BENEDETTO PAPA XIV.

2 Diletti Figli, salute e Benedizione Apostolica.

Missio.

7 PONT. A. V. Ai Missionari senza alcun speciale Indulto Apostolico.

8 DUB. IV. I detti Diaconi siano tenuti a recitare l'Ufficio Divino.

I a Timoteo cap.

I a Timoteo cap.

I. pag. 136. §. 52.

1 Dilectis Filiis, justo Maraghi, in universa Aegypto Vicario Generali, & Jacobo a Cremifir Ordinis Minorum S. Francisci Strictioris Observantiae, Praefecto Missionis Apostolicae in Aegypto, cæterisque Missionis Copta Missionariis.

BENEDICTUS PAPA XIV.

2 Dilecti Filii, salutem, & Apostolicam Benedictionem.

3 Eo quamvis tempore, quo pro demandato Nobis Apostolicae fervitutis onere tot tantisque curis circumdamur, ut penè obruamur, delata ad Nos fuerint nonnulla Postulata a Religioso Viro Jacobo a Cremifir Ordinis Fratrum Minorum S. Francisci Strictioris Observantiae, & Missionum Apostolicarum in Aegypto Praefecto: Nihilominus in eo, qui infirmatatem Nostram misericorditer regit, confidentes, operam studiumque nostrum ad proposita enodanda dubia libenter adjecimus, in spirituale electi illius Gregis solatium, qui magno licet intercedente Terrarum spatio a Nobis diffitus fit, fit, Paterno tamen Cordi Nostro charitate proximus efficitur.

4 §. I. Quas sane Pontificia sollicitudinis, & providentiae partes cum a nemine desiderari patiamur, qui verum Deum per veram fidem agnoscant; peculiari fibi illas vindicat jure Inclyta Coptorum Natio, quae praecipui cultus, ac Filialis obsequii, quo Romanam Ecclesiam omnium aliarum Matrem & Magistram prosequitur, non semel luculenta, & perenni digna laude praebuit specimina; Praefertim vero in Sacra Oecumenica Florentina Synodo, in qua fel: rec: Eugenio PP. IV. Praedecessore Nostro expetitam diu Graecae Latinaeque Ecclesiae Unionem promovente, veteri ejusdem Unionis incendi desiderio vifa est, palamque edocuit, oportere membra sub uno in Terris Capite indivisa consistere. Id ipsum quoque testata est Successoribus Romanis Pontificibus Pio IV., & Gregorio XIII. omni conatu in praemissa Unionis scopum enitentibus; Ac apertius etiam Clementi VIII., ad quem solemni, & honorifica decreta Legatione, obsequentis animi, ac devota in Romanam Ecclesiam voluntatis publica exhibuit Testimonia. Hanc quoque egregiam propensionem adherendi Romanae Ecclesiae plane perspectam habuit alter Noster Praedecessor Urbanus PP. §. 2. Alacriores tamen prae omnium rationum momentis ad hanc exequendam Pastoralis Officii partem Nos effecit jampridem concepta, intimeque cordi Nostro infixa spes majoris incrementi Catholicae Religionis, & lucris Animarum, quibus erudiendis in Superiori, ac Inferiori Aegypto, & in Urbe Principe Cairo, strenuum, invictamque navant operam Apostolici Missionarii ex Franciscana ut plurimum Familia adlecti, qui nullo laborum aspectu territi, sed induti fortitudine ex alto, in summa rerum ac temporum difficultate, Nationem illam toto olim Orbe Terrarum celeberrimam, nunc vero assiduis aerumnis attritam, ac penè confectam, verbo vitae informant, vigilisque laborant, ut novi in diem palmite in Vineam Domini traducantur. §. 3. Adhibitis itaque in consilium nonnullis Ven. Fratribus Nostris S. R. E. Cardinalibus, Dilectisque Filiis Confessoribus in Congregatione Supremae & Universalis Inquisitionis contra haereticam pravitatem confidentibus, exquisitique, quò maturius deliberare possemus, aliorum etiam doctrinâ & prudentiâ praestantium Virorum suffragiis, eorumque praefertim, quibus Orientalium mores, Ritus, & Instituta, longo usu & experientia effent cognita planèque perspecta, privati Nostri laboris acceffione singulorum sententias scripto traditas expendimus, atque librarivmus. Cum tamen ad singula definienda Dubia in praefentiarum quamplurima desiderentur; idcirco hæc Apostolica scripta Missionariis exhibenda mandavimus, ut ea, quæ definitivo reliquorum dubiorum judicio facem quodammodo praefere valent, ad Nostri Apostolatus auditum quamprimum deducenda curent. DUB. I. Cum Fideles Copti Catholicam profitentes Religionem a Baptismo Ritù Ecclesiae Latinæ collato hoc potissimum nomine abhorreant, quod Baptizatis una simul non conferatur Sacramentum Confirmationis: Quaeritur, an in casu, quo Sacerdos Ritùs Copti commodè adiri nequeat, permittendum sit PP. Missionariis illico post Baptismum Confirmationem conferre?

