Apostolici ministerii

21 § 10. E poiché nelle predette cappellanie della Spagna senza certo provento abbiamo inteso essere fornite;

XXXIV.
Decrees are issued for restoring ecclesiastical discipline in the kingdoms of Spain 1 Pope Innocent XIII, for perpetual remembrance of the matter.
1 The beginning of the apostolic ministry, which the disposition of divine counsel has imposed upon us with such solicitude for preserving and restoring ecclesiastical discipline, requires that we vigilantly attend with all diligence to ecclesiastical discipline in those who have been called to the lot of the Lord, either to preserve it or, where it shall be necessary, to restore it according to the institutes of the sacred canons and the most holy laws and ordinances of the Church. 1 The Constitutions pertaining to such decrees are noted here in their places: the Constitution of Innocent XII, issued in 1697, on 4 August, in the eighth year of his pontificate, confirmed the Congregation on regular discipline; and the Constitution of Benedict XIII, issued in 1724, on 23 September, in the first year of his pontificate, confirms the present constitution.
2 For after the fall of our first parent, the infirmity of human mortality always depresses us toward lower things, and through the weakness of the flesh, the vigor of observance is gradually relaxed; whence also we are taught by daily experience that religious hearts themselves become soiled from worldly dust, and in the very field of the Lord thorns and thistles germinate there; but if the harmful things are uprooted and useful things are planted, there is no doubt that, with the Lord blessing, a more abundant harvest of the wheat of the elect and holy works will arise, and all the people will proceed happily in the way of the Lord, with the clergy shining forth as a light.
3 § 1. Since therefore our beloved son Louis, Cardinal of the Holy Roman Church, surnamed Belluga, Archbishop and Metropolitan of the Church of Cartagena by apostolic concession and dispensation, when he had been sent into Spain in the early days of our pontificate, exposed to us certain abuses introduced into ecclesiastical discipline and not at all consonant with the most salutary decrees of the sacred ecumenical Council of Trent, which had gradually crept in at various places in the renowned nation of Spain, and both he himself, the said Cardinal and Archbishop, and other venerable brothers, the archbishops and bishops of the kingdoms of Spain, humbly petitioned us, to whom the fullness of solicitude has been committed, that opportune remedy be applied to these matters; and to their earnest prayers our most beloved son in Christ, Philip, the Catholic King of Spain, joined also his own efforts and wishes, for his singular piety and outstanding zeal for the Christian religion, having sent to us many letters concerning this matter: we entrusted the whole matter to a particular Congregation of some of our venerable brothers, the same Cardinals of the Holy Roman Church, interpreters of the Council of Trent, appointed by us, to be carefully examined. And when this had been accomplished by the said Congregation of Cardinals with the maturity that was fitting, and the opinion of the same had been reported to us through the secretary of the same Congregation, by the counsel of the aforesaid Cardinals we deemed it fitting and opportune to establish, decree and declare by this our perpetual constitution, which shall remain in force, the following matters, for the glory of almighty God, the utility of the Church, the restoration of ancient discipline, and the spiritual edification of the kingdoms of Spain.

7 Necessity demands that they be entrusted with such matters, and since other faithful, constantly fixing their eyes upon their lives, are to draw from them an example to imitate, it was therefore prudently provided by those fathers that none should be enrolled in the ecclesiastical militia through the first tonsure except those who give probable indication that they have chosen this way of life, not by the counsel of declining secular judgment, but with sincere intention of rendering faithful cultivation and service to God; we therefore will, and for the safer execution of this conciliar sanction1 by all the archbishops and bishops of the kingdoms of Spain, that henceforth no others be admitted to the first tonsure than those to whom some ecclesiastical benefice is to be conferred immediately, or those who are known to be so devoted to the study of letters that they appear to be on the way to receiving both minor orders and thereafter also major orders, or finally those whom they shall see fit to assign to the service or ministry of some church.
8 § 3. And both in those who receive the first clerical tonsure and in others who are promoted to orders, even minor ones, if they desire it, the rule handed down by the same Council of Trent shall be altogether observed, namely that no one shall be ordained who, in the judgment of his bishop, is not useful or necessary to his churches, and who is not enrolled in that church or pious place for whose utility or necessity he is assumed, where he may in fact exercise functions consonant with his rank. But if any should be found either already initiated with clerical tonsure or already promoted to orders whether minor or major, who have been enrolled in no certain church or pious place, let the bishops supply this enrollment, omitted either by themselves or by their predecessors, immediately, no less for all those constituted in major orders even of the priesthood, than for those who, whether with only the first tonsure or initiated in minor orders, nevertheless possess an ecclesiastical benefice. From the rest, however, as aforesaid, either marked with only the first tonsure or constituted in minor orders, but lacking a benefice, let them enroll only those whom they shall have judged useful or necessary to their churches. Moreover, we permit that the execution of the aforesaid enrollment may be deferred for some space of time, which shall seem convenient to the bishops themselves, regarding those who are found absent from the diocese in which they received the tonsure or orders, for the reason of learning the knowledge of letters in some public university or gymnasium, or from another reasonable cause approved or to be approved by their bishop.
