LITTERAE APOSTOLICAE SS. D. N. LEONIS PP. XIII

Quamobrem, anno MDXCVIII, a Clemente VIII decessore Nostro facultatem iam impetraverant, qua Hospitium in ecclesiasticum colle verteretur.

14 II. Collegii unus e S. R. E. Cardinalibus Patronus esto, quem Pontifex Maximus destinabit.

15 III. Collegio moderando tres praeerunt delecti viri, prudentia vitaeque integritate spectati.

16 Horum alter, Rectoris titulo, suprema in Collegio auctoritate potietur; alter, rectoris vice, quae ille mandant, curabit reique econonomicae administrandae praeerit; tertius magisterio spiritus fungetur, eique demandabitur cura Hieronymiani templi sacrasque in eo caeremonias omnes ordinandi.

17 IV. Rectorem eligendi Summi Pontificis ius esto, nulla originis vel patriae ratione habita.

18 Alterum vero a Rectore et conscientiae magistrum Cardinalis Patronus nominet, audito Rectore.

19 V. Praeter habitationem et victum aliaque ad vitae usum necessaria, Rector tria millia libellarum italicarum quotannis a Collegio accipiet; vicerector vero et conscientiae moderator mille et octingentas.

20 VI.

23 IX. Sacerdotes alumnos in Collegium mittendi ius habeant : Archiepiscopus Zagrabiensis, Episcopi Sirmiensis, Seniensis et Crisiensis, graeci ritus unitorum.

24 Item Archiepiscopus Iadertinus; Episcopi Rhagusinus, Spalatensis, Sebenicensis, Pharensis et Catharensis.

25 Item Episcopi Veglensis, Tergestinus, Parentinus.

26 Item Archiepiscopus Vrhbosnensis; Episcopi Mandetriensis, Tribuniensis, Banialucensis.

27 Postremo Archiepiscopus Antibarensis.

28 X. Tot in Collegium alumni cooptentur, quot ex instituti reditibus ali queant. In cooptandis vero sic dioecesium singularum amplitudinis ac necessitatis ratio habeant, ut nulla prae alia potiore iure frui videatur.

29 XL Alumni triennio vel saltem biennio in Collegio manebunt, iisque disciplinis operam dabunt, quarum peritia, Ordinarii iudicio, utiliores dioecesi suae eveniant.

APOSTOLIC LETTERS OF OUR MOST HOLY LORD POPE LEO XIII
BY WHICH THE CHAPTER OF THE COLLEGIATE CHURCH OF ST. JEROME OF THE ILLYRIANS IS SUPPRESSED AND THE HIERONYMIAN COLLEGE IS ERECTED IN THE CITY*

1 The Slavic people, most noble in the praise of faith and piety, whom Our Predecessors have embraced with charity through all ages, We have likewise pursued with perpetual care from the very beginning of Our Pontificate. Although the measures which We have prudently undertaken hitherto for the religious security and dignity of that people are a splendid testimony to this; yet, since the occasion presents itself most favorably, We are pleased to add a new testimony, so that evidence of Our benevolence may remain for future times and serve as a kind of monument.

2 For zeal for faith and Christian charity, as it has moved very many nations, so too it moved the Slavic people in times past to establish in this Our City, the principal seat of the Catholic name, some institution and to endow it with suitable revenues, namely for receiving fellow countrymen who would undertake the Roman pilgrimage to venerate the relics of the Apostles; and it has always been the custom of the Supreme Pontiffs not only to confirm such institutions by their authority and counsel, but also to advance them with munificent donations. This, as was fitting, came to pass also for the Slavs. For, complying with the prayers of Jerome of Potomnia of the Ragusine diocese and other pious men from Dalmatia and Slavonia, Our predecessor Nicholas V, by Bull Piis fidelibus votis, given on 21 April in the year 1453, established a hospice in the City, which was called St. Jerome of the Slavonians, and later also of the Illyrians, from the ancient geographical designation; with the purpose, namely, that poor faithful coming from afar from Dalmatia, Istria, Croatia, Slavonia, Bosnia and Herzegovina might be received and sustained.

3 The hospice, through the pious donations of Catholics, among which worthy of mention is that which Queen Catherine of Bosnia left by testament, grew so quickly that it soon became adequate not only for receiving pilgrims but also for caring for the sick, with the buildings enlarged; and so that this twofold work of charity might be carried out properly and rightly, the buildings themselves were divided into two parts, one part being assigned to the hospice, the other to the hospital.

4 When, however, Sixtus V was elevated to the supreme office of the Apostolate, he, on account of his piety toward St. Jerome and his benevolence toward the Croatian nation, from which he traced his origin, first restored the Hieronymian church, his former titular church when he was in minor orders, though it was narrow and decayed with age, almost from its foundations, at his own expense, adorned it, and furnished it with every ornament; and then also elevated it to the honor of a Collegiate Church, adding a Chapter, which consisted of an archpriest, six canons and four beneficiaries.

