1 Pius, bishop, servant of the servants of God. To the perpetual memory of the matter. § 1. Concerning the salvation of souls, for which we are solicitous with unceasing care on account of the increase of the Catholic religion through the office of apostolic service, we continually direct our efforts to all those things which we recognize can be procured more apt and useful for the spiritual governance of the Christian faithful. By this counsel we have long directed our thoughts with particular attention to those regions which are now subject to the dominion of the most serene prince Frederick William, king of the Prussians, so that by his intercession and liberality we might be able to arrange the sacred matter there by the best method that could be accomplished.

2 § 2. Indeed, the present condition of those regions was well before our eyes, nor have we ever ceased to lament the great losses flowing from the past disturbances of affairs, which had reduced the once most flourishing and richest churches of Germany, cast down from the ancient splendor in which they excelled, and despoiled of the protection of their goods, to a most wretched state, from which the greatest destruction to the Catholic religion and to Catholics themselves has flowed.

3 § 3. And since the condition of the times did not at all permit the illustrious churches of the German nation to be recalled to their splendid ancient state, we applied all study and diligence so that we might at least prepare for such great evils those remedies which appeared to be in the first place necessary and opportune for preserving the Catholic faith in those regions and for procuring the salvation of Christian souls.

4 § 4. Our wishes were indeed wonderfully seconded by the praised king of the Prussians, whose propensity we found to be very great and whom we follow with grateful mind in his will toward Catholics in great number subject to him, especially since to him is attributed a great part of the provinces toward the Rhine, so that at length we might arrange all things with favorable and happy outcome, and according to the position of places and the convenience of the inhabitants, we might now constitute a new state of churches and limits of dioceses in the Prussian kingdom, and then endow each see, where it is lacking, with its own, worthy, and suitable pastors. § 5. Having therefore the matters to be expressed and inserted word for word below concerning the extinction or alteration or reordering of the rights and prerogatives of churches and chapters and their peculiar predecessors, as well as the dismemberment or new application of the respective dioceses, and likewise the annulment of any preceding metropolitan right, and moreover supplying the consent of all those having an interest therein, from certain knowledge and mature deliberation of ours, and from the fullness of apostolic power, with the prior and complete suppression, extinction, and annulment from now of the vacant episcopal see of Aachen with its cathedral chapter, reducing it to the state of a simple collegiate as below, and likewise of another episcopal church and cathedral chapter of Cologne, as well as of the monastery of the abbey called Neocellensis, commonly Neuonzell, from now, and likewise of another monastery of the abbey similarly called Olivensis, from now for then, namely when from the person of our venerable brother Joseph of Hohenzollern, bishop of Warmia, the present abbot of Olivensis, it shall have become vacant in any way; so that we might also follow with benign favor the common wishes of the Germans, increased also by royal commendations, to the glory of almighty God and to the honor of blessed Peter, prince of the apostles, we restore the church of Cologne, already before among the sees of Germany second to none in antiquity and splendor, under the invocation of the praised prince of the apostles, to the rank of a metropolitan church, and we decree that it is to be perpetually constituted in that rank, and to it as a metropolitan we assign the suffraganean episcopal churches of Trier, Münster, and Paderborn.

5 § 6. We likewise elevate and constitute the episcopal church of Posen under the invocation of the holy apostles Peter and Paul to the rank of a metropolitan see; and the same we unite and aggregate perpetually to another archiepiscopal church of Gnesen under the invocation of St. Adalbert, which is equally vacant at present through the resignation of our venerable brother Ignatius Raczinsky, the last archbishop thereof, made freely into our hands and admitted by us, and we commit the care, governance, and administration of the church of Gnesen fully to our venerable brother Timothy Gorszenski, the present bishop of Posen, and we constitute and depute him archbishop of Gnesen and Posen, and we command that he always be and be called archbishop of Gnesen and Posen, and to his metropolitan right we assign the episcopal church of Culm as suffraganean.

6 §. 7. We declare that the episcopal churches of Wrocław and Warmia ought to be and remain perpetually immediately subject to this holy See. §. 8. To each and every archbishop and bishop we grant and confirm all and singular rights, preeminences, prerogatives, and privileges legitimately competent to the other archbishops and bishops of their regions.

7 §. 9. As regards the chapter of the metropolitan church of Cologne, we erect therein two dignities, namely a prepositure, which shall be the greater after the pontifical, and a deanery second, ten canonries numerary, and four canonries honorary, and besides eight vicariates or prebends.

8 §. 10. The chapter of the archiepiscopal church of Gniezno shall henceforth consist of a single dignity of prepositure only, and of the number of six canonries. The chapter of the other archiepiscopal church of Poznań shall be formed of two dignities, namely of prepositure and deanery, eight canonries numerary, and four other canonries honorary, as well as eight vicariates or prebends.

9 §. 11. The chapter of the cathedral churches of Trier, Wrocław, and Paderborn respectively

10 shall consist of two dignities, namely one of prepositure and the other of deanery, of eight canonries numerary, and four canonries honorary, and of six vicariates or prebends. §. 12. In the cathedral church of Münster the chapter shall be constituted of two dignities, namely the major one of prepositure and the second of deanery, and eight vicariates or prebends.

11 §. 13. The chapter of the cathedral church of Kulm shall consist of two dignities, namely of prepositure and deanery, of eight canonries numerary, of four honorary canonries, and of six vicariates or prebends.

12 §. 14. The chapter of the cathedral church of Wrocław

13 shall be formed of two dignities, namely one of prepositure and the other of deanery, ten canonries numerary, of which the first shall have the prebend of the scholastic attached, six honorary canonries, and eight vicariates or prebends.

14 §. 15. Finally, as regards the episcopal church of Warmia, its chapter shall consist in that state in which it is now found; there being reserved to Us, however, and to Our successors the Roman Pontiffs, the faculty of conforming that chapter hereafter to the norm of the other churches existing in the kingdom of Prussia. §. 16. Moreover, in each of the aforesaid churches, both archiepiscopal and episcopal, the habitual care of the souls of the parishioners shall reside with the chapter, but the actual care shall be exercised by one of the capitulars expressly designated for this purpose, and approved beforehand by examination according to the form of the sacred canons by the ordinary, with the assistance of the vicars; and in each of these chapters two suitable canons shall be stably appointed by the ordinary, by one of whom the office of penitentiary, and by the other the office of theologian expounding sacred scripture to the people on appointed days, shall respectively be faithfully fulfilled.

15 §. 17. To each and every one of the canons of the aforesaid chapters, whom we declare to be in no way obliged to personal residence and to the service of the choir, there shall be open the same access to the choir and to other ecclesiastical functions as to the resident canons; and we expressly confirm to all the aforesaid dignities and canons the indult of using the same insignia which they formerly enjoyed, and insofar as it is necessary we grant and bestow it anew.

16 §. 18. To each likewise of the cathedral chapters now and for the time being existing among the aforesaid, that they themselves, gathered together capitularly, for the new and more accommodated circumstances of the same archiepiscopal and episcopal churches, and for the daily service of their choirs, as well as for the prosperous, happy governance, direction, and support of the burden of things and rights both spiritual and temporal respectively incumbent upon them, for the exaction and division of daily distributions and all other emoluments whatsoever, and for the incurrence of penalties from those not assisting at divine offices, noting the presence and absence of individuals, observing ceremonies and rites, and in all other matters necessary and fitting concerning the aforesaid, may make whatever statutes, ordinances, chapters, and decrees, provided they be lawful and honest and not contrary to the sacred canons and constitutions

17 apostolic, and the decrees of the Council of Trent in no way contrary, under the presidency, inspection, and approbation of the respective archbishops and bishops to issue, and the issued documents to declare and interpret, and to reduce into better form and to reform, or other new ones, by those to whom it pertains, and for the time being shall pertain, to be inviolably observed, under penalties to be established against those acting contrary, likewise to enact and to issue freely and lawfully we are able. We grant and impart this faculty perpetually. § 19. Concerning the number of dignities, canons, and vicars or prebendaries both in metropolitan and in cathedral chapters as above predetermined, to be composed for this first time as well as for future times we decree, that henceforth each one seeking to obtain dignities and canonicates ought to be adorned with the following required qualifications, namely that he shall have received the major sacred orders, and shall have rendered useful service to the Church in works for at least five years, or shall have shown himself in the exercise and assistance of the care of souls, or shall have been a professor of theology or of sacred canons, or shall have served some bishop existing in the Kingdom of Prussia in the office of diocesan administration, or finally shall have duly obtained the doctorate degree in sacred theology or in canon law: the effect of this last condition, however, on account of just and grave causes, to be reckoned from the date of these presents, to remain suspended for ten years. We decree that ecclesiastical men of whatever condition ought to enjoy equal right in obtaining dignities and canonicates; and likewise we decree one canonical prebend to be designated in the cathedral church of Münster, and another in the cathedral church of Wrocław, and to be conferred always and whenever it shall pertain according to the month after the Nativity by him to whom it pertains, to be conferred upon one and the other having the canonical requirements from among the professors of universities existing in the said respective cities; and further we decree both the prepositius of the parochial church of St. Hedwig of the city of Berlin, and the dean commissioner ecclesiastical in the county of Glatz for the time being existing to be coöpted among the honorary canons of the cathedral chapter of Wrocław; so that they enjoy equal right with them, holding that place and order which according to the time of the respective nomination is known to be competent to them. Each one moreover from the honorary canons to be coöpted into each one of the aforesaid chapters shall be taken from the number of archpresbyters laudably exercising the care of souls in the respective diocese.

18 § 20. As to the new provision of the aforesaid chapters for this first time with the speed that is fitting for the composition, in the person named below as executor of these Our letters We grant power, so that in each and every church both dignities and canonries, as well as vicarages or prebends now vacant, which perhaps may be lacking to equal the number designated above, he may confer upon worthy and suitable ecclesiastical men from the special apostolic faculty delegated to him, and in the name of this holy See; provided however that those only who shall have been provided by him to dignities and canonries shall be bound to obtain and have expedited apostolic letters of new provision and confirmation from Our datary within six months next following from that time. And if it should happen that in any of the metropolitan or cathedral churches existing in the kingdom of Prussia dignities, canons, and vicars or prebendaries legitimately and canonically instituted still living exceed the respective number fixed by Us as above, the aforesaid apostolic executor, with those having an interest called and heard, shall settle the matter either through voluntary renunciations of rights to be made by them or by some of them, with provision made at the same time through suitable life pensions already promised by the most serene king for the support of those renouncing, or if such renunciations should not be forthcoming, or should not attain a sufficient number, in this case those who have obtained possession of dignities, canonries, and vicarages exceeding the number fixed in Our aforesaid disposition in the last place, if they reside at their churches, shall continue to be capitular members and vicars respectively, shall enjoy the rights and prerogatives now competent to them, and shall receive their revenues in that amount in which they now enjoy them: but when benefices obtained by them shall have become vacant in any way whatsoever, they cannot be conferred upon others, and from now for then they ought to be understood as suppressed and extinguished, to the end that henceforth the number fixed as above in the respective chapters shall be observed exactly. If in any chapter the canons now enjoy smaller revenues than those assigned to their successors, these shall receive no increase of revenues unless they are individually endowed by the apostolic executor with similar larger revenues. § 21. In future time, moreover, and upon successive vacancies by Us and by the Roman pontiffs Our successors, the prepositure, which is the greatest dignity after the pontifical in the aforesaid archiepiscopal and episcopal churches, as well as in the church of Aachen to be erected into a collegiate church as below, and likewise canonries in the months of January, March, May, July, September, and November in the aforesaid churches becoming vacant shall be conferred, just as has been done hitherto in the chapter of Wrocław: but as to the deaneries in the aforesaid metropolitan and cathedral churches, and to canonries both in these and in the said church of Aachen to be erected into a collegiate church becoming vacant in the other six months, they shall be conferred by the archbishops and bishops respectively. Vicarages or prebends in the aforesaid churches becoming vacant in whatever month We leave to the collation of the respective archbishops and bishops.

19 § 22. Finally, judging that We shall be doing something most pleasing to Germany and at the same time most acceptable to the aforesaid king of Prussia, if, with the right of elections retained and confirmed in the Transrhenish churches, and ceased in the Cisrhenish churches through apostolic dispositions of the year one thousand eight hundred and one, now in these same Cisrhenish dioceses subject to the temporal dominion of the aforesaid king, the same right of elections shall be restored as to the chapters of churches pertaining to Germany, namely Cologne, Trier, Wrocław, Paderborn, and Münster, We decree and ordain that, with any other manner or custom, as well as the distinction of election and postulation, and the necessity of nobility of birth removed, We grant to the aforesaid chapters, after the aforesaid method has been established and ordained, the faculty that in each and every vacancy of their sees through the death of the respective prelates outside the Roman curia, or through the resignation and abdication of their sees (excepting however the present case of the vacancy of the Cologne and Trier churches), within the customary space of three months, the dignities and canons gathered capitularly, and with canonical rules observed, may elect new prelates and ecclesiastical men whatsoever, inhabitants of the kingdom of Prussia, worthy however, and according to canonical sanctions suitable, with all things to be observed according to the form of the sacred canons. To such elections the right of suffrage shall belong to canons both numerary and honorary, not even excluding those who beyond the capitular number fixed in this reordering shall be preserved in the same chapters as long as they live.

