In suprema
Bolla sulla riforma dell'Ordine Cistercense
mazione dell'Ordine Cistercense.
Alessandro Papa VII, a perpetua memoria.
19 xix.
22 xxii.
24 xxiv.

matione Ordinis Cisterciensis.
Alexander Papa VII, ad futuram rei memorìam.
1 In suprema Sedis Apostolicae specula Prooomiura, dispositione divina constituti , dominicum gregem caelitus nobis^ commissum circumspicientes, mentis nostrae aciem convertimus in sacrum Ordinem Cisterciensem, cuius odor, sicut agri pieni sua vitas cui Dominus benedixit , totam replevit Ecclesiam, et veluti fons hortorum irriguus ceteras irrigavit religiones et Ordines.

Pope Alexander VII, for the memory of future generations.
1 Placed by divine disposition in the highest seat of the Apostolic See, we, looking upon the Lord's flock entrusted to us from heaven, turn the gaze of our mind toward the sacred Order of Cistercians, whose fragrance, like a field full of its fruits which the Lord hath blessed, hath filled the whole Church, and like a fountain of gardens hath watered and irrigated the other religious communities and Orders. Yet as the years have rolled on, we have learned not without great sorrow of heart that the aforesaid Order hath departed not a little from the path of its original institution on account of the injury and calamity of the times, and hath suffered many losses both in spiritual and temporal matters. Wherefore we, zealous with singular affection from the duty of our pastoral office, have deemed it our part to apply the care of our solicitude to the restoration and reform of so great an Order, relying upon divine assistance: so that monastic discipline, where it hath collapsed, may be restored, and where it hath been preserved, may persevere more steadfastly, unity may be maintained in the Order, and the dissensions and conflicts which have long since arisen in the kingdom of France between the monks of the common and strict observance, being cut off, sincere peace and mutual offices of charity may, with the Lord blessing, be restored.
2 § 1. Indeed, by our letters previously issued in the form of a Brief, on 16 January in the year of our pontificate seven, by the vote of a particular congregation appointed by us for this purpose, which examined and reviewed the writings given from various quarters, we evoked the cause of the reform itself from any tribunal whatsoever to ourselves, in the state and terms in which it was then found, and we gave in charge to our beloved son Claude Vaussin, Abbot General of the entire Order of Cistercians, that he should summon or admonish suitable men of his Order, both from France and elsewhere, to present within three months to the said particular congregation appointed by us articles concerning the said reform instituted by us, and other matters, as is more fully contained in the aforesaid letters.
3 And when the aforesaid Claude, obeying our commands, transmitted to us the articles of reform, and likewise the beloved sons, the abbots of strict observance introduced in France many years ago, protested: we, having the articles thus presented on both sides carefully and maturely examined and weighed by a congregation of certain venerable brothers of ours, Cardinals of the Holy Roman Church, and beloved sons, prelates of the Roman Curia appointed by us for this purpose, have made such a fitting restriction of those very articles to the general reform of the Order of Cistercians and such a reduction to the chapters of the Rule of St. Benedict, namely:
Concerning Chapter II of the Rule, What the Abbot ought to be.
4 i. According to the decrees of the sacred Council of Trent, let the abbots and superiors of the said Order take the greatest care that the essential vows, which are the bases and foundations of all regular discipline, be inviolably observed by their subjects of both sexes. Let the abbots and superiors themselves, being made a pattern of the flock from the heart, set an example in all things, following the Rule as their master.
5 ii. Let the abbots and convents have their own seals, and let new abbots be bound to take an oath not to alienate or pledge the goods of the monastery, and not to spend its monies and revenues uselessly: and all officials shall take the same oath concerning the faithful exercise of their duties, and concerning not contracting debts, unless the apostolic constitutions be observed.
The tenor of the articles.
6 iii. Since regular visitations greatly conduce to the restoration and preservation of monastic discipline, let the general chapter, the Abbot of Cistercians, General of the Order, and the four first abbots of Firmitas, of Pontigny, of Clairvaux and of Morimond provide diligently that each year visitations be made solicitously, charitably, prudently and with piety for the salvation of souls, the worship of God, the observance of essential vows, and other matters which pertain to the morals, correction and edification of regular persons, as well as to the administration and temporal state. Let the visitors beware especially of receiving any gifts, and also lest they burden the monasteries with too numerous a retinue or household or with greater expenses than is expedient, and let them eat during the visitation in the refectory with the brothers, for the sake of maintaining discipline.
