1 LETTERE APOSTOLICHE PER L'EREZIONE DEL VESCOVATO DI TAMAULIPAS, PIO VESCOVO SERVO DEI SERVI DI DIO A PERPETUA MEMORIA DELLA COSA

2 Poiché nella provvidenza verso tutte le chiese dell'orbe terrestre con paterna sollecitudine fin dall'inizio del Nostro Pontificato, seguendo le orme dei Nostri Predecessori Romani Pontefici, abbiamo avuto cura di estendere la Nostra sollecitudine, e nulla abbiamo ritenuto più utile, più conveniente e più opportuno per il bene spirituale e l'incremento della repubblica cristiana, se non che il numero dei cristiani fedeli crescesse il più possibile, così che un solo pastore non risultasse affatto sufficiente alle loro necessità per diminuire la distanza dei luoghi dall'ovile, e parimenti per moltiplicare i necessari alimenti della salvezza anche per mezzo della nuova circoscrizione di queste medesime chiese diocesane, affinché sedi episcopali siano erette dalla loro smembrazione, e così la nuova adesione dei popoli alla chiesa cattolica sia accresciuta e la professione della fede cattolica ivi fiorisca più vigorosamente, e lo stesso popolo, sostenuto dall'assistenza di pastori vigilanti, nella dottrina e nel governo progredisca sempre nella fede con la propagazione del culto divino e non manchino i progressi spirituali.

3 Con questo proposito e consiglio certamente Noi con Lettere Apostoliche in forma di Breve del tredicesimo giorno del mese di agosto dell'anno del Signore milleottocentosessantuno abbiamo circoscritto più opportunamente l'ampia Diocesi di Linares nel territorio messicano e dalla sua smembrazione abbiamo sottoposto l'intera Regione Tamaulipeca all'amministrazione del Vicario Apostolico, finché diversamente da Noi e da questa Santa Sede Apostolica fosse decretato. Ora invece, provvedendo più opportunamente a quella medesima regione e attendendo in primo luogo alla maggiore utilità dei cristiani fedeli, abbiamo stabilito di istituire ivi una Diocesi, e dalla nuova circoscrizione da farsi dalle Diocesi messicana e di Puebla di erigere il Vescovato della Città di Vittoria o Tamaulipeca, da denominarsi così, essendo completamente soppresso l'Apostolico Vicariato Tenisulipense.

4 Perciò Noi, che già nelle Lettere Apostoliche di erezione tanto della Metropolitana messicana quanto della Chiesa Episcopale di Puebla abbiamo riservato a Noi e a questa medesima Sede la facoltà di fare in qualunque tempo la nuova circoscrizione di queste medesime Diocesi secondo il Nostro e di questa Sede arbitrio, avendo inoltre il consenso dei Venerabili Fratelli Arcivescovi di queste Chiese, spontaneamente prestato a ciò, come ratificato e accettato, e supplendo con pienezza di Autorità Apostolica al consenso di altri che abbiano interesse in questo affare o che in qualunque modo si presumano di averne, per il tenore delle presenti, e assolvendo e ritenendo assolti da qualunque scomunica, sospensione e interdetto e da altre sentenze ecclesiastiche, censure e pene, tanto di diritto quanto di fatto, inflitte per qualunque occasione o causa, coloro che in qualunque modo vi fossero incorsi, al solo effetto di conseguire quanto qui si dispone, e avendo con maturo consiglio esaminato tutto ciò che doveva essere considerato, con Motu Proprio e da certa scienza, e dalla pienezza della Potestà Apostolica, il Vicariato Apostolico che per la regione Tamaulipeca da Noi era stato istituito, con la medesima Autorità Apostolica completamente sopprimiamo e estinguiamo per l'effetto dell'erezione qui sotto descritta. Subito dunque la regione Tamaulipeca medesima in una peculiare nuova Diocesi con i medesimi confini, entro i quali prima il suo Apostolico Vicariato era circoscritto, con la medesima Autorità Apostolica perpetuamente istituiamo, e le Parrocchie che nella Arcidiocesi messicana si trovano e si chiamano - Ozuluama - - Tantina - Panuco - Tempoal - Puebloveio - Tampico - e Alto - Tantoyuca - e la Succursale - Santa Catarina Chontla -, dalla Metropolitana messicana, e dalla Diocesi Episcopale di Puebla, e le Parrocchie che comunemente si chiamano - De Amatlan - De Tamiahua - insieme con tutte le loro cose ecclesiastiche, Oratori e Pie Istituzioni di ambo i sessi, gli Abitanti di qualunque grado, ordine e condizione, i Conventi dei Frati Religiosi, i Chiostri delle Monache e gli altri accessori che di consueto vi si accompagnano, con la suddetta Autorità Apostolica parimenti perpetuamente disgiungamo e smembriamo, e dall'ordinaria autorità tanto degli odierni quanto dei futuri Arcivescovi messicani e di Puebla perpetuamente eziandio esoneriamo e sciogliamo, e alla detta nuova regione nella Diocesi Tamaulipeca edichiamo, e così una propria e distinta Diocesi del Vescovato della Città di Vittoria o Tamaulipeca, da denominarsi così, con simile Autorità Apostolica perpetuamente parimenti costituiamo e stabiliamo, ordinando che tutti gli scritti e i documenti, che tanto alle Chiese, quanto alle persone, quanto ai redditi, quanto ai diritti e a qualunque altra cosa delle parrocchiali chiese come sopra smembrate appartengono, e che al presente si conservano nelle Cancellerie delle Diocesi messicana e di Puebla, si separino e si consegnino alla Cancelleria della suddetta nuova Diocesi Vittoriense per l'uso e la necessità delle cose.

