15 menli et cinquanta leguminum rubra ipsius archiospedale spese dell'ospedale stesso trasportata all'Urbe predetta ospizio predetto apostolico per i poveri infermi dovesse contribuire ogni anno. Terziamente § 12.

apostolic poor and infirm of the City with certain ordinances and perpetual plenary indulgence. I. Innocent, Bishop, servant of the servants of God, for perpetual memory of the matter.
1 For the exercise of piety, having according to the Apostle the promise of life which is now and likewise future, and especially of hospitality, the study of which sometimes caused men to receive angels themselves as guests, turning the eyes of our mind with careful meditation, so that we might provide for the extreme poverty and infirmity of the poor of our beloved City, we are reminded by that voice of the Lord speaking through the Prophet: Break thy bread to the hungry, and bring the needy and the harbourless into thy house; we are likewise stirred by that commandment which God enjoined upon His chosen people through Moses: There shall not be wanting poor and beggars among you; we are moved by great fear, while we meanwhile consider in our mind the dreadful examination of the final judgment, in which the Son of Man, when He shall come in the seat of His majesty, shall render to the poor all the works of piety and charity done or denied to Himself, and shall commend those to the elect, who shall have exercised them,1
2 In the City there were various places of pious works and alms for the poor. them, shall recall them kindly to eternal retribution and glory, but shall reproach sharply those reprobate who denied them, to eternal perdition and punishment.
3 § 1. Indeed, although our predecessor Sixtus V, of blessed memory, endeavoured to provide that beggars should no longer be dispersed and wandering through the aforesaid City seeking their livelihood, and therefore, to provide for the salvation of both their souls and bodies, founded, erected, established and endowed a hospital house near the bridge called the Sixtine Bridge at the bank of the Tiber for receiving, feeding and clothing such beggars of either sex; and although in the aforesaid City there exist very many other, and indeed most wealthy, hospitals, confraternities, conservatories, places and pious works instituted for various forms of relief to the poor; and although very considerable alms, and increasing daily, have been accustomed to be and are dispensed by our Roman Pontiff predecessors and by us likewise: nevertheless the provident and pious intention of that same predecessor Sixtus (both on account of the insufficiency of the aforesaid house, which, though otherwise spacious, does not contain all beggars; and on account of the insufficiency of the endowment, which, though otherwise considerable, is unequal to the sustenance of all beggars; and on account of the institution or use of the aforesaid hospital of receiving and feeding only men and women, but not boys and girls, nor of providing for the poor dwelling outside it) did not achieve the premeditated effect of eliminating begging, with an immense number of them still remaining, who, either truly poor and infirm in body or age, unable to seek their livelihood by themselves or through others, or feigning poverty or infirmity, or in any case not caring to seek their livelihood by themselves or from those obliged to do so, not only begged throughout the same City, but even in the churches themselves, in which, for the most part forgetful of reverence toward the house of God and the most holy sacrament of the Eucharist even when exposed, they distracted the faithful, intent upon prayers, the sacrifice of the Mass and divine offices, with wailing, complaints and importunate petitions; and some, given over to gluttony and vices, led a shameful life, and educated their sons imbued with similar morals, and, being vagrants without a fixed dwelling and therefore without their own parish priest, and subject to no censure, sometimes even neglected with impunity to be refreshed or fortified by the sacraments of the Church contrary to its precepts.
4 § 2. Desiring therefore to enlarge a pious and salutary work, begun at another time by certain of our Roman Pontiff predecessors and especially by Pius IV of revered memory and Gregory XIII, yet always, because they had not assigned certain revenues for the sustenance of the poor, abandoned in vain attempt, and indeed established by the same Sixtus our predecessor, but deprived of full effect, as is aforesaid, and, as much as is granted to us from on high, to perfect it, so that we might provide for the reverence of churches, look to the salvation of souls, truly succor the genuinely poor and infirm in body or age, guard against the frauds of those simulating poverty and infirmity, meet the idleness of those choosing to live in leisure, and provide for the more healthful governance of the same City: all such vagrants and beggars who are truly poor, and infirm in body or age, and are unable to seek their sustenance by their own labor and industry, nor have those by whom they ought and are able to be supported, namely men, women and girls in the Lateran palace of ours; but boys in a place or building at the bank of the Tiber called Magnani under the invocation of St. Michael constructed heretofore, we have brought in, and the said palace with suitable furnishings and necessary and appropriate utensils and movables, purchased at no small expense, we have sufficiently equipped, and with equal expense we have so arranged such a structure, that men might be and in the future can be separated and kept apart from women and girls in distinct and proper refectories, dwellings, porticoes, courtyards, cells, workshops, entrances and schools of each sex, and in all respects separated and divided. And lest married couples, whom or one of whom such poverty and infirmity had forced to beg, should remain deprived of our assistance, to the same, although dwelling outside the aforesaid hospice, we have provided with some alms subsidy or distribution.
