Sancta Dei Ecclesia
Motu proprio on the jurisdiction of the Sacred Congregation for the Oriental Church
LETTERS GIVEN MOTU PROPRIO CONCERNING THE JURISDICTION OF THE SACRED CONGREGATION FOR THE ORIENTAL CHURCH PIUS PP. XI
1 The Holy Church of God, although from the first century of the Christian name it has been formed from the faithful of both East and West, is nevertheless entirely one; and therefore the Roman Pontiffs, as successors of the Blessed Peter, Prince of the Apostles, to whom Christ the Lord entrusted the authority of feeding the entire flock, have at all times exercised the greatest care over the Oriental Christians as well, so that they might retain both the integral faith and firm discipline and flourishing piety and divine worship; and thus might daily attain greater prosperity and extent. And if in the course of time heresies, schisms, and most frequent and prolonged incursions and dominions of infidels have so harassed the peoples of the Oriental Church and almost utterly laid them low, that it is permissible to marvel that the customs of Christian life, although sometimes brought to the extreme, have nevertheless survived; and likewise if some, impelled by excessive love of unity and concord, not sufficiently knowing the affairs and nature of the Orientals, have attempted either to corrupt their sacred rites or to reduce them to Latin rites, yet the Roman Pontiffs, Our predecessors, have resisted these attempts to the best of their ability, sparing no labors. It was their care to check the audacity of heretics and schismatics, to aid with all strength the strenuous athletes of faith and unity, to confirm the uncertain and wavering minds, and to continually recall the separated brethren and sons through their own voice and through their legates and missionaries to the one flock of Jesus Christ. And in like manner they have left nothing undone to restrain and repel with all their strength those destructive floods which the negligence and discord of princes might spread far and wide. But when the Supreme Pontiffs were informed that some were striving either to turn the Orientals away from their rites or to change something peculiar in them, they disapproved of these inopportune attempts, and wished to preserve the integrity of those same rites intact and unharmed. For it is the mind of the Roman Pontiffs that the liturgical variety of things, which has been introduced from the peculiar genius and nature of peoples, not only does not conflict with the unity of holy faith and divine worship, but rather adorns it with commendation and praise; since from this source it is easily gathered that one and the same Catholic religion responds most excellently to the nature and customs of all peoples, however diverse, and produces fruits most abundant and distinguished by varied beauty. To this is added that the individual books of each liturgy, by reason of their integrity from the most ancient times, bear witness invincibly and clearly to the ancestral faith, by which the ancient Christianities embraced and religiously venerated the mysteries and sacraments, which are today hostilely assailed in a peculiar manner by the Innovators.
2 Such was the care of these Supreme Pontiffs in this order of affairs, even before the Holy Council of Trent. But afterwards, to conduct affairs more aptly and easily, they instituted appropriate Congregations; and so Our predecessor of happy memory Gregory XIII, in the second year of his Pontificate, with the intention indeed of preserving the Oriental rites intact or, according to the circumstances of affairs, restoring them to their former dignity, and likewise of deliberately increasing the number of Christians who profess these same rites, established a special Congregation concerning the affairs of the Greeks, which Clement VIII transferred into a Congregation over the affairs of Faith and Catholic Religion, entrusting to it not only the care of the Oriental Church, but also the duty of propagating the faith both among the peoples of the West who had declined to the errors of the Innovators and also in those regions which had been most recently explored. And so, although it was a matter of a special Congregation, which was afterwards rightly and deservedly called the Congregation of Propaganda Fide, it nevertheless already had committed to it the same duty which Gregory XV entrusted to the General Congregation established by him under this same title, that is, "presiding over all missions for preaching and teaching the Gospel and Catholic doctrine"; and thus into the new Congregation, established by the same Gregory XV, there flowed together [these responsibilities].
3 This Sacred Congregation was from that time forth one and the only Pontifical Office for promoting Missions everywhere. Nevertheless, having regard to the peculiar juridical condition of Oriental Catholics, who were under the dominion of the Turks; and likewise having weighed no small diversity in their own liturgy and discipline, it was soon found necessary, namely to entrust to special Congregations, which had been formed within the bosom of the General Congregation of Propaganda Fide, the dispatch of weightier matters pertaining to those peoples. For this reason Urban VIII instituted a Congregation concerning the doubts of Orientals, and another concerning the correction of the Greek Euchologion; and the Pontiffs used these same methods of proceeding down to Our predecessor of happy memory Pius IX, except however Clement XI, who, when he wished to complete the emendation of the Euchologion and to review all other Oriental liturgical books, established a Congregation "concerning the correction of the books of the Oriental Church," as a permanent Congregation, distinct from the Sacred Council of Propaganda Fide. Now Our predecessor, whom We mentioned above, Pius IX, moved by this design, that matters of this kind, by long use of things and experience, might be arranged in a firmer and more suitable manner, established a new Congregation distinct from the S. C. of Propaganda Fide. To this new Sacred Council, to which the title S. C. of Propaganda Fide for the Affairs of Oriental Rite was given, it pertained to handle "all Oriental affairs, even if mixed, which namely either by reason of the matter or of persons might affect Latins." This Congregation indeed, although it enjoyed its own Secretary and its own Secretarial office, was nevertheless subject to the same Prefect as the S. Congregation of Propaganda Fide, whose duty it therefore was to arrange and organize the work of both Congregations, when matters pertained to the same region. Since however it was subject to the S. Congregation of Propaganda Fide and retained its title, it seemed to some, although not correctly, as if it were a kind of supplement to that Congregation; and thus Oriental Catholics seemed to be subject to Latins and as if equated with the infidels and heretics of the West.