9 § 4. Since, however, clerks who are educated in episcopal seminaries, so that they may more assiduously apply themselves to the study of sacred letters and of the things of the Church alone and to learning those things prescribed by the same Council of Trent, are able to devote themselves to this more diligently,
10 let them be bound, according to the decree of the same Council, to serve in the cathedral and other churches of the place on feast days only, and we will and command that this manner of service to be performed by them be observed in all dioceses of Spain, and that they themselves participate only in the general supplications or processions of the whole clergy, with every custom of greater service being removed, even if immemorial, and with every appeal or inhibition being set aside. But if any seminary should be found in whose foundation it was otherwise provided on account of an added law of greater service by him who founded the seminary itself or endowed it or conferred some pious gift, let the bishops refer this to us and to the Roman Pontiff existing for the time, so that they may be able to provide appropriately thereupon.
11 § 5. Those to be promoted to sacred orders ought to possess knowledge.
12 Moreover, since it is most fitting that those who draw near to the most sacred mysteries, beyond other requirements, should also be endowed with suitable knowledge, by which equipped they may show the way of salvation to other Christian faithful, let bishops admit to sacred orders from the clergy both secular and regular only those whom they shall have found through diligent inquiry to be truly worthy of that rank on account of knowledge and other qualities, so that it is not enough for those who desire to be promoted to the aforesaid orders to understand the Latin language, to be instructed in the catechism, and to answer aptly to questions concerning the order to be received proposed to them in examination; but those who are to be assumed to the priesthood shall first be proved suitable through a similar careful examination for administering the sacraments and for teaching the people those things which it is necessary for all to know for salvation; and in order that this may be rightly accomplished, we exhort these same bishops in the Lord that, as far as it can be done, they assume to the priesthood only those who are at least competently skilled in moral theology.
13 necessary for salvation; which indeed, in order that it may be rightly provided, we exhort these same bishops in the Lord that, as far as it can be done, they assume to the priesthood only those who are at least competently skilled in moral theology.
14 § 6. But if those having a domicile in one diocese and a benefice in another can be ordained by the bishop of the benefice on the title of that benefice, provided they have produced testimonials from the bishop in whose diocese the benefice is situated, the bishop of their domicile ought to examine them, if they are about to return to his diocese, concerning their knowledge or fitness before granting them testimonial letters concerning their birth, age, morals and life, according to the constitution of our predecessor Pope Innocent XII of happy memory which begins Speculatores, to be obtained; adding also a testimony of proven fitness in the same letters; nor should they be granted in any way if they have not been approved as suitable in the aforesaid examination; and if they have not obtained letters according to the aforesaid form, they can in no way be promoted to orders by another bishop to whom they are also subject by reason of the benefice obtained; and if it be done otherwise, the ordaining bishop shall indeed be suspended from the conferral of orders for a year, and the ordained person from the execution of the orders received for as long as his own Ordinary shall see fit, by that very fact, and both shall be subject moreover to graver penalties according to the measure of the fault and at the discretion of the reigning Roman Pontiff.
15 § 7. And since also according to the aforesaid constitution of our predecessor Innocent, a benefice obtained in another diocese ought to be of such income and title that orders may be received from the bishop of that diocese only if the aforesaid benefice be of such revenue as to suffice for a suitable sustenance of life, with burdens deducted, according to the custom of the place of the domicile.
16 We declare that such sufficiency ought to be determined not according to the synodal tax or custom prevailing in the place of the aforesaid benefice for those to be promoted to sacred orders (unless indeed it requires continuous and precise residence), but according to the tax, or, that being lacking, according to the custom prevailing in another place of domicile. Those clerics not proceeding in clerical habit and tonsure, or not fulfilling their duty, or perpetrating things forbidden by the sacred canons, are to be subjected to these penalties.