5 E poiché la Città della Vittoria, che è invero un insigne Borgo della regione Tamaulipeca, si ritiene sempre più idonea a conservare stabilmente la residenza Episcopale, non solo per l'ampiezza del suo territorio e per l'apparato dei suoi edifici e costruzioni, ma anche per la conveniente abbondanza delle cose necessarie, nonché per la dignità di alcune prerogative e la congruenza dei vantaggi amministrativi, e ciò che non è di minore importanza, perché occupa il luogo centrale della predetta Regione; per questo motivo quella stessa, con tutti e singoli i diritti, le prerogative, le preminenze, gli onori, gli indulti, i privilegi e tutto il resto che per diritto comune le altre Città Episcopali nel Dominio Messicano possiedono, godono e tutelano, con l'Autorità Apostolica predetta perpetuamente la eleviamo e l'esaltiamo, e anzi l'erigiamo a Sede del Vescovato novellamente istituito di Vittoria e a residenza del suo Presule nei tempi a venire. Perciò il Tempio, che al Delegato Apostolico infrascritto, al quale specialmente incaricheremo questo compito, parrà più idoneo e ornato e provvisto di suppellettile ecclesiastica, lo eleviamo con pari Autorità Apostolica perpetuamente all'onore di Chiesa Cattedrale, affinché la medesima Chiesa conservi il titolo antico o l'invocazione e la parrocchialità, se per caso esistessero; così che la cura delle anime risieda presso il Capitolo, come di seguito sarà istituito, e quando sarà stato istituito, abitualmente; l'esercizio attuale sia per mezzo del Vicario del medesimo Capitolo, oppure altrimenti per mezzo di un Presbitero idoneo, da approvarsi dall'Ordinario; e in esso sia costituita la Sede della Cattedra e la Dignità Episcopale per un suo futuro Presule, da chiamarsi Ordinario di Vittoria o Tamaulipeco, il quale presida alla medesima Chiesa, Città e Diocesi e al suo Clero e Popolo universale, e provveda salutarmente e fruttuosamente nel Signore al governo ecclesiastico della sua ordinaria giurisdizione; si adoperi a conservare intatta e protetta la Religione Cattolica Apostolica Romana insieme con i suoi diritti e le sue prerogative di cui per l'Ordinazione di Dio e per le Costituzioni dei Sacri Canoni deve godere, e sempre più a promuoverla; e sia libero, né possa mai da alcuno per nessun titolo essere distolto o impedito in alcun modo, e per l'esercizio delle cose ecclesiastiche, e anche per il governo della sua Diocesi pienamente, liberamente ed efficacemente possa considerare, ordinare, decernere e sentenziare tutto ciò che la ragione del ministero pastorale e del suo foro Ecclesiastico, e parimenti delle cose ecclesiastiche, sia per necessità, sia per opportunità, sia per retta disciplina, richiedono. Per questo motivo con quella libertà pastorale e paterna e con quella prudenza che conviene, possa e si adoperi volentieri a compiere la sacra visita della sua Diocesi, a convocare e celebrare il Sinodo Diocesano nei tempi stabiliti dai Sacri Canoni, a emanare le sue istituzioni, ordinazioni, mandati, decreti tanto per adempiere i compiti dell'amministrazione ecclesiastica da ogni parte, quanto per osservare la retta disciplina dei costumi, e inoltre a promulgarli efficacemente, e inoltre si adoperi diligentemente affinché sia mantenuta e tutelata la comunione libera e del tutto senza impedimenti con tutto il suo Clero e Popolo, e tanto più con questa predetta Santa Sede Apostolica sempre e ogni volta che sia necessario. Inoltre per quanto riguarda il Capitolo di questa nuova Cattedrale, Noi, considerata la natura delle particolari circostanze, con l'Autorità Apostolica ordiniamo che al più presto possibile sia costituito nella Cattedrale, secondo la prescrizione dei Sacri Canoni, un Capitolo, che possa prestare opera e riverenza al Presule Diocesano, e che consti di sette Canonici costituiti nell'Ordine del Presbiterato, dei quali uno porti il titolo e la dignità prima di Arcidiacono, sempre riservata alla disposizione della Sede Apostolica; due altri per ufficio da nominarsi, dei quali uno eserciti le funzioni di Penitenziere o Magistrale, l'altro invece di Teologo o Dottorale, gli altri quattro invece siano detti e siano di grazia, come è in uso negli altri Capitoli della dominazione Messicana; e tutti e singoli essi siano tenuti a compiere gli uffici divini e i compiti ecclesiastici, e gli altri oneri e tutto il resto che è prescritto ai Capitoli e ai Canonici delle Chiese Cattedrali, e che si trova essere stato loro imposto per consuetudine, a compierlo diligentemente e rettamente. Altrimenti gli stessi diritti, onori, privilegi e il resto di cui per diritto comune e per legittima consuetudine i Capitoli delle altre Chiese Cattedrali del detto Dominio godono e si avvalgono, possano godere e avvalersi; disponendo inoltre che ivi siano istituiti anche sei Presbiteri Cappellani o Beneficiati o Mansionari, che siano addetti al servizio della medesima Cattedrale: per questo motivo tutti costoro siano tenuti parimente a intervenire ivi diligentemente e rettamente ai servizi corali e a tutte le altre funzioni ecclesiastiche, e così pure siano obbligati a compiere alternatamente i ministeri di Diaconi e Suddiaconi; e inoltre colui che di questi sia il primo, debba anche compiere le funzioni di Segretario capitolare; il secondo, di primo Maestro di cerimonie; il terzo, di Maestro dei musicanti della cappella; il quarto, di Censore o Puntatore di coloro che senza alcuna causa canonica si astengono dal servizio corale; il quinto, di secondo puntatore siano tenuti a compiere i compiti. Raccomandiamo che il numero suddetto dei Canonici sia aumentato al più presto possibile.

