BENEDICTUS XIII IT.

13 cedendae. cedantur nisi cum insertione lenoris sententiæ aut decreti, a qua vel a quo provocatum fuerit; alias inhibitiones et processus et inde secuta quaecumque sint ipso iure nulla, eisque impune liceat non parere.

29 § 21. Giuramenti qualunque, al solo effetto di agire per causa, di rilassare a chiunque;

30 § 22. Assolvere chiunque da qualunque censura e pena ecclesiastica, semplicemente o per cautela, se e dopo che avranno convenientemente, come dovranno, soddisfatto tanto alle parti quanto al giudice, rimanendo ferme tuttavia e osservandosi rispettivamente quelle cose che circa il modo e l'ordine dell'impartizione dell'assoluzione sono state prescritte sopra;

31 § 23. Assolvere parimenti chiunque, che abbia commesso il reato di omicidio e di spergiuro in qualunque modo, e che abbia partecipato alle guerre, e che abbia commesso adulterio, incesto, fornicazione e qualunque altro flagizio della carne, nonché gli usurai, fatta però la restituzione delle usure, dalle scomuniche e da altre sentenze, censure e pene ecclesiastiche e temporali, che abbiano incorso in qualunque modo, imposte a ciascuno secondo la misura della colpa una pena salutare, e le altre cose che di diritto dovranno essere imposte, anche in utroque foro;

32 db censuri^ § 24. (Dichiariamo tuttavia che né per mezzo delle apostoliche costituzioni, né in alcun altro modo, nessun giudice ecclesiastico, né alcuna altra persona ecclesiastica, di qualunque grado, dignità e preminenza sia, e benché sia legato di latere, ha potuto o può assolvere alcuno dalle censure ecclesiastiche inflitte per apostoliche costituzioni, la cui assoluzione è riservata al solo Romano Pontefice. E benché questo stesso valga anche per quel genere di assoluzione che si dice con reincidenza, e ad effetto di agire soltanto, o per cautela, e per quanto riguarda il giudizio se la dichiarativa delle predette censure sia stata valida o nulla, giusta o ingiusta (poiché tutte queste cose competono al Romano Pontefice pro tempore esistente e alla Congregazione dei Cardinali della Santa Romana Chiesa preposta all'immunità ecclesiastica e alle controversie di giurisdizione, a ciò dalla Sede Apostolica specialmente deputata, in modo esclusivo rispetto a tutti gli altri, anche legati di latere), tuttavia considerando le speciali circostanze che muovono il nostro animo, dichiariamo che il prefato giudice ecclesiastico, come da nostro carissimo in Cristo figlio Carlo VI re di Sicilia al di là del Faro, e dai suoi successori in avvenire, come sopra, deputato e delegato, osservati i diritti da osservarsi, e senza alcun abuso, possa concedere a coloro che ricorrono da gravame, che nella dichiarativa delle censure riservate alla Sede Apostolica sia stato loro inflitto, assoluzioni con reincidenza, ad effetto di agire soltanto, e anche per cautela, nonché assumere il giudizio se le predette dichiarative delle censure riservate alla Sede Apostolica, promulgate dai vescovi o arcivescovi del regno di Sicilia al di là del Faro, siano state valide o nulle, giuste o ingiuste; in modo però che, se riconosceranno che soffrono del solo vizio di nullità, ordini al vescovo o arcivescovo che rispettivamente hanno proceduto alla loro dichiarativa, che procedano da capo, riservata dopo la nuova dichiarativa l'assoluzione plenaria alla Sede Apostolica; e nella misura in cui riconosceranno che soffrono del vizio di nullità e ingiustizia o del solo vizio di ingiustizia, dichiari che i ricorrenti non hanno incorso nella censura; e se troverà che la dichiarativa è stata giusta, rimandi i ricorrenti per l'assoluzione alla medesima Sede Apostolica. Che se il prefato giudice delegato sia stato egli stesso colui che ha proceduto alle dichiarative, e il censurato pretenda di essersene gravato, o per il capo di nullità, o di nullità e ingiustizia, o del solo capo di ingiustizia; allora si osservino le cose che sopra sono state stabilite nel caso in cui alcuno si sia sentito gravato da una sentenza o da un altro qualunque decreto dello stesso giudice: e il nuovo giudice ecclesiastico sia tenuto a osservare tutte le cose che lo stesso giudice delegato, secondo le cose che ora sono state dette, sia tenuto a osservare1 nel caso di ricorso fatto a lui da una dichiarativa nulla o ingiusta delle censure riservate alla Sede Apostolica, che rispettivamente siano state promulgate dai vescovi o arcivescovi);