17 § 8. Furthermore, for maintaining ecclesiastical discipline sound and intact, it is no less important that the name of clerical service not be permitted to those who are not sufficiently suitable, than that those already enrolled in the same service should follow a praiseworthy manner of living and exhibit that innocence of morals which corresponds to the holiness of the institute undertaken, and much more that they abstain from those things which are justly and rightly forbidden by the sacred canons as altogether unworthy of men dwelling in the tabernacle of the Lord and dedicated to the venerable ministry of the altar. We therefore establish and decree that if there are any clerics, initiated into the first tonsure or minor orders, possessing no ecclesiastical benefice, who, neglecting the decrees of the Council of Trent, do not wear clerical habit and tonsure, or, if they do wear them, do not nevertheless serve a certain church or pious place to which they have been assigned by mandate of the bishop, or do not engage in an ecclesiastical seminary or in some school or university with the permission of their Ordinary; the bishops, without even any prior admonition, shall declare them deprived of the privilege of forum, and shall order that their assignment to the service of a certain church previously made be annulled. And if they do not enter upon a better manner of life, or even if there are others whom, through their own fault, it cannot be hoped will be made suitable for promotion to sacred orders; the same bishops, observing the form handed down by the sacred canons, shall proceed against them to the deprivation of other clerical privileges. But where clerics are found holding chaplaincies or benefices of any income whatsoever, whose wicked life, giving offense to others, destroys rather than builds up, or who are concubinaries, or usurers, or given to drunkenness or games of chance, or sowers of quarrels, or merchants, or bearing arms, or wandering in uncertain dwellings, or not wearing clerical habit and tonsure, or wickedly abusing ecclesiastical immunity in fraud of tributes and tolls not paid by laymen without example, or who finally, perpetrating similar or greater crimes, seem to belong to the Church more by number than by merit; the bishops, having first made the necessary admonitions and observed other things to be observed by law, shall proceed against them according to the penalties imposed by the Roman Pontiffs our predecessors and by the sacred councils, and also to the deprivation of benefices, chaplaincies and ecclesiastical offices in all those cases in which the aforesaid deprivation is imposed by the sacred canons, all human considerations being set aside, mindful that they themselves will pay fitting penalties to God as avenger for the neglected correction of their subjects.
18 § 8. Moreover, for the purpose of preserving intact and undefiled ecclesiastical discipline, it is no less important that the name of the clerical militia not be permitted to those who are not sufficiently fit, than that those already enrolled in the same militia should follow a praiseworthy manner of living and exhibit that innocence of morals which corresponds to the holiness of the institute undertaken, and much more that they abstain from those things which are justly and deservedly forbidden by the sacred canons as altogether unworthy of men dwelling in the tabernacle of the Lord and dedicated to the venerable ministry of the altar. We therefore establish and decree that, if there are any clerks initiated into the first tonsure or minor orders, possessing no ecclesiastical benefice, who, neglecting the decrees of the Council of Trent, do not wear the clerical habit and tonsure, or, if they do wear them, do not nevertheless serve a certain church or pious place to which they have been assigned by mandate of the bishop, or do not engage in an ecclesiastical seminary or in some school or university with the permission of their Ordinary; the bishops, without even any prior admonition, shall declare them deprived of the privilege of forum, and shall order that their assignment to the service of a certain church previously made be annulled. And if these men do not undertake a better manner of life, or even if there are others whom, through their own fault, it cannot be hoped will be made fit for promotion to sacred orders; the same bishops, observing the form handed down by the sacred canons, shall proceed against them to the deprivation of other clerical privileges. But where clerks are found holding chaplaincies or benefices of any income whatsoever, whose wicked life, giving offense to others, destroys rather than builds up, or who are concubinaries, or usurers, or given to drunkenness or games of chance, or sowers of quarrels, or merchants, or bearing arms, or wandering in uncertain dwellings, or not wearing the clerical habit and tonsure, or rashly abusing ecclesiastical immunity in fraud of tributes and tolls not paid by laymen without example, or who finally, committing similar or greater crimes, seem to belong to the Church by number rather than by merit; the bishops, having first made the necessary admonitions and observing other things to be observed by law, shall proceed against them according to the penalties imposed by the Roman Pontiffs our predecessors and by the sacred councils, and also to the deprivation of benefices, chaplaincies and ecclesiastical offices in all those cases in which the aforesaid deprivation has been imposed by the sacred canons, setting aside all human considerations whatsoever, mindful that they themselves will pay fitting penalties to God as avenger for the neglected correction of their subjects.