6 Al quale futuro Capitolo, affinché tutti e singoli i Dignitari e Canonici predetti, nonché i Cappellani o Beneficiari ovvero Mansionari tanto nella detta Cattedrale, quanto fuori di essa (tuttavia Diocesani entro i limiti), quante volte si riuniranno capitolarmente, possano liberamente e lecitamente indossare e usare gli indumenti e gli insegni corali, che già per diritto comune rispettivamente sono in uso nelle altre Cattedrali del territorio Messicano, eccettuati però quelli che fossero stati concessi e acquisiti da peculiare privilegio, ovvero da qualunque titolo speciale anche oneroso, con la medesima autorità Apostolica perpetuamente parimenti concediamo e indulgiamo. | Al medesimo Capitolo inoltre, quando sarà costituito come sopra, fin d'ora diamo facoltà e potestà di farsi capitolari statuti, ordinazioni e decreti, non punto contrari ai sacri canoni, alle Costituzioni Apostoliche e specialmente ai precetti del concilio di Trento, ma pienamente conformi; i quali debbono essere sottoposti al giudizio del Vescovo di Vittoria, e non ottengono forza di legge se non dopo la sua approvazione.

7 Affinché poi tutti e singoli i Canonicati, nonché i sei benefici dei Cappellani siano conferiti secondo le leggi canoniche, le Costituzioni Apostoliche e specialmente i precetti del concilio di Trento, ordiniamo e comandiamo espressamente, che qualunque prebenda in tutta la Diocesi, alla quale incombe la cura delle anime, anche quelle che si chiamano Teologale o Dottorale e l'altra che si dice Penitenziale o Magistrale, non possano in alcun modo essere ottenute se non per concorso secondo la norma delle sacre costituzioni e specialmente del nostro Predecessore di felice memoria Gregorio PP. XIII - Pastoralis officii - per quanto riguarda la Penitenziale e la Teologale predette.

8 Inoltre per la nuova fondazione dell'Episcopato della Città di Vittoria o detta Tamaulipana, e per la sua successiva conservazione e incremento, ordiniamo che per la residenza del Vescovo, nonché per la curia o cancelleria episcopale siano subito procurate e assegnate alla Mensa Episcopale tante case, quanto più prossime possibile alla Cattedrale, quante sembrino necessarie per i predetti usi, e convenientemente fornite di opportuni arredi.

9 E affinché per la Diocesi della Città di Vittoria o Tamaulipana possano continuamente crescere operai buoni e capaci per la messe del Signore, che possano dedicarsi con sollecitudine e ampiamente alla coltura opportuna e diligente; perciò con la detta autorità Apostolica ordiniamo, che nella predetta Città Vittoria o Tamaulipana, se non sia già disponibile, sia procurato un edificio idoneo e conveniente, o anche sia costruito, e sia assegnato sufficientemente fornito di arredi necessari e opportuni, perché sia istituito e amministrato secondo le norme del sinodo diocesano di Trento.

10 E benché sia in uso stabilito dall'istituto dei sacri canoni, che qualsiasi mensa episcopale, e singole Prebende delle Cattedrali e altre dotazioni ecclesiastiche debbano essere fondate in beni stabili; tuttavia, avuta particolare considerazione delle circostanze, affinché tutte le suddette dotazioni siano convenientemente costituite in decime, opportunamente e rettamente le assegniamo secondo la norma delle altre Diocesi nella Diocesi Messicana con pari autorità Apostolica. Perpetuamente però rimanga salvo e intatto questo diritto sacro, affinché a favore della Diocesi della Città di Vittoria, ossia Tamaulipana così denominata, cioè della sua mensa Episcopale tanto della chiesa Cattedrale, quanto del suo Capitolo e Clero, quanto anche delle altre chiese minori e di qualsiasi istituzione pia, possano e liberamente e lecitamente e validamente possano beni anche stabili essere legati, acquistati, e infine con pieno dominio posseduti, amministrati e rivendicati. Tuttavia, finché alla Diocesi non abbondino le necessità, al Vittoriense ossia Tamaulipano nei tempi al Presule da ora concediamo venia Apostolica, affinché egli lecitamente possa a sé riservare una sola delle parrocchie della Diocesi, affinché essa per mezzo di un Vicario da lui stesso Presule eletto, e con congrua porzione o pensione remunerato, sia amministrata con quel provvido consiglio, affinché i redditi decimali di questa parrocchia riservata possano e debbano dal suo prudente arbitrio e provvidenza essere erogati per riparare e alleviare le più gravi necessità della medesima Diocesi. Tuttavia se veramente si scopra, che specialmente negli anni precedenti i proventi delle decime non valgano pienamente a bastare al simultaneo e congruo sostentamento dello stesso Vescovo, del suo intero Capitolo, e anche delle altre istituzioni ecclesiastiche connesse, allora il Presule stesso, accedendo già da allora la Nostra autorità, possa e valga dal suo prudente giudizio a suo piacimento sospendere sia la fondazione effettiva del Capitolo Cattedrale sia di altre qualsiasi istituzioni connesse, finché non sia stato accertato, che i proventi decimali di questo genere siano già in condizione tale, che da allora possano continuamente fornire le congruità doti sia per questo Capitolo, sia per tutti gli altri, o per l'uno o l'altro delle prescritte istituzioni ecclesiastiche conveniente sostentamento. Durante però il tempo di questa sospensione il medesimo Presule si attribuisca bensì ogni anno per la mensa episcopale otto soli migliaia di scudi Messicani. Tutto ciò che poi avanzerà dal cumulo delle medesime decime, quello in massa particolare ritenere assolutamente dovrà, finché sia accertato che da esso possa risultare disponibile ciò, che valga a bastare alla dote o pensione congrua e continuata di ciascuna di queste istituzioni (anche se gradualmente secondo l'ordine della maggiore necessità o opportunità da compiersi).