33 np liiieris § 25. Inoltre concediamo di spedire lettere monitorie e penali in forma significativa secondo l'uso consueto, contro i malfattori occulti e ignoti, e di sollevare i consapevoli differendo, osservata tuttavia la forma del Concilio di Trento nonché della costituzione del nostro predecessore Papa Pio V edita su queste materie. De commuiaiio- § 26. Nonché commutare qualunque voti, ulteriormente tuttavia, di visita del sepolcro della beata Vergine Maria, di san Pietro e san Paolo apostoli di terzo e quarto (tradii per l'Urbe e di san Giacomo in Compostella, e dei poveri soltanto e dei voti di carità e religione eccettuati, in speciale facoltà di opere pie da concedersi). Desiderando inoltre provvedere anche alla comodità e alla milizia della nazione Siciliana, concediamo al medesimo giudice, come sopra, nominato e delegato dal re di Sicilia al di là del Faro, facoltà speciale di concedere dispense matrimoniali in terzo e quarto grado; gratuitamente tuttavia, e senza ricevere alcun compenso o minimo emolumento, e a favore soltanto di coloro che veramente sono poveri e miseri, e vivono del lavoro delle loro mani;

34 Dell'assoluzione § 27.

CCXXXIII.

1 It is decreed what method is to be observed and what order is to be prescribed for handling and determining cases of the Patrimony. To a faithful and prudent steward, whom the Lord has placed at the summit of the apostolate over His household, it especially befits to use the power delivered to him from heaven, so that, if there be any contentions between pontifical authority and royal power, they may be removed as far as possible, and so that not only the dangers of the faithful peoples may be warded off, but also their hardships may be alleviated, as, having regard to the circumstances of places and times, shall seem more expedient in the Lord.

2 § 4. Since therefore, for the sake of blessed memory, our predecessor Clement XI, in promulgating this constitution, extinguished and suppressed the apostolic legation and monarchy of the kingdom of Sicily beyond the Strait, so called, and its tribunal, and absolved whatever privileges and indults had been granted in any manner by any of the Roman Pontiffs, his predecessors, and revoked and abrogated them, and prescribed in the meantime a certain method by which cases pertaining to the ecclesiastical forum might be heard and terminated with due finality in that kingdom, as is more fully contained in his apostolic letters issued in the years mdccxiv and mdccxv; and since our most beloved son in Christ Charles VI, elected Roman Emperor, King of Sicily beyond the Strait, has recently caused it to be represented to us that the rights of apostolic legation in that kingdom belong to him, his legitimate heir and possessor, by virtue of the privilege specifically granted by Urban II, our predecessor 1 1 This jurisdiction, granted by Urban II at the end of the eleventh century to Roger, count of the Normans, and his successors in the kingdom of Sicily, for handling and determining ecclesiastical cases, was extinguished and abolished by Clement XI, on account of abuses that had crept in, by const. of mdccxiv and mdccxv; but here it is confirmed with certain moderations.

BENEDICT XIII

3 which rights were indeed once granted to Roger, count of the Norman race, and his successors, on account of the elimination of Saracen tyranny, the Catholic faith restored, and churches, which at that time adhered to the Patriarchate of Constantinople, again subjected to the Roman See, and remained in their force and use throughout the course of the six preceding centuries, until the death of Charles II: hence we, although we have ascertained that our same predecessor was in no way satisfied by such reasons, especially on account of the abuses which were found to have crept in, and we ourselves, while holding the honour of cardinal, reverently subscribed to that constitution, and opportunely recall all the circumstances; nevertheless, since grave contentions and evils have arisen therefrom, not without harm to souls and detriment to public tranquility, we therefore, seriously trusting in how much pastoral solicitude it concerns us to avert and utterly eliminate the causes of such contentions, so that, with abuses removed from the midst, justice may be rendered equitably to all, by the will of the Congregation of our venerable brethren, the Cardinals of the Holy Roman Church, specially deputed for the examination of this matter, and also by our own motion, and from certain knowledge and mature deliberation, and from the fullness of apostolic power, imposing an end to this laborious and most grave matter, our constitution hereby perpetually valid, having the force and effect of an agreement, we decree and enact the following, and command that it be inviolably observed by those to whom it pertains and shall pertain in the future.