19 § 9. But also, since the persons of the Church, all clergy in ... ... their churches never sufficiently in obedience to the supreme ... ecclesiastical collations ... which are consonant with their state, are able to be exercised, we commend most highly in the Lord the pious custom prevailing in most dioceses of Spain, that clerics constituted in both minor and major orders, and also priests, even if they do not hold ecclesiastical benefices or offices, clothed in the surplice in the churches to which they are assigned, assist at the conventual Mass celebrated with singing, as well as at first and second Vespers on Sundays and other feast days.
20 Moreover, we earnestly exhort that bishops of other dioceses, in which that custom has not been established hitherto, take care to observe it in the future in all respects, and furthermore endeavor that all the aforesaid ecclesiastics also attend the collations to be held before their parish priests or others appointed by the bishop concerning cases of conscience affecting the forum and concerning sacred rites and ceremonies.
21 § 10. And since in the aforesaid kingdoms of Spain we have learned that benefices and chaplaincies are found without certain revenue;
22 which indeed benefices and chaplaincies also from the right of patronage, whether ecclesiastical or lay, are conferred without certain revenue;
23 first tonsure instructed, or even so that they do not ascend to one half nor to one third of the congrua necessary for clerics to be promoted to sacred orders; wishing to meet the evils not indeed light arising thence, we decree and command that bishops proceed immediately to the suppression of benefices and chaplaincies which have no certain income. Concerning other benefices and chaplaincies, however, whose certain annual fruits do not ascend to the aforesaid third part of the congrua, we decree that first tonsure is to be conferred on no one hereafter by reason of acquiring any of the said benefices and chaplaincies. And in order that the rights of patronage may, as far as possible, remain safe, it is permitted to patrons, both ecclesiastical and lay, to nominate to the said benefices and chaplaincies, yet not as to ecclesiastical benefices requiring first tonsure in those nominated, but as to pious legacies; and those nominated, although not having first tonsure, may retain them as pious legacies with the burden of fulfilling all the charges imposed by the founders.
24 § 11. Not without grave sorrow of our heart have we also learned that, although the Council of Trent decreed that all who obtain parochial or other churches with the care of souls attached in any manner whatsoever ought to feed the peoples committed to them on at least Sundays and solemn feast days with salutary words according to their capacity and that of the peoples, teaching those things which the Christian faithful ought to know for salvation, and explaining the precepts of divine law and the dogmas of faith, and imbuing the children with the rudiments of the same faith, and in brief and easy discourse denouncing the vices which ought to be avoided and the virtues which ought to be followed; nevertheless some rectors of parochial churches neglect these things, which are so much their duty, striving to remove such blame either by the pretext of immemorial, but indeed depraved, custom, or because these do not seem necessary to be performed by themselves, there being indeed an abundance of others having sacred sermons in other churches and likewise imbuing children with the mysteries of faith either in schools or in confraternities. Lest therefore, under the empty pretext of these and other similar excuses, such destruction of Christian society be constructed, we strictly command all the archbishops and bishops of Spain that they altogether ensure that all those who have the care of souls perform the aforesaid duties through themselves, or, if they are legitimately hindered, through other suitable persons diligently. If indeed any are found not sufficiently able to perform them, the same archbishops and bishops through others to be appointed by themselves shall take care to supply appropriately at the expense of the less suitable parish priests; and hereafter those having the care of souls ought to instruct the people at least on feast days through themselves, through others however if suitable ones are not available, but at their expense.
25 § 11. Not without grave sorrow of Our heart have We also learned that, although the Council of Trent decreed that all who hold parochial or other churches with the care of souls attached in any manner whatsoever ought on at least Sundays and solemn feast days to feed the peoples committed to them with salutary words according to their own and their capacity, teaching those things which the Christian faithful ought to know for salvation, and explaining the precepts of divine law and the dogmas of faith, and imbuing children with the rudiments of the same faith, and in brief and easy discourse denouncing the vices which ought to be avoided and the virtues which ought to be pursued; nevertheless certain rectors of parochial churches neglect these things, which are so much their duty, striving to remove such blame either by the pretext of an immemorial, but indeed depraved, custom, or because these do not seem necessary to be performed by themselves, there being surely an abundance of others having sacred sermons in other churches and likewise instructing children in the mysteries of faith either in schools or in confraternities. In order therefore that, under the empty pretext of these and other similar excuses, such great harm to Christian society not be brought about, We strictly command all the archbishops and bishops of Spain that they altogether ensure that all those who have the care of souls diligently perform the aforesaid duties through themselves, or, if they be legitimately hindered, through other suitable persons. But if any should be found not sufficiently able to discharge those duties, the same archbishops and bishops through others to be appointed by themselves shall take care that they be suitably supplied at the expense of the less suitable rectors; and henceforth those having the care of souls ought on at least these days to instruct the people through themselves, but through others if they are not suitable, yet at their own expense.