11 Questa chiesa della Città Vittoriense, ossia Tamaulipana nella Chiesa Arcivescovile Messicana quale Suffraganea con tutti e singoli i diritti, onori, prerogative, grazie, indulti, che parimente quella Chiesa Suffraganea dell'Arcivescovato e vicendevolmente avere sogliono e tutelare, detta autorità Apostolica sottomettiamo, e la sua tassa canonica per l'expedizione delle Lettere Apostoliche, quante volte all'Antistite di questa Chiesa Cattedrale sarà da prefiggersi, in fiorini d'oro di camera trentatré con la terza parte del medesimo fiorino stabiliamo, e così nei libri della camera Apostolica e della Sacra Chiesa Romana e del Collegio dei Cardinali inscrivere e osservare ordiniamo.

12 Infine a Noi e al Romano Pontefice per il tempo esistente la facoltà riserviamo di circoscrivere questa nuova Diocesi, quandocumque più nel Signore sarà visto opportuno.

13 Le presenti Lettere non potranno essere impugnate per subrepzione, obrepzione, nullità, o per difetto di Nostra intenzione, o per qualsiasi altro difetto, per quanto giuridico e sostanziale, neppure per il fatto che coloro che avevano o presumevano di avere interesse in tutti e singoli i predetti punti, di qualunque qualità, stato, condizione e dignità, non siano stati chiamati, citati e ascoltati, e per qualsiasi altra causa, per quanto pia, privilegiata e degna di speciale considerazione; non potranno essere invalidate, infrante, ritardate o rese inefficaci, ricondotte alle vie e ai termini del diritto, né contro di esse potranno essere ottenuti apertura di bocca o qualsiasi altro rimedio di diritto o di fatto, neppure per capo di lesione, per quanto enorme e gravissima, o di qualsiasi pregiudizio; e neppure potranno essere accettate, allegate, dedotte o altrimenti utilizzate in giudizio e fuori di esso, per moto e pienezza di potestà simili, da parte di qualunque Nostro Successore Romano Pontefice contro i predetti; anzi, tutti e singoli i predetti punti rimangono sempre e perpetuamente fermi, validi ed efficaci, e producono e ottengono i loro pieni e interi effetti; e non sono compresi, né in alcun modo possono essere compresi, nelle revoche, sospensioni, limitazioni, deroghe o altre disposizioni contrarie, anche concistoriali, di grazie simili, ma sempre ne sono eccettuati, e quante volte quelle si manifesteranno, altrettante volte sono restituiti, riposti e pienamente reintegrati nel loro pristino e validissimo stato, e di nuovo concessi e saranno come se fossero stati concessi anche sotto qualsiasi data posteriore, qualunque volta si voglia scegliere; e così e non altrimenti devono essere giudicati e definiti da qualunque Giudice Ordinario o Delegato che eserciti qualsiasi autorità, anche dagli Uditori delle cause del Palazzo Apostolico, o dai Cardinali della Santa Romana Chiesa, anche Legati a latere, e dai Nunzi della medesima Sede, e da qualunque altro che splenda di qualsiasi autorità, potestà, prerogativa, onore e preminenza; e tutto ciò che da chiunque, con qualsiasi autorità, sia consapevolmente sia inconsapevolmente, fosse tentato contro queste cose, dichiariamo irritum e vano.

14 Perciò al Venerabile Fratello Pelagio De la Bastida y Davalos, attuale Arcivescovo di Messico, per mezzo di queste medesime presenti affidiamo e ordiniamo che egli proceda all'esecuzione di tutti i predetti; impartendogli le facoltà necessarie e opportune, per le quali egli possa subdelegare a un'altra persona idonea e provata, costituita tuttavia in dignità ecclesiastica; in modo però che lo stesso Pelagio Arcivescovo, per se stesso o per la persona da subdelegarsi, possa ordinare, disporre e anche definitivamente, rimossa ogni appellazione, decernere tutte quelle cose che gli sembreranno opportune o più convenienti, affinché l'erezione della predetta Città di Vittoria o Tamaulipani sia felicemente condotta al fine desiderato, ordinando inoltre che nel decreto esecutoriale di tutte queste cose siano descritti con cura i confini naturali della medesima nuova Diocesi, e singolarmente nominati i comuni e le parrocchie, e inoltre sia inserita una carta topografica, Non ostante la Nostra regola e della Cancelleria Apostolica - De iure quaesito non tollendo - e il Concilio Lateranense ultimamente celebrato, che proibisce le dismembrazioni perpetue se non nei casi permessi dal diritto, e altre costituzioni e ordinazioni Apostoliche, anche sinodali, provinciali, generali e universali, edite o da emettersi, speciali o generali, e i decreti delle Chiese Messicana e di Puebla, anche corroborati da giuramento, da conferma Apostolica o da qualsiasi altra fermezza, gli statuti e le consuetudini, i privilegi inoltre e gli indulti e le Lettere Apostoliche di qualsiasi genere concesse a superiori e persone in genere o in specie, o altrimenti con qualsiasi anche derogatoria delle deroghe, e altre clausole più efficaci ed efficacissime e insolite, irritanti e altri decreti anche in moto proprio, con scienza e pienezza di potestà pari, e parimenti in modo concistoriale, anche nella fondazione e nella primeva istituzione, o altrimenti in qualunque modo concessi, approvati, confermati e innovati: di tutti e singoli i quali, benché per la loro sufficiente deroga fosse necessario fare menzione speciale, specifica, espressa e individuale di essi, del loro intero tenore, e non mediante clausole generali che importino lo stesso, o qualsiasi altra espressione, o alcuna altra forma ricercata da osservarsi a questo fine, tuttavia tenendo i tenori di questi come pienamente e sufficientemente espressi, come se fossero stati inseriti parola per parola, senza alcuna omissione e osservata la forma in essi tradita, nelle medesime presenti; altrimenti rimarrebbero nel loro vigore; latissimamente e plenissimamente e specialmente ed espressamente per l'effetto dei presenti e della validità di tutti e singoli i predetti, in questa sola occasione, in moto, scienza e pienezza di potestà simili, anche per mezzo di questa serie di lettere deroghiamo, e a tutti gli altri contrari.

