Costituzione sul rito greco nell'Italia meridionale e in Sicilia
BENEDETTO VESCOVO
^ IUR. PONT. DE P. P. PARS I.
13 Del Primato Romano. VI.
BENEDETTO XIV. 61 An. C. 1742

41 IUR. PONT. DE P. P. PARS I.

87 II. Item permittitur eisdem, facta iam consecratione antequam sacerdos communicet, iuxta ritum in liturgia praescriptum aquam ferventem seu tepidam in sacrum calicem infundere.
88 III.
92 VII.
93 VIII. Cum in parochialibus ecclesiis ipsorum Graecorum, ex antiquissimo et hactenus servato ritu, nonnisi semel in die per unum sacerdotem celebrare liceat, permittitur quidem presbyteris graecis suum, si velint, morem hac in parte servare: interdicitur autem latinis sacerdotibus, ne missas et alia divina officia in dictis Graecorum ecclesiis et super eorum altaribus maioribus extra casum alicuius necessitatis et aliorum altarium ecclesiarumque defectus, et nisi ex parochi graeci consensu, quem nullatenus huiusmodi in casibus negare possit, celebrent.
94 IX. Quia tamen ipsi Graeci et Albanenses presbyteri nobis humillime supplicarunt, ut sibi liceat pro sacerdotum numero plures in diem in suis ecclesiis missas celebrare; nos ipsorum precibus annuere volentes, per praesentes nostras concedimus ac indulgemus, ut in suis parochialibus vel aliis ecclesiis praeter altare maius alia etiam minora altaria seu cappellas sacris indumentis Graecorum seu Latinorum more ornata seu ornatas erigant, in quibus latini vel graeci presbyteri respective suo quisque ritu celebrare valeant.

IUR. PONT. DE P. F. PARS I.
114 XX. Ciascun sacerdote sacrifichi soltanto in calice d'oro o d'argento o almeno di stagno, avendo troni o corporale di lino bianco e lucido, e l'altare coperto di vesti pulite o ornato di decente apparato.
115 XXI.

§ VII.

92 VII.

130 VI. Episcopi graeci in ordinibus conferendis ritum proprium graecum in euchologio descriptum servent, in quo, etsi nonnulli de minoribus ordinibus praetermissi videantur, eos tamen vel nunquam habuisse, vel eorum exercitium aliis ordinibus esse adnexum iidem Graeci affirmant.
131 VII.

191 VIII.
192 IX.

BENEDICT, BISHOP
Servant of the servants of God, for perpetual remembrance of the matter.
1 Although the pastoral vigilance of the Roman Pontiff extends with paternal charity to all Christian faithful, even those separated by the longest intervals of place and differing greatly among themselves in manner of life, rites and languages, and applies every care and effort so that everywhere throughout the earth the integrity of the Catholic faith, the splendor of ecclesiastical discipline and the probity of morals may be preserved intact and secure; nevertheless he directs the greater studies of pontifical solicitude toward those who dwell in the ecclesiastical domain and in the remaining parts of Italy and its adjacent islands, whether born there or brought from elsewhere. Since therefore it has come to pass that, with evils spreading for a long time throughout the entire East both through the savage cruelty of barbarians and also through the perfidy of schismatics, many from Greece, Epirus, Albania and other regions of Asia have fled to Italy and its adjacent islands as to a harbor of faith and tranquility, and have there established their seats and dwellings, and both they themselves and their children diligently and earnestly continue to preserve the Greek customs, institutions, rites and practices handed down to them from their Greek forebears, yet in such manner that they profess complete obedience and devotion to the Roman Church; hence it is that we, who by the ineffable mercy of God, though unworthy of such merits, hold His place on earth, before whom there is neither Greek nor Jew, Barbarian nor Scythian (for all are one in Christ Jesus), wishing to honor Greeks and Albanians of the Greek rite dwelling in our ecclesiastical domain and in both Sicilies, as well as in the remaining parts of Italy and adjacent islands in the dioceses of Latin bishops, with special favors and graces, do hereby renew, confirm and approve all and singular things which by the praiseworthy ordinance of our predecessors, the Roman Pontiffs, are known to have been granted, established, ordained, bestowed and made to the aforesaid Greeks and Albanians, both as regards the observance of Greek rites or customs, and as regards privileges, immunities, exemptions, favors, indults and graces, so that they may obtain fuller strength and firmness, and may endure more firmly and stably unimpaired and unshaken, the more frequently they are protected by the aid of the Apostolic See in general and in particular, and we add to them the strength of our approval, confirmation and renewal, so that by the same privileges, immunities, exemptions, indults, graces and favors, just as Latin clergy both secular and regular, and their churches, monasteries and goods in those same places where Italo-Greeks dwell, use, possess and enjoy them, they may freely be able and have power to use, possess and enjoy them, and rejoicing fully in the Lord in these privileges and graces granted to them, may rest in the tranquility of peace, and advancing along the path of God's commandments may persevere in more fervent devotion toward the Apostolic See. Since moreover for the confirmation of the constitutions, various and diverse documents have been issued at different times and circumstances by those same predecessors of ours, the Roman Pontiffs, and by some of our venerable brothers, the Cardinals of the Holy Roman Church, in their congregations concerning these same Greeks and Albanians, their rites, customs, institutions, and the due subjection to the Latin Prelates in whose dioceses they dwell, apostolic constitutions, ordinances, responses, edicts and decrees; and for this reason questions and controversies have often arisen and are wont to arise both concerning the rites themselves of the Greeks and Albanians, and concerning the power of their priests, and the jurisdiction and authority of the Latin Prelates and parish priests; we, for the solicitude of our pastoral office, as much as in us lies, 1 wishing to apply an opportune remedy to these evils, and to cut away the causes of all lawsuits, quarrels, dissensions, contentions, questions and controversies, and to hand down a certain rule, norm and instruction concerning these matters both to the aforesaid Greeks and Albanians of the Greek rite and to the Latin bishops and parish priests, to which they ought chiefly to conform themselves henceforth and to adhere in all occurring doubts and cases, do find that all and whatsoever things have been ordained and constituted by those same Roman Pontiffs our predecessors, and especially by Innocent IV, Leo X, Clement VII, Paul III, Julius III, Pius IV and V, Gregory XIII, Clement VIII and perhaps other Roman Pontiffs concerning the aforesaid Greeks and Albanians and their rites and customs (1), so that, the more frequently these faithful perceive them to be renewed, the more fervently and readily they may be stirred to their observance, in all other respects, except in those things which are contrary to these our present letters, are to be confirmed and renewed, and to be strengthened by the protection of our authority, and we do confirm and renew them, and moreover by our own motion and from certain knowledge and mature deliberation of ours, and from the fullness of apostolic power, by this our perpetually valid sanction and constitution we dispose, constitute, ordain, decree and declare, as in the Lord we perceive it to be expedient.
Concerning the Catholic Faith.
2 And first indeed, since the Catholic faith is of such a kind that, unless each one shall have kept it whole and inviolate, he cannot be saved, whatever the most holy Roman Church believes and teaches, all and each of these things the same Greeks and Albanians of the Greek rite are bound to believe and affirm wholly, firmly and without doubt; as was defined and declared in the sacred ecumenical Synod of Florence on the union of the Western and Eastern Church, and is contained in the profession of orthodox faith to be emitted by the Greeks by command of Gregory, our predecessor as Pope, namely: on the procession. That the Holy Spirit proceeds eternally from the Father and the Son, and has its essence and its subsistent being from the Father together with the Son, and from both eternally as from one principle and one spiration: and that this explanation of those words "and the Son" was lawfully and reasonably added to the symbol for the sake of declaring the truth and in view of the pressing necessity then at hand. Although the Greeks are bound to believe that the Holy Spirit proceeds also from the Son, they are not bound to pronounce it in the Symbol; nevertheless the contrary custom has been laudably received by the Albanians of the Greek rite, which we wish to be observed by the same Albanians and by any others whatsoever in the churches where it prevails; and indeed we command and order that the particle "and the Son" be pronounced in the symbol by Greek priests of any other regions dwelling in Italy and its adjacent islands, if they shall be required by the Ordinaries of places, either on suspicion of heresy, or on account of scandal, or for any other just cause.
3 II. They are likewise bound to profess that the Body of Christ is truly confected in both unleavened and leavened wheaten bread; and priests ought to confect the Body of the Lord in either one, each namely according to the custom of his Church, whether Western or Eastern.