5 DUB. II. An Parochis Ritùs Copti, qui a Schismate redeunt ad Catholicam Ecclesiam Unitatem, tribuenda sit facultas administrandi Catholicis Sacramento Parochialia, qua prius potiebantur inter Schismaticos; quamvis eadem administratio, nullo existente Parocho Catholico, demandata sit PP. Missionariis?

6 DUB. III. An Coptis proprio Ritù in ætate puerili ad Diaconatus Ordinem promotis, ubi legitima ad contrahendum Matrimonium ætas advenerit, liceat nedum primum, sed alterum quoque inire Matrimonium, ex vi dispensationis obtentæ a PP. Misso.

7 PONT. A. V. Missionariis absque ullo speciali Indulto Apostolico.

8 DUB. IV. An dicti Diaconi Officium Divinum recitare teneantur.

9 §. 4. Quod attinet ad primum, plane compertum Nobis est, veteri more & disciplina invaluisse apud Coptos, ut abluti Sacro Regenerationis Lavacro illico ab eodem Sacerdote post absolutas Baptismatis Coeremonias Sacro Chrismate liniantur, ut præ aliis testatur Thomas a Jesu in suo Tractatu de Conversione Gentium lib. 7. cap. 7. §. 6. Præterea licet apud Occidentales etiam Ecclesias in more posita quandoque fuerit Baptismatis, & Confirmationis simultanea collatio, & hæc coniuncto in aliquibus Diœcesibus anteacto tempore inoleverit, juxta exempla relata a Vicecomite in Tract. de Confirmat. cap. 14., & a Martene de antiqu. Eccles. Rit. lib. 1. cap. 2. art. §. 7. Verum attributa, juxta propositum thema, Sacerdotibus Latinis facultate conferendi statim post Baptismum, Confirmationem, tantum abest, ut Orientales captivari possint in obsequium veritatis, ut immò animo semper obfirmatiore suæ adhærerent sententiæ, erga quam facilem se ac pronam Apostolica Sedes exhiberet. Præterea Hæretici, & Schismatici, qui improbo pravoque ut plurimum ingenio Catholicorum facta interpretantur, vel inconstantiae notam inurerent Latinis, a fuscepta semel probataque disciplina deflectentibus; vel suo exemplo eos commovisse, & in suas traxisse partes superbe dicitarent, ipsa temere vertentes officia pietatis in elationis argumentum. §. 8. §. 9. Apostolici igitur Missionarii, non suæ auctoritatis incremento, sed lucro tantùm Animarum inhiantes, qua par est sedulitate & diligentia inquirent, an Catholico Gregi, super quo vigilias custodiunt, defit præsentia Pastoris; an difficilis, vel impossibilis sit frequens illius accessus; an fidelis Populus in casu necessitatis versetur; & an demum circumstantiæ in unum collectæ præmissis confonent exemplis, ac parem expofcant providentiam. Integra porro, sinceræque fide ea omnia quamprimum renuncient Sanctæ Sedi, ut re tota fedulo cognita, intimèque perspecta, deliberare possit, an, & cui potissimum Presbytero, tanquam Ministro extraordinario, tribuenda sit hæc auctoritas confirmandi, & Episcopale hoc munus obeundi. §. 10. §. 11. Hæc quoad primum Dubium. Quo verò ad secundum, licet in fui primo mordio Catholica Ecclesia hæresim ejurantibus non semel ostenderit dura, ut eos potaret vino compunctionis; ideoque promotos ad Sacros Ordines folius Laicæ Communionis participes voluerit; ab hac tamen severitate judicii successivis temporibus temperamentum est, & ipsi Nicensæ Synodi Patres Canone 8. ultro confessere, quod Novatiani in Sacris Ordinibus constituti, ab errore in semitam veritatis reduces, nedum permanenter in Ordine Clericali, fed etiam obtentarum Dignitatum honore (providis tamen adjunctis legibus) fruerentur. Hanc quoque piæ Matris Ecclesiæ lenitatem in ample-xum Filiorum occurrentis, experti sunt Donatistæ. Siquidem Catholici Præsules, qui gemino adstipulante Edicto Marcellini Proconsulis, eos pro agenda Religionis causa advocaverant in illum Conventum Ecclesiasticis monumentis tantopere celebratum, quò facilius ad veræ Fidei cultum, & unitatem allicerent, retentionem gradus Episcopalis antea adepti, veluti quoddam concilianda pacis præliminare, illis consulto obtulere. §. 12.