22 Pius PP. Seventh month, and also the archiepiscopal sees of Gnesen and Posen perpetually united with one another, renewing, we command only that the canons of Gnesen and Posen ought to proceed jointly to the election of the archbishop. But as regards the vacant episcopal church of Wroclaw, we grant special power to the five dignities existing in that church, namely the prepositus, dean, archdeacon, scholasticus, and custodian, together with eight resident canons and six honorary canons, who are now held to be canons of that church, so that they may and are able to proceed to the canonical election of a new bishop in the manner and form aforesaid, also on this first occasion.

23 § 24. All instruments of such elections, drawn up in authentic form, shall be sent to the Holy See in the customary manner, and if the election were recognized to have been canonically completed, and from the process of inquiry thereafter committed by the Roman pontiff in individual cases to one of the archbishops or bishops existing within the boundaries of the kingdom of Prussia, and carefully drawn up according to the form of the instruction issued by command of our predecessor of holy memory Urban VIII, it shall be established that the elected person is suitable, such elections shall be confirmed by us and by the Roman pontiffs our successors according to the established custom by apostolic letters.

24 § 25. Moreover, in each city, both archiepiscopal and episcopal, we decree that one seminary of clerics is to be preserved or erected anew as soon as possible, in which the number of clerics which shall be suitable, and according to the form of the decrees of the sacred Council of Trent is to be instituted and educated, which shall correspond to the extent and necessity of the respective dioceses, and which shall be appropriately determined from the execution of these present letters: nevertheless we leave to the judgment and prudence of the archbishops of Gnesen and Posen, whether to establish either in each city a separate and distinct seminary, or one only in the city of Posen, which consists of ample buildings, for the clerics of both dioceses, as the utility of those churches shall have demanded.

25 § 26. Wishing now, with prior dismemberment, separation, and alteration of certain places and parishes to be withdrawn from the jurisdiction of former ordinaries for the purpose of aggregating and incorporating them and those to dioceses hereinafter written, as seemed more opportune in the Lord, and having also heard our venerable brothers, the cardinals of the Holy Roman Church presiding over the congregation of Propaganda Fide, to proceed to a new circumscription of dioceses, so that all questions concerning the exercise of spiritual jurisdiction, their distribution and division may be removed from the distinct boundaries of individual dioceses, we decree and prescribe from the fullness of apostolic power according to the manner which follows, namely.

26 § 27. The metropolitan church of the Cologne diocese shall be formed from six hundred eighty-six parishes, some situated on the left bank, some on the right bank of the Rhine. And on the left bank it shall include all the parishes formerly contained in the now suppressed Aachen diocese, which pertain to the provinces of Cologne, Düsseldorf, and Aachen, namely, beyond the parishes of the cities of Cologne and Aachen, the churches called cantons = Bergheim = Bonn = Brühl = Kerpen = Lechenich = Lessenich = Rövenich = Meckenheim = Münster = Neuwied = Tolbiacum, commonly called Zülpich = Crefeld = Dahlen = Dormagen = Elsey = Gladbach = Neuss = Urdingen = Viersen = Bortscheid = Marcodurum, commonly called Düren = Erkelenz = Eschweiler = Geilenkirchen = Gemund = Heinsberg = Iuliacum, commonly called Jülich = Linnich = Montjoie = and Nideggen = together with their subsidiary churches and annexed territories, which in those provinces are now found within the bounds of the Prussian kingdom, separating from the canton churches the subsidiary parishes and annexed territories situated outside the kingdom: and conversely aggregating to the canton churches existing in the kingdom the subsidiary and annexed territories formerly dependent on canton churches situated outside the kingdom. It shall moreover include the canton churches pertaining to the Liège diocese and temporarily committed to the administration of the modern vicar capitular of Aachen by apostolic authority, namely the churches called cantons = Cronenburg = Eupen = Malmedy = Niederkruchtcn = Schleiden = and St. Vith = together with their subsidiary churches and annexed territories situated in Prussian territory, and six subsidiary parishes called = Afden = Alsdorff = Merkstein = Rolduc = Ubach = and Welz = now dependent on the canton = Herckraedc = situated outside the Prussian kingdom. Furthermore it shall include nineteen parishes of the Aachen province hitherto pertaining to the Trier diocese, called = Allendorf = Blankenheim = Dollendorf = Hollerath = Lommersdorf = Manderfeld = Marmagen = Mülheim = Nettersheim = Reifferscheid = Rescheid = Ripsdorff = Rohr = Schmittheim = Schönberg = Steinfeld = Tondorff = Udelhoven = and Wildenburg = with their annexed churches. On the right bank of the Rhine, however, and in the provinces of Cologne, Düsseldorf, and Coblence it shall include parishes of the regions = Tuitiensis = Düsseldorf = Essen = and Siegburg = with their subsidiary and annexed territories, except however the parish = Romershafen = to be applied to the Paderborn diocese as below, as well as the parishes = Hachenburg = and Marienstadt = called, which are found in the duchy of Nassau.

27 § 28. The episcopal diocese of the church of Trier, withdrawn from all metropolitan right of the archbishop of Mechlin, and assigned as suffragans to the metropolitan of Cologne, shall consist within the boundaries of the kingdom of Prussia of six hundred thirty-four parishes, namely on the left bank of the Rhine from all those which now pertain to that diocese and are contained in the province of Trier, and moreover from that part of the now suppressed diocese of Aachen which is contained in the Confluentina province, namely the city itself of Coblence and the cantonal churches called Ahdcnau, Ahrweiler, Andernach, Boppard, Castellaun, Cochem, Creuznach, Kaysersesch, Kirchberg, Kirn, Lutzerath, Mayen, Munstermayfeld, Niederzissen, Oberwesel, Polch, Punderich, Remagen, Rubenach, Simmern, Sobernheim, St. Goar, Stromberg, Treiss, Ulroen, Wanderath and Zell, with their subsidiary churches and annexed territories. Moreover, from one hundred thirty-two parishes, both cantonal and subsidiary with their annexed territories, which in the circumscription of the year one thousand eight hundred one had been attributed to the diocese of Metz, and afterwards committed to the temporary administration of the vicar capitular of Trier by the apostolic See. On the right bank of the Rhine, however, from all churches of the Prussian dominion which formerly pertained to the same Trieran diocese, and which through the circumscription of the Gallic dioceses made by Us in the year one thousand eight hundred one had been dismembered from it, and are at present administered by the apostolic vicar residing in the town of Ehrenbreitstein at Our pleasure. Finally, beyond the aforesaid number of six hundred thirty-four parishes and the boundaries of the Prussian kingdom, all those which are found in the territories of the princes of Coburg, Homburg, and Oldenburg, already pertaining to the same diocese of Trier. § 29. The episcopal diocese of Münster, a suffragans church of the metropolitan of Cologne, shall be formed by two hundred eighty-seven parishes situated within the boundaries of the kingdom of Prussia, and also other parishes beyond the boundaries of the same kingdom comprehended in the same diocesan territory at present, concerning which We reserve to Ourselves and to Our successors the Roman pontiffs the faculty of disposing at another time, as shall be judged opportune in the Lord. We moreover adjoin the regions called Recklinghausen, Sterkrathen, and Rees, formerly of the ancient diocese of Cologne, excepting however from this last region the parish called Oeffelt, existing under the temporal dominion of the Belgian kingdom; and also from the now suppressed diocese of Aachen the cantonal churches called Calcar, Cleve, Cranenburg, Dulken, Geldern, Goch, Kempen, Meurs, Rheinberg, Wankum, Wesel and Xanten, with their subsidiary churches and annexed territories, excepting however those subject to the dominion of the king of the Belgians in temporal matters. We moreover adjoin the parishes called Elten and Emmerich with its filial, hitherto existing under Dutch missions, and likewise the parish called Damme, which We separate from the diocese of Osnabrück, and the parish called Oldenburg, which We sever from the Northern missions, and which pertain to the dominion of the duke of Oldenburg. Finally, to the modern and for the time being existing bishop of Münster We commit for perpetual governance and administration five parishes called Brochterbeck, Ibbenbühren, Mettiogen, Recke, and Halverde, which had been committed to the administration of the suffragan of Osnabrück at the pleasure of the apostolic See.

28 § 30. The episcopal church of Paderborn, a suffragan of the metropolitan church of Cologne, shall remain circumscribed within the same limits in which it is now found. We moreover adjoin to it another now suppressed diocese of Corvey with its entire territory, administered by our venerable brother Ferdinand, bishop of Münster, and also from the territory beyond the Rhine of the ancient diocese of Cologne the deaneries called Mesch­eden, Altendorn, Brilon, Wormbach, Medebach, and Wallenscheid, with their respective parochial and filial churches, and likewise the commissariat Haaren and the parish Romershagen; and further the deaneries Rittberg and Wiedenbrück, with their respective parochial and filial churches to be separated from the diocese of Osnabrück, and also the parishes called Siegen and Oberneukirchen to be disjoined from the diocese formerly of Mainz, afterwards of Regensburg, the city Heiligenstadt with its deanery, and the deanery Beuren-Leinleben and Bischofrod, the parish Kirchworben, excepting however the deaneries Kulsladten, Lengefeld, Schlochau, Tuchel, and Kamenz, to be added to the diocese of Culm as below, and moreover the deaneries Rüttenfeld and Wiesenfeld, and further the deaneries Kruszwitz, Inowlawlawislawski, and Gniewski to be separated from the dioceses, and the city Erfurt with three suburban parishes and the parishes existing in the territory of the Grand Duke of Saxony, and the deanery Ostrszeszow and Kempnen to be disjoined from the diocese of Wrocław. We moreover commit to the executor of these present letters the division and assignment of diocesan territory for the said diocese to be established, and the administration of the parishes of Eppingen outside the Prussian kingdom in the principality of Waldeck to be separated from the ancient diocese of Cologne, and finally to be separated from the vicariate apostolic of the Northern Missions, and to be perpetually administered by future and existing Paderborn bishops. § 31. The archiepiscopal dioceses of Gniezno and Poznań, mutually and perpetually equally united as principal, shall be formed from those things which are contained in the same, after the most recent circumscription of the dioceses of the Polish kingdom made by Us. The division and assignment of diocesan territory for the said diocese to be established is expressly committed to the executor of these present letters to be carried out. § 32. The episcopal diocese of the church of Culm, a suffragan of the archbishop of Gniezno and Poznań, shall consist of one hundred and fifteen parishes, namely with their respective vicars and filial churches from the deaneries Lessen, Rhoetden, Neumark, Löbau, Lautenburg, Strasburg, Golub, Thorn, Culm, Culmsee, and Gurczno, with the parish called Białutten: which last two were formerly of the diocese of Płock as a suffragan of Culm in the past administered; likewise from the deaneries Gdańsk, Puzzig, Mirchau, Dirschau, Stargard, Moew, Neuenburg, Schwetz, Lauenburg, Schlochau, Tuchel, Kamenz, and Fordon: which deaneries of the diocese of Wrocław are now administered by the aforesaid vicar apostolic of Gdańsk, and also from the territory of the monastery called Olivensis as above suppressed, now for the present only from the person of the modern abbot, and whenever it shall have become vacant. And since it was set forth to Us that suitable houses are lacking at Culm for the decent habitation of the bishop and chapter, We grant faculty to the executor of these apostolic letters, having heard those having an interest and the matter having been maturely considered, with the firm title and denomination of the episcopate of Culm remaining, and with appropriate churches and buildings assigned, to transfer the residence of the bishop and chapter of Culm freely and licitly, and to exercise spiritual jurisdiction there: and moreover other places and parishes disjoined from the diocese formerly of Mainz, afterwards of Regensburg, and administered by the bishop formerly of Corvey, now of Münster, shall likewise be entrusted to the administration of the vicar apostolic. § 33. The diocese of the episcopal church of Wrocław, immediately subject to this apostolic See, shall form from the actual territory thereof, excepting only the deaneries Ostrszeszow and Kempnen to be incorporated into the diocese of Poznań as above, and moreover the deaneries Pless and Bytom to be disjoined from the diocese of Kraków, and also the following parishes in Lusatia, namely of the monastery of Neocell Nullius as above suppressed, and others called Wittichenau, Gunthersdorf, Hennersdorf, Pfaffendorf, Ublersdorf, hitherto administered by the dean of the collegiate church of St. Peter of the town of Bautzen in Upper Lusatia: which all together within the borders of the Prussian kingdom shall amount to six hundred and twenty-one parishes. It shall likewise preserve those parishes which it has in the Austrian dominion. The future and for the time being existing bishop of Wrocław shall have perpetually subject to his administration those parishes which have hitherto been administered by the vicar apostolic of the Northern Missions in the cities of Berlin, Potsdam, Spandau, Frankfurt on the Oder, Stettin, and Stralsund, and which henceforth by virtue of subdelegation of the bishop of Wrocław shall be administered by the aforesaid prepositus of the parochial church of St. Hedwig of the said city of Berlin.

29 §. 31. Finally, the diocese of Warmia shall consist of the proper actual diocesan territory of the Church subject to the Apostolic See of the same rank, and moreover from the deaneries of Fürstenwerder, Neuteichen, Marienwerder, Stuhm, and Christburg, with their churches both subsidiary and filial, to be separated from the diocese of Culm, so that the entire diocese shall comprise one hundred nineteen parishes.

