lam. — Sanzione penale.

— Cap. I.

Abbiano anche i fratelli suddetti mantelli e pelli, senza cuciture, strappate o intere, allacciate però, o aperte, come conviene all'onestà, e maniche chiuse.

27 Come in quanto sopradetto nessuno è obbligato a colpa mortale. — Cap. XX.

Penal sanction.—Nicholas, bishop, servant of the servants of God, to his beloved sons the brothers, and to his beloved daughters in Christ the sisters of the order of the brothers of Penance, both present and future, greeting and apostolic blessing.

1 Upon the mountain of the Catholic faith, which the sincere devotion of the disciples of Christ, burning with the fire of charity, taught to the peoples of the nations who walked in darkness by the word of diligent preaching, and which the Roman Church holds and preserves, is known to be the solid foundation of Christian religion, never to be shaken by any storms, never to be broken by the waves of tempests. This is indeed the true and genuine faith, without fellowship with which no one is made acceptable in the sight of the Most High, no one comes forth with favor. This is the faith which prepares the path of salvation, and promises the rewards and joys of eternal happiness. And therefore the glorious Confessor of Christ, Blessed Francis, the founder of this order, showing the way of ascending to the Lord both by word and by example, instructed his sons in this sincerity of faith, and willed that they profess it, hold it steadfastly, and likewise fulfill it in deed, so that by walking safely along its path, they might become, after the prison of the present life, blessed possessors of eternal beatitude. Concerning the manner of examining those wishing to enter the order.—Cap. I.

2 We therefore, pursuing this order itself with fitting favors and bending ourselves more benignly to its increase, decree that all whom it shall happen to be admitted to observe this form of life, before their admission or reception, shall be subjected to diligent examination concerning the Catholic faith and obedience toward the aforesaid Church. And if they shall have professed these firmly and believed them truly, they may be safely admitted or received to the same. Care must be taken, however, lest any heretic, or one suspected of heresy, or even one of ill repute, be admitted in any way to the observance of this life. And if it should happen that such a one be found to have been received, he shall be assigned forthwith to the inquisitors of heretical depravity to be punished.

Concerning the form of receiving those wishing to enter the order.—Cap. II.

3 When, however, anyone wishes to enter this brotherhood, the ministers appointed to reception and probation shall carefully inquire into his office, profession, and status and condition, explaining more clearly the burdens of the same brotherhood, and especially the restitution of others' property. These things being premised, if it shall please him, let him be clothed according to this manner, and let him strive to make satisfaction for any property of others (if there be any with him) in ready money, or according to the security of a pledge offered: and let him nevertheless strive to reconcile himself with his neighbors. All these things being brought to effect, after the space of one year, with the counsel of some discreet brothers, if he shall appear to them suitable, let him be received in this manner, namely, that he promise that he will keep all the divine precepts, and also make satisfaction (as is fitting) for transgressions which he shall have committed against this manner of living, when he shall have been called upon by the will of the visitor. And such promise made by him shall be reduced to writing by public hand. In no other manner, however, shall anyone be received by the same ministers, unless it shall seem good to them otherwise, the condition of the person and his earnest petition having been discussed with careful consideration. We further ordain and decree that no one after his entrance into the same brotherhood shall be able to depart from it, returning to the world. He may, however, have passage to transfer to another religion approved among the brothers and sisters. But to women having husbands (unless with their license and consent) entrance to the fellowship of the said brotherhood shall not be open.

Concerning the form of habit and the quality of garments.—Cap. III.

4 Moreover, the brothers of the same brotherhood shall be clothed in humble cloth in price and color, not wholly white or black, commonly indeed, unless it shall have been dispensed to some at a time in price by the visitors with the counsel of the minister on account of a legitimate and open cause. Cloaks also and furs, without collars, torn or whole, fastened, however, or buttoned, as befits propriety, and with closed sleeves, let the aforesaid brothers have. The sisters also shall be clothed in a cloak, and a tunic made of such humble cloth, or at least with a cloak let them have a little garment, or a placket, of white or black color, or a wide mantle of hemp or linen, without any pleating of the seams. Concerning the humility of the cloth and furs of the same sisters, according to the condition of each of them and the custom of the place, dispensation may be granted. Let them not use silk bindings and fastenings; let them have only sheepskin furs, purses of leather and straps, made simply without any silk and in no other way, both brothers and sisters, having laid aside (according to the salutary counsel of Blessed Peter, Prince of the Apostles) the vain ornaments of this world.

That they shall not go to dishonorable banquets and spectacles, and that they shall not give to actors.—Cap. IV.

5 Let access to disreputable gatherings, or spectacles, whether in courts or dances, be entirely forbidden to them. Let them give nothing to actors or for the sake of vanity. And let them take care to prohibit that nothing be given to them by their own family.

On abstinence and fasting. — Cap. V. On the second, fourth and sixth day of the week.