4 III. Likewise, if truly penitent they shall have departed in the charity of God before they have made worthy satisfaction by the fruits of penance for their commissions and omissions, their souls are purged after death by the pains of Purgatory; and, that they may be relieved from such pains, it avails them that the suffrages of the living faithful be offered for them, namely the sacrifices of masses, prayers and alms, and other works of piety, which are wont to be done by the faithful for other faithful according to the ordinances of the Church.
5 IV. The souls of those who after Baptism received have incurred no stain of sin whatsoever, and likewise those who after contracting a stain of sin, whether in their bodies or stripped of their bodies, as was said above, have been purged, are received into heaven forthwith, and behold clearly God Himself, Three and One, as He is, yet according to the diversity of their merits, one more perfectly than another.
6 V. The souls of those who depart in actual mortal sin, or in original sin alone, descend forthwith into hell, to be punished with unequal pains.
7 On the procession of the Holy Spirit from the Father and the Son.
8 On unleavened and leavened bread.
9 On Purgatory.
10 On the beatific vision of the Saints.
11 On the souls of those dying in actual mortal sin, or in original sin.
12 (l) Acts of this kind see in the appendix. ^ IUR. PONT. DE P. P. PART I.
13 On the Roman Pontiff and the Apostolic See and the Primacy of the Pontiff. VI. That the Roman Pontiff holds the primacy over the whole world, and that the Roman Pontiff is the successor of Blessed Peter, Prince of the Apostles, and the true Vicar of Christ, the Head of the whole Church, and the Father and Doctor of all Christians, and that to him in Blessed Peter full power of feeding, ruling and governing the universal Church has been delivered by our Lord Jesus Christ, as is also contained in the acts of ecumenical councils and in the sacred canons.
14 VII. They ought likewise to receive and profess without doubt all other things which have been handed down, defined and declared by the sacred canons and ecumenical councils, and especially by the most holy Tridentine Synod and by the holy Roman Church under Gregory XIII, our predecessor, in the profession of orthodox faith to be emitted by the Greeks; and at the same time they are wholly bound to condemn, reject, anathematize and abjure all things contrary to these, and all schisms and heresies whatsoever condemned, rejected and anathematized by the holy Catholic and Apostolic Roman Church, the mother and teacher of all churches.
15 On the Sacrament of Baptism, on children baptized, and on the change of rite received in Baptism.
16 I. Greek priests shall not sign the baptized with Chrism on the forehead; and therefore those things which follow after those words in their order of baptism according to their euchologion, "and after the prayer" etc., up to where it says "when the priest makes the sign of a circle": that is, "and after the prayer" etc., where the form of this signing is found, up to those words: "then the priest makes the sign of a circle" etc., shall be omitted by them.
17 II. Since Greek priests have this form of Baptism prescribed in the Euchologion: the servant of God N. is baptized in the name of the Father, and of the Son, and of the Holy Spirit (which is equivalent to the Latin form I baptize you in the name of, etc.), and they use a triple immersion or sprinkling of water in conferring it, they are not to be troubled by the Latin Ordinaries of places concerning these matters.
18 III. Although Our predecessor Innocent IV once enjoined upon the Greeks dwelling in the kingdom of Cyprus that in the unctions which are performed around Baptism they should hold and observe the custom of the Roman Church; if however the conferral of the Sacrament of Confirmation, which is prescribed in the Greek Euchologion after Baptism, is to be omitted by Greek priests—
19 Greek priests are not to be troubled concerning the Sacrament of Baptism.
20 In the unctions which are performed around Baptism, their own rite as described in the Euchologion—
21 they are permitted to follow.
22 Albanian priests, if they have wished to observe the rite of anointing the breast and the middle of the back, the ears, feet, and hands as described in the Euchologion, where there is no contrary custom, are not to be hindered.
23 IV. But the rite or custom which the Eastern Greeks are said to have, of anointing throughout the entire bodies of those to be baptized, if it cannot be removed or taken away without scandal, can be tolerated in the same, since whether it be done or not, inasmuch as it does not greatly affect the efficacy or effect of Baptism, it may be tolerated in the same.
24 IV. As for the rite or custom which the Greek Orientals are said to have, of anointing the bodies of those to be baptized throughout their entirety, if it cannot be removed or set aside without scandal, it can be tolerated, since, whether it be done or not, it does not greatly affect the efficacy or effect of baptism, and thus it may be tolerated in the same. V. Nor does it matter whether they baptize with cold or hot water, since in either case baptism is said to have equal power and effect.
25 VI. If in the same church infants of both rites are to be baptized, the Greek pastor confers Baptism upon his subjects with water blessed by himself in the Greek manner; and therefore he is not to be troubled if he does not use the baptismal water which the Latin pastors employ according to the custom of the Roman Church: nevertheless let the Ordinaries take care that there be present baptismal water latinly consecrated, which the Latin priest should absolutely use (except in the case of urgent necessity) whenever it falls to him to receive Latin children for Baptism.
26 VII. Since the administration of the Sacrament of the Eucharist, which the Greeks are accustomed to exhibit to infants in Baptism and to children in Mass under one or under both species, contains nothing contrary to orthodox faith and good morals (provided that the same Greeks firmly believe and hold that such communion is not necessary for salvation, and that Baptism can be validly and licitly administered without communion); yet because it is more fitting for the dignity and reverence of the Sacrament if it be denied to them; therefore we interdict and prohibit that Greeks or Albanians of the Greek rite minister the Sacrament of the Eucharist under one or under both species to infants lacking the use of reason in Baptism, nor to children in Mass.
27 VIII. Infants born of a Greek father and a Greek mother, unless the parents otherwise wish, with the consent of the Ordinary, ought to be baptized in the Greek rite.
28 IX. But those born of a Latin father and a Greek mother are to be baptized with Latin ceremonies; for the offspring ought altogether to follow the rite of the father if he be Latin.
29 X. But if the father be Greek and the mother Latin, it shall be free for the same father, so that the offspring—

Latin Bishops shall confirm infants or others baptized in their dioceses by Greek priests, absolutely, having been signed with Chrism on the forehead; since neither by our predecessors nor by us has faculty been granted or is granted to Greek priests in Italy and the adjacent Islands to confer the sacrament of Confirmation upon baptized infants; indeed, even until the year 1595, by our predecessor of happy memory Clement VIII, it was expressly forbidden to Italo-Greek priests to sign the baptized with Chrism.
35 II. Otherwise, they ought to confirm them under condition and with caution, concerning whom it can be reasonably doubted whether they were baptized by Greek Bishops, observing the order of Baptism according to their euchologium.
36 III. The same is to be said if a Latin Bishop, by apostolic dispensation, shall have ordained some Greek who was baptized by a Greek priest in Italy or the adjacent Islands, and it is not established that he was signed with Chrism on the forehead by any Bishop, whether Latin or Greek: he ought indeed to confirm him absolutely beforehand; but under condition, if it can be reasonably doubted whether he was baptized by a Greek Bishop.
37 Latin Bishops shall confirm infants baptized by Greek priests and absolutely signed with Chrism.
38 Under condition, however, if it can be reasonably doubted that they were baptized by Greek Bishops.
39 The same is to be said concerning ordination, if a Latin Bishop.
40 shall ordain a Greek baptized by a Greek Bishop, concerning whom it is not established that he was signed with Chrism.
41 IUR. PONT. DE P. P. PARS I.
42 Those confirmed by a simple priest are not to be compelled to receive the Sacrament of Confirmation from a Bishop.
43 Where a Greek Catholic Bishop is available, Latin Bishops are not to administer the Sacrament of Confirmation.
44 IV. Although those confirmed by a simple priest are not to be compelled to receive such a Sacrament of Confirmation from a Bishop, if scandals could arise from such compulsion, since the Sacrament of Confirmation does not have such necessity that without it one cannot be saved; nevertheless they are to be admonished by the Ordinaries of places that they are held by the guilt of grave sin if, when they are able to approach Confirmation, they refuse and neglect it.
45 V. Where a Greek Catholic Bishop can be had, as is the case with one constituted in the College of Italo-Greeks in Calabria, let the Latin Ordinaries take care absolutely that the Sacrament of Confirmation be administered to their subjects living according to the Greek rite by that Bishop rather in Greek ceremonies according to the Greek euchologium than by themselves in the Latin rite, with Chrism received from Latin Bishops, lest namely the rites of the Churches be mixed together, insofar as it can be done.
