III. LA CHIESA DI SANTA MARIA DEGLI ANGELI DELLA PORZIUNCOLA È DICHIARATA BASILICA PATRIARCHALE E CAPPELLA PAPALE, CON PRIVILEGI E DIRITTI RICONOSCIUTI E AMPLIATI.
PIO PP. X

III. ECCLESIA S. MARIAE ANGELORUM DE PORTIÜNCULA DECLARATUR BASILICA PA- TRIARCHALIS ET CAPELLA PAPALIS, PRIVILEGIIS AC IURIBUS RECOGNITIS ET AMPLIAT1S.
PIUS PP. X
Memoriae traditum est, quarto reparatae salutis saeculo, dum Petri Cathedram obtineret sa. me. decessor Noster Liberius Pontifex, quatuor pios fideles, peregre Ierusalem advenientes, consedisse in valle, Assisii moenibus supposita, ibique sacellum aedificasse, quod ob fragmentum sepulcri Deiparae, una cum insignibus reliquiis a Cyrillo Patriarcha acceptis, eodem in sacello depositum, sanctae Mariae a Iosaphat dicarunt. Sanctuarium ipsum invisere Pius II, Syxtus IV, Iulius II, Clemens VII, Paulus III ac Pius VII, quorum postremus Romam repetens, die x v maii mensis anno MDCCcv, in templo Angelorum eucharisticum Sacrum litavit. S. R. E. Cardinali Lambruschini vivae vocis oraculo prolatam accepimus. Praeterea eodem in templo Angelorum pio fidelium sodalitio canonice instituto Pius PP. IX rec. me. decessor Noster, archisodalitatis titulum singularesque indulgentias impertitus est. THE CHURCH OF ST. MARY OF THE ANGELS OF PORTIÜNCULA IS DECLARED A PATRIARCHAL BASILICA AND PAPAL CHAPEL, WITH PRIVILEGES AND RIGHTS RECOGNIZED AND ENLARGED.
PIUS PP. X
1 To Perpetual Memory of the Matter. — The Almighty and Merciful Lord, Who pours forth heavenly graces upon the whole earth, as if they were salutary rains, by the most wise counsel of His providence illuminates certain holier places in the world with His present divinity, so that from thence the Christian people, as from a perennial fountain, may draw divine charisms in more abundant measure. Who would doubt that among the most celebrated of these sanctuaries is to be reckoned that of Holy Mary of the Angels, or called of the Portiuncula, renowned for the origin of the illustrious Franciscan Order, and the ornament and glory not only of Italy, but also of the whole Catholic world? It has been handed down to memory that in the fourth century of restored salvation, when our predecessor, the Pontiff Liberius, held the Chair of Peter, four pious faithful, coming from abroad to Jerusalem, settled in a valley beneath the walls of Assisi, and there built a chapel, which, on account of a fragment of the sepulchre of the Mother of God, together with distinguished relics received from Cyril the Patriarch, deposited in the same chapel, they dedicated to Holy Mary of Josaphat. From this fragment of that blessed sepulchre, where the body of the Virgin lay, soon assumed among the choirs of Angels, the name of Mary of the Angels was given to the little building. This holy Benedict, father of the monks of the West, restored in the year 511 after Christ was born, and to it he assigned as a gift a small portion of adjoining land, whence it was called the Portiuncula. Monks and hermits of most holy life cultivated it through the centuries with the greatest devotion, and even when, through the injury of time, it remained almost destroyed, the citizens of Assisi piously celebrated the falling chapel of Mary of the Angels, and the mother of the divine Francis herself, Pica by name, is said to have obtained there the grace of motherhood. This chapel was therefore pleasing and acceptable to Francis from his earliest youth, who, cherishing it with filial reverence, took care to restore and adorn it first, and afterwards, entering the way of evangelical perfection, called by God, laid the foundations of the Minorite Order there. For when he had gathered to himself the first companions, he here devised in his mind that wonderful rule of poverty, obedience, and sacred apostolate, which shortly afterwards at Rome our predecessor, the Pontiff Innocent III, admonished by a heavenly vision, so that he might repair the tottering Lateran buildings by the aid and work of Francis, approved, offered by the Saint himself and standing by, on the sixteenth day of the month of April in the year 1209, by apostolic authority. In this place also, where he had happily begun the Order of Friars Minor, Francis imposed the rough tunic of seraphic religion upon Clare, a noble maiden of Assisi, and by that pious ceremony instituted the sacred Franciscan family of nuns. Here were held the first chapter meetings, here is that most celebrated heavenly vision of the divine Saviour and the Virgin Mary presented to the law-giving Father, whence the indulgence of the Portiuncula flowed. And indeed, the Saint, whom while living he had loved before all others and had illustrated with so many miracles, this seat, even in death he commended to his brothers: "Behold, my sons, never leave this place, for this place is truly holy, and the dwelling of Christ and of His Virgin Mother." Here beside the altar of Mary of the Angels and the sanctuary of the Portiuncula Francis commanded his heart to be kept after his death, as if to signify that this was the place which he had loved above all others on earth: here he desired to complete the course of his mortal life: hither he ordered his companions to bring him as he was dying: here finally, desiring to be dissolved and to be with Christ, in that most sweet refuge he passed away peacefully on his last day. But after the holy founder departed from the living, and his body was laid to rest at Assisi in the most renowned basilica, nevertheless the Christian people did not cease through the centuries to celebrate the building of Holy Mary of the Angels or