8 Quarta l'amministrazione dell'Eucaristia;
9 Quinta l'ingresso nelle case delle monache;
10 Sesta l'estrazione delle ragazze dai monasteri;
11 Sepli num ma ordiroihtiononi;
12 Ottava della celebrazione della messa e delle letture della Sacra Scrittura; Nona delle controversie suscitate;
17 14. Alcuni invece, anche da luoghi dei Mendicanti che hanno cura delle anime, Decima quarta . . . decime; Decima cura delle anime;
18 Undecima quarta parte dei funerali;
19 Duodecima prestazione sui beni lasciati;
20 Decima terza diritto di sepoltura;
30 24. Altri invece non permettono loro di associarsi ai corpi dei morti, altri invece non permettono loro di compiere simili uffici con il parroco, se non sia intervenuta la maggior parte dei canonici. 25. Altri invece non vogliono che gli uffici dei morti si compiano nelle chiese dei singoli regolari, se non con la presenza dei morti stessi, e proibiscono che le loro monache o altre persone, anche se nella loro funzione di benefici;

of indults for the Orders of mendicant brothers and nuns; and the declaration and extension of the decrees of the Council of Trent concerning these matters, and the communication of the same indults with other regular Orders, as well as the jurisdiction of conservators.
1 Pius, bishop, servant of the servants of God, for perpetual remembrance of the matter.
2 Although the Orders of Mendicants, who for the sake of imitating Christ the Lord do not cease to render daily service as fellow soldiers in the vineyard of the Lord, we have always embraced with the highest zeal, even when we were in a lesser position; yet, having been raised to the apex of the supreme apostolate, though by unequal merits, by divine clemency favoring us, when we recall this to mind, we cannot refrain from embracing them with more ready charity and paternal affection, and from this, for their holy studies and honest labors, and for the salvation of souls, they have received and do receive from the Apostolic See, whose peace and dignity these Orders have constantly and strongly protected, both spiritual and temporal subsidies and ornaments, by which they may more easily and expeditiously execute and carry out their holy offices and their regular life, and so that other religious persons and other Orders, following their example, may become more prompt and eager in performing their duties.
3 § 1. Hence it is that we, taking pious consideration of the troubles arising from our venerable brothers in Christ, the archbishops and bishops, toward these Orders especially, as fruitful branches in the field of the Lord, whom they ought both to cultivate and to aid, not only do they neglect to do this, but also, by twisting the decrees of the Council of Trent to a perverse sense, they strive to afflict them and each of them with various inconveniences and disturbances, and to bring no small burden upon their privileges.
4 1. For certain bishops, as we have learned, are unwilling to admit certain regulars to preach, even in their own churches without examination, although they have good testimony from their superiors concerning their ability to exercise such work. Others, however, wish that not only once, but also several times in the year, preachers be presented before them or their vicars, and for permission to preach, which they wish to give only in writing, they sometimes exact something. Still other bishops seem to inflict the greatest injury upon regulars, when, contrary to order and ancient custom, without any reason they reject some and admit others, according to their pleasure, to such preaching in places of their diocese. 2. Moreover, certain local ordinaries are unwilling in any way to admit certain religious, good men and confessors suitable for this, even approved by their superiors, to hear confessions. Some of them wish that not only each year, but also several times in the year in certain places these same confessors be presented to them; in certain towns, moreover, both the bishops or their vicars and the parish priests are unwilling that the Mendicant brothers, called to hear the confessions of the sick, especially if the sickness be grave, or even of the healthy, be able to go to their private homes or elsewhere, except in their own churches or monasteries.
5 3. Some also dare to examine the confessors of nuns, who are fully subject to regulars, although this is in no way decreed by the council, just as also concerning brothers, who are to hear the confessions of other brothers.
6 4. Some also in certain places strive to assert or to bring it about that no one within a year be able to receive the sacred Eucharist in the churches of Mendicants, nor even the nuns called Tertiaries of their Orders, as some assert, in certain places, although only at Easter, as far as seculars are concerned, according to the privileges of the Supreme Pontiffs, our predecessors, granted to these Orders, this ought to be observed. 5. Other bishops or their vicars dare to give permission at their pleasure to anyone whatsoever to enter any monasteries of nuns, even of St. Clare, even if they are subject to the care of regulars.
