Misericors Dei Filius
Apostolic Letter on the Rule of the Third Order of St. Francis
MISERICORS DEI FILIUS*
LEO BISHOP SERVANT OF THE SERVANTS OF GOD
For perpetual remembrance of the matter
1 The merciful Son of God, who, by imposing upon men a yoke that is sweet and a burden that is light, provided for the life and salvation of all, left to the Church which He founded as heir not only of His power but also of His mercy, so that the benefits obtained through Him might be propagated to all ages of centuries with the same constant tenor of charity. Therefore, just as in those things which Jesus Christ either performed or commanded in His entire life, that mild wisdom and invincible magnitude of kindness shone forth, so likewise in the individual institutions of Christian society there stands out a certain wonderful indulgence and gentleness, so that the Church plainly appears to bear in this very matter a likeness to God, who is charity [1 John IV, 16]. Now this office of such maternal piety is especially proper, to adapt laws wisely, insofar as it can be done, to the times, to the customs, and in commanding and exacting always to use the greatest equity. And by such a custom of charity together with wisdom it comes to pass that the Church joins the absolute and eternal immutability of doctrine with the prudent variety of discipline.
2 By this reasoning, conforming Our mind and thought in the exercise of Our Pontificate, We hold it to be a duty of Our office to estimate by the judgment which is proper the nature of the times, and to look upon all things, lest any difficulty deter anyone from the useful exercise of virtues. And indeed it has pleased Us to consider according to this norm the confraternity of Franciscans of the Third Order, which is called secular, and to determine carefully whether its laws ought to be moderately tempered on account of changed times.
3 That illustrious institution of Father Francis We have commended most earnestly to the piety of Christians through an Encyclical Letter Auspicato which We gave on 17 September in the year preceding. We gave it, however, with this will and this sole purpose, that as many as possible might be seasonably recalled by Our invitation to the praise of Christian holiness. For the origin is greatest both of the evils which destroy and of the dangers which are feared, neglected Christian virtue: but to remedy the former and to avert the latter, men are able by no other means than by hastening, both privately and publicly, to a return to Jesus Christ, who is able to save for ever them that come to God by Him [Heb. VII, 25]. Now in observing the precepts of Jesus Christ the Franciscan institutions are wholly placed: for the most holy founder looked to nothing else than that in them, as in a certain arena, Christian life might be exercised more diligently. Truly the two prior Franciscan Orders, informed with the disciplines of great virtues, pursue something more perfect and more divine: but they are for the few, namely for those to whom it has been granted by God's gift to strive toward the holiness of evangelical counsels with a certain singular eagerness. But the Third Order was born apt for the multitude: and how much it can accomplish for just, upright, and religious customs the monuments of earlier times and the matter itself declare.
4 To God, the author and helper of good counsels, we ought to render thanks, that the ears of the Christian people were not closed to those exhortations of Ours. Indeed, from many places it is reported that piety toward Francis of Assisi has been stirred up, and the number of those seeking the confraternity of the Third Order has grown everywhere. Wherefore, as if providing incentives to those running, We have determined to direct Our thought to that matter, from which this salutary course of souls seemed to be able to be hindered or retarded in some way. And first indeed We perceived that the Rule of the Third Order which Our Predecessor Nicholas IV approved and confirmed by Apostolic Constitution Supra Montem on 18 August 1289, does not altogether correspond to the times and customs in which men now live. Hence, since the undertaken duties cannot be fulfilled without trouble and excessive labor, it has been necessary hitherto to remit many chapters of the laws at the petitions of the members: which indeed cannot be done without detriment to common discipline, as is easily understood.
5 Then there was also another cause in the same confraternity which claimed Our cares. Namely, the Roman Pontiffs, Our Predecessors, embraced the Third Order from its very birth with the greatest benevolence, and granted to the members many and sufficiently ample Indulgences for the expiation of sins committed. The matter of these became more complicated in the course of years: and it often came into dispute whether the pontifical indulgence was certain in certain cases, and at what time, and in what manner it was lawful to use the same. Certainly the foresight of the Apostolic See has not been lacking in this matter: and namely Blessed Benedict XIV by Constitution Ad Romanum Pontificem on 15 March in the year 1751 took care to remove the earlier doubts; yet not a few, as usually happens, the passage of time brought forth anew.
