Motu Proprio on the organization of ecclesiastical tribunals in Italy for deciding marriage nullity cases
MOTU PROPRIO ON ESTABLISHING ECCLESIASTICAL TRIBUNALS IN ITALY FOR DECIDING CASES OF NULLITY OF MARRIAGE. PIUS PP. XI
1 With what care and diligence the Holy Mother Church throughout the passing centuries has protected the rights and stability of the Great Sacrament, all history testifies, as we have briefly set forth recently in the Encyclical Letter Casti connubii.
2 And indeed with good reason, since Christian matrimony tends not only to the spiritual and temporal good of the spouses, but is chiefly ordained by God for the generation of offspring, so that mankind, according to God's commandment, "increase and fill the earth," and is therefore for both the Church and the State the true and only seminary. But since matrimony itself consists in the contract elevated to the dignity of a Sacrament, it can sometimes happen that the contract itself, and consequently the Sacrament, is affected by nullity, either because the parties contracting were incapable of contracting, or were hindered by some diriment canonical impediment, or because they brought defective consent, or did not express the same consent in valid form, and so forth.
3 In these cases, to judge concerning the validity or nullity of matrimony pertains exclusively to the Church, which employs for this purpose ecclesiastical tribunals constituted according to the canons, and which are bound to proceed according to the norms laid down for this grave matter, as has been most recently and beneficially and notably provided through the Instruction of the S.C. for the Discipline of the Sacraments given on 15 August of the year 1936, which we wish to confirm by these Apostolic Letters given Motu Proprio, to be valid for all tribunals, saving for the Apostolic Tribunals their own particular norms.
4 How arduous, however, is the duty of determining whether in a concrete case the Sacrament of matrimony was valid or not, anyone will easily perceive if he keeps before his eyes the nature of the controversy to be settled by the tribunal. Thus it seems equally unnecessary to declare the dangers and harms which, from a chance error made by the judge either in law or in fact, can befall both the parties and the matrimonial institution and the goods both of families and of civil society itself.
5 If that most wise King Solomon was compelled to cry out humbly to the Lord: "Who is able to judge this people, this people of thine which is so great?" (III Kings I, 9) when nevertheless the matter concerned temporal judgments and not spiritual ones, what excellence of moral virtues, of knowledge, of prudence, of ability did we think necessary for ecclesiastical judges, so that they might be found equal to their office? With good reason, therefore, the aforesaid Instruction says: "Given the gravity of these cases and their difficulty, both as regards the procedural laws to be observed and as regards the intrinsic merits of the case, it is the duty of Bishops, with their consciences gravely burdened, to choose carefully priests whose prudence and integrity are beyond all exception, and who are endowed with a degree or at least a license in canon law, or if not, who truly possess juridical knowledge and experience" (art. 21).
6 Anyone, therefore, easily perceives why in Italy, where, on account of the great number of dioceses, very many consist of small territory and scanty clergy, the Ordinaries are affected by grave and sometimes even insuperable difficulty in placing truly expert officials and judges at the head of their tribunal. This difficulty, therefore, if it be kept before one's eyes, makes manifest the necessity of assigning for the handling of matrimonial cases certain tribunals, fewer in number, which, complete in all respects, can properly and commendably discharge their own office.
7 After, therefore, the Sacred Congregation for the Discipline of the Sacraments, through the labor of many years, had carefully gathered information concerning the tribunals and matrimonial cases from the Ordinaries of Italy and had received their votes, and after it had requested the votes of experts on the present matter, it proposed the whole matter in its Plenary Sessions of 22 July of the current year, with the Most Eminent Fathers of the S.C. Consistorial also present, for Us to decide.