26 § 12. Furthermore, lest the sanctions of the constitution of our pious predecessor, concerning the perpetual portion by which the congrua portion of fruits is fixed ...
27 § 12. Furthermore, lest the sanction of the constitution of Pius V and also of our predecessor, concerning the perpetual portion in which a suitable portion of the fruits is fixed...
28 to be assigned to perpetual vicars exercising the care of souls, an interpretation alien to his judgment should happen to be made, we declare that constitution to pertain only to the perpetual vicars of those parochial churches which are united to other churches, monasteries, colleges, benefices and pious places, and likewise the annual portion of fruits which is therein appointed to be assigned to the same vicars in a sum not greater than one hundred nor less than fifty scudi, ought to be understood of silver scudi of ten julii of Roman currency for each scudo.
29 § 13. Whenever therefore in other parochial churches, which, as aforesaid, are not united in such manner, it shall be necessary to provide by means of coadjutors of the rectors or by temporary vicars, it shall be the care of the bishops, by the power given to them by the Tridentine Synod, to determine the portion of fruits to be assigned to the aforesaid coadjutors or vicars in such quantity as, according to their prudent judgment and conscience, shall seem fitting, namely having regard to the revenues and emoluments of the parochial church in which they shall have been appointed, as well as having regard to the conditions of the place, the number of souls, the quality of the labor, and the amount of expenses which the necessity of the committed office shall have demanded. Which if the rectors, admonished by the bishops, within a suitable time fixed to them, shall have neglected to assume coadjutors or temporary vicars, whenever it shall be necessary; the bishops themselves may, by their own authority, appoint those whom they shall judge suitable for this office, with the assignment of the aforesaid portion of fruits. And nevertheless, even where the aforesaid coadjutors or temporary vicars shall have been nominated or assumed by the rectors, their suitability ought to be established to the bishops by examination before they are admitted to the exercise thereof; nor is it sufficient that they were previously approved for hearing confessions, unless they are known to be endowed with other qualities opportune for the correct exercise of the care of souls. If they lack these, and the rectors thereafter within another similar time to be fixed by the bishops shall not have nominated others truly suitable, then likewise it shall freely pertain to the bishops themselves to make the appointment with the said suitable assignment; nor can any contradiction or exemption or appeal of the rectors, or inhibition of any judge, suspend the execution of the appointment and assignment of a certain portion of fruits in the aforesaid cases, and likewise notwithstanding any contrary custom even immemorial.
30 § 14. But, because the care and necessities of souls are not always sufficiently provided for by the fact that other priests are joined to the rectors for the performance of parochial duties, but greater remedies must be applied, namely whenever on account of the distance of places or the difficulty of travel the parishioners cannot without great inconvenience approach the parochial church for receiving the sacraments and hearing divine offices; then indeed let the bishops remember that it is permitted to them, according to their judgment, even against the will of the rectors, either to designate within the same parishes other churches in which priests, coadjutors of the rectors, may minister the sacraments and exhibit divine worship, or to establish new parishes and new parochial churches distinct from the old ones, and to place new rectors over them, assigning from the revenues in any way pertaining to the old parochial church a suitable portion for the sustenance of those who, either as coadjutors appointed in the said other churches, or as distinct and independent rectors, shall exercise the care of souls; no appeal or inhibition availing to prevent the aforesaid.
31 § 15. Since, according to the prescription also of the Tridentine Synod, honor is to be given to the bishops, which befits their dignity, and the first place in the choir and in the chapter, in processions and other public acts ought to be theirs, and especially the authority of all things to be done; we command that this be religiously and perpetually observed in all acts so consonant with such just preeminence and authority, notwithstanding privileges even competent from foundation, customs even immemorial, sentences, oaths and concordances, which bind only their own authors.
32 § 15. Since, according to the prescription also of the synod, honor and the first place must be accorded to bishops, which befits their dignity, and they ought to have the first place in the choir and in the chapter, in processions and other public acts, and especially the authority in all matters to be transacted; we command that this be observed religiously and perpetually in all acts so consonant with such just preeminence and authority, notwithstanding privileges even competent from foundation, customs even immemorial, sentences, oaths and concordances, which bind only their own authors.