6 Wherefore, moved by the consideration of such inconveniences, We have designated from the sacred Council entrusted with the protection of Indulgences and sacred relics several of Your Eminence the Cardinals, who might carefully review the ancient laws of the Tertiaries; likewise examine all the Indulgences and privileges set forth in the commentary: and having applied discerning judgment, report to Us on this matter, what they judged should be retained and what should be renewed according to the condition of the times. When the business had been transacted as commanded, they indeed advised Us that the old laws ought to be bent and accommodated to these recent customs of living, with the alteration of certain chapters. Concerning the Indulgences, however, lest any place for hesitation remain, and to prevent the danger of prohibition, lest anything be done unlawfully, they judged that We would act wisely and usefully following the example of Benedict XIV, if, having revoked and abrogated all the Indulgences which had hitherto been valid, We should decree certain others anew for the same sodality.
7 Therefore, that it may be good and prosperous, may amplify the glory of God, may kindle more ardently the study of piety and the other virtues, We by these Letters with Our apostolic authority renew and establish the Law of the Franciscan Order of the Third, which is called secular, in the manner as described below. Yet by this action let nothing be thought to be taken away from the very nature of the Order itself; which We absolutely will to remain unchanged and entire. Furthermore, We will and command that the same members of the sodality be able to use the remissions of penalties, or Indulgences, and privileges, which are listed below in the index, with all Indulgences and privileges completely removed, which this Apostolic See had granted to the same sodality at any time, or by any name, or in any form before this day.
8 Law of the Members of the Franciscan Third Order
9 which is called Secular
10 Cap. I. CONCERNING ADMISSION, NOVITIATE, AND PROFESSION.
11 § I. No one may be admitted unless they are older than fourteen years, and are of good morals, maintaining harmony, and above all proven in the holiness of the Catholic profession, with evident obedience toward the Roman Church and the Apostolic See.
12 § II. Married women shall not be admitted unless with the knowledge and consent of their husband, except if it should seem otherwise to be done, with the judgment of their confessor as arbiter of conscience.
13 § III. Those admitted to the sodality shall wear a small scapular and a cord in the customary manner: if they do not wear them, they shall lack the stated privileges and rights.
14 § IV. Those who enter the Third Order shall require one year of novitiate: then, having duly professed the Order, each shall pledge that they will observe the laws of God, will be obedient to the word of the Church; if they should fail in any of those things which they have professed, they shall make satisfaction.
15 Cap. II CONCERNING THE DISCIPLINE OF LIVING.
16 § I. Members of the Third Order shall maintain in all dress and habits, setting aside more costly elegance, that rule of moderation which befits each one.
17 § II. They shall abstain with great caution from dances and more wanton theatrical games, likewise from excessive feasting.
18 § III. They shall use food and drink frugally: and neither shall they sit down at nor rise from table before invoking God piously and gratefully.
19 § IV. Each shall observe the fast of the Immaculate Virgin Mary, likewise of Francis the Father, on the day before their solemn feasts: it is most praiseworthy if any shall further observe either the fast on Fridays, or abstinence from meat on certain Wednesdays, according to the ancient discipline of the Tertiaries.
20 § V. They shall make proper confession monthly; likewise they shall approach the divine banquet monthly.
21 § VI. It pleases Us that Tertiaries from the order of Clerics, who give themselves daily to the Psalms, owe nothing further on this account. Lay persons, who recite neither the canonical hours nor the Marian prayers, commonly called the Office of the Blessed Virgin Mary, shall use the Lord's Prayer with the Hail Mary and Glory be to the Father twelve times each day, except if illness does not permit.
22 § VII. Those who have the power to make a will shall each make their will concerning their property in due time.
23 § VIII. In family life they shall strive to go before others by example: they shall promote the arts of piety and the best things. They shall not allow books or journals to be brought into their house from which harm to virtue is to be feared, nor shall they permit those who are in their power to read them.
24 § IX. They shall diligently maintain benevolent charity both among themselves and toward others. They shall take care to settle disagreements wherever they are able.
25 § X. They shall never swear an oath except when necessary. They shall avoid speaking shameful things and scurrilous jests. They shall examine themselves in the evening whether they have done anything of this sort rashly: if they have, they shall correct the fault by repentance.
26 § XI. Those who are able shall attend divine worship daily. They shall come together for the monthly gatherings which the Prefect shall have convened.