5 § 3. Hence it is, that those things which, the Lord inspiring us with the goodness of his providence for all these matters, we have begun for his greater glory, and for the spiritual and bodily salvation and edification of our neighbor, with the same giving increase, we may reduce at least to that form, subsistence and perfection to which the exiguous strength of our Apostolic Chamber, pressed by various necessities, has hitherto been able to supply, and we may establish with the greater protection of the authority divinely committed to us as we are able; and therefore lest concerning the underwritten erection, foundation, endowment, institution, ordinance, grants, donations and unions of the hospice, and their variety, tenor, validity, subsistence, perpetuity, irrevocability and immutability at any time whatsoever, by any right, or by any mode, way or pretext, doubt should be able to arise or occur, by our own motion, from certain knowledge and mature deliberation of ours, and from the fullness of apostolic power, an apostolic hospice for the poor and infirm, by the tenor of the present, we perpetually erect, found and establish, or that which has already been begun, founded and established by us we perpetually approve, confirm and renew, and to such erection, foundation and establishment we add the strength and efficacy of perpetual, inviolable and irrefragable apostolic firmness.
6 § 4. For the habitation of such poor invalids of the Palace, namely men and women as well as boys and girls, We have assigned and granted a building adjoining on one side the Lateran church, our principal church in the apostolic palace, and situated in the street or streets likewise called Lateran, which was once built by the aforesaid Sixtus our predecessor for the habitation of Roman Pontiffs, who nevertheless did not dwell there for more than a hundred years thereafter, with ample and noble structure, but which for a long time and especially recently has been in need of great and prompt repair in many of its parts, even threatening ruin, and therefore by us with manifold and great expense has been supported, strengthened and restored through the renewal of certain collapsed floors, the solidification and restoration of many ceilings, vaults and walls nearly collapsing, the repair of very many wooden doors and windows, and other necessary and suitable repairs, and has been conveniently reduced to the aforesaid hospice use. And although this building was perpetually donated by Paul, Pope of blessed memory, also our predecessor, through his letters issued in the form of a Brief on 8 January in the fourth year of his pontificate to the archpriest, chapter and canons of the aforesaid church for the habitation of the same canons, it was nevertheless not inhabited by them, and with their knowledge and consent was long ago resumed by the Apostolic Camera, and was converted to various uses of military station, infirmary or hospital in time of plague and for the most part for storing and preserving grain and other similar provisions, and was sometimes inhabited even by the poor themselves who were fed there in time of extreme charity, and nevertheless for greater caution and as was necessary was by our venerable brother Flavius, bishop of Porto, cardinal of the Holy Roman Church called Chigi, the present archpriest, and by our beloved sons the chapter and canons of the said church, through the acts of Ludovicus Mariolus, notary public of the court of our beloved son the vicar general in spiritual matters in the City, on 1 March last past, returned and restored. We therefore designate, assign, establish and constitute it. To which effect, by our chirograph made and signed by us under date of 5 February likewise last past, and by an instrument made in its execution by our beloved son Joseph Paravicinus, our treasurer general of the aforesaid Camera, through our beloved son Peter Palmerius, secretary of the said Camera, requested on 23 of the same month of February, we have freely, gratuitously and perpetually donated and assigned this palace with all and singular its rights, members, appurtenances, uses and conveniences, excepting nevertheless those reserved for the use of pontifical functions and blessings, with the portico constructed for the same blessings, and a small part of the same palace, according to the delineation inserted in the aforesaid instrument, to the same hospice.
7 § 5. Also by a certain motion of ours made by decree under date of 5 February of the said month, we have perpetually dismembered and separated from the aforesaid church or the chapter's table, or the same chapter's small endowment so called, a certain garden pertaining to the said church called of the Saviour or St. John in the Lateran, or its chapter's table, or the same chapter's small endowment so called, situated near the said church, the canonical residences and other boundaries, as well as a certain small house with its residences and garden near the same church, and its greater courtyard, and the aforesaid garden, pertaining to two of the same church's canonicates or prebends, from the aforesaid church or table or endowment and respectively from the said two canonicates or prebends, yet having given to them equivalent or greater recompense, and with their evident utility, and we have thus perpetually granted, assigned and applied it and them so dismembered and dismembered, with all and singular their members, dependencies and appurtenances, and all and whatsoever rights, revenues and emoluments whatsoever, coming from wherever, to the aforesaid hospice (from which, or from the aforesaid palace for the habitation of poor invalids, access is provided to the aforesaid garden, garden plot and small houses by means of a passage over the great portico of the said Lateran church constructed by our mandate) for the perpetual use, convenience and utility of the aforesaid poor; and to the same perpetual dismemberment, separation, grant, assignment and application the chapter of the same chapter and canons of the aforesaid church, as well as the particular two canons possessing the aforesaid two canonicates or prebends, through the said acts of the aforesaid Ludovicus Mariolus on the same 1 March last past gave their assent.