10 §. 13. Præterea qui a Vicario Generali inter alios praelecti fuerint, abftineant ab exercitio dictæ authoritatis, quoufque non reportaverint neceffariam in utroque foro abfolutionem, rehabiliationem, necnon dispensationem ab Irregularitate, Cenfuris, & poenis, lapfis in Hærefim canonice inflictiis. Ritu præterea Catholico adminiftrant Sacramenta. Nullum eifdem cum Schifmaticis in Divinis fit confortium, ex quo hærefis, pravæque mentis fufpicio fuboriatur; Sed interjecto cum Schifmaticis pariete, corde puro, confcientia bona, fide non fifta, pracepta Matris Ecclefiæ, quæ de nuò eos in Chriſto genuit, intemeratè cuftodiant. §. 14. Ex hac porrò indulgentia uberem in dies fpiritualium gaudiorum meffem expectamus; lucrum fcilicet Animarum ad gremium Ecclefiæ redemptionem: Probè enim intelligent, Nos Paftoris Jefu Chrifti vicem in Terris tenentes, tantùm querere, & falvum velle, quod perierat; Ovefque inventas, non virga timoris, fed officio charitatis, ad Ovile congregare.

11 §. 15. Nec conqueri jure poterunt Miffionarii fuam autoritatem hoc pacto videri imminutam, fi oportunè in memoriam revocaverint, quæ ab eorum Patre, & Inftitutore Sancto Francifco in fuo Teftamento fcripta leguntur: Et fi haberem tantam fapientiam, quantam Salomon habuit, & invenirem pauperculos Sacerdotes in Parochiis, in quibus morantur, volo contra eorum voluntatem pradicare: Cui fententix confona funt documenta S. Bonaventuræ in fuo Tractatu, Quare Fratres Minores pradicent: Temperatiffimè, inquit Sanctus Doctor, difpofuit divina Sapientia, & inftituit Sedes Apoftolica, ut per Ordines prænotatos in prædicatione, & Confefsione defectus Cleri fuppleetur, & Anima falvetur, & nec in fpiritualibus, nec in temporalibus fus Clericorum aliqua tenus minuatur. Parique cenfura, in fimili negotio cum Græcis Melchitis nuperimè difcuſſo, a Nobis definitum eft: Licere tantùm Fratribus Ordinis Minorum Sancti Francifci Cuftodia Terræ Sanctæ Parochialia munia obire circa Græcos Melchitas, eifque Sacramenta adminiftrare in iis locorum, & temporum circumftantiis, quibus omnino deficiat modus habendi Parochum, aut alium Antiftitem Græci Ritùs.