27 § XII. Each shall contribute to the common fund according to their means something, whereby either the poorer among the members of the sodality, especially those afflicted with illness, may be relieved, or the dignity of divine worship may be provided for.
28 § XIII. The Prefects shall either visit a member who is sick themselves, or send someone to perform the offices of charity. They shall likewise, in a serious illness, admonish and urge that the sick person promptly attend to those things which pertain to the cleansing of the soul.
29 § XIV. At the funeral of a deceased member, the members and guests shall gather together, and at the same time shall recite the Marian prayers according to the institution of the Father Dominic, that is the Rosary, the third part for the heavenly consolation of the deceased. Likewise priests during the divine service, and the laity, if they are able, having received the Eucharist, shall devoutly pray for eternal peace to their deceased brother.
30 Cap. III. CONCERNING OFFICES, VISITATION, AND THE LAW ITSELF.
31 § I. Offices shall be conferred upon members summoned to the assembly. Let these offices be for a term of three years. Let no one refuse the duties undertaken without just cause, nor perform them carelessly.
32 § II. The Curator, who is called the Visitor, shall diligently inquire whether the laws are sufficiently observed. For this reason, he shall visit the seats of the confraternities in each year, and more frequently if the matter requires it, according to his authority, and shall hold a meeting with all the Prefects and members ordered to be present. If the Visitor shall recall anyone to office by admonition and command, or if he shall decree anything against anyone in the name of salutary punishment, let this be accepted humbly, and let the same not refuse to undergo it.
33 § III. Visitors shall be chosen from the First Order of Franciscans, or from the Third Regular Order, whom the Custodians or Guardians, if asked to do so, shall designate. Let the office of Visitor be forbidden to lay men.
34 § IV. Members who are disobedient and harmful shall be admonished a second and third time concerning their duty: if they do not obey, they shall be ordered to withdraw from the Order.
35 § V. If anyone shall perchance transgress in these laws, let them know that they shall incur no guilt on this account, except in those matters which are otherwise prescribed by divine law or the laws of the Church.
36 § VI. If any chapter of this law should be prevented from being observed by anyone for grave and just cause, it shall be lawful to dispense that person from the law in that respect, or to prudently commute those chapters. The Prefects of the ordinary Franciscals of the First Order and the Third, as well as the Visitors mentioned above, shall have the faculty and power for this.
37 Cap. I. CONCERNING PLENARY INDULGENCES.
38 To Tertiaries of both sexes individually, who, having been purified by confession and Christian rite, shall have received the sacred Eucharist, the right of obtaining a plenary indulgence shall belong, on the days and for the causes which are written below:
39 I. On the day of admission: II. On the day on which individuals first profess the Order: III. On the day on which they gather for the monthly sermon or Conference, provided they shall have visited some public church or place of worship for the sake of piety, and shall have commended the Christian cause to God in the customary manner: IV. On the 4th day of October, the birthday of Francis the Father and lawgiver: on the 12th day of August, the birthday of Clare the Virgin and lawgiver: on the 2nd day of August, the feast of Mary Queen of the Angels on account of the dedication of her Basilica: likewise on the day on which the anniversary solemnities are celebrated of the Saint in whose church the seat of the confraternity is established, provided they shall have visited that church for the sake of piety and shall have commended the Christian cause to God in the customary manner: V. Once in each month, on whatever day pleases each one, provided they shall have visited some public church or place of worship for the sake of piety, and shall have persisted for some time in supplication to the mind of the Supreme Pontiff: VI. As often as, in pursuit of a better life, they shall have withdrawn for eight continuous days to engage in fixed meditations of the mind: VII. Likewise to the dying, if they shall have invoked the holy saving name of Jesus either by voice, or, if they shall have ceased to be able to speak, by will. These same shall enjoy the same right, if, not being able to receive holy Confession and Eucharist, they shall have expiated their sins by sorrow of heart. VIII. To those accepting twice in the year the Blessing in the name of the Supreme Pontiff, if they shall have supplicated God for some time to the mind of that Pontiff: and likewise, by this same law of supplication, to those accepting what is called the Absolution, that is the Blessing, through these days which are written below: I. On the birthday of Our Lord Jesus Christ: II. on the solemn day of the Resurrection of Easter: III. on the solemn day of Pentecost: IV. on the feast of the Most Sacred Heart of Jesus: V. likewise on the Immaculate Conception of the Blessed Virgin Mary: VI. On the 19th day of March, the day of Joseph her spouse: VII. On the 17th day of September, the feast of the Impression of the sacred Stigmata of Francis the Father: VIII. On the 25th day of August, the day of Louis king of the Gauls, the heavenly Patron of the members of the Third Order: IX. On the 19th day of November, the day of Elizabeth of Hungary. IX. Likewise once in a month, if anyone shall have recited the Pater, Ave and Gloria Patri five times for the safety of the Christian cause, once to the mind of the Supreme Pontiff, those persons shall enjoy every right for expiation of the stains of the soul, which those enjoy who undergo the stationary supplications in the City, and those who celebrate the Portiuncula, the most holy places of Jerusalem, the shrine of the Apostle James at Compostela, for the sake of religion. X. On those days on which stationary supplications are designated in the Roman Missal, if they shall have visited a sacred church or place of worship in which they shall have commended the Christian cause to God in the customary manner, in that same church or place of worship through those same days they shall enjoy the most ample right which citizens and guests enjoy in the City.