15 Vogliamo inoltre che il detto Pelagio Arcivescovo entro sei mesi dal compimento dell'esecuzione delle presenti, diligentemente a questa Sede Apostolica non solo un esemplare in forma autentica del suddetto decreto esecutoriale; ma anche di tutti gli altri documenti che su questo affare siano stati prodotti e compiuti, affinché insieme nell'Archivio della prefata Congregazione della Santa Romana Chiesa dei Cardinali preposti alle cose consistoriali opportunamente si inseriscano, e tra gli atti della medesima Congregazione per la piena osservanza si conservino accuratamente. Vogliamo inoltre che dei transunti delle medesime presenti anche stampati, sottoscritti però di mano di alcun Notaio pubblico e muniti del sigillo di alcuna persona costituita in dignità ecclesiastica, la medesima fede in giudizio e fuori di esso si attribuisca, quale alle medesime Lettere si attribuirebbe, se fossero esibite od ostese.

16 A nessuno dunque assolutamente sia lecito infrangere questa pagina della Nostra soppressione, estinzione, separazione, smembramento, ordine, concessione, indulto, impartizione, mandato, decreto, deroga e volontà, o osare di contravvenirvi temerariamente. Se qualcuno però avrà presunto di tentare ciò, sappia che incorrerà nell'indignazione dell'Onnipotente Iddio e dei Beati Pietro e Paolo Apostoli Suoi. Dato a Roma: presso San Pietro. 10 Et licet sit in more positum ex sacrorum egnonum isstituto, ut quaevis mensa episcopalis, sjngulaeque Cathedralium Praebendae ceteraeque ccelesiastiege dotationes in bonis stabilibus debeant fundari; nihilominus, habita paeculiari circumstantiarum ratione, ut congruae omnes supra relatae dotationes in decimis constituantur, opportune riteque assignandee ad normam aliarum in' Mexicana Ditione Dioeeesium pari Apostolica auctoritate indul+ gemus. 2 Since from the very beginning of Our Pontificate, following in the footsteps of Our Predecessors the Roman Pontiffs, We have taken care to extend paternal solicitude over all the churches throughout the world, and We have judged that nothing is more useful, nothing more fitting and opportune for the spiritual good and increase of Christian society than that the number of the Christian faithful should grow as much as possible, so that one shepherd alone should be found insufficient for their needs on account of the distance of places from the fold, and likewise that the necessary food of salvation should be multiplied also by way of the circumscription of new dioceses from the dismemberment of those same churches, and that new episcopal sees should be erected, and thus the adhesion of peoples to the Catholic Church should be increased and the profession of the Catholic faith should flourish more vigorously there, and that the same people, supported more closely by the assistance of vigilant pastors in doctrine and governance, should always make progress in faith with the propagation of divine worship and should not lack spiritual increase.

3 With this purpose and counsel indeed, We by Apostolic Letters in the form of a Brief on the thirteenth day of the month of August in the year of Our Lord one thousand eight hundred sixty-one more appropriately circumscribed the very extensive Diocese of Linares in the Mexican territory and from the dismemberment of the same subjected the entire Tamaulipan Region to the administration of an Apostolic Vicar, until We should decree otherwise and this Holy Apostolic See. Now, however, consulting more appropriately for that same region and striving first for the greater utility of the Christian faithful therein, We have determined to institute a Diocese there, and by a new circumscription to be made from the Mexican and Puebla Dioceses to erect the Bishopric of the City of Victoria or Tamaulipas to be named, with the Apostolic Vicariate of Tenesulipa entirely suppressed.