4 For this reason Our predecessor of pious memory Benedict XV, when he desired that even the appearance of this insulting suspicion should vanish, by Apostolic Letters Dei Providentis given as a Motu Proprio on the 1st day of the month of May, in the year 1917, instituted a Sacred Congregation For the Oriental Church, entirely separate from the S. C. of Propaganda Fide. To this new Congregation, in order to testify his peculiar benevolence and care toward Oriental Christendoms, he wished the Roman Pontiff himself to preside, and to it he attributed all the faculties "which other Congregations for Churches of the Latin rite possess, saving however the right of the Congregation of the Holy Office." Nevertheless he concluded and restricted the attributed faculties "to affairs which pertain either to persons, or to discipline, or to the rites of Oriental Churches, even if mixed, which namely either by reason of the matter or of persons might also affect Latins, so that Latins who dwell in the regions of Christian Orient should still be subject to the Sacred Congregation of Propaganda Fide."
5 With this twofold jurisdiction thus established, it was altogether most difficult to achieve valid unity of government and expeditious administration of affairs, which are altogether required, both that diversities and dissensions which easily arise among the faithful of dissimilar rites and dissimilar discipline might be quickly resolved, and that the works of apostolate and charity, which pertain especially to Catholic Action, might be more effectively ordered and promoted, and that finally all the forces of Catholics might come together and coalesce into one, as the circumstances of present affairs undoubtedly demand, not to say require.
6 We therefore, since We earnestly desire that those signal benefits which perfect unity and a peculiar manner of government naturally bring forth may be safely preserved for the most beloved Churches of the Orient to the extent of Our ability, after having long and carefully considered the matter with Ourselves, and having offered Our suppliant prayers to God, by Motu Proprio, with certain knowledge, and from the fullness of apostolic power, decree and establish all the things which follow:
7 I. - The Sacred Congregation for the Oriental Church, over which the Roman Pontiff himself presides, has full and exclusive jurisdiction in the regions which follow: in Egypt and in the Sinai peninsula, in Eritrea and in the northern part of Ethiopia, in southern Albania, Bulgaria, Cyprus, Greece, the Dodecanese, Iran, Iraq, Lebanon, Palestine, Syria, Transjordan, Asiatic Turkey and in Thrace subject to Turkish dominion.
8 II. - Wherefore in the aforesaid regions not only for the faithful of the Eastern rite, but also for the faithful of the Latin rite and their hierarchy, works, institutions, pious societies, the same Sacred Congregation possesses all faculties which other Congregations possess for the faithful of the Latin rite outside those territories, saving however the right of the Congregation of the Holy Office, and with those matters remaining intact which have hitherto been reserved to the Sacred Congregation for the Discipline of the Sacraments, the Sacred Congregation of Sacred Rites, the Sacred Congregation for Seminaries and Universities of Studies, and the Sacred Penitentiary.
9 III. - As regards the faithful of the Eastern rite dwelling outside the aforesaid regions, the competence of the Sacred Congregation for the Oriental Church of the Apostolic See remains firm in all respects. Wherefore to it are reserved all matters of every kind which pertain either to persons, or to discipline, or to the Eastern rite, even if they be mixed, that is to say which by reason either of the matter or of the persons also touch upon Latins; and to it for these faithful are attributed all faculties which pertain to other Congregations for the faithful of the Latin rite, saving always the right of the Congregation of the Holy Office and with those matters remaining intact which have hitherto been reserved to the Sacred Congregation for Seminaries and Universities of Studies and the Sacred Penitentiary. IV. - This Sacred Congregation settles controversies by the disciplinary way; those which it shall judge ought to be settled by judicial order, it shall remit to the tribunal which the Congregation itself shall designate.
10 V. - The regions of Christian Orient which we have mentioned above shall gradually come under the exclusive jurisdiction of the Sacred Congregation for the Oriental Church, namely at the times which we designate severally below: a) on the first day of the month of June, in the year 1938, Palestine, Transjordan, Egypt, the Sinai Peninsula and Cyprus shall pass under the exclusive jurisdiction of this Sacred Congregation; b) on the first day of the month of January, in the year 1939, Greece, the Dodecanese, southern Albania, Bulgaria, the Asiatic Turkish republic and Thrace subject to Turkish rule;
11 c) on the first day of the month of June, in the year 1939, Syria, Lebanon, Iraq and Iran.