7 iv. Let regular abbots, even perpetual ones, be subject to visitation and correction by visitors, even those who are not abbots, and by them let them be compelled, by suspension of jurisdiction and other ecclesiastical penalties and censures, with the order of law being observed, to maintain a sufficient number of monks to be properly and religiously trained, to make repairs to buildings, to pay the annual contributions of the Order, and to bear the common burdens of the Order and provinces.
8 v. They shall be bound to reside in their own proper monasteries, as is required by law; nor shall they dwell in castles, nor in granges, or elsewhere, outside the enclosures of their monasteries: nor shall they dare to undertake the governance and visitation of any nuns of another Order without express licence of the Supreme Pontiff, under the penalty of deprivation of active and passive voice to be incurred ipso facto.
9 vi. Between the regular abbots and the convents or officials of the monasteries there shall be no
10 division of honours, fruits, revenues and income; but let them be assigned to their common uses according to the statute of Pope Benedict XII; unless for the better governance and utility of certain monasteries, to prevent dissipation, the general chapter or the intermediate assemblies should judge otherwise. vii. Let the superiors and visitors of the Order nevertheless take care that in the commended monasteries, as far as it can be done, the pensions of the religious and servants be assigned in stable property.
Concerning Chapter III On the Brothers to be Employed in Council.
11 viii. General chapters shall be celebrated every three years at Cîteaux, and all abbots, unless legitimately hindered or excused for just causes, together with abbots deputed from congregations, general procurators, visitors and syndics of provinces, provisors or rectors of colleges, shall be bound to be present, to render an account of the duties committed to them and of the acts performed by them, and to treat of matters to be done or reformed in the future in the fear of God according to the regular institutes of the Order and apostolic constitutions.
12 ix. Although, however, only the definitors have a decisive voice in making definitions, nevertheless all abbots, and other suitable persons well-deserving of the Order, to be designated by the judgment of the abbot general and the four first abbots and to be named after the election of the definitors, shall have a consultative voice. x. Let the constitutions also be observed concerning the number of those whom the said abbots of the Order coming to the chapter were formerly able to bring with them; and let no one who does not have the right to intervene, or who has not been called, dare to approach the said chapters without licence sought and obtained from the abbot general.
13 xi. And because many matters arise daily which require mature deliberation, at any time intermediate between two chapters, on a day and at a place to be designated by the abbot of Cîteaux, let the abbot of Cîteaux himself and the four first abbots convene with others from the provincial visitors of monasteries of both observances, the presidents of congregations, the general procurators and the syndics of provinces, who shall have matters of great importance to transact; and that the celebration of the said assembly be known to all, the said general abbot shall be bound to announce it in the customary manner six months beforehand to the presidents of congregations, the provincial visitors, the general procurators and the syndics, so that they may come to the said assembly or send representatives, and may inform the said general abbot and the four first abbots of the state of their congregations: besides which assembly, let no other be held throughout the kingdom of France, under any pretext whatsoever, unless it be permitted by the general chapter.
14 xii. Visitors of provinces of monasteries of the common observance shall be instituted by the general chapter, or, if it be not in session, by the abbot of Cîteaux, with the counsel and consent of the four first abbots, like other public officials, not only from the number of approved religious of the common observance, but also, if they shall judge it thus expedient, from the number of religious of the strict observance or abstinence, whose counsel and assistance they may use for instituting the present reformation.
15 xiii. Likewise the provisor of the college of Paris, the procurator, doctors, regents and other officials according to the constitution of Pope Benedict XII shall be instituted and removed by the general chapter of the Order, or, if it be not in session, as is customary, by the abbot of Cîteaux, exercising the authority of the general chapter, until the general or intermediate chapter, whether they be of the common observance or of the stricter. xiv. Similarly, having consulted the provincial visitors concerning the merits or demerits of the religious, let the cloister priors and confessors in the monasteries of nuns be instituted and removed at the discretion of the said general abbot and the four principal abbots and others having filial relationship respectively, removable at will, observing the moderation that in the monasteries of stricter observance of men and nuns they cannot institute any one who does not profess abstinence: and although all the officials of the Order and priors of monasteries are removable at will, nevertheless every three years let them make a voluntary resignation of their offices and priorates in writing to the general chapter, to the abbot of Cîteaux, to the four first abbots, and to the other superiors by whom they were respectively instituted, with facility however of continuing them in their offices and priorates as long as they shall find and judge them suitable.