4 Wherefore We, who have already in the Apostolic Letters of erection both of the Metropolitan Church of Mexico and of the Episcopal Church of Puebla reserved to Ourselves and to this same See the faculty of making a new circumscription of those same Dioceses at Our and this See's discretion at any time, and now also having the consent of the Venerable Brethren, the Prelates of those same Churches, willingly given to this end, and ratifying and accepting it, and by the tenor of these presents more than sufficiently supplying by Apostolic Authority to the consent of others who have or in any way are presumed to have an interest in such a matter, and absolving and holding as absolved all and each to whom these Letters are favorable from any excommunication, suspension and interdict, and other ecclesiastical sentences, censures and penalties, whether from law or from man imposed on any occasion or cause, if in any way they are bound by them, to the effect of obtaining the present matter only, and having maturely deliberated upon all things which were to be examined, by Our Own Motion and from certain knowledge, and from the fullness of Apostolic Power, the Apostolic Vicariate which had been instituted by Us for the Tamaulipan region, by the same Apostolic Authority We entirely suppress and extinguish to effect the underwritten erection. Forthwith indeed the Tamaulipan region itself We institute by the same Apostolic Authority in perpetuity as a particular new Diocese with the same boundaries by which the same Apostolic Vicariate was previously circumscribed, and the Parishes which are contained in the Mexican Archdiocese and are called Ozuluama, Tantina, Panuco, Tempoal, Puebloveio, Tampico and Alto, Tantoyuca and the Succursal Church of St. Catharine Chontla, from the Metropolitan Church of Mexico and from the Episcopal Diocese of Puebla, and the Parishes which are commonly called De Amatlan, De Tamiahua, together with all their ecclesiastical possessions, Oratories and Pious Institutions of both sexes, Inhabitants of whatever rank, order and condition, Religious Brethren in Monasteries, Nuns in Convents and other accessories attending in the customary manner, by the aforesaid Apostolic Authority We also in perpetuity disjoin and dismember, and from the ordinary authority both of the present and of those existing for the time being Prelates of Mexico and Puebla We in perpetuity likewise exempt and dissolve, and We decree and thus constitute and establish in perpetuity by like Apostolic Authority the said new Diocese in the Tamaulipan region, a proper and distinct newly erected Bishopric of the City of Victoria or Tamaulipas to be named, commanding that all writings and documents which pertain either to the Churches, or to persons, or to revenues, or to rights and whatever else of the parochial churches dismembered as above, and which are at present preserved in the Chancelleries of the Mexican and Puebla Dioceses, be separated, and be delivered to the Chancellery of the aforesaid new Diocese of Victoria for the use and necessity of affairs.

5 And since the City of Victoria, which is indeed a conspicuous town of the Tamaulipan region, is judged to be increasingly more suitable for the permanent maintenance of an Episcopal residence, not only from the wider extent of its boundaries and the arrangement of houses and public buildings, but also on account of the convenient supply of necessary things, and moreover on account of the dignity of certain prerogatives and the suitability of advantageous facilities, and what is of no small importance, because it occupies the central place of the aforesaid Region; wherefore We, by the Apostolic Authority aforesaid, do perpetually elevate and exalt that city to the dignity of an Episcopal See, to be enjoyed henceforth by all and singular with the rights, prerogatives, eminences, honors, indults, privileges and all other things whatsoever which other Episcopal Cities in the Mexican dominion possess, enjoy and maintain by common law. And indeed We erect it as the residence of the newly established Bishopric of Victoria and of its Bishop in time. For this reason, the Temple, which to the Apostolic Delegate hereinafter appointed specially for this business shall seem most suitable and adorned and provided with ecclesiastical furnishings, We do by like Apostolic Authority perpetually elevate to the honor of a Cathedral Church, so that the same Church shall retain its former title or invocation and parochial status, if any should happen to exist; so that the care of souls shall reside with the Chapter, to be established as below, and when it shall have been established, shall be exercised habitually by the Chapter's Vicar, or otherwise by a suitable Presbyter approved by the Ordinary; and in it shall be established the Cathedral Seat and Episcopal Dignity for one future Bishop, to be called the Ordinary of Victoria or of Tamaulipas, who shall preside over the same Church and City and Diocese and its Clergy and entire People, and shall provide for them salutarily and fruitfully in the Lord through the ecclesiastical governance of his ordinary jurisdiction; he shall take care to preserve entirely and protect the Catholic Apostolic Roman Religion together with its rights and prerogatives which by the Ordinance of God and the Constitutions of the Sacred Canons it ought to enjoy, and to promote it more and more; and he shall be free, nor can he ever be distracted or hindered in any way by any title whatsoever, and for the exercise of ecclesiastical matters, and also for the governance of his Diocese fully, freely and effectively, he shall be able to observe, ordain, decree and determine all things whatsoever which the pastoral ministry and his ecclesiastical forum and likewise ecclesiastical matters, whether by necessity, or by opportunity, or by right discipline, require. Wherefore with pastoral and paternal freedom and prudence, as is fitting, he shall be able and shall strive to make the sacred visitation of his Diocese, to convoke and hold a Diocesan Synod at the times prescribed by the Sacred Canons, and to issue his institutions, ordinances, mandates and decrees both for the fulfillment of the duties of ecclesiastical administration in every way and for the observance of right moral discipline, and moreover to promulgate them effectively, and furthermore he shall diligently endeavor that communion obvious and entirely free be maintained and preserved between himself and the entire Clergy and People, and all the more with this aforesaid Holy Apostolic See always and whenever. Moreover, as regards the Chapter of this new Cathedral, We, having regard to the particular circumstances, do by Apostolic Authority prescribe that as soon as it can be done, a Chapter shall be established in the Cathedral according to the prescription of the Sacred Canons, which may render service and reverence to the Diocesan Prelate, and which shall consist of seven Canons constituted in the Order of Presbyters, of whom one shall bear the title and first dignity of Archdeacon, always reserved to the disposition of the Apostolic See; two others to be appointed by office, of whom one shall perform the duties of Penitentiary or Master of the Schools, the other truly of Theologian or Doctor, the remaining four shall be called and be of grace, as is customary in the other Chapters of the Mexican dominion; and all and each of them shall be bound diligently and duly to fulfill the divine offices and ecclesiastical duties, and to perform carefully and duly the other burdens and whatever else is prescribed for Chapters and Canons of Cathedral Churches and is found to be customary. Otherwise, let them be able to possess and enjoy the same rights, honors, privileges and others, by which by common law and by legitimate custom the Chapters of other Cathedral Churches of the aforesaid dominion possess and enjoy; providing moreover that six Presbyter Chaplains or Beneficiaries or Chantry Priests shall also be instituted there, who shall be bound to the service of the same Cathedral: and therefore all these shall be bound equally to attend diligently and duly the choral and all other ecclesiastical functions whatsoever, and indeed they shall be obliged to perform the ministries of Deacons and Subdeacons in turn; and moreover, he who is the first of these shall also perform the duties of Capitular Secretary; he who is second, of first Master of Ceremonies; he who is third, of Master of the Chapel Musicians; he who is fourth, of Censor or Pointer of those who without any canonical cause abstain from choral service; he who is fifth, shall be bound to perform the duties of second pointer. We commend that the aforesaid number of Canons be increased as soon as it can be done.