5 And thus indeed the Institution flourished down to our own times. Now, however, since the circumstances of those times have changed greatly, on account of increased commerce among various nations, more expeditious travel and more abundant provisions everywhere for the convenience of travelers, it scarcely appears that any utility remains in such hospices as the narrow circumstances of past ages required. On the contrary, all perceive that the times demand that, as wicked doctrines flourish everywhere and the boldness of the enemies of the Christian name increases, those resources be multiplied which are able both to protect the faith and to repel the attacks of adversaries, according to the necessity of individual regions. To which end, since it greatly contributes that chosen young men, either already initiated into sacred orders or to be initiated at the opportune time, be educated at Rome, under the protection and as it were in the sight of the Supreme Pontiffs, in virtues worthy of the priesthood and in sacred disciplines, who afterwards, returning to their homeland, may communicate the doctrine drawn from the very apostolic source with their fellow countrymen each in his own place; it seemed best to do so, if ancient hospices for pilgrims of other nations were to be changed into ecclesiastical colleges for young men. Thus indeed has been done with many Roman hospices of other nations: thus therefore it has been decreed to be done with the Illyrian Hieronymian hospice.

6 Indeed, the administrators of the hospice, from the sixteenth century onward, perceived how beneficial it would be if the Hieronymian house of the Slavs should not only be open to receive pilgrims, but also to receive priests to be more abundantly trained in sacred disciplines and imbued with piety. For this reason, in the year 1598, they had already obtained from Clement VIII, Our predecessor, the faculty by which the Hospice might be converted into an ecclesiastical college. However, difficulties that arose prevented the matter from proceeding as desired. After two centuries had elapsed, the matter began to be pursued again; yet in such a way that, with the pilgrims' hospice preserved, that part of the buildings which had been assigned to the hospice should thereafter be designated for clerics, with revenues also sufficient for their support being granted to them. This plan, when Pius VI, our predecessor, had approved it, was finally established by Apostolic Letters, given on 27 February 1790, as the Croatian College at St. Jerome. But although the efforts of illustrious men favored these undertakings, scarcely five years having elapsed, when public disturbances did not afford security to those dwelling in the City, with the Canons and students departing from Rome, the College ceased to exist. After peace was restored, the restoration of the College was deliberated upon again and often: and this finally succeeded in the year 1864, when namely some young men, who were engaged in philosophical and theological disciplines, were received into the Hieronymian buildings, and their community was called after SS. Cyril and Methodius, the patrons of the Slavs. Yet neither did the use of this institution last beyond seven years: for in the year 1871 it was suppressed. Nor finally did that which was again founded in the year 1884 have a more fortunate outcome, namely a College designated for priests alone, to be trained more thoroughly in learning and piety.

7 The difficulty of perfecting this plan was all the greater because in the Slavic buildings at St. Jerome another community had long held possession by legitimate right, namely of Canons, who, as was related above, had been instituted by Sixtus V, through the Constitution Sapientiam Sanctorum, given on the first day of August 1589.

8 For, Sixtus being cut off by death, the Hieronymian Chapter instituted by him had scarcely any revenues, which would in no way suffice for an honest livelihood: wherefore it was necessary again and again that, with Apostolic indults being employed, resources should be sought from the Hospice's funds, which were to be directed toward the sustenance of the Canons. Hence the resources of the Hospice were diminished, and the power to maintain the often-restored College of young men or Priests was taken away.

9 We therefore, in order that the College, which We have long desired to exist in Rome, may finally exist and may have a firmer, more certain, and more stable foundation than in the ages that have elapsed, having taken counsel with the Bishops of the Croatian nation, to whom it pertained, for the greater glory of Almighty God, for the increase of the Catholic religion, for the honor and benefit of that nation most beloved to Us, by the Apostolic authority of Our predecessors Nicholas V and Sixtus V, derogating from their Constitutions: We suppress and declare suppressed by these Our letters the Hospice of St. Jerome as well as the Chapter of the collegiate church of the same St. Jerome, which up to now has been called that of the Illyrians. We will meanwhile that the Canons, for whom provision has not yet been made otherwise by special indult and who still perform sacred duties in the temple, shall continue to receive whatever they were accustomed to receive before this time under the title of prebend, until they shall be provided for in another manner. In place of the aforesaid Hospice and Chapter, We found and establish the Hieronymian College for the Croatian nation, under Our Authority and protection; and to the same thus founded and established by Us We give and assign in perpetuity all goods and whatever revenues, names and rents pertaining in any way to the aforesaid Hospice and Chapter. Let this be the law of giving and assigning, however, that the obligations of the Chapter also, both as regards the recitation of the divine Office and as regards the Sacred rites to be performed on fixed days according to the will of pious founders, and finally the entire divine worship to be performed in the Hieronymian temple, shall be immediately transferred to the College and its administrators; whose consciences We therefore burden, so that all things which were formerly done by the Chapter shall henceforth be done by the College, except those things which perhaps ought to be modified for the sake of equity, yet with Our consent, as prudence shall suggest.