Concerning Chapter VI On Silence.
16 xv. Let all maintain the praiseworthy custom of keeping silence from Compline until the time of Chapter on the following day in every place and always in regular places, namely in the regular cloister, in the church, in the dormitory, in the refectory and in the warming room, with the faculty however of requesting necessities in a submissive voice without scruple of conscience.
Concerning Chapter VIII through XX inclusive: On the form of divine office and the manner of chanting.
17 xvi. Let this form be observed most exactly, and let the matter be taken from the use of the Roman Church for the glory of God and the edification of neighbour, as the Cistercian Church has been accustomed hitherto, since as a mother all other churches of the elect Order, by the charity of the definitions and precepts of Eugene III and Pius V, are bound to conform themselves. But in order that this uniformity in performing divine office be maintained in all the monasteries of the Order, with the same rites and chant and all books necessary for the daytime and nighttime hours and masses, according to the aforesaid form of the Cistercian monastery, let all make use of them. xvii. At the canonical hours, the office of the Blessed Virgin and of the dead according to the praiseworthy uses and customs of this Order, to be recited and chanted in choir, let all and each one attend with their cowls, and let them perform the canonical hours with Gregorian chant according to the rule.
18 xviii. On the more solemn feast days let them rise at the second hour after midnight, but on other days more moderately, as shall be determined by the General Chapter. At Matins after the office of the Blessed Virgin Mary, and after Compline, or at other suitable hours, let them devote themselves for half an hour at each time to meditation, and for ten days to spiritual exercises once in a year.
Concerning Chapter XXII: How monks should sleep.
19 xix. Let all, both abbots and monks, both abbesses and nuns, recline in the dormitory of the chapter, except those who on account of their offices or business, or for other just causes, ought to be excused from it according to the judgment of the abbot or other officials. Although indeed the rule commands, and also the constitution of Pope Benedict XII prescribes, that all sleep in one place without separate cells; yet, for the sake of greater modesty and honesty of life, as has been proven by long experience, and to provide for the infirmities of each, the use of the aforesaid cells comes to be tolerated, provided that, according to the decrees of Pope Clement VIII, the superior have the key, so that when it shall seem good to him, he may be able to open all the cells. And let no one close his cell even at night in such a way that it cannot be opened by the superior. Let there also be in the door an opening covered with a hanging or sliding board. Let all sleep clothed with a small white hood. Let the bedding be arranged in them according to the rule, and let the furnishings be such as befits the state of poverty which the monks have professed: let nothing superfluous be in it, and let nothing necessary be lacking in it either.
Concerning Chapter XXVIII: On those who are not amended though corrected often.
20 xx. Let the decrees of the sacred congregation of the Council concerning regular apostates and those expelled be observed, and according to those decrees only let the incorrigible be expelled from the monasteries and the Order.
Concerning Chapter XXXI: On the cellarer.
21 xxi. The administration of temporal goods, according to the decree of the Council of Trent, shall be done through officials, namely as the abbot shall have enjoined upon them, removable at his pleasure, so that concerning all receipts and expenses they are bound to render a faithful account before the abbot or superior and the seniors of the house: but let all money be kept by one bursar, to be appointed by the abbot or superior with the counsel of the seniors, in a chest under three keys, of which one shall remain with the abbot or superior, another shall be guarded by the senior of the house, and the third by the bursar himself. Let no one of the superiors of places be able to have or exercise the administration of goods, or of other things, and the dispensation of money and revenues of his convent, even in the name of the convent, by himself; but let the whole of this burden be entrusted by the General to three brothers of the same convent, so that one shall have the care of collecting and exacting things and goods and revenues, another as a depositary shall faithfully preserve the money and other things collected and exacted by the former, another, from the money and things received from the depositary, shall provide for the superior and brothers and the whole convent with necessities, commanding however the superior himself, not according to his own affection, but according to the rule of charity, as a good steward; the confusion of such offices being entirely forbidden.
Concerning Chapter XXXIII: Whether monks ought to have anything of their own.