33 Religious § 16. Furthermore, in order that the vigor of discipline in cloistered communities of religious may likewise remain unimpaired, We have also deemed it fitting to interpose the care of Our pontifical solicitude. Since therefore it has been ascertained by experience how much harm is brought upon them from the fact that more are admitted to the religious habit than the strength of revenues can sustain; by these presents We commit and command to Our nuncio, existing in the present time and for the time being in those kingdoms of Spain on behalf of the Apostolic See, that he take care and exercise vigilance, lest contrary to the prescription of the aforesaid Council of Trent, into monasteries, convents and houses, both of men and of women, whether they possess immovable property or not, a greater number be received than those who can be conveniently sustained either from the revenues proper to those monasteries, convents or houses themselves, or from customary alms and whatever other emoluments whatsoever, to be contributed in common, however.
34 § 17. Whenever indeed regulars are to be promoted to orders, the decree of the Congregation of cardinals, interpreters of the Council of Trent, confirmed also by Our predecessor of pious memory, Pope Clement VIII, on the fifteenth of March in the year fifteen hundred ninety-six, shall be observed entirely, by which it is enacted that letters dimissory for the reception of those orders are to be directed by their superiors to no one other than the diocesan bishop, except in the case where the diocesan is absent from the diocese, or is not to have ordinations, in which case also express mention must be made in the letters dimissory directed to another bishop either of the aforesaid diocesan bishop's absence, or of that other cause, namely that he is not to have ordinations, excepting however, as to the aforesaid, those regulars to whom by special privilege from the Apostolic See after the Council of Trent it shall have been granted that they may receive orders from any Catholic bishop, concerning which indult We intend to innovate nothing by these presents. Let bishops moreover know that they ought by themselves, the case of sickness excepted, to confer orders, and the conferral of sacred orders, at the times appointed by law, and in the cathedral church, with canons called and standing by, to be held publicly, or, if in another place of the diocese, always however in a church as more dignified as can be done and with the clergy of that place present. But lest uncertainty, whether they themselves are to have ordinations, bring too grave inconvenience to those to be promoted dwelling in various places of the diocese, one month before, each time, let it be announced by public edict by those same bishops that they are to have ordinations, so that to which bishop the letters dimissory of the religious to be promoted to orders are to be directed.
35 Whenever such announcement shall not have been made, from that let the regulars sufficiently understand that the diocesan bishop is in no way to have ordinations at that time, and that it will therefore be lawful for them to receive orders from another bishop with letters dimissory directed to him from their superiors, the form expressed above being observed in them.
36 § 18. Bishops shall be vigilant in all women's monasteries subject to them as ordinary, in others however by authority of the Apostolic See let them take care that those things are inconcussably observed which concerning the enclosure of nuns, and the prohibition of entrance into those monasteries, both in the decrees of the Tridentine Synod and in the constitution of like memory of Pope Gregory XIII, also Our predecessor, issued on the fifteenth of January in the year fifteen hundred seventy-five, have been providently ordained.
37 § 19. Considering moreover that it is especially expedient for the Christian republic that confessors be approved by the bishop of the diocese in all matters concerning the care of souls
38 holy ministry and power of the keys in remitting and retaining sins may be rightly exercised, we declare that priests, both secular and regular, who have obtained from bishops a license to hear confessions limited either as to place or as to the kind of persons or as to time, are not able to administer the sacrament of penance outside the time or place or kind of persons prescribed by the bishops themselves, which in no way whatsoever shall be aided by any privilege, even one competent by virtue of the Bull which is called the Holy Crusade. Moreover, since the same Innocent, our predecessor, by his letters expedited on 19 April of the year 1700 decreed that priests, both secular and regular, are not permitted to hear the confessions of those who, by the indult of the aforesaid Bull of the Crusade, have been chosen for this purpose, without the prior approval of the Ordinary of that place in which the penitents dwell and choose confessors, even if they had previously been approved by the Ordinaries of other places, and even if the penitents were subject to those Ordinaries who had approved the chosen confessors, and moreover that confessions otherwise made and respectively received are null, void and invalid, and that the confessors themselves are suspended by the law itself: we, approving, confirming and renewing the same constitution, declare furthermore that it can in no way avail the aforesaid priests, both secular and regular, chosen to receive confessions either by virtue of the aforesaid Bull of the Crusade or by any other privilege, that they were previously approved by that bishop who at some time was the Ordinary of the place in which confessions are to be heard, but such a one no longer exists at that time, either because he has departed from human affairs, or has renounced the episcopate, or because he is found to have been transferred to another church by apostolic authority; but the approval of him who actually and for the time being exercises ordinary jurisdiction in that diocese is altogether necessary. This approval, however, shall suffice even if tacit, and it shall be held to exist so long as the preceding license or approval lasts and has not been revoked by him; in which case a new and express one must be obtained, if that previously obtained has expired through the lapse of the prescribed time, or has been taken away by subsequent revocation.
