divided by three senior Cardinals, namely one from each order, and the Camerlengo proportionately according to the distribution otherwise customarily made, among all and each of the aforesaid.
After ten days have elapsed, following the Mass of the Holy Spirit, the Cardinals enter the Conclave and proceed to the business of election, and a scrutiny shall be held on each day, and it is also permitted to proceed even in the first scrutiny.
4 § 3. After ten days have elapsed from the day of the Pontiff's death, the entrance into the Conclave shall in no way be postponed or deferred; but on the following day, the Mass of the Holy Spirit having been celebrated, whether the absent Cardinals shall have come or not, those who shall have been present are immediately bound to enter the Conclave, and those entering it shall without any delay, omitting entirely the chapter meetings customarily held on the first days, proceed to the business of election, and a scrutiny shall be held on each day, and it is also permitted to proceed even in the first scrutiny.
Those unwilling to enter the Conclave incur the penalty of the Gregorian Constitution.
5 § 4. If any shall perhaps be unwilling to enter, or having entered shall depart without a manifest cause of illness approved by oath of Physicians and by the majority of the Cardinals through secret ballot, they shall incur the penalty of the aforesaid Constitution of Gregory X.
The Cardinals present in the Conclave and outside it, after ten days have elapsed, are able to elect a Pontiff.
6 § 5. Nevertheless declaring that after the Cardinals present, not awaiting further the other Cardinals even as Legates a latere or for any other cause whatsoever, even with the permission of the Supreme Pontiff who are absent, after however the aforesaid ten days have elapsed from the death of the Pontiff, shall have made the election either within or outside the Conclave, the election thus made cannot in any way be impugned under the pretext of the journey or other even probable and notorious impediment of those absent Cardinals, since the public utility arising from a mature election ought to be preferred to any other consideration.
The power of the Sacred College is placed during the vacancy of the See.
7 § 6. During a vacancy of the See, the College of Cardinals shall have no power whatsoever, or jurisdiction in those matters which pertained to the Supreme Pontiff while he lived, neither to grant grace, nor to administer justice, nor to execute what was done by the deceased Pontiff; but shall be bound to reserve all these things for the future Pontiff. Nor concerning the temporal state of the Holy Roman Church, nor concerning the monies of the Apostolic Camera, or the Datary, whether for the payment of debts contracted in any manner before the death of the Pontiff, or otherwise from any cause whatsoever (except only in the cases written below), shall they dispose of anything, nor contrary to the said Constitution of Gregory shall they receive anything for themselves, nor shall they contract debt beyond the necessary expenses comprehended herein, and neither the Camerlengo, nor the Treasurer, nor the Datary, nor the Depositary, nor the Castellan of the Castle of St. Angelo, nor other Officials shall be bound to obey the College contrary to the tenor of these Constitutions, nor should they: nay rather if they shall have complied with such things, or if the Cardinals themselves, or their Officials shall have presumed to attempt anything against the aforesaid, they shall be compelled to make full satisfaction from their own property to the Apostolic Camera, and to restore the monies expended, and to repair all damages at the discretion of the Pontiff to be elected. That which may be expended shall be the aforesaid sum of ten thousand ducats: likewise that which is for the sustenance of the Pontifical Household before entrance into Conclave, and after entrance, for the poor Officials of the Palace only through the Camerlengo, and the Priors of the Orders to be described, for sustenance, and also for alms customarily given during a vacant See, and likewise for the defense of the lands of the Church or part thereof, and also for the regalia of the Roman People and its Magistrates, and the Custody of the City, and of the Conclave, and its necessary provisions, shall be necessary. But that expenditure which is to be made for the defense of the Lands and Places of the Church, and for security, and for the provisions of the Conclave, the Cardinals present ought to ordain by secret ballot, so that the opinion of the greater part shall obtain that which shall be observed, even in the Governors of the City, both beyond the Bridge and on this side, and other Officials, even for the governance of the Ecclesiastical State if need be to be elected. But if beyond the aforesaid some great danger should threaten, which to all and each of the Cardinals present according to the ordinance of Gregory X., or at least to two-thirds of them by secret ballot should seem to require swift remedy, then the College according to the opinion of the greater part likewise by secret ballot may and ought to provide for the appropriate remedy, and providently for the necessary expenditure.
8 § 7. We also decree that three senior Cardinals, namely one from each order, together with the Camerlengo after the death of the Pontiff shall have the right to gather the remaining Cardinals, and to propose the occurring necessities in General Congregations, and to take care that the Conclave be well closed on all sides.
9 § 8. But their office shall expire entirely on the third day after entrance into the Conclave, and in their place three others following in order, each third day likewise with the same Camerlengo shall succeed in the same power.