8 § 6. For the habitation moreover of boys, a building by a certain Charles Thomas Odescalco, canon of the basilica of the Prince of the Apostles, is assigned to him, in which he lived with a vineyard.
9 on the Bank of the Tiber called the Great, built under the invocation of St. Michael, and by him under the protection of Our beloved son the noble man Livius Odescalchi, duke of Cera, with substitution nevertheless in Our favor, so that a similar pious work of boys instituted there would not be continued, left in the schedule of his will and codicils, and by reason of the cession of rights in virtue of the said schedule compelling, or permission of purification of the aforesaid substitution, to which cession or permission of purification the same Livius duke, under the consideration that the pious place, where scarcely thirty boys dwelt, could be continued and perpetuated in a better form, and there poor boys in a far greater number hitherto rising to about three hundred, under the regime or comprehension in the apostolic hospice, founded, given and instituted by Us, as aforesaid, could be educated and nourished, by means of a public instrument through the acts of Our beloved son John Peter de Carolis, notary of the Capitol, requested on the eleventh day of the aforesaid month of March, with all and singular goods, rights, members and appurtenances of the aforesaid pious place constructed and instituted by the aforesaid Charles Thomas, acquired by Us, partly reduced to absolute use of habitation, and successively, God willing, to be enlarged, together with a contiguous vineyard or garden, which we meanwhile caused to be purchased, We perpetually grant, assign and apply. We consider moreover the poor hospice of boys called Litterati, a house or hospice instituted piously by Leonardo Cerusio, called the Litterato, and to this one assigned in the Via Cursus of the same City near the monastery called St. Sylvester in Capite situated, as boys who could not seek their own sustenance, except by reason of body at least by reason of age, among the poor invalids and other boys received in the hospice of invalids could be numbered, inscribed and reckoned, and therefore, so that under the same governance of the poor invalids, regime, direction and administration they might be nourished, governed and educated, and learn mechanical arts and especially the craft or art of wool, which in the said house or hospice called poor Litterati were not exercised, in the aforesaid apostolic hospice of poor invalids, it was fitting and shall be: therefore, by Our motion, knowledge, deliberation and fullness of power equal, the house or hospice of poor boys called Litterati of this kind, as well as any congregation and protection by whatsoever Roman Pontiffs Our predecessors over the same house or the same hospice of poor boys called Litterati of this kind, and its goods, fruits, revenues and proceeds of administration, or the direction of the same house or hospice of the same poor boys called Litterati of this kind in any manner constituted and appointed, as well as any administration and direction held by any person whatsoever with any authority, dignity or preeminence and also shining with the honor of the cardinalate or held by whatsoever administrators and deputies existing by any name and title, We have perpetually suppressed and extinguished by apostolic authority, and all and singular of the house or hospice of poor boys called Litterati of this kind thus suppressed and extinguished or suppressed and extinguished, things, goods, church or chapel, not however collative, members, houses, dependencies, rights, privileges, prerogatives, honors and burdens, as well as whatsoever revenues and proceeds, obligations and emoluments, consisting in whatsoever things and proceeding from whatsoever source, and all appurtenances, to the aforesaid apostolic hospice of poor invalids, so that the poor boys called Litterati of the said house or said hospice thus suppressed and extinguished or suppressed and extinguished, and aggregated to the said apostolic hospice of poor invalids as below, no longer under their and the said house or hospice thus suppressed and extinguished or suppressed and extinguished denomination, instituted by acts and rules or statutes or ordinances, but in all things and throughout under the said apostolic hospice, by Us, as aforesaid, erected, name, instituted, rules, statutes and ordinances should be educated, directed and live, with the most ample faculties, clauses, decrees and derogations most widely extended, by apostolic authority, motion, knowledge, deliberation and fullness of power similar, We have perpetually assigned, applied and appropriated, and respectively aggregated and incorporated; and otherwise, as in Our own motion proper schedule under date of the fifteenth day of the said month of February is more fully contained.