39 § 20. Let regular clerics also remember that they cannot hear the confessions of nuns subject to them, even though they are subject to their governance and direction, unless, beyond the license of their regular superiors, there precedes an examination to be made before the diocesan bishop, and his special approval as to the confessions of the said nuns; all contrary custom, even immemorial, being removed. Those who and as often as are to be appointed extraordinary confessors of nuns,
40 Bishops shall cause the ceremonial, ritual and rubrics to be observed.
41 Likewise sess. un of the Council of Trent on the celebration of masses.
42 § 21. And since from the same Council of Trent an extraordinary confessor should be offered to nuns twice or three times in a year who may hear the confessions of all, if henceforth the regular superiors as to the monasteries subject to them neglect to appoint the aforesaid extraordinary confessor so many times, or if they also always appoint one from their own Order, and have not at least once in a year chosen for this duty a priest either secular or regular professing a different Order, in these cases the bishops, according to their discretion and conscience, may make such an appointment, nor shall it be able to be hindered by the regular superiors under any title or pretext.
43 § 22. Bishops moreover shall strive entirely to remove all abuses which have crept into churches, whether secular or regular, contrary to the prescription of the ceremonial of bishops and the Roman ritual or the rubrics of the missal and breviary. And, if it should happen that even immemorial custom is alleged against those things which are established in the said ceremonial, after they have ascertained either that it is not sufficiently proved, or even if proved, that it cannot avail, as being unreasonable by law; let them diligently apply themselves to the execution of those things which are constituted in the said ceremonial, nor shall any suspensive appeal be admitted.
44 § 23. Let the same bishops likewise take care diligently that abuses be eliminated, if any have perhaps been introduced as much against ecclesiastical seculars as against regulars contrary to the decree of the Council of Trent on those things to be observed and avoided in the celebration of masses, sess. xxii, and against regulars, if it be necessary, let them proceed by apostolic delegation granted to them in that decree, setting aside any suspensive appeal, but only reserving the devolutive on any doubt which may happen to arise, for declaration by the Congregation existing for the time being of the Cardinals of the Holy Roman Church, interpreters of the aforesaid Council.
45 § 24. And whereas concerning the celebration of Masses in private oratories, as well as concerning the use of a portable altar, a timely decree was promulgated by Clement, Pope XI, also our predecessor, of blessed memory, on the fifteenth of December in the year seventeen hundred and three; let bishops take care that all things therein decreed be observed also in the kingdoms of Spain, and let them cause the same decree to be published in their respective dioceses, so that it may more easily become known to all, adding also a prohibition lest an altar be erected in private cells or chambers of regulars for the purpose of performing sacred rites therein, and let them proceed against any and all who contravene this with ecclesiastical censures as well, employing, as regards regulars, the authority of the Apostolic See delegated to them in the aforesaid decree, with any contrary custom, even immemorial, being set aside. We declare, however, that, since it is provided in the aforesaid decree that it is not lawful for bishops to erect an altar outside their own dwelling house in the houses of lay persons, and there to celebrate or cause to be celebrated the most holy sacrifice of the Mass, such prohibition is not to be understood as applying to houses, even of lay persons, in which bishops perchance are received as guests on the occasion of a visitation or journey, nor even when bishops, in cases permitted by law or by special license of the Apostolic See, absent from their own house of ordinary residence, remain for that reason in another's house in the manner of a similar residence; for in these cases the erection of an altar for the purpose of the aforesaid celebration shall be lawful for them, no differently than in their own house of ordinary residence.
46 § 25. We also command that whatever other things are prescribed in the same decree of Clement XI concerning Mass in private oratories and a portable altar be carefully observed and fulfilled.
47 All privileges contrary to what is prescribed in the same general council, session xxv, On Regulars and Nuns, are abolished: and whereas in chapter xxv all contrary privileges are most fully derogated, under whatsoever formulas of words they may be conceived, and under the name of the sea called great, even those obtained in a foundation, as well as constitutions and rules even of law, and also customs or prescriptions even immemorial; let all know that such derogation does not refer only to those things which are contained in the aforesaid chapter, but also to other things which have been established in each of the preceding chapters of the same session.