4 § 2. All cases, in whatever manner pertaining to the ecclesiastical forum, are to be known and decided by the Apostolic See according to canonical sanctions, except those cases which are truly greater, which are to be handled at the Apostolic See and by the Roman Pontiff, or by judges whom he himself shall specially appoint, and are not to be heard elsewhere than in the kingdom of Sicily beyond the Strait, and are to be terminated with the proper conclusion which justice demands, namely that exemplary cases in the first instance are to be heard before the Ordinaries of places only and are not to be removed from their courts except by way of legitimate appeal from a definitive sentence, or from an interlocutory sentence having the force of a definitive one, or from an act whose injury cannot be repaired by appeal from a definitive sentence, or which is prejudicial by inverting the just order of law and judgments, or unless they shall have remained undecided before the same Ordinaries for a full two years, reckoned from the day the suit was brought, just as it was decreed by the Council of Trent in cap. xx Causae omnes, session xxiv De reformatione; and if it be done otherwise, whatever appeal, inhibition, or sentence shall be by that very fact null and void, according to the prescription of the same Council; with respect, however, to those exempt from the Ordinaries, an ecclesiastical judge, nominated and delegated by the king of that kingdom, as is to be said below, and to be nominated and delegated at his pleasure for the time being, as an Ordinary, shall know of the civil and criminal cases of those, as will be said later, lest such persons and rights remain without provision. From the sentence of the Ordinary let appeal be made to the metropolitan, the form prescribed in the aforesaid decrees of the Council being observed in all respects.

5 § 3. After the metropolitan, who is judge in the cause in the second instance as to the sentences of his suffragans, or in the first instance as to the causes of his own diocese, shall have pronounced, the parties, or either of them, may appeal to a man learned or licensed in canon law, of the manner of noble universities, promoted by diligent examination, and established in ecclesiastical dignity, by our most dear son Charles VI, elected Roman Emperor and King of Sicily, and his successors in the kingdom of Sicily beyond the Strait, or by their mandate, from the concession of the Apostolic See appointed and delegated, and to be appointed and delegated in the future by him and his successors in the same kingdom or by their mandate: whom we recognize and confirm as delegated by that very fact by the authority of the Apostolic See, and to be constituted for the time being, so that he may know the ecclesiastical cases of the aforesaid appeals in the aforesaid kingdom of Sicily beyond the Strait and perform the other things expressed below, the aforesaid matters and other things to be explained below being observed, so that whatever shall have been done otherwise, whether knowingly or unknowingly, shall be by that very law null and void. § 4. If indeed the aforesaid judge of the first appeals, or in any way the parties, or either of them, shall feel themselves aggrieved by the sentence or decree of the same,

6 sentence, then, so that the remedy of appeal and of extreme provocation may be available to all the faithful of the aforesaid kingdom of Sicily and all the aids of the laws and canonical sanctions may be used and may be available, and the same remedies, the order of law being observed, as is proper, may be tried, the same most dear son in Christ, the King of Sicily, and his successors in perpetuity, or another by the mandate of him or of his successor, shall diligently provide that an open and accessible tribunal or court be maintained at all times, in which, however, a man also established in ecclesiastical dignity, and, as above, licensed or a doctor in both laws, appointed and delegated, with three other assessors versed in both laws, to be appointed and nominated in the same manner as above, shall render justice.

7 And first let him diligently consider whether the appeal ought to be rejected or admitted, and with what clauses the case is to be committed. Whenever indeed the case shall have been seen worthy of further examination, let the same judge, by whom it was decreed worthy of further examination, first know and judge it in the same manner, with the counsel of the same assessors being employed. If after these things the matter should require further discussion, and the suit be not finished, let the same be discussed before another suitable ecclesiastical judge, as above, with assessors or counselors to be appointed; and so thereafter: provided always that the case in any instance be always handled before an ecclesiastical judge, and, in all respects the order of law being observed, be terminated.

8 § 5. Appellants in one case shall remain subject to the jurisdiction of their Ordinaries in all other cases, if they should wish to appeal, and they can be exempted neither by the metropolitan nor by a delegated judge, except in cases prescribed by canon law.

9 § 6. In cases in which conservators of the regular clergy shall have rendered a decree or sentence, whoever considers himself aggrieved by them shall likewise be able to have recourse to the aforesaid delegated judge; who indeed, if, having examined the rights of both parties, he shall deem the appeal to be admissible, shall himself proceed in the cognition of such a case, as shall be according to law: and if the parties, or one of them, should complain of a grievance inflicted upon them by his judgment, that shall be observed which above has been established concerning appeals from a decree or sentence of a delegated judge. Moreover, the aforesaid conservators ought inviolably to observe the prescriptions in the constitutions of the happy memory of Pope Innocent IV, Alexander IV, Boniface VIII, Gregory XV, and our other predecessors, as well as in the decrees of the Council of Trent, under the penalties contained therein.

10 § 7. Appeals shall never be received and admitted unless, by public documents to be actually exhibited, it shall first be established that the appeal from a definitive sentence or one having the force of a definitive sentence, or from a grievance which cannot be repaired by a definitive sentence, or which is prejudicial in cases not prohibited by law, has been interposed or prosecuted by a legitimate person and within the prescribed times; nor, except in cases permitted by law, while the case is pending before inferior judges, before a definitive sentence or one having the force of a definitive sentence, can superiors take cognizance of a grievance which is asserted to have been inflicted, although they declare that they do this without prejudice to the ordinary course of the case; nor is it lawful for them for this purpose to inhibit, or even simply to order that a copy of the process be sent to them, even at the expense of the appellant or recurrent, except in cases permitted by law.