12 §. 16. Neque etiam perperam timeant Miffionarii fibiin Vinea Domini, tanquam Operariis tota die otiofis, & a bono opere torpentibus, nullam, vel exiguum occafionem impendendi laboris effe relictam. Prædicandum eft ab illis fanctum Chriſti Evangelium, & docenda Myfteria Chriftiano Homini neceffaria ad æternam falutem; explicanda vitia, quæ declinare, virtutes, quas fequi oporteat; adhibenda medela fauciatis per Sacramentum Poenitentiæ; Tum alia quoque adminiftranda funt Sacramenta in fubfidium Presbyterorum Ritùs Cophti; nihil demum derelinquendum eft, quod ad Animarum falutem, & Religionis incrementum pertinere poffit. Potiffima tamen folllicitudo conferenda eft, ut Sacerdotes Cophti a Fidei unitate, rectâque femità declinantes, erroris depulfa caligine, ad unionem, & amplexum Catholicæ Ecclefiæ revocentur, eorumque numerus augeatur; hoc enim pacto Vinea Domini Sabaoth reflorefcet, optatumque fructum falutis, benedicente Domino, dabit in tempore fuo.

Præmaturam hujufmodi Ordinationem apud Cophtos veteri ufu, & difciplina invaluiffe teftatur Pater Tho- 1745. Thomas a Jesu dicto Oper. de Conversion. Gent. lib. 7. pag. 361.: Conferuntur, inquit, Ordines, excepto Presbyteratu, omni ætati, etiam immediate post Baptismum Parvulis, simulque dantur Tonfura, & quatuor Gradus, & Diaconatus, & Subdiaconatus; nec hisce conferendis interficitia, vel tempora particularia determinata sunt. Ubi Sacros Ordines recipiunt, castitatem, & abstinenticam pollicentur, jejunare videlicet diebus Mercurii, & Veneris, & tempore Adventus, & Quadragesimæ &c.

14 §. 18. Hanc quoque vigentem inter Coptos confuetudinem affumendi ad Ordinem Diaconatus constitutos in ætate infantili, confirmat suo testimonio Carolus Franciscus a Breno in Manuali Mission. Oriental. tom. 1. lib. 3. cap. 2. num. 5.; idemque usus evincitur in Litteris P. Berna. Missionarii Societatis Jesu datis Anno 1706. Cairo ad P. Solerium, magni nominis, probatæque doctrinæ Bollandistam: memoratis in iisdem litteris Cophtorum, seu Jacobitarum moribus & institutis, advertit, Diaconos promotos in ætate sex vel septem Annorum, in immenso exercivisse numerum, cæteroquin necessarium, ne Ecclesia debitis fraudetur obsequiis; neve Divina Mysteria absque decenti Ministrorum cultu & frequentia celebrentur, quemadmodum videre est in continuatione Bollandi tom. 5. Mens. Jun. pag. 132.

15 §. 19. Nemo adeo rudis est, qui ignorat in Ecclesia Occidentali diversos Ordines, & Ministrorum Gradus fuisse institutos, & in sua rite tempora dispositos. Primâ etenim Tonfurâ initiandi sunt præditi usu rationis; qui in septimo ætatis Anno præsumitur. Minoribus verò Ordinibus licet determinata ætas a Sacris Canonibus præstituta non fit, adhuc a septimo ad decimum quartum Annum conferri solent, concurrentibus tamen in Ordinando qualitatibus desideratis a Tridentino sess. 23. de Reform. cap. 5. & 11.

17 §. 21. Obsolevit enim verus illa Ecclesiæ Disciplina, quæ coactè, aut per vim Promotos ad Sacerdotium, & Episcopatum, duro subjiciebat jugo servitutis, & observationis onerum & legum cuicumque Ordini impositarum, spretâ quavis protestatione Ordinati, vel Promoti, contra vim illatam, spretâque declaratione animi a fuscepto Ordine abhorrentis. Insuper licet usque ad faculum duodecimum consueverint Parentes Filios in infantili ætate positos in sacris Monachorum Coenobiis devovere, & Divino Famulatui mancipare, perpetuò vito A. V. tito egressu è septis Monachorum; attamen mitioribus Clementis III., Coelestini III., & Tridentinæ Synodi Decretis abrogata fuit Lex illa, contra quam naturæ, & liberi arbitrii jura clamare videbantur.

