JS1 Uti Jean.
IMO III. Leo PP. XII.

1 For a perpetual record. § 1. Among the many and outstanding deeds which Our predecessor, the Supreme Pontiff Pius VII, accomplished both before his departure from the city and after his return for the good of the Christian religion, that one is certainly most notable by which he took care to restore the Society, to which the holy parent Ignatius gave the name of Jesus (since God commended to him and his companions, bearing the cross with the Son of Jesus, through a special manner of offering themselves). Moreover, it is hidden from no one how many and how great are the benefits that have flowed from this very Society, which is fertile in men distinguished by piety and manifold praise of learning, to the Christian commonwealth especially, and which we hope will flow in the future, when with new roots it spreads forth great branches far and wide. Indeed, besides other things, not only in the principal and governing Church of the world, but also in Italy and in regions beyond the Alps and in remote places, where it is received with great affection, it undertakes and sets in motion nothing less than that young men and adolescents, pious and mature in liberal disciplines, may be the ornament of Our age and the next. While indeed Our same predecessor received all its colleges, houses, provinces, and students into his own protection, the aid, and obedience of the Apostolic See, he reserved to himself and to the Roman Pontiffs his successors to establish and prescribe those things which would seem opportune for constituting and strengthening that same Society more and more. This work he would doubtless have perfected, had he not, already advanced in age and exhausted by the cares of governing the Church's vessel, long and greatly tossed about, been called by God into his bosom and embrace, to receive the merited crown of glory. Therefore We, who, although unequal to the task, by the counsel of the eternal mind from its inaccessible depths have been placed in the supreme pontifical dignity and watchtower, consider it to be Our duty to promote that same thing, so that the Society of Jesus may be strengthened by new supports, and its students, as so many workers in the Lord's field, may strive with great spirit to cultivate the portion entrusted to them, and that the useful plantations which the heavenly Father has sown may receive more abundant watering from Christ Jesus and increase unto salvation. When therefore We have carefully considered the privileges and faculties which the students of the Society of Jesus have requested, faculties with which St. Ignatius was enriched by the indulgence of Our predecessors Paul III and Julius III before the celebration of the seventeenth session and the subsequent sessions up to the last twenty-fifth of the Council of Trent; and likewise other faculties granted to the same Society by the Roman Pontiffs St. Pius V, Gregory XIII, and Urban VIII, We have deemed it fitting to set forth those which both from the decrees of that same council and thereafter from the various constitutions of Our predecessors, and both from the inclination of the times and the present discipline of the Roman Church, We have judged it expedient to grant. § 2. Wherefore by Our apostolic authority We renew, confirm, and again grant these same faculties according to the prescription of these letters, from which We command that not even the breadth of a fingernail be departed; because indeed, wishing to favor the Society of Jesus and its students, and especially the General Superior, as their prelate, and their prefect, who from their family are sent for the sake of the Gospel into distant regions, We do not hesitate to add certain other faculties from Our benignity. These, however, are of the following kind, namely: First, We grant permission to religious men enrolled in the Society of Jesus, so that they may hear the sacred confessions of Christian people, announce the word of God, administer the sacraments, with the assent and approval of the ordinary prelates of those places, or quasi-dioceses, in which they happen to be engaged. They may moreover receive orders, both minor and major, even outside the prescribed times and without observing the intervals, from any sacred bishop united with the Roman See, having however obtained the consent of the ordinary prelate of that place in which this is to be done; and by the judgment of that same ordinary they may have the churches of the Society of Jesus blessed and consecrated by any bishop or archbishop. By particular reasons We wish to be moved, so that the Society and its students may nowhere be bound to undertake the burden of visitation at the request of any prelate, or to assume the care of religious women and virgins. And likewise it is permitted to them to absolve from cases reserved to the Apostolic See, excepting those which are contained in the bull In coena Domini. To commute simple vows, but never vows of chastity, religion, the three pilgrimages to the sacred thresholds of the blessed Apostles, to St. James in Compostela, and to Jerusalem, and those vows in which there is a question of prejudice or the right of a third party. To perform the divine office before dawn or after midday. And after the sacrifice, or before its celebration, or otherwise to minister the sacrament of the Eucharist. And also to absolve in the forum of conscience those who have incurred occult irregularity, both for receiving and for exercising orders, from this impediment. We further decree that it is forbidden to appeal outside the Society from the punishment inflicted by the prescription of the Society's laws. That the students of the Society may not hear confessions of souls in need except those who have received faculty from the Superior to hear their sacred confessions. That no one who has taken vows in the Society may pass to another sacred family, except the Carthusians. That the irregular, who give their name to the Society (unless the irregularity arise from voluntary homicide, bigamy, mutilation of members, defect of mind, and similarly excepted irregularity which arises from infamy of fact in law) may be promoted to sacred orders and to any offices of the Society. That the masters of novices are in no way subject to that decree which forbids prelates to hear the sacred confessions of students. That the Society, from its custom, constitutions, and manner of conduct, may enjoy all the privileges granted to sacred families which live by begging, or, as they are called, generally to mendicant orders. Finally, that the Christian faithful entering the temples of the Society, once on any feast day of their title in the year, may gain a plenary indulgence.