10 § 9. Moreover the offices of the Camerlengo and of the Major Penitentiary, which we decree and declare shall also endure during a vacant See in such manner, that they shall not only not usurp those things which are prohibited by the present Constitution, and which they were not accustomed to exercise while the Pontiff lived, or from which they abstained for the reverence of the same Pontiff, or otherwise in any manner; but the Camerlengo, and the Presidents, and Clerks, and other Ministers, and Officials of the Apostolic Camera shall be occupied only in the collection of monies owed to the same Camera, and in the provisions necessarily to be made on account of a vacant See according to the aforesaid, and therefore they ought to abstain entirely from the payment of debts contracted before the death of the Pontiff, or their declaration, the settlement of accounts, the extraction of grain, the remission of offenses, the assurance of offenders, and whatsoever other expeditions, whether concerning grace or justice, or the execution of either in any manner whatsoever.
11 § 10. But the Penitentiary, and his Officials may do and expedite only those things which pertain to the forum of conscience, in other matters their office shall rest, so that they shall abstain entirely from whatsoever matrimonial and other dispensations, and absolutions, and declarations, and also from whatsoever other expeditions concerning the forum (as they say) of the forum, mixed or separate in any manner whatsoever: otherwise in which both the Camerlengo and the Penitentiary, and the others aforesaid even by license or mandate of the whole College shall have acted contrary, those things shall be null and void, and shall avail no one. And nevertheless they shall be bound to render account of their excesses and disobedience to the discretion of the Pontiff whenever. Our Letters also issued upon the reformation of the Camera and Penitentiary in this manner shall remain in their force.
12 § 11. Moreover, the office of the Datary shall entirely expire upon the death of the same Pontiff, so that he shall have no power not only to extend the dates previously noted by him, but also whatever petitions for favours and justice remaining with him or his Ministers, even if they have been given to the College of Cardinals, he shall be bound immediately to present them closed under seal to the future Pontiff to be reserved. But if anyone, even at the instance of any Cardinal whatsoever, shall presume to attempt anything contrary to the foregoing, let it be null and void, and nevertheless let him incur the crime of forgery, and he shall render an account thereof to the future Pontiff.
13 § 12. We further prohibit that the Cardinals and Prelates, Prefects of the Signature of Favours and Justice, during the vacancy of the See, be able to sign any petitions and commissions, even if the petitioners have previously obtained small ones given, as is customary: but let their offices be understood to cease entirely. But if they act otherwise, for such excesses let them be punished at the discretion of the future Pontiff.
The cells of the Conclave shall be distributed by lot.
14 § 13. We command also that the cells of the Conclave be distributed by lot among the Cardinals, nor shall it be lawful to change them even under the pretext of infirmity, or to build upon them, or to enlarge them; but let each one, even the Dean, be content with his lot.
Dwelling or remaining near the Conclave is prohibited.
15 § 14. After the entrance into the Conclave we interdict and expressly prohibit under penalty of deprivation of offices and benefices, and also under other penalties to be inflicted at the discretion of the Governor appointed to guard the Conclave, that anyone dwell or remain immediately above or below the Conclave, or on its sides. Which places ought to be closed with walls and frequently visited by the Presidents of the guard of the Conclave and by the said Governor. And if any fraud shall have been committed, the Governor himself shall be bound under penalty of perjury incurred ipso facto, and other penalties to be inflicted at the discretion of the future Pontiff, to reveal such delinquents to the Cardinals appointed for the time being, and to ensure that such delinquents be imprisoned and severely punished.
The closure of the Conclave ought to be visited by the Cardinals appointed.
16 § 15. The Cardinals appointed for the time being ought also to visit frequently the cells of the Cardinals and other places of the Conclave, and to inquire diligently lest forbidden openings be made in the walls of the Conclave itself, or in the ceilings or pavements. And if anything of this sort be discovered, let the authors be subjected to deprivation of offices and benefices, and also to corporal and most severe penalties at the discretion of the Governor and also of the future Pontiff, and let associates be held to the same penalties for the foregoing; unless they immediately, if they be within the Conclave, reveal it to the Cardinals appointed for that purpose, or if outside the Conclave, to the Governor and the Prelates placed in charge. Which Governor and Prelates ought to watch over this under penalty of perjury and to provide opportunely.
The number of servants of the Cardinals is determined.
17 § 16. Let each Cardinal in the Conclave be content with two servants, whether Clerics or Laymen, but for the infirm and gravely afflicted, a third may be allowed at most by the greater part of the College through secret ballot.
Conclavists are to be approved by the Cardinals.
