Actum praeclare

CONSTITUTIO APOSTOLICA qua in insula Cubana eriguntur duae novae dioeceses i. e.
LEO PP. XIII.
Ad futuram rei memoriam.
1 Actum praeclare a divina Providentia cum Cubana insula est, quae regio praedives maximeque frugifera, quemadmodum immortali viro Christophoro Columbo patuit e primis, ita maturius lumini christianae veritatis accessit. Quo Deji beneficio celerrime per eas gentes diffuso, Leo X, Decessor Noster, minime dubitavit parochialem ecclesiam S. Iacobi de Cuba in cathedrae episcopalis honorem provehere. Aucto fidelium numero, eadem provinciae caput seu metropolitana declarata est a Pio VII P. M., die XXIV mensis Septembris anno MDCCCIII, subiecta illi sedi Avanensi, quam eiusdem nominis Decessor Pius VI instituerat. Haec vero Pontificum Romanorum haud intermissa sollicitudo, ab iisdemque permissum Hispaniae regibus munus tuendi tam felices insulas, rei catholicae apud Cubanos proximosque incolas talia in dies incrementa attulerunt, qualia vix a confirmatis diuturna humanitate ac religione gentibus expectari possent.
2 Nuperrime conversus bello reipublicae status in vices quoque religionis influxu His de causis, et sublato hispaniensem regum dominio in Cubanam insulam, plane intelleximus nostri muneris esse, pro ratione temporis earum regionum bono consulere. Itaque Ven.
Hi sacra obeunti solemniore ritu episcopo adstabunt. In beneficiis ecclesiasticis conferendis vel Canonicis vel aliis sacri ordinis viris serventur leges plenarii Concilii latini Americani et authenticae earum declarationes editae a S. Congregatione Negotiis ecclesiasticis extraordinariis praeposita ; quibus legibus haud minus ac SS. Canonum decretis Canonici pareant in suis muneribus obeundis.
Qua super re (1) Conc. Trid., De Ref., Sess. 24, C. XII.
Huc spectant, quae 1 per S. R. E. Cardinalem a publicis negotiis declaranda curavimus datis Litteris Calendis Maii an. MDCCCC.
8 Quae praesentibus Litteris constituimus, quae monuimus, procul dubio e sententia procèdent suosque parient fructus, si sacri ordinis viri summo studio curaverint suo ministerio sese dignos exhibere, confirmantes exemplo doctrinam, vere « facti forma gregis ex animo » 2. Oportet igitur iidem sic vitam moresque conforment, ut habitu, incessu omnique re nihil ipsi redoleant nisi « bonum odorem Christi ». Itaque, ad ecclesiasticam disciplinam roborandam, praecipimus, ubi primum nova dioecesium circumscriptio fuerit promulgata, institutaeque sint novae sedes suisque Pastoribus assignatae, ut Ven. Frater Noster Placidus Ludovicus Chapelle, Archiepiscopus Novae Aureliae, Delegatus Apostolicus Cubanae insulae, cui executionem committimus praesentium Litterarum, convocet Provinciale Concilium, eique praesideat, cuius Acta ad hanc Apostolicam Sedem iuxta canonicas praescriptiones mittat.
FROM THE SECRETARIAT OF BRIEFS
APOSTOLIC CONSTITUTION by which two new dioceses are erected in the island of Cuba, namely Pinar del Rio and Cienfuegos, and other provisions of disciplinary order are issued.
LEO PP. XIII.
For the record of the future.
1 A remarkable work has been accomplished by divine Providence in the Cuban island, which region, most rich and abundantly fertile, as was evident to the immortal man Christopher Columbus from the beginning, has thus more speedily come to the light of Christian truth. By this benefit of God diffused swiftly among those peoples, Leo X, Our Predecessor, did not hesitate to elevate the parish church of St. James of Cuba to the honour of an episcopal cathedral. As the number of the faithful increased, the same province was declared the capital or metropolitan see by Pius VII, P. M., on the 24th day of the month of September in the year 1803, subject to that see of Avana, which a Predecessor of the same name, Pius VI, had established. This solicitude of the Roman Pontiffs, however, was not interrupted, and the permission granted by the kings of Spain to protect such fortunate islands, brought about such increases in the Catholic faith among the Cubans and neighbouring peoples as could scarcely be expected even from peoples confirmed in long-standing humanity and religion.