11 § 8. Inhibitions, after appeals have been admitted as is premised, shall not be granted except with the insertion of the tenor of the sentence or decree from which or from whom appeal was made; otherwise inhibitions and process and whatever shall follow therefrom are by that very fact null, and it shall be lawful to disregard them with impunity. But if the appellant asserts that he cannot obtain an authentic copy of the sentence or decree, or of the appeal interposed, through the fault of the judge from whom, or of the notary; then, whether the metropolitan, or the aforesaid delegated ecclesiastical judge, respectively, shall enjoin those to whom it pertains, that, their fee being paid, a copy in probative form be delivered to the appellant within a brief period: and meanwhile nothing new shall be attempted before the judge from whom against the appellant.

12 § 9. From decrees of Ordinaries, issued in visitation or for the correction of morals, there shall be no place for appeal as to suspensive effect, except when the visitor, the party having been cited, and the cognition of the case having been employed, shall have proceeded judicially, and in other cases permitted by law.

13 to be yielded. They shall not be yielded unless with the insertion of the tenor of the sentence or decree from which or by whom the appeal was made; otherwise any inhibitions and proceedings and whatever has followed therefrom shall be null by the law itself, and it shall be lawful to disobey them with impunity. But if the appellant asserts that he cannot obtain an authentic copy of the sentence or decree or of the interposed appeal through the fault of the judge from whom, or of the notary; then, whether the metropolitan or the aforesaid delegated ecclesiastical judge, respectively, shall enjoin those to whom it pertains that, the customary fee being paid, a copy in probative form be delivered to the appellant within a brief period: and meanwhile nothing new shall be attempted before the judge from whom against the appellant.

14 § 11. In a case of unlawful imprisonment, inasmuch as it shall have occurred with the verbal mandate of a judge, the judge of appeal can issue inhibitions by virtue of the appeal, it being established either by the deposition of two witnesses concerning the mandate, or by a document of a notary or keeper of prisons concerning the imprisonment. But in cases of alleged unjust imprisonment, or torture, or excommunication, general and indefinite inhibitions shall not be issued, but only compulsory ones for the transmission of a copy of the acts for the purpose of ascertaining whether the appeal ought to be deferred or not, with an inhibition adjoined in the said compulsory letters that meanwhile the judge from whom shall not proceed to further matters; and inasmuch as, the acts having been examined, an evident grievance shall result, then let the appeal be admitted with inhibition, and let the case be cognized before the judge to whom. But if such a grievance be not established, let the case be remitted to the judge from whom to be cognized in the first instance.

15 § 12. The notary or notary of the first instance shall in no way be compelled to send the original acts to the judge of appeal, unless the nature of the case itself demands it, or some probable suspicion of falsity should arise, which shall have been judicially raised by those having an interest: and then, after the termination of the case, let them immediately be remitted to the Ordinary, and be preserved in the archive of his curia.

16 § 11. In a case of unlawful imprisonment, concerning inhibitions, insofar as it shall have been followed with the mandate of the judge given verbally, the judge of appeal may expedite inhibitions by virtue of the appeal, established either by the deposition of two witnesses concerning the mandate, or by a document of a notary or of the keeper of prisons concerning the imprisonment. But in cases of complained unjust imprisonment, or torture, or excommunication, let general and indefinite inhibitions not be expedited, but only compulsory letters for the transmission of a copy of the acts for the purpose of ascertaining whether or not the appeal ought to be admitted, with an inhibition adjoined in the said compulsory letters that meanwhile the judge from whom [the appeal is taken] shall not proceed to further matters2; and insofar as, the acts having been examined, evident injury shall result, then let the appeal be admitted with an inhibition, and let the cause be heard before the judge to whom [it is appealed]. But if such injury shall not be established, let the cause be remitted to the judge from whom it is to be heard in the first instance.

17 § 12. The notary or clerk is not at all compelled to send the original documents of the first instance to the judge of appeal, unless the nature of the case itself demands it, or some probable suspicion of falsity should arise, which shall have been judicially alleged by those having an interest therein: and then, after the termination of the case, they shall immediately be returned to the Ordinary, and be preserved in the archive of his curia.