7 6. Some, moreover, under the pretext of inquiring into the will of girls before their profession, wish to extract them from monasteries and to detain them elsewhere for a long time, and they question these girls or novices concerning many matters, neither necessary nor contained in the decree of the Council of Trent on this matter, from which no small occasion of scandal can arise. 7. Others, moreover, very many have been unwilling to initiate certain regulars of other dioceses into sacred Orders, and they are also unwilling to admit those approved by their Order's prelates. 8. Some, moreover, on each Sunday publish excommunication to their parishioners at the sound of the bell, so that they cannot attend Masses, sermons and divine offices except in their own parish. Others, moreover, in certain places, are unwilling that sacred Scripture sermons and discourses for the dead be held in their churches; and if anything has been left to them that they might [receive it]; as to the Third [Order] nuns, it concerns their confessors;
8 Fourth, the administration of the Eucharist;
9 Fifth, entrance into the houses of nuns;
10 Sixth, the extraction of girls from monasteries;
11 Seventh, the ordination of matters;
12 Eighth, the celebration of Mass and the readings of Holy Scripture; Ninth, controversies are stirred up;
13 Masses are said, or other offices for the dead are celebrated, they themselves usurp these, saying that they themselves cannot execute them because they themselves are pastors. Others, under the sentence of excommunication incurred and the penalty of exile for ten years from the diocese, have forbidden that Masses be celebrated in their churches on feast days before the rector of the parish church has celebrated. Others also do not wish that, while preaching is held in the cathedral church, it be preached elsewhere.
14 9. And moreover in certain places they disturb all order and peace, while they have stirred up controversies long since settled and extinguished concerning precedence, and where none existed they have created them, while, according to their own judgment and will, they have been unwilling to prefer these to those.
15 10. Certain bishops also wish to exclude regulars from the care of souls and to commit it to secular priests alone. 11. Certain others wish to extend the fourth part of funerals also to Masses, legacies and all other things whatsoever which are left to the houses of regulars.
16 12. Others wish the fourth part of all those things which are also left for the ornament of the church, vestments, chasubles, curtains, cloths and also those which are left for the sustenance of the brothers. 13. Some also in certain parts wish that not only the customary right of burial, which is always paid and is not denied, but also all that which the churches of the Orders give to their parts at their pleasure when the bodies of the dead are buried therein, all of this also be paid anew to the rectors, and they strive insistently, preventing that otherwise the bodies of the dead be carried to the monasteries of the brothers, whence in this matter it happens that both the rectors and the brothers themselves are greatly burdened.
17 14. Some also, even from the places of the Mendicants, who have the care of souls, Fourteenth, tithes; Tenth, the care of souls;
18 Eleventh, the fourth part of funerals;
19 Twelfth, the payment upon legacies;
20 Thirteenth, the right of burial;
21 wish to exact tithes for a seminary, and in case of resistance they also exact a pledge. Others compel the aforesaid brothers and nuns living under their care to pay a royal subsidy, when many of the same nuns scarcely have what is necessary for their sustenance and clothing. 15. Others also in certain parts prohibit the poor Mendicants from begging alms for their sustenance alone, and if they find them carrying bread or something else given to them in like charity for the love of God, they sometimes threaten to take it from them, inflicting grave injury and contumely. Certain bishops or chapters of canons compel the poor Mendicants, both brothers and nuns of their Orders, from the revenues of goods, if they have any, as well as from possessions, vineyards, fields and all their other things whatsoever, not only from the gifts of the faithful granted to them, but also otherwise from just causes acquired by them and monies purchased, to pay to them tithes and first fruits to be paid respectively to others.
