BENEDETTO VESCOVO

BENEDICT, BISHOP

2 Servant of the servants of God, to perpetual memory.

3 To the militant Church.

4 This text appears to be OCR noise or severely corrupted print from a historical document. The passage contains numerous garbled words, broken syllables, and nonsensical letter combinations that do not form coherent Latin. Examples include "Ecclefix regids quh mennullo me-", "ftrorum NNo- 9rd", "ost»sis moerore", and similar corrupted sequences throughout. Without a legible source text, faithful translation is impossible. I recommend consulting the original document or a clearer reproduction before requesting translation.

5 PONT.

6 Legates of the Holy See at the side, and by various officials of the Roman Curia, Inhibitions were issued without discrimination of cause and of the matter in question, and examination thereof. And although it is customary that such Inhibitions improperly expedited be revoked and abolished according to the merits of the case, yet they say that the remedy is not sufficiently applied to the inflicted wound; since in the meantime Bishops and inferior judges must remain idle in the very course of causes and judgments, judicially assert and vindicate their right, and undergo grave inconveniences and losses in order to keep peoples in their duty. § 2. On the other hand, we also, when we were still in lesser office, happened to hear the responses of Superior Judges asserting that the aforesaid complaints were empty and rested on no foundation; inasmuch as they had their cause and origin from this one thing alone; that it is grievous to them to bear the yoke of obedience and subjection toward the greater Tribunals; and it displeases them greatly that their subjects are aided by the benefit of appeal.

7 § 3. In order that these matters may be composed and the seeds of growing litigation may be uprooted, so that those things which have been sanctioned by the Sacred Council of Trent and by the Synod, by Apostolic Constitutions and by the Decrees of Congregations, may be duly carried out into execution: We therefore, for the preservation of the discipline of the Church and for the restoration to the Tribunals of a form consonant with the same canonical laws, in accordance with the office of Apostolic service committed to us, have deemed it opportune to provide.

8 Adhering therefore to the Decrees of the same Sacred Council, as well as to the Congregation of Bishops and secular matters, with the counsel and approval of our Predecessor of happy memory, Clement VIII, otherwise issued on 16 October; likewise to other decrees of a particular Congregation, by the command and approval likewise of our Predecessor of happy memory, Urban VIII, similarly promulgated on 5 September 1626, and to their declarations recently superadded by our Predecessor of pious memory, Benedict XIII, in 1742 in the Appendix of the Roman Council, and to other Apostolic Constitutions on this matter otherwise issued and renewed, and especially to the pious Constitution of Gregory XV of happy memory, which begins: Inscrutabilis, given at Rome at St. Peter in the year of the Incarnation of the Lord 1622, on the nones of February:

9 § 5. We strictly command and ordain that Appeals with Inhibitions be not henceforth granted for the execution of the decrees of the said Sacred Council of Trent in all those causes and matters in which the execution of this kind has been committed to Bishops or Ordinaries of places, even as Apostolic Delegates, by the same Sacred Council or by Apostolic Constitutions, unless some appeal in the aforesaid Tribunals be received, or Inhibitions, whether general or special, with a clause of communication inserted, Monitions and other things of this kind, by which the execution of the said Decrees is delayed, or the Process in the same execution is suspended or impeded, be granted in any way whatsoever.

