Crebrae allatae
6 Can. 1
9 Can. 2
12 Can. 3
14 Can. 4
19 Can. 5
21 Can. 6
23 § 2. 1° Alla promessa di matrimonio validamente assiste il medesimo parroco o Gerarca del luogo o sacerdote designato da una delle parti che secondo quanto prescritto dai can. 86, 87 validamente assiste al matrimonio;
26 Can. 7
28 Can. 8
31 Can. 9
34 Can. 10
38 Can. 11
41 Can. 12
43 Can. 13
47 Can. 14
49 Can. 15
51 Can. 16
53 Can. 17
55 Can. 18
58 Can. 19
60 Can. 20
63 Can. 21
65 1° Il parroco investighi la cosa più accuratamente, interrogando sotto giuramento almeno due testimoni degni di fede, purché non si tratti di impedimento la cui conoscenza comporterebbe infamia per le parti, e, se necessario, anche le stesse parti;
66 2° Compia o perfezzioni le pubblicazioni, se il dubbio sia sorto prima che le pubblicazioni fossero iniziate o completate;
68 § 2. Scoperto un impedimento certo:
69 1° Se l'impedimento sia occulto, il parroco compia o assolva le pubblicazioni, e deferrisca la cosa, tacendo i nomi, al Gerarca del luogo o alla Sacra Penitenzeria;
72 Can. 22
74 Can. 23
76 Can. 24
78 CAPUT II Degli impedimenti in genere
79 Can. 25
81 Can. 26
85 Can. 27
87 Can. 28
90 Can. 29
93 Can. 30
95 Can. 31
96 § 1. Gli impedimenti di grado minore sono:
97 1° La consanguinità nel sesto grado della linea collaterale;
98 2° L'affinità di cui nel can. 67, § 1, n. 1, nel quarto grado della linea collaterale: e quella di cui nello stesso canone § 1, nn. 2, 3, in qualsiasi grado;
99 3° L'onestà pubblica nel secondo grado;
100 4° La cognazione spirituale;
101 5° La tutela e la cognazione legale di cui nel can. 71;
104 Can. 32
106 1° Dall'impedimento di consanguinità nel quinto e sesto grado della linea collaterale;
107 2° Dall'impedimento di affinità di cui nel can. 67, § 1, n. 1, nel quarto grado della linea collaterale e dagli impedimenti di cui nello stesso canone § 1, nn. 2, 3, in qualsiasi grado;
108 3° Dall'impedimento di onestà pubblica nel secondo grado;
109 4° Dall'impedimento di cognazione spirituale;
110 5° Dall'impedimento di cognazione legale e di tutela;
113 1° Dall'impedimento di età, non però oltre i due anni compiuti;
114 2° Dall'impedimento di crimine di cui nel can. 65, n. 1;
115 3° Dal quarto grado di consanguinità nella linea collaterale;
116 4° Dall'impedimento di affinità di cui nel can. 67, § 1, n. 1, nel secondo e ulteriore grado della linea collaterale;
120 § 5. Se i contraenti appartengono a diverse eparchie dello stesso rito o a diversi riti, la dispensa sia chiesta all'Ordinario dell'uomo, e se l'uomo sia acattolico, all'Ordinario della donna.
122 Can. 33
124 Can. 34
127 Can. 35
132 Can. 36
134 Can. 37
136 Can. 38
139 Can. 39
142 Can. 40
144 Can. 41
146 Can. 42
148 Can. 43
150 Can. 44
152 Can. 45
154 Can. 46
156 Can. 47
158 CAPUT III Degli impedimenti impedenti
159 Can. 48
160 § 1. Impediscono il matrimonio:
161 1° Il voto pubblico di castità perfetta emesso nella professione semplice o minore;
164 Can. 49
166 Can. 50
168 Can. 51
170 1° Vi siano cause giuste e gravi;
171 2° Il coniuge acattolico abbia prestato cautela di allontanare dal coniuge cattolico il pericolo di perversione, e ambedue i coniugi di far battezzare e educare cattolicamente tutta la prole;
173 § 2. Le cautele regolarmente si esigano per iscritto.
174 Can. 52
176 Can. 53
180 Can. 54
181 Gli Ordinari e gli altri pastori d'anime
182 1° Distolgano i fedeli dalle nozze miste, per quanto possono;
183 2° Se non potranno impedirle, si adoperino con ogni studio affinché non siano contratte contro le leggi di Dio e della Chiesa;
185 Can. 55
188 Can. 56
190 CAPUT IV Degli impedimenti dirimenti
191 Can. 57
194 Can. 58
198 Can. 59
201 Can. 60
204 Can. 61
206 Can. 62
209 Can. 63
211 Can. 64
215 Can. 65
216 Non possono validamente contrarre matrimonio:
217 1° Coloro che, perdurando lo stesso valido matrimonio, hanno consumato adulterio tra loro e si sono reciprocamente promessi il matrimonio o hanno tentato il matrimonio stesso, anche per solo atto civile;
218 2° Coloro che, perdurando parimente lo stesso valido matrimonio, hanno consumato adulterio tra loro e uno di essi ha ucciso il coniuge;
220 Can. 66
224 § 1. 1° La consanguineità si computa per linee e gradi;
225 2° In linea retta, tanti sono i gradi quante le persone, escluso lo stipite;
227 Can. 67
228 § 1. 1° L'affinità di cui nel can. 68, § 1, dirimente il matrimonio in linea retta, in qualsiasi grado; in linea obliqua, fino al quarto grado incluso;
229 2° L'affinità di cui nel can. 68, § 2, dirimente il matrimonio fino al quarto grado incluso;
230 3° L'affinità di cui nel can. 68, § 3, dirimente il matrimonio nel primo grado.