22 xxii. Let the common life be observed everywhere according to the decrees of the Council of Trent, of Pope Benedict XII and Clement VIII: nor shall it be lawful for any of the regulars, whether men or women, of the said Order to possess or hold any goods as their own, or even in the name of the convent, nor shall it be permitted for superiors to grant to any regular stable goods, or fixed allowances of grain, bread, wine or money, even under the pretext of contracts entered into or to be entered into between monks of common and stricter observance, whom our most holy lord Alexander VII declared by his letters in the form of a Brief of the eighth day of the month of March in the year 1660 to be null, void, illicit, and contrary to religious poverty; but let all things be common to all, and let each one be given according to the resources of each monastery, the conditions of regions, all things necessary both for food and for clothing, whether in health or in sickness, whether in old age or in youth, without any respect of persons, and having regard only to necessity.
Concerning chapter XXXIX On the measure of food.
23 xxiii. Those who have embraced abstinence from meat, or shall embrace it in the future, let them retain it exactly, and none of them shall be permitted to pass to the common observance of the Order itself, unless permission be sought and obtained from the Supreme Pontiff for the time being, or at least from the general chapter, or, that failing, from the Abbot of Cîteaux. Nor shall any professed of the common observance, for the sake of preserving peace and charity, be permitted to pass to the said perpetual abstinence without seeking permission at least from his immediate superior; and superiors shall not be able to compel anyone to embrace that abstinence who has not been educated in it: nor shall anyone enjoy the license of using meat, granted by apostolic authority to all regular persons of the Order even those in good health and well-being, and approved and again conceded by the same, except on three days only in the week outside the time of Advent, Septuagesima and Quinquagesima, and other times prohibited by the Church.
Concerning chapter XLI At what hours the brothers ought to take their meal.
24 xxiv. Let fasts be observed not only ecclesiastical, but also those prescribed by the rule and by constitutions with ecclesiastical moderation. Concerning the time of refection, let regard be had for the elderly, the young and the infirm. Moreover, concerning the fasts of the rule, superiors may sometimes dispense, taking into consideration the circumstances of persons, places, regions and seasons of the year, so that some fruits and other such foods may be granted to those fasting in the collation or light refection.
Concerning chapter LI On brothers who do not travel far enough.
25 xxv. Let the praiseworthy custom that has been introduced be observed.
Concerning chapter LIII On guests to be received.
26 xxvi. Let the superiors of monasteries be all the more fervent in hospitality so greatly commended, but in receiving guests let frugality appear, and no excess be permitted: nor shall it be allowed for religious to eat with relatives and others who arrive in the dormitory, in private chambers, nor outside places designated by superiors, just as neither for nuns in the parlor and in the locutory with anyone whatsoever, whether secular or regular. Concerning the washing of the feet of guests, let the custom be maintained. Concerning chapter LIV That a monk ought not to receive letters. xxvii. Letters directed to anyone shall not be opened without the permission of the superior, nor shall they be sent out; and let there be one seal only in the monastery, which shall remain with the prior, and by it all letters shall be sealed.
Concerning chapter LV On the clothing and footwear of the brothers.
27 xxviii. Since humility becomes religious persons especially, and modesty is the splendor and ornament of all virtues, all abbots and monks of the same Order shall wear a uniform, modest and becoming habit, which shall breathe forth both the same virtues and poverty. Abbots shall not wear hats within the cloisters of their monasteries, but shall cover themselves in religious manner; monks, however, both within and without the enclosure of monasteries shall never go about without hoods; all likewise, both abbots and monks, shall be clothed in cloths of black and white color only, simple yet honest and clean, so that nothing appear in them that savors of secular novelties, and that could offend those who behold them. Let them abstain from linen undergarments and collars, and use only woolen ones, both within and without the monastery, as also in breeches. No abbot or monk shall dare to grow a beard and hair, or to foster prominent hairs on the upper lip, or to cut hair or beard otherwise than uniformly and with an equal comb all around, leaving on the head that circle which they call the monastic crown, as the religious of the monastery of Cîteaux are accustomed to wear. Concerning chapter LVII On the craftsmen of the monastery. xxix. Let superiors take care that young men, whom they shall judge not sufficiently inclined to studies, learn some honest craft, by the exercise of which they may avoid idleness and the weariness of solitude. Chapter LVIII On the discipline of brothers to be received.