10 § 8. Perceiving also that our intention and that of our aforesaid predecessor of blessed memory was the same, namely to remove begging from the aforesaid City, and to provide true assistance to the poor, and therefore, so that one and the same pious work might be constituted and exist, and be administered and governed by one and the same congregation, and be ruled and directed by the same rules and institutions, it would be fitting and conducive to its more fortunate progress and more salutary increase: for this reason, by our own motion, knowledge, deliberation, and fullness of power equally, the aforesaid hospital for the poor established by the same Sixtus our predecessor, through his letters expedited on the eighth day of May in the year of our Lord's Incarnation 1587, and the third year of his pontificate, and on the eighth day of September in the aforesaid year of the Incarnation 1588, and the fourth year of the same pontificate, and founded, erected, endowed and instituted, and all and singular the buildings of the same hospital for the poor, the church, the chaplaincies erected or existing therein, things, goods and rights whatsoever, even of patronage or of presenting or nominating, members, houses, dependencies, privileges, prerogatives, honors and burdens, as well as whatsoever revenues, proceeds, emoluments and benefits whatsoever, consisting in whatsoever things, coming from whatsoever source, and all appurtenances by whatsoever name called, even those worthy of special and individual note, to the aforesaid apostolic hospital of poor invalids (or3 to its congregation, and to its rectors, administrators and deputies) we grant corporeal, real and actual possession of the aforesaid buildings of the elected hospital for the poor, church, chaplaincies, things, goods and rights whatsoever, members, houses, dependencies, revenues, proceeds, emoluments and benefits whatsoever, and all appurtenances, and all others, as aforesaid, expressed, to freely apprehend by themselves or through another or others by their own authority, and to perpetually retain what has been apprehended, and to lease, unleash, rent, receive, exact, collect and recover the same, and to freely dispose of them, and to convert the fruits, revenues and proceeds, rights, emoluments and benefits whatsoever of all and singular the aforesaid into the proper uses and benefit of the said apostolic hospital of poor invalids constituted and confirmed according to the form of these presents, and enlarged by means of the aforesaid union of the hospital for the poor, without any license being required thereupon; so also that the poor of both sexes of the said hospital for the poor united by these presents under the aforesaid hospital of poor invalids erected by us, as aforesaid, and enlarged by means of this union, or reduced into one, by the institution, rules, statutes and ordinances in all things and through all things may be treated, directed, governed and live) by the tenor of these presents we perpetually unite, assign, apply, appropriate, aggregate and incorporate in the most ample and fullest and irrevocable manner, and in every better, stronger and more efficacious way, and constitute and make one and the same hospital and pious work. And whereas the aforesaid Sixtus our predecessor the aforesaid hospital for the poor, as aforesaid united, in the aforesaid earlier letters of his through four men, clerics or laymen suitable and approved, namely two to be elected and appointed annually by the Roman people in public Council, and the other two by the confraternity brothers of the archconfraternity of the Most Holy Trinity of the convalescent and pilgrims, determined to be ruled, administered and governed,5 as well as the Treasurer and General Commissioner of the Apostolic Chamber, then and for the time being existing, so that together with the aforesaid four administrators or deputies for the salutary governance, direction and preservation6 of the aforesaid hospital of poor beggars, its officials, ministers, honors and rights, with the faculties expressed therein he appointed: for this reason, wishing to constitute one and the same Congregation of both places, or of one and the same pious work incorporated together, and reduced into one hospital of poor invalids, as aforesaid, to the Congregation inscribed below constituted for the hospital of poor invalids the aforesaid Treasurer and General Commissioner now and for the time being existing, and four men appointed by the said Sixtus our predecessor for the governance, administration and government of the said hospital of poor beggars, as aforesaid, appointing, we add, aggregate, unite and incorporate.24
§ 9. Willing and commanding that poor persons of both sexes, both men and women, as well as boys and girls, although according to the present state they are lodged in different places of the aforesaid Lateran Palace, a place near the Sixtus Bridge, and another place at the Great Riparian area of the Tiber, and although they might also be distinguished or changed differently in the future as to place and manner of habitation, they shall nevertheless always constitute one and integral apostolic hospice of invalid poor, and the same pious work, which shall be governed by one and the same Congregation, and shall be comprehended under the same foundation, erection, endowment, institution, and whatever rules, ordinances, graces and privileges have already been and now are being established and granted thereupon.
11 § 10. But lest the purpose of this pious work, which was always one and the same hospice for the invalid poor, and the same, should fail at the outset, as happened to the aforesaid Roman Pontiffs and especially to Pius IV and Gregory XIII, who had not established certain revenues, or in its progress should be deprived of the desired effect, at least in full measure, as occurred in the aforesaid hospice of the poor founded by Sixtus our predecessor, who erected it and assigned certain revenues indeed, but far unequal to the sustenance of all the poor: we have decreed that the aforesaid hospice of the invalid poor be established with a much greater endowment, partly from the goods or revenues of the aforesaid hospice or house of boys for learning formerly called by that name, as well as of the hospice of the poor, as aforesaid, united, but mostly from goods, rights and revenues assigned by us, as below. The revenues, however, which are received from the goods and rights of the said house and hospice of boys for learning formerly called by that name, beyond the value of the building or house where they dwelt, amount to approximately eighteen hundred scudi annually; those which are received from the goods and rights of the said hospice of the poor, beyond the building, which still serves for the habitation of the poor, amount to approximately another ten thousand scudi annually.