232 1° Tante volte quante si moltiplica l'impedimento di consanguineità da cui procede;
234 Can. 68
235 § 1. 1° L'affinità da digeneia sorge da matrimonio valido anche se non consumato;
236 2° Sorge tra l'uno e l'altro coniuge e i consanguinei dell'altro;
238 § 2. 1° Per diritto particolare, l'affinità da digeneia di cui in § 1, n. 1, sorge anche tra i consanguinei dell'uomo e i consanguinei della donna;
240 § 3. 1° Per diritto particolare, l'affinità inoltre sorge da trigeneia cioè da due matrimoni validi, anche non consumati, se due persone contraggono matrimonio: a) con una medesima terza persona, sciolto il matrimonio, l'uno dopo l'altro, oppure b) con due persone tra loro consanguinee;
241 2° L'affinità da trigeneia la contraggono l'uno o l'altro coniuge con coloro che sono, da altro matrimonio, affini dell'altro coniuge da digeneia;
242 3° Questa affinità, tra l'uno o l'altro coniuge e gli affini dell'altro, si calcola così che coloro che da altro matrimonio sono affini dell'uomo da digeneia, siano nello stesso grado affini della donna da trigeneia, e viceversa;
244 Can. 69
246 Can. 70
248 § 2. 1° Dal battesimo la cognazione spirituale la contraggono il padrino con il battezzato e i suoi genitori;
250 Can. 71
252 CAPUT V Del consenso matrimoniale
253 Can. 72
256 Can. 73
259 Can. 74
262 1° Se l'errore sulla qualità si riduce a errore sulla persona;
264 Can. 75
266 Can. 76
268 Can. 77
271 Can. 78
274 Can. 79
277 Can. 80
280 Can. 81
285 Can. 82
288 Can. 83
290 Can. 84
293 Can. 85
296 Can. 86
298 1° A partire soltanto dal giorno in cui hanno legittimamente iniziato l'amministrazione del beneficio, o assunto l'ufficio, a meno che non siano stati scomunicati o interdetti o sospesi dall'ufficio o dichiarati tali;
299 2° Entro i confini soltanto del loro territorio, sia che i contraenti siano loro sudditi, sia che non lo siano, purché siano del loro rito;
302 § 3. 1° Se non sia diversamente stabilito, sia per domicilio sia per quasi-domicilio, chiunque ha il parroco e il Gerarca del proprio rito;
303 2° Venendo a mancare il parroco per i fedeli di un certo rito, il loro Gerarca designi un parroco di altro rito, che se ne assuma la cura, dopo che lo stesso Gerarca abbia ottenuto il consenso del Gerarca del parroco da designarsi;
305 4° Il parroco o il Gerarca proprio del vagabondo è il parroco o il Gerarca del suo rito del luogo dove il vagabondo attualmente dimora; venendo a mancare il parroco o il Gerarca del suo rito, si osservino le norme stabilite nei nn. 2, 3;
307 Can. 87
308 § 1. 1° Il parroco e il Gerarca del luogo, che possono validamente assistere al matrimonio, possono anche concedere a un altro sacerdote la facoltà di assistere entro i confini del loro territorio a un matrimonio determinato, purché lo facciano espressamente e il sacerdote sia determinato; possono anche concedere allo stesso sacerdote la facoltà di subdelegare un altro sacerdote determinato, che assista a quel matrimonio;
309 2° Al vicario cooperatore può essere concessa dal parroco o dal Gerarca del luogo anche la facoltà generale di assistere ai matrimoni; ottenutala, egli gode della facoltà di subdelegare, come nel n. 1;
313 Can. 88
315 1° Dopo che sia loro legittimamente constatata la libertà dello stato dei contraenti secondo la norma del diritto;
316 2° Dopo che inoltre sia loro constatato il domicilio o il quasi-domicilio o la dimora di un mese o, se si tratti di vagabondo, la dimora attuale di uno dei contraenti nel luogo del matrimonio;
321 Can. 89
323 1° In pericolo di morte è valido e lecito il matrimonio contratto davanti ai soli testimoni; e anche fuori dal pericolo di morte, purché si possa prudentemente prevedere che questo stato di cose durerà per un mese;
325 Can. 90
326 § 1. All'osservanza della forma stabilita sopra sono tenuti:
327 1° Tutti coloro che sono stati battezzati nella Chiesa cattolica e ad essa convertiti dall'eresia o dallo scisma, benché questi o quelli si siano in seguito allontanati da essa, tutte le volte che contraggono matrimonio tra di loro;
330 Can. 91
332 Can. 92
337 Can. 93
339 Can. 94
341 Can. 95
344 2° Se i genitori non provvedessero affinché la prole nata da tale matrimonio sia battezzata; o provvedessero al suo battesimo con nomi falsi espressi, e nel frattempo non denunziassero al Gerarca, entro trenta giorni, la prole nata e battezzata, aggiungendo i veri nomi dei genitori;
346 Can. 96
349 Can. 97
353 Can. 98
357 Can. 99
359 Can. 100
361 Can. 101
363 Can. 102
365 Can. 103
367 Can. 104
370 Can. 105
372 Can. 106
376 Can. 107
378 Can. 108
380 Can. 109
383 Can. 110
385 1° Se voglia anche essa convertirsi e ricevere il battesimo;
388 Can. 111
391 Can. 112
393 Can. 113
395 Can. 114
397 Can. 115
399 Can. 116
402 Can. 117
404 Can. 118
407 Can. 119
409 Can. 120
413 Can. 121
416 ARTICULUS I Della convalidazione semplice
417 Can. 122
420 Can. 123
422 Can. 124
426 Can. 125
430 Can. 126
432 ARTICULUS II Della sanatione in radice
433 Can. 127
437 Can. 128
440 Can. 129
443 Can. 130
446 CAPO XII Delle seconde nozze
447 Can. 131

PIUS XII, POPE
MOTU PROPRIO
CREBRAE ALLATAE SUNT
ON THE DISCIPLINE OF THE SACRAMENT OF MATRIMONY FOR THE ORIENTAL CHURCH
1 Frequent petitions have been brought to Us, especially in these recent years, both by Our Legates and by the sacred Prelates of the Oriental Church, by which we were asked that, acceding to their pressing wishes, while the codification of the laws of the Oriental Church is not far from completion, we should without delay promulgate certain particular chapters of those same laws, which are indeed of great importance, so that we might effectively counter the grave and pernicious circumstances in which certain parts of Christ's flock using the Oriental rite were placed.
2 We therefore, having carefully and thoughtfully weighed all things in the Lord, by motu proprio, with certain knowledge and from the fullness of Apostolic power, decree and determine that those canons which pertain to the discipline of the sacrament of matrimony be now published.
3 Already at the beginning, when the first conferences were held for the preparation of the Code, Peter, Cardinal of the Holy Roman Church, Presbyter, Gasparri, President of the Council for preparing the Code of Canon Law of the Oriental Church, having in view the ease and frequency of the relations which the peoples and nations of the world bind together on account of the most expeditious travel of our age, in a letter given on the 15th day of September in the year 1930, consulted the sacred Pastors of the Oriental Church, asking from them whether it would seem expedient, for the fulfillment of the wishes explained to the Apostolic See from many places, that, as far as possible, ecclesiastical discipline pertaining to matrimonial impediments and to the form of entering into the nuptial covenant be made uniform; and this was requested because on account of the aforementioned ease of travel and return, mixed-rite marriages were becoming more frequent among men, and also with the purpose that uncertainties about the validity of marriages, which were harmful to their sanctity, might be completely removed.
4 The Council for the Oriental Church, therefore, in preparing the Code of Canon Law, having given due attention to the weighed responses, with almost all of the same sacred Pastors affirming, after this was reported to Our immediate Predecessor of happy memory, the Supreme Pontiff, proposed these canons for Our approval, which We by Our Apostolic authority approve:
5 ON THE SACRAMENT OF MATRIMONY
6 Can. 1
7 § 1. Christ the Lord raised the matrimonial contract itself between the baptized to the dignity of a sacrament.
8 § 2. Wherefore among the baptized there cannot be a valid matrimonial contract which is not by that very fact a sacrament.
9 Can. 2
10 § 1. The primary end of matrimony is the procreation and education of offspring; the secondary end is the mutual assistance and the remedy for concupiscence.
11 § 2. The essential properties of matrimony are unity and indissolubility, which in Christian matrimony obtain a particular firmness by reason of the sacrament.
12 Can. 3
13 Matrimony enjoys the favor of law; wherefore in doubt it must be held in favor of the validity of matrimony, until the contrary is proved, saving the prescription of can. 116.
14 Can. 4
15 § 1. A valid matrimony of the baptized is called ratified if it has not yet been completed by consummation; ratified and consummated if there has taken place between the spouses the conjugal act to which the matrimonial contract is by its nature ordained and by which the spouses become one flesh.
16 § 2. When matrimony has been celebrated, if the spouses have lived together, consummation is presumed, until the contrary is proved.
17 § 3. Matrimony validly celebrated between non-baptized persons is called legitimate.
18 § 4. An invalid matrimony is called putative if it has been celebrated in good faith before the Church by at least one party, until both parties become certain of its nullity.
19 Can. 5
20 The matrimony of the baptized is governed by law not only divine but also canonical, saving the competence of civil power concerning the merely civil effects of the same matrimony.
21 Can. 6
22 § 1. A promise of matrimony, even if bilateral or of betrothal, is invalid in both forums, unless it has been made before the pastor or the local Hierarch or a priest to whom the faculty of assisting has been given by one of the parties.
23 § 2. 1° The same pastor or local Hierarch or priest designated by one of the parties validly assists at a promise of matrimony, who according to the prescription of can. 86, 87 validly assists at matrimony;
24 2° He who assists at a promise of matrimony is bound by obligation to see that its celebration is noted in the book of betrothals.
25 § 3. But from a promise of matrimony there is no action to demand the celebration of matrimony; there is, however, an action for the reparation of damages, if any is owed.
26 Can. 7
27 The priest assisting at a promise of matrimony shall not omit to impart to the Catholic spouses the blessing prescribed in the liturgical books, if particular law provides for it.
28 Can. 8
29 The pastor shall not omit to instruct the people prudently concerning the sacrament of matrimony and its impediments.
30 CHAPTER I On those things which ought to precede the celebration of matrimony and especially on matrimonial publications
31 Can. 9
32 § 1. Before matrimony is celebrated, it must be established that nothing stands in the way of its valid and licit celebration.