22 16. Others have dared to inquire and proceed against certain regulars within the cloister offending or concerning whom there was some suspicion of crimes, not awaiting the censure of their superiors. Others, certain bishops presume to enter the monasteries of nuns and to grant licenses to enter them to others and to form proceedings against them, without consulting the superiors of their Orders. Some also claim to have temporal dominion over nuns. Not a few very frequently cite regulars, attempt to subject them to their jurisdiction, and occupy their convents, expelling them, and exercise jurisdiction or power over them. Some deliver them to prisons without cognizance of the cause, and labor with hands and feet that Mendicant regulars be subjected to their dominion, and have so far intruded themselves into the governance of convents and into the correction of brothers,
23 that to provincials and generals no place or jurisdiction appears any longer to be left.
24 17. Some forbid the priors and guardians of convents to make accounts and reckonings with the syndics of such convents.
25 18. Brothers also who have recourse to such bishops, they forbid to be corrected and punished by the aforesaid priors and guardians. They also inhibit the superiors of the Orders from making proceedings against brothers, and exercise over them the secular arm and power.
26 19. Others receive those living outside the cloister under their protection and permit them to remain thus, and detain them even against the will of their superiors. 20. Some presume to occupy the goods of the brothers themselves as if they pertain to them, should they die outside the cloister, and are unwilling to return their goods to those who have returned to the religious habit.
27 21. And they also impede unions made by the aforesaid See or otherwise duly made of ecclesiastical benefices, and wish them to be relaxed to themselves, and strike those who contradict with the sword of excommunication.
28 22. Others indeed, regular clergy, are unwilling to ring bells on feast days or at the same time, or to celebrate masses when the bishop celebrates masses.
29 23. Some also, in order to grant permission to build a certain regular house, have not blushed to demand thirty or forty ducats.
30 24. Others again do not permit them to associate with the bodies of the dead, and others do not allow them to undertake similar duties with the parish priest, unless the greater part of the canons intervene. 25. Others again are unwilling for the offices of the dead to be performed in the churches of individual regulars, unless with the presence of the dead themselves, and they prohibit their nuns or other persons, even if in the enjoyment of their benefices, from being present;
31 to intervene with parish priests, unless a certain sum has first been paid to the parish priest; and if they know that someone has chosen burial in the churches of regulars, they do not allow him, as it is said, to be brought to those churches before he has been brought to the parish church, and the office has been performed there.
32 26. Finally, they prohibit wills from being made without the presence of priests, and asserting that whatever has been left to the regulars themselves is contrary to the canons of the Council of Trent, they endeavor to revoke it entirely.
33 § 2. And therefore, wishing to provide for the aforesaid and other similar excesses and grievances, by the duty of our pastoral office, considering also that those who bear the burden of the day and heat, both in preachings and in other spiritual duties daily, unless they are also somewhat relieved, it will easily come to pass that oppressed by their offices they altogether desist, lest in the future any grievance be brought upon them, we have deemed that the decrees of the Council of Trent of this kind, whose false or less true understanding has crept in from the aforesaid, and whose declaration pertains only to us, should be declared in the manner and form written below.
34 1. We therefore, by our own motion, not at the instance of anyone, but of our own deliberate will and from certain knowledge and from the fullness of apostolic power, declare that the canon of session xxiv, chapter iv, by which the office of preaching is interdicted to all regulars, even in the churches of their Orders, the bishop contradicting, does not comprehend the brothers of the Mendicant Orders of this kind, when they have been appointed to this by their generals or their provincial ministers, nor can it affect them; rather we will that in their churches, when it pleases them, they may lawfully and without any impediment or contradiction, even of the bishop, unless he himself shall have preached, preach.
35 2. But what is established in session xxiii, chapter xv, concerning confessions not to be heard by regulars with troublesome molestations, this also does not in the least comprehend the brothers of the said Orders, approved by their aforesaid generals or provincial ministers to hear confessions of the faithful of both sexes, as is premitted, so that they may in no way be prohibited from hearing confessions, both within their churches and houses and without, approving hereupon the letters of Paul, Pope of happy memory, also our predecessor, granting to the same brothers of the Mendicants of regular Observance that they may hear confessions of secular persons, even of the infirm, even outside their houses and monasteries and anywhere, and newly granting anew. We also establish that he who has once been admitted in one diocese by the bishop shall always be held as admitted in the same diocese, nor shall he need to be examined or presented again in that diocese, both as regards preachings to be made and as regards confessions to be heard, nor shall anything be exacted or received for the aforesaid.