30 §. 35. We therefore assign and in all spiritual matters subject the aforesaid cities and archiepiscopal and episcopal churches, and likewise the parishes and places attributed to the respective churches for the diocese, and their inhabitants of both sexes, both clergy and laity, to the same churches and their prelates for their respective city, territory, diocese, clergy, and people in perpetuity, so that it shall be lawful for each one, whether already promoted or to be promoted in the future by apostolic authority, through himself or others in their name, after the aforesaid Joseph, bishop of Warmia, shall have caused these present letters to be duly executed, and as to certain provisions now made by Us for then, when the time for their execution as defined above shall have come, to freely apprehend true, real, actual, and corporeal possession of the governance, administration, and all diocesan and ordinary right in the aforesaid cities and their churches and dioceses, as well as goods and other revenues assigned below for their endowment by virtue of these apostolic letters and canonical institution, and to retain what has been apprehended; wherefore immediately and in the places where by this Our disposition the several dioceses now attributed shall have taken possession and their governance shall have been actually obtained, all jurisdiction of the ancients under whatever title of ordinaries, vicars, or administrators shall cease, and all faculties in the parts and places withdrawn from their jurisdiction shall be of no further force or moment. § 36. We indeed, consulting for the utility of the respective diocesans with paternal care, write and enjoin that all and singular documents concerning the churches, dioceses, parishes, and places as above dismembered and newly applied be extracted from the old chanceries and delivered to the chanceries of the dioceses to which they shall be incorporated in appropriate form, and in them shall be perpetually preserved.

31 §. 37. You venerable and beloved brothers, the modern and for the time being existing archbishops of Prague and Olomouc, and the bishops of Naumburg and now Litomyšl, shall likewise conserve in the kingdom of Prussia the same spiritual jurisdiction which you exercise even hereafter. § 38. We separate the filial and parochial churches and their portions not comprehended in this Our disposition and existing outside the kingdom of Prussia from the mother and parochial churches situated in the same kingdom, and mandate that they be applied to the nearest other ordinaries and mother and parochial churches of the dominions to which they are subject in temporal matters; and conversely concerning the parishes and filial churches with their portions situated within the kingdom of Prussia, which depend upon mother churches outside the same kingdom, We decree that the same is to be observed, reserving to Us and this Apostolic See the care of spiritual governance in other parts and places, if need be, to provide. § 39. Having examined the amplitude of the dioceses of the Prussian kingdom and the great number of diocesan cares, since it would be difficult for archbishops and bishops to administer the sacrament of confirmation to the faithful and to exercise other pontifical duties without the work and assistance of another bishop; hence We, confirming the suffragans in the dioceses of the kingdom of Prussia in which they are found, restore them and newly constitute them in the dioceses of Cologne and Trier: and therefore each archbishop and bishop shall beseech Us and Our successor Roman pontiffs according to the prescribed custom, that some ecclesiastical man endowed with suitable requisites be designated for the office of suffragan, and after previous canonical process, with the customary forms observed, provision shall be made for the titular episcopate in partibus infidelium with the accustomed and congruous assignment.

32 § 37. We see that the venerable and modern brothers, and the Archbishops of Prague and Olomouc existing for the time being, as well as the Bishop of Gniezno, and now the Bishop of Litoměřice, shall likewise conserve in the kingdom of Prussia even hereafter the same spiritual jurisdiction which they exercise. § 38. Having examined the extent of the dioceses of the Prussian kingdom, and the great number of the cares of diocesans, since it would be difficult for archbishops and bishops to administer the sacrament of confirmation to the Christian faithful and to exercise other pontifical duties without the work and assistance of another bishop; hence We, confirming the suffragans in the dioceses of the kingdom of Prussia in which they are found, restore them and newly constitute them in the dioceses of Cologne and Trier: and therefore each archbishop and bishop shall beseech Us and Our successors the Roman Pontiffs according to the prescribed custom, that some ecclesiastical man endowed with suitable qualifications be designated for the office of suffragen, and with prior canonical process observed and the customary forms being kept concerning titular bishoprics in the lands of the infidels with the accustomed and suitable assignment, provision shall be made.

33 § 40. Since We have deemed it right to restore the most renowned and most ancient metropolitan see of Cologne to its former dignity rather than to preserve the episcopal see of Aachen, which was erected in some manner twenty-two years ago, yet having regard for some consideration of the city of Aachen, and having also ascertained the ready will of the most serene King of Prussia in this matter, We decree and establish that the church under the title of the Blessed Virgin Mary, formerly cathedral, shall be converted into a collegiate church, and its collegiate chapter shall consist of a single prepositional dignity and six canons, whose collation, as far as the preposition pertains to the Apostolic See, and as far as the canonries pertain to the same Apostolic See alternately to the Archbishop of Cologne, shall be clearly designated; and to these capitular members We grant by special grace the peculiar faculty of wearing a great cope of the color of cordials with fur of ermine in summer, however, omitting the fur, worn over the rochet, and We further grant the faculty of making statutes for themselves in the same manner and form as has been set forth above concerning the canons of cathedral churches, and We will that this be observed. § 41. For the execution of the provisions of Our aforesaid letters, We expressly name, choose, constitute, and depute the venerable brother Joseph, Bishop of Warmia, in whom We have great confidence in the Lord regarding his prudence, learning, and integrity, and We commit to him that he bring all and singular the things disposed by Us to the appointed end, and likewise that he provide vacant churches with suitable pastors, which the first necessity requires to be provided quickly, and that he strive to furnish all ecclesiastical matters to a better state and order, with the necessary means being most benevolently and liberally provided by the aforesaid most serene King of Prussia, who has openly declared the magnanimous spirit of a prince and his most ready will toward the Catholics subject to his empire for establishing dioceses without any delay, and has proposed that they be established and applied in the following manner and method. § 42. Upon the public forests of the kingdom, so many royal tax revenues shall be imposed as there will be dioceses to be endowed, and in that respective quantity, so that from them the annual fruits, entirely free from all works of whatever kind, may be received, which shall be sufficient either for the complete endowment of those dioceses, if they have none at present, or for the supplement of the same endowment if they possess some part of their goods, so that each diocese shall henceforth have those annual revenues which correspond perfectly to the revenues established in the prescribed quantity for the archbishop or bishop's table, for the chapter, for the diocesan seminary, and for the vicar general; and the ownership of such revenues shall be conferred upon each church through instruments to be drawn up in the legitimate and valid form of the kingdom and to be subscribed by the aforesaid king. And since the aforesaid forests, as well as the public goods of the kingdom, are burdened with debts and are subject to hypothecation, and for this reason no revenues can be imposed upon any part of them nor their fruits received, except insofar as they are freed from the bond of hypothecation, diminished by payments made to hypothecary creditors, and a sufficient quantity is liberated according to the law by which the most serene king has provided for public creditors, from the year one thousand eight hundred thirty-three to be freed by magistrates from the bond imposed by him, and which shall still remain, We decree that the aforesaid revenues shall be imposed upon the aforesaid forests from the said year one thousand eight hundred thirty-three or earlier, if the forests shall have been freed from hypothecation before that time for the imposition of revenues; therefore each diocese shall receive the fruits of the aforesaid revenues at least immediately after the year one thousand eight hundred thirty-three; and until the whole year one thousand eight hundred thirty-three, or until the fuller imposition of the said revenues, the same sum of money corresponding to the fruits of the revenues shall be paid to each diocese from the provincial treasuries. Lest, however, the postponement of payment be feared in any way beyond the year one thousand eight hundred thirty-three, should the magistrates perchance intervene to prevent the imposition of revenues without the public debt being diminished, the aforesaid king has voluntarily promised and bound himself in express words that, if this should happen contrary to all expectation, he will take care that so much royal land shall be imposed in full dominion upon the Bullarium Romanum in behalf of individual churches as shall be necessary, so that their annual revenues may equal those sums which would be received from the revenues, had that impediment not intervened. All which things, since the most serene king has promised to secure by diplomas in the valid form of the kingdom to be subscribed by himself, so that they may have full and complete effect in due time; therefore the aforesaid Bishop Joseph shall deliver such diplomas to individual churches to be preserved in their respective archives. § 43. Similar revenues, according to the form of the royal promise, deductions being made for common burdens, shall constitute the following annual endowment sums, namely for the Archbishop of Cologne and for the Archbishops of Gniezno and Poznań twelve thousand Prussian thalers, for the Bishops of Trier, Münster, Paderborn, and Kulm eight thousand thalers of the same currency, for the Bishop of Wrocław truly twelve thousand thalers of the said currency beyond the revenues of the Würben fund pertaining to his episcopal table for the part of the diocese in the Prussian kingdom, the revenues which he receives from the remaining part of the diocese subject to the temporal dominion of Our most beloved son in Christ Francis, Emperor of Austria and King of Hungary and Bohemia, remaining safe; but as regards the endowment of the Warmian episcopal table, with the fixed goods and revenues which that table now enjoys, We declare that nothing is to be changed at present, but that it shall at some time be conformed to the norm of the other tables in the Prussian kingdom, with apostolic authority intervening.

34 § 44. By the same method the chapter of the metropolitan church of Cologne shall be endowed with an annual sum: for the provost two thousand Prussian thalers, for the dean likewise two thousand thalers, for each of the two first canon residentiaries twelve hundred thalers, for each of the following six canons one thousand thalers, for each of the two last canons eight hundred thalers, for each of the four honorary canons one hundred thalers, and finally for each of the eight vicars, or prebendaries, two hundred thalers.

35 § 45. In the archiepiscopal church of Gniezno for the provost and six canons, of which that chapter shall henceforth consist, that amount of revenues shall be preserved which the provost and six senior capitulars now enjoy. In the chapter of the archiepiscopal church of Poznań revenues shall be assigned in the aforesaid manner in an annual sum: for the provost eighteen hundred thalers, for the dean likewise eighteen hundred thalers, for each of the two first canons twelve hundred thalers, for each of the four following canons one thousand thalers, for each of the two last canons eight hundred thalers, for each of the four honorary canons one hundred thalers, and for each of the eight vicars, or prebendaries, two hundred thalers.

36 § 46. In the chapters of the cathedral churches both of Trier and of Paderborn and of Osnabrück, for the provost fourteen hundred thalers, likewise for the dean fourteen hundred thalers, for each of the two first canons one thousand thalers, for the two following nine hundred thalers, for each of the last four eight hundred thalers, for each of the four honorary canons one hundred thalers, and for each of the six vicars, or prebendaries, two hundred thalers. § 47. In the episcopal church of Münster for the provost eighteen hundred thalers, and likewise for the dean eighteen hundred thalers, for each of the two first canons twelve hundred thalers, for each of the following four canons one thousand thalers, for each of the two last eight hundred thalers, for each of the four honorary canons one hundred thalers, and for each of the eight vicars, or prebendaries, two hundred thalers.

37 § 48. In the cathedral church of Kulm for the provost twelve hundred thalers, likewise for the dean twelve hundred thalers, for the first canon one thousand thalers, for the second nine hundred thalers, for each of the remaining six eight hundred thalers, for each of the four honorary canons one hundred thalers, and for each of the six vicars, or prebendaries, two hundred thalers. § 49. In the cathedral church of Wrocław for the provost two thousand thalers, for the dean likewise two thousand thalers, for the first canon holding the prebend of the scholasticus fifteen hundred thalers, for each of the two following eleven hundred thalers, for each of the other seven one thousand thalers, for each of the six honorary canons one hundred thalers, and for each of the eight vicars, or prebendaries, two hundred thalers.

For the maintenance moreover of the buildings, both metropolitan and cathedral churches, including also the suppressed cathedral churches of Corbey and Aachen, and for the expenses of divine worship and those serving it, those goods and revenues shall be preserved also in the future, which are already destined for these uses, and which the most serene king has most diligently promised to preserve; and in case of extraordinary necessity we trust that from the royal treasury liberal provision shall be made for these matters.

44 § 55. To the aforesaid Joseph, bishop, we moreover enjoin that he provide for the suffragans of each archiepiscopal and episcopal church accustomed to congruous endowment, and that to each archbishop and bishop, for satisfying the expenses of vicars general and of the court, he shall grant that quantity of revenues which shall be established by the aforesaid king of Prussia according to his liberal and provident promise made on these titles.

45 § 56. And since the most serene king of Prussia has of his own accord promised to Us that he shall not only preserve those houses both for maintaining aged or infirm priests and for restraining ecclesiastical malcontents, where they exist, but also establish new ones, where they are lacking; therefore we commit to the same Joseph, bishop,

46 that, having learned what the aforesaid king shall have established concerning this matter, and having heard the respective ordinaries of the places, under whose jurisdiction such houses ought to remain, he shall arrange all things that shall be necessary concerning the aforesaid houses and their congruous endowment.

47 § 57. Since moreover in the suppressed cathedral churches of Corbey and Aachen sacred furnishings are found no longer necessary for exercising pontifical functions in them, we grant faculty to the aforesaid Joseph, bishop, that he may freely convert them to the use and benefit of the archiepiscopal church of Cologne, if need be, or otherwise to the use of other churches of the kingdom which may need them.