46 Concerning the Holy Oil of Chrism, of Catechumens, and of the Sick. I. Greek priests are not to be compelled to receive the holy oils, apart from Chrism, from Latin diocesan Bishops, since such oils are prepared or blessed by them in the very exhibition of oils and sacraments according to their ancient rite; unless however a contrary custom has been introduced, which we wish to be observed and command. But Chrism, which can be blessed only by a Bishop, even according to their rite, they are to be compelled to receive.
47 II. They are not, however, to dare to receive it from Greek Bishops external schismatics, or those not having communion with the Holy Roman Church, or to use it.
48 III. Likewise let them refrain from receiving Chrism from any other Bishop, Latin or Greek Catholic, except their own Latin Ordinary to whose jurisdiction they are subject. § V.
49 Concerning the Sacraments of Penance and Extreme Unction.
50 I. Let no unction whatsoever be imposed through priests or confessors for the satisfaction of penance.
51 II. But to the sick, according to the word of the Apostle James, let Extreme Unction be administered. Greek priests are not to be compelled to receive, apart from Chrism, other holy oils from a Latin Bishop.
52 Not from a schismatic Bishop.
53 But from their own Latin Ordinary.
54 III. Nor does it matter whether the same Extreme Unction is performed by one or several priests, where such a custom prevails; provided they believe and assert that that sacrament, with the due matter and form preserved, is validly and licitly performed by one priest.
55 IV. The same priest must apply the matter and pronounce the form respectively: and therefore he who anoints should himself say the corresponding form, and not one anoint and another pronounce the form.
56 V. In case of necessity Greek Catholic priests can absolve Latins; let them use, however, the form of absolution prescribed in the General Council of Florence, and afterwards, if they wish, let them say that deprecatory prayer which they have been accustomed to say only for such a form of absolution.
57 VI. Outside the case of necessity, if the Latin Ordinary has judged some of the Albanian priests to be skilled and suitable for hearing the confessions of all, so that they can absolve not only Greeks but also Latins coming to them, this is left to the prudence and discretion of those same Ordinaries.
58 VII. Married priests also and others to whom the care of parishes or the governance of parochial churches is committed by their Bishops can licitly and freely hear the confessions of their parishioners and impose penance upon them for sins; because to whom what is greater is permitted or granted, to him also what is lesser is competent and ought not to be denied.
59 VIII. Let the Latin Ordinaries place in charge of the governance of parochial churches, if they are able to have them, those who in the seminaries of Italo-Greeks erected, one indeed in Palermo, the other however in Calabria in the town of St. Benedict Ullano, or in the College of Greeks in the City, have spent a period of at least three years and applied themselves to literary studies, provided that the other things required for the exercise of the care of souls are not lacking, and that they exhibit letters from the Bishop of the same seminary, the president or respectively the rector, which bear witness to the correct manner of their life and to their progress in Greek and Latin sciences. IX. It is nevertheless free for those same Bishops to assign other suitable coadjutors and cooperators to Greek parish priests, if need be, for hearing confessions and imposing penances and other things which pertain to the salvation of souls, and to commit these to them throughout their dioceses without prejudice and burden to the priests themselves.
60 He who anoints should pronounce the form of the Sacrament.
61 Form of absolution prescribed in the Council of Florence to be used.
62 Outside the case of necessity.
63 is left to the prudence and discretion of the Ordinaries, so that Albanian priests can also receive Latin confessions.
64 and be able to receive the care of parishes and hear the confessions of parishioners.
65 Married priests can both undertake the care of parishes and hear the confessions of parishioners.
66 Those to be placed in charge of the governance of parochial churches are those who in the seminaries of Italo-Greeks or Albanians have spent a period of at least three years.
67 The Ordinaries can.
68 and to attach other suitable priests to the Greek parishes as assistants and cooperators.
69 of monasteries, and to them the observance of the monastic rules is to be required.
70 priests, whether foreign or native, by favor and permission, in Greek parishes may be placed.
71 nor shall a man and woman confess together to the same priest.
72 may be blessed.
73 Suffices to the Sign of Penance; the penitents are to be admonished;
74 and the sacrifice is to be completed.
75 is to be performed.
76 It is permitted in the manner of the fast in the celebration of the Mass.
77 and it is blessed by the assistance of the ecclesiastical law.
78 for the infirm to be renewed.
79 on certain days.
80 Not to be kept the whole year.
81 Secondly, bishops may celebrate their functions by another, since on account of manifold occupations and various occasions it may happen that they cannot execute their office through these same dioceses by themselves.
82 X. The care of souls shall never be committed to Greek monks or caloyers, unless from necessity or some other just cause.
83 XI. Greek secular priests coming from Albania or other parts of the East, having abjured schism and errors, and being well instructed in the Catholic faith, may be appointed to parochial or curate churches of the Greeks.
84 XII. The abuse is to be removed, where it exists, that a man and woman confess together and at the same time to the same priest.
85 XIII. Water blessed according to the Greek rite on the day of the Epiphany or the first day of the month shall be preserved in the church, so that the faithful may be sprinkled with it.
Concerning the Sacrament of the Eucharist and the Sacrifice of the Mass.
86 I. Priests shall frequently approach the sacrament of Penance, so that when they are about to perform the divine mystery, they may be subject to no crime before God, but may have a heart empty of all depravity, clean and pure as far as possible: for it is unworthy and utterly abhorrent to the ears that one who has a soul stained by some crime should handle the Holy of Holies with impure hands, and attempt to placate God while existing in sins, thereby provoking the anger and wrath of God Himself.
87 II. Likewise it is permitted to them, after the consecration has been made before the priest communicates, according to the rite prescribed in the liturgy, to pour hot or warm water into the sacred chalice.
88 III. The abuse of pounding, or even mixing with sacred oil, and again cooking or otherwise drying the species of the sacrament of the sacred Eucharist on the Friday of the Lord's Supper, so that they may preserve it afterwards, is to be removed.
89 IV. The most holy sacrament of the Eucharist, which is reserved for the sick, shall be renewed every eight days or at least every fifteen days.
90 V. The same sacrament shall not be reserved throughout the whole year: if, however, it has been reserved, it shall be consumed at the end of the year.
91 VI. In the celebration of solemn feasts and other Masses, and concerning the hour of celebrating them, provided that in the confection or consecration they observe the form of words expressed and handed down by the Lord, and in celebrating do not transgress the ninth hour, they are permitted to follow their own custom: yet so that the law of fasting concerning a single meal in the day be religiously observed; and if anywhere the custom of prolonging the fast with the Mass until Vespers prevails, it shall in no way be abolished, but shall remain in its strength and firmness.
92 VII. If among the Greeks who dwell in Italy and the adjacent islands there prevails an abuse, which they say prevails in the Eastern regions, that monks carry a particle of the Eucharist suspended at the neck or otherwise with them, and likewise retain it in private houses where they happen to dwell, so that relying on this aid they may be free from any dangers, or when they commit themselves to longer journeys, may be refreshed, we wish it to be entirely abolished and expressly command it: and we most severely prohibit the aforesaid monks from daring to do this in the future. For the obedience and reverence with which each of the faithful ought to honor this most august sacrament does not permit that it be retained privately and secretly at the will and pleasure of anyone at home, or be carried in journeys and pilgrimages.
93 VIII. Since in the parochial churches of the Greeks themselves, according to the most ancient and hitherto observed rite, it is permitted to celebrate only once in the day by one priest, it is indeed permitted to Greek priests to observe their own custom in this matter if they wish: but it is forbidden to Latin priests to celebrate Masses and other divine offices in the said churches of the Greeks and upon their greater altars outside the case of some necessity and the lack of other altars and churches, and unless with the consent of the Greek pastor, whom in no way in such cases can they refuse.
94 IX. Since, however, the Greeks and Albanians themselves have humbly besought us that it be permitted to them to celebrate several Masses in a day in their churches on account of the number of priests; we, wishing to accede to their prayers, by these presents grant and indulge that in their parochial or other churches, besides the greater altar, they may also erect other smaller altars or chapels adorned with sacred vestments according to the manner of the Greeks or Latins, in which Latin or Greek priests respectively may each celebrate according to their own rite.