2 § 3. We grant to the General Superior, as to a Prelate, the power to grant to those alumni of the Society whom he judges it opportune, permission to celebrate Mass legitimately in a domestic chapel erected for that purpose. To dispense the same alumni from fasting and forbidden foods for just causes. To commute the divine office into other pious prayers for those laboring under adverse health. Likewise to permit, if it be fitting, that the morning hours, after the sacrifice is completed, be recited. To grant to those alumni for whom he deems it expedient the faculty by which they may read prohibited books. Finally, to furnish the superiors of all houses and colleges of the Society in each province with such faculties. After this we decree that the General Superior shall preside over sacred missions wherever his Society's alumni shall labor for the benefit of the Catholic religion and the salvation of souls. Wherefore it is permitted to him to send his alumni to preach the Gospel of Jesus Christ, where these preachers are desired, and especially where the number of ecclesiastical workers is so small that there is no one to break bread to the little ones who seek it; and likewise to appoint the prefects of these same missions. And that more abundant fruits may be reaped therefrom, we grant to the General Superior himself those faculties which are contained in the formulas long since drawn up by the supreme Congregation of the Inquisition, according to the will of our predecessors, and which according to the distance of places, at the request of the sacred Congregation for the Propagation of the Christian Name presiding over this laborious province, are granted by us to the prefects thereof, to be delegated by the General Superior to them, and by these to others devoted to such ministry. But the prefects and other heralds of Christian truth in regions subject to the jurisdiction of ordinary bishops cannot exercise this office except with their permission; if, however, there be no ecclesiastical jurisdiction there, let them freely discharge the same office. But in order that from this our indulgence all doubt which could arise from the distinction of the formulas which we have mentioned be entirely removed, we deem that these same faculties, with which we furnish the General Superior for the good of the Church and the salvation of souls, should be enumerated here individually, and expressed in those very words which the Congregation for the Propagation of the Christian Name is accustomed to use in granting them, namely: I.

3 § 4. To dispense and commute simple vows into other pious works: and to dispense for reasonable cause in simple vows of chastity and religion.

4 To dispense in the third and fourth degrees of consanguinity and affinity simple and mixed only, and in the second, third, and fourth mixed, not however in the second alone, as regards future marriages: but as to past marriages also in the second alone, provided it in no way touches the first degree, with those who are converted from heresy or infidelity to the Catholic faith, and in the aforesaid cases to declare offspring received legitimate.

5 To dispense over the impediment of public honesty arising from just espousals.

6 To dispense over the impediment of crime, provided neither of the spouses contrived it, and to restore the right of demanding the debt lost. V.

7 To dispense in the impediment of spiritual relationship, except between the one conferring and the one receiving.

Leo PP. the Twelfth VI.

8 But these matrimonial dispensations, namely II, III, IV, V, shall not be granted except with the clause, provided the woman has not been abducted, or if she has been abducted she is not in the power of the abductor; and in the dispensation the tenor of such faculties shall be inserted, with the expression of the time for which they shall have been granted.

VII.

9 To dispense with gentiles and infidels having several wives, so that after conversion and baptism they may retain whichever of them they prefer, if she also becomes faithful. Provided the first wife wishes to be converted. VIII.

10 To bless vestments and other vessels necessary for the sacrifice of Mass, where sacred unction does not intervene; and to reconcile churches polluted with water blessed by the bishop, and in case of necessity also with water not blessed by the bishop.

11 To absolve from heresy, and apostasy from the faith and from schism whosoever, even ecclesiastics both secular and regular, not however those who are from places where the Holy Office is exercised, except in mission places in which heresies rage with impunity where they have offended; nor those who have abjured judicially, unless these were born where heresies rage with impunity, and after judicial abjuration have returned there and relapsed into heresy, and these in the forum of conscience only.

12 To absolve in all cases reserved to the Apostolic See, even those contained in the bull In coena Domini.

13 To grant plenary indulgence to those first converted from heresy, and also to any of the faithful in the article of death at least contrite, if they are unable to confess.

XII.

14 To recite the rosary or other prayers, if they are unable to carry the breviary otherwise, or if they cannot recite the divine office or some legitimate impediment prevents them from reciting it.

XIII.

15 To consecrate chalices, patens, and portable altars with oils blessed by the bishop, where there are no bishops, or they are distant two days' journey, or the see is vacant.

16 To dispense, when it shall seem expedient, concerning the eating of meat, eggs, and dairy products during times of fasting, and especially during Lent.

17 To celebrate twice in a day, if necessity should press, yet so that in the first Mass he shall not have taken ablution one hour before dawn, and another after midday, on a portable altar, without a minister, in the open air and underground, in a decent place however, even if the altar be broken or without relics of saints, and with heretics, schismatics, infidels, and the excommunicated present, provided that the minister be not a heretic or excommunicated, and that otherwise celebration cannot take place. However, this faculty of celebrating twice in a day may in no way be used except most rarely and from the gravest and most urgent causes, in which matter the conscience of the superior general is gravely burdened, as well as that of the prefects of missions and of the missionaries themselves.

XVI.

18 To carry the most holy Sacrament of the Eucharist secretly to the sick without light, and to retain it without the same for those same sick, in a decent place however, if there be danger of sacrilege from heretics or infidels.

XVII.

19 To wear secular clothing, if otherwise they cannot pass through or remain in mission territories.1

XVIII.

20 To administer all sacraments even perpetual ones, excepting orders and confirmation, and as to parochial sacraments in dioceses where there shall be no bishops or ordinaries or their vicars, or in parishes where there shall be no pastors, or where they shall be with their permission.

XIX.

21 To bless crowns, rosaries, crosses. Given at Rome at St. Peter's under the Fisherman's Ring on the eleventh day of July in the year one thousand eight hundred twenty-six, in the third year of Our pontificate.