12 VI. - From the day on which these present Apostolic Letters given Motu Proprio are promulgated, until the day on which the individual regions shall come under the exclusive jurisdiction of the Sacred Congregation for the Oriental Church, no work and no institution can be established, nor can any change be made in the condition of things, unless the consent of the Sacred Congregation for the Oriental Church shall have first been obtained.
13 VII. - When the regions of Christian Orient shall have come under the exclusive jurisdiction of the Sacred Congregation for the Oriental Church, the documents which pertain to those same regions and which are preserved in the Archives of the Sacred Congregation for the Propagation of the Faith shall be handed over and delivered to the Archives of the Sacred Congregation for the Oriental Church, as the matter can be done, and by the mutual consent of the moderators of each Office. VIII. - The Sacred Congregation for the Propagation of the Faith shall transmit to the same Sacred Congregation all sums of money which are destined for the works and institutions of those regions which are assigned to the exclusive jurisdiction of the Sacred Congregation for the Oriental Church. If such distinct sums of money do not exist, the Sacred Congregation for the Propagation of the Faith shall establish from its own treasury only such income as shall equal the entire sum of subsidies, both ordinary and extraordinary, which the same Sacred Congregation was accustomed to send yearly to these regions for the works and institutions of each. Extraordinary subsidies, however, shall be designated from the average amount of money which in the preceding three-year period, that is in the years 1935-1936-1937, was sent yearly to these same regions. IX. - The Pontifical Work for the Propagation of the Faith shall render yearly to the Sacred Congregation for the Oriental Church that sum which shall maintain an unchanged comparison and proportion between the entire sum of subsidies, both ordinary and extraordinary, which in the last three-year period, as we have said above, were expended for the cause of Orientals and Latins for the same regions, and the sum of income and revenues which the aforesaid Pontifical Work accumulated in that same three-year period. X. - The Pontifical Work of St. Peter the Apostle for the Indigenous Clergy shall transmit yearly to the Sacred Congregation for the Oriental Church that sum which shall equal two hundredths of all the income and revenues of the same Pontifical Work.
14 XI. - The Substitute of the Sacred Congregation for the Oriental Church by right participates in the General Superior Council of the Pontifical Works for the Propagation of the Faith and of St. Peter the Apostle for the Indigenous Clergy. Those things, however, which have been established by Us here, We will and command to be firm and valid in perpetuity, notwithstanding anything to the contrary, even those matters worthy of most particular mention.
15 Given at Rome, at St. Peter's, on the twenty-fifth day of the month of March, on the feast of the Annunciation of the Blessed Virgin Mary, in the year 1938, in the seventeenth year of Our Pontificate.

LITTERAE MOTU PROPRIO DATAE DE IURISDICTIONE SACRAE CONGREGATIONIS PRO ECCLESIA ORIENTALI PIUS PP. XI
Novo huic Sacro Consilio cui titulus inditus fuit $.
4 Quamobrem decessor Noster p. r.
8 II.
IV. - Haec Sacra Congregatio controversias dirimit via disciplinari; quas vero ordine iudiciario dirimendas iudicaverit, ad tribunal remittet quod ipsa Congregatio designaverit.
10 V. - Christiani Orientis regiones, quas supra memoravimus, in exclusivam S. Congregationis pro Ecclesia Orientali iurisdictionem gradatim devenient, temporibus nempe, quae infra singillatim designamus : a) die prima mensis Iunii, anno MDCCCCXXXVIII, in exclusivam Sacrae huius Congregationis iurisdictionem transibunt Palaestina, TransJordania, Aegyptus, Península Sinaitica et Cyprus; ö) die prima mensis Ianuarii, anno MDCCCCXXXIX, Graecia, Dodecanesus, australis Albania, Bulgaria, asiatica Turcarum respublica et Thracia Turcarum dicioni subiecta;
11 c) die prima mensis Iunii, anno MDCCCCXXXIX, Syria, Libanus.. Iraq et Iran.
12 VI. - A die, quo praesentes Apostolicae Litterae Motu Proprio datae promulgabuntur, ad diem usque, quo singulae regiones in exclusivam S. Congregationis pro Ecclesia Orientali iurisdictionem devenient, nullum opus nullumque institutum condi poterit, neque ulla rerum condicionibus immutatio fieri, quin antea consensio intercesserit S. Congregationis pro Ecclesia Orientali.
13 VII.
14 XI.

10 V. - Le regioni dei Cristiani d'Oriente, che sopra abbiamo ricordato, passeranno gradatamente sotto la giurisdizione esclusiva della S. Congregazione per la Chiesa Orientale, nei tempi cioè che qui di seguito designiamo singolarmente: a) dal primo giorno del mese di giugno, anno MDCCCCXXXVIII, passeranno sotto la giurisdizione esclusiva di questa Sacra Congregazione la Palestina, la Transgiordania, l'Egitto, la Penisola del Sinai e Cipro; b) dal primo giorno del mese di gennaio, anno MDCCCCXXXIX, la Grecia, il Dodecaneso, l'Albania meridionale, la Bulgaria, la repubblica turca asiatica e la Tracia sottoposta al dominio turco;
