In apostolicae dignitatis apice
7 § 5. Affinché però gli stessi, elevati per Nos in Episcopali, come è stato detto, servano a più splendido decoro, dei medesimi col tenore dei presenti ordiniamo, che oltre i Monaci continuamente nel suddetto Monastero, secondo le regole e i precetti del medesimo suddetto Monastero, prima ricevuti, e ivi abitanti e residenti, i quali, come prima, quotidianamente al servizio del Coro della medesima Chiesa, e ad altre funzioni sacre secondo l'arbitrio del Vescovo e dell'Abate Fuldense per il tempo esistente siano obbligati a compiersi; il Decano per il tempo esistente con Moto pari;
10 Clausole, e Decreti, Derogantur contrariis.
Spedito in Cancelleria Apostolica.

BENEDICT BISHOP
Servant of the Servants of God.
For perpetual remembrance of the matter.
1 Placed at the summit of Apostolic Dignity, by Divine disposition thus ordering all things, to which all obey, though with unequal merits, We behold and survey all parts of the Lord's Field, as it were from the peak of a mountain, so that We may judge what is fitting for the condition, adornment, and strengthening of all Churches: And for this reason, adhering to the footsteps of Our Predecessors, We deem it fitting sometimes to plant and establish new Episcopal Sees, and sometimes to adorn with Episcopal dignity and honor notable Monasteries, yet preserving in them Regular observance, so that from this there may result a more abundant cultivation and harvest of the Lord's Field, and the Monastic Order may flourish more brightly, peace and concord may be maintained with neighboring peoples, and what is most important, the name of the Catholic Faith may appear more splendidly in Cities in which illustrious Persons reside, and their Prelates may be distinguished with more worthy titles, and may be exalted with fitting favors.
2 § 4. Since therefore, as We have learned, the notable Monastery, called the Abbey of Fulda, of the Order of St. Benedict, founded by St. Boniface in Buconia, immediately subject to the Apostolic See, which has its City, with a Seminary of Students and an Academy of General Studies existing there, and Territory subject to it, containing very many Places, Prepositurae, and Towns, with certain Secular and Collegiate Churches, and no small number of Parochial Churches positioned round about, under itself, and in which a most abundant number of Monks is nourished under one and the same Discipline and Regular Observance, from which at least thirty daily perform the Divine offices, both in the Choir and within the sacred Church, rendering praises to God, with particular frequency and decorum, and the fruits, revenues, and income of which Monastery are found to be taxed at three hundred twenty florins in the Books of the Apostolic Chamber; and the Abbot of the same Monastery (who, as We have likewise learned, is also a Prince of the Holy Roman Empire, and Arch-Chancellor of Our most illustrious Daughter in Christ Mary Theresa, Queen of Hungary and Bohemia, and of Our most beloved Son in Christ Francis, King of the Romans and elected Emperor of the Romans, and also for the time being existing Empress of the Romans, and is Primate through Germany and Gaul; and who exercises quasi-Episcopal jurisdiction, both in the aforesaid city and in the whole Territory, and other Places subject to him, Prepositurae, and Towns aforesaid, not however in those things which are of the Order) the election to the fourteen professed Monks of the same Order, expressly capitular for the time being, namely the Dean, who is also called Prepositus of St. Andrew on the New Mountain near Fulda and is the first dignity after the Abbatial, and continuously resides in the Prepositure of the same St. Andrew of the said Order adjoining the same Monastery, and eight Prepositi in eight other Monasteries or Prepositurae of the same Order, yet depending on the aforesaid first Monastery, dwelling in places distant outside the aforesaid principal Monastery, and presiding over them, and in the community of Regular companions, besides spiritual Offices, administering the annexed jurisdiction in the name and authority of the Abbot of Fulda, and also five other Monks of the aforesaid Order, respectively Capitular Monks, yet not Prepositi, of whom one of them is the Capitular President of Regular Discipline and Choir in the aforesaid Monastery, and always with the aforesaid Dean, the remaining four Monks Capitular, and not Prepositi, continuously dwelling and remaining together with the same Prepositi, as their companions and messmates, with due however reverence and subjection toward them, respectively, pertains and belongs to the Concordats of Germany prevailing there, and enjoyed very many, for this reason, distinguished prerogatives.