2 Recently the state of the republic, changed by war, has also affected religion in turn. For these reasons, and with the removal of the dominion of the Spanish kings over the Cuban island, We have clearly understood that it is Our duty to consult the good of those regions according to the circumstances of the time. Accordingly, We sent the Venerable Brother Placidus Ludovicus Chapelle, Archbishop of New Orleans, there with the office of Our Apostolic Delegate extraordinary, who, having diligently examined matters, would accurately report to Us what was most necessary. After all things had been maturely weighed, and especially after observing that the Cuban island has certain mutual affinities and similarities with other peoples of Latin America, therefore by a decree issued on the day before the Nones of September in the year 1898 We provided that the Cuban island should be contained by the same laws which had been enacted by the plenary Council of Latin America, held at Rome in the year 1899. Yet not considering that We had sufficiently met new necessities by these measures, We have turned Our Apostolic solicitude to counsels for ordering the Catholic faith more suitably and seasonably in that region. Wherefore, having heard the opinions of certain Cardinals of the Holy Roman Church of the Congregation set over extraordinary matters, which things seemed in the Lord to be expedient for protecting and promoting religion in the Cuban island, by this Constitution We pronounce by Our supreme judgment.
3 And first, having ascertained that the boundaries of Cuba and Havana extend so widely, and with commerce increasing thus daily in the number of Catholics flowing in, so that for each bishop their visitation is most difficult, we have taken counsel to multiply bishops through those tracts. Therefore we decree that to the dioceses of Cuba and Havana there shall be added, to be separated from them, the sees of Pinar de Rio and Cienfuegos. To the former of these, to which the entire region of its name shall pertain, we have established boundaries: to the north, the Mexican strait; to the east, the province of Havana; to the south, the sea of the Antilles; to the west, the strait of Yucatan. But for the diocese of Cienfuegos, with those boundaries defined by which the civil province of St. Clara is contained, let these be the boundaries: to the north, the old strait of Bacama; to the east, the province of Puerto Príncipe; to the south, the sea of the Antilles; to the west, the province of Matanzas. Let the principal see of the island of Cuba be the same as before, that is St. James, to which see shall be subject, or suffragans, besides the already instituted, which we have mentioned, St. Christopher of Havana, also the two newest, one Cienfuegos, the other Pinar de Rio. The diocese of Puerto Rico indeed we declare released from the bond of subjection to the metropolitan church of St. James of Cuba, and in the meantime subject immediately to the Apostolic See. But the metropolitan bishop shall enjoy his rights, privileges, and offices, both those which obtain by the common force of the sacred Canons and apostolic Constitutions, and those which have been prescribed by the plenary Council of Latin America. In exercising these and in all things which pertain to pastoral ministry, each one according to his office, both the metropolitan bishop and the other bishops shall especially take care that mutual charity flourish among them, that all have one mind, one conspiracy of souls and wills toward the common good. The churches of St. James of Cuba and likewise of St. Christopher of Havana we command that their colleges of Canons, or chapters, be preserved, both on account of the dignity of sacred worship and to aid the bishop according to the prescription of the Holy Canons. But if straitened circumstances do not permit the same number in that assembly which was before, thus shall the revenues be divided, so that in each college, after those constituted in dignity, there may be sufficient to pay for ten canons. We also will that the newly constituted dioceses of Pinar de Rio and Cienfuegos be adorned with their own Chapters as soon as it shall be permitted, and we wish each council to consist of at least ten canons. In the meantime, however, such Colleges not yet canonically instituted, let the bishops choose for themselves from either clergy counselors of men who are commended before others by piety, learning, and experience in conducting affairs. These shall stand by the bishop performing sacred rites in more solemn manner. In conferring ecclesiastical benefices either on Canons or on other men of sacred order, let the laws of the plenary Council of Latin America be observed and the authentic declarations of them issued by the Holy Congregation set over extraordinary ecclesiastical matters; by which laws no less than by the decrees of the Holy Canons let Canons obey in performing their duties.