of the Portiuncula. Innumerable persons every year from every condition of life, citizens, strangers, princes, rulers, kings and emperors gathered there as pilgrims to duly obtain the indulgence, and even at present, on the day designated for gaining the indulgences, the great temple can scarcely contain the throngs of pilgrims flowing together. Nor did the honour to the same sanctuary increase little from the fact that several of our Roman Pontiff predecessors, namely Gregory IX, Innocent IV, Clement IV, Honorius IV, Benedict XI, Urban VI and Boniface IX, undertook a devout pilgrimage to the temple of Holy Mary of the Angels, and sometimes stayed in the adjoining monastery, so that they not only venerated the sanctuary, but also showed singular and special devotion to the Portiuncula, and filled those sacred buildings with the presence of pontifical majesty. Pius II, Sixtus IV, Julius II, Clement VII, Paul III and Pius VII visited the sanctuary itself, the last of whom, returning to Rome, on the fifteenth day of the month of May in the year 1805, offered the Eucharistic Sacrifice in the temple of the Angels. The Roman Pontiffs Gregory XVI and Pius IX also in more recent times honoured the church itself of the Angels with a visit. Yet it is especially fitting to remember that Pius V, our predecessor, whose munificence erected for the custody of the venerable little building of the Portiuncula a temple splendid in its vast extent, structure and marvellous works, with a lofty and marvellous dome, which will be seen far and wide, proclaims to all the inhabitants of Umbria the glory of the seraphic Father. Nor do we consider it less worthy of memory that Gregory XVI, who restored the church destroyed by earthquake in the year 1840, took care to adorn it with new worship. Our Roman Pontiff predecessors also exercised careful concern that in the holy place, in which Father Francis had received the spirit of grace and laid the foundations of his Order, religious men, his sons, should keep with more careful study the rule prescribed by him and approved by the authority of this Holy See. By wise counsel also our same Predecessors provided that the glorious traditions and memories of the Portiuncula should be held in due honour by all, and should remain unchanged. Moreover, they demonstrated their special devotion to the Portiuncula by broad and solemn decrees, by which they forbade anyone to dare to build dwelling houses or permanent shops around the precincts of the sanctuary or the adjoining convent; and by other decrees, both for the repair of aqueducts and for the preservation of roads, they made provision. These same Pontiffs finally excepted the indulgence of the Portiuncula to be gained in the temple of the Angels from the universal suspension of indulgences in the sacred jubilee years, rightly considering that it is not fitting that an indulgence immediately derived from God should be revoked or suspended by the Pontiffs. Nor did our Predecessors cease in their liberality to wish to honour, increase and enrich that sacred building with manifold treasures of spiritual graces and singular indulgences and principal privileges, from the very beginnings of the seraphic Order. Above all others shines forth the singular and throughout the whole Catholic world most celebrated plenary indulgence called of the Portiuncula, which is to be gained every year by the faithful who have been absolved by sacramental confession, on the second day of the month of August, from the first Vespers until the setting of the sun of the same day, as many times as they visit the chapel of the Portiuncula. But among other special privileges are to be reckoned the perpetual plenary indulgence, to be gained daily in the temple of the Angels under the usual conditions, which our predecessor Innocent XII granted by pontifical letters, whose beginning is Redemptoris, given on the eighteenth day of the month of August in the year 1685; and likewise a similar plenary indulgence, to be gained every year on the anniversary day of the consecration of the same temple by the faithful of both sexes, who, having been absolved by sacramental confession and refreshed by heavenly food, visit the church of the Angels from the first Vespers until the setting of the sun of the same day, pouring forth pious prayers to God for the concord of Christian princes, the extirpation of heresies, the conversion of sinners and the exaltation of holy Mother Church; which indulgence we have learned was proclaimed in the year 1840 by the vivid voice of the Cardinal of the Holy Roman Church Lambruschini. Furthermore, in the same temple of the Angels, to a pious confraternity of the faithful canonically instituted, our predecessor Pius IX granted the title of archconfraternity and singular indulgences. Finally, both the privileges of Masses for the dead to be freed from the pains of Purgatory, with which several altars of the same temple are endowed; and the privilege of votive Mass for certain chapels of the Portiuncula; and special faculties for confessors and penitentiaries; and many other graces altogether special granted to the same sanctuary, most clearly testify to the devoted care and munificence of the Roman Pontiffs towards that most distinguished temple. Now, however, since on the sixteenth day of the present month of April, seven centuries happily turn from that day in the whole assembly of the Seraphic family, most venerable to be observed, on which the holy father Francis, having professed the rule of the Order in the hands of the Pontiff Innocent III, obtained