48 § 58. Having now taken account of the revenues assigned at present to the aforesaid archiepiscopal and episcopal churches of the kingdom of Prussia respectively, in the books of the apostolic chamber as follows, namely the church of Cologne in one thousand florins of camera gold, the churches united together of Gnesen and Posen in likewise one thousand florins, the church of Wrocław in one thousand one hundred sixty-six florins with two-thirds, and the churches of Trier, Münster, Paderborn, Kulm, and Warmia in six hundred sixty-six florins with two-thirds, we command to be fixed.

49 §. 59. But in order that all things disposed by Us as above may be brought to the desired outcome rightly, happily, and speedily, We grant to the aforesaid Joseph, bishop of Warmia, appointed as executor of these letters, all and singular faculties necessary and opportune for such effect, so that with the respective endowments previously made through instruments drawn up in valid form of the realm, he may proceed to the erection or new ordination of each church with its chapter, and to the circumscription of the respective diocesan territory, and may perform and establish all other things as ordained above, delegated to him by apostolic authority, freely and lawfully; and further We likewise grant to the same Joseph, bishop, the faculty that for the full execution of all matters, especially in places remote from his residence, he may subdelegate one or more persons constituted in similar or other ecclesiastical dignity; and both Joseph himself and the person or persons thus to be subdelegated by him may, with the observance of what is to be observed by law, pronounce freely and lawfully, even definitively, and with any appeal whatsoever removed, upon any opposition that may arise in the act of such execution, and each of them respectively may and shall be able to do so. §. 60. To the same Joseph, bishop, We expressly enjoin and command that he transmit to this Apostolic See, within four months from the completion of the execution of these letters, in authentic form, examples of each and every act performed both by himself and by those subdelegated by him in the execution of these letters, to be preserved in the archive of the Congregation entrusted with consistorial matters according to custom. §. 61. Moreover, these present letters and all things contained in them, and any statutes whatsoever, even from the fact that anyone in the foregoing matters, or in any of them, has or pretends to have in the future any right or interest, of whatever status, order, condition, and preeminence, and even those worthy of specific, express, and individual mention, have not consented to them, and that some of them have not been called to the foregoing, or have not been heard at all, or not sufficiently, or from any other cause whatsoever, even of injury or other juridical, privileged, and most privileged cause, color, pretext, and ground, even one closed in the body of law, shall at no time be able to be impugned, attacked, or otherwise infringed, suspended, restricted, limited, or called into question, or restitution in full, opening of the mouth, or any other remedy whatsoever of law, fact, or justice be obtained against them, or under any contrary constitutions, revocations, suspensions, limitations, derogations, modifications, decrees, or declarations general or special made in any way, but shall always be excepted from them and shall be so, and as made from the office of pontifical providence, with certain knowledge, and the fullness of Our power, shall exist with complete firmness perpetually valid and efficacious, and shall obtain and secure their full and complete effects, and shall be perpetually and inviolably observed by all to whom it pertains and shall pertain in any way in the future, and ought to benefit most fully the aforesaid bishops and chapters of churches and others to whom these Our letters pertain, in all and singular of the foregoing matters or on their account, and that they cannot be molested, disturbed, disquieted, or impeded by anyone exercising any authority whatsoever, nor shall they be bound at all to any proof or verification of anything narrated in these same letters, nor shall they be able to be compelled or forced to it in judgment or outside of judgment; and if otherwise anything contrary to this should be attempted by anyone exercising any authority whatsoever, knowingly or unknowingly, We will and decree that it be null and utterly void. §. 62. Notwithstanding the law which is not to be taken away, suppressions to be committed to the parties, the voice of whom is interested, and Our other rules and those of the apostolic chancery, as well as the statutes and customs, even immemorial ones, of the said churches also strengthened by apostolic confirmation or any other firmness; and also privileges, indults, and concessions, however worthy of specific and individual mention, and all and singular apostolic constitutions and ordinances in synodal or general form, even if special, more special, and individual mention, or any other expression should be had, or any other exquisite form should be observed for this, the tenors of which, as if inserted word for word with nothing whatsoever omitted and the form transmitted in them observed, We have as expressed, for the effect of all and singular of the foregoing, most broadly and fully, and specially and expressly, with certain knowledge and the fullness of Our power, We derogate and declare to be derogated, and all other things contrary whatsoever. §. 63. We will moreover that transumpts of these Our letters, even printed ones, subscribed however by the hand of some public notary and furnished with the seal of a person constituted in ecclesiastical dignity, shall everywhere receive the same faith that would be given to these same letters if they were exhibited or shown.

Let no one whatsoever be permitted to infringe upon this page of Our suppression, extinction, annulment, restoration, erection, union, dismemberment, disjunction, separation, aggregation, application, circumscription, concession, indult, enlargement, assignment, supplementation, subjection, attribution, statute, declaration, commission, deputation, mandate, decree, derogation, and will, or to dare to act contrary to it with rash presumption: if anyone, however, should presume to attempt this, let him know that he will incur the indignation of Almighty God and of the blessed Apostles Peter and Paul. Given at Rome at St. Mary Major in the year of Our Lord's incarnation one thousand eight hundred twenty-one, on the seventeenth day before the Kalends of August, in the twenty-second year of Our pontificate.

51 CMLXXXVI.

52 Suppression of parishes in the city of Bisignano and application of their goods to the seminary of the same city. To Our venerable brother the Bishop of Bisignano. Pius, Pope VII. Venerable brother, greetings and apostolic benediction. 1. It was recently set forth to Us by your petition that in this city of Bisignano, which numbers three thousand five hundred inhabitants, there exist fourteen parishes, in some of which only twenty or thirty, but not more than fifty faithful are counted, and in one alone of these, namely the cathedral church, is there a baptismal font; the most holy sacrament of the Eucharist is preserved in only three of the aforesaid parishes; nine of the said parishes, since a great scarcity of priests, and especially capable ones, prevails, are now vacant of rectors, and beyond hope that so many can be found as the number of churches requires. While you show abundance on one side and deficiency on the other; for the diocesan seminary, where clerics are to be educated religiously and instructed in ecclesiastical disciplines, so that in due time they may be able to serve the Church usefully, has been closed for twenty years now, and its meager revenues, not exceeding the sum of two hundred ducats, and unequal to the necessary expenses for sustaining it, will not permit it to be reopened in the future unless they be increased in some way; since therefore the aforesaid parishes abound in the said city, and it is difficult to provide rectors for them, and the seminary, whose usefulness has been ascertained by Us, cannot receive students without new subsidy, you, desiring to provide for the necessity of the aforesaid diocese and to satisfy the wishes of the whole clergy and people, could think of nothing more suited to the matter than to make useful things from useless ones, and you have humbly besought Us that We deign to suppress seven of the said parishes, and to join and incorporate all their revenues, which together amount to the sum of three hundred ducats annually, to the aforesaid seminary in perpetuity. 2. Della salvezza delle anime, per la quale con continua sollecitudine, impegnati nell'ufficio della servitù apostolica per l'incremento della cattolica religione, rivolgiamo costantemente le Nostre cure a tutto ciò che riconosciamo possa essere più atto e utile per procurare il governo spirituale dei Cristifedeli. Con questo proposito abbiamo da tempo rivolto principalmente i Nostri pensieri a quelle regioni che attualmente sono sottoposte al dominio del serenissimo principe Federico Guglielmo re di Prussia, affinché con l'aiuto e la liberalità di lui potessimo disporre la cosa sacra in quelle terre con il migliore metodo che fosse possibile.

2 § 2. Certamente Ci stavano bene dinanzi agli occhi la presente condizione di quelle regioni, e non abbiamo mai cessato di deplorare gli ingenti danni derivati dalle passate perturbazioni delle cose, che le chiese della Germania un tempo floridissime e ricchissime avevano ridotto dal loro antico splendore, nel quale eccellevano, e spostate dei beni che le proteggevano, a uno stato miserabilissimo, dal quale è derivata una somma rovina alla religione cattolica e ai cattolici stessi.

3 § 3. E poiché la condizione dei tempi non permetteva affatto che le chiese dell'inclita nazione germanica fossero richiamate a contemplare il loro antico stato splendido, abbiamo impiegato ogni studio e diligenza affinché a tanti mali preparassimo almeno quei rimedi che apparissero in primo luogo necessari e opportuni per conservare in quelle regioni la fede cattolica e per procurare la salvezza delle anime dei Cristifedeli.

4 § 4. A questi Nostri voti ha meravigliosamente corrisposto il lodato re di Prussia, la cui volontà propensa abbiamo trovato e accogliamo con animo grato verso i cattolici in gran numero a lui sottoposti, specialmente nella grande parte di province attribuite a lui presso il Reno, così che finalmente con esito favorevole e felice possiamo disporre tutte le cose, e secondo la posizione dei luoghi e la comodità degli abitanti costituire ora il nuovo stato delle chiese e i limiti delle diocesi nel regno di Prussia, e quindi dotare i singoli seggi, dove manchino, di propri, degni e idonei pastori. § 5. Avendo dunque per espressamente e parola per parola inseriti tutti gli atti che riguardano l'estinzione o l'alterazione o la riordinazione dei diritti e delle prerogative particolari anteriori delle chiese e dei capitoli, nonché lo smembramento o la nuova applicazione delle rispettive diocesi, e inoltre l'annullamento di qualsiasi precedente diritto metropolitico, e inoltre supplendo pienamente al consenso di chiunque abbia interesse, dalla Nostra certa scienza e matura deliberazione, e dalla pienezza della potestà apostolica, con la previa soppressione, estinzione e annullamento da ora di ogni sorta della vacante sede episcopale di Aquisgrana con il suo capitolo cattedrale, riducendola allo stato di semplice collegiata, come di seguito, e di un'altra chiesa episcopale e capitolo cattedrale di Corbeia, nonché del monastero abbazia denominato Neocellense volgarmente Neuonzell, da ora, e parimenti di un altro monastero abbazia parimenti denominato Olivense, da ora per allora, cioè quando dalla persona del venerabile fratello Giuseppe di Hohenzollern vescovo di Varmia moderno abate di Olivense in qualunque modo sarà vacato; affinché anche i comuni voti dei Germani, accresciuti dalle raccomandazioni regie, perseguiamo con benevolo favore, a gloria di Dio onnipotente e a onore del beato Pietro principe degli apostoli, la chiesa Coloniense, già prima tra le sedi della Germania non seconda ad alcuna per antichità e splendore, sotto l'invocazione del lodato principe degli apostoli, l'abbiamo restituita al grado di chiesa metropolitana, e decretiamo che in esso sia perpetuamente costituita, e ad essa assegniamo come suffraganee le chiese episcopali Trevericense, Monasteriense e Paderborense.

5 § 6. La chiesa episcopale di Posnania parimenti sotto l'invocazione dei santi apostoli Pietro e Paolo l'eleviamo e costituiamo al grado di sede metropolitana; e la medesima all'altra chiesa arcivescovile di Gniezno sotto l'invocazione di sant'Adalberto per la dimissione del venerabile fratello Ignazio Raczynski ultimo arcivescovo di quella, liberamente fatta nelle Nostre mani e da Noi ammessa, ora vacante, parimenti perpetuamente uniamo e aggreghiamo, e al venerabile fratello Timoteo Gorszenski moderno vescovo di Posnania affidiamo pienamente la cura, il governo e l'amministrazione della medesima chiesa di Gniezno, e lo costituiamo e deputiamo arcivescovo di Gniezno e Posnania, e ordiniamo che sia sempre arcivescovo di Gniezno e Posnania e così sia chiamato, e al suo diritto metropolitico assegniamo come suffraganea la chiesa episcopale di Culma.

6 § 7. Le chiese episcopali di Vratislavia e di Varmia dichiariamo che debbono essere e rimanere perpetuamente immediatamente soggette a questa santa Sede. § 8. A ciascuno degli arcivescovi e dei vescovi attribuiamo e confermiamo tutti e singoli i diritti, le preminenze, le prerogative e i privilegi che legittimamente competono agli altri arcivescovi e vescovi di quelle regioni.

7 § 9. Per quanto riguarda il capitolo della chiesa metropolitana di Colonia, in esso erigiamo due dignità, cioè la prepositura, che sarà la maggiore dopo il pontificale, e il decanato secondo, dieci canonicati numerari e quattro canonicati onorari, e inoltre otto vicarie o prebende.

8 § 10. Il capitolo della chiesa arcivescovile di Gniezno consterà d'ora innanzi di una sola dignità di prepositura e di sei canonicati. Il capitolo dell'altra chiesa arcivescovile di Poznań sarà formato da due dignità, cioè di prepositura e di decanato, otto canonicati numerari e altri quattro canonicati onorari, nonché otto vicarie o prebende.

9 § 11. Delle chiese cattedrali di Tre-

10 virense e di Paderborn il capitolo rispettivo consterà di due dignità, una cioè di prepositura e l'altra di decanato, di otto canonicati numerari e quattro canonicati onorari, e di sei vicarie o prebende. § 12. Nella chiesa cattedrale di Monaco-Pisteriensi il capitolo sarà costituito da due dignità, la maggiore cioè di prepositura e la seconda di decanato, e da otto vicarie o prebende.

11 § 13. Il capitolo della chiesa cattedrale di Culm consterà di due dignità, cioè di prepositura e di decanato, di otto canonicati numerari, di quattro canonicati onorari e di sei vicarie o prebende.