28 xxx. Concerning the novitiate and profession to be designated, what is established in the letters of our most holy lord shall be observed. And concerning the reception and education, let the apostolic rule and constitutions be observed, especially the decrees of Clement VIII of blessed memory, and let novices of sufficient learning be received, that is, instructed in grammar, and, if it can be done, in philosophy, after some probation made in secular habit in their own homes, with sufficient support to be determined by the visitors or other superiors according to the circumstances of places, and to be paid or compensated by the monasteries for which they are received.
29 xxxi. Let them be received by the visitor of the province and by the master of novices, and let them be examined by these and, if found suitable, be clothed and tested, and in this common observance let them be so educated that, except for abstinence from meat alone, they understand themselves to be bound throughout the whole course of their life to all the chapters of the holy rule as they are noted here.
30 xxxii. Seminaries or professions shall be erected in like manner for the work of cultivating piety and religion, in which the newly professed shall remain with sufficient support or compensation, and shall be so instructed for acquiring perfection of the holy rule and the practice of the said Cistercian Order, that none of them shall be admitted to studies, or to orders, or to degrees, who has not given testimony of proven life and sufficiency.
31 xxxiii. Because some monks of the said Order, under the pretext of stability promised when they made solemn profession of vows in some certain and determined monastery, claim that they cannot, even for the greater convenience, good and utility of the monasteries themselves, of the Order, or for any other just and legitimate reason, be transferred to other monasteries if they refuse, unless for some grave crime which cannot easily be amended in the same place, whence by experience thus proven many dissensions, disobediences, rebellions, lawsuits and innumerable inconveniences often arise: the constitution of Pius II of the year 1461 is renewed, by which power is given to the visitors and superiors of the Order existing for the time being, that, if it thus seems expedient to them, they transfer these persons to other monasteries of the same Order, and substitute other suitable ones in their place up to a sufficient number, for the benefit of the common novitiates and seminaries, and for easier execution of the present constitution and reformation, so that those who in the places of the common novitiates and seminaries and in other monasteries to be reformed are unwilling to submit themselves in all things to the present reformation, shall be compelled under penalty of imprisonment to transfer themselves to other monasteries designated to them by the provincial visitor, and to dwell there; which monasteries shall be bound to receive them, and to have them as sons and professed members, the sole exception being the right of election of abbots, under penalty of interdict, and other censures against those refusing and opposing themselves to this ordinance.
Concerning chapter LXI On pilgrim monks, how they are to be received.
32 xxxiv. Let each visitor or president of provinces have the seal of the province committed to his visitation, nor can anyone besides him give permission to convene the greater superiors, nor to depart from the monastery beyond four days; which permission shall be given in writing and be secured with the seal of the province.
Concerning chapter LXIV On ordaining an abbot.
33 xxxv. Let no one henceforth be elected as abbot general of the Cistercian Order who is not expressly professed of the same Order, and any election made otherwise shall be null by the law itself; and those so electing shall incur by that very fact the penalty of deprivation of active and passive voice in perpetuity without any other declaration; moreover, the one to be elected shall be instructed in those gifts and virtues which St. Benedict requires in an abbot in this chapter and in the second of his rule; but in such elections let all inordinate ambition and proceedings be avoided; and let them be made according to the canons by scrutiny, in which all monks of the said Order of either observance shall enjoy passive voice respectively, unless some impediment intervenes from elsewhere.
Concerning chapter LXVII On brothers directed on the way.
34 xxxvi. Let superiors remember that they and their religious are bound to solitude, nor ought they and are able to depart from it, except for grave and necessary cause, and that with the greatest fear, lest the fruit of conceived devotion be scattered. Whence the holy legislator commands that those going out from solitudes to prayer, on account of such great danger, must have recourse. Therefore let not religious be permitted to go to towns or neighboring villages, unless some grave necessity should occur, and always with a companion designated by the superior. Concerning chapter LXX That no one presume to cede another.
35 xxxvii. Causes merely regular emerging between persons of the said Order shall be terminated within the Order according to its ancient constitutions, nor is it permitted to anyone to appeal outside the Order under the penalties contained in the same.
36 xxxviii. We will that all the aforesaid matters pertain respectively to the nuns, commanding the abbot general and the four first abbots, and the other father abbots, that they reduce and compel all those subject to them to the enclosure ordained by Boniface VIII and by the Council of Trent.