3 § 2. We therefore, attentive to so many and such great merits by which the aforesaid Monastery excels, desiring to erect its Abbatial Church into a Cathedral and Episcopal one, as below, For which reasons it is erected into an Episcopate, the Regular observance remaining nonetheless intact:
4 Nor the right of those electing, and the form of election. By Our own motion, not at the instance of any petition offered to Us on this matter, but from certain knowledge, and from Our mere deliberation, and from the fullness of Apostolic power, We do erect and establish in perpetuity the aforesaid Abbatial Church, with firm things however always remaining in it, and always vigent therein, in every state, quality, denomination, and complete essential regularity; so that henceforth as before it shall never cease to be Regular, into a Cathedral and Episcopal Church, which as before subject immediately to the Apostolic See, and Regular existing Church; by Apostolic authority, through the present tenor, We erect and establish in perpetuity, and with title and honor Episcopal We adorn, and the Abbots of the aforesaid Monastery existing for the time being, We declare to be Bishops and Bishops of Fulda; nor that the Bishop of the same Church existing for the time being by Us, as aforesaid, erected into Episcopal, shall henceforth be called not only Bishop and Abbot of Fulda, but also true Bishop of the same Church with all Episcopal insignia, privileges, honors, and prerogatives due and granted to Bishops, and with rights and jurisdictions over the Secular and Regular Clergy, and the People of the aforesaid City, as well as of the whole Territory, and Dominion, and Diocese of Fulda, and with faculties, preeminences, graces, favors, and indults real, and personal, and mixed, which other Episcopal Churches, and their Prelates in any manner whatsoever, yet not however by burdensome title, or from indult, or particular privilege, use, enjoy, possess, and rejoice, and to use, enjoy, possess, and rejoice can and shall be able; and true at the same time Abbot Regular of Fulda, with all his Abbatial rights, honors, preeminences, prelations, and prerogatives all, which at present he enjoys, truly, really, and with effect exist, and he himself in the Letters Apostolic as well concerning grace as justice separately, or both mixed, henceforth to be expedited. With the title and name of Bishop at the same time and Abbot of Fulda be adorned, and called, and let the same be inscribed; and that upon the occurrence of the vacancy of the same Church erected into Episcopal by Us, as aforesaid, and of the aforesaid Monastery, the Bishop and Abbot thereof, with no innovation in its election, in the same manner and form as before, by the said Dean and the other thirteen be elected and held: With this also, the Bishop and Abbot of Fulda, jurisdiction over the true Professed Monks Capitular aforesaid, who only voice active and passive in the aforesaid election, as before, can have, to be elected.
§ 3.
5 Yet so, that the Canonical Election of the Abbot of the aforesaid Monastery having followed, as aforesaid, the Bishop of Fulda elected shall also remain, and therefore the Confirmation of the aforesaid election, as before, together with the provision of the Episcopal Church by Us, as aforesaid, erected, and of the Monastery of Fulda, from the Apostolic See to seek and obtain respectively; from which as his Episcopal at the same time and Abbatial Diocese in the same Places, Churches, and Persons, and the aforesaid Clergy both secular and Regular, at present subject to the Territory of Fulda, and according to the Concordat entered into between Our Venerable Brother Charles Philip, the present Bishop of Würzburg, and Our Beloved Sons, the Chapter and Canons of the Church of Würzburg on the one part, and Our Venerable Brother Amand, Bishop of Themiscira in partibus infidelium, and the present Abbot of the aforesaid Monastery, whom we intend shortly to transfer to the aforesaid Church of Fulda erected into Episcopal by Us, as aforesaid, and Our Beloved Sons also the Regular Chapter of the aforesaid Monastery on the other part entered into, and recently by Us with Apostolic authority aforesaid approved and confirmed, yet always with the precedence saved and unharmed, in favor of the aforesaid present and for the time being existing Bishop of Würzburg, and of his Episcopal See, to them, as to ancients, due, to exercise shall be able, and the aforesaid tax of three hundred twenty florins in the Books of the Apostolic Camera, as aforesaid, described, remaining firm also, which sole tax in the Letters Apostolic of the Episcopal and Abbatial Church of this kind provision, and confirmation of election, to be made thereupon from expedition, henceforth to be paid, and that never by reason of the aforesaid erection of the same Church into Episcopal by Us, as aforesaid, made to be increased We will, by equal motion, the said Apostolic authority, by the tenor of the same present We decree.