8 Wherefore, having duly weighed the wishes of the Most Eminent Fathers, by Motu Proprio, with certain knowledge and from the fullness of Apostolic power, We have decreed and do decree that all the following matters shall be established: I. Each individual Ecclesiastical Region or Conciliar Region of Italy shall constitute a single circumscription and shall have one regional tribunal for the handling and decision of cases concerning the nullity of marriages. Therefore in the first instance cases of the Conciliar Regions shall be handled: 1) Piedmont at the tribunal of Turin; 2) Lombardy at Milan; 3) Liguria at Genoa; 4) Aemilia at Modena; 5) Venetia at Venice; 6) Romagna at Bologna; 7) Etruria at Florence; 8) Umbria at Perugia; 9) Picenum at Fermo; 10) Latium at the Tribunal of the Vicariate of the City; 11) Abruzzo at Teramo; 12) Benevento at Benevento; 13) Lucania and Salerno at Salerno; 14) Campania at Naples; 15) Apulia at Bari; 16) Calabria at Reggio; 17) Sicily at Palermo; 18) Sardinia at Cagliari.
9 II. For the handling of the aforesaid cases in the grade of appeal, the faculty of directly appealing to the Sacred Roman Rota according to can. 1599, § 1, n. 1 of the Code of Canon Law always remaining intact, to which the Vicariate of the City shall always appeal, the procedure shall be as follows:
10 Cases handled in the first instance at the tribunal of Genoa shall be brought to the tribunal of Turin; those at the tribunal of Milan to the tribunal of Genoa; those at the tribunals of Turin and Venice to the tribunal of Milan; those at the tribunal of Bologna to the tribunal of Venice; those at the tribunals of Florence and Modena to the tribunal of Bologna; those at the tribunals of Perugia and Fermo to the tribunal of Florence; those at the tribunals of Naples and Cagliari to the tribunal of the Vicariate of the City; those at the tribunals of Palermo, Reggio, Salerno and Benevento to the tribunal of Naples; those at the tribunals of Bari and Teramo to the tribunal of Benevento.
11 III. Officials, judges, promoters of justice, defenders of the bond and other ministers of these tribunals — except the tribunal of the Vicariate of the City, whose Officials, judges, etc. shall be appointed by the Supreme Pontiff himself, upon the proposal of the Most Eminent Cardinal Vicar of the City — are to be chosen and appointed for a definite period by the Excellent Ordinaries in the Regional Assemblies.
12 IV. The rights and duties of these tribunals as well as the practical method of procedure shall be defined by the Sacred Congregation for the Discipline of the Sacraments, also concerning the time when the matters established above are to be put into execution, as well as concerning temporary norms relating to pending cases.
13 V. The Sacred Congregation for the Discipline of the Sacraments shall give vigilant and diligent attention, according to its office, so that both Officials and judges, and especially promoters of justice and defenders of the bond, shall duly and diligently discharge their duties according to the norms issued or to be issued by the same Sacred Congregation.
14 We establish these things, notwithstanding anything to the contrary, even if worthy of special mention.
15 Given at Rome, at St. Peter's, on 8 December, on the Feast of the Immaculate Conception of the Blessed Virgin Mary, in the year 1938, the seventeenth year of Our Pontificate.

MOTU PROPRIO DE ORDINANDIS TRIBUNALIBUS ECCLESIASTICIS ITALIAE PRO CAUSIS NULLITATIS MATRIMONII DECIDENDIS. PIUS PP. XI
6 Facili prorsus negotio, igitur, quisquis percipit cur in Italia, ubi, ob magnum dioecesium numerum, permultae parvo territorio exiguoque clero constant, gravi immo quandoque insuperabili difficultate afficiantur Ordinarii in officialibus et iudicibus vere peritis suo tribunali praeponendis.
Ideoque in prima instantia tractabuntur causae Regionis Conciliaris I) Pedemontanae apud tribunal Taurinense; 2) Longobardiae, apud Mediolanense; 3) Liguriae, apud Ianuense; 4) Aemiliae, apud Mutinense; 5) Venetae, apud Venetiarum; 6) Romandiolae, apud Bononiense; 7) Aetruriae, apud Florentinum; 8) Umbriae, apud Perusinum; 9) Picenae, apud Firmanum; 10) Latii, apud Tribunal Vicariatus Urbis; II) Aprutinae, apud Teatinum; 12) Beneventanae, apud Beneventanum; 13) Lucanae et Salernitanae, apud Salernitanum; 14) Campanae, apud Neapolitanum; 15) Apuliae, apud Barense; 16) Calabriae, apud Rheginense; 17) Siciliae, apud Panormitanum; 18) Sardiniae, apud Calaritanum.
9 II.

PIO PP. XI