12 § 14. Il capitolo della chiesa cattedrale di Vratislavia

13 sarà formato da due dignità, una cioè di prepositura e l'altra di decanato, dieci canonicati numerari, dei quali il primo avrà annessa la prebenda di scolastico, sei canonicati onorari e otto vicarie o prebende.

14 § 15. Infine per quanto riguarda la chiesa cattedrale di Varmia, il suo capitolo rimarrà nello stato in cui ora si trova; riservata tuttavia a Noi e ai Nostri successori romani pontefici la facoltà di conformare d'ora innanzi il medesimo capitolo alla norma delle altre chiese esistenti nel regno di Prussia. § 16. Inoltre in ciascuna delle suddette chiese tanto arcivescovili quanto episcopali la cura abituale delle anime dei parrocchiani risiederà presso il capitolo, quella attuale invece sarà esercitata da uno dei capitolari a ciò espressamente designato e previa approvazione dell'ordinario secondo la forma dei sacri canoni, con l'aiuto dei vicari; e in ciascuno di questi capitoli due canonici idonei dovranno essere stabilmente deputati dall'ordinario, affinché l'uno di essi eserciti l'ufficio di penitenziere e l'altro quello di teologo espositore della sacra Scrittura al popolo nei giorni stabiliti.

15 § 17. A ciascuno certamente dei canonici dei suddetti capitoli, ai quali dichiariamo che non sono obbligati alla residenza personale e al servizio del coro, sarà aperto l'accesso al coro e alle altre funzioni ecclesiastiche come ai canonici residenti; e Noi, per maggior decoro e splendore delle predette chiese, a tutti i suddetti dignità e canonici confermiamo espressamente il privilegio di usare gli stessi insegni di cui prima godevano, e per quanto sia necessario di nuovo concediamo e larggiamo.

16 § 18. A ciascuno similmente dei suddetti capitoli cattedrali ora e per il tempo che sarà, affinché essi capitolarmente congregati provvedano al nuovo e alle circostanze più adatte al governo, all'amministrazione e alla direzione delle medesime chiese arcivescovili ed episcopali e del loro servizio quotidiano del coro, nonché al prospero e felice regime delle cose e dei diritti tanto spirituali quanto temporali, al sostentamento degli oneri che rispettivamente incombono loro, alla riscossione e divisione delle distribuzioni quotidiane e di tutti gli altri emolumenti, all'incorso delle pene da parte di coloro che non assistono agli uffici divini, alla registrazione delle presenze e assenze di ciascuno, all'osservanza delle cerimonie e dei riti, e a qualsiasi altra cosa necessaria e opportuna circa le predette materie, possano fare statuti, ordinazioni, capitoli e decreti, leciti tuttavia e onesti e conformi ai sacri canoni e alle costituzioni Bull. Rom. 7 om. XV.

17 apostoliche, e dai decreti del concilio di Trento in nulla contrari, sotto la presidenza, ispezione, e approvazione dei rispettivi arcivescovi e vescovi edere, e gli editi dichiarare e interpretare, e in migliore forma ridurre e riformare, ovvero altri di nuovo, da coloro a cui spetta, e per il tempo spetterà inviolabilmente osservanda, sotto pene nei contraffattori statuende parimente condere, e edere libere e licitamente valgano. facoltà perpetuamente concediamo e impartiamo. II.r §. 19. Dignità, canonicati e vicari ovvero prebendati numero prefisso tanto nelle metropolitane quanto nelle cattedrali capitoli come sopra, a ciò tanto per questa prima volta quanto per i futuri tempi componenda statuiamo, affinché in posterum chiunque alle dignità e canonicati conseguendi infracritti ornato essere debba requisiti, cioè che i maggiori ordini sacri susceperit, utile all'chiesa opera almeno per quinquennio navaverit, o nell'anime cura esercenda o adjuvanda sese praestiterit, o teologia o sacri canoni professore extiterit, o alicui in regno Prussico existenti vescovo nella diocesana amministrazione munere inservierit, o infine nella sacra teologia o nel diritto canonico dottorato laurea rite fuerit consequutus: ultimamente però di questa condizione effetto da giuste gravi cause per decennio dalla data delle presenti computando in sospeso rimanga. Qualunque vero condizione Ecclesiastici uomini eguale diritto alle dignità e canonicati ottenendo godere debbono decerniamo; similmente statuiamo una nella Monasteriense, e altra nella Vratislaviense cattedrali chiese canonicale prebenda designanda, e da colui, a cui secondo i mesi dopo la nativita pertinebit, sempre e quandocumque conferenda sia uno e all'altro canonica requisita habentibus ex professoribus universitatum nelle dette rispettive città existentium; e ulteriormente decerniamo tanto il preposto della chiesa parrocchiale di santa Edvige della città di Berlino, quanto il decano commissario ecclesiastico nella contea di Glatz pro tempore existentes tra gli onorari canonici della Vratislaviense cattedrale capitolo che cooptandos; così che pari con essi fruano diritto, luogo quello e ordine tenentes, che secondo la rispettiva nominazione tempo ipsis competere dignoscatur. Chiunque però ex canonicis onorari in unumquodque ex antedictis capitulis cooptandus sumendus erit ex numero archipresbiteri animarum cura Digitized by CjOO^Ic Bullarium Romanum in impetiva diocesi laudabiliter exercentium.

18 § 20. Per quanto riguarda poi il nuovo ordinamento dei capitoli suddetti, affinché sia compiuto con la celerità che conviene in questa prima volta, diamo facoltà all'esecutore di queste Nostre lettere di conferire in ciascuna chiesa, tanto le dignità e i canonicati, quanto i vicariati o i prebendati attualmente vacanti, che forse mancheranno per raggiungere il numero da Noi sopra designato, a uomini ecclesiastici degni e idonei, in virtù della speciale facoltà apostolica a lui delegata e nel nome di questa santa Sede; tuttavia in modo che coloro soltanto che da lui saranno provvisti di dignità e canonicati, siano tenuti a ottenere e far spedire dalla Nostra dataria, entro sei mesi prossimi da allora, le lettere apostoliche di nuova provisione e di conferma. E se accadesse che in alcune delle chiese metropolitane o cattedrali esistenti nel regno di Prussia, le dignità, i canonici e i vicari o i prebendati legittimamente e canonicamente istituiti ancora viventi superassero il numero da Noi sopra prefissato, il predetto esecutore apostolico, convocati e ascoltati gli interessati, componga la cosa o mediante abdicazioni volontarie dei loro diritti da emettersi da loro o da alcuni di loro, provvedendo nel contempo al sostentamento di coloro che si dimettono con congrue pensioni vitalizie già promesse dal serenissimo re, oppure se tali abdicazioni non si ottenessero, o non raggiungessero il numero sufficiente, in questo caso coloro che hanno conseguito per ultimo il possesso delle dignità, canonicati e vicariati che superano il numero nella Nostra disposizione sopradetta, se risiedono presso le loro chiese, continueranno rispettivamente ad essere capitolari e vicari, godranno dei diritti e delle prerogative ora loro competenti, e percepiranno i loro redditi nella quantità di cui attualmente godono: ma quando i benefici da loro ottenuti saranno vacati in qualunque modo, non potranno essere conferiti ad altri, e da ora per allora debbono intendersi soppressi e estinti, affinché d'ora innanzi il numero sopra prefissato sia osservato esattamente nei rispettivi capitoli. Se in qualche capitolo i canonici godano attualmente di redditi minori di quelli che saranno assegnati ai loro successori, questi non conseguiranno alcun aumento di redditi se non quando l'esecutore apostolico li avrà singolarmente dotati di redditi più ampi.

19 § 21. Nel futuro inoltre, e quando si verificheranno le successive vacanze, da Noi e dai Nostri successori Romani Pontefici la prepositurale, che è la dignità maggiore dopo quella pontificale nelle suddette chiese arcivescovili e vescovili, nonché nella chiesa di Aquisgrana da erigere in collegiata come appresso, e parimenti i canonicati nei mesi di gennaio, marzo, maggio, luglio, settembre e novembre nelle predette chiese vacanti saranno conferiti, come finora è stato fatto nel capitolo di Breslavia: quanto invece ai decanati nelle predette chiese metropolitane e cattedrali, e ai canonicati tanto in esse quanto nella detta chiesa di Aquisgrana da erigere in collegiata vacanti negli altri sei mesi, saranno conferiti rispettivamente dagli arcivescovi e dai vescovi. I vicariati poi, o prebendati nelle predette chiese, in qualunque mese si verifichino le vacanze, li lasciamo alla collazione dei rispettivi arcivescovi e vescovi.

22 •Pio PP. Settimo mese, nonché delle arcivescovili di Gniezna e di Poznań perpetuamente unite fra loro, rinnovando ordiniamo tuttavia, che i canonici di Gniezna e di Poznań debbano procedere congiuntamente all'elezione dell'arcivescovo. Quanto poi concerne la chiesa episcopale vacante di Breslavia, facciamo speciale potestà ai cinque dignitari in essa esistenti, cioè al preposto, al decano, all'arcidiacono, allo scolastico e al custode, a otto canonici residenti, e a sei canonici onorari, che ora sono i canonici di quella chiesa, affinché alla elezione canonica del nuovo vescovo, secondo il modo e la forma premessi, anche questa prima volta procedere possano e valgano.

23 §. 24. Tutti gli strumenti di tali elezioni redatti in forma autentica saranno inviati alla santa Sede secondo il consueto, dalla quale se l'elezione fosse riconosciuta canonicamente compiuta, e dal processo d'inchiesta poi dal Romano pontefice in singoli casi affidato a uno degli arcivescovi, o vescovi entro i confini del regno di Prussia esistenti, e secondo la forma dell'istruzione per ordine della san. mem. di Urbano VIII Nostro predecessore edita diligentemente redatto, della idoneità dell'eletto consti, tali elezioni da Noi e dai Romani pontefici successori Nostri secondo il consueto statuto per lettere apostoliche saranno confermate.

24 §. 25. In singole città tanto arcivescovili quanto episcopali un seminario di chierici conservarsi, o di nuovo al più presto erigersi stabiliamo, nel quale quel numero di chierici ali, e secondo la forma dei decreti del sacro concilio di Trento istituirsi e educarsi debba, che alle rispettive diocesi ampiezza e necessità corrisponda, e che dall'esecuzione delle presenti lettere convenientemente sarà prefissato: agli arcivescovi però di Gniezna e di Poznań al giudizio e prudenza lasciamo, o in ambedue le città proprio e distinto, o uno soltanto nella città di Poznań, che di ampi edifici consta, per i chierici di ambedue le diocesi seminario stabilire, secondo che l'utilità delle chiese stesse postulasse.

25 §. 26. Volendo ora previa disgregazione, separazione, e mutazione di alcuni luoghi e parrocchie dalla giurisdizione dei precedenti ordinari sottraendosi ad effetto quelli e quelle alle diocesi sottoscritte novellamente aggregandosi e incorporandosi, come più nel Signore opportuno sembrò, e ascoltati anche i venerabili fratelli Nostri della santa Chiesa Romana cardinali alla congregazione di Propaganda Fide preposti, alla nuova circoncrizione delle diocesi procedere, affinché di singole con distinti confini tutte le questioni si tolgano circa l'esercizio della spirituale giurisdizione, la loro distribuzione e divisione dalla pienezza della potestà apostolica decerniamo, prescriviamo secondo il modo che segue, cioè.

26 § 27. La diocesi metropolitana della Chiesa di Colonia sarà formata da seicento ottantasei parrocchie, in parte situate sulla riva sinistra, in parte sulla riva destra del Reno. E sulla riva sinistra comprenderà tutte le parrocchie già contenute nella diocesi di Aquisgrana ora soppressa, che appartengono alle province Coloniese, Düsseldorfina e Aquisgrana, cioè, oltre alle parrocchie delle città di Colonia e Aquisgrana, le chiese cantonali denominate = Bergheimerdorff = Bonna, volgarmente Bonn = Brühl = Kerpen = Lechenich = Lessenich = Lövenich = Meckenheim = Munster = Zülpich = Crefeld = Dahlen = Dormagen = Elsey = Gladbach = Neuss = Uerdingen = Viersen = Bortscheid = Marcodurum, volgarmente Düren = Erkelenz = Eschweiler = Geilenkirchen = Gemund = Heinsberg = Iuliacum, volgarmente Jülich = Linnig = Montjoie = e Nideggen = insieme con le loro chiese sussidiarie e annesse, che si trovano ora in quelle province entro i confini del regno prussiano, separando dalle chiese cantonali le parrocchie sussidiarie e annesse situate fuori del regno: e viceversa aggregando alle chiese cantonali esistenti nel regno le sussidiarie e annesse che prima dipendevano da chiese cantonali situate fuori del regno. Comprenderà inoltre le chiese cantonali appartenenti alla diocesi di Liegi e affidate temporaneamente all'amministrazione del moderno vicario capitolare di Aquisgrana dalla Sede apostolica, cioè le chiese cantonali denominate = Cronenburg = Eupen = Malmedy = Niederkruchtcn = Schleiden = e s. Viti = insieme con le loro sussidiarie e annesse situate nel territorio prussiano, e sei parrocchie sussidiarie denominate = Afden = Alsdorff = Merkslein = Rolduc = Ubach = e Welz = attualmente dipendenti dalla cantonale = Herckraede = situata fuori dal regno prussiano. Inoltre comprenderà diciannove parrocchie della provincia di Aquisgrana finora appartenenti alla diocesi di Treviri denominate = Allendorf = Blankenheim = Dollendorf = Hollerath = Lommersdorf = Manderfeld = Marmagen = Mülheim = Nettersheim = Reifferscheid = Rescheid = Ripsdorff = Rohr = Schmittheim = Schönberg = Steinfeld = Tondorff = Udelhoven = e Wildenburg = con le loro chiese annesse. Sulla riva destra invece del Reno, e nelle province Coloniese, Düsseldorfina e Confluente comprenderà le parrocchie delle regioni = Tuitiense = Düsseldorfina = Essense = e Siegburgense = con le loro sussidiarie e annesse, eccettuate tuttavia la parrocchia = Romershauen = da applicarsi alla diocesi di Paderborn come di seguito, nonché le parrocchie = Hachenburg = e Marienstadt = denominate, che si trovano nel ducato di Nassau.