95 celebration of Mass under certain conditions.
96 That monks traveling do not carry the Eucharist.
97 It is permitted to Greek priests to observe their own rite of celebrating once in the day upon one and the same altar; and Latin priests are forbidden in parochial
98 their churches and to celebrate divine Mass.
99 It is granted to Greek and Albanian presbyters that in their churches, besides the high altar, other altars may also be erected, in which the Greeks themselves or Latins may celebrate Mass.
IUR. PONT. DE P. F. PARS I.
100 Greeks are prohibited from celebrating in the Latin rite and Latins in the Greek rite.
101 He prohibits that Latin parish priests retain the pyx in the ciborium with particles under the species of fermented bread for the communion of Greeks, or that Greek parish priests retain their species of unleavened bread for the communion of Latins.
102 He commands Latin laity that they never under the species etc.
103 He permits Greek laity that where they do not have their own parish, they may communicate etc.
104 Let the Ordinaries of places take care to correct the contrary custom etc.
105 X. Since in the sacred general Council of Florence it was prescribed that each priest should confect the Eucharist according to the rite of his own Church, whether Latin or Greek, in unleavened or fermented bread, and it was forbidden by our predecessors, the supreme Roman Pontiffs, that a Latin priest use the Greek rite, or a Greek the Latin; we more strictly forbid, even under the penalties of perpetual suspension from the divine offices, that Greek presbyters in the Latin manner, and Latin presbyters in the Greek rite, under any pretext whatsoever of licenses and faculties for celebrating Masses and other divine Offices, Greeks in the Latin manner, and Latins in the Greek rite, obtained from the Apostolic See, or its legates and also from the Major Penitentiary existing at the time, presume to celebrate or cause to be celebrated Masses and other divine offices.
106 XI. For the same reason, both where there are two parishes, one Latin and the other Greek, and in one and the same parochial Church of Latins or even of Greeks, in which, as is aforesaid, besides the high altar, which is erected for Greek priests alone, smaller altars also constructed for the use of Latin priests are seen, we establish and decree that neither the Latin parish priest retain the pyx in the ciborium with particles under the species of fermented bread for the communion of Greeks, nor the Greek parish priest under the species of unleavened bread for the communion of Latins, in any altar of his church; but each priest ought to offer the Eucharist to the faithful only in his own rite, whether Greek or Latin.
107 XII. Lest Latin laity receive communion from Greek presbyters under the species of fermented bread, we altogether prohibit and forbid.
108 XIII. We permit Greek laity, however, that where they do not have a Greek parish, they may, if they wish, receive the Eucharist under the species of unleavened bread from Latin priests in a Latin church.
109 XIV. But if in places in which Greeks and Latins dwell together, and there are churches of both rites, Latins indeed in fermented and Greeks in unleavened bread are accustomed sometimes to receive the sacred Eucharist; if indeed this custom cannot be removed without offense to the people and disturbance of minds, let the Ordinaries apply their care in the most gentle manner, so that Latins always communicate in unleavened bread, and Greeks, where they have their own parish, in fermented bread.
110 XV. But so that the same Greek laity may be refreshed by communion in the Eucharist under both species, we permit in those places only in which such a rite has been introduced, and is preserved and observed to the present day: yet so that under the other species they firmly believe that the whole and entire Christ and the true sacrament are received, and therefore, as far as the fruit is concerned, they are defrauded of no grace necessary for salvation, those who receive one species alone: but where the aforesaid rite hitherto received by custom does not exist, it shall be the care of the Bishops, under whose jurisdiction the Greeks are subject, that it be not admitted in the future.
111 XVI. Wishing, however, to show special favor to the Greeks and Albanians themselves and their presbyters, by the tenor of these presents, so that at the time of the Lenten fast, when, except on Sundays, Saturdays and certain more solemn feasts, only the Mass of the Presanctified is celebrated according to ancient custom, the Greeks and Albanians aforesaid, observing nevertheless and not omitting the rite of the Presanctified in parochial churches, may and are able to celebrate in other altars or churches or chapels for their own and the devotion of the faithful peoples complete Masses on any days of the week, and especially when feasts of precept of the Latin Church occur, which they are bound to observe, excepting the last three days of Holy Week, we grant and indulge.
112 XVII. If Greeks wish to receive portable altars consecrated by Latin Bishops, it will be well; if not, let their antimensions or thrones be tolerated to be placed upon stone altars when they celebrate.
113 XVIII. Corporals, as Latins have them, unless they also use thrones for corporals. XIX. It is not lawful for Latin presbyters celebrating in the Latin rite in the churches of Greek Catholics, if they lack their own portable stone altar, to perform the sacred rites upon the antimensions or thrones of the Greeks.
114 XX. Let each priest sacrifice only in a golden or silver chalice, or at least a tin one, having thrones or a corporale of white and bright linen, and an altar covered with clean vestments or adorned with decent ornament.
115 XXI. Women, however, ought not dare to serve at the altar, but are to be entirely repelled from its ministry.
116 Communion under both species is permitted, etc.
117 Indulgence is granted to Greek or Albanian presbyters, etc.
118 Greeks may, if they wish, receive altars from the Latins.
119 Greeks may use thrones for corporals.
120 It is not permitted for a Latin presbyter to celebrate upon a Greek antimension, etc.
121 Concerning vestments and other sacred things.
122 Concerning the service of women at the altar.

§ VII.
Concerning the Sacrament of Orders.
125 I. Our predecessors, the Roman Pontiffs, wishing to meet the needs of the Italo-Greeks, so that they might conveniently be promoted to orders by the Prelates of their own rite, and at the same time taking care lest, if they were sent by Latin Ordinaries to Greek Bishops in Greece or Epirus or other parts of the East with dimissorial letters, they should have recourse to schismatic Bishops for ordination, decreed that Clement VIII in the year 1596 a Greek Catholic Bishop should reside in Rome, who would initiate Greeks subject to Latin Bishops in Italy and the adjacent Islands into sacred orders; and Clement XII in 1735, in order to consult the welfare of the Italo-Greeks dwelling in both Sicilies, ordered that another Bishop of the same Greek rite should remain in the Seminary of Corsino erected by him in Calabria for the ordinations of Greeks of this kind, whose most praiseworthy institution we also confirm and renew by these our letters, perpetually valid.
126 II. No cleric of the secular Greek rite, however otherwise fit in morals, knowledge, and age, shall be promoted to sacred orders unless it first legitimately appears that he peacefully possesses an ecclesiastical benefice or patrimony sufficient for him to live honorably; and therefore, if a title of benefice is lacking, he must make his Ordinary certain by legitimate documents of sufficient patrimony, so that he may be initiated into sacred orders: in place of said patrimony, neither shall a cleric presume to assign the dowry of his wife, nor shall an Ordinary dare to receive it.
127 III. Likewise, no one from among the Greeks or Albanians dwelling in Calabria and Sicily shall be assumed for sacred ministries who has not devoted himself for a space of at least three years to Greek and Latin letters in one of the Seminaries of the Italo-Greeks, or in the College of Greeks in the City.
128 IV. Those to be promoted to the priesthood and presbyters who are to be placed in charge of the governance of churches shall first be examined diligently, especially whether they are sufficiently instructed concerning the canonical hours and the offices of Masses to be performed according to the distinction of seasons, so that only the worthy may be admitted to these.
129 V. Priests and all those constituted in sacred orders shall recite the canonical hours according to their own custom; and before they celebrate Mass, they shall take care to recite the office of Matins.
130 VI. Greek Bishops in conferring orders shall observe the proper Greek rite as described in the euchologion, in which, although some of the minor orders appear to be omitted, the Greeks themselves affirm that they either never had them, or that their exercise is annexed to other orders.
131 VII. Yet doubts sometimes arise as to which orders, namely, ought to be supplied by one who was first initiated into certain orders by the Greek rite, and then is to be promoted to the rest by the Latin rite. In order that we may completely remove these controversies and hand down a certain rule to be observed in the future, we thus decree. If anyone was initiated as a cleric and reader only by the Greek rite, and by the benignity of the Apostolic See obtained that the greater orders be conferred upon him with Latin ceremonies, he, before he is ordained a subdeacon, must receive the three minor orders omitted by the Latin rite. But if, besides the order of reader, he also ascended to the subdiaconate by the Greek rite, and by apostolic dispensation likewise the faculty was granted to him of receiving the remaining orders by the Latin rite, before he is enrolled among the Deacons, he is obliged to supply only the order of exorcist from the minor orders, since by the subdiaconate conferred by the Greek rite he is considered to have received the acolythate and ostiariat. The same is to be said of one who, together with the other inferior orders, received the diaconate or even the presbyterate in the Greek manner, and is afterwards to be promoted by the Latin rite to the sacred order of presbyter respectively or to the Episcopate by apostolic concession; namely, the order of exorcist is to be supplied in him before he is ordained a priest or consecrated a Bishop.