18 § 17. Who as serving familiars, domestic servants, and continual table companions of the Cardinal ought to have been for a year before and to be then, and not Merchants, Ministers of Princes, temporal Lords, and those having jurisdiction, nor brothers or nephews of the Cardinal even if they lived at their expense: and concerning the qualities of the Conclavists, the Cardinals appointed ought to make diligent inquiry before the entrance into the Conclave and to approve them, and after the entrance ought again to provide diligently.
The Sacristan, Masters of Ceremonies, and other Officials of the Conclave are determined.
19 § 18. Let the Sacristan also with one Cleric as assistant in the office of the Sacristy enter the Conclave, and also two Masters of Ceremonies of the Conclave, to be occupied with celebrating Masses and other matters pertaining to them. Let there also be present one Religious, to be chosen by the greater part of the Cardinals through secret ballot for hearing Confessions, one Secretary of the College only, two Physicians, one Surgeon, one Apothecary with one or two servants, one Carpenter, one Mason, two Barbers with one or two servants. Likewise eight or ten servants for public utility and the convenience of all, as for carrying wood, for sweeping the Conclave, and for ministering similar necessities, who all shall be chosen by the College of Cardinals, yet not from the household of any Cardinal, by secret ballot, in such manner however that he obtains it who has received the most votes, and salaries shall be paid to them from the public treasury. But if anyone beyond the aforesaid persons be found in the Conclave, he ought immediately to be expelled. And if anyone be discovered to have hidden himself anywhere, let him be ignominiously expelled, and be marked with infamy, and be deprived of offices and benefices: but those aware of it shall be bound under the same penalty to reveal them to the College, and shall receive a reward if they inform.
When the Conclave is closed, conversations with those who are outside the Conclave are prohibited.
20 § 19. When the Conclave is closed, no one shall be admitted to conversation, even outside the door of the Conclave, not even the Ambassadors of Princes, unless for a grave and urgent cause approved by the greater part of the College. And if anyone by chance (which God forbid) should enter the Conclave secretly, and by any way other than through the door, he shall be deprived ipso facto of all honour, rank, office, and benefice, and shall be delivered to the secular Curia to be punished with the severest penalties.
Letters and signs are similarly prohibited when the Conclave is closed.
21 § 20. It shall in no way be permitted to send or receive letters, or any kind of writing, or a messenger, or a note, or a sign to those who shall be in the Conclave, or conversely, from the Conclave to those who shall be outside: those who act contrary, of whatever dignity, even if they shine with the honour of the Cardinalate, shall be subject to the penalty of excommunication latae sententiae, with the faculty of absolution reserved, except in the article of death, to the Supreme Pontiff alone, by whom nevertheless, according to the quality of the offence, they shall be punished beyond the said penalty of excommunication.
Excommissae concerning the Election of the Roman Pontiff are condemned.
22 § 21. We also prohibit agreements concerning the future election of the Pontiff, which are called excommissae, from being made, and if by chance they have been made contrary to the tenor of the present document, we decree that they shall be null and void in judgment and outside of judgment, and shall be considered altogether void; and those who act contrary, and the brokers, ought to be punished at the discretion of the Governor and the future Pontiff.
Cardinals shall eat a single moderate dish in their own cell.
23 § 22. Moreover, the Cardinals, from the very first day on which they shall have entered the Conclave, both at dinner and at supper, shall be content with and ought to have only a single dish of one kind only, and that moderate, and otherwise qualified according to the Constitution of the aforesaid Clement VI, and no one shall eat in another's cell, or from another's dish.
24 The Prelates who are guardians of the Conclave ought to inspect the food, lest letters, notes, or signs be sent into the Conclave along with it.
25 § 23. Moreover, the Prelates also appointed to the custody of the Conclave shall, under penalty of perjury and suspension from the Divine Office, exercise the greatest and most careful diligence in inspecting and searching the food and other things and persons entering and leaving the Conclave, lest under the cover of these things, letters or notes or any signs be transmitted. And if such a thing be found, the Familiars of the Cardinals or other offenders shall incur the penalty of deprivation of offices and benefices, and of incapacity for those obtained and to be obtained. And further they shall be committed to prison by the Governor, from which they shall in no way be released except by command of the new Pontiff, but shall be punished more severely at his discretion, all faculty being entirely forbidden to the College of Cardinals in favour of any who shall have offended in the aforesaid matters or in any of them.
26 Conclavists who depart shall not enter again.
27 § 24. Moreover, the Conclavists and any others serving shall be able to leave the Conclave on account of manifest and notable infirmity, proved by Physicians by means of an oath, and with the consent of the appointed guardians, whose conscience we also burden in this matter, and in no other way, and shall in no way be able to return, but others in their place shall enter at the very same time at which the infirm depart.