18 § 13. While an appeal is pending, the appellant shall remain in the same prison where he is found, until the judge to whom the cognition of the case is to be transferred, having examined the acts and having heard the case, shall decree otherwise: and then indeed, if an appeal shall have been made from the decree of the second judge having the force of a definitive sentence, he himself can in the meantime neither command anything nor attempt anything for the execution of his decree, until the superior judge shall have ordained otherwise; excepted however those cases in which the law has otherwise provided, and those in which an appeal against the decree of release produces only a devolutive effect, in favor of liberty. § 14. Ecclesiastical censure pronounced in an appeal shall be revoked or declared null.

19 clearly through a judge of appeals, even if he be a delegate, cannot [do so], unless first the parties have been heard and the case examined; and then, if it shall be established that it was just, the appellant shall be remitted to the judge who pronounced the excommunication, and from him according to the sacred canons the benefit of absolution, if he shall have humbly requested it and shall have rendered due amendment, he shall obtain; but if it shall appear to have been unjust, the judge of appeals shall grant absolution; and if it be doubted whether it was just or unjust, although it be more fitting that to the one who pronounced the excommunication1 within some brief competent period, to be fixed for the same, the one to be absolved be remitted, the judge—

20 § 15. Absolution ad cautelam, only when the things required by law have been observed, with doubt concerning the nullity of the excommunication either pronounced by man or inflicted by law, if a doubt of fact or a probable doubt of law should occur, shall be granted as for a brief time, with the condition of reincidence, and with a pledge given by the excommunicated person to stand to the law and to obey the mandates of the Church. But if, according to the form prescribed by law, it shall appear that someone was excommunicated on account of a manifest offense, he shall also be bound to render due satisfaction, and on account of manifest contumacy, to satisfy also the expenses, and to pledge himself to stand to judgment before the one who pronounced the excommunication, before he obtains the aforesaid absolution. Furthermore, such absolutions with the condition of reincidence are committed by the judge of appeal, even if he be the aforesaid judge, to the Ordinaries themselves who pronounced the excommunication, with the clause that they absolve the excommunicated within three days, provided however that the excommunicated are in the same place where the Ordinaries dwell. But if they are not in the same place, or if the Ordinaries, being present and requested, shall refuse or neglect to absolve, let them be absolved by a confessor according to the form of the same commission to be issued by the judge of appeal, as aforesaid. Moreover, the aforesaid commissions for absolving ought to be presented not to the Ordinaries themselves directly and personally, but to their chancellors, so that the reverence due to bishops may be preserved intact, and from the presentation made by the chancellor the aforesaid three days ought to be reckoned. But the notices, in the case of obtaining absolution for a certain time with the condition of reincidence, insofar as they have been affixed, shall not be removed; but only covered, and shall remain covered during the period fixed in the absolution; saving however the practice observed there concerning their removal in certain cases.

21 § 15. Absolution under seal shall be granted only when the prescriptions of law are observed, with doubt concerning the nullity of an excommunication either pronounced by man or inflicted by law, if a doubt of fact or a probable doubt of law should arise, as granted for a brief time, with the condition of relapse, and provided that the excommunicated person has given security for standing to law and obeying the mandates of the Church. But if, according to the form prescribed by law, it shall appear that someone was excommunicated on account of a manifest offense, he shall also be bound to render due satisfaction, and on account of manifest contumacy, to make satisfaction also for expenses, and to give security for standing to judgment before the excommunicator, before he obtains the aforesaid absolution. Furthermore, such absolutions with the condition of relapse are committed by the judge of appeal, even if he be the aforesaid judge, to the Ordinaries who excommunicated, with the clause that they absolve the censured within three days, provided however that the excommunicated are in the same place where the Ordinaries dwell. But if they are not in the same place, or if the Ordinaries, being present and requested, shall refuse or neglect to absolve, let them be absolved by a confessor according to the form of the same commission to be expedited by the judge of appeal, as aforesaid. Moreover, the aforesaid commissions for absolving ought to be presented not to the Ordinaries immediately and personally, but to their chancellors, so that the reverence due to bishops may be preserved intact, and from the presentation made by the chancellor the aforesaid three days ought to be reckoned. But cedulas, in the case of absolution being obtained for a certain time with the condition of relapse, insofar as they have been affixed, shall not be removed; but only covered, and shall remain covered during the term fixed in the absolution; saving however the practice observed there concerning their removal in certain cases.

22 Concerning appeals in criminal cases and sentences of the Ordinaries § 17. Where in criminal cases the proceedings of the Ordinaries of places have proceeded ex officio, if an appeal from their sentences shall have been made either to the metropolitan or to the aforesaid judge, then the fiscal procurators of the metropolitan curia or of the tribunal of the aforesaid delegate shall act in the place of the prosecutor, and shall perform and pursue the necessary instances and other acts concerning this, so that they may obtain the confirmation and execution of the sentences of the aforesaid Ordinaries, if it shall thus be consonant with justice. But if, the said fiscal procurators not being cited or heard, contrary sentences should happen to be pronounced in the grade of appeal, these shall be entirely null and void with all the acts performed; nay rather the preceding sentences of the Ordinaries shall be committed to execution, just as if the appeal made by them had in no way been made.