36 3. But we are unwilling that confessors of nuns who dwell under the care of regulars be examined by the ordinary, just as neither should the brothers be examined if they ought to hear the confessions of other brothers. Moreover, readers from the same brothers, and those graduated in theology, who with the permission of their superiors have been admitted to the degree, since there is no reason to doubt their learning, shall in no way be examined by bishops, both as those about to hear confessions and as those about to undertake the office of preaching.
37 k. And the same Christ-faithful may receive the sacrament of the Eucharist (the solemnity of the Resurrection of the Lord alone excepted), and it may be administered to them by brothers of this kind; nor can or should they be compelled or forced to do this by the local ordinaries, or the aforesaid rectors of churches, or any others whatsoever (their license not being required), even under ecclesiastical censures and other penalties, as we also decree and declare. And although in session xxv, chapter xii it is provided that ecclesiastical censures and interdicts, even if promulgated by local ordinaries at the command of the bishop, ought to be published by regulars in their churches; nevertheless if at the time of the celebration of any one of the feasts of Saints of the same Orders, and other festivities according to the apostolic privileges of the same Orders, such an interdict should be issued, we suspend it on the aforesaid festivities and their octaves.
38 5. Since it is unbecoming for anyone to put a sickle to another's harvest, and whereas the monasteries of nuns are not to be entered by anyone except with the license of the bishop or superior, and in cases of necessity, it is prohibited in session xxv, chapter v; we will that this apply only in those monasteries which are subject to the ordinaries themselves with full right, in which, in cases of necessity, they themselves may give license, and not in other monasteries. So that in the aforesaid monasteries, which are not subject to the ordinaries themselves with full right, the ordinaries themselves may not enter them, as is provided in their Rules or by law; and we altogether prohibit them from forming or making any processes against the nuns themselves, or brothers of this kind on that account, or otherwise, with the superiors of their Orders being requested, in any way whatsoever, so that they can or should in no way have, exercise or execute any jurisdiction or any whatsoever dominion over the nuns and brothers of this kind respectively; rather we exempt and free all of them from their superiority, dominion, jurisdiction and power, as has been granted to them by their privileges obtained from the aforesaid See; and thus the aforesaid nuns and brothers are so excluded from the superiority and jurisdiction of the ordinaries respectively of this kind, that they do not in any way interfere even in the appointment of their syndics or procurators, or in disposing of their faculties, or in doing other things not competent to them; nor can the ordinaries themselves cite the aforesaid regulars and subject them to their jurisdiction, and occupy their convents, expelling them from them, and exercise any jurisdiction and power over them, as is aforesaid, or commit them to prisons and do anything else against them, so that they are subjected to their dominion.
39 6. We also will that the examination of girls dedicated to God, namely whether they were forced or seduced by trouble, can be made only within fifteen days after the bishops or their vicars have been requested, according to the Council of Trent; which days having elapsed, it is no longer permitted for them to interfere in this; on which occasion, neither the bishop nor his vicar shall enter within the walls of the monasteries, but shall stand before the iron grate, and we altogether prohibit interrogations other than those which the aforesaid Council of Trent orders to be made to them; and similarly we will that the girls or novices themselves are in no way bound to answer other interrogations.
40 7. But session xxiii, chapter viii, establishing that ordinances can be made only by the proper bishop, we declare in no way applies to regulars: so that brothers of this kind may receive the aforesaid sacred orders from any bishop having the grace and communion of the Apostolic See, without the license of the ordinary of the place being required, in the places or houses of the brothers of this kind or elsewhere.