27 § 28. La diocesi episcopale della chiesa di Treviri sarà sottratta da ogni diritto metropolitico dell'arcivescovo di Malines e assegnata come suffraganea della metropolitana di Colonia, e consisterà entro i confini del regno prussico da seicento trentaquattro parrocchie, cioè sulla riva sinistra del Reno da tutte quelle che attualmente appartengono a quella diocesi e sono contenute nella provincia di Treviri, e inoltre dalla parte ora soppressa della diocesi di Aquisgrana che è contenuta nella provincia della Confluenza, cioè dalla città stessa della Confluenza e dalle chiese cantonali denominate = Ahrdenaù = Ahrweiler = Andernach = Boppard = Castellaun = Cochem = Creuznach = Kaysersesch = Kirchberg = Kirn = Lutzerath = Mayen = Munstermayfeld = Niederzissen = Oberwesel = Polch = Punderich = Remagen = Rubenach = Simmern = Sobernheim = s. Goar = Stromberg = Treiss = Ulroen = Wanderath e Zeli = con le loro succursali e annessi. Inoltre da centotrenta due parrocchie tanto cantonali quanto succursali con i loro annessi, che nella circoscrizione dell'anno milleottocentouno erano state attribuite alla diocesi di Metz, e successivamente commesse all'amministrazione temporanea del vicario capitolare di Treviri dalla Sede apostolica. Sulla riva destra del Reno invece da tutte le chiese del dominio prussico che precedentemente appartenevano alla stessa diocesi trevirana, e che per la circoscrizione delle diocesi galliche da Noi fatta nell'anno milleottocentouno erano state da quella separate, e che attualmente sono amministrate dal vicario apostolico residente nella città di Ehrenbreitstein secondo il Nostro beneplacito. Infine, al di là del predetto numero di seicento trentaquattro parrocchie e dei confini del regno prussico, tutte quelle che si trovano nei territori dei principi di Coburgo, di Homburgo e di Oldenburg già appartenenti alla stessa diocesi di Treviri. § 29. La diocesi episcopale di Münster, chiesa suffraganea della metropolitana di Colonia, sarà formata da duecentottantasette parrocchie, situate entro i confini del regno prussico, e anche altre comprese nel medesimo territorio diocesano al di là dei confini di detto regno, delle quali in altro tempo disporremo secondo il Nostro giudizio e dei Nostri successori Romani Pontefici, come sarà giudicato opportuno nel Signore, riservandoci la facoltà. Aggiungiamo inoltre le regioni denominate = Recklinghausen = Sterkrathen = e Rees = , già dell'antica diocesi di Colonia, esclusa però da quest'ultima regione la parrocchia = Oeffelt = che si trova sotto il dominio temporale del regno del Belgio; e inoltre dalla diocesi di Aquisgrana ora soppressa le chiese cantonali denominate = Calcar = Cleve = Cranenburg = Dulken = Geldern = Goch = Kempen = Meurs = Rheinberg = Wankum = Wesel e Xanten = con le loro succursali e annessi, eccettuate però quelle soggette nel temporale al dominio del re dei Belgi. Aggiungiamo inoltre le parrocchie denominate = Elten = e Emmerich = con la sua filiale, finora sotto le missioni olandesi, e parimenti la parrocchia = Damme = che separiamo dalla diocesi di Osnabrück, e la parrocchia = Oldenburg = che separiamo dalle missioni settentrionali, e che appartengono al dominio del duca di Oldenburg. Infine affidiamo al moderno e per il tempo presente esistente vescovo di Münster, da reggere e amministrare perpetuamente, cinque parrocchie denominate = Brochterbeck = Ibbenbühren = Mettingen = Recke = e Halverde, che erano state commesse all'amministrazione del suffraganeo di Osnabrück secondo il beneplacito della Sede apostolica.

28 § 30. La diocesi episcopale di Paderborn, suffraganea della metropolitana chiesa di Colonia, rimarrà circoscritta nei medesimi limiti in cui ora si trova. Ad essa inoltre aggiungiamo l'altra diocesi ora soppressa di Corbey con l'intero suo territorio amministrato dal venerabile fratello Ferdinando vescovo di Münster, nonché dal territorio transrenano dell'antica diocesi di Colonia i decanati denominati Mesched, Altendorn, Brilon, Wormbach, Medebach e Wallenscheid, con le loro rispettive chiese parrocchiali e filiali, parimente la commessaria di Haaren e la parrocchia di Romershagen; e inoltre i decanati Rittberg e Wiedenbrück, con le loro rispettive chiese parrocchiali e filiali da separarsi dalla diocesi di Osnabrück, nonché le parrocchie denominate Siegen e Oberneukirchen da disgiungere dalla diocesi un tempo di Magonza poi di Ratisbona, la città di Heiligenstadt con il suo decanato, e il decanato di Beuren-Leni, la circoscrizione di Bischofrod, eccettuati tuttavia i decanati di Kulstädten, Lengefeld, Schlochau, Tuchel e Kamenz, da aggiungersi alla diocesi di Culma come di seguito, e inoltre i decanati di Rüttenfeld e Wiesenfeld; inoltre i decanati di Kruszwitz, Inowlazlaw e Gniewkow da separarsi dalle diocesi, e la città di Erfurt con tre parrocchie suburbane, e le parrocchie esistenti nel territorio del granduca di Sassonia, nonché il decanato di Ostrszeszow e Kempnen da disgiungere dalla diocesi di Wratislavia. La divisione e l'assegnazione del territorio diocesano per l'una e l'altra diocesi da statuirsi, affidiamo espressamente all'esecutore delle presenti lettere da compiersi, e le parrocchie di Minden, cioè in Vestfalia, e nella provincia di Sassonia, da amministrarsi perpetuamente dai futuri e pro tempore esistenti vescovi di Paderborn. § 32. La diocesi episcopale della chiesa di Culma, suffraganea dell'arcivescovo di Gniezno e di Poznań, consterà di centocinquanta parrocchie, cioè con le loro rispettive chiese succursali e filiali dai decanati di Lessen, Rhoetden, Neumark, Loebau, Lautenburg, Strasburg, Golub, Thorn, Culm, Culmsee e Gurczno, con la parrocchia denominata Bialutten: le quali ultime due un tempo della diocesi di Plock sono amministrate dal suffraganeo di Culma; parimente dai decanati di Danzica, Putzig, Mirchau, Dirschau, Stargard, Moew, Neuenburg, Schwetz, Lauenburg, Schlochau, Tuchel, Kamenz e Fordon: quali decanati della diocesi di Wladislavia sono ora amministrati dall'antidetto vicario apostolico di Danzica, nonché dal territorio del monastero denominato Olivense come sopra soppresso e ora per allora soltanto dalla persona dell'attuale abate, e comunque vacasse. E poiché Ci fu esposto che a Culma mancano case convenienti per l'abitazione del vescovo e del capitolo, concediamo facoltà all'esecutore delle presenti lettere apostoliche, uditi gli interessati e mature considerate le cose, affinché, rimanendo fermo il titolo e la denominazione dell'episcopato di Culma e assegnate opportune chiese e edifici per la residenza del vescovo e del capitolo di Culma, se così giudicherà opportuno nel Signore, eserciti la giurisdizione spirituale: e inoltre altri luoghi e parrocchie da disgiungere dalla diocesi un tempo di Magonza, poi di Ratisbona, e amministrati precedentemente dal vescovo di Corbey, ora di Münster, saranno parimente affidati all'amministrazione del vicario apostolico. § 31. Le diocesi dell'arcivescovado di Gniezno e di Poznań, perpetuamente unite fra loro e parimente principali, formeranno un'unità. E quelle che sono contenute in esse dopo la recentissima circoscrizione delle diocesi del regno di Polonia da Noi compiuta, nonché le parrocchie denominate Wittichenau, Gunthorsdorf, Hennersdorf, Pfaffendorf, Ublersdorf, amministrate fino ad ora dal decano della collegiata chiesa di san Pietro della città di Bautzen in Lusazia superiore: le quali tutte insieme entro i confini del regno prussiano ascenderanno al numero di seicentoventuno parrocchie. Conserverà inoltre quelle che possiede nel territorio austriaco. I futuri inoltre e pro tempore esistenti vescovi di Wratislavia avranno perpetuamente sottoposte alla loro amministrazione quelle parrocchie che dal vicario apostolico delle missioni settentrionali sono state fino ad ora amministrate nelle città di Berlino, Potsdam, Spandau, Francoforte sull'Oder, Stettino e Stralsunda, e che in avvenire in virtù della subdelegazione del vescovo di Wratislavia saranno amministrate dal suddetto preposto della chiesa parrocchiale di santa Edvige della medesima città di Berlino.

29 §. 31. Infine la diocesi di Varmia sarà soggetta immediatamente alla Sede apostolica e consisterà dal territorio diocesano proprio e attuale, e inoltre dai decanati di Fürstenwerder, Neuteichen, Marienburgo, Stuhm e Christburg, con le loro chiese tanto sussidiarie quanto filiali, da separarsi dalla diocesi di Culm, in modo che l'intera diocesi comprenda centodicianove parrocchie.

30 §. 35. Le predette città e chiese arcivescovili e vescovili, nonché le parrocchie e i luoghi rispettivamente attribuiti alle medesime chiese per la diocesi, e i loro abitanti di ambo i sessi, tanto chierici quanto laici, li assegniamo perpetuamente alle medesime chiese e ai loro presuli per la rispettiva città, territorio, diocesi, clero e popolo, e li sottoponiamo in spiritualibus in ogni modo, affinché a ciascuno dei presuli, sia già promosso sia in futuro da promuoversi con autorità apostolica, sia lecito per sé o per altri in loro nome, dopo che tuttavia il suddetto Giuseppe vescovo di Varmia avrà mandato ad esecuzione le presenti lettere con il debito, e per quanto riguarda alcune disposizioni ora da Noi fatte per allora, quando il tempo per la loro esecuzione come sopra definito sarà giunto, di apprendere liberamente vera, reale, attuale e corporale possessione del governo, dell'amministrazione e di ogni diritto diocesano e ordinario nelle predette città e nelle loro chiese e diocesi, nonché dei beni e altri redditi assegnati di seguito per la loro dotazione, in virtù di queste lettere apostoliche e della canonica istituzione, e di mantenerla appresa; perciò stesso, non appena e nei luoghi per questa Nostra disposizione singolarmente attribuiti alle diocesi abbiano preso possessione e abbiano conseguito il governo in atto, dovrà cessare ogni giurisdizione degli antichi ordinari, sotto qualunque titolo di vicari o amministratori, e tutte le facoltà nelle parti e nei luoghi sottratti dalla loro giurisdizione non avranno più alcuna forza o valore. § 36. Noi infatti, consultando l'utilità dei rispettivi diocesani con sollecitudine pastorale, prescriviamo e ingiungniamo che tutti e singoli i documenti riguardanti le chiese, le diocesi, le parrocchie e i luoghi come sopra smembrati e di nuovo applicati siano estratti dalle antiche cancellerie e consegnati nella forma opportuna alle cancellerie delle diocesi alle quali saranno incorporati, e in esse debbano essere conservati perpetuamente.

31 §. 37. Voi invece, venerabili fratelli nostri, arcivescovi di Praga e di Olomouc, e vescovi di Naumburgo e ora di Litoměřice, conserverete anche in futuro nel regno di Prussia la medesima giurisdizione spirituale che finora esercitate. § 38. Le chiese filiali e parrocchiali e le loro frazioni non comprese nella Nostra disposizione e esistenti fuori del regno di Prussia le separiamo dalle matrici e dalle parrocchiali poste nello stesso regno, e ordiniamo che siano applicate ai più prossimi ordinari altre matrici e parrocchiali dei territori ai quali in temporalibus sono soggette; e viceversa per le parrocchie e le chiese filiali con le loro frazioni poste entro il regno di Prussia, che dipendono da matrici esistenti fuori dello stesso regno, lo stesso deve osservarsi, riservandoci Noi e a questa Sede apostolica la cura del governo spirituale in altre parti e luoghi, se fosse necessario, di provvedere. § 39. Considerata l'ampiezza delle diocesi del regno di Prussia, e il gran numero dei diocesani, poiché sarebbe difficile agli arcivescovi e ai vescovi amministrare il sacramento della confermazione ai fedeli e compiere altri uffici pontificali senza l'opera e l'aiuto di un altro vescovo; perciò Noi, confermando i suffraganei nelle diocesi del regno di Prussia nei quali si trovano costituiti, li rintegriamo e di nuovo li costituiamo nelle diocesi di Colonia e di Treviri: e perciò ciascun arcivescovo e vescovo supplicherà Noi e i Nostri successori Romani Pontefici secondo il prescritto modo, affinché qualche uomo ecclesiastico fornito dei requisiti opportuni sia designato al munus di suffraganeo, e previo il processo canonico, osservate le consuete forme di episcopato titolare in partibus infidelium con la congrua assegnazione consueta, sia provveduto.