12 INNOCENT XII, POPE
13 § 11. Wishing therefore to provide for the same hospice, its perpetual subsistence and successive maintenance, by means of another greater endowment or subvention, by the same motu proprio, knowledge and fullness of power, one hundred thousand scudi of Roman currency, accumulated by us from the fruits of our Camera, for the purpose of investing them in as many places of the mountains of the said Camera not vacant or in stable goods or rents at the discretion of us and our successors the Roman Pontiffs, as recently one hundred thousand scudi in annual revenue were invested; as well as the Borough of houses in our town of Civita Vecchia in the place commonly called la Tanaglia built by our mandate up to now, and to be built in the future with the fruits of the same Camera, with all and singular their rights, members and appurtenances; likewise whatever, deducting all the burdens and expenses of our Penitentiary and the greater portion of our Penitentiary otherwise assigned, and for this part or sum otherwise reformed, shall remain, amounting to approximately five thousand scudi annually; and likewise another two thousand scudi annually from the alms of matrimonial dispensations, which otherwise are expended entirely in the subvention of the poor, to be fixed and invariably deducted; and likewise that part of the minor services, which, before the suppression of the venality of camerlengo offices long since made by us, was assigned as part of the endowment or emoluments or revenues of our aforesaid Camera to the clerics presiding, amounting to approximately two thousand scudi annually, to this apostolic hospice of invalid poor in such manner, we have purely, freely, perpetually and irrevocably donated and assigned, as is more fully contained in the aforesaid chirograph made by us on the fifth day of the said month of February and signed by us and the instrument drawn up for its execution. In which chirograph we further will and have commanded that the house or archihospice called the Holy Spirit in Saxia of the same City, according to the oblation made on its behalf to us, one hundred
14 § 11. Wishing therefore to provide for the same hospice, its perpetual subsistence and successive maintenance, by means of another greater endowment or subvention, by the same motu proprio, knowledge and fullness of power, one hundred thousand scudi of Roman currency, accumulated by us from the fruits of our Camera, for the purpose of investing them in as many places of the mountains of the said Camera not vacant or in stable goods or rents at the discretion of us and our successors the Roman Pontiffs, as recently in an annual revenue of three thousand scudi were invested; as well as the Borough of houses in our town of Civita Vecchia in the place commonly called la Tanaglia built by our mandate up to now, and to be built in the future with the fruits of the same Camera, with all and singular their rights, members and appurtenances; likewise whatever, deducting all the burdens and expenses of our Penitentiary and the greater portion of our Penitentiary otherwise assigned, and for this part or sum otherwise reformed, shall remain, amounting to approximately five thousand scudi annually; and likewise another two thousand scudi annually from the alms of matrimonial dispensations, which otherwise are expended entirely in the subvention of the poor, to be fixed and invariably deducted; and likewise that part of the minor services, which, before the suppression of the venality of camerlengo offices long since made by us, was assigned as part of the endowment or emoluments or revenues of our aforesaid Camera to the clerics presiding, amounting to approximately two thousand scudi annually, to this apostolic hospice of invalid poor in such manner, we have purely, freely, perpetually and irrevocably donated and assigned, as is more fully contained in the aforesaid chirograph made by us on the fifth day of the said month of February and signed by us and the instrument drawn up for its execution. In which chirograph we further will and have commanded that the house or archihospice called the Holy Spirit in Saxia of the same City, according to the oblation made on its behalf to us, one hundred
15 and fifty medicines from the red [supply] of the same archihospital at the expense of the aforesaid City transported to the aforesaid apostolic hospice for the poor and infirm to be obliged to contribute each year. Furthermore— § 12. By another moreover our motu proprio document under date of the 8th of the said month of February, one correctorium of the archive of the Roman Curia through the suppression of the venality of the office of auditor of the Apostolic Camera, and its restitution and reunion to the same Camera or Apostolic Dataria, and another of the register of apostolic letters called non-salaried, and of the writing of apostolic letters not divided, and another of St. Paul, and another of St. Peter, and another of Pius respectively called soldiers, as well as another of the presidency of provisions, and the remaining portion of the Ripa offices, through the death respectively thus becoming vacant, with all and singular their honors, burdens, salaries, rights and emoluments accustomed and customary, both ordinary and extraordinary, certain and uncertain, even from congregations, attendances and officiatures, and otherwise from whencesoever and howsoever arising, with the faculty of deputing a person or persons through the Congregation of the said apostolic hospice for the purpose of exacting the said fruits and emoluments whatsoever, as well as congregations and officiatures of the said offices intervening, to the aforesaid apostolic hospice of poor invalids by apostolic authority we have perpetually granted, assigned and applied.
16 § 13. To these, another eleven thousand seven hundred and fifty scudi of other Roman money from three shield-bearers, one portion of two Lauretan couriers, and two other Pian ones, and the remaining offices called Libi, which through the death of those possessing them had recently become vacant, the price retracted, as well as the price from the office of notary of the magistracy of roads called thus, likewise becoming vacant through death, of the sale to be retracted, in the bank of our beloved son Francis Montioni and of the aforesaid Camera depositary general, in credit to the aforesaid apostolic hospice, and to the disposition of the deputies of the same hospice, and for the purpose of investing that and it in so many places of the mountains, rents or stable holdings for such hospice, through another document made thereupon and by us on the 13th of the current month of May signed in our own hand, with appropriate derogations and clauses, we have ordered to be deposited, as the said sum of eleven thousand seven hundred and fifty has already been deposited.