41 8. And moreover by the decree of Session XXII, a Declaration whereby the people are often admonished to come together to their churches, at least on Sundays and major feast days, we will that the Mendicant friars not only cannot be prohibited from celebrating masses and other divine offices in their churches, but also in any other places where masses are accustomed to be celebrated, even without being called or required to do so, they may celebrate; and also that they may make sermons and readings of Sacred Scripture and homilies for the dead, even in churches, and receive alms for the celebration of such masses and the performance of other divine offices, if these should be given or bequeathed to them; and also that they may celebrate and perform such masses and divine offices, even on Sundays or feast days, even before the rector of the parish church has celebrated, and when it shall seem good to them, even if at that time preaching is taking place in the cathedral church; and also that any faithful of either sex, throughout the whole year, may hear those masses and offices in the churches of such friars. These faithful may in no way be molested or hindered thereupon by the ordinaries of places or rectors of parish churches or any others whatsoever, in any manner, cause or occasion; but the aforesaid faithful, by hearing masses and other divine offices in the church of such friars on Sundays or feast days, shall be considered to have satisfied the precept of the Church concerning hearing them.
42 9. But all controversies concerning precedence, which, in the same Session XXV, chapter XIII, the bishop is commanded to settle, we decree can be settled only while he is in office, and when finished, in no way can be renewed.
43 10. And whereas, although chapter XI of Session XXV provides that in the houses of men or women, to whom the care of souls of lay persons pertains, none, even if removable at will, shall be appointed therein except with the consent of the ordinary and after a prior examination of this kind preceding, we will that the aforesaid regulars may be admitted to such care in every way.
44 11. But the fourth part of funerals, concerning which in the same Session XXV, chapter XIII, monasteries which have been founded within forty years are in no way truly bound, after the council itself speaks only of monasteries founded before forty years, which were accustomed to pay that same fourth part; and where it was accustomed to be paid, only that of wax and other things which in some places it happened to be carried at the time when the bodies of the deceased are borne to burial, not however of masses or legacies or other things left to such friars or nuns, or otherwise given in any manner, ought to be paid; and thus we decree that the council's decree concerning the payment of such fourth part ought to be understood. But where there is no custom of paying such fourth part, we declare that nothing of the aforesaid ought to be paid.
45 12. Nor to the fourth part or any other portion of all those things which also for the adornment of the church, vestments, chasubles, curtains, cloths and other things which it happened to be left or given to the said churches, even if left for the use of the friars or otherwise, are any bound to contribute.
46 13. And also the right of burial customarily paid to the curates, and nothing else ought to be paid to them, although the parties, at their pleasure, may bestow other things whatsoever upon the churches of such Orders or their friars, or distribute alms, when the bodies of such deceased are buried therein; nor ought they to be hindered on this account from being able to have the aforesaid bodies of the deceased borne to their churches for burial.
47 14. It is also considered unseemly that the Mendicant Orders be held to contribute to the bearing of certain burdens of monasteries, those Orders themselves and their places, even if they have the care of souls, and whatever benefices are united to them, to contribute for a seminary, or to the payment of certain tithes, indeed those Orders and their houses, monasteries, benefices and places whatsoever, and whatever depends on them in any way, and their possessions, vineyards, fields and meadows and other goods whatsoever, both as regards the Orders themselves as regards the aforesaid nuns, even acquired through the largesse of the faithful or otherwise for just causes by them and purchased with money, or otherwise pertaining in any way, are in no way bound; and we exempt and free those Orders and those nuns from all tithes, first-fruits, quarters, halves and other portions of fruits, as well as from charitable subsidies, even granted by us, at the instance of whosoever, even kings, princes, and temporal lords, for whatsoever cause, even the most urgent and to be expressed from necessity, and also from all other burdens whatsoever, both ordinary and extraordinary, even by reason of fruits, vegetables, brushwood, wood, benefices and other things whatsoever, both for sustenance as for clothing, otherwise necessary to them in any way, even by apostolic authority now and for the time being imposed, so that they are entirely and altogether in no way bound to contribute to anything, entirely and completely; and we will that those Orders and those nuns are in no way bound to those things, even if secular and other persons whatsoever have been in possession of exacting them; nor do we decree that they can or ought to be comprehended under chapter xii of session xxv.
48 15. Moreover, what session xxi, chapter viii speaks of concerning the removal of the use of questors for alms, we also decree in no way can or ought to be referred to the Mendicant Orders, but rather, since they are compelled to live on such alms, we declare that it is entirely free for them to do so.