6 Let all abstain from the eating of meat on the second, fourth and sixth day of the week, and on Saturday, unless the urgency of infirmity should counsel otherwise. However, let meat be given to the young for three days, nor let it be withheld from those on a journey; let also the eating of meat be lawful to each one whenever a principal solemnity should occur, on which other Christians are accustomed from ancient times to eat meat dishes. On other days, however, in which a fast is not observed, let eggs and cheese not be denied. And they may also lawfully take with the other religious in their conventional houses from what is set before them by the same. And let them be content with the refection of dinner and supper, except for the infirm, travellers and the sick. Let the food of the healthy be moderate and the drink, since the evangelical text has it: Take heed that your hearts be not overcharged with surfeiting and drunkenness. But dinner or supper shall not be taken unless the Lord's Prayer be said once beforehand: after taking food, let each one give thanks to God, and if it should happen to anyone, let it be said three times, Our Father. Let a fast be observed on every Friday of the whole year, unless perhaps infirmity or another legitimate cause should excuse them, unless the feast of the Nativity of the Lord should fall on that Friday to be observed. But from the feast of All Saints until Easter, let them fast on Wednesday and Friday; other fasts, which have been established by the Church, or commonly appointed by the ordinaries for a cause, shall nevertheless be observed. But in the Lent of St. Martin until the day of the Nativity of the Lord, and from the Sunday of Sexagesima until Easter, let them fast on each day (except Sundays), unless perhaps infirmity or some other necessity should counsel otherwise. Sisters who are pregnant may, if they wish, abstain from any bodily exercise (prayers alone excepted) until the day of their purification. But those who labour (on account of the urgency of afflicting fatigue) from the feast of the Lord's Resurrection until the feast of St. Francis aforesaid may lawfully take food three times on the day on which they are engaged in the exercise of labour. But when it should happen that they are occupied with the labours of others, they may take from all that is set before them on any day, unless it be Friday, or another day on which a fast is known to be instituted generally by the Church.

How often they ought to confess in the year, and receive the Body of Christ. — Cap. VI.

7 Each one of the brothers and sisters, three times in the year, namely, at the feast of the Nativity of the Lord, at His Resurrection and at the solemnity of Pentecost, shall not delay to confess their own sins and devoutly receive the Eucharist, reconciling themselves with their neighbours and also restoring what belongs to others. That they bear not weapons of aggression.

Cap. VII.

8 Let the brothers not carry weapons of aggression with them, except for the defence of the Roman Church, the Christian faith, or also their own land or by the licence of their ministers.

On the recitation of the canonical hours. — Cap. VIII.

9 Let all recite daily the seven canonical hours, namely, Matins, Prime, Terce, Sext, None, Vespers and Compline. Clerics, namely the Psalter, for Prime "O God, in thy name," "Blessed are the undefiled," up to "Lay down the law," and the other psalms of the hours, according to the order of clerics with "Glory be to the Father," let them say. But when they do not go to the Church, let them strive to say for Matins the psalms which clerics say or the cathedral Church, or at least, as others who are illiterate, for Matins twelve times, and for any other hour seven times, let them not omit to say "Our Father" with "Glory be to the Father." In which, namely Prime and Compline hours, let those who know add the lesser creed and "Have mercy on me, O God." But if they have not said the hours at the appointed times, let them say "Our Father" three times. The infirm, however, are not bound to say such hours, unless they wish. But in the Lent of St. Martin, and also in the greater Churches in whose parishes they dwell, let them strive to go personally to the morning hours, unless they are excused by a reasonable cause.

That all who are able by law shall make a will. — Cap. IX.

10 On wills. Moreover, all to whom the faculty has been granted by law shall make or draw up a will, and shall order and dispose of their goods within three months immediately following their entry, lest any of them should happen to die intestate.

On restoring peace among the brothers and other outsiders. — Cap. X.

11 Concerning peace between brothers and sisters. Concerning peace, or also concerning the settling of discord among outsiders, as it shall seem good to the ministers, so it shall be done, with the counsel of the diocesan bishop being employed (if opportunity should afford) in this matter. When they are harassed contrary to law, or their privileges. — Cap. XI. If indeed brothers or sisters are vexed contrary to law or their privileges by the authorities or rulers of the places where they have their residence, the ministers of the place shall strive to have recourse to the bishops and other ordinaries of the places, according to the counsel and ordinance of the same, proceeding in the manner set forth in the records.

That they beware, as much as they are able, from solemn oaths. — Cap. XII.

12 Let all abstain from solemn oaths, unless necessity compels in cases excepted by indulgence of the Apostolic See, namely, for peace, faith, calumny and the bearing of testimony, and also in the contract of buying, selling and donation, where it shall seem expedient. In common speech also let them avoid, as much as they are able, oaths. And whoever on any day shall have sworn less carefully by a slip of the tongue (as is wont to happen in much speaking), on that day in the evening, when he ought to reflect on what he has done, let him say the Lord's Prayer three times, on account of such oaths carelessly made. Let each one moreover be mindful to exhort his own household to divine worship.