19 §. 23. Alium expendunt casum Theologi, Ordinis suscepti post usum rationis, sed ante pubertatem. Affirmant ita Ordinatum tunc solum obligari voto servandæ Castitatis, quando Ordinationem expressè ratam habuerit, vel tacitè aliquo exteriori signo, puta quia ministraverit in Ordine suscepto, vel quia pensum diurnum horarum Canonicarum more aliorum absolverit: Quousque ratihabitio non superveniat, iidem Theologi nullam Ordinato imponunt obligationem recitationis Officii Divini; immo censent tandem interdictum exercitium Ordinis suscepti, quamdiu Ordinatus in ætate impuberi attingat alteram ætatem a sacris Canonibus Promovendis ritè præstitutam.

20 §. 24. Expenfa huc usque in abstracto ad tramites Legum Canonicarum, quibus Ecclesia Occidentalis informatur, faciem viam sternunt resolutioni non solum tertii Dubii, in quo quæritur: An Diaconis Ritus Copti licita sint prima, & ulteriores Nuptiæ; fed etiam quarti, in quo quæritur: An dicti Diaconi teneantur Divinum Officium recitare.

23 §. 27. In Concilio Toletano II. relato in Can. de iis, dist. Canonicae hujus sanctionis littera apertè edocet, Infantes a Parentibus Ecclesiasticis Ministeriis dedicatos, exacto decimo octavo anno ab Episcopo interrogari oportere, an velint in sancto perseverare proposito, vel temporale ini re Conjugium.

24 §. 28. Hæc porro interrogatio, & inquisitio fiat postquam Diaconi Decimum sextum ætatis Annun excelferint; confonum quippe eft, Diaconos eo tempore deliberare, quo, juxta Tridentini Decreta, in quacumque Religione tam Virorum, quàm Mulierum solemnia Cælitatis, Paupertatis, & Obedientiæ vota per Regularem Professionem emittuntur. Si completo decimo fexto anno Interroganti responderint, nolle diutius in Diaconali Officio perfistere; liceat illis primum, eoque legitime soluto, alterum quoque inire Matrimonium.

Occident. & Orient. lib. 7. cap. 27.

26 §.30. E contra fi Diaconi Ritus Copti, completo decimo fexto anno, Interroganti, & illorum voluntatem inquirrenti feriò ac deliberatè responderint, velle fe in adepto Ordine perfeverare, & Ecclesiasticis vacare muneribus; eo cafu sub diftricti feveritate judicii Secundæ Nuptiæ illis apertè interdicantur, clamante Apostolo, Ep. I. ad Timoth. cap.3. Diaconi fint unius Uxorís Viri.

28 §. 32. P. Bernar apud Bollandiftas loco citato propiùs ad rem accedens, testatur, Diaconos Coptos vinculo fecundi Matrimonii alligatos adepro gradu excidere, & ab Ordinis antea collati minifterio fufpendi. Nec sane deeft huic Disciplinae fatis firmum rationis præfidium. Cum enim Diaconi opportuno tempore interrogati, libero & deliberato actu voluntatis ratam Ordinationem habuerint, & novum quoddam vitæ genus ratificando elegerint, ac profeffi fuerint; deliberato pariter voluntatis actu cenfendi funt fe fubjeciffe Legibus Ordini ratificato, & vitæ A. V. vitæ instituto necessariò connexis, ac Legi præferim prohibenti secunda Conubia, & Bigamiam, adeo ut nefas fit a proposito resilire.

De matrimonii Diaconorum.

29 §. 33. Toti hactenus fuimus in examine secundarum Nuptiarum: Nunc verò aliqua de primis attingenda sunt, ut singulis propositi Dubii partibus fatis fiat.

Disciplina Ecclesiæ Occid. & Or. quoad Cœlibatum Sacr. Ministrorum.

30 §. 34. Quamvis antiquissimo tempore, ad augendam Clericalis Militiæ Sanctitatem, utraque Ecclesia Occidentalis, & Orientalis æquè præscripserit, nedum Presbyteros, sed alios etiam in SS. Ordinibus constitutos in perpetuo Cœlibatu versari debere, & hanc custodiendæ Castitatis obligationem numquam remiserit aliarum Mater & Magistra Romana Ecclesia: Secùs tamen contigit tractu temporis in Ecclesia Orientali, ut apertè evincitur ex Can. alter. diffinit. 31., cap. quæsitum. de pœnit. & remiss., & cap. cum olim. de Cleric. conjugat. Quibus factionibus consonæ sunt Literæ Apostolicæ fel. record. Gregorii XIII. Prædecessoris Nostri datæ ad Patriarcham Maronitarum, legendæ apud Thomam a Jesu in supra memorato Opere pag.