23 Concerning poor litigants § 18. To poor litigants shall be remitted the fees and emoluments of any kind even otherwise due to the chancellor: likewise all other expeditions whatsoever shall be given gratis, and also copies of public instruments or wills, as well as registers and copies of acts to be transmitted to the judge of appeal: and this in both civil and criminal cases. But as to the proof of poverty, let it be done summarily by witnesses, likewise to be examined gratis, and as to the poverty itself let the judgment of the judge be followed.

24 § 17. Where in criminal cases the Ordinaries of places have proceeded ex officio, if an appeal from their sentences has been lodged either to the metropolitan or to the aforesaid judge, then the fiscal procurators of the metropolitan curia or of the tribunal of the aforesaid delegate shall act in the place of the prosecutor, and shall perform and pursue the necessary instances and other acts concerning this matter, so that they may obtain confirmation and execution of the aforesaid sentences of the Ordinaries, if thus it shall be consonant with justice. But if, with the said fiscal procurators not cited or heard, contrary sentences should happen to be pronounced in the grade of appeal, these shall be altogether null and void with all acts performed; moreover the preceding sentences of the Ordinaries shall be committed to execution, just as if an appeal had in no way been lodged by them.

25 On the poor § 18. To the poor litigating and co-litigating . . .

26 there shall be furnished free of charge all fees and emoluments whatsoever, even those otherwise due to the chancellor: likewise all other expeditions whatsoever shall be given gratis, and also copies of public instruments or wills, as well as registers and copies of acts to be transmitted to the judge of appeal: and this in both civil and criminal cases. But as to the proof of poverty, let it be done summarily by witnesses, to be examined likewise free of charge, and as regards the poverty itself, let recourse be had to the discretion of the judge.

27 § 19. In criminal cases, the regulation of the Council of Trent and the particular constitutions of whichever Order the delinquent has professed shall be exactly observed, when he shall have offended within the cloister. But if they offend outside the cloister, or if they dwell outside the monastery, they shall be judged and punished by the bishops, according to the prescription of the same Council of Trent and apostolic constitutions. Those who believe themselves aggrieved by the bishop's judgment may have recourse to the aforesaid judge, who, when an appeal shall be admissible by law, shall undertake a revision of the case. But if anyone believes himself aggrieved by the sentence or decree of this judge as well, those things shall be observed which were set forth above for those appealing from the decree of a delegated judge. If, however, prelates or other superiors in the kingdom of Sicily beyond the Strait, having no example of others, shall offend, the aforesaid ecclesiastical judge, as ordinary with respect to the exempt, shall proceed against them as the law shall require, the rule concerning the manner prescribed always being observed.

28 § 20. But lest any dispute concerning the faculties of the aforesaid ecclesiastical judge should arise before it comes to pass, we declare firmly: that he, named and delegated by the king of Sicily beyond the Strait by the authority of the Apostolic See, may and ought to exercise full and free license and power of restoring to their former state whatever persons, against sentences, adjudicated matters, and whatever contracts, as the law shall require, in their entirety;

29 § 21. All oaths whatsoever, for the purpose of acting solely on account of a cause, to be relaxed for any persons;

30 § 22. To absolve whomsoever from any censures and ecclesiastical penalties, simply or as a precaution, if and after they shall have made fitting satisfaction, as they ought, both to the parties and to the judge, the things which were prescribed above concerning the manner and order of imparting absolution being nevertheless firm and observed respectively;

31 § 23. To absolve likewise whomsoever, who have incurred the guilt of homicide, as well as perjury in whatever manner, and who have taken part in wars, and who have perpetrated adultery, incest, fornication, and any other whatsoever depravity of the flesh, as well as usurers, restitution of usuries having been made, from excommunications and other sentences, censures and ecclesiastical and temporal penalties, which they have incurred in any manner whatsoever, a salutary penalty being enjoined upon each according to the measure of his guilt, and other things which shall be enjoined by law, even in both forums;