Concerning hearing Mass and holding a gathering. — Cap. XIII.

13 Let all healthy brothers and sisters of any city or place, on individual days (if they conveniently can), hear Mass, and each month let them gather at the church or places to which the ministers shall have arranged, there to hear the solemn Masses. Each one moreover shall give to the collector a denarius of usual currency, who shall collect such money, and by the counsel of the ministers shall divide it among brothers and sisters burdened by poverty, and especially among the infirm, and those who are known to lack the solemnities of funeral rites, and then among other poor people appropriately. Let them moreover offer from the same money to the aforesaid Church. Then (if they conveniently can) let them endeavor to have a religious man competently instructed in the word of God, who shall exhort them to penance and the exercise of works of mercy, shall carefully admonish and persuade them. Let each one, while the office of Mass is being celebrated and the word of preaching is being set forth, strive to keep silence; let him be attentive to prayer and the office, unless the common utility of the fraternity should hinder. Concerning brothers who are infirm and deceased.

14 Cap. XIV.

15 When it happens that any one of the brothers falls ill, the ministers through themselves or through another, or others (if the infirm person shall have had this intimated to them) shall be bound to visit the sick person once in a week, carefully inducing him to receive penance (as they shall judge it better and more efficaciously to be expedient), ministering to him the necessaries from the common goods. And if the aforesaid infirm person shall depart from this present light, it shall then be announced to the brothers and sisters present in the city or place where he happened to die, so that they may strive to be personally present at the funeral rites of the deceased. From which, until the solemn Masses shall have been celebrated and the body committed to the tomb, let them not depart. We also wish this same thing to be observed concerning infirm and deceased sisters. Furthermore, within eight days immediately following his burial, each one of the brothers and sisters shall say for his soul, namely the priest one Mass, knowing the Psalter, fifty Psalms, and the illiterate the same number of Our Fathers, and at the end of each let them add Eternal rest. And after this, within a year for the welfare of the brothers and sisters, both living and deceased, let three Masses be celebrated. Those who know the Psalter, let them say it, and the others shall not omit to say the Lord's Prayer one hundred times, adding Eternal rest at the end of each.

16 Concerning ministers. — Cap. XV.

17 Let each one devoutly undertake the ministries and other offices which the series of the present formula expresses, and let him take care to exercise them faithfully. The office of each one moreover shall be limited to a certain space of time. Let no minister be appointed for life, but let his ministry be comprehended within a certain time.

18 Concerning visitation and correction of those who offend.

19 Cap. XVI.

20 To this end let the ministers and brothers and sisters of the said city and of any place whatsoever come together for a common visitation in some religious place, or church, where such a place should happen to be lacking, and let them have as visitor a priest who shall be of some approved religious order, and who shall enjoin upon them salutary penance for the excesses committed. Nor can any other exhibit to them the office of such visitation. But since the present form of living received its institution from the Blessed Francis aforesaid, we advise that visitors and inspectors be assumed from the order of the Friars Minor, whom the custodians or guardians of the same order, when requisitioned upon this matter, shall have deemed fit to assign. We do not wish, however, that such a congregation be visited by a layperson. Moreover, let the office of such visitation be exercised once in a year, unless some necessity should require it to be done more frequently. But let incorrigible and disobedient persons be preceded by a threefold admonition. If they shall not have taken care to correct themselves, let them be entirely expelled from the fellowship of the said congregation by the Council of the discreet. Concerning the avoidance of lawsuits among themselves and with others.

21 Cap. XVII.

22 Let the brothers and sisters moreover avoid (as much as they are able) lawsuits among themselves, and if such should arise, let them diligently settle them: otherwise, by right they shall answer before him in whose power the authority of judging resides.

23 In what manner and by whom dispensation may be granted in matters of abstinence. — Cap. XVIII.

24 Moreover the Ordinaries of places, or the visitor, together with all the brothers and sisters,

25 in abstinences, fasts and other austerities, from a legitimate cause (when it shall seem expedient) shall be able to grant dispensation.

26 That their ministers denounce manifest faults to the visitor. — Cap. XIX. Moreover let the ministers denounce to the visitor the manifest faults of the brothers and sisters to be punished. And if anyone shall be incorrigible, after the instance of a threefold admonition by the ministers (with the counsel of some of the discreet brothers) let him be reported to the visitor himself, to be cast out from the fellowship of the fraternity by him, and afterwards to be made public in the congregation.

27 In what manner in the aforesaid matters no one is bound to mortal sin. — Cap. XX.

28 Furthermore in all the foregoing matters, which your brothers of the order are not bound to by divine precepts or statutes of the Church, we do not wish that any of them be bound to mortal sin,

29 but let him receive the penance imposed upon him for the excess of transgression with prompt humility, and let him strive efficaciously to fulfill it.