Item from Mandates or Decrees compelling Oeconomi, Vicars Capitular, to render account of the administration conducted by them during the vacancy of the Episcopal See, according to the prescription of the Sacred Council sess. 24, on Reform, cap. 16.—f.36. Item from the threat of excommunication imposed by Law, and from the sentence of excommunication, suspension and interdict imposed by man, unless an appeal has been interposed on the ground of nullity: And conversely from the sentence of absolution from the same Ecclesiastical Censures.—f.37. And generally from the execution of any other Decrees whatsoever of the said Sacred Council of Trent, entrusted by the Council itself to Bishops and Ordinaries of places, and in the Constitution of the blessed memory of Pope Pius IV, which begins: Benedictus Deus.—f.38. We will, command and mandate that by Archbishops, Patriarchs, or Primates, and other Ecclesiastical Judges; even Our own and of the Holy Apostolic See Nuncios; or Legates a latere, even Cardinals of the Holy Roman Church, and also the general Auditor of Our Camera, the Prefect of the Signature of Justice, and other Judges of the Roman Curia; and their Vicars and Officials, general or special Citations with Commission inserted, Monitions and other such things with Inhibition; by which the execution of Decrees, Mandates and Provisions of this kind is retarded, suspended or impeded; be in no wise granted; and insofar as they have now or hereafter been granted, they shall not inhibit, and may be spurned with impunity by Bishops and Ordinaries of places; any custom whatsoever, even immemorial, or any Privilege or style of granting Inhibitions in the aforesaid causes notwithstanding, even if temporary; being wholly excluded. For We declare Citations and Monitions, otherwise than as aforesaid, granted or hereafter to be granted, null and void, and We will them to be held and declared null and void, and We truly mandate: Decreeing that against such Decrees, Mandates and Provisions, which have or shall have been issued by Bishops or others in the aforesaid causes and matters, there shall be either simple and extrajudicial Recourse by way of a supplicant petition to Us and Our Successors the Roman Pontiffs; or respectively, and according to the nature and quality of the causes, Appeal to those to whom by Law, in the devolutive effect alone, and without delay or prejudice to legitimate execution, it may be received and admitted.—f.39. Since however in these very negotiations and causes in which Inhibition is said to be issued, there is need of more careful consideration.

28 can be given, which by the Sacred Council of Trent itself, or according to its Mind, by Apostolic Constitutions, and declarations of the Sacred Congregations, or the common opinion of Doctors; are excepted from the aforesaid general rule concerning the non-granting of Inhibitions, and their being set aside; and which for the most part ought not to be granted otherwise than by the prudent judgment and at the discretion of the Judges and Ordinaries of Places, or can be taken as impediments to or suspensions of Canonical execution.

29 according to the particular circumstances of the case: Hence We, lest under such pretext Inhibitions, as aforesaid prohibited, be commonly and without any discrimination granted even in cases not excepted: Do Establish and command, that in the said Causes and matters above expressed; the Metropolitans, Patriarchs, Primates, and other aforesaid Judges, and especially the Auditor of Our General Camera and his Locum Tenentes; and the Prefect of the Signature of Justice and his Auditor, to whom in a contingent case recourse for obtaining an Inhibition shall happen to be had, even if it be asserted that that case is excepted by the Sacred Council, or by Apostolic Constitutions for whatever cause: Nevertheless they shall not grant Letters Citatory, or Monitory with such Inhibition, unless first from the circumstances of the case, to be clearly and plainly set forth in the petition presented by the Party resorting, and verified with some document at least in part, it shall appear to them summarily; that that case is among the excepted, and therefore the Bishop or Ordinary of the Place is to be inhibited, lest he proceed to further matters; Then indeed, and not otherwise, and after the same Judges, whose conscience We burden in this part, shall have written with their own hand upon the said petition; that the Inhibition can be granted; and the petition with such rescript shall have been produced in the Acts, to be carefully kept and preserved there, it shall be lawful for their Notaries, or Actuaries, to expedite Letters Citatory with the said Inhibition and deliver them to the Party resorting; provided however that in their closing there be expressly added the following clause: We, having regard to the matters, the petition presented to Us, and the documents exhibited, as is aforesaid, have commanded by special Rescript that inhibition be made; Otherwise such letters without such clause shall have no force of inhibiting in the aforesaid cases. And nevertheless if Notaries, without the said special Rescript upon the petition, or without the production of it in the Acts, or without the aforesaid clause, shall grant any Citations or Monitory with inhibition,