§ 4
6 And that the Episcopium, for the residence and habitation of the Bishop and the Abbot of Fulda existing for the time being, be the same Monastery or Palace which, until the election of the Abbot of Fulda as Bishop of Fulda takes place, the Cathedral Episcopium and the Capitular Regular is designated. The residence of the Capitulars, how it was observed in the time of Abbot Fulda, and at present is inhabited, and is accustomed to be inhabited, we declare by a similar Motu. For the Cathedral Church, however, so that the same principal Church of the aforesaid Monastery, under the ancient invocation of SS. Saviour, be held as a Church; and in it a Chapter; nor in the least be diminished in its Regularity and denomination of a Regular Chapter, consisting only of the aforesaid fourteen or fifteen Capitulars, insofar as another Monk of the same Order may be added to the same number, as below; not however of other non-Capitular Monks, and outside the aforesaid number of the same Order respectively, namely the Dean, whose Deanery be the first and only Regular Dignity in the aforesaid Church, and whose, while that be vacant for the time, election ought to pertain to the aforesaid Abbot and the remaining Capitular Monks aforesaid as before, and to the same eight Prepositi, as well as five or six, if another non-Capitular Monk of the said Order expressly professed by the Bishop and Abbot of Fulda existing for the time being (to whom it shall always, as before, pertain the election both of the aforesaid eight Prepositi, as well as of the other five or six Capitular Monks aforesaid) may be added to the same Capitular number; with this condition however that both the aforesaid Dean and the aforesaid Capitular Monks wear Regular and Monastic vestments, and the Dean and the other aforesaid Capitular Monks shall be obliged to wear them according to their Regular profession, composed only; and that the aforesaid Chapter, at the time of the Episcopal and Abbatial See being vacant, until the election of the new Bishop and Abbot shall have taken place, shall take governance not only from the Monastery, but from the whole City and Diocese of Fulda, we decree.
7 § 5. But in order that the same Church erected by Us into an Episcopal one, as aforesaid, may be served with more splendid adornment, by the tenor of these presents we command that beyond the Monks to be continuously received in the aforesaid Monastery, according to the rules and precepts of the same aforesaid Monastery, and there dwelling and residing, who, as before, are obliged daily to the Choir service of the same Church, and to other sacred functions to be performed at the discretion of the Bishop and Abbot of Fulda existing for the time being aforesaid; the Dean existing for the time being by a like Motu;
8 aforesaid, together with one of the said five or six Canons, not however Abbots Monks, as before, to reside continually at the same Prepositorship of St. Andrew, and the eight Priors existing for the time being of the aforesaid, beyond residence in the aforesaid Church on four and perhaps more days of the year; by them, as before, five of the same eight Priors aforesaid are to serve alternately for each complete month of every year; the remaining four or five Capitular Monks existing for the time being of this kind, also alternately for complete six months (unless otherwise concerning both the eight Priors and the other Capitular Monks not Abbots Monks aforesaid regarding this residence, it shall have been disposed by the Apostolic See) are respectively bound to fulfill their respective residence at the same Church. § 6. For the office of Penitentiary and Theologian respectively, to be exercised in the aforesaid Church according to the form of the Council of Trent, from the fact that none of the aforesaid eight Priors and the remaining Capitular Monks aforesaid, given their permanence in the aforesaid Priorates, can fulfill the aforesaid office, by the tenor of these presents We will that the Bishop and Abbot of Fulda existing for the time being shall designate two, not however Canons, but nevertheless expressly professed of the aforesaid Order, in the first-mentioned Monastery and at the same Church continually dwelling and residing suitable Presbyter Monks, of whom one shall exercise the office of Penitentiary, the other truly that of Theologian respectively, according to the form of the aforesaid Council. § 7. Furthermore, to the modern and existing for the time being Dean and eight Priors only (who together with the other aforesaid Capitular Monks a special Badge of a Golden Cross to be worn on the neck, from the concession of Pope Clement XII of blessed memory, Our Predecessor, and only Mitre and Ring, as often as they shall provide assistance to the Bishop or Abbot of Fulda existing for the time being exercising Pontificals, may use, enjoy, possess, and rejoice freely and lawfully, the same Apostolic authority, by the tenor of these presents, We also grant and indulge § 8. These present Letters always and perpetually to be valid and effective and to be, nor at any time by any subreptiousness or obreption of Our, they enjoy) so that the same Dean and eight Priors, Penitentiary and Theologian hands to be entrusted to certain ones.
9 To the Dean and Priors is conceded the use of Mitre and Ring when assisting the Bishop Abbot in exercising Pontificals.