6 To this future Chapter, so that all and each of the Dignitaries and Canons aforesaid, as well as Chaplains or Beneficiaries or Mansionaries both in the said Cathedral and outside it (yet Diocesans within the limits), as often as they shall convene in chapter, may freely and lawfully wear and use the vestments and insignia of the choir, which are already in common use respectively in other Cathedrals of the Mexican dominion, excepting however those which shall have been granted and acquired by peculiar privilege, or by any special even burdensome title, we likewise perpetually grant and indulge by the same Apostolic authority. And to the same Chapter, when it shall have been constituted as aforesaid, we now give permission and faculty to draw up for itself capitular statutes, ordinances, and decrees, in no way contrary to the sacred canons, Apostolic constitutions and the prescriptions especially of the Council of Trent, but rather entirely consonant with them; which shall be subject to the judgment of the Bishop of Victoria, and shall obtain the force of law only after his approval has been confirmed.

7 That all and each of the Canons' prebends, as well as those six Chaplains' benefices, may be conferred according to the canonical laws, Apostolic constitutions and the prescriptions especially of the Council of Trent, we expressly command and enjoin, that whatsoever prebends in the whole Diocese, to which the care of souls is incumbent, even those which are called Theological or Doctoral and the other, which is called Penitential or Magisterial, may be obtained only by competition entirely according to the norm of the sacred constitutions and especially of our Predecessor of happy memory, Gregory XIII, Pope—Pastoralis officii—beginning, as regards the aforesaid Penitential and Theological offices.

8 Moreover, for the foundation of the new Bishopric of the City of Victoria or called Tamaulipan, and for its subsequent preservation and increase, we prescribe that for the residence of the Bishop, as well as for the episcopal curia or chancery to be immediately procured and suitably furnished with appropriate furnishings, there shall be assigned to the Episcopal Mensa as many buildings, as near to the Cathedral as may be possible, as shall seem necessary for the aforesaid purposes.

9 And so that for the Diocese of the City of Victoria or Tamaulipan there may continually grow up worthy and skilled laborers for the harvest of the Lord, who may diligently and widely apply themselves to careful and timely cultivation; therefore by the said Apostolic authority we command that in the aforesaid City of Victoria or Tamaulipan, unless it be already at hand, a suitable and convenient building be procured, or even constructed, and that it be sufficiently furnished with necessary and appropriate furnishings, and we mandate that it be assigned for a seminary to be duly administered according to the prescriptions of the Council of Trent.

10 And although it is established in custom from the institution of sacred canons, that every episcopal table, and each Cathedral Prebend and other ecclesiastical endowments ought to be founded in stable goods; nevertheless, having regard to the particular circumstances, so that all the aforesaid endowments may be suitably constituted in tithes, properly and rightly assigned according to the norm of other Dioceses in the Mexican Territory by like Apostolic authority, we grant. Let it be perpetually preserved and maintained as sacred law, that in favor of the Diocese of the City of Victoria, or called Tamaulipan, namely of its Episcopal table both of the Cathedral church, and of its Chapter and Clergy, and also of other lesser churches and of any pious institutions whatsoever, stable goods may be able, and freely and lawfully and validly may be able to be bequeathed, acquired, and finally with full ownership to be possessed, administered and vindicated. Nevertheless, while the Diocese of Victoria or Tamaulipan has need, we grant from now Apostolic permission to the Prelate in these times, so that he himself may lawfully be able to reserve for himself one only of the Diocesan parishes, so that it may be administered through a Vicar to be chosen by the Prelate himself, and to be remunerated with a suitable portion or pension, with this indeed prudent counsel, so that the tithe revenues of such reserved parish may be able and ought to be expended by his prudent judgment and providence to repair and relieve the graver needs of the same Diocese. However, if it shall truly be discovered, that especially in the earlier years the proceeds of tithes may not be able fully to suffice for the simultaneous and suitable sustenance of the Bishop himself, and his entire Chapter, and also of other connected ecclesiastical institutions, then the Prelate himself, our authority now from then acceding, may be able and by his prudent judgment at his pleasure to suspend either the effective foundation of the Cathedral Chapter or of any other connected institutions, until it shall have been ascertained, that such tithe proceeds are now in such a state, that thereafter they may be able to supply suitable endowments continuously either for such Chapter, or for all the others, or for one of the aforesaid ecclesiastical institutions for suitable sustenance. During however such time of suspension the same Prelate shall indeed appropriate for himself yearly for the episcopal table eight thousand only Mexican scudi. Whatever moreover shall remain from the same heap of tithes, that he shall be entirely bound to retain in a special fund, until it shall be ascertained that there is ready from it that which may be able to suffice for the endowment or pension of each of the same institutions (even if gradually according to the order of greater necessity or opportunity to be made) to be suitably and continuously attributed.

11 Which indeed church of the City of Victoria, or Tamaulipan, we subject in the Suffragans of the Archiepiscopal Church of Mexico with all and singular rights, honors, prerogatives, graces, indults, which likewise the Suffragans of that Archiepiscopal Church are accustomed to have and to maintain, by the said Apostolic authority, and its canonical tax for the expedition of Apostolic Letters, whenever a Prelate shall be to be placed over the same Cathedral Church, we establish in thirty-three golden florins of the camera with the third part of the same florin, and thus in the books of the Apostolic Camera and of the Sacred Roman Church and of the College of Cardinals we order to be inscribed and observed.