17 § 14. And nevertheless to the foregoing not confirmation, and innovation of the rest of the motu proprio documents, chirographs, dated documents, and instruments of this series wishing to add greater force and fuller efficacy, and of those and of those, as well as of any other apostolic letters, rights, documents, foundations and dispositions of whatsoever denomination and kind, of which and of which the mention, expression or insertion in any way necessary or opportune would have been, holding for fully and sufficiently and word for word expressed, by motion, knowledge, deliberation, fullness of power similar, the aforesaid our motu proprio documents, chirographs and instruments of this kind, and all and singular things contained and expressed in them, not only in so far as it is contained in the said documents, chirographs and instruments, but in every other better, more valid and more efficacious manner most fully by the tenor of these present we perpetually confirm, approve and innovate, and inviolably and unshakably to be observed we will and command, and all and singular defects of law and fact even substantial, if any thereupon in any way have intervened, or shall have intervened, be said, be deemed, or be alleged, most fully and most amply we heal and supply.
18 § 15. Moreover, wishing that those who come to the benefit of this same gift may proceed according to the institution, regime, norm and discipline of the hospice of the apostolic poor and invalids, as aforesaid erected, founded and endowed: in the first place, truly poor persons of either sex not joined in matrimony, and invalid in body or age, and unable to seek their sustenance by their own labor and industry, nor having those from whom they ought and are able to be supported, namely men, women and girls in the aforesaid palace of the Lateran and the house at the Sixtine Bridge, according to the assignment and distinction to be made hereafter at the discretion of the Congregation written below, but boys in St. Michael's at the Great Bank of the Tiber, so called, in the aforesaid hospices or places, we will and decree that food and similar clothing respectively be provided. It is possible, however, that sometimes a married person may be admitted to the aforesaid palace of the Lateran or house at the Sixtine Bridge hospice, with the mutual consent of the same person and the other spouse willing to live separately outside the hospice, and with the danger and suspicion of incontinence ceasing on both sides, and, according to the contingencies and circumstances of cases, at the discretion of the aforesaid Congregation, both married spouses, similarly poor and invalid, may be admitted to such a hospice when they are elderly, and with the danger and suspicion of incontinence ceasing, the husband among the men, the wife among the women of the aforesaid hospice, living separately and chastely if they shall have chosen it. And nevertheless also to poor invalids married and with infants, nor having those from whom they ought and are able to be supported, who otherwise would be altogether forced to beg, we will and decree that they be helped by some alms support.
19 § 16. But because the care of such poor, intending to consult solicitously not bodies alone, but especially souls, so that they may not languish in idle sloth, from which many sins proceed, and, as much as can be done, may make progress in piety and charity, we establish and command that all and each, who are not altogether unable, and especially boys and girls, of whom very many are not invalid in body, but by reason of age and especially also of the female sex cannot acquire their sustenance at least honestly or sufficiently, and ought not to be given over to idle begging, ought, according to whatever activity each one has, to work for the benefit of the hospice, saving however the discretion of the Congregation to allow some workers some modest portion of the profit resulting from the work of each of them. But because it is less to refrain from evil unless someone strives to labor in good works, we also will and decree that all such poor, living together with the greatest charity that can be, attend the sacrifice of the Mass on each day, frequent sacramental confession and Eucharistic communion on days to be established by the spiritual directors of such apostolic hospice, and daily apply themselves with devoted effort to prayers and orations according to the schedule and rules and ordinances to be prescribed concerning this.
20 § 17. Whenever indeed such poor of this institution shall contravene their discipline or rules, or shall not obey their superiors with the submission that is fitting, or shall be deemed worthy of other punishment, the aforesaid Congregation may, through itself or through others, restrain such contraveners or disobedient persons with fitting and appropriate penalties, even imprisonment, both in the hospice and its places and dwellings of this kind, and in public prisons for such time as it sees fit. But if they shall relapse further, or otherwise be deemed incorrigible or no longer to be tolerated, they ought altogether to be punished by our and for the time being existing vicar general in spiritual matters, and other competent judges, at the instance of the aforesaid Congregation, such relapsed, incorrigible, or no longer to be tolerated persons, with exile, under the threat of other penalties in case of contravention to be carried out in execution, and to be restrained and coerced, or otherwise according to the quality of the offenses to be afflicted with fitting penalties.
21 § 48. But if those who, truly poor and invalid, refuse to dwell in such hospice and its respective places and dwellings, or, neglected by those who are bound and able to support them, or not being poor and invalid, or otherwise refusing or not seeking to acquire their sustenance by their own labor and industry according to their aptitude, shall have preferred to lead an idle life and to beg, our and for the time being existing vicar general in spiritual matters of the Roman Pontiff in the said City, as regards beggars in churches and their doors or porticoes, the same vicar and the governor of the said City and other competent judges as regards beggars throughout the same City, both ex officio and much more at the instance of the aforesaid Congregation, ought to restrain and coerce them.