33 § 2. In danger of death, if other proofs cannot be obtained, it is sufficient, unless contrary indications are present, that those wishing to contract marriage affirm by oath that they have been baptized and are detained by no impediment.
34 Can. 10
35 § 1. The pastor to whom the right belongs to assist at marriage shall diligently investigate beforehand, at an opportune time, whether anything stands in the way of the marriage to be contracted.
36 § 2. He shall interrogate both the bride and the bridegroom, also separately and cautiously, whether they are detained by any impediment, whether they give their consent freely, especially the woman, and whether they are sufficiently instructed in Christian doctrine, unless this last interrogation should appear unnecessary on account of the quality of the persons.
37 § 3. It is for the local Ordinary to give particular norms concerning such investigation by the pastor.
38 Can. 11
39 § 1. Unless baptism was conferred in his own territory, the pastor shall require testimony of baptism from both parties, or from the Catholic party only, if the marriage is to be contracted with a dispensation from the impediment of disparity of worship.
40 § 2. Catholics who have not yet received the sacrament of confirmation shall receive it before they are admitted to marriage, if they can do so without grave inconvenience.
41 Can. 12
42 The marriage to be contracted shall be publicly announced by the pastor between whom it is to take place, if particular law requires it.
43 Can. 13
44 § 1. The publication of marriages shall be made by the proper pastor of the spouses.
45 § 2. If a party has resided in another place for six months after reaching puberty, the pastor shall report the matter to the Ordinary, who according to his prudence shall either require publications to be made there, or shall prescribe other proofs and inquiries concerning the freedom of status.
46 § 3. If there be any suspicion of a contracted impediment, the pastor, even if the residence be shorter, shall consult the Ordinary, who shall permit the marriage unless the suspicion is first removed according to the norm of § 2.
47 Can. 14
48 The publications shall be made on three consecutive Sundays and other days of precept in the church, during the divine offices to which the people frequently come.
49 Can. 15
50 The local Ordinary may for his territory substitute for the publications a public posting of the names of those to be married at the doors of the parish church or another church for a space of at least eight days, provided that two days of precept are included in this space.
51 Can. 16
52 Publications shall not be made for marriages contracted with a dispensation from the impediment of disparity of worship or mixed religion, unless the local Ordinary according to his prudence, scandal being removed, shall have deemed it opportune to permit them, provided that the Apostolic dispensation has preceded, with the provision of can. 32 being observed, and mention is omitted of the religion of the non-Catholic party.
53 Can. 17
54 All the faithful are bound by the obligation of revealing to the pastor or the local Ordinary any impediments of which they know, before the celebration of the marriage.
55 Can. 18
56 § 1. The proper local Ordinary according to his prudent judgment can, for a legitimate cause, dispense from the publications even to be made in another eparchy.
57 § 2. If there be several proper Ordinaries, it belongs to him in whose eparchy the marriage is celebrated to dispense; but if the marriage is to be contracted outside their proper eparchies, it belongs to any of the proper Ordinaries.
58 Can. 19
59 If another pastor has conducted the investigation or publications, he shall immediately inform the pastor who is to assist at the marriage of their outcome by an authentic document.
60 Can. 20
61 § 1. After the investigations and publications have been completed, the pastor shall not assist at the marriage until he has received all necessary documents, and moreover, unless a reasonable cause requires otherwise, three days have elapsed from the last publication.
62 § 2. If the marriage has not been contracted within six months, the publications shall be repeated, unless the local Ordinary shall decide otherwise.
63 Can. 21
64 § 1. If doubt arises concerning the existence of some impediment:
65 1° The pastor shall investigate the matter more carefully, by interrogating under oath at least two trustworthy witnesses, provided that it does not concern an impediment from the knowledge of which infamy would arise to the parties, and, if necessary, the parties themselves also;
66 2° He shall conduct or complete the publications, if the doubt has arisen before the publications were begun or completed;
67 3° He shall not assist at the marriage without consulting the Ordinary, if he prudently judges that doubt still remains.
68 § 2. If a certain impediment is discovered:
69 1° If the impediment be occult, the pastor shall conduct or complete the publications, and shall refer the matter, concealing the names, to the local Ordinary or to the Sacred Penitentiary;
70 2° If it be public and is discovered before the publications are begun, the pastor shall not proceed further until the impediment is removed, even if he knows that a dispensation has been obtained for the internal forum only; if it is discovered after the first or second publication, the pastor shall complete the publications and refer the matter to the Ordinary.
71 § 3. Finally, if no impediment has been discovered, neither doubtful nor certain, the pastor, after the publications have been completed, shall admit the parties to the celebration of marriage.
72 Can. 22
73 The pastor shall not assist at the marriage of vagrants, namely those who have no domicile or quasi-domicile anywhere, except in case of necessity, unless he has obtained permission to assist after the matter has been referred to the local Hierarch or to a priest delegated by him.
74 Can. 23
75 The pastor shall not omit to teach the spouses, according to the different condition of persons, the holiness of the sacrament of matrimony, the mutual obligations of spouses and the obligations of parents toward their offspring; and he shall earnestly exhort them to confess their sins diligently before the celebration of matrimony and to receive the divine Eucharist devoutly.
76 Can. 24
77 The pastor shall seriously exhort minor children of a family not to enter into marriage without the knowledge or reasonable consent of their parents; and if they refuse, he shall not assist at their marriage unless he has first consulted the local Hierarch.
78 CHAPTER II On Impediments in General
79 Can. 25
80 All persons can contract matrimony who are not prohibited by law.
81 Can. 26
82 § 1. A prohibiting impediment carries with it a grave prohibition against contracting matrimony; nevertheless it does not render the marriage invalid if, notwithstanding the impediment, it is contracted.
83 § 2. A diriment impediment both gravely prohibits matrimony from being contracted and prevents it from being validly contracted.
84 § 3. An impediment, although it exists on the part of only one of the parties, nevertheless renders the marriage either illicit or invalid.
85 Can. 27
86 An impediment is considered public which arises from a public act or which can be proved in another way in the external forum; otherwise it is occult.
87 Can. 28
88 § 1. It is the prerogative of the supreme ecclesiastical authority alone to declare authentically when divine law prohibits or diriments matrimony.
89 § 2. The same supreme authority alone has the right to establish other impediments prohibiting or diriment to matrimony for the baptized in the manner of law, whether universal or particular.
90 Can. 29
91 § 1. The Hierarchs of places can forbid marriages to all persons actually residing in their territory and to their subjects even outside the boundaries of their territory in a particular case, but only for a time, for a just cause and while that cause endures.
92 § 2. The Apostolic See alone can add a diriment clause to a prohibition.
93 Can. 30
94 Custom introducing a new impediment or contrary to existing impediments is reprobated.
95 Can. 31
96 § 1. Impediments of lesser degree are:
97 1° Consanguinity in the sixth degree of the collateral line;
98 2° Affinity of which in can. 67, § 1, n. 1, in the fourth degree of the collateral line: and that of which in the same canon § 1, nn. 2, 3, in any degree;
99 3° Public honesty in the second degree;
100 4° Spiritual relationship;
101 5° Guardianship and legal relationship of which in can. 71;
102 6° Crime arising from adultery with promise or attempt of matrimony even by civil act alone.
103 § 2. The remaining diriment impediments are of greater degree.
104 Can. 32
105 § 1. Saving the broader faculty which may belong to them from privilege or particular law, with a canonical cause supporting, the Hierarchs of places, but not the Syncellus without special mandate, can dispense their own subjects from prohibiting impediments, except impediments arising from mixed religion or from a vow in profession minor or simple emitted in a religion of pontifical or patriarchal law, and from the following diriment impediments:
106 1° From the impediment of consanguinity in the fifth and sixth degree of the collateral line;
107 2° From the impediment of affinity of which in can. 67, § 1, n. 1, in the fourth degree of the collateral line and from the impediments of which in the same canon § 1, nn. 2, 3, in any degree;
108 3° From the impediment of public honesty in the second degree;
109 4° From the impediment of spiritual relationship;
110 5° From the impediment of legal relationship and guardianship;
111 6° Outside patriarchates, from the impediment of age, but not beyond two complete years.