31 §. 35. Junguntur Matrimonio Græci in Minoribus Ordinibus constituti, & Uxore retenta, ad majores Ordines, & ad Sacerdotii gradum rite promoventur: Ubi tamen contigerit, eos in Statu Cœlibi Sacris Ordinibus insigniri, a quacunque spe contrahendi Matrimonii dejiciuntur, ut fusè edocet Glos. in Canon. Diaconi. diffinit. 28.

Nuptiæ post fulceptri Diaconatum incertior.

32 §. 36. Quin obstat declaratio, & protestatio de expetendo Conjugio in ipsa susceptione Ordinis Sacri emissa a Diacoonis; qua concurrente, compatibiles videntur Nuptiæ cum simultaneo Diaconatus Ministerio, ad præscriptum Canonis 10. Concilii Ancyranì, relati in Canon. Diaconi. diff.

§. 38. Diù

34 §. 38. Diù multumque agitata est inter Theologos controversia illa, plena jurgii, ac diffidii: An solum illicitorum, vel potiùs illicitorum & invalidum reputari deberet Matrimonium initum in Ecclesia Orientali post collationem Sacrorum Ordinum, quemadmodum nullum & irritum reputatur in Ecclesia Occidentali. Placuit sane pluribus, validum, sed illicitum censeri debere hujusmodi matrimonium, tum quia Canonicae Sanctiones, & Decreta Ecclesiae Occidentalis illud irritantia, protendi non possunt indole sua ad Ecclesiam Orientalem; Tum quia Canones Synodi Trullanae, quorum semper a Græcis commendata fuit auctoritas, nullibi expresse annullant, & irritant matrimonium post Sacros Ordines contractum. Strenue contra pugnarunt alii pro omnimoda invaliditate: Et saniori certe consilio; utpote tuentes sententiam majoribus suffragiis suffultam, & menti Congregationum Urbis consentaneam. Nullitatem Matrimonii fatis erui posse judicarunt ex ipso Canone 3. Concilii Trullani his verbis: Eis nefario videlicet dissoluto Conjugio. §. 39. Favet etiam eidem Sententiae auctoritas Imperatoris Justiniani, qui in Codice a Gothofredo illustrato lib. 1. de Episc. & Cleric., Novell. 45. hujusmodi Nuptias nefarias, & incestuosas appellat; & soboli inde procreatae notam illegitimitatis, & turpem Paternae incontinentiae maculam inurit. §. 40. Omnia itaque in unum perstringentes, si, ex hucusque dictis, Græcis ad Ordines Sacros jam promotis expresse vetitæ sunt non solum secundæ, sed primæ etiam Nuptiæ; Pari sane jure in proposito themate prohibenda est Diaconis ordinatis in tenera ætate celebratio quarumcumque Nuptiarum, postquam ipsi in ætate jam confirmata, fierio deliberatoque animo confensere in Ordinationem jamdiù susceptam, illamque publica declaratione ratificarunt; proindeque Patribus Missionariis omnis adimitur potestas super hoc dispendandi. §. 41. Nec opitulari quoquo modo potest Cophis salutare propositum ejurandi Schismaticorum errores, seque devovendi ex animo unioni Catholicae Romanae Ecclesiae. Si enim Divina tantum adspirante aura, nulloque humano impellente consilio, in piæ Matris gremium se receperint, & ad Nos confugerint; facile etiam intelligent, ejusdem Catholicae Ecclesiae Disciplinæ & observantiæ eos conformari oportere; Ideoque subjici legi Coelibatus, quam Promoti ad Ordines Sacros, five Latini sint, five Græci, in Romana Ecclesia fanctè & inviolate custodiunt. §. 42. Imminet etiam Diaconis raram habentibus suam Ordinationem onus dietime recitandi Officium Divinum; de quo instituitur quæstio in quarto Dubio.

35 §. 43. In Ecclesia Occidentis imposita est Presbyteris, Diaconis