132 VIII. Greeks without a dimissorial letter of the Latin diocesan Bishop shall in no way be admitted to receive the first tonsure or any order.
133 IX. Those promoted to the first tonsure or to any other order without dimissorial letters of the Latin Ordinary are suspended; and if, while suspended, they minister in sacred orders, they become irregular just as Latins do.
134 X. Concerning such and similar irregularities, the faculty of dispensing must be obtained from the Holy Apostolic See.
135 XI. Schismatic Bishops are not to be admitted either for conferring orders or for administering other sacraments, but are to be prevented; Greek Bishops in conferring orders are to use the Greek euchologion.
136 Certain orders received according to the Greek rite are to be supplied by one who has received some orders according to the Latin rite.
137 They are not to be ordained unless with dimissorial letters from a Latin Ordinary.
138 Concerning suspension and irregularity.
139 The Pope alone dispenses in irregularities.
140 Schismatic Bishops are neither to confer orders nor other sacraments.
141 Concerning Greek Catholic Bishops.
142 Concerning those ordained by schismatics.
143 Concerning their absolution and dispensation over irregularity.
144 The law concerning interstitia is relaxed with the Greeks or Albanians. On three feast days, not however continuous, if they come from distant regions to receive orders, they may be ordained, provided that the Apostolic See is consulted thereupon and a response is obtained.
145 XII. Those whom it shall be established to have communion with the Holy Roman Church, the Latin Ordinaries in their dioceses may freely grant them the faculty of exercising pontifical functions.
146 XIII. Those ordained by schismatic Bishops, otherwise duly ordained with the proper form observed, do indeed receive the order, but not its execution.
147 XIV. Therefore those same ordained by schismatic Bishops, corrected or amended, are to be reconciled and absolved with salutary penances, provided that they abjure the errors, if any they have embraced, or otherwise the schism of their ordainer in judgment, either publicly or secretly according to the nature of the case.
148 XV. In the orders, however, otherwise duly received by them, they are not to be permitted to minister unless dispensation shall have been granted to them by the authority of the Apostolic See over the irregularity contracted on this occasion.
149 XVI. Since from the discipline of the Church once received by the Greeks, those promoted to some sacred order, if they have not been engaged in it for some interval of time, cannot ascend to a higher grade, by which indeed the faith and probity of morals of those to be ordained may be known over that space of time; by which law the Greeks or Albanians dwelling in Italy and adjacent islands are undoubtedly bound; nevertheless, since the aforesaid Greeks or Albanians have their own Ordinaries, who are Latin, by whom as of an alien rite they are prohibited from being initiated into sacred orders, and therefore, since they would have to betake themselves repeatedly to Rome, or to Calabria, where Bishops appointed by the Apostolic See to exercise ordinations according to the Greek rite are stationed, not without very many inconveniences and expenses, to receive sacred orders according to the intervals of time; we, wishing to treat the same Greeks or Albanians with grace and favor, and to provide for their inconveniences, from the fullness of apostolic power, grant license and faculty to the aforesaid Greek Bishops dwelling in Rome and in Calabria for the time being, that they may henceforth be able to promote these Greeks or Albanians coming from distant regions, who desire to be initiated into minor or major orders, to all orders on three feast days, not however continuous, but separated by some interval of time at the discretion of the ordaining Prelate, without observing the law of interstitia, nor requiring from those being initiated the license or dispensation of their respective Latin Ordinaries.
150 XVII. But as for those Greeks or Albanians who have domicile or otherwise dwell in that province in which a Bishop of the Greek rite is accustomed to exercise sacred ordinations, to whom therefore they can approach without grave inconvenience through intervals of time, we do not dispense them from the law of interstitia, except with the students and residents of the Greek rite of the Greek College of the City and of the Italo-Albanians in Calabria and Sicily, if the necessity or utility of the same Colleges, at the discretion of the Cardinal administrator and protector of the aforesaid Greek College of the City, and of the Bishop presiding over or rector of each of the aforesaid Italo-Albanian Colleges respectively existing for the time being, shall have required that the aforesaid students and residents be promoted to orders without an interval of time on three feast days, not however continuous, as aforesaid; in which case we make and grant them full faculty to be thus initiated.
151 XVIII. To those, however, who have hitherto been ordained in good faith without observing the law of interstitia, we also grant from apostolic benignity that they may minister in the orders received and ascend to higher orders as well, with the observances being observed, without any other dispensation.
152 XIX. What, however, concerning the age of those to be ordained was prescribed by the most sacred Council of Trent, we will to be altogether observed. Let no one therefore of the aforesaid Greeks or Albanians be promoted to the order of subdeacon before the twenty-second year, to the order of deacon before the twenty-third year, to the order of presbyter before the twenty-fifth year of his age without apostolic dispensation. We burden the conscience of the aforesaid Greek Prelates, that they assume to sacred ministries only the worthy, and those whom they know to be well instructed in letters and in those things which pertain to the exercise of orders.
153 XX. In order that in the conferring of orders any confusion and mixing of rites may be entirely removed, and that a bishop of one rite may in no way be able to initiate clerics of another rite henceforth; we prohibit under the penalty of perpetual suspension from the divine offices, that no Latin bishop whatsoever, even Greeks subject to his jurisdiction, nor any Greek bishop whatsoever Latins on any pretext, without hope— However, dispensation is not granted to those who have domicile or reside in that province in which a bishop of the Greek rite is accustomed to exercise sacred ordinations. Alumni and boarders, etc.
154 With those who have not observed the interstitial law, dispensation is granted, since they have hitherto been ordained in good faith, etc.
155 Regarding the age of those to be ordained, what has been prescribed by the sacred Council of Trent is to be observed.
156 A Latin bishop is prohibited from initiating even Greeks subject to him into orders, etc.
157 He prohibits Latins professed and educated in the Latin rite from being initiated, etc.
158 Under hope of retaining wives, if they are promoted to sacred orders, etc.
159 Dispensation is granted to Italo-Greeks regarding this; a Latin bishop is obliged to them, with this however reserved, that permission is granted to remain in that rite, and also to another, etc.
160 An Italo-Greek, if dispensed by a Latin bishop, to those orders according to the Greek rite prescribed by the Apostolic See, etc.
161 may be promoted, they are able without other, etc.
162 cial license of the Apostolic See, to first tonsure, or any order whether minor or major presume to promote; otherwise both the one ordaining and the one ordained are to understand that they will incur perpetual suspension, as aforesaid.
163 XXI. Most certainly neither is it to be permitted nor in any way to be tolerated, that Latins born of Latins and educated in the Latin rite, who are unwilling to profess continence, according to the Greek rite in hope of retaining wives, be promoted to sacred orders by any bishop whatsoever with any authority shining forth, both in places in which there are not peoples living in the Greek rite but Latins, and in places in which there are peoples who from the Greeks of old were descended or derive their origin from the Greeks, or otherwise in times past have observed the Greek rite, or among them or in some of their Churches such a rite has been observed from antiquity until now. XXII. However, with those Italo-Greeks who to this day either on account of ancient custom, or on account of certain privileges, as they say, granted to them by our Roman Pontiff predecessors, by which it was permitted to Latin bishops to ordain Greeks subject to them or to have them ordained by other bishops both Greek and Latin, have been promoted by Latin bishops in good faith and without apostolic dispensation to clerical tonsure, or to minor or major orders, with the intention nevertheless of retaining their own Greek rite, and without actual exercise of the Latin rite in the orders received; by these our present letters on this occasion only do we dispense, so that it may be lawful for them to remain in their Greek rite, and in it to be promoted to further orders (provided they have been approved by their own Ordinary) by a Greek bishop: by these same our letters expressly prohibiting, that nothing of this kind be attempted henceforth either by the Greeks themselves or by Latin bishops, without consultation with the Holy See.
164 XXIII. Moreover, in order that we may opportunely in every way meet the controversies and doubts concerning the aforesaid ordinations of such Italo-Greeks by Latin Prelates, by this our Constitution we decree and declare, that if a Latin bishop, whether Ordinary, confer first tonsure or minor orders on Italo-Greeks according to the Latin rite with apostolic dispensation, so that those ordained by him ought to minister in their Greek rite (which is customarily granted by the Apostolic See on account of the lack of Greek Prelates), the same Latin Ordinary may lawfully grant dimissorial letters to such Italo-Greeks ordained by him or by another Latin Prelate, as aforesaid, so that they may be promoted to sacred orders according to the Greek rite without other apostolic dispensation.
165 XXIV. But if such Italo-Greeks should be promoted by a Latin bishop to any orders according to the Latin rite without apostolic dispensation (which would be illicit both for the one ordaining and for those ordained, as being contrary to this our constitution), such Greek clerics are so bound to the Latin rite, that it is no longer lawful for them to return to the Greek without apostolic dispensation, nor is it any longer permitted to the Latin bishop or Ordinary to remit a Greek cleric, constituted by him as aforesaid in minor orders according to the Latin rite, with dimissorial letters to a Greek bishop, so that he may be promoted by him to sacred orders according to the Greek rite, without apostolic dispensation; but he ought rather, if indeed he shall have judged him suitable, after obtaining absolution from suspension, either himself to ordain him according to the Latin rite, or to have him ordained by another Latin Prelate. For from the Latin rite to the Greek, as we have aforesaid, it is lawful neither to pass nor to return without apostolic dispensation.
166 XXV. Hence those same dimissorial letters are to be denied with greater right to Italo-Greeks, who, although baptized according to the Greek rite, have not only received the first tonsure and minor orders according to the Latin rite but also lived in the Latin manner, and afterwards desire to be advanced to major orders according to the Greek rite; for the Latin rite once assumed, as we have said above, cannot be abandoned without the special authority of the Apostolic See. In order therefore that Italo-Greeks of this kind return to the Greek rite, they have need of apostolic dispensation; but in order that they ascend to major orders according to the Latin rite, they have no need of dispensation.
167 XXVI. Although it would be most desirable that Greeks who are constituted in sacred orders should observe chastity no less than Latins; nevertheless, in order that their clerics, subdeacons, deacons, and presbyters may retain wives in their ministry, provided they have not taken virgins who are neither widows nor corrupted before sacred orders, the Roman Church does not prohibit. But those who have taken a widow or a corrupted woman, or who have contracted second vows after the death of the first wife, we absolutely prohibit from being advanced to the subdiaconate, diaconate, and presbyterate.
168 Otherwise, if they have been ordained without apostolic dispensation by a Latin bishop, they must remain in the Latin rite and cannot afterwards return to the Greek rite or minister in it without apostolic dispensation. Especially if after receiving orders from a Latin bishop they have lived in the Latin manner: for the Latin rite once assumed, etc. The marriage of a presbyter with a single and virgin woman is not disapproved.
169 After the subdiaconate, diaconate, and presbyterate, contracted, is declared null. Concerning a married Greek presbyter. The decree of the Council of Trent concerning matrimony is to be observed. Marriages cannot be dissolved. Concerning second and further marriages. Concerning bigamists. Concerning degrees of consanguinity and affinity.
170 XXVII. Furthermore, if any subdeacon, deacon, or presbyter, after sacred ordination, having lost his wife, shall have taken another, or if he did not have a wife, shall have presumed to take one, not only shall he be most severely punished with the penalty of excommunication latae sententiae and other punishments to be inflicted at the discretion of ourselves and our successors the Roman Pontiffs; but he shall also immediately be deposed from his order and separated from his illegitimate wife. For we declare null and void any marriage contracted after the aforesaid orders.
171 XXVIII. A married Greek presbyter, before he proceeds to celebrate the sacred sacrifice or holy Mass, shall take care to abstain from his wife either for a week or for three days.
§ VIII.
172 Concerning the Sacrament of Matrimony. Let the Ordinaries of places take care that the decree of the sacred general Council of Trent concerning the reform of Matrimony be turned into the common Greek language, and in the places and parishes of Greeks and Albanians, whenever it shall seem expedient, be published and made known.
173 II. Let them in no way permit or suffer marriages between Greek spouses to be dissolved, or divorces as to the bond to take place. And if any have in fact taken place, let them declare them null and void.
174 III. Because indeed according to the Apostle a woman, her husband being dead, is loosed from the law of her husband, and has free faculty to marry whom she will in the Lord, let not Greeks condemn second, and third, and further marriages, but let them approve them as legitimate and valid between persons who can otherwise lawfully be joined to each other in matrimony by right.
175 IV. Those contracting second marriages, however, presbyters shall in no way bless: nor is it lawful for these bigamists to be advanced to sacred orders without special apostolic dispensation.
176 V. And because among Greeks it has been customary to contract marriages between persons related to each other, according to their reckoning, in the eighth degree, which according to the reckoning and distinction of degrees which Latins make, is reckoned as the fourth degree among them; lest this be presumed henceforth, we firmly prohibit it; and we strictly command that, since marriages can lawfully be contracted in further degrees, they shall not presume to be joined in the aforesaid fourth degree of consanguinity or affinity; observing the statute of the general Council as to this.
177 VI. Likewise in spiritual relationship, which is contracted through Baptism and Confirmation, let that be observed in the degrees which was defined in the Tridentine Synod. Namely in Baptism between the sponsor and the baptized and his father and mother, and also between the one baptizing and the baptized and the baptized's father and mother only, relationship is contracted; and that which arises from Confirmation, between the one confirming and the confirmed and his father and mother, and the one holding, does not go beyond; all impediments to marriage of this other spiritual relationship being removed among all other persons.
178 VII. A Latin husband shall not follow the rite of his Greek wife. Concerning the Yoke.
179 VIII. A Latin wife shall not follow the rite of her Greek husband.
180 IX. A Greek husband can, if he wishes, follow the rite of his Latin wife: likewise a Greek wife can, if she wishes, follow the rite of her Latin husband, after whose death she cannot return to the Greek rite.
181 X. But if they do not wish to, let each of the spouses be permitted to remain in his or her own rite, provided it be Catholic.
182 XI. A marriage between a Latin husband and a Greek woman shall be contracted in Latin before a Latin pastor: but between a Greek husband and a Latin woman it may be contracted either in Greek before a Greek pastor, with two or three witnesses present, or in Latin before a Latin pastor wherever the Greek husband shall wish.
183 XII. The pastor of that place and rite ought to assist where and according to which rite the marriage is contracted.
In what manner the Greek rite is to be observed in Italy and adjacent Islands: concerning the subjection of the Greeks or Albanians to the jurisdiction of Latin bishops.
184 I. Since the rite of the Oriental Church, although Greek in character and derived in no small part from the holy Fathers and the traditions of the ancients, has been established among the Greeks and others in such a way that they are able to observe it in their souls, and since our predecessors, the Roman Pontiffs, have judged it more fitting and prudent to approve or permit such rites, insofar as they are not contrary to the Catholic faith nor generate danger to souls nor derogate from ecclesiastical propriety, rather than to reduce them to the norm of Roman ceremonies; therefore we grant and indulge to the Greeks themselves and Albanians of the Greek rite dwelling among Latins, both to prelates, pastors and secular priests, and to regulars and laity, that they may freely and lawfully use their rites and observances or customs, and observe them, and celebrate Masses and other divine offices according to their ancient custom. Nor do we permit any Latin Ordinary to molest or disturb them or any one of them on these matters: forbidding all and singular prelates and others, lest anyone dare to blaspheme or disapprove or condemn the rites and ceremonies of the Greeks approved in the Council of Florence or otherwise.
185 II. We declare that permission and indulgence to remain in their rites has been granted to the said Greeks and Albanians in such a way that those things which are to be observed by the faithful in the diocese where they dwell, universally and without any discrimination of persons and rites, according to the sacred canons, to these same things also they are bound to be subject, notwithstanding the diversity of rites.
186 III. Such things are chiefly the observance of the Gregorian calendar, according to which the same Greeks and Albanians are bound to celebrate the universal fasts and feasts of the Church, such as, for example, the Lenten fast, Easter, the Ascension of the Lord, Pentecost, the Nativity of the Lord, the Circumcision, the Epiphany, and other things of this kind, which are celebrated equally in the Latin and Greek Church.