112 § 2. The Patriarch, saving the broader faculty which may belong to him from privilege or particular law, besides the faculty of which in § 1, can dispense:
113 1° From the impediment of age, but not beyond two complete years;
114 2° From the impediment of crime of which in can. 65, n. 1;
115 3° From the fourth degree of consanguinity in the collateral line;
116 4° From the impediment of affinity of which in can. 67, § 1, n. 1, in the second and further degree of the collateral line;
117 5° From the form of celebration of matrimony in the case of which in can. 90, § 1, n. 2, but for a most grave cause.
118 § 3. The Patriarch can exercise the power which is attributed to him or recognized in §§ 1, 2, in his own subjects everywhere, and in all the faithful of his rite actually residing in the patriarchate, even if they do not have domicile or quasi-domicile in some eparchy of the patriarchate.
119 § 4. Dispensation from the remaining impediments is reserved to the Apostolic See.
120 § 5. If the contracting parties belong to different eparchies of the same rite or to different rites, dispensation shall be sought from the Hierarch of the man, and if the man is not a Catholic, from the Hierarch of the woman.
121 § 6. A delegate for the universality of cases does not have the faculty of subdelegating, unless it is expressly granted to him for individual acts.
122 Can. 33
123 In urgent danger of death, local Hierarchs, for the purpose of consulting conscience and, if the case warrants, for the legitimation of offspring, are able to dispense their own subjects dwelling anywhere and all persons actually residing in their own territory from both the form to be observed in the celebration of matrimony and from all and each of the impediments of ecclesiastical law, whether public or occult, even multiple impediments, excepted impediments arising from the sacred order of priesthood and from affinity of which in can. 68, § 1, in the direct line, with consummated matrimony, with scandal removed, and, if dispensation be granted from the impediment of disparity of worship or mixed religion, with the customary precautions having been taken.
124 Can. 34
125 § 1. In the same circumstances of which in can. 33 and only in cases in which not even the local Hierarch can be approached, the same faculty of dispensing is possessed by the parish priest, the assistant vicar, the priest who assists at matrimony according to the norm of can. 89, n. 2, and the confessor, but this one in the internal forum in the act of sacramental confession only.
126 § 2. In the case of which in § 1, the local Hierarch is deemed unable to be approached if he can be reached only by telegraph or telephone.
127 Can. 35
128 § 1. The local Hierarchs are able, under the clauses established at the end of can. 33, to grant dispensation from all impediments of which in can. 33, whenever an impediment is discovered or, although previously known, is then brought to the knowledge of the Hierarch or parish priest only when all things are already prepared for the nuptials, and matrimony cannot, without probable danger of grave harm, be deferred until dispensation is obtained from the Apostolic See or, as regards impediments from which he is able to dispense, from the Patriarch.
129 § 2. This faculty is valid also for the convalidation of matrimony already contracted, if the same danger exists in delay and there is not time to have recourse to the Apostolic See or, as regards impediments from which he is able to dispense, to the Patriarch.
130 § 3. In the same circumstances, all those of which in can. 34, § 1 enjoy the same faculty, under the clauses of the same canon, but only if the case by its nature or by fact alone is occult and not even the local Hierarch can be approached according to the norm of can. 34, or only with danger of violation of secrecy.
131 § 4. The faculty of which in § 1 does not take away from Hierarchs the power of dispensing from the form to be observed in the celebration of matrimony, and from impediments of ecclesiastical law from which the Apostolic See is accustomed to dispense, whenever recourse to the Apostolic See is difficult and likewise to the Legate of the Roman Pontiff endowed with the necessary faculty, and at the same time there is danger of grave harm in delay.
132 Can. 36
133 The parish priest, assistant vicar, or priest of which in can. 34, concerning the dispensation granted for the external forum shall immediately inform the local Hierarch; and it shall be noted in the book of matrimonies.
134 Can. 37
135 Unless the rescript of the S. Poenitentiariae or, within the limits of each one's competence, the Patriarch or local Hierarch shall provide otherwise, dispensation in the non-sacramental internal forum granted from an occult impediment shall be noted in the book carefully kept in the secret archive of the curia, and no other dispensation for the external forum is necessary, even if afterwards the occult impediment should become public; but it is necessary if dispensation had been granted only in the sacramental internal forum.
136 Can. 38
137 § 1. If a petition for dispensation has been sent to the Apostolic See, local Hierarchs shall not use their faculties, if they have any, except from grave and urgent cause, in which case they shall immediately notify the Apostolic See of the matter.
138 § 2. The same shall be observed by local Hierarchs subject to the Patriarch, if a petition for dispensation has been sent to the Patriarch.
139 Can. 39
140 § 1. In matrimonies either contracted or to be contracted, he who enjoys a general indult of dispensing from a certain impediment is able, unless the indult itself expressly prescribe otherwise, to dispense from it even if the same impediment be multiple.
141 § 2. He who has a general indult of dispensing from several impediments of diverse species, whether diriment or prohibitive, is able to dispense from the same impediments, even public ones, occurring in one and the same case.
142 Can. 40
143 If ever with a public impediment or impediments from which by indult someone is able to dispense, there concurs another impediment from which he is not able to dispense, recourse must be had to the Superior who is able to dispense from all; if, however, the impediment or impediments from which he is able to dispense are discovered after dispensation has been obtained from that Superior, he will be able to use his faculties.
144 Can. 41
145 By dispensation from a diriment impediment granted either from ordinary power or from delegated power through a general indult, but not through a rescript in individual cases, legitimation of offspring is also granted by that very fact, if any offspring from those to whom dispensation is granted has already been born or conceived, excepted however adulterine and sacrilegious offspring.
146 Can. 42
147 A dispensation from the impediment of consanguinity or affinity, once granted, in some degree of impediment, is valid, even if an error concerning the degree has crept into the petition or in the granting, provided that the degree truly existing be lower, or even if another impediment of the same kind in an equal or lower degree has been passed over in silence.
148 Can. 43
149 A dispensation granted by the Apostolic See from a ratified and non-consummated marriage, or made even by those who have authority below the Apostolic See, permitting passage to other nuptials on account of the presumed death of the spouse, always carries with it a dispensation from the impediment of which in can. 65, n. 1, if any be needed.
150 Can. 44
151 A dispensation from a lesser impediment granted is not invalid by reason of no vice either of obreption or subreption, even if the sole final cause set forth in the petition has been false.
152 Can. 45
153 Dispensations from public impediments entrusted by the Hierarch to petitioners shall be executed by the Hierarch who gave the testimonial letters or transmitted the petitions to the Apostolic See, or to the Patriarch, even if the spouses, at the time when the dispensation is to be executed, having left the domicile or quasi-domicile of his eparchy and departed to another eparchy never to return, provided that the Hierarch of the place in which they wish to contract matrimony be notified.
154 Can. 46
155 Except for some small payment in return for the expenses of the chancery in dispensations for the non-poor, the Hierarchs of places and their officials, any contrary custom being reprobated, cannot, on the occasion of a granted dispensation, exact any emolument whatsoever, unless they have obtained express permission of the Apostolic See to do so or it has been constituted or recognized in approved Synods; and if they have exacted it illegitimately, they are bound by the obligation of restitution.
156 Can. 47
157 Those who grant a dispensation from delegated power shall make express mention in it of the indult of the Superior delegating.
158 CHAPTER III Concerning Prohibiting Impediments
159 Can. 48
160 § 1. Matrimony is prohibited by:
161 1° A public vow of perfect chastity emitted in simple or minor profession;
162 2° A private vow of virginity, perfect chastity, not to marry, to embrace the religious state, and, in rites in which clerics from the reception of the subdiaconate order are bound by the obligation of observing sacred celibacy, to receive the subdiaconate or a major order.
163 § 2. No vow, except a solemn one or one emitted in major profession, dissolves matrimony, unless this has been prescribed by special ordinance of the Apostolic See for some.
164 Can. 49
165 In those regions where civil law prohibits nuptials by guardianship, or legal relationship arising from adoption, by canon law matrimony is illicit.
166 Can. 50
167 The Church everywhere most severely prohibits that matrimony be contracted between two baptized persons, of whom one is Catholic and the other is ascribed to a heretical or schismatic sect; and if there be present a danger of perversion of the Catholic spouse or of the offspring, the marriage is forbidden even by divine law itself.
168 Can. 51
169 § 1. The Church does not dispense from the impediment of mixed religion unless:
170 1° Just and grave causes urge it;
171 2° The non-Catholic spouse has given a guarantee of removing the danger of perversion from the Catholic spouse, and both spouses have given a guarantee concerning the entire offspring to be baptized and educated in the Catholic faith only;
172 3° Moral certainty be had of the fulfillment of the guarantees.
173 § 2. The guarantees are regularly to be required in writing.
174 Can. 52
175 The Catholic spouse is bound by the obligation of prudently endeavoring for the conversion of the non-Catholic spouse.
176 Can. 53
177 § 1. Even if a dispensation from the impediment of mixed religion has been obtained from the Church, the spouses cannot, either before or after matrimony contracted before the Church, also approach, either in person or through a proxy, a non-Catholic minister as one devoted to sacred things, for the purpose of giving or renewing matrimonial consent.
178 § 2. If the pastor certainly knows that the spouses are about to violate this law or have already violated it, he shall not assist at their matrimony, except from the most grave causes, with scandal removed and the Hierarch first consulted.
179 § 3. It is not disapproved, however, that, civil law commanding it, the spouses present themselves also before a non-Catholic minister, performing only the office of a civil official, and that only for the purpose of fulfilling a civil act, for the sake of civil effects.
180 Can. 54
181 The Hierarchs and other pastors of souls
182 1° Shall deter the faithful from mixed marriages as much as they can;
183 2° If they are unable to prevent them, they shall take every care that they not be contracted contrary to the laws of God and the Church;
184 3° When mixed marriages have been celebrated either in their own or in another territory, they shall carefully watch that the spouses faithfully fulfill the promises they have made.
185 Can. 55
186 § 1. The faithful are also to be deterred from contracting matrimony with those who notoriously have rejected the Catholic faith, even if they have not passed over to a non-Catholic sect, or who are ascribed to societies condemned by the Church.
187 § 2. The aforesaid parish priest shall not assist at such marriages unless he has consulted the Ordinary, who, having examined all the circumstances of the matter, may permit him to be present at the matrimony, provided that a grave cause urges it and the Ordinary judges according to his prudent discretion that sufficient care has been taken for the Catholic education of all the offspring and for the removal of the danger of perversion of the other spouse.
188 Can. 56
189 If a public sinner or one notoriously bound by censure shall first refuse to approach sacramental confession or to be reconciled with the Church, the parish priest shall not assist at his marriage unless a grave cause urges it, concerning which, if it can be done, he shall consult the Ordinary.
190 CHAPTER IV On Diriment Impediments
191 Can. 57
192 § 1. A man before the completion of his sixteenth year of age, a woman before the completion of her twelfth year of age, cannot validly enter into matrimony.
193 § 2. Although matrimony contracted after the aforesaid age is valid, nevertheless the pastors of souls shall take care to deter young people from it before the age at which, according to the received customs of the region, matrimony is usually contracted.
194 Can. 58
195 § 1. Impotence antecedent and perpetual, whether on the part of the man or on the part of the woman, whether known to the other party or not, whether absolute or relative, dirimes matrimony by the very law of nature.
196 § 2. If the impediment of impotence be doubtful, whether by doubt of law or doubt of fact, matrimony is not to be impeded.
197 § 3. Sterility neither dirimes nor prohibits matrimony.
198 Can. 59
199 § 1. He who is bound by the bond of a prior matrimony, even though not consummated, attempts matrimony invalidly, saving the privilege of the faith.
200 § 2. Although the prior matrimony be null or dissolved for any reason whatsoever, it is not therefore lawful to contract another, before it has been legitimately and certainly established that the prior marriage is null or dissolved.
201 Can. 60
202 § 1. Matrimony contracted by an unbaptized person with a baptized person is null.
203 § 2. If at the time of the contraction of matrimony a party was commonly held to be baptized or his baptism was doubtful, it is to be held, according to the norm of can. 3, in favor of the validity of the matrimony; until it is certainly proved that one party was baptized and the other was not baptized.
204 Can. 61
205 Those things which are prescribed concerning mixed marriages in canons 50-54 ought also to be applied to matrimonies which are hindered by the impediment of disparity of worship.
206 Can. 62
207 § 1. Clerics advanced to major orders attempt matrimony invalidly.
208 § 2. To the subdiaconate, as well as to the major orders, the power of diriming matrimony is attributed.
209 Can. 63
210 Those bound by solemn profession or major vows attempt matrimony invalidly, and likewise those who have emitted a vow of chastity outside of major profession, to which, however, by special prescription of the Apostolic See, power has been added to dirimes nuptials.
211 Can. 64
212 § 1. Between a man who has abducted a woman and the woman abducted with a view to matrimony, so long as she remains in the power of the abductor, no matrimony can subsist.
213 § 2. But if the abducted woman, separated from the abductor and placed in a safe and free place, shall have consented to marry him, the impediment ceases.
214 § 3. As regards the nullity of matrimony, violent retention of a woman is held equivalent to abduction, namely when a man violently detains a woman in the place where she dwells or to which she has freely come, with a view to matrimony.
215 Can. 65
216 They cannot validly contract matrimony:
217 1° Those who, while the same valid matrimony endured, committed adultery with each other and gave each other mutual promise of marriage or attempted the same matrimony, even by civil act only;
218 2° Those who, while likewise the same valid matrimony endured, committed adultery with each other and one of them killed the spouse;
219 3° Those who by mutual physical or moral cooperation, even without adultery, brought about the death of the spouse.
220 Can. 66
221 § 1. In the direct line of consanguinity matrimony is null between all ascendants and descendants, both legitimate and natural.
222 § 2. In the collateral line it is null up to and including the sixth degree, provided, however, that the impediment of matrimony is multiplied as many times as the common stock is multiplied.
223 § 3. Matrimony shall never be permitted if any doubt subsists whether the parties are related by consanguinity in any degree of the direct line or in the second degree of the collateral line.
224 § 1. 1° Consanguinity is computed by lines and degrees;
225 2° In the direct line, there are as many degrees as there are persons, the common stock being excepted;
226 3° In the collateral line, there are as many degrees as there are persons in both branches, the common stock being excepted.
227 Can. 67
228 § 1. 1° Affinity of which mention is made in can. 68, § 1, dirimes matrimony in the direct line in any degree; in the collateral line up to and including the fourth degree;
229 2° Affinity of which mention is made in can. 68, § 2, dirimes matrimony up to and including the fourth degree;
230 3° Affinity of which mention is made in can. 68, § 3, dirimes matrimony in the first degree.
231 § 2. The impediment of affinity of which mention is made in can. 68, § 1, n. 1, is multiplied:
232 1° As many times as the impediment of consanguinity from which it proceeds is multiplied;
233 2° By a second or further marriage contracted with a consanguine of the deceased spouse.
234 Can. 68
235 § 1. 1° Affinity arises from a valid marriage even if not consummated;
236 2° It exists between each spouse and the consanguines of the other;
237 3° By whatever line and degree one spouse is related by blood to the other, the other is related by affinity.
238 § 2. 1° By particular law, affinity arising from digeneia, of which in § 1, n. 1, arises also between the blood relatives of the husband and the blood relatives of the wife;
239 2° It is computed thus: there are as many degrees as the sum of the degrees of consanguinity by which each of the affines is distant from the spouses from whose marriage the affinity arises.
240 § 3. 1° By particular law, affinity moreover arises from trigeneia, that is, from two valid marriages, even if not consummated, if two persons contract marriage: a) with one and the same third person, the marriage being dissolved, one after the other, or b) with two persons related by blood to each other;
241 2° Those contracting affinity from trigeneia are either spouse with those who are, from another marriage, the affines of the other spouse from digeneia;
242 3° This affinity, between either spouse and the affines of the other, is computed thus: those who from another marriage are affines of the husband from digeneia are in the same degree as affines of the wife from trigeneia, and conversely;
243 4° Whenever this affinity exists also between the blood relatives of one and the affines of the other spouse, it is computed thus: there are as many degrees as the sum of the degrees both of consanguinity and of affinity from digeneia by which each of the affines is distant from the spouses from whose marriage the affinity arises.