apostolic approval from him, and thus gave beginning to the Order of Minors; and for this reason the General Superior of that Order, in his own name and in the name of the whole religious family over which he presides, has earnestly besought us with urgent prayers that, having obtained so auspicious an occasion, we should wish by apostolic power to raise the sanctuary of the blessed Virgin Mary of the Angels in the Portiuncula to the rank and dignity of a patriarchal basilica; We, knowing well that this most celebrated church, illustrious with so many memories and adorned with so many prodigies, stands most venerable to the Order of Friars Minor, which ought to regard it as the natal font, have deemed it fitting to accede to these wishes, as much as we can in the Lord. Since these things are so, We, led by the obedience of filial devotion, with which we regard the divine Francis, and also wishing to exhibit a singular and special pledge of our will to the whole Order of Friars Minor, of which we ourselves are patron and protector, by our own motion and from certain knowledge and mature deliberation of ours, and from the fullness of our apostolic power, by the force of these presents, we decree this, the proper causes and especially the glorious memories of Franciscan annals persuading us, that the church of St. Mary of the Angels in the Portiuncula, situated within the bounds of the diocese of Assisi, is to be called by right the head and mother of the Order of Minors, just as the Assisi basilica, in which the body of St. Francis rests, has been enriched by our predecessors Gregory IX and Benedict XIV with a similar title on account of the weight of its praises. Furthermore, likewise by our own motion and from the fullness of our power, by the tenor of these presents, we erect the same church of the Angels in the Portiuncula into a patriarchal basilica and papal chapel, and we decree that it shall be and remain such from now into the future perpetually: and we wish that the same basilica be called and held patriarchal and papal chapel equally and in like manner as other patriarchal basilicas within the holy City and outside its walls, and also papal chapels constituted in pontifical buildings and near them are called and reckoned. Therefore the patriarchal basilica of St. Mary of the Angels in the Portiuncula and the convent adjoining it, together with all things which pertain to the basilica itself and the convent, we likewise subject by our apostolic authority, by the tenor of these presents, to the jurisdiction, patronage and dominion of ourselves and our Successors and of this Holy See of full right, leaving, as before, the perpetual use and perpetual custody to the Friars Minor of the seraphic province. We expressly command, however, that the Minister of the same province, for the greater honour of the distinguished sanctuary, establish a stable residence there, and together with the custodian, elected in provincial chapters or congregations, personally and effectively see to it that the same basilica maintains that lofty dignity with which the Apostolic See has deigned to honour it by the addition of the most honourable title of patriarchal. Moreover, in memory of the immediate subjection both of the basilica itself and of the convent, together with all pertinences, to this apostolic Holy See, we impose by our authority an annual census of one pound of white wax to be paid to the Apostolic Camera on the vigil of the Nativity of the holy Apostles Peter and Paul, for perpetual future times. We further wish that in the church of the Angels, thus raised to the sublime honour of a patriarchal basilica, beside the high altar, on the Gospel side, a pontifical throne, or chair, be erected in a stable manner for the use of the Roman Pontiff alone and of no other. The high altar, moreover, placed in the same patriarchal basilica, from that part only in which it faces the pontifical throne, we declare from now henceforth to be and to remain a pontifical, or papal, altar, so that it shall be lawful for no one to celebrate Mass thereon, either privately or solemnly, without special indult, or outside the cases which are enumerated in the Ceremonial. As to what pertains to the sacred actions to be performed in the same basilica and the ceremonial rites to be observed therein, we commit the matter to be handled by the Congregation of Sacred Rites, whose duty it shall be to collect the manifold laws and rules into one code, to be approved by us in due time according to the Ceremonial which by right pertains to patriarchal basilicas. But to all and each to whom it pertains, or may pertain in the future, by the force of these presents, we command that they observe exactly all things which shall be thus established by the same Congregation of Rites, and that they strive to conform themselves in all things and through all things to the prescriptions and dispositions of the same Congregation, and that they obey them. Moreover, to perpetuate the memory of the present concession, by which the sanctuary of the Angels, the head and mother of the Order of Minors, is raised to the honour of a patriarchal basilica, we permit that mention of the auspicious event be made in the lessons of the Office of the Seraphic Order. Now, however, turning the eyes of our mind to the almost innumerable and principal treasures of indulgences with which the sanctuary in the Portiuncula is ennobled, we, from the fullness of our apostolic power, by the force of these presents, confirm all those privileges which have been found to have been