22 and since the aforesaid Congregation, at the instance of the president of such a hospice, [is to ensure that] those mendicants with armed families are to be imprisoned and restrained by penalties of imprisonment for a time, exile, and other [penalties] at their discretion, and [is to] strive that such mendicancy be altogether eliminated; and let the prefect of the City for the time being in office keep watch, so that the bans issued and to be issued against vagabonds, and the penalties established and to be established in them, be altogether and diligently committed to execution.
23 § 19. Since, however, it frequently happens that the poor and infirm cannot be sustained otherwise, so that those who are bound and able to sustain the poor and infirm refuse to do so, or are unwilling or unable to be constrained by the same poor and infirm, let the aforesaid Congregation, presiding over such an apostolic hospice, also keep watch, so that the same poor [and] infirm, the mere fact being examined, by royal hand and with information also extrajudicial from whatsoever competent judges, to whom we impart the necessary and opportune faculty for this effect, be altogether compelled to provide such sustenance. § 20. Wishing moreover that the concession of the poor and the devotion of the infirm of this kind, as well as of the ministers and officials of whatsoever [rank] dwelling in the aforesaid hospice and its places or habitations, and also of all and each of the Congregation presiding over this apostolic hospice, be more and more excited and promoted by the bestowal of the heavenly treasures of the Church, trusting in the mercy of almighty God and the authority of the blessed Apostles Peter and Paul, to all and each of either sex aforesaid, who on the festivals of the Nativity of our Lord Jesus Christ, the Epiphany, the Resurrection, the Ascension, Pentecost, the Most Holy Trinity, and
24 the Body of the same our Lord Jesus Christ, as well as the Purification, the Annunciation, the Assumption, and the Nativity of the blessed Virgin Mary, and the Nativity of St. John the Baptist, as well as [the festivals] of the Apostles and the Commemoration of All Saints, being truly penitent and confessed, and refreshed by holy communion, shall have poured forth pious prayers to God for the concord of Christian princes, the extirpation of heresies and schisms, and the exaltation of holy Mother Church, we mercifully grant in the Lord a plenary indulgence and remission of all their sins, which may also be applied to souls in purgatory by way of suffrage, to be valid in perpetuity by these presents; and also to all and each of the aforesaid Congregation dying anywhere, as well as to those whom it shall happen to die from human affairs in the aforesaid hospice, its places, or habitations, or in hospitals of the infirm, to which they shall have been led from the hospice, or the aforesaid places and habitations, if they shall have been truly penitent and confessed and refreshed by holy communion, or, insofar as they shall not have been able to do so, at least contrite, [and shall have] devoutly invoked the name of Jesus by mouth if they could, if not by heart in the article of their death, we likewise grant in perpetuity a plenary indulgence and remission of all their sins.
25 § 21. Furthermore, to the poor of either sex of this kind dwelling in the aforesaid hospice, its places, or habitations, in the article of death from sin and censure, [we grant that] those whose infirmity or too weak state of health or bodily condition cannot bear fasting, or abstinence from meat and dairy products, may, by the counsel of either physician, on any Lenten days, and the four seasons of the year and vigils, and other days on which fasting is enjoined by the Church, or the use of meat, eggs, and dairy products is prohibited by law, or custom, or otherwise exists or shall exist, use and eat meat, eggs, butter, dairy products, and other prohibited foods of this kind; and to each presbyter, whether secular or of whatsoever regular Order, who shall have been elected for this by the Congregation hereinafter written and approved by the aforesaid vicar in the City, [we grant] that they may absolve each of the poor, ministers, and servants of this apostolic hospice from whatsoever excommunication, even the greater, suspension and interdict, and other ecclesiastical sentences, censures and penalties, imposed by law or by name, on whatsoever occasion or cause, by which they shall have been bound, as well as from whatsoever their sins, crimes, excesses and offences, however grave and enormous, even such as would merit consultation of the said See, namely in cases both ordinary to the places and also reserved to the same See, not however brought to judgment, nor contained in the letters to be read on the day of the Lord's Supper, once upon entrance into the said apostolic hospice, and again by all the aforesaid, with no one whatsoever excepted, in the article of death, their confession however having been diligently heard, in the forum of conscience only, enjoining upon them for the measure of their guilt at their discretion a salutary penance, we grant and indulge in perpetuity.