32 § 37. Vedranno tuttavia i venerabili comuni fratelli moderni e pro tempore esistenti arcivescovi di Praga e di Olomouc, ordinariamente non vescovi di Naumburgo e ora di Litormerice, conserveranno la medesima giurisdizione spirituale che esercitano nel regno di Prussia anche in avvenire. § 38. Le chiese filiali invece e parrocchiali di Delmold, le loro frazioni non comprese nella nostra disposizione ed esistenti fuori del regno di Prussia le separiamo dalle matrici e dalle parrocchiali poste nello stesso regno, e ordiniamo che siano applicate ai più prossimi ordinari altre matrici e parrocchiali dei territori ai quali sono soggette nelle temporalità; parimenti delle parrocchie e chiese filiali con le loro frazioni poste entro il regno di Prussia, che dipendono da matrici situate fuori dello stesso regno, decerniamo che si osservi lo stesso, riservato a Noi e a questa Sede apostolica il provvedere alla cura del regime spirituale in altre parti e luoghi, se sarà necessario. § 39. Considerata l'ampiezza delle diocesi del regno di Prussia, e il gran numero dei curati diocesani, poiché difficile sarebbe agli arcivescovi e ai vescovi amministrare il sacramento della confermazione ai cristiani fedeli e compiere altri muneri pontificali senza l'opera e l'aiuto di un altro vescovo; perciò Noi, confermando i suffraganei nelle diocesi del regno di Prussia nei quali si trovano costituiti, li rintegriamo e di nuovo li costituiamo nelle diocesi di Colonia e di Treviri: e perciò ciascun arcivescovo e vescovo supplicherà Noi e i nostri successori Romani pontefici secondo la norma prescritta, affinché qualche uomo ecclesiastico fornito dei requisiti opportuni sia designato al munere di suffraganeo, e con previo processo canonico, osservate le consuete forme di episcopato titolare nelle parti dei miscredenti con la congrua assegnazione consueta, sia provveduto.

33 § 40. Poiché abbiamo ritenuto opportuno di restaurare la celebre e antichissima sede arcivescovile di Colonia piuttosto che conservare la sede episcopale di Aquisgrana, eretta in certo modo novanta due anni fa, tuttavia dovendo avere riguardo a una certa ragione della città di Aquisgrana, conosciuta anche la volontà propensa del serenissimo re di Prussia, decerniamo e stabiliamo che la chiesa sotto il titolo della beata Maria vergine, già cattedrale in Colonia, sia mutata in collegiata, e il suo capitolo collegiale consti di una sola dignità di preposto e di sei canonici, la cui collazione, per quanto riguarda la prepostura, spetti alla Sede apostolica, e per quanto riguarda i canonicati, spetti alternativamente alla medesima Sede apostolica e all'arcivescovo di Colonia; inoltre concediamo a questi canonici, con particolare grazia, la facoltà di portare una cappa di colore cordiale con pelliccia di ermellino nel tempo estivo, e nel tempo invernale una rocchetta, e inoltre concediamo loro la facoltà di stabilire statuti secondo il medesimo modo e forma di cui è stato detto sopra riguardo ai titoli delle chiese cattedrali, e lo permettiamo. § 41. Per l'esecuzione delle presenti Nostre lettere, nominiamo, eleggiamo, costituiamo e deputiamo espressamente il venerabile fratello Giuseppe, vescovo di Warmia, del quale abbiamo grande fiducia nel Signore riguardo alla prudenza, dottrina e integrità, e gli affidiamo il compito di condurre a termine tutto ciò che da Noi è stato disposto, e parimenti di provvedere alle chiese vacanti con pastori idonei, che la prima necessità richiede di provvedere celermente, e di sforzarsi di dotare convenientemente e solidamente tutte le chiese per ricondurre le cose ecclesiastiche a migliore stato e ordine, fornendo benevolmente e generosamente i mezzi necessari a ciò il già lodato serenissimo re di Prussia, il quale con animo da grande principe e con volontà propenssissima verso i cattolici sottoposti al suo imperio ha apertamente dichiarato di ordinare senza alcun indugio le diocesi in tutto il regno di Prussia, e ha proposto che siano stabilite e applicate secondo la seguente ragione e modo. § 42. Sulle foreste pubbliche del regno, designando tanti censi con autorità regia si impongano quante saranno le diocesi da dotarsi, e in quella rispettiva quantità, affinché da essi si percepiscano annualmente i frutti liberi da ogni genere di opere, i quali siano sufficienti sia al completamento della dotazione delle medesime diocesi, se attualmente non ne abbiano alcuna, sia al supplemento della medesima dotazione se possiedano ancora una parte dei loro beni, in modo che singole diocesi abbiano d'ora innanzi quei redditi annuali che corrispondano perfettamente ai redditi stabiliti in quantità designata inferiormente per l'arcivescovo, o per il vescovo, per il capitolo, per il seminario diocesano e per il seminario maggiore; e la proprietà di questi censi sarà conferita a ciascuna chiesa per mezzo di strumenti da stipularsi in forma legittima e valida del regno e da sottoscriversi dal già lodato re. E poiché le suddette foreste, come pure i beni pubblici del regno, sono gravati da ipoteca e sono lontani dal governo, e su nessuna loro parte si può imporre censo e percepirne i frutti, salva la fedepromissione, se non dopo che, diminuita la somma dell'estero per i pagamenti fatti ai creditori ipotecari, una quantità sufficiente di beni sia stata liberata dal vincolo di ipoteca secondo la legge con cui il serenissimo re ha provveduto ai creditori pubblici, dal magistrato nel milleottocentotrentesimo terzo anno da lui vincolato, e quelli che ancora rimarranno vincolati, decerniamo che i predetti censi sui suddetti boschi nel detto anno milleottocentotrentesimo terzo, o anche prima se i predetti boschi fossero stati prima liberati dalle ipoteche per la quantità dei censi da imporsi, siano da imporsi; perciò singole diocesi, almeno immediatamente dopo l'anno milleottocentotrentesimo terzo, abbiano a percepire i frutti dei predetti censi; e fino a tutto l'anno milleottocentotrentesimo terzo, o fino alla più piena imposizione dei detti censi, la medesima somma di denaro corrispondente ai frutti dei censi sia da numerarsi a ciascuna diocesi dagli erari provinciali. Affinché però in nessun modo la proroga della numerazione oltre l'anno milleottocentotrentesimo terzo possa essere temuta, qualora per caso i magistrati intercedessero perché i censi non siano imposti, non diminuita la quantità del debito pubblico, il lodato re ha spontaneamente promesso e con parole espresse si è obbligato che, se al di là di ogni aspettativa ciò accadesse, avrà cura che tanti campi del re siano impegnati in pieno dominio al Banco Romano per singole chiese da consegnarsi, quanti siano necessari affinché i loro redditi annuali uguaglino quelle somme che sarebbero percepite dai censi, se quell'impedimento non fosse intervenuto. Tutte queste cose, poiché il serenissimo re ha promesso di mettere al sicuro per mezzo di diplomi da sottoscriversi da lui in forma valida del regno, affinché abbiano pieno e integro effetto a suo tempo; quindi il suddetto Giuseppe, vescovo, consegnerà questi diplomi a singole chiese da conservarsi nei rispettivi archivi. § 43. Simili redditi secondo la forma della Promissione regia, dedotti gli oneri comuni, dovranno costituire le seguenti somme annuali di dotazione, cioè per l'arcivescovo di Colonia e per l'arcivescovo di Gniezno e Poznań dodici mila taleri prussiani, per i vescovi di Treviri, Münster, Paderborn e Kulm ottomila taleri della medesima moneta, per il vescovo di Breslavia invece dodici mila taleri della detta moneta oltre i redditi del fondo Würben spettanti alla sua mensa episcopale per la parte della diocesi nel regno di Prussia, rimanendo salvi quei redditi che percepisce dalla restante parte della diocesi sottoposta al dominio temporale del carissimo in Cristo Nostro figlio Francesco, imperatore d'Austria e re apostolico d'Ungheria e Boemia; per quanto invece riguarda la dotazione della mensa episcopale di Warmia, dichiaramo che non si deve innovare nulla nei beni e redditi di cui attualmente gode quella mensa, ma che dovrà essere conformata in qualche tempo alla norma delle altre mense nel regno di Prussia, intervenendo l'autorità apostolica.

34 § 44. Con il medesimo metodo il capitolo della chiesa metropolitana di Colonia sarà dotato in somma annua di talleri prussici duemiladuecento per il preposto, di duemiladuecento talleri per il decano, di milleduecento talleri per ciascuno dei due primi canonici numerari, di mille talleri per ciascuno dei sei canonici seguenti, di ottocento talleri per ciascuno dei due ultimi canonici, di cento talleri per ciascuno dei quattro canonici onorari, e infine di duecento talleri per ciascuno degli otto vicari, ossia prebendati.

35 § 45. Nella chiesa arcivescovile di Gniezno per il preposto e i sei canonici, di cui il capitolo consterà in avvenire, sarà conservata quella quantità di rendite di cui il preposto e i sei canonici capitolari seniori attualmente godono. Nel capitolo della chiesa arcivescovile di Poznań le rendite saranno assegnate nel modo predetto in somma annua di milleottocento talleri per il preposto, di milleottocento talleri parimente per il decano, di milleduecento talleri per ciascuno dei due primi canonici, di mille talleri per ciascuno dei quattro seguenti, di ottocento talleri per ciascuno dei due ultimi, di cento talleri per ciascuno dei quattro canonici onorari, e di duecento talleri per ciascuno degli otto vicari, ossia prebendati.

36 § 46. Nei capitoli delle chiese cattedrali tanto di Treviri quanto di Paderborn e di Paderborn, per il preposto milleaquattrocentoalleri, parimente per il decano milleaquattrocentoalleri, per ciascuno dei due primi canonici mille talleri, per i due seguenti novecento talleri, per ciascuno degli ultimi quattro ottocento talleri, per ciascuno dei quattro canonici onorari cento talleri, e per ciascuno dei sei vicari, ossia prebendati, duecento talleri. § 47. Nella chiesa episcopale di Münster per il preposto milleottocento talleri, e parimente per il decano milleottocento talleri, per ciascuno dei due primi canonici milleduecento talleri, per ciascuno dei quattro seguenti mille talleri, per ciascuno dei due ultimi ottocento talleri, per ciascuno dei quattro canonici onorari cento talleri, e per ciascuno degli otto vicari, ossia prebendati, duecento talleri.

37 § 48. Nella chiesa cattedrale di Kulm per il preposto milleduecento talleri, parimente per il decano milleduecento talleri, per il primo canonico mille talleri, per il secondo novecento talleri, per ciascuno dei rimanenti sei ottocento talleri, per ciascuno dei quattro canonici onorari cento talleri, e per ciascuno dei sei vicari, ossia prebendati, duecento talleri. § 49. Nella chiesa cattedrale di Wrocław per il preposto duemilatalleri, per il decano parimente duemilatalleri, per il primo canonico che ottenga la prebenda di scolastico millecinquecento talleri, per ciascuno dei due seguenti millecentotalleri, per ciascuno degli altri sette mille talleri, per ciascuno dei sei canonici onorari cento talleri, e per ciascuno degli otto vicari, ossia prebendati, duecento talleri.

38 § 50. Nella chiesa episcopale di Warmia dichiariamo che nulla deve essere mutato al presente circa la dotazione e la forma del suo capitolo, riservata tuttavia a Noi e ai Nostri successori pontefici romani la facoltà di conformarle talvolta

39 alla norma delle altre chiese del regno di Prussia.

40 § 51. La chiesa di Aquisgrana inoltre, da Noi costituita in collegiata come sopra, avrà un capitolo constante di una sola dignità di preposto e di sei canonicati, conservando la medesima somma di rendite annue di cui attualmente gode.

41 § 52. Affidiamo parimente al suddetto Giuseppe vescovo di Warmia, affinché nei seminari dei chierici da stabilirsi opportunamente in ciascuna diocesi, rimanendo ferma la possessione dei beni che attualmente posseggono, assegni loro le dotazioni di beni, intere o parziali, secondo che la necessità e l'utilità richiederà, che saranno fornite dalla promessa liberalità del serenissimo re di Prussia.

42 rum seminari in qualunque diocesi opportunamente da stabilirsi, rimanendo ferma il possesso dei beni che al presente posseggono, assegni loro, sia parziali che integrali, secondo che la necessità e l'utilità richiederà, dotazioni di beni, che saranno fornite dalla promessa liberalità del serenissimo re di Prussia.