granted by our Predecessors through authentic documents. We wish the distinguished indulgence of the Portiuncula to remain unchanged, namely to be gained every year only on the second day of the month of August, from the first Vespers until the setting of the sun of the same day, by the faithful of both sexes, only if they have been confessed, as many times as they visit the sacred little building of the Portiuncula situated in the patriarchal basilica of St. Mary of the Angels. Confirming the concession of Innocent XII, we wish that on each and every day the faithful, who have been duly absolved by sacramental confession and refreshed by divine food, visit the basilica of the Angels, and there pour forth pious prayers to God for the concord of Christian princes, the extirpation of heresies, the conversion of sinners and the exaltation of holy Mother Church, shall obtain plenary indulgence in perpetuity: and likewise perpetually, on the day of the year on which the memory of the basilica itself is celebrated, namely the last Sunday of July, the faithful, who, truly penitent and confessed and refreshed by holy communion, visit the same, from the first Vespers until the setting of the sun of that day, pouring forth prayers, as we have said above, shall also receive by our apostolic authority the plenary indulgence and remission of all their sins. It shall be permitted to the faithful themselves to apply these plenary indulgences to the stains and pains of the dead, if they wish. We confirm all the privileges and indulgences which the archconfraternity instituted in the same patriarchal temple possesses, by similar apostolic letters given by our predecessor Pius IX. That we may more aptly meet the pious wishes of the faithful, especially of priests and pilgrims, by our apostolic authority, by the force of these presents, we grant that votive Masses of the Mother of God and of the holy father Francis, already granted by this holy See for the chapel of the Portiuncula and the chapel of the passage of Father Francis himself, may from now henceforth be celebrated by any priest offering the Sacrifice therein, on those days on which a votive Mass of the same Patriarch is permitted at his sepulchre in the Assisi basilica, and with the same rights and privileges with which votive Masses in the greater sanctuaries of the Order in the Holy Land are adorned. And likewise by our authority we confirm that in the very ancient chapel called of the Roses, of the holy Father Francis himself, most illustrious in marvellous examples of virtue and deeds, any priest offering the Sacrifice therein may celebrate a Mass of St. Francis, as on the fourth day of October, provided that there does not occur a double of the first or second class, or a feast of precept to be observed, nor a feria, vigil or octave which is privileged. We further confirm all other similar indults of Masses and also privileges of Masses for the dead both to the basilica and to the altars of the adjoining chapels, duly granted by our Predecessors through apostolic letters: and as to the number of penitentiaries and priests in the same basilica receiving sacramental confessions, and their special faculties, we hold as valid and wish to be religiously observed all things which our Roman Pontiff predecessors, as we have mentioned above, deemed fit to grant benignly. Finally, likewise by our own motion and from certain knowledge and mature deliberation of ours, by these our letters to remain valid in perpetuity, all other and singular privileges, prerogatives, liberties, exemptions and other indults both of the aforesaid basilica of St. Mary of the Angels in the Portiuncula and of the adjoining monastery granted by our Predecessors at any time and in any manner whatsoever, or confirmed and renewed, provided that they have not been actually revoked or comprehended under some general revocation, we also approve, confirm and renew by apostolic authority: and the same basilica, raised by us to patriarchal honour, we wish, decree and declare to be free and immune from the ordinary and delegated jurisdiction, visitation and authority of the Ordinary of the place and of all and any Prelates or Superiors, even of Regulars; for we constitute it, as we have said above, under the immediate power, dominion and property of ourselves and our Successors, the Roman Pontiffs and the Apostolic See, immutably. Decreeing that these our letters shall always be firm, valid and effective and shall produce and obtain their full and complete effects, and shall most fully avail those to whom they pertain and shall pertain in the future, in all things and through all things, and that thus in the aforesaid matters they ought to be judged and decided by any judges ordinary or delegated, and that it shall be null and void if anything otherwise should be attempted concerning these things by anyone, by whatever authority, knowingly or unknowingly. Notwithstanding apostolic constitutions and ordinances, even those worthy of special and individual mention and derogation, and all other things whatsoever to the contrary. We wish, however, that to copies or exemplars of these letters, even printed ones, subscribed by the hand of some public Notary and furnished with the seal of a person constituted in ecclesiastical dignity, the same faith shall be given as would be given to these presents themselves, if they were exhibited or shown.
2 Given at Rome at St. Peter's under the Fisherman's Ring, on the solemn feast of the Resurrection of Our Lord Easter, 11 April 1909, in the sixth year of Our Pontificate.