49 16. Since indeed from excessive authority arrogated to themselves by bishops, they themselves strive altogether to subject regular persons to their jurisdiction; and by the decree of the aforesaid council, session xxv chapter xiv issued, whereby it is provided that if a regular person existing within the cloister, and outside it has so notoriously offended as to be scandalous to the people, within a term fixed by the bishop, he be punished altogether by his superior, if not, the offender can be punished by the ordinary, trusting in this, they afflict regulars with various and undue grievances, we will that the aforesaid ordinaries can in no way or ought to innovate anything against regulars on occasion or cause, those dwelling in such cloisters, under any pretext, nor can or ought to form or make any process against those regular persons themselves, unless on account of manifest scandal, and their Order's superiors having been first consulted and being negligent, otherwise all and singular things done and acted against the foregoing and to be done in the future shall be held for null and void.
50 17. Nor let them intermeddle in any way or by any means in the governance of convents, both of brothers and of such nuns, and their corrections, but let all these things and others necessary for the correction and governance of such brothers or nuns be left entirely to their generals ministers or provincials or their or their respective other superiors, even by reason of making accounts with the syndics of such convents, nor in any way in the aforesaid matters, by themselves or through others, let them intermeddle. 18. Moreover, brothers also, if it should happen that they have recourse to such ordinaries, can and ought to be chastised and punished by the aforesaid generals ministers or provincials, priors, guardians and other superiors, nor ought those ordinaries themselves inhibit the aforesaid superiors of such Orders in any way. Indeed we decree that the aforesaid superiors can make process against their brothers and such nuns, when it shall be necessary, concerning the inquiry into or chastisement of offences, invoking also for this, if it shall be necessary, the aid of the secular arm.
52 19. We also inhibit to those ordinaries themselves, lest they receive brothers dwelling outside the cloister under their protection, and detain them, unwilling to their superiors. 20. We also prohibit to the same ordinaries, lest in any way they intermeddle in the goods of the said brothers dwelling outside their monasteries for the time being or dying, and, although they die in habit or without habit, we will that their movable and immovable goods pertain to the Order which they have professed, to be disposed according to the constitutions or ordinances of the aforesaid Orders; nor let the aforesaid ordinaries presume to seize those; indeed such things, and to those returning to the habit of Religion, all goods we also decree pertain to the monasteries themselves, since those things which a monk acquires are acquired to the monastery by right.
53 21. And to those same ordinaries, we altogether prohibit that they impede any unions, even perpetual ones, made heretofore by the aforesaid See or otherwise, as is aforesaid, or to be made in the future, of ecclesiastical benefices or their fruits, from obtaining their effect, and we likewise decree and declare that the ecclesiastical censures and other penalties imposed by them against those who contradict in the future shall be of no force or moment. Moreover, we will that the aforesaid regulars, to whom the care of souls is entrusted, may exercise that care through themselves, according to the ordinance of their superiors, or through other vicars or secular chaplains, removable at the will of those regulars, appointed by them and approved by the ordinary as suitable; nor in their appointment or removal, nor in the assignment of any part of the fruits for the aforesaid chaplains or vicars, if the care should happen to be exercised by such, shall bishops in any way interfere.
54 their appointment or removal, nor in the assignment of any part of the fruits for the aforesaid chaplains or vicars, if the care should happen to be exercised by such, shall bishops in any way interfere.
55 22. We further prohibit to those same ordinaries and to all other persons whatsoever, that they impede those brothers, whenever it shall please them, both on Sundays or feast days or at other times throughout the year, from ringing bells and, even at the time when they themselves shall have celebrated, from celebrating masses, as well as from accompanying the bodies of the dead, and from causing those bodies, when brought into their aforesaid churches, to be buried by the brothers themselves without the presence of the rectors of such churches, and from being able to perform the offices of the dead; and we decree and declare that the necessary presence of rectors or other clerics is in no way required, so that the sick may freely make their wills, and that those regulars may exact and obtain legacies or any other things left to them in wills, nor is there any right to the contrary.