26 §22. Whenever, however, the poor dwelling in such a hospice and its places and dwellings should fall sick, they shall be sent to the hospitals of the same City erected and designated for poor sick persons, which ought to receive them entirely according to their institutions, and those who shall have recovered shall again be brought back to the aforesaid hospice and its places and dwellings; and let the access and egress of this kind be carried out by the carriages of the said hospitals, as is customary in other similar sick persons: but the clothing of the deceased shall be promptly and faithfully restored by the hospitals in which they shall have died from human death to the aforesaid apostolic hospice. Moreover, if it should happen that some sick persons cannot be transported from the hospice and its places and dwellings to hospitals, the sacraments of the Church shall be administered to them by the parish priests in whose district the same hospice and its places and dwellings are situated, or by others with the permission of the same parish priests. But the bodies of those who shall have died in the Lateran hospice shall be buried in the cemetery of the hospice at the Holy of Holies, and those who shall have died in the aforesaid places at the place called the Great Bank, or at the Sixtine Bridge, in the burials and cemeteries of the same churches respectively constructed and to be constructed, without any emolument to the parish priests.
27 § 23. And in order that the immense expenses which are necessary for so great a work may be supplied in some measure, we will, command, and by apostolic authority grant and indulge to the aforesaid hospice, that the aforesaid poor, whether living in the hospice or dwelling outside it, as aforesaid, yet wearing the habit of the hospice, and chosen by the Congregation for this purpose, may not only be able but ought to seek alms modestly at the doors of churches and in other convenient places, never however within churches, for the benefit of the aforesaid hospice and the sustenance of its poor, nor shall such seeking cease or be abandoned, even if the revenues of this hospice should be acquired sufficient for, or even exceeding, the sustenance of all the poor invalids in any way whatsoever; for whatever shall remain, God granting, for such sustenance, we decree shall be and is to be expended and converted, by the judgment of the aforesaid Congregation, into the dowry of girls who shall have lived laudably in the aforesaid hospice. And lest these same girls remain deprived of dowry subsidies, which are distributed most abundantly by confraternities, places and pious persons of the aforesaid City, we indulge with equal motion, knowledge and fullness of power that they may perpetually use, enjoy and possess all and singular indults, faculties and privileges habilitating the girls of other conservatories, places and pious houses of the same City to obtain such subsidies in any manner whatsoever, just as if they had been granted nominally to themselves or to the aforesaid apostolic hospice. And nevertheless we similarly habituate and dispense the girls of the aforesaid hospice, with like motion, knowledge and fullness of power, even by the tenor of these presents, most amply and fully, for obtaining any dowry subsidies even national, although they do not dwell in their own or particular houses or in regions to which the distribution of such subsidies is destined for girls in certain or individual years, or although the requisites prescribed by the disposition of founders, benefactors, or donors, or by any even long-established custom, or by any statutes or apostolic constitutions, are not had, all the foregoing and other things notwithstanding.
28 § 24. And moreover, in order that for the perpetual conservation, happy governance, and healthful progress and increase of such a hospice of poor invalids, there may be opportunely consulted with greater diligence and attention as can be done, a Congregation, partly from the prelates of the Roman Curia, partly from other men, all virtuous.
INNOCENTIUS XII PP.
29 charity, piety, and outstanding knowledge of affairs, composed, and by the addition and incorporation of the aforesaid Treasurer of Our Chamber and Commissioner General and likewise four approved men, as aforesaid, increased, and brought into one body, who nevertheless these four men not for more than a year, but in the future, in the manner of the others, likewise at Our and the Roman Pontiff for the time being existing discretion are and are understood to be appointed, We place in charge, appoint and constitute, or already place in charge7, appoint and constitute, and, as aforesaid, increased, confirm and renew, so that this Congregation for the time being existing, and to be renewed, confirmed, or constituted at the discretion of Us and Our successors the Roman Pontiffs, in perpetual future times concerning those things which pertain to the observance of such an institute, the salvation of souls, the sustenance of bodies, and the correct norm and discipline of the hospital, as well as economic administration, the preservation and defense of goods and rights, the provident selection, distribution and removal of ministers and officials even of priests, and both of regulars and of seculars, saving however as regards regulars obedience toward their superiors, and any superintendence both of spiritual and temporal matters, direction and administration, may preside in the Lord, watch over diligently and apply itself without delay; and to the same Congregation We grant and impart fitting and ample faculty for making whatever statutes, ordinances, constitutions and rules, lawful however and honest, and not contrary to the sacred canons and decrees of the sacred Council of Trent, and for correcting, changing, reforming, as often as need shall be, those made and established, and for making others anew. Which indeed statutes, ordinances, constitutions and rules thus made, corrected, changed, reformed and newly made, after they shall have been approved by Us and the Roman Pontiff for the time being existing, We will that they be inviolably observed by all and each whom they and they concern, and according to their and their disposition and tenor by any judges and superiors whatsoever, the faculty of judging and interpreting otherwise being removed, they ought to be judged and decided.
30 § 25. Finally We exhort Christian faithful with the greater exhortation to this hospital as much as We can with affection of mind in the Lord, so that to this most pious and most salutary hospital, for whose perpetual preservation and successive maintenance vast and prompt expenditure and the greatest care is required, and whose resources and revenues the more they are increased, the more is multiplied the number of the poor to be fed and the works of charity enlarged, they may extend helping hands with alms and kind gifts, about to receive a hundredfold in the eternal tabernacles of heaven.