12 Finally we reserve to ourselves and to the Roman Pontiff existing for the time, the faculty of circumscribing this new Diocese, whenever it shall seem more expedient in the Lord.

13 These present Letters may not be impugned, invalidated, infringed, retarded, or rendered void on account of subreptitiousness or obreption, or nullity, or on account of Our intention, or any other defect whatsoever, however juridical and substantial; even on the ground that whosoever having or deemed to have or claiming to have any interest whatsoever in all and singular of the foregoing, of whatever quality, status, condition and dignity they may be, were not called, cited and heard thereto, and on account of any other cause whatsoever, however pious, privileged and worthy of special note; nor may they be challenged, invalidated, infringed, retarded, or rendered void, reduced to the way and terms of law, nor may any opening of the mouth against them, or any other whatsoever remedy of law or fact, even on the ground of injury howsoever enormous and most enormous, or of any prejudice whatsoever, be obtained; and likewise by motive and fullness of power, similar things granted against the foregoing by any of Our Successors, the Roman Pontiffs, in any manner whatsoever, may not be accepted, and may not be alleged, deduced, or otherwise used in any manner whatsoever in judgment and outside it; but rather all and singular of the foregoing shall always and perpetually remain firm, valid and efficacious, and shall produce and obtain their full and complete effects; and they shall not be comprehended under revocations, suspensions, limitations, derogations, or other contrary dispositions, even consistorial, nor comprehended in any manner whatsoever, but shall always be excepted from them, and as often as those shall flow forth, so often shall they be restored to their pristine and most valid state, replaced and fully reintegrated, and granted anew also under whatever later date to be chosen at any time, and shall be and remain so; and thus and not otherwise by whatsoever Ordinary or Delegated Judges exercising any authority whatsoever, even the Auditors of the causes of the Apostolic Palace, or Cardinals of the Holy Roman Church, even Legates a latere, and Nuncios of the said See, and any others whatsoever exercising any authority, power, prerogative, honour and pre-eminence, they ought to be judged and determined; and whatsoever shall happen to be attempted concerning these things by anyone whatsoever with any authority whatsoever, knowingly or unknowingly, We decree to be null and void.

14 Wherefore to Our Venerable Brother Pelagius De la Bastida y Davalos, the present Archbishop of Mexico, by these same presents We commit and command that he proceed to the execution of all the foregoing; imparting to him the necessary and opportune faculties, by which he may subdelegate to another suitable and approved person constituted in ecclesiastical dignity for this work; yet so that the same Pelagius, the Archbishop, either by himself or by the person to be subdelegated, may be able to ordain, dispose and also definitively determine, with all appeal removed, all those things which shall seem to him either to be fitting or more expedient, so that the aforesaid erection of the City of Victoria or the Bishopric of Tamaulipas may be happily brought to the desired end, commanding moreover that in the executorial decree of all these things the natural boundaries of the same new Diocese be described with special care, and each town and parish be named individually, and indeed a topographical chart be inserted, Notwithstanding Our rule and that of the Apostolic Chancery—De iure quaesito non tollendo—and the most recently celebrated Lateran Council, which prohibits perpetual dismemberments except in cases permitted by law, and also other special or general constitutions and ordinances, whether issued or to be issued in synodal, provincial, general and universal councils, Apostolic, and of the Mexican and Puebla churches, even those strengthened by oath, Apostolic confirmation, or any other firmness; statutes and customs; privileges also, indults and Apostolic Letters whatsoever granted to superiors and persons in general or in particular, or otherwise with any derogatory clauses even of derogations, and other more efficacious and most efficacious and unusual clauses, irritant and other decrees even by motive proprio, knowledge and fullness of power equal, likewise consistorially, even in foundation and original institution, or otherwise granted, approved, confirmed and renewed in any manner whatsoever: all and singular of which, even if for their sufficient derogation special, specific, express and individual mention of them and their whole tenor ought to be had, or any other expression, or some other exquisite form to be observed for this, the tenors of which, as if word for word, with nothing whatsoever omitted and the form transmitted in them observed, were inserted in these same presents, We hold to be fully and sufficiently expressed, those otherwise remaining in their force; most widely and fully and specially and expressly for the purpose of the present and the validity of all and singular of the foregoing this time only, by motive, knowledge, and fullness of power equal, We also by the tenor of these derogate, and to all other things contrary whatsoever.

15 We will, however, that the said Pelagius, Archbishop, within six months from the completion of the execution of these present letters, shall diligently send to this Apostolic See not only an authentic copy drawn up in proper form of the said executory decree, but also of all other documents whatsoever which shall have been brought forward and completed upon this matter, so that together they may be opportunely inserted in the Archive of the aforesaid Congregation of the Cardinals of the Holy Roman Church placed in charge of consistorial affairs, and among the acts of the same Congregation they may be carefully preserved for full observance. We will also that transumpts of these same present letters, even if printed, provided they are subscribed by the hand of some public Notary and furnished with the seal of some person constituted in ecclesiastical dignity, shall have the same force entirely in judicial proceedings and outside them as would be had by these same Letters, if they were exhibited or shown.

16 Let no one whatsoever be permitted to infringe this page of Our suppression, extinction, separation, dismemberment, command, concession, indult, grant, mandate, decree, derogation and will, or to dare to act contrary to it with rash presumption. If anyone, however, shall presume to attempt this, let him know that he will incur the indignation of Almighty God and of the Blessed Apostles Peter and Paul His. Given at Rome, at St. Peter's, in the year of Our Lord's Incarnation one thousand eight hundred and sixty-nine, on the fourth day before the Ides of March 1, in the twenty-fourth year of Our Pontificate.