56 23. Licenses truly for constructing regular houses, which in chapter xxv of the session are prohibited from being constructed unless with the license of the ordinary, are to be given entirely freely, and can be refused only when a legitimate cause subsists, to be explained to the superiors. 24. Likewise we decree and declare that the aforesaid brothers, even alone, may accompany the bodies of the dead, and may solemnly perform the mandate which is customarily done on the day of Maundy Thursday in the churches or houses of brothers of any of the aforesaid Orders, and may preach on that aforesaid day at the hour which shall seem good to them, nor can they be prohibited by the ordinaries of places or rectors of churches or any others whatsoever.
57 25. Commanding also all ordinaries of places, that they not permit the rectors of parish churches to perform the offices of the dead in the churches of those brothers against their will.
58 And nuns subject to the aforesaid brothers, or persons choosing burial in their churches, may be buried without any parochial portion being paid; or if the brothers shall have been called to accompany the bodies of the dead, they shall not dare or presume to cause those bodies to be buried without the presence of such brothers.
59 26. Since it is fitting above all that the will of any testator be freed, and that use, introduced but a short time ago, as is aforesaid, by which wills are forbidden to be made without the presence of priests, we altogether abrogate.
60 § 3. Finally, what was provided in chapter xiii of session xxv, that all, namely both clerics and regulars of any kind, when called to public processions, are compelled to attend, we will that, as regards the aforesaid brothers, this be understood only of those processions to which according to the ancient custom of places they have been accustomed to attend, or which are proclaimed for the good of the peace of the Church or for victory against infidels; which we will also in no way be understood of those convents which are called colleges, in which brothers live under stricter enclosure, so that they neither sing in choir nor attend the dead, but only devote themselves to studies and readings. § 4. Moreover, if perchance a suit or suits should be pending between bishops or colleges or chapters or any other persons whatsoever and the aforesaid brothers or nuns or any of them, concerning the aforesaid matters or any of them, before any judge or judges whatsoever, even auditors of the causes of the Apostolic Palace, and cardinals of the holy Roman Church, both in the Roman Curia and outside it, anywhere, we call that suit or suits and cause or causes to ourselves, and we will that their status and the names and surnames of the judges and co-litigants be held as sufficiently expressed in these presents, we quash and extinguish it and them, and impose perpetual silence upon the parties thereon.
61 § 5. And moreover, so that all the aforesaid confirmations may more easily persist entirely unimpaired, we approve and confirm in perpetuity, by apostolic authority, in the tenor of these presents, all and singular privileges, immunities, indulgences, faculties, liberties, indults, dispensations, favors and graces, which by the decrees of the Council of Trent, otherwise than as has been said above, are not expressly contrary, granted and declared to the same brothers as well as to any nuns and sisters of the Third Order of the aforesaid Orders respectively to their Orders, and to their churches, houses and persons, even by word of mouth, in general or in particular, granted, confirmed and renewed in any manner whatsoever by the memorable Eugene IV, Sixtus IV, Leo X, Paul III and the aforesaid Paul IV and Pius IV as well as by any other Roman Pontiffs, even our predecessors, and the same See; and likewise our letters and those of our predecessors and any other letters made concerning this matter, the tenors of all of which and the names of the same predecessors of ours and other matters necessary to be expressed, as if they had been inserted word for word, nothing whatsoever being omitted and the form contained in them being observed, we also wish to be sufficiently expressed in these presents, and we add to them the strength of perpetual and inviolable firmness, and they ought to be inviolably observed in perpetual future times; and we wish that they ought to benefit or be able to benefit the brothers, superiors and persons of such Orders as well as any others whomsoever whom they concern. Moreover, privileges, immunities, faculties, liberties, indults, dispensations, exemptions, favors and graces, both spiritual and temporal, in the manner and form in which they have been granted, even by way of communication and extension, actively and passively, among themselves and any other Orders respectively, we grant anew; and all and singular of these we extend and enlarge to any houses and places whatsoever of the said Mendicant Orders and of any nuns and sisters called of the Third Order, living in the congregation of the said Orders, as aforesaid, received hitherto and to be received hereafter, as well as to their persons and goods, even if the authentic originals of the privileges and other graces aforesaid have been lost on account of the antiquity of time or the various ruins of the City, provided that it is otherwise legitimately established concerning them.