37 xxxix. But so that henceforth one rule, one charity, and like customs may be lived everywhere, and all persons of both sexes of the Order may know in what the stricter observance consists, except for abstinence from meat alone, let there be made a brief and clear compilation and reduction of all apostolic constitutions and statutes, which have not been abrogated either by contrary usage or by any other reason, and let them be distributed by men selected by the abbot general and the four first abbots, exercised in regular discipline, in the rights and privileges of the said Order, into certain chapters to be approved and promulgated by the general chapter, and finally sent to the press, and turned into the vernacular language for the nuns, and appended to the end of the rule of blessed Benedict, so that in the chapters of individual monasteries after the reading of the rule some of their chapters may be read successively82. Since indeed in the congregation of cardinals and prelates, as was instituted above for the examination of the aforesaid articles of reform, the articles inserted above were carefully discussed and examined, and in that part where it was necessary amended and fitted: We, being fully instructed and informed concerning all things, have found that they were providently compiled for the happy state and wholesome direction of the monks of the said Order, and were drawn up, and in all respects are in agreement with the rule of blessed Benedict, which the first Cistercians in their original institution, called the Charter of Charity, approved by many of Our Roman Pontiff predecessors, left to posterity to be held and understood, except in some things which either by reasonable long-standing custom have been abrogated, or by legitimate dispensation of the Apostolic See have been mitigated and tempered for the variety of times. Wherefore, by Our own motion and from certain knowledge, and mature deliberation, and from the fullness of apostolic power, by the tenor of these presents, We approve and confirm the same aforesaid articles of reform in all and through all, and add to them the strength of perpetual and inviolable firmness, and in the whole Cistercian Order, as much in the kingdom of France as in other kingdoms and provinces, We strictly command and order that they be firmly and inviolably observed by all, as well of the common as of the strict observance religious, under the penalties contained in the rule.
38 § 3. Desiring moreover that this reform of Ours be not merely in word, but real and with effect by divine aid, We strictly enjoin upon the same Claude that at the earliest opportunity he convoke a general chapter to be celebrated at the monastery of Cîteaux in the month of May of the following year 1667, to which all and singular abbots and priors of the conventual monasteries of the whole Order not having a canonical impediment shall be called and bound to come, and in it the abbot of Cîteaux and the four primary abbots shall elect in the customary manner the general definitors, yet so that each of them shall elect at least two from the abbots of strict observance; so that in total in the definitorum there shall have a decisive voice twenty-five abbots, namely the abbot of Cîteaux and the four primary abbots, then ten definitors from the common observance, and as many from the strict observance: in the chapter moreover or definitorum, as is aforesaid, being assembled, let there be careful treatment of the reform of the Order and regular observance, and of the more fitting manner of executing and reducing to practice the aforesaid articles of reform, and what shall have been deliberated and enacted shall be inviolably observed.
39 § 4. Let there also be ordained in the same chapter or definitorum, religious and circumspect persons, who may strive to visit the individual monasteries of each province according to the form prescribed for them, correcting and reforming those things which they shall see to need correction and reform.
40 Furthermore, let there be made a division or partition of the monasteries of strict observance existing in the kingdom of France into at least two provinces, and by the abbot of Cîteaux himself and the four primary abbots and ten definitors of the same strict observance, by secret ballot, let there be elected from the same observance two provincial visitors to be called, lasting until the next general chapter, each of whom shall have ordinary jurisdiction in the monasteries of his province.
41 Likewise in each province of the entire Order, even outside Gaul, let two monasteries of monks of the common Observance be designated, namely one for the novitiate and the other for the professed, or second novitiate, together with masters for the education of novices and newly professed, and with a select household; which designations, being reduced to writing together with the acts of the chapter, and subscribed by the same abbot of Cîteaux and four principal abbots and sealed with the customary seal, shall be transmitted to the procurator of the Order existing in our City, who shall immediately exhibit them to us, so that they may be recognized and approved.
42 § 5. In the meantime, by our own motion, knowledge and similar power, we prohibit and interdict, as much to the aforesaid abbot of Cîteaux and four principal abbots as to the other abbots and superiors of monasteries of the common observance, whether in Gaul or in other kingdoms and provinces existing, that they receive no one into the habit of their religion, or henceforth admit to profession those perhaps to be received contrary to such prohibition, until the aforesaid designations for novitiates and professed houses, as above, made and transmitted to the procurator of the Order, shall have been actually and effectively exhibited to us and, as aforesaid, approved; otherwise those receiving or admitting thus shall incur the sentence of excommunication, from which they cannot be absolved save by us and the Roman Pontiff existing for the time, unless they be in the article of death.