30 in any manner whatsoever under any pretext, shall presume to expedite and deliver, even if they have been subscribed by the Judge, shall incur the penalty of infamy and perpetual disqualification from exercising the office of Notary in Ecclesiastical Cases, and as regards those of Our General Auditor of the Camera or other Judges of the Roman Curia expressed above, even fifty gold ducats of the Camera, one half for Our Apostolic Camera, the other half for the Party recurring and having interest in the case, or if not, for some Pious Place, to be assigned at Our discretion and that of Our Successors, to be applied. Furthermore, similarly adhering to the disposition of the same Sacred Council and also to the decree of Pius of blessed memory and Benedict XIII promulgated in this matter, among his additions to the decrees of Urban, Pope VIII, in the appendix to the Roman Council, We will and command that Clerics, whether Secular or Regular dwelling outside the Monastery, in any manner whatsoever exempted, in Cases of Wages and miserable Persons, even if they have a certain Judge appointed by the Apostolic See in the regions: in other cases, if they do not have the same Judge, they may be summoned before the Ordinaries of Places, as delegated by the same See, in the first instance, and by right of the middle course may be compelled to pay the debt. As to non-exempt Persons, adhering similarly to the dispositions of the same Sacred Council and to the aforesaid general Decrees of the Congregation of Bishops issued in the year 1600 with the newest additions and declarations of Pius of blessed memory Benedict XIII in the Appendix of the Roman Council, We will, decree, and command that all Cases, both Civil and Criminal, pertaining to the Ecclesiastical Forum, excepted Privileged ones, which from the same Council or otherwise according to Canonical Sanctions may and ought to be handled before Us and the Apostolic See, shall be heard before the Ordinaries of Places only in the first Instance, and may not be avoked to themselves by Metropolitans, Patriarchs, or Primates, or other Ecclesiastical Judges, even Our own and of the Apostolic See Nuncios, or Legates de latere, or our General Auditor of the Camera, and all other whatsoever Judges of our Curia, unless by way of legitimate appeal and in cases as above not prohibited, they be brought to their Tribunals. Appeals, however, shall not be received, nor shall inhibitions be granted by virtue of them, unless it shall first be established not only that the appeal has been made by a legitimate Person and within legitimate times truly, but also that it has been appealed from a definitive Sentence or one having the force of definitive, or from a grievance which cannot be repaired by a definitive Sentence: and this by public Documents which shall really be exhibited in the Acts; Then indeed, and not before, it shall be lawful for the Judge to whom appeal has been made to interpose himself in the Case, to grant citations and inhibitions; provided, however, that they be granted with the inscription of the tenor of the Sentence or definitive Decree, or one having definitive force or causing irreparable harm by a definitive Sentence; Otherwise citations, inhibitions, Process, and whatever follows therefrom shall be null by the law itself, and may be impugned with impunity. But if the appellant assert that he cannot have an authentic Exemplar of the Sentence or Decree through the fault of the Judge from whom, or of the Notary or Actuary, then at least he shall be bound to produce a simple copy of the Sentence or Decree in the Acts, and its tenor inserted in the Letters of Inhibition shall be added, as We will and command to be added in their body with express condition: Provided, however, that the tenor inserted shall truly agree with the Original in substantial matters and that the present Letters be with the same Original at the time of their presentation; otherwise they shall be null and void: And if it be done otherwise, inhibitions otherwise granted shall in no way affect, and Notaries or Actuaries who shall have expedited them shall incur the penalties expressed above. But since a grievance which cannot be repaired by a definitive Sentence is also a legitimate grievance to be appealed, if indeed the matter be of an imprisonment already effected with a verbal Mandate, Inhibitions by virtue of Appeal cannot otherwise be expedited than it being first established of the same imprisonment by the deposition of at least two Witnesses. Meanwhile, however, the Appellant shall remain in the same prison in which he is found, until it be otherwise judged. But where it is a matter of censures already pronounced, or of the threat of Imprisonment, Torture, or Censures, the disposition of the said Decrees of the Congregation of Bishops under the blessed