43 §. 53. Ordiniamo inoltre al medesimo Giuseppe vescovo, che per la conveniente residenza di ciascun presule, o i vecchi episcopi, se comodamente si potrà, o altrimenti case ad ciò dal predetto re nelle rispettive città concedende; e inoltre altre case in campagna, se facilmente si potrà, assegnate; parimenti case per le dignità, canonici, e vicari, o prebendali, nonché per la curia ecclesiastica, per il capitolo, e l'archivio da attribuirsi; opportunamente stabilisca e assegni. 54. Per il mantenimento poi delle fabbriche, tanto metropolitane, quanto cattedrali delle chiese, compresi anche i soppressi episcopi di Corbeia e di Aquisgrana, e per le spese del culto divino e dei ministri, quei beni e rendite anche in futuro si conserveranno, che a questi usi già sono destinati, e che il serenissimo re diligentissimamente osserverà secondo la sua promessa; e in caso di straordinaria necessità confidiamo che dal tesoro regio liberalmente si provvederà a queste cose.

44 §. 55. Al predetto Giuseppe vescovo inoltre ingiungamo, che della congrua dotazione assuefattasi a ciascuna chiesa arcivescovile e vescovile suffraganea provveda, e che ai singoli arcivescovi e vescovi per soddisfare alle spese dei vicari generali e della curia quella quantità di rendite attribuisca, che dal prelodata re di Prussia secondo la sua liberale e provvida promessa fatta su questi titoli sarà costituita.

45 §. 56. E poiché il serenissimo re di Prussia ulteriormente a Noi ha promesso che non solo quelle case tanto per mantenere i vecchi sacerdoti emeriti, o infermi, quanto per correggere i discoli ecclesiastici, dove esistono, conserverà, ma anche nuove, dove mancano, costruirà; perciò al medesimo Giuseppe vescovo affidiamo,

46 che conosciute quelle cose che su questa materia avrà stabilito il prelodata re, ascoltati i rispettivi ordinari dei luoghi, sotto la cui giurisdizione queste case dovranno rimanere, tutto ciò che sarà necessario circa le ricordate case e la loro congrua dotazione disponga.

47 §. 57. Poiché però nelle soppresse cattedrali chiese di Corbeia e di Aquisgrana si trovino suppellettili sacre per i pontificali in esse esercitare non più necessarie, la facoltà al predetto Giuseppe vescovo concediamo, che esse nell'uso e comodo della chiesa arcivescovile Coloniense, se sarà necessario, altrimenti nell'uso di altre chiese del regno, che ne abbiano bisogno, liberamente possa convertire.

48 §. 58. Avuta ora considerazione delle rendite alle suddette chiese arcivescovili e vescovili del regno di Prussia al presente rispettivamente assegnate, nei libri della camera apostolica come segue, cioè la chiesa Coloniense in fiorini mille d'oro di camera, le chiese insieme unite Gnesnense e Posnaniense in fiorini parimente mille, la chiesa Vratislaviense in fiorini mille centosessantasei con due terzi, e le chiese Trevericnse, Monastericnse, Paderborncnse, Culmensc, e Varmicnse in fiorini seicentosessantasei con due terzi ridurre ordiniamo.

49 § 59. Affinché tuttavia tutte le cose da Noi come sopra disposte si conducano rettamente, felicemente e celermente al desiderato esito, al suddetto Giuseppe vescovo di Warmia, deputato esecutore di queste lettere, concediamo tutte e singole le facoltà necessarie e opportune a tale effetto, affinché, previe le rispettive dotazioni per strumenti da redigersi in forma valida del regno, possa procedere all'erezione o nuova ordinazione di ciascuna chiesa con il suo capitolo e alla circoscrizione del rispettivo territorio diocesano, e possa compiere e statuire tutte le altre cose come sopra ordinate, delegategli con apostolica autorità liberamente e lecitamente; e inoltre al medesimo Giuseppe vescovo parimenti attribuiamo la facoltà di subdelegare, per la piena esecuzione di tutte le cose soprattutto in luoghi remoti dalla sua residenza, una o più persone costituite in simile o altra dignità ecclesiastica; e tanto lo stesso Giuseppe quanto la persona o le persone da lui così subdelegatae, possono e valeono pronunciare liberamente e lecitamente, anche definitivamente, su qualsiasi opposizione che per qualche modo sorga nell'atto di questa esecuzione, osservate tuttavia le cose che di diritto devono osservarsi, e con qualsiasi appello rimosso, e ciascuno di essi rispettivamente può e vale. § 60. Al medesimo Giuseppe vescovo espressamente ingiungamo e comandiamo che gli esemplari di tutti gli atti tanto da lui stesso quanto da coloro da lui subdelegati da redigersi nell'esecuzione di queste lettere, entro quattro mesi dal completamento della medesima esecuzione, trasmetta a questa Sede apostolica in forma autentica, da conservarsi nel modo consueto nell'archivio della congregazione preposta alle cose consistoriali. § 61. Le presenti lettere e tutto ciò che in esse è contenuto e qualsiasi statuto, benché chiunque nei premessi o in alcuno di essi abbia diritto o interesse, o per qualche modo in futuro pretenda di avere, di qualsiasi stato, ordine, condizione e preminenza, e anche specificamente, espressamente e individualmente degno di menzione, non vi abbia consentito, e benché alcuni di essi ai premessi non siano stati affatto chiamati, o nemmeno sufficientemente ascoltati, o per qualsiasi altra causa anche di lesione o altra causa giuridica, privilegiata e privilegiatissima, colore, pretesto e capo anche nel corpo del diritto chiuso, in nessun tempo mai possano essere notate, impugnate o altrimenti infrante, sospese, ristrette, limitate o poste in controversia, né contro di esse possano ottenersi restituzione in integrum, apertura della bocca o qualsiasi altro rimedio di diritto, di fatto o di giustizia, né possano comprendersi sotto qualsiasi costituzione contraria, revoca, sospensione, limitazione, deroga, modificazione, decreto o dichiarazione generale o speciale comunque fatta, ma sempre da quelle eccettuate siano e rimangano, e come emanate dall'ufficio della provvidenza pontificia, con certa scienza e dalla pienezza della Nostra potestà, con ogni fermezza perpetuamente valide ed efficaci esistano e rimangano, e i loro pieni e interi effetti conseguano e ottengano, e da tutti coloro a cui spetta e spetterà comunque in futuro perpetuamente e inviolabilmente si osservino, e alle suddette chiese, ai loro vescovi e capitoli e agli altri a favore dei quali le Nostre presenti lettere si riferiscono, perpetuamente nei tempi futuri pienissimamente giovino, e gli stessi sui premessi tutti e singoli, o per causa loro da chiunque rivestito di qualsiasi autorità comunque non possano essere molestati, perturbati, inquietati o impediti, né alla prova o verifica di qualsiasi cosa narrata nelle medesime presenti lettere siano mai tenuti, né a ciò in giudizio o fuori di esso possano essere costretti o compelli, e se diversamente su queste cose da chiunque rivestito di qualsiasi autorità consapevolmente o inconsapevolmente accadesse di tentare, irrito e completamente nullo vogliamo sia e rimanga. § 62. Non ostante le cose di diritto, non togliendo il diritto, le soppressioni da commettere alle parti, vocali di cui interessi, e le altre Nostre e della cancelleria apostolica regole, nonché gli statuti e le consuetudini anche immemorabili delle suddette chiese anche confermate da apostolica conferma o da qualsiasi altra fermezza, i privilegi inoltre, gli indulti e le concessioni benché specificamente e individualmente degni di menzione, e tutti e singoli gli apostolici e nei sinodali o generali costituzioni e ordinazioni e forme, benché speciale, più speciale e individuale menzione o qualsiasi altra espressione dovesse aversi o qualche altra forma esquisita a ciò dovesse osservarsi, i cui tenori, come se da parola a parola nulla affatto omesso e la forma in essi tramandata osservata fossero inseriti nelle presenti, avendo per espressi, ai premessi tutti e singoli effetti latissimamente e pienissimamente e specialmente e espressamente da certa scienza e dalla pienezza della Nostra potestà parimente deroghiamo, e derogatae essere dichiariamo, e a tutte le altre cose contrarie comunque. § 63. Vogliamo inoltre che ai transunti anche stampati di queste Nostre lettere, sottoscritti tuttavia da mano di qualche notaio pubblico e muniti del sigillo di persona costituita in dignità ecclesiastica, la medesima fede in ogni luogo sia prestata, quale prestata sarebbe alle medesime presenti, se fossero esibite o mostrate.

Nessun uomo dunque assolutamente sia lecito infrangere questa pagina della Nostra soppressione, estinzione, annullamento, restituzione, erezione, unione, dismembrazione, disgiunzione, separazione, aggregazione, applicazione, circoscrizione, concessione, indulto, elargizione, assegnazione, supplenza, soggezione, attribuzione, statuto, dichiarazione, commissione, deputazione, mandato, decreto, deroga, e volontà, oppure osare di contravvenirvi temerariamente: se qualcuno invece avrà osato tentare ciò, sappia che incorrerà nell'indignazione di Dio onnipotente e dei beati apostoli Pietro e Paolo. 52 Soppressione di parrocchie nella città di Bisignano e applicazione dei loro beni al seminario della medesima città. Al venerabile fratello Vescovo di Bisignano. Pio pp. VII. Venerabile fratello, salute e benedizione apostolica. 1. Ci è stato esposto di recente dalla tua relazione che nella città di Bisignano, la quale conta tremila e cinquecento abitanti, esistono quattordici parrocchie, nelle quali in alcune si contano venti o trenta, ma non più di cinquanta fedeli, e in una sola di esse, cioè nella chiesa cattedrale, si trova il fonte battesimale; il santissimo sacramento dell'Eucaristia invece si conserva in sole tre; nove delle predette parrocchie, poiché vigora una grande penuria di sacerdoti, e specialmente di idonei, sono ora prive di rettori, e al di là della speranza che se ne trovino tanti quanti sono necessari per il numero delle chiese. Mentre da una parte mostri l'abbondanza, dall'altra la deficienza; infatti il seminario diocesano, dove i chierici devono essere educati religiosamente e istruiti nelle discipline ecclesiastiche, affinché al tempo opportuno possano servire utilmente la Chiesa, è chiuso da venti anni, e i suoi esigui redditi, che non superano la somma di duecento ducati, e insufficienti alle spese necessariamente da sostenersi, non permetteranno di riaprirlo in futuro, se non vengano aumentati in qualche modo; poiché dunque le predette parrocchie nella detta città abbondano, ed è difficile provvederle di rettori, mentre il seminario, della cui utilità Ci è noto che senza nuovo sussidio non può ricevere alunni, tu, desiderando provvedere alla necessità della predetta diocesi e soddisfare a tutti il clero e il popolo, non hai potuto escogitare nulla di più conveniente alla cosa che rendere utili le cose inutili, e infatti ci hai umilmente supplicato affinché sopprimessimo sette delle dette parrocchie, e tutti i loro redditi, che computati insieme portano annualmente la somma di trecento ducati, li unissimo e incorporassimo perpetuamente al predetto seminario. 2. Noi dunque, volendo prosequire te e le singole persone alle quali le presenti Nostre lettere perverranno con speciali grazie e favori, e assolvendo da qualsiasi scomunica, sospensione e interdetto, e da altre censure, sentenze e pene ecclesiastiche comunque e per qualunque causa inflitte, se per caso le hai incorse o le incorreranno, assolvendo e assolvendo per questa sola ragione, inclinati alle supplicazioni poste innanzi a Noi nel tuo nome, nella misura in cui in Domino procederai con prudenza, ti concediamo facoltà di ridurre le quattordici parrocchie predette, purché non siano di diritto di patronato, nel qual caso è necessario l'assenso dei patroni, né di quelle che al presente hanno rettore senza il cui esplicito consenso nulla può essere innovato, a sole sette, con la Nostra autorità apostolica, tracciandone nuovi confini secondo il tuo arbitrio e prudenza, e di applicare, unire e incorporare perpetuamente al seminario diocesano predetto tutti e singoli i frutti, redditi e proventi delle parrocchie che avrai giudicato dover essere soppresse, con la detta Nostra autorità, non essendo tuttavia rilasciato l'obbligo del seminario predetto di soddisfare agli oneri, e specialmente ai legati di messe, se ve ne siano gravanti sulle predette prebende; le facoltà necessarie e opportune ti concediamo e impartiamo con la detta Nostra autorità apostolica, per mezzo del tenore delle presenti. § 3. Decernendo che queste presenti lettere siano sempre ferme, valide ed efficaci, e siano, e ottengano i loro pieni e interi effetti, e a coloro ai quali spetta, e per il tempo in cui spetterà, in ogni cosa e per ogni cosa pienamente giovino, e da tutti rispettivamente inviolabilmente si osservino; e così in quanto precede da qualsiasi giudice ordinario e delegato, anche dai revisori delle cause del palazzo apostolico, debba giudicarsi e definirsi, e sia irritum e vano, se diversamente da chiunque con qualsiasi autorità consapevolmente o inconsapevolmente fosse tentato contro queste cose.