244 Can. 69
245 The impediment of public propriety arises from an invalid marriage, whether consummated or not, and from notorious or public concubinage; and it invalidates marriages in the first and second degree of the direct line between the man and the blood relatives of the woman, and conversely.
246 Can. 70
247 § 1. That spiritual relationship invalidates marriage of which in § 2.
248 § 2. 1° From baptism the godparent contracts spiritual relationship with the baptized person and his parents;
249 2° If baptism is repeated under condition, the godparent does not contract spiritual relationship, unless the same person is employed again.
250 Can. 71
251 Those who are held by civil law to be incapable of contracting marriage with each other on account of guardianship or on account of legal relationship arising from adoption, cannot by virtue of canon law validly contract marriage with each other.
252 CHAPTER V On Matrimonial Consent
253 Can. 72
254 § 1. Marriage is brought about by the consent of the parties between persons capable in law, legitimately manifested; which consent can be supplied by no human power.
255 § 2. Matrimonial consent is an act of the will by which each party gives and accepts a right over the body, perpetual and exclusive, which pertains to acts per se apt for the generation of offspring.
256 Can. 73
257 § 1. In order that matrimonial consent can exist, it is necessary that the contracting parties at least do not ignore that marriage is a permanent society between a man and a woman for the procreation of children.
258 § 2. This ignorance after puberty is not presumed.
259 Can. 74
260 § 1. Error concerning the person renders marriage invalid.
261 § 2. Error concerning a quality of the person, even if it gives cause for the contract, invalidates marriage only:
262 1° If error concerning quality results in error concerning the person;
263 2° If a free person contracts marriage with a person whom he believes to be free, when in fact she is a slave, in slavery properly so called.
264 Can. 75
265 Simple error concerning the unity or indissolubility of marriage or its sacramental dignity, even if it gives cause for the contract, does not vitiate matrimonial consent.
266 Can. 76
267 Knowledge or opinion of the nullity of marriage does not necessarily exclude matrimonial consent.
268 Can. 77
269 § 1. Internal consent of the mind is always presumed to be in conformity with the words or signs employed in celebrating marriage.
270 § 2. But if either or both parties by a positive act of the will exclude marriage itself, or all right to the conjugal act, or some essential property of marriage, they contract invalidly.
271 Can. 78
272 § 1. Marriage is also invalid if entered into from force or grave fear unjustly inflicted from without to extort consent.
273 § 2. No other fear, even if it gives cause for the contract, brings with it the nullity of marriage.
274 Can. 79
275 § 1. To contract marriage validly it is necessary that the contracting parties be present either in person or through a proxy.
276 § 2. The spouses shall express matrimonial consent in words; nor may they employ equivalent signs, if they are able to speak.
277 Can. 80
278 § 1. Marriage cannot be contracted through a proxy unless the local Hierarch has granted this faculty in writing in a particular case.
279 § 2. The local Hierarch can grant this faculty only in case of necessity, that is, if the contracting parties, for a grave reason, cannot present themselves together to the priest.
280 Can. 81
281 § 1. With the eparchial statutes on this matter being observed, in order that marriage contracted through a proxy be valid, there is required a special mandate to contract with a certain person, signed by the mandator and either by the pastor or local Hierarch in the place where the mandate is made, or by a priest delegated by either party, or by at least two witnesses.
282 § 2. If the mandator cannot write, this shall be noted in the mandate itself and another witness shall be added who shall also sign the document; otherwise the mandate is void.
283 § 3. If, before the proxy contracted in the name of the principal, the latter revoked the mandate or fell into insanity, the marriage is invalid, even if either the proxy or the other contracting party was ignorant of this.
284 § 4. For a marriage to be valid, the proxy must be designated by the principal himself, and the proxy must personally perform his office.
285 Can. 82
286 § 1. For a marriage to be validly celebrated through a proxy, the norms of cann. 85 and 86 must be observed.
287 § 2. The spouses, when they are present, must not neglect to receive the blessing of which can. 91 speaks from a priest designated according to the norm of these canons.
288 Can. 83
289 Marriage cannot be contracted under a condition.
290 Can. 84
291 Even if a marriage was invalidly entered into by reason of an impediment, the consent given is presumed to persevere, until it is established that it has been revoked.
292 CHAPTER VI On the form of celebrating marriage
293 Can. 85
294 § 1. Only those marriages are valid which are contracted in sacred rite, before the pastor, or the local Hierarch, or a priest to whom the faculty of assisting at marriage has been given by either party, and at least two witnesses, according however to the prescriptions of the canons which follow, and saving the exceptions of which in cann. 89, 90.
295 § 2. A sacred rite is considered, for the purpose of which in § 1, by the very intervention of the assisting and blessing priest.
296 Can. 86
297 § 1. The pastor and the local Hierarch validly assist at marriage:
298 1° From the day only on which the legitimate administration of the benefice has been begun, or the office has been undertaken, unless they have been excommunicated or interdicted or suspended from office by sentence or declared to be such;
299 2° Within the limits only of their territory, whether the contracting parties are their subjects or not, provided they are of their rite;
300 3° Provided that they require and receive the consent of the contracting parties neither by force nor by grave fear.
301 § 2. At the marriage of the faithful of diverse rite, the Hierarch of the place and the pastor validly assist, who according to the norm of § 3, nn. 24 is their proper Hierarch or pastor.
302 § 3. 1° Unless otherwise provided, whether by domicile or by quasi-domicile, each person obtains the pastor and Hierarch of his own rite;
303 2° If a pastor is lacking for the faithful of some rite, their Hierarch shall designate another rite pastor, who shall undertake the care of the same, after the same Hierarch has obtained the consent of the Hierarch of the pastor to be designated;
304 3° Outside the territory of his own rite, if the Hierarch of this rite is lacking, the Hierarch of the place is to be held as proper. If there are several, he is to be held as proper whom the Apostolic See has designated, or, with its consent, the Patriarch, if by particular law the care of the faithful of his rite dwelling outside the patriarchate has been entrusted to him.
305 4° The proper pastor or Hierarch of a vagrant is the pastor or Hierarch of his rite of the place where the vagrant actually dwells; if a pastor or Hierarch of his rite is lacking, the norms established in nn. 2, 3 are to be observed;
306 5° Also for those who have only an eparchial domicile or quasi-domicile, the proper pastor is the pastor of the place in which they actually dwell.
307 Can. 87
308 § 1. 1° The pastor and the local Hierarch, who can validly assist at marriage, can also give to another priest the faculty to assist at a determined marriage within the limits of their territory, provided they do so expressly, and the priest is determined; they can also grant to the same priest the faculty of subdelegating another determined priest, who shall assist at that marriage;
309 2° A general faculty of assisting at marriages can be granted to a cooperator vicar by the pastor or by the local Hierarch; having obtained this, he himself enjoys the faculty of subdelegating, as in n. 1;
310 3° A faculty granted contrary to the prescription of nn. 1, 2 is null.
311 § 2. The faculty of which in § 1, n. 1, is not to be granted unless all things which the law constitutes for proving freedom of status have been completed.
312 § 3. The Hierarchs of places administering the faithful of diverse rite according to the norm of law can give to rectors of churches or other priests of any Eastern rite, having the care of the faithful, lacking a pastor of their own rite, a general faculty of assisting at marriages of the faithful of Eastern rite, even if of a rite diverse from that of the rector or presbyter.
313 Can. 88
314 § 1. The pastor or the local Hierarch, however, assist at marriage licitly:
315 1° After it has been legitimately established to them that the contracting parties are free according to the norm of law;
316 2° After it has moreover been established to them that one of the contracting parties has domicile or quasi-domicile or a month's residence or, if it is a matter of a vagrant, actual residence in the place of marriage;
317 3° If the conditions of which in n. 2 are lacking, having obtained the permission of the pastor or Hierarch of the domicile or quasi-domicile or month's residence of one of the contracting parties, unless it is a matter of vagrants actually traveling, who have no fixed place of residence anywhere, or grave necessity intervenes which excuses from seeking permission.