48 § 26. Furthermore, in order that right procedure be observed in judgments in criminal cases, we command that, where in criminal causes the Ordinaries of places in the kingdoms of Spain have proceeded ex officio, that is, not at the complaint or accusation of anyone, if an appeal from the sentences of the same Ordinaries has been made either to the Nuncio of the Apostolic See or to the metropolitans, then (lest otherwise, if no one acts the part of the accuser, the guilty escape the punishment due to their crimes) the fiscal procurators of the tribunal of the Apostolic Nunciature and respectively also of the metropolitan Curia shall perform and pursue the instances and other necessary acts thereupon, so that the aforesaid sentences of the Ordinaries may obtain just confirmation and execution. But if, the said fiscal procurators not being cited and heard, contrary sentences should happen to be pronounced in the grade of appeal, these shall be altogether null and void with all acts and deeds, and shall produce no effect whatsoever: nay rather, the preceding sentences of the Ordinaries shall be ordered to execution just as if an appeal had in no way been made from them. 2
49 § 27. Moreover, since it has seemed good generally concerning prohibitions in petitions and appeals and inhibitions to provide sufficiently by the constitution of Innocent, Pope IV, also our predecessor, of pious memory, in the chapter Romana, and also by the decrees of the Council of Trent, likewise also others issued on the sixteenth of October in the year sixteen hundred by the Congregation placed over the affairs and consultations of bishops and regulars and confirmed by the aforesaid Clement VIII, our predecessor, and finally also others promulgated in the time of the pontificate of Urban, Pope VIII, also our predecessor, of like blessed memory, namely on the fifth of September in the year sixteen hundred and twenty-six; we will and command that, whatever is provided in all the aforesaid constitutions and decrees, be observed most diligently by all those comprehended therein in causes pertaining to ecclesiastical courts in the kingdoms of Spain, any custom even immemorial, or any privilege or style whatsoever being entirely excluded, of granting even certain inhibitions called temporary.
50 § 28. As to the conservator judges, and the manner and faculty of proceeding in civil cases which may pertain to their cognizance, the norm prescribed in the constitutions of Innocent IV, Alexander IV, Boniface VIII, Gregory XV and other Roman Pontiffs, our predecessors, issued on this matter shall be inviolably established, as well as in the decrees of the Council of Trent, under the penalties contained therein, which we renew and confirm by the present constitution: with this also added, that the same conservator judges and the executors of their mandates ought to exhibit to the bishops and other Ordinaries of places letters of their deputation, by the force of which they intend to proceed
51 § 29. Finally, earnestly and from the innermost sense of our heart, let the decrees of the Council of Trent be inviolably observed.
INNOCENT
52 We admonish all from the most religious Spanish nation, with the sense of our eternal heart, that they be mindful that they are bound to observe exactly, firmly and with effect all and singular things sanctioned in all the other decrees of the same Council of Trent. And, lest the execution thereof be hereafter impeded or delayed in any way, we decree and declare that no privilege obtained from the Apostolic See before the promulgation of the aforesaid Council can or ought to avail for impeding or suspending the execution of the conciliar sanctions or decrees which shall have been issued by the Ordinaries for the execution likewise of those things which were established in the council itself, unless it shall also have been confirmed in specific form by the same Apostolic See after the council itself or newly granted; likewise no statute or concordat which has not been specially confirmed by the aforesaid Apostolic See can stand in the way; nor any long-standing disuse or contrary custom or prescription, even centennial or immemorial, unless perhaps the matter of the aforesaid custom or prescription be capable thereof, and moreover immemorial custom or prescription shall have already been proved and admitted by a competent judge through three conformable sentences, or through one which shall have passed into judgment, nor finally any appeal, even though temporary, saving always recourse in devolutive form to the aforesaid Congregation of cardinals, the interpreters of the same Council; to whom also, as executors 3 of the present letters of ours, we not only commit and command that they cause these same and all their decrees and ordinances to be observed perpetually and inviolably with the same power which has been granted to the same cardinals by the Apostolic See for the execution of the decrees of the aforesaid Council, but we also grant them exclusively the faculty, whenever it shall be necessary, of interpreting, duplicating and declaring the same constitution of ours, and all and singular ordinances contained therein (excepting those which pertain to the ceremonial of bishops and the Roman ritual and the rubrics of the missal and breviary), insofar as any doubt or difficulty shall emerge to them; the execution thereof not being delayed in the meantime, so that before such execution, neither any recourse to the same Congregation of cardinals, nor any consultation upon any doubt whatsoever can be promoted. But the decrees and declarations to be made by the aforesaid Congregation, after our approval or that of the Roman Pontiff existing at the time shall have been obtained, immediately all reclamation or consultation ought entirely to cease and perpetual silence thereupon to be imposed.