10 In order that in a matter of such importance proceedings may be conducted rightly and properly, We establish the laws which follow for governing and directing the College. Other matters, which pertain either to the duties of piety, or to the course of studies, or to domestic discipline and daily order, We permit to be determined by the Cardinal Patron of the College.

11 LAWS OF THE HIERONYMIAN COLLEGE FOR THE CROATIAN NATION IN THE CITY

12 I. The Hieronymian College shall now receive only student priests, who by birth and language belong to the Croatian nation and who, having completed the course of studies in a diocesan seminary or in some theological Lyceum, are judged suitable for more advanced studies in pontifical law especially and also in other sacred disciplines, as each one's Bishop shall designate.

13 But as soon as time and increased revenues permit, we wish the college to be open to young men who are about to undertake the priesthood, that they may apply themselves to sacred disciplines.

14 II. Let one of the Cardinals of the Holy Roman Church be Patron of the College, whom the Supreme Pontiff shall designate.

15 III. Three chosen men, distinguished by prudence and integrity of life, shall preside over the governance of the College.

16 One of these, with the title of Rector, shall hold supreme authority in the College; another, as vice-rector, shall carry out what he commands and shall preside over the administration of economic affairs; the third shall exercise the office of spiritual director, and to him shall be entrusted the care of the Church of St. Jerome and the ordering of all sacred ceremonies therein.

17 IV. The right of electing the Rector shall belong to the Supreme Pontiff, with no consideration of origin or country.

18 The other, however, shall be named by the Rector and the spiritual director by the Cardinal Patron, having heard the Rector.

19 V. Besides lodging and food and other things necessary for living, the Rector shall receive three thousand Italian lire annually from the College; the vice-rector and the spiritual director, however, eighteen hundred.

20 VI. These same shall enjoy the title of Canons for the honor of the Collegiate Church of St. Jerome; provided, however, that they shall be deprived of it immediately upon being removed from office or for failing in their duty or for other grave causes.

21 VII. The administration of the entire patrimony shall be in the hands of a Council designated for that purpose. The Council shall consist of five men; that is, the Rector of the College, who shall also be president, and the two other moderators, and two others elected by the Cardinal Patron.

22 VIII. All right of admitting priest-students to the College shall belong to the Cardinal Patron. No one, however, shall be admitted unless he is of outstanding ability and of upright morals and has been proposed and recommended by his Ordinary. Moreover, the power of dismissing students shall belong to the same Cardinal Patron, if he shall find anyone, having heard the moderators, to be impatient of discipline or forgetful of the laws.

23 IX. The right of sending priest-students to the College shall belong to: the Archbishop of Zagreb, the Bishops of Sirmium, Senj, and Križ, of the Greek rite united.

24 Likewise the Archbishop of Zadar; the Bishops of Dubrovnik, Split, Šibenik, Pharos, and Cattaro.

25 Likewise the Bishops of Veglia, Trieste, and Parenzo.

26 Likewise the Archbishop of Vrhbosna; the Bishops of Mandatrisium, Tribunium, and Banjaluka.

27 Finally the Archbishop of Antivari.

28 X. As many students shall be admitted to the College as can be supported from the revenues of the institution. In admitting them, however, regard shall be had to the size and needs of each individual diocese in such a way that none shall appear to enjoy a greater right than another.

29 XI. Students shall remain in the College for three years or at least two years, and shall apply themselves to those disciplines which, in the judgment of their Ordinary, shall be more useful to their diocese.

30 The Bishops of Croatia, in whose dioceses the Old Slavonic language is used in sacred liturgy, retain the full right to enjoin upon the priests whom they send to Rome that they learn Old Slavonic and know well the Glagolitic letters.

31 These things concerning the Hieronymian College of the Croatian people in the City we have established and decreed. It remains that the priest-students admitted to it may duly appreciate the benefit bestowed by God and may abundantly fulfill our hope and that of their Bishops by their zeal in acquiring virtue and knowledge.

32 We will that these present letters be firm, valid, and effective and shall be and produce their full and complete effects and obtain them, and that they shall most fully avail for those to whom they pertain and shall pertain in the future in all things and through all things; and thus in the foregoing matters by any judges ordinary and delegated judgment should be rendered and definition made, and that if anything contrary to these things shall be attempted by anyone whatsoever with any authority, knowingly or unknowingly, it shall be null and void. Notwithstanding our and the Apostolic Chancery's rule concerning acquired right not being taken away, and other Apostolic Constitutions and ordinances, and all other things to the contrary whatsoever.

33 Given at Rome at St. Peter's under the Fisherman's Ring, on 1 August 1901, in the twenty-fourth year of our Pontificate.