187 IV. Then the commemoration of the supreme Roman Pontiff and the Ordinary of the place in Masses and divine offices, not of the Patriarchs or Oriental Prelates, who have no jurisdiction in Italy and adjacent Islands: but where a Greek Catholic Prelate is permitted to exercise pontifical functions by license of the Apostolic See or the Ordinary of the place, his name also may be commemorated according to the custom of the Greeks after the supreme Roman Pontiff and the Ordinary of the place.
188 V. Then subjection to all and singular constitutions of the Roman Pontiffs, issued especially against those who solicit in confession, which extend their force universally to individual nations, and comprehend Greeks equally with Latins in their scope.
189 VI. Finally, they are bound to observe the feast days of precept of the Latin Church where they dwell.
190 VII. As to the observance of the fasts and vigils of the same Latin Church, it would be most excellent if the whole community of Greeks in that place or the greater part of the laity joined with the pastors and priests could be induced to it; and we leave this to the discretion of the Latin Ordinaries without other dispensation from the Apostolic See: nevertheless they ought not to be compelled to it, if they wish to follow their own rite in fasts, since they are accustomed, as is asserted, to fast on every Wednesday and Friday of the week; nor is it permitted to private persons, where they have a Greek parish, to observe fasts and vigils there contrary to their own rite in the manner of Latins; but all ought to fast either in Greek with the Greeks or in Latin with the Latins. But where they do not have their own parish, they may freely and lawfully conform themselves to the Latin rite in all things, whether they be laity or Priests, except the Greek rite, which is to be observed by priests in Masses and divine offices.
191 VIII. Hence where they have a Greek parish, the eating of meat on Saturday among the Greeks is to be tolerated, if it can be done without scandal; but in their places and among themselves only.
192 IX. The Greeks are forbidden, however, to set forbidden foods before their Latin servants, either on Saturday when the aforesaid Greeks are permitted to eat meat, or at any other time when Latins ought to abstain from them; for Latin servants of Greeks are bound to observe the Latin rite.
193 X. Likewise it is to be tolerated that they are not bound to fast on the same Saturday in Lent, except one Holy Saturday, according to ancient tradition, but only to abstinence.
194 XI. Also in fasts of two or three days, or otherwise enjoined by the Diocesans, or in jubilees by the supreme Roman Pontiff, Saturday included or prescribed in them may be commuted to another day for the Greek people by the Diocesans themselves by apostolic authority.
195 XII. But because the beloved sons of the Greek rite dwelling in Corsica have recently humbly presented petitions to us, that we declare by apostolic authority that they are not bound to abstinence from fish having blood, oil and wine, both in Lent and on Wednesdays and Fridays, and in other annual fasts; or, if they are bound to such abstinence both by precept and by the custom of the Greek Church, as is set forth to us, they may, if they wish, observe the fasts and vigils of the Latin Church, yet they ought not to be compelled to do so.
196 Meat to be tolerated, etc.
197 Latin servants of the Greeks ought to observe the Latin rite.
198 They are not to be compelled to fast.
199 on Saturday, etc.
200 Fast from the Latin on Saturday.
201 prescribed for another day for Italo-Greeks, etc.
202 Italo-Greeks throughout Italy and adjacent islands are permitted, in Lent and their other fasts, to use fish,
203 oil and wine.
204 IUR. PONT. DE P. P. PARS I.
205 Italo-Greeks ordained in the Latin manner by a Latin diocesan Bishop are not to be placed over Italo-Greek peoples.
206 But Greeks or Albanians, yet Catholic, whether foreigners or natives, living in the Greek rite, are to be placed over them.
207 tur, we deign to dispense with them by the same authority, so that they might be permitted to eat fish, oil and wine on the said Wednesdays and Fridays, and in Lent and other fasts occurring throughout the year; we, mindful of paternal pontifical charity, which knows how to bear the infirmities of the weak, to the said Greeks dwelling in Corsica, and to all and singular Albanians and Greeks who dwell in Italy and adjacent islands, by the tenor of these presents, so that in the manner of the Latins in whose dioceses they dwell, in the aforesaid Lent, Wednesdays and Fridays, and other annual fasts, they may use wine, oil and fish of any kind, we grant and indulge. And we confirm and strengthen by this our constitution the letters of Pope Clement XII, our predecessor, given in the form of a Brief to the abbot and monks of the monastery of the Order of St. Basil the Great of the Greek Oriental rite in the territory of Half-Palermo of the diocese of Palermo, for the Greek and Epirote monks of the same Order and rite founded, in which he granted that they might freely and lawfully eat fish having blood in certain fasts of the year, notwithstanding the ordinances of the Greek rite.
208 XIII. Since it has always been the care of the Apostolic See to preserve the Greek rite, and has never intended or had in mind its abolition; hence we, following the example of our predecessors, as much as God granting permits, intent upon the preservation of Greek rites, neither judge it expedient, nor do we grant the faculty, that Latin Ordinaries according to the Latin rite promote to the Priesthood any Italo-Greek diocesan who has been baptized in the manner of the Greeks and has also lived thus, so that he might preside over the Greek people ministering in the Latin rite: especially because this brings no utility to the Greek peoples, to whom a pastor is usually more acceptable if he observes the same Greek rite with them than if he follows the Latin.
209 XIV. But in the lands or places and villages of Greeks and Albanians, or in which there are Greeks or Albanians, whether they be natives or have come from the provinces and islands of Greece, or from the parts of Epirus and Albania, or have come from elsewhere from any quarter, living in the Greek rite at present, for the care of their churches or the exercise of the care of souls, not Latins nor those born of Latin parents or living in the Latin manner are to be promoted to the same Greek rite, but Greeks or Albanians of the Greek rite respectively, yet Catholic and otherwise suitable and sufficient, and having the other qualities which the sacred canons require, whether they be natives or, in the absence of natives, also foreigners, are to be ordained and placed over the care of souls of the same Greeks or Albanians.
210 XV. Moreover, to remove all mixture and confusion of rites, Latin priests and clerics in the churches of the Greeks are neither to celebrate Masses, nor to attend or involve themselves in funerals, marriages, baptisms and other public and private acts of the Greeks, unless they are specially called to these by the Greeks themselves, nor dare nor presume to do so.
211 XVI. Nor are Greek priests and clerics in the churches of the Latins, without consulting the Bishop to whom they are subject, or his vicar general in spiritual matters, to celebrate Masses and other divine offices with solemnities and chant. But so that the aforesaid Bishop or vicar general may be able to grant the aforesaid permission rightly, no precise necessity is required as a cause, but it suffices that some spiritual utility be hoped for from it.
212 XVII. Since disputes and controversies sometimes arise between Latin and Greek clergy in processions, seatings, and other ecclesiastical solemnities, which they are accustomed to perform by custom or by their own judgment and will in mixed fashion, by which charity and mutual harmony of minds is violated, on account of the order of precedence, because the Greeks refuse to give the principal place to the Latins, and the Latins to the Greeks, wishing to settle and eliminate these disputes henceforth, we decree that in such precedences, unless custom otherwise obtains, the diversity of Greek and Latin rite shall not be considered, but rather the time of ordination of the aforesaid clergy, or the quality of ecclesiastical dignity, if any of them be found adorned with it, or other qualities, which by their own right are accustomed to claim the principal place for themselves in the aforesaid solemnities.
213 XVIII. Because certain errors have crept into the ecclesiastical books of the Greeks, by which the orthodox grieve that the pristine purity of the Greek Church has been corrupted by the fraud and deceit chiefly of schismatics; therefore we stir up by these our letters the pastoral vigilance of the Latin Ordinaries, in whose dioceses these same Greeks and Albanians dwell, that with all effort and care they ensure that Latin presbyters do not meddle in Greek functions except when called. Greek presbyters and clergy shall not celebrate Masses and divine offices in Latin churches without consulting the Bishop. In the precedences of Latin and Greek clergy the diversity of rite shall not be considered, but the time of ordination or the quality of ecclesiastical dignity. They shall use only ecclesiastical books corrected by the Congregation appointed by the Holy See for their emendation. Both secular and regular clergy shall use ecclesiastical books in the administration of sacraments and in celebrating Masses and divine offices only those which have been corrected by the Congregation appointed by the Apostolic Holy See for the emendation of such books and printed by the press.