4 Since indeed those revenues which previously existed have either entirely ceased or have been greatly diminished, it will be most advantageous to the dignity of sacred worship, to the necessities of the clergy, and to other Catholic matters of the dioceses, if provision be made according to the norm of the Holy Canons and according to the prescriptions of the aforesaid plenary Council of America, and if the cathedraticum right be restored; what certain sum of money ought to be assigned to it shall be determined in the next provincial Council. Those things which We decree in these Our Letters concerning the ordering of the hierarchy, concerning the rights, privileges, and honors of those who are placed before others, are indeed suited and nearly necessary both to the best government of the Christian people and to the amplification of divine worship; they are, however, in a certain sense external. But it is of the greatest importance that those to whom both the faithful care of the flock and the vigilance of the house of God itself have been entrusted "be approved as suitable and thus be conspicuous in piety and chaste morals, so that a splendid example of good works and precepts of life may be expected from them" (1). — Nor is it necessary only that men of the Church excel in piety and virtues, but also in both sacred and profane learning, especially at this time when men's studies are turned to the most hidden matters. In this therefore particular care must be placed by bishops, so that they form priests equal to so grave a charge, by whose work the Christian people, surrounded by so many snares and exposed to so many dangers, may be especially aided. From the priestly order thus instituted and prepared, it is fitting (1) Council of Trent, On Reform, Session 25, Chapter XIV.
5 FROM THE SECRETARIAT OF BRIEFS it is for greater matters that they are to be called: "those who, engaged in the clerical order, commend themselves by the learning necessary for the execution of their office and by integrity of morals" (1); but for the governance of souls, those whom the Bishops shall have judged more suitable by reason of age, morals, learning, prudence and other qualities opportune for governing the vacant Church (2). — Moreover, men of the sacred order, in whatever office they are engaged, shall entirely abstain from the study of civil matters, according to that saying of the Apostle: "no one serving God entangles himself with the affairs of this world" (3); and this especially lest the holy religion, which ought to excel all human things and to bind together the minds of all citizens with the bond of mutual charity and benevolence, should appear to fail in its office, and its salutary ministry should be held in suspicion. — Even with such contentions removed, truly a wide field lies open for aiding the Catholic cause, especially by the example of mutual concord, whereby all envy and rivalry being cast out, priests of every order "loving one another with the charity of brotherhood," may be able to coalesce into one body of Christ, as the Apostle has it: "we, being many, are one body in Christ, and every one members one of another" (4). — For the preservation of this concord, no less than for fostering that piety from which the mind can sometimes be drawn away by so many external things, since those pious exercises are of the greatest use by which it is permitted to devote oneself more earnestly to the contemplation of divine things, let the bishops take care that, on fixed days of the year, the men of the Church be gathered together to reflect upon the teachings of the most holy Religion and the duties of priestly life. By this meditation, to which counsels for living more holily shall succeed, and by the frequent use of the sacraments, let them be strengthened and confirmed. — Finally, that the cultivation of sacred discipline may flourish, let there be assemblies in which questions concerning morals and sacred ceremonies be discussed. Truly a great matter is the instruction of the students of the sacred order, the hope of which is almost entirely placed in the Seminaries. In such institutions therefore let the bishops apply themselves to their establishment, and let them exercise careful concern over them, taking care especially that none be admitted except "those whose character and will give hope that they will serve perpetually in ecclesiastical ministries" (5). On this matter (1) Council of Trent, On Reform, Session 24, Chapter XII.
6 FROM THE SECRETARIAT OF BRIEFS several matters have been wisely declared and opportunely enacted by the aforesaid plenary Council of Latin America. But for the spiritual benefit of the whole island of Cuba, we earnestly commend the Pio-Latino-American Seminary, in which many and distinguished heralds of the Gospel and rulers of souls have been educated in the City, the principal city of the whole Christian world and under the very eyes of the Roman Pontiffs, and many future imitators of them are being educated. Wherefore we will that, just as from the other dioceses of America, so also from each diocese of the island of Cuba at least two young men be placed for support in that College, without interruption of succession.