318 § 2. The pastor, if particular law so provides, in order to assist at marriage licitly, further needs the permission of the Hierarch of the place.
319 § 3. Marriage shall be celebrated before the bridegroom's pastor, unless legitimate custom provides otherwise or a just cause excuses it; marriages of Catholics of mixed rite, however, shall be celebrated in the rite of the husband and before his pastor, unless the husband, having domicile or quasi-domicile in an Eastern region, consents that the marriage be celebrated in the rite of the bride and before her pastor.
320 § 4. A pastor who assists at a marriage without the license required by law does not make the stole fees his own, and is bound to remit them to the proper pastor of the contracting parties.
321 Can. 89
322 If a pastor or Hierarch or priest to whom the faculty of assisting at marriage has been granted according to the norms of canons 86, 87 cannot be obtained or approached without grave inconvenience:
323 1° In danger of death, a valid and licit marriage may be contracted before witnesses alone; and even outside danger of death, provided it can be prudently foreseen that this state of affairs will last for a month;
324 2° In either case, if any other Catholic priest is available who can be present, he must be called and, together with the witnesses, must assist at the marriage, the validity of the marriage before witnesses alone being preserved.
325 Can. 90
326 § 1. Those bound to observe the form prescribed above are:
327 1° All baptized in the Catholic Church and those converted to it from heresy or schism, whether these or those have subsequently defected from it, whenever they contract marriage among themselves;
328 2° The same persons mentioned in n. 1, if they contract marriage with non-Catholics, whether baptized or not baptized, even after obtaining a dispensation from the impediment of mixed religion or disparity of worship.
329 2. However, with the prescription of § 1, n. 1 remaining in force, non-Catholic baptized persons, if they contract marriage among themselves or with non-baptized non-Catholics, are nowhere bound to observe the Catholic form of marriage.
330 Can. 91
331 Outside a case of necessity, in the celebration of marriage the rites and ceremonies prescribed in the liturgical books approved by the Church or received by legitimate custom shall be observed.
332 Can. 92
333 § 1. After the marriage has been celebrated, the pastor or his substitute shall as soon as possible record in the marriage register the names of the spouses and witnesses, the place and day of the celebrated marriage, the dispensation, if a dispensation took place, and its author together with the impediment and its degree, and other matters according to the manner prescribed in the liturgical books and by his own Hierarch; and this even if another priest assisted at the marriage with a faculty obtained either by himself or by the Hierarch.
334 § 2. Furthermore, the pastor shall also note in the baptismal register that the spouse contracted marriage in his parish on such a day. If, however, the spouse was baptized elsewhere, the pastor shall transmit notice of the marriage contracted to the pastor with whom the baptism of the spouse is to be noted according to the norms of the canons, either by himself or through the episcopal curia, so that the marriage may be entered in the baptismal register.
335 § 3. Whenever a marriage is contracted according to the norm of can. 89, the priest, if he assisted at it, or otherwise the witnesses and the contracting parties must see to it that the marriage contracted is noted in the prescribed registers as soon as possible.
336 CHAPTER VII On Marriage of Conscience
337 Can. 93
338 Only from the gravest and most urgent cause, by the Hierarch of the place himself, excluding the Vicar General without special mandate, may permission be granted that a marriage of conscience be entered into, that is, that marriage be celebrated with the announcements omitted and in secret, according to the norms of the canons which follow.
339 Can. 94
340 The license for the celebration of a marriage of conscience carries with it a promise and grave obligation of maintaining secrecy on the part of the assisting priest, the witnesses, the Hierarch and his successors, and also of the other spouse, if the one spouse does not consent to disclosure.
341 Can. 95
342 The obligation of this promise, on the part of the Hierarch, does not extend to the following cases:
343 1° If scandal or grave injury to the sanctity of marriage would result from the observance of secrecy:
344 2° If the parents do not take care that offspring from such a marriage be baptized; or if they take care that it be baptized under false expressed names, and meanwhile do not denounce to the Hierarch within thirty days the offspring conceived and baptized, with the true names of the parents added;
345 3° If the parents neglect the Christian education of the offspring.
346 Can. 96
347 A marriage of conscience shall not be noted in the customary marriage and baptismal register, but in a special register to be kept in the secret archive of the curia.
348 CHAPTER VIII On the Time and Place of Celebration of Marriage
349 Can. 97
350 § 1. Marriage may be contracted at any time of the year, with the prescription of § 2 remaining in force.
351 § 2. During the sacred time before the Nativity of the Lord and the Great Lent, as well as at other times established by particular law, the celebration of the nuptials itself or only the solemnity thereof is forbidden, according to the norm of particular law.
352 § 3. The Hierarchs of places, however, may, for a just cause, permit during the forbidden time either the celebration of the nuptials themselves or the solemn blessing thereof, having admonished the spouses to abstain from the display of pomp.
353 Can. 98
354 § 1. Marriage shall be celebrated in the parish church; it cannot, however, be celebrated in another church or oratory, whether public or semi-public, except with the permission of the Hierarch of the place or the pastor.
355 § 2. The local Ordinaries may permit the celebration of matrimony in private houses only for a just and reasonable cause, but not in churches or oratories, whether of a seminary or of religious women, unless urgent necessity presses, and appropriate precautions are taken.
356 CHAPTER IX On the effects of matrimony
357 Can. 99
358 From a valid matrimony there arises between the spouses a bond which by its nature is perpetual and exclusive; moreover, Christian matrimony confers grace upon the spouses who place no obstacle in its way.
359 Can. 100
360 Both spouses have an equal right and duty from the very beginning of matrimony with regard to the acts proper to conjugal life.
361 Can. 101
362 Unless special law provides otherwise, the wife, as regards the canonical effects, becomes a participant in the status of her husband.
363 Can. 102
364 Parents are bound by the most serious obligation to care for the education of their children, both religious and moral, and also physical and civil, to the best of their ability, and to provide for their temporal welfare.
365 Can. 103
366 Legitimate are children conceived or born of a valid or putative matrimony.
367 Can. 104
368 § 1. He is the father whom lawful marriage indicates, unless the contrary is proved by evident arguments.
369 § 2. Children born at least one hundred eighty days after the day of the celebration of matrimony, or within three hundred days from the day of the dissolution of conjugal life, are presumed to be legitimate.
370 Can. 105
371 By the subsequent matrimony of the parents, whether true or putative, whether newly contracted or convalidated, even if not consummated, offspring becomes legitimate, provided that the parents were capable of contracting matrimony with each other at the time of conception, or of pregnancy, or of birth.
372 Can. 106
373 Children legitimated by subsequent matrimony are, as regards canonical effects, in all respects equated with the legitimate, unless otherwise expressly provided.
374 CHAPTER X On the separation of spouses
375 ARTICLE I On the dissolution of the bond
376 Can. 107
377 A valid matrimony, ratified and consummated, can be dissolved by no human power and for no cause whatsoever, except by death.
378 Can. 108
379 A non-consummated matrimony between the baptized or between a baptized party and an unbaptized party is dissolved both by operation of law through solemn religious profession, and by dispensation from the Roman Pontiff granted for a just cause, at the request of both parties or of one of them, even if the other is unwilling.
380 Can. 109
381 § 1. A legitimate matrimony between the unbaptized, even if consummated, is dissolved in favor of the faith by the Pauline privilege.
382 § 2. This privilege does not obtain in a matrimony between a baptized party and an unbaptized party entered into with a dispensation from the impediment of disparity of worship.
383 Can. 110
384 § 1. Before a converted and baptized spouse may validly contract a new matrimony, he must, saving the prescription of can. 114, interrogate the unbaptized party:
385 1° Whether he or she is willing to convert and receive baptism;
386 2° Whether at least he or she is willing to live peacefully with him without contempt of the Creator.