28 A Cardinal who is not a Deacon does not have a vote in the Election.
29 § 25. We also decree and declare that if by chance any Cardinal has not been constituted at least in the order of Deacon, he ought in no way to be admitted to voting.
30 Admonition to the Cardinals concerning those things which they ought to observe in making the Election.
31 § 26. Moreover, we earnestly beseech and exhort the Cardinals by the bowels of the mercy of Our Lord Jesus Christ, and nevertheless command and enjoin them under the threat of divine judgment, that, attending to the magnitude of the Ministry which is handled through them in giving their votes, and in all and singular matters concerning the Election in any way whatsoever, with all deceit and fraud, factions and base passions removed, and paying no heed to the intercessions of secular Princes and other worldly considerations; but having God alone before their eyes, they ought to conduct and comport themselves purely, freely, sincerely, quietly, and peacefully, and shall not enter into conspiracies, agreements, pacts, and other illicit dealings for the Election of the Pontiff itself; they shall not dare or presume to give signs or countersigns of their votes to another, or to diminish them in any way to some, or to stir up tumults, or to do other things by which the election might be delayed, or votes be given less freely, either by themselves or through another, directly or indirectly, under any colour or device. And if they act otherwise, or admit anything contrary to the prohibitions in the present Constitution, beyond divine vengeance, the future Pontiff may visit punishment upon them at his discretion according to the measure of the fault, whenever he is able.
32 Executors of the Bull are appointed.
33 § 27. But since it is of little avail to establish laws unless there be those who commit them to execution; we do establish and ordain that the Prelates, Rectors, Officials of the City, and the Orators of Princes, Illustrious Men, all of whom shall be chosen by the College for the custody of the Conclave (and the College ought to choose those who shall appear most suitable for this purpose) shall cause all the aforesaid things to be observed fully, inviolably, and without any fraud or deceit, concerning which they are bound to take a corporal oath before the College itself before entering the Conclave, and as often as it shall be necessary: and if they shall not do these things, or if they shall commit fraud or deceit in them, they shall incur the aforesaid penalties and others contained in the said Constitution of Gregory X.
34 The Cardinals cannot change this Constitution.
35 § 28. We will, moreover, that the Cardinals be restricted by neither the Prelates nor the Rectors or Officials aforesaid beyond what is premised, nor that these our Constitutions be able to be altered, corrected, or changed by the College of Cardinals in any way, but that they be read word for word before all in the first Congregation held after the death of the Pontiff, and then after the entry into the Conclave, and sworn to in the manner in which the Constitutions of Julius II and our other predecessors are read and sworn to, whose Constitutions and penalties contained in them, beyond what is premised, we do not intend to derogate from by this our Constitution, but rather to confirm, renew, and approve them.
36 Cardinals are not excluded from Election on account of Censures.
37 § 29. And lest occasion of dissension or schism arise, we will that the Cardinals be in no way excluded from the election of the Pontiff, actively or passively, on the pretext of the aforesaid censures and excommunications and any others whatsoever, which excommunications and censures we suspend and will to be suspended and declare to be suspended for the effect of the election only, those otherwise remaining in their force. We also decree that the excommunications and censures themselves affect only him who has committed the offense, and not the others conversing with him during the Conclave.
38 Clauses executive and derogatory are set forth.
39 § 30. And these our Constitutions ought to have place and be observed wherever the election of the Supreme Pontiff shall happen to take place, even if outside the City.
40 § 31. And moreover that they be read and published on the doors of the Basilica of the Prince of the Apostles, and of the Apostolic Chancery, and in the open space of the Campus Florae by some of our Couriers, and that a copy thereof be affixed there and left, and that thereafter all and each of the Cardinals, even those absent and future, and all others whomsoever to whom it concerns or may concern in any way in the future be affected and bound, and that none of them be able to plead ignorance thereof, as if they had been personally notified thereof, notwithstanding the aforesaid and other Apostolic Constitutions and Ordinances and all other things contrary thereto whatsoever.
41 § 32. Let no man whatsoever be permitted to infringe this page of our definitions, statutes, declarations, decrees, prohibitions, mandates, interdict, precept, request, exhortation, and will, or to dare to act contrary to it with rash presumption. If anyone, however, shall presume to attempt this, let him know that he shall incur the indignation of Almighty God and of the Blessed Apostles Peter and Paul His.
42 Given at Rome at St. Peter, in the year of the Incarnation of the Lord one thousand five hundred sixty-two, on the seventh day before the Ides of October, in the third year of our Pontificate.