40 I. To individual Tertiaries of both sexes, if they shall have celebrated in the sacred temple or sanctuary in which the seat of the sodality is established, and shall have made supplication to God for the safety of Christian affairs on the day on which the sacred Stigmata were divinely impressed upon St. Francis the Father, likewise on the feast of St. Louis the King, St. Elizabeth Queen of Portugal, St. Elizabeth of Hungary, St. Margaret of Cortona, and also on twelve other days which each one shall have chosen and which the Prefect of the Order shall have approved, let such supplication serve in place of seven years and seven times forty days of satisfaction. II. As often as they shall have attended Masses or other divine offices, or public or private assemblies of the sodality: received the poor with hospitality: composed or endeavored to compose dissensions: proceeded in a procession duly conducted: accompanied the August Sacrament when it is carried about, or, if they were unable to accompany it, shall have recited the Lord's Prayer with the Hail Mary once at the sound of the bell: shall have recited the Prayer and the same Hail Mary five times for commending Christian affairs or the souls of deceased sodality members to God: carried out a dead person: brought back to duty anyone who had gone astray: instructed anyone in the precepts of God and other things necessary for salvation: or done anything else of this kind of charity, as often as any one of them shall have done any one of these things, it shall be permitted to strike three hundred days from the number of penal days for each one. To Tertiaries, if they wish, it shall be permitted to apply all and each of the indulgences mentioned above, whether plenary or partial, to expiate the stains and penalties of the deceased.
41 I. To priests from the order of Tertiaries celebrating at any altar, it shall be permitted to offer Mass on three days of each week, provided they have not obtained a similar faculty to offer Mass on another day. II. Whoever shall have offered the sacred Mass for the expiation of the souls of deceased sodality members, he, wherever he may be, shall have obtained pardon for the deceased by the Mass offered.
42 And all and each of these things, as they have been decreed above, thus we will to be firm, stable, and ratified in perpetuity: notwithstanding Constitutions, Apostolic Letters, statutes, customs, privileges, and other rules of Ours and of the Apostolic Chancery and anything whatsoever to the contrary. Therefore let no one of mankind be permitted to violate these Letters of Ours in any way or in any part. But if anyone shall dare to attempt anything against them, let him know that he will incur the indignation of Almighty God and of the blessed Apostles Peter and Paul His.
43 Given at Rome at St. Peter's, in the year of the Lord's Incarnation one thousand eight hundred and three, on the third day before the Kalends of June, in the sixth year of Our Pontificate.

MISERICORS DEI FILIUS*
LEO EPISCOPUSSERVUS SERVORUM DEI
IV, 16], gerere Ecclesia videatur.
Nimirum Romani Pontifices Decessores Nostri Tertium Ordinem iam inde a natali suo summa benevolentia complexi, Indulgentias complures et satis amplas in expiationem admissorum sodalibus concessere.

A perpetua memoria.
8 Capo I - Dell’accettazione, noviziato, professione
26 XIII.
36 Capo I - Delle Indulgenze plenarie

48 Capo II - Delle Indulgenze parziali
52 Capo III - Dei Privilegi
53 I. I Sacerdoti iscritti al Terz’Ordine, dovunque celebrino, godano personalmente dell’altare privilegiato, tre giorni di ciascuna settimana, purché non abbiano ottenuto simile privilegio per altro giorno.