387 § 2. These interrogations must always be made, unless the Apostolic See has declared otherwise.
388 Can. 111
389 § 1. The interrogations shall be made regularly, at least in summary and extrajudicial form, by the authority of the Ordinary of the converted spouse, by whom a delay for deliberation shall also be granted to the unbelieving spouse, if he or she has requested it, with the warning, however, that if the delay passes uselessly, the response shall be presumed to be negative.
390 § 2. The interrogations, even if made privately by the converted party themselves, are valid, and are indeed also licit, if the form prescribed above cannot be observed; in this case, however, they must be established for the external forum by at least two witnesses or by another legitimate mode of proof.
391 Can. 112
392 If the interrogations have been omitted by declaration of the Apostolic See, or if the unbeliever has answered them by explicit or implicit denial, the baptized party has the right to contract new nuptials with a Catholic person, unless he or she has given the unbaptized party a just cause for leaving after baptism.
393 Can. 113
394 A faithful spouse, even though after receiving baptism he or she has again lived conjugally with the unbelieving party, does not lose the right to celebrate new nuptials with a Catholic person, and therefore can exercise this right if the unbelieving spouse, having changed his or her mind, afterwards departs without just cause, or no longer lives peacefully without contempt of the Creator.
395 Can. 114
396 Those matters concerning matrimony in the Constitutions of Paul III Altitudo, 1 June 1537; of St. Pius V Romani Pontificis, 2 August 1571; of Gregory XIII Populis, 25 January 1585, which were written for particular regions, are extended also to other regions in the same circumstances.
397 Can. 115
398 The bond of a prior matrimony contracted in unbelief is dissolved only when the faithful party has actually validly entered into a new matrimony.
399 Can. 116
400 In a doubtful matter the privilege of the faith enjoys the favor of the law.
401 ARTICLE II On the separation of bed, board, and dwelling
402 Can. 117
403 Spouses must maintain the communion of conjugal life, unless a just cause excuses them.
404 Can. 118
405 § 1. On account of the adultery of one spouse, the other spouse, the bond remaining, has the right of dissolving, even perpetually, the common life, unless he consented to the crime, or gave cause for it, or expressly or tacitly forgave it, or himself also committed the same crime.
406 § 2. Tacit forgiveness is held to exist if the innocent spouse, after being made certain of the crime of adultery, has of his own accord lived with the other spouse with marital affection; but marital affection is presumed, unless within six months he has expelled or abandoned the adulterous spouse, or made a legitimate accusation.
407 Can. 119
408 The innocent spouse, whether by the sentence of a judge or by his own legitimate authority, is never bound by any obligation to receive the adulterous spouse again into the consortium of life; he may, however, admit or recall the same, unless by his own consent he has assumed a state contrary to matrimony.
409 Can. 120
410 § 1. 1° If the other spouse has given his name to a non-Catholic sect; if he has educated the offspring in a non-Catholic manner; if he leads a criminal and ignominious life; if he causes grave danger either to the soul or to the body of the other; if by cruelties he makes the common life excessively difficult, these and other things of this kind are to the other spouse so many legitimate causes for separation, by the authority of the local Ordinary, and also by his own authority, if these are certain and there is danger in delay.
411 2° In all these cases, the cause of separation ceasing, the common life is to be restored; but if the separation has been pronounced by the Ordinary for a certain or uncertain time, the innocent spouse is not bound to it, unless by decree of the Ordinary or after the time has elapsed.
412 § 2. Also a spouse maliciously abandoned by the other can obtain a decree of separation from the local Ordinary for a certain or uncertain time according to the norm of § 1, n. 2.
413 Can. 121
414 When separation has been instituted, the children are to be educated with the innocent spouse, and if one of the spouses is non-Catholic, with the Catholic spouse, unless in either case the Ordinary has decreed otherwise for the good of the children themselves, always preserving their Catholic education.
415 CHAPTER XI On the Convalidation of Matrimony
416 ARTICLE I On Simple Convalidation
417 Can. 122
418 § 1. To convalidate a marriage null on account of a diriment impediment, it is required that the impediment cease or be dispensed and that consent be renewed at least by the party aware of the impediment.
419 § 2. This renewal is required by ecclesiastical law for validity even if at the beginning both parties gave consent and did not subsequently revoke it.
420 Can. 123
421 The renewal of consent must be a new act of the will regarding the marriage which is known from the beginning to have been null.
422 Can. 124
423 § 1. If the impediment is public, consent must be renewed by both parties in the form prescribed by law.
424 § 2. If it is occult and known to both parties, it suffices that consent be renewed by both parties privately and secretly.
425 § 3. If it is occult and unknown to one party, it suffices that only the party aware of the impediment renew consent privately and secretly, provided the other perseveres in the consent given.
426 Can. 125
427 § 1. A marriage null on account of defect of consent is convalidated if the party who did not consent now consents, provided the consent given by the other party perseveres.
428 § 2. If the defect of consent was merely internal, it suffices that the party who did not consent internally consent.
429 § 3. If it was also external, it is necessary that consent also be manifested externally, either in the form prescribed by law, if the defect was public, or in another manner privately and secretly, if it was occult.
430 Can. 126
431 A marriage null on account of defect of form, in order that it become valid, must be contracted anew in legitimate form.
432 ARTICLE II On Sanation in Root
433 Can. 127
434 § 1. Sanation of a marriage in root is the convalidation of the same, carrying with it, besides dispensation or cessation of the impediment, dispensation from the law concerning the renewal of consent, and retroaction, by a fiction of law, regarding canonical effects, to the past.
435 § 2. Convalidation takes place from the moment of the granting of the grace; retroaction, however, is understood to be made to the beginning of the marriage, unless otherwise expressly provided.
436 § 3. Dispensation from the law concerning the renewal of consent can be granted even without the knowledge of the parties.
437 Can. 128
438 § 1. Any marriage entered into with the consent of both parties, sufficient by its nature, but, as far as law is concerned, inefficacious on account of a diriment impediment of ecclesiastical law or on account of defect of legitimate form, can be healed in root, provided consent perseveres.
439 § 2. A marriage contracted with an impediment of natural divine law, however, even if the impediment subsequently ceases, the Church does not heal in root, not even from the moment of the cessation of the impediment.
440 Can. 129
441 § 1. If consent is lacking in both or in one of the parties, a marriage cannot be healed in root, whether consent was lacking from the beginning or, given from the beginning, was subsequently revoked.
442 § 2. But if consent was indeed lacking from the beginning, but was subsequently given, sanation can be granted from the moment consent was given.
443 Can. 130
444 § 1. Sanation in root can be granted solely by the Apostolic See, with the provision of § 2 remaining in force.
445 § 2. The Patriarch has the facility of granting a sanation in root if the validity of the marriage is obstructed only by a defect in the form of celebration or by an impediment from which he himself can dispense.
446 CHAPTER XII On Second Marriages
447 Can. 131
448 Although chaste widowhood is more honorable, second and subsequent marriages are nevertheless valid and licit, with the prescription of can. 59, § 2 remaining in force.
449 We, moreover, by these Apostolic Letters given motu proprio, promulgate the aforesaid canons and give them the force of law for the faithful of the Oriental Church, wherever they may be and even though they are subject to a Prelate of a different rite. As soon as by these Apostolic Letters such canons shall have begun to be in force, any statute whatsoever, whether general or particular or special, even one enacted by Synods approved in special form, shall lose its force; any prescription and custom still in effect, whether general or particular, shall be abrogated, so that the discipline of the sacrament of matrimony shall be governed solely by these canons, and particular law contrary to them shall no longer have force except when and insofar as it is admitted in them.
450 But in order that knowledge of this Our will may reach in good time all those to whom it pertains, We will and decree that these Apostolic Letters given motu proprio shall begin to take effect from the second day of the month of May in the year 1949, the feast of St. Athanasius, Bishop and Doctor, notwithstanding anything to the contrary, even those matters worthy of most particular mention.
451 Given at Rome at St. Peter's, on the twenty-second day of the month of February, on the feast of the Chair of St. Peter in Antioch, in the year 1949, in the tenth year of Our Pontificate.