214 XIX. We permit the Greeks or Albanians, namely bishops in their rite, as is aforesaid, to remain, and to preserve those ceremonies in their diocese, so that they be considered subject to the jurisdiction of the Latin Bishops, in whose diocese they dwell. Therefore Greeks or Albanians of the Greek rite, both ecclesiastical and regular as well as lay, dwelling in either Sicily or other parts of Italy and adjacent islands, since they do not have their own Greek Ordinaries, notwithstanding any exemptions whatsoever and other privileges granted to the said Greeks and their prelates, rectors, abbots, and others, both of St. Basil and of another Order of regulars, who lead a private life and are not reduced into a congregation, as well as to secular and lay persons by whatever name they are called, heretofore conceded by the blessed memory of Leo X, Paul III, Julius III also, and perhaps other Roman Pontiffs and the Apostolic See in general or in particular, and also approved and renewed at repeated times, must thus be subject to the Latin Ordinaries of the places where they dwell, so that the Ordinaries of those places may visit whatever churches, monasteries, priories, and other pious places of the same Greeks and Albanians, both secular and of any Order regular, and their prelates, even if they shine with episcopal, archiepiscopal, and greater dignity, as well as abbots, rectors, ministers, and any other persons of the same nation residing in their cities and dioceses, whenever it shall be necessary, and in those places may freely and lawfully exercise and follow their ordinary jurisdiction and full and complete authority in those matters which concern the worship of God, the administration of sacraments, and the salvation of souls and the extirpation of heresies; the remaining divine celebrations of the same Greeks and Albanians and other rites approved by the Apostolic See, as well as apostolic privileges and graces remaining intact: nor shall the said exemptions or privileges avail in any way to the Greeks and Albanians, whether clergy or lay, or their prelates, churches, convents, or other pious places; but all of them, each and every one, shall be subject to the visitation, correction, punishment, jurisdiction, and complete authority of the Ordinaries of the places in which they have taken up residence in the aforesaid matters, and shall humbly obey them as their superiors and the pastors of their souls.
215 XX. But where there were two Bishops of the same place appointed by the Holy Apostolic See, one Latin, the other Greek, (as is reported to have formerly existed in parts of Calabria and in Sicily, and now exist in certain islands of Greece) the Latin Bishop shall in no way presume to involve himself in matters concerning Greek ecclesiastical and secular persons, and in the jurisdiction of the Greek Bishop or in any other matters whatsoever pertaining in any way to the Greek Bishop; but let the Latin Bishop have care, governance and jurisdiction over the Latins, and the Greek Bishop over the Greeks respectively, and let them exercise these. We declare that this is in no way to be understood concerning Greek Bishops appointed for the ordination of Italo-Greeks, at Rome or in Calabria by the Apostolic See, as we have said above: since they lack the faculties of Ordinaries, nor can they promote any of those who are not alumni of the Greek College at Rome, and of the Italo-Greek or Albanian College in Calabria, to first tonsure or to any order, whether minor or major, except with dimissorial letters from their own Ordinary.
216 XXI. In a Diocese where Latins and Greeks dwell, and there is only a Latin Archbishop or Bishop as Ordinary, the said Archbishop or Bishop shall appoint a Greek Vicar pleasing to the Greeks themselves, or to be chosen by the Greeks themselves (since a Greek man better knows Greek customs than a Latin) to be retained at their stipend and salary; and in cases of appeal to the Metropolitan, who perhaps might not be Greek, the said Metropolitan shall likewise be bound to appoint a Greek judge in the said cases.
217 XXII. Finally, the ordinances and regular institutions of the Holy Fathers concerning the life and state of Monks we command to be inviolably observed by abbots and monks who are Greek, dwelling privately in Italy and adjacent islands, and who have not professed the rule of monks of the Order of St. Basil in a congregation; and we subject all and each of them to the jurisdiction of Latin Ordinaries, commanding moreover that whatever has been prescribed above concerning the observance of Greek rites be executed with exactness.
218 XXIII. Saving nevertheless and always remaining in their force the privileges which have been granted and indulged by our predecessors, the Roman Pontiffs Gregory XIII, Sixtus V, Clement VIII, Paul V, Urban VIII, Innocent X, Clement XII, and perhaps others, both to the Pontifical Greek College of the City and the Corsini Seminary in Calabria, as well as to the Congregation of our beloved sons, the monks of the Order of St. Basil in Italy, to which we do not intend to derogate.
219 XXIV. Moreover, these things which above in any part we have granted, indulged, declared, commanded, ordained and forbidden or prohibited to the Italo-Greeks, shall in no way prejudice the rights of whatever kind of the Greeks dwelling in the East under their own Catholic Bishops, Archbishops, or Patriarchs, and of other Christian nations of whatever rites approved or permitted by the Holy See, if any such rights legitimately belong to them by law, or by custom, or in any other way, or by apostolic constitutions, or by decrees of general or particular councils, or of the Congregations of our venerable brothers the Cardinals of the Holy Roman Church, which have been issued concerning the rites of the Greeks or other Orientals, and we expressly declare that we do not intend any prejudice or the slightest injury to be inflicted, and we will and command that it be held as declared and repeated in every part of this our Constitution or disposition. § X.
220 Decreeing that these present letters and whatever is contained in them can in no way at any time be noted or impugned on account of the vice of subreptiousness or obreption or nullity, or of our intention, or any other defect, or otherwise in any way be infringed, or retracted or invalidated, or called into question or controversy, or any remedy of law or fact, or of justice or grace be attempted, sought or granted against them and those things in any way whatsoever, but that they ought to be inviolably observed in the future by all to whom they concern and shall concern in any way, shining with whatever dignity and honor.
221 And thus and in no other way by whatever ordinary and delegated judges and commissioners, exercising any authority whatsoever, and also by the Cardinals of the Holy Roman Church and Legates a latere, the faculty and authority being taken away from them and from each of them in any other manner of judging and interpreting, it ought to be judged and defined; and it shall be null and void, if otherwise concerning these things by anyone whatsoever, by whatever authority, knowingly or unknowingly, it should happen to be attempted.
222 Commanding all and each of the venerable brothers Bishops, Archbishops, Primates, and Patriarchs of the Latin rite, in whose dioceses these Italo-Greeks dwell, that in their synods, constitutions, statutes, edicts, decrees, or any other whatsoever mandates and admonitions, concerning their rite, observances and customs, beyond that which in these letters of ours is expressly and explicitly contained, they warn, enact, decree, constitute, command or mandate nothing else, unless first having consulted the Apostolic See.
223 Notwithstanding the letters of our predecessors and other matters aforesaid, as well as apostolic and in universal, provincial and synodal councils issued general or special constitutions and ordinances concerning these Italo-Greeks, and their rite, observances, customs, and practices, and also of the communities, monasteries and churches aforesaid, even those strengthened by oath, apostolic confirmation, or any other firmness, and statutes and customs, privileges also, indults and apostolic letters granted to the same Italo-Greeks, their communities, or individual persons of them under whatsoever tenors and forms, and with whatsoever clauses and decrees, even by way of perpetual statute, even by our own motion and from certain knowledge and from the fullness of apostolic power in like manner, even repeated times, and also with whatsoever derogatory clauses of derogatory clauses, and other more efficacious and most efficacious and unusual clauses rendering null, and other decrees in general or in particular otherwise in contravention of the matters aforesaid in whatsoever manner granted, confirmed and renewed. All and each of which, their tenors being held as fully and sufficiently expressed in these presents and inserted word for word, which would otherwise remain in their force, we on this occasion specially and expressly derogate from, and from all other things contrary whatsoever.
224 We will moreover that transcripts of these presents, whether copies, even printed ones, subscribed by the hand of some public notary,
225 and furnished with the seal of some person constituted in ecclesiastical dignity, shall have the same force entirely in judgment and outside of judgment, which would be given to these same presents, if they were exhibited or shown.
226 Let no one whatsoever be permitted to infringe this page of our decree, constitution, declaration, inhibition, prohibition and will, or to dare to act contrary to it with rash presumption; if anyone however should presume to attempt this, let him know that he will incur the indignation of almighty God and of the Blessed Apostles Peter and Paul.
227 Given at Rome at St. Mary Major in the year of the Incarnation of the Lord 1542, on 8 June, in the second year of our pontificate.