7 Schools for adolescents from the people also demand careful attention from them, especially at a time when the minds of the ignorant are easily corrupted through so many induced errors and so many objects that incite to vice. For it is a matter of the future society of men, such as it shall have proceeded from the beginning, and the more timely it is to be snatched from danger, the more quickly and almost from the cradle it is surrounded by the frauds of the impious. From which no one fails to understand how great is the importance of opening many schools, of watching over them, of examining into the faith and morals of those who teach. It will be expedient moreover to establish those larger schools, in which teachers are formed, for both sexes. The Religious Families, which are engaged in the Cuban island, so well deserving of the Church and of civil society itself, it is scarcely necessary for us to admonish that they not fall away from their former renown; to which they have bound themselves to God by vows; in these let them persevere; let them not break the law of the cloister; let them be obedient to those placed over them; let them conspire with the rest of the clergy with united strength "for the building up of the body of Christ" (1). But those ministries which pertain almost to them, commonly called "missions," a very wide field lies open through these for preserving faith, defending it, and restraining the Christian morals of the people. Truly, in order that more abundant fruit may be obtained from this, it is necessary that in more frequent places religious houses be established, at least of eight men, whose duty it shall be, both in cities and in villages, to hold sermons for the people and to teach them. That the concerted action of the bishops in the Cuban island may be able to meet and provide sufficiently for those things which are commonly needed, episcopal assemblies, or Councils, will be of the greatest utility, in which the necessities of the dioceses may be deliberated upon. To this end pertain those matters which 1 through the Cardinal of the Holy Roman Church we caused to be declared from public affairs by Letters given on the Calends of May in the year nineteen hundred.
8 What We establish and enjoin by these present Letters will undoubtedly proceed from Our intention and will bear its fruits, if the men of the sacred order shall have taken the utmost care to show themselves worthy of their ministry by confirming doctrine through example, truly "becoming a model to the flock from the heart" 2. It is therefore necessary that these same men so conform their life and morals that in habit, bearing, and in all things they exhale nothing but "the good odour of Christ". Accordingly, to strengthen ecclesiastical discipline, We command that, as soon as the new circumscription of dioceses shall have been promulgated and new sees shall have been established and assigned to their Pastors, Our Venerable Brother Placidus Ludovicus Chapelle, Archbishop of New Orleans, Apostolic Delegate of the island of Cuba, to whom We commit the execution of these present Letters, shall convoke a Provincial Council, preside over it, and send its Acts to this Apostolic See according to canonical prescriptions.
9 As for what remains, the best hope holds that the outcome which We earnestly desire shall come to pass, and that what is decreed in these Our Letters shall soon bear salutary fruit. Raised up by this expectation, We turn Our final words to the Cuban people, earnestly exhorting them to persevere invincibly in the faith of their fathers, to preserve unity in the bond of peace, according to their condition, that is, as children obedient to their fathers, to place their works at the service of their sacred Pastors, to obey the precepts of the Gospel, to treat those placed over the commonwealth with due honour, "to fulfil Our joy by having the same charity, being of one mind, feeling the same thing" (2). We decree that these present Letters and whatever they contain can never at any time be noted or impugned on account of subreption or obreption or defect of Our intention or any other defect whatsoever, but shall always be valid and in their full force and effect, and shall obtain their effects in all things and shall be inviolably observed by all of any grade and dignity in judgment and outside of judgment, notwithstanding Apostolic constitutions and sanctions issued in synodal, provincial and ecumenical Councils, whether general or special, as well as the rights and privileges of the ancient Sees of the island of Cuba and of the Missions established therein and of any Churches and pious places whatsoever, even those strengthened by oath, Apostolic confirmation, or any other firmness whatsoever, and all other things contrary thereto, even those worthy of special mention; all of which, insofar as they stand in the way of what is said above, We expressly derogate. We also declare null and void if anything contrary to these matters should happen to be attempted by anyone, by whatever authority or pretext, knowingly or unknowingly.
10 We also will that copies of these Letters, even if printed, yet subscribed by the hand of a Notary and sealed by a man constituted in ecclesiastical dignity, shall have the same force as Our expression of will shown in these present Letters.
11 Let no man therefore infringe this page of Our constitution, ordinance, limitation, derogation, and will, or dare to contravene it with rash presumption. If anyone should presume to attempt this, let him know that he shall incur the indignation of Almighty God and of the Blessed Apostles Peter and Paul. Given at Rome at St. Peter's in the year of Our Lord's Incarnation nineteen hundred and three, on the twentieth day of February, in the twenty-fifth year of Our Pontificate.