10 Clauses and Decrees. Contrary things are derogated.
11 ption, or nullity, or invalidity by defect, or of Our intention, or any other defect whatsoever, to be noted, impugned, invalidated, or brought into question or controversy, or any remedy of law or fact, or of grace or justice to be obtained against them; nor shall they be comprehended or confused under any revocations, suspensions, limitations, derogations, or other contrary dispositions of similar or dissimilar graces, even by Us and the aforesaid Apostolic See, under whatsoever tenors and forms, and with whatsoever clauses and decrees, even by similar Motu Proprio, even consistorially, made or to be made from time to time; but they shall always be excepted from them, and as often as they shall be issued, so often shall they be restored, replaced, and fully reintegrated into their pristine and most valid state, and newly granted even under whatsoever later date, to be chosen at any time, and shall be valid and remain so, and shall obtain and secure their full and complete effects; and thus shall they be held by all; and if it shall happen that they be attempted against by any Judges, Ordinaries, or any authority whatsoever, knowingly or unknowingly, We decree them by similar Motu Proprio to be null and void. § 9. Notwithstanding any constitutions and ordinances, even special or general, issued or to be issued in Synodal, Provincial, and General Councils, and Apostolic Constitutions and Ordinances, and those of the aforesaid Monastery and Order aforesaid, even those strengthened by oath, Apostolic confirmation, or any other firmness whatsoever, statutes and customs, privileges granted, confirmed, approved, and renewed: All and singular of which, even if special, specific, express, and individual mention ought to be made of them and their whole tenors, or some exquisite form ought to be observed for this purpose, their tenors, as if they had been inserted word for word, with nothing whatsoever omitted, and the form transmitted in them observed, We hold as expressed in these presents, and otherwise remaining in their force, for the validity of all and singular of the aforesaid matters, on this occasion only specially and expressly, and most widely and fully, by similar Motu Proprio We derogate, and from all other things contrary whatsoever. Penal Sanction. § 40. Let no one whatsoever be permitted to infringe this page of Our erection, institution, declaration, decree, concession, mandate, will and indult, and derogation, or to contravene it with rash presumption: But if anyone shall presume to attempt this, let him know that he shall incur the indignation of Almighty God, and of the Blessed Apostles Peter and Paul. Given at Rome at St. Mary Major in the Year of the Incarnation of Our Lord one thousand seven hundred fifty-two, on the third day before the Nones of October, in the first year of Our Pontificate. Expedited in the Apostolic Chancery. The Bishop of Würzburg is honored with the prerogatives of bearing the Cross honorifically and the use of the Pallium, under certain modes and conditions.
BENEDICT, BISHOP, SERVANT OF THE SERVANTS OF GOD.
12 For perpetual remembrance of the matter.
13 The Church, the teacher and mistress of all churches, having received from the heavenly spouse Jesus Christ the supreme authority and direction over all the churches of the Catholic world, has always obtained this, that nevertheless according to the conditions of places, times, and persons, she now administers some part of her more ample jurisdiction to the distinguished Pastors of those churches, through Indults and Apostolic Letters under whatsoever tenors and forms, and with whatsoever even Derogatory Derogations and other more efficacious, most efficacious, and unusual Clauses, irritant and other Decrees, even by similar Motu Proprio, and even consistorially, and otherwise in whatsoever manner.
14 The right of the aforesaid Cross, and the use of the Pallium, the principal insignia of Pontifical honor; the rite customarily observed in granting the Pallium, and its mystical signification.
15 The amplitude of the Church of Würzburg, and the dignity of its Bishops, Chapter, and Clergy.
16 to be sustained and exercised, has now granted exquisite prerogatives of honor, as it has seemed salutary in the Lord to the Roman Pontiffs, successors of the same Jesus Christ and of the Blessed Apostle Peter, the Prince of the Apostles, to expedite for the glory of God and the promotion of the utility of the faithful peoples, and for the protection and majesty of the Catholic Religion.
17 § 4. Moreover, among the principal insignia of sacerdotal honor, by which various Churches throughout the world and their Prelates have merited to be adorned by the Apostolic See, both the use of the Sacred Pallium and the right to bear the sign of the Most Holy Cross are deservedly numbered. That pallium, indeed, blessed by the Roman Pontiff, or by his authority alone, with solemn rite, and preserved with religious care near the Body of the Most Blessed Prince of the Apostles, and thence taken at the earnest prayers of the Prelates who request it, is granted to be used and worn by one, signifies a certain peculiar bond of sacred covenant between him and the Roman Pontiff, the Successor of that Blessed Peter, confirmed by the interposition of a special sacrament: And since the Pallium itself is woven from the fleece of sheep, and is borne upon the shoulders of the sacred Pastor, it represents the appearance of that sheep which the Lord sought when it had gone astray, and having found it, lifted it upon His own shoulders; so that the Bishop, who bears the type of Christ and performs His office, by the very garment itself may show himself an imitator of that good Shepherd, who bore the infirmities of His sheep with admirable excess of piety and mercy. But the bearing of the erect Cross not only displays the force and authority of the Pastoral Office, derived from the power of Him who, crucified in weakness, yet living by the power of God, armed His Ministers against all adverse powers with the sign of the invincible Cross; but also by its very sight places before the faithful peoples the sum of Episcopal preaching, and raising up to their consolation the standard of our Faith, instills the hope of eternal salvation in believers. The Province of Mainz, situated in the parts of Upper Germany, founded and erected from the eighth century of the Church by St. Buchard the Bishop by the authority of the Apostolic See, endowed with singular prerogatives, and giving the rights of a most ample Diocese to many distinguished Prelates and others from