43 § 6. To these matters, by the vote of the same council of the congregation of cardinals and prelates, by our command the reasons and motives, proposed both in voice and in writing by the procurator of the Order and by two abbots of strict observance delegated from Gaul to the City for the business of reform, they again and a third time carefully and maturely considered and discussed, and made to us a full report of all things; by apostolic authority, by the tenor of these presents, we declare that the letters given in the form of a Brief on the days 10 November 1657, and 8 March 1660, as well as 11 July 1661 respectively, have labored under no obreption, subreption, defect of our intention, or any other vice of nullity, and are therefore to be entirely observed and executed, as we command them to be observed and executed, imposing perpetual silence thereupon under the penalties contained in our aforesaid letters issued on 16 January 1662.
44 § 7. Moreover from this our declaration, as far as those things which are not adverse to our aforesaid letters and to these presents, we do not intend to generate any prejudice to the monasteries of reformed monks in the kingdom of Gaul and their strict observance, but we will that it remain in its firmness and strength, just as if the same letters had not been issued. Nay rather it is our intention to foster the same strict observance in its praiseworthy manner of living, and for its conservation and increase to bestow the parts of our pastoral office graciously and favorably; wherefore we seriously admonish and exhort the abbot of Cîteaux and the four principal abbots in the Lord, and to them in virtue of holy obedience strictly command and enjoin, that they strive not only to protect the same strict observance and to embrace it with the zeal of charity, but also to spread and propagate it according to their ability, so that day by day, with the Lord blessing, it may bear more abundant fruit in the Church militant.
45 § 8. Similarly we declare valid and to be valid the professions themselves and the professions made by monks of strict observance down to this present day, as well as the absolutions together with the acts hitherto performed, which have obtained their full effect, so that by the force of the aforesaid and present letters of ours they are not to be considered as having been subject to or as being subject to the defect of nullity, nor on that account can they be impugned, infringed or brought into controversy by anyone whatsoever; and thus by whatever ordinary and delegated judges, even auditors of the causes of the apostolic palace, and cardinals of the Holy Roman Church, even legates a latere, and nuncios of the Apostolic See, and any others whatsoever, exercising or about to exercise any preeminence and power, having removed from them and from each of them any facility and authority of judging and interpreting otherwise, they ought to be judged and determined, and we decree it to be null and void if otherwise anything concerning these matters should be attempted by anyone whatsoever, by whatever authority, knowingly or unknowingly; notwithstanding the foregoing, and our and the apostolic chancery's rule of not taking away acquired right, and other apostolic constitutions and ordinances issued in universal, provincial and particular councils, general or special, as well as the statutes and customs of the said Order, and of its congregations, provinces, monasteries and places whatsoever, and any others whatsoever, even those strengthened by oath, apostolic confirmation, or any other firmness, privileges also, indults and apostolic letters, even to the same Order, and to its congregations, provinces, monasteries and places, and to their superiors, abbots, monks and any persons whatsoever, under whatsoever tenor of words and forms, and with whatsoever even derogatory clauses of derogations, and other more efficacious, most efficacious and unusual clauses, irritant and other decrees, in general or in special, even by our own motion, knowledge and fullness of power, and consistorially, and otherwise in any manner whatsoever granted, confirmed and renewed any number of times in contravention of the foregoing; all and each of which, even if for their sufficient derogation special, specific, express and individual mention of them and of their whole tenors, word for word, and not by general clauses importing the same, or some other exquisite form to be observed for this purpose would have been required, we having the tenors, forms and occasions of all and each of them respectively considered and inserted as fully and sufficiently expressed herein, those otherwise remaining in their force, for the effect of the foregoing, we specially and expressly derogate; and all other things whatsoever to the contrary.
46 § 9. We will, however, that transcripts or copies of these same letters, even printed ones, subscribed by the hand of some public notary and furnished with the seal of a person constituted in ecclesiastical dignity, shall have the same faith everywhere as would be given to these presents themselves, if they were exhibited or shown.