32 of censure. § 24. (We declare, however, that neither through apostolic constitutions nor through any other ecclesiastical person, of whatever grade, dignity and pre-eminence he may be, and although he be a legate a latere, has anyone been able or is able to absolve from ecclesiastical censures inflicted by apostolic constitutions, the absolution of which is reserved to the Roman Pontiff alone. And although this same thing proceeds also with regard to that kind of absolution which is said to be with reincidence, and for the effect of acting only, or for caution, and with regard to the knowledge whether the aforesaid declaration of censures was valid or null, just or unjust (since these also all pertain to the Roman Pontiff existing at the time and to the Congregation of the Cardinals of the Holy Roman Church entrusted with ecclesiastical immunity and jurisdictional controversies, specially deputed for this by the Apostolic See, exclusively as regards all others even legates a latere), nevertheless, having regard to special circumstances moving our mind, we declare that the aforesaid ecclesiastical judge, as one deputed and delegated by our most beloved son in Christ Charles VI, King of Sicily beyond the Strait, and his successors hereafter, as above, observing what ought to be observed by law, and without any abuse, may grant to those appealing from a grievance, which they shall have shown to have been inflicted upon them in the declaration of censures reserved to the Apostolic See, absolutions with reincidence, for the effect of acting only, and also for caution, as well as assume knowledge whether the aforesaid declarations of censures reserved to the Apostolic See, promulgated by the bishops or archbishops of the kingdom of Sicily beyond the Strait, were valid or null, just or unjust; provided, however, that if they shall have found them to labour under the sole defect of nullity, he shall command the bishop or archbishop who respectively proceeded to their declaration, that they proceed anew, the full absolution after the new declaration being reserved to the Apostolic See; and insofar as he shall have found them to labour under the defect of nullity and injustice or of injustice alone, he shall declare the appellants not to have incurred it; and if he shall have found the declaration to be just, he shall remit the appellants for absolution to the same Apostolic See. But if the aforesaid delegated judge himself was the one who proceeded to the declarations, and the censured person shall have claimed to be aggrieved, either on the ground of nullity, or of nullity and injustice, or of injustice alone; then those things shall be observed which were established above in the case where someone shall have felt himself aggrieved from a sentence or from any other decree of the same judge: and a new ecclesiastical judge shall be bound to observe all those things which the delegated judge himself, according to what has just been said, shall be bound to observe1 in the case of an appeal made to him from a null or unjust declaration of censures reserved to the Apostolic See, which shall have been respectively promulgated by bishops or archbishops);

33 of letters. § 25. Furthermore, we grant the power to issue whatsoever monitory and penal letters in the customary form of significance against hidden and unknown malefactors, relieving the conscious, deferring, yet observing the form of the Council of Trent as well as the constitution of Pius, our predecessor, issued on these matters. Concerning the commutation of vows. § 26. Likewise, we grant in special faculty to commute whatsoever vows, beyond the sea, of visitation to the shrine of the blessed Apostles Peter and Paul of the third and fourth degree (saving for the City and St. James in Compostella, and except for vows of poverty alone and of the grace of chastity and religion, into works of piety), and wishing also to provide for the convenience and military strength of the Sicilian nation, we grant to the same judge, as above, named and delegated by the King of Sicily beyond the Strait, special faculty to grant matrimonial dispensations in the third and fourth degree; freely, however, and with no fee received or even the smallest emolument, and in favour of those only who are truly poor and miserable, and live by the labour of their own hands;

34 Concerning Absolution § 27. And, so that concessions, favours and grants to bishops made through the aforesaid judge, as has been stated above, may be granted with obstacles removed and may obtain their full effect, We absolve any and all persons whatsoever, for the purpose solely of obtaining all and singular of the aforesaid matters, from all and any excommunications, suspensions and interdicts, and other ecclesiastical censures by which they may have been bound, and pronouncing them absolved; § 28. For greater caution, however, We declare and decree the following, which are set forth below: namely, that the aforesaid judge can neither be able nor ought to involve himself in cases in which the execution of apostolic letters is at issue, even concerning the conferral of any secular or regular benefices whatsoever, for whose execution certain executors have been appointed, from whose decree or execution, if complaint has been made in any way, and the said grievance or excess has been mentioned, then the same judge in these cases in all respects and throughout, as has been said and declared above concerning other matters, shall proceed:

35 § 29. He shall also not be able to appoint sub-delegates or delegates residing in the dioceses of the aforesaid kingdom, and much less to grant them exemption from the jurisdiction of their Ordinaries, except for one, who nevertheless shall be ecclesiastical, in any of the bishops' residences, and in the principal other cities of the kingdom, such as Drepana, Thermae, Milazzo, and Augusta, commonly called Trapani, Termini, Melazzo and Augusta:

36 § 30. Furthermore, letters patent of exemption from the jurisdiction of one's Ordinary on the grounds of serving the court or tribunal of the same delegated judge cannot be granted to anyone, except only to the necessary ministers and officials, who nevertheless in the whole kingdom shall not be more than fifty, apart from those who serve in the principal ecclesiastical courts of first, second and third instance in Palermo:

37 § 31. In no way whatsoever shall the same judge involve himself, either in first instance or in the grade of appeal or recourse or by way of provision, in anything whatsoever concerning the discipline and observance of regular persons of either sex, the distribution of offices, the placement of regulars in one or another monastery or convent, ordinances concerning the choir and the parlour of nuns and their enclosure, the designation of cells and other similar matters; but in all these things let those to whom it pertains according to the sacred canons, the statutes of the individual Orders, and apostolic constitutions proceed:

38 Concerning Presidents § 32. Let him likewise take care not to appoint presidents of chapters and

39 superiors or abbesses, vicars or vicairesses, or any officials whatsoever in monasteries or regular houses of either sex from any title or pretext, whether on account of inconveniences, dissensions, or discrepancy of votes, even by way of provisional acts; but let the elections and appointments of all prelates and offices remain entirely free, according to the prescription of the sacred canons and the statutes of the regular Orders themselves:

40 § 33. Likewise, he cannot, even by way of provision, appoint masters of studies, rectors of studies, nor confirm in the possession of offices or duties those who, when the time prescribed by the constitutions of their Orders has ended, ought to lay them down, or who have been removed by legitimate superiors: in cases, however, truly contentious between regulars, and in which there can be a place for appeal by law, when the course of judgment in each regular Order prescribed by its constitutions has been completed, if those who have lost wish to pursue the matter, then the cases shall be devolved to the aforesaid ecclesiastical judge, who shall be bound to proceed, observing in all respects and throughout those things which have been established above regarding other cases: provided, however, that in cases of nullity of profession, both before and after the lapse of five years, he shall in no way interpose himself; but those shall be known and determined entirely according to the norm of the sacred canons and the sacred Council of Trent, session xxv, On Regulars, chapter xxix: § 34. Moreover, the delegate shall not hinder the jurisdiction granted by the sacred Council of Trent to bishops, delegated by the Apostolic See, in exempt secular clerics; the same ecclesiastical judge has, however, the faculty of proceeding even in first instance in the cases, both civil and criminal, of the same exempt secular clerics, and of knowing and judging the same, the order of law being observed; and in case of appeal from the decrees or sentences of the same delegated judge, in all respects those things which have been established above concerning this matter shall be observed.

41 § 35. Concerning the more serious cases of bishops and archbishops, let the disposition of the sacred constitutions and of the sacred Council of Trent, session xxiv, chapter v, On Reform, be observed entirely. In other minor and civil cases, however, in which bishops or archbishops of the kingdom of Sicily beyond the Strait are not plaintiffs but defendants, the delegate has the right to judge even in the first instance, if the case concerns an archbishop or bishop exempt from metropolitan jurisdiction (and especially concerning all cases of the payment of pensions), and in the second instance only, if the case concerns a bishop subject to metropolitan law; for then in the first instance the case shall be judged by the archbishop: but in the case of an appeal from the judgment of the delegate, all things deposited in the foregoing shall be observed.

42 § 36. Finally, so that we and our successors, the Roman Pontiffs, may diligently care for the Church given to us by apostolic authority.

43 shall ensure that the things disposed and established above are observed with exactness, which we have established and decreed to have force and effect of agreement, and that nothing be done by our ministers under any pretext or colour which could delay or impede their observance and execution; thus the said ecclesiastical judge shall assume no authority for himself, even by way of provision, or under any other pretext whatsoever, against the ordinances and mandates which shall have been signed and subscribed by our own hand or by our successors for the time being by special rescript, nor shall he dare to impede or delay their execution, insofar as it lies with him; but to these due reverence, observance and execution shall be rendered entirely.

44 § 37. Decreeing that all and singular things expressed above can never be impugned by any patriarch, archbishop, bishop, or others shining with other authority, dignity and pre-eminence, and that the present letters shall always and perpetually be valid and effective and shall obtain and secure their full and complete effects, and that they are to be firmly and inviolably observed by all and singular to whom it pertains or shall pertain, and that at no time they can be noted, retracted, invalidated, or called into question or controversy, and that these same letters are in no way comprehended under any revocations, suspensions, limitations, or other contrary dispositions, even made and to be made by us and our successors, the Roman Pontiffs, granted and to be granted; but we have established that these letters, as issued by us for the tranquility and peace of the churches of Sicily, are always to be entirely excepted, and whatever otherwise concerning these, as aforesaid approved by us, shall be attempted by anyone, by whatever authority, knowingly or unknowingly, we decree to be null and void. Notwithstanding customs, privileges and indults, howsoever otherwise granted concerning the foregoing.

45 § 38. Let no one whatsoever dare to infringe this page of our constitution, agreement and will, or presume to act against it with rash boldness. If anyone, however, shall presume to attempt this, let him know that he shall incur the indignation of almighty God and of the blessed Peter and Paul, his apostles.