62 § 6. And thus, in all and singular of the aforesaid matters, by whatever judges and persons, exercising any authority whatsoever, even the aforesaid cardinals and auditors, having been removed from them and from each of them any facility and authority of judging and interpreting otherwise, they ought to be judged and decided; and whatever is done otherwise, concerning these matters, by anyone whomsoever, by any authority, knowingly or unknowingly, we decree to be null and void.
63 § 7. Wherefore to our beloved sons, the cardinal protector of the Order of Preachers, and the general of St. Jerome of the Orders, and also the general auditor of the Apostolic Camera of the Court of Cases, now and for the time being existing, by apostolic writings, by similar mandate we command that they themselves or any two or one of them, through themselves or through another or others, these letters and whatever is contained in them, where and when it shall be necessary, and as often as they shall be requested concerning this matter on behalf of the same brothers or nuns or any of them, solemnly publishing them, and assisting them with the protection of effective defense in the aforesaid matters, shall cause them to be carried out.
64 ctority of ours these presents and the matters contained in them to be firmly observed, and allowing the individuals whom the letters themselves concern to enjoy and rejoice peacefully, not permitting them or any of them to be molested in any way contrary to the tenor of these presents by anyone whomsoever, even by local ordinaries, compelling any contradictors and rebels whatsoever by censures and ecclesiastical penalties and other appropriate remedies of law, appeal being set aside, legitimate proceedings being observed concerning these matters, aggravating even the said censures and penalties repeatedly, and imposing ecclesiastical interdict, invoking also to this end, if it shall be necessary, the aid of the secular arm.
65 § 8. Notwithstanding the foregoing and apostolic decrees of any kind, as well as general or special constitutions and ordinances issued in provincial and synodal councils, and also statutes and customs strengthened by oath, apostolic confirmation, or any other firmness; likewise privileges, indults and apostolic letters granted to the same bishops or to any other persons whatsoever, under whatsoever tenors and forms, and with whatsoever, even derogatory clauses of derogations and other more efficacious and unusual clauses, irritant and other decrees, in general or in particular, even by similar motu proprio, and in any other manner whatsoever granted, approved and renewed, all of which, even if, for their sufficient derogation, special, specific, express and individual mention of them and their entire tenors should be had, rather than by general clauses importing the same, or if some other exquisite form should be observed for this purpose, we regard these tenors as if they had been inserted word for word, with nothing whatsoever omitted and the form contained in them observed, we hold them as sufficiently expressed and inserted in the present, and which would otherwise remain in their force, on this occasion only, we specially and expressly derogate from, as well as from all those things which in the letters of confirmation and renewal of the same privileges, otherwise granted to the Order of Friars Minor by our aforesaid predecessors Paul IV and Pius IV, it has been granted that they not stand in the way, notwithstanding anything to the contrary; or if it has been indulged by the Apostolic See to the ordinaries of places or to any others whatsoever, commonly or severally, that they cannot be interdicted, suspended or excommunicated by apostolic letters not making full and express and word-for-word mention of this indult. And because it would be difficult for knowledge of these present letters to reach any persons whatsoever, and for them to present them everywhere, we also by similar motu proprio and knowledge will and decree that transcripts of these present letters, even made by printing, subscribed by the hand of some public notary or sealed with the seal of some person constituted in ecclesiastical dignity, shall be afforded the same credence everywhere as would be afforded to these original letters if they were presented, both in judgment and outside of it, full and undoubted faith.
66 § 9. Let no man whatsoever be permitted to infringe this page of our declaration, prohibition, exemption, liberation, inhibition, advocation, cassation, extinction, imposition, approbation, confirmation, addition, concession, extension, amplification, will and derogation, or to dare to act contrary to it with rash presumption. If anyone, however, shall presume to attempt this, let him know that he will incur the indignation of almighty God and of the blessed Apostles Peter and Paul.