memory of Clement VIII shall be observed entirely, according to the additions and declarations of blessed memory Benedict XIII. Furthermore, in the aforesaid Cases pending in the first Instance, or in other cases expressed above, in which appeal is not admitted in suspensive, Citations, process to further matters, subscribed even by the Auditor of the Signature of Justice or to the effect of appearing, or for going to the same Signature, We will that they shall in no way have the force of inhibiting, and We order them to be expedited for the aforesaid other effects only, namely for appearing or going to the Signature, not, however, for retarding execution or suspending process to further matters. Finally, as to Privileged Cases, which as is aforesaid may be handled in the first Instance before Us and the Apostolic See, We will that nothing be changed from the ancient practice; but Monitions in them before Our General Auditor of the Camera or his Locum Tenens in privileged cases shall be expedited, as has hitherto been laudably observed, according to the prescription of the Apostolic Constitutions, and especially of the blessed memory of Paul V, Our Predecessor, in the Constitution which begins: Universi; as well as of the aforesaid additions and declarations of Benedict XIII, which are wont to be expedited before the Cardinal beyond the Mountains, in which to avoid the scandal which once prevailed in that Tribunal, that is, that to the expediting of such Monitions there shall be no otherwise proceeding than upon a supplicant Libel first offered to the Auditor himself or to one of his Locum Tenentes before whom the Monition is to be expedited, containing clearly and lucidly the whole species of the Fact, and also with the prior rescript of the same Judge that the Monition may be expedited, kept by the Notary of the Case; excepted, however, Monitions to be intimated beyond the Mountains, and the inconveniences of litigants, We will that they be entirely renewed and observed as is aforesaid and without the said supplicant libel and special rescript of the Judge, if the said Monitions beyond the Mountains to be intimated shall have been expedited, the Notary or Actuary and Substitute who shall have expedited it shall by the fact itself incur the penalties expressed above. All and singular things hitherto disposed by Us are to be exactly kept and observed for the right administration of the Courts by all. And We command this the more earnestly, inasmuch as it is more clearly evident that by this Our Constitution not new laws are being enacted, but ancient laws, providently and wisely instituted, and made obsolete by the injury of time and the fraud of men, are being restored, and with new protection of Pontifical authority the order of proceeding in Cases is being strengthened, already long since prescribed to the Superior and Inferior Tribunals by the Sacred Tridentine Synod, the Decrees of Congregations, and the Constitutions of Our Predecessors, the Roman Pontiffs, and other Apostolic Ordinances. Wherefore, if the Judges themselves, with all human cupidity of affection removed, as is fitting, shall have before their eyes only those things which have been so maturely and so beneficially constituted and ordained by counsel, each of them shall easily recognize what parts of his own and what of another's Ministry ought to be in admitting and respectively rejecting the Appeals and Inhibitions of Cases: And thus it shall come to pass that not only to each in his own order due jurisdiction and authority shall be preserved...

31 MOREOVER, that prerogative may be preserved; but also so that, with all seeds of contentions and discords completely and utterly rooted out, the Courts may be joined together by the mutual bond of charity, and right and Christian discipline, useful and necessary to the People, may be restored among them,—— f.49. Finally, so that, by Our example, all may carefully apply themselves to the execution of the aforesaid matters and according to their ability, and so that especially to Notaries, Tabellions, and their Advocates and Substitutes every opportunity of acting contrary may be cut off; We will and expressly command that the Processes and Acts of Cases pending in Our Roman Curia before any Judge whatsoever, and the Inhibitions; Appeals, Monitions; and other Citations and Acts;

Decreeing that these present Decrees all and always be firm, valid, and efficacious.

35 §. 52.: But so that the same present [letters] may more easily come to the knowledge of all, We will them; or their copies to be affixed to the doors of the Church of the Lateran; and of St. Peter's, exercising and about to exercise power; with the faculty and authority taken from them and from each of them in any other manner of judging and interpreting, [they] ought to be judged; and to be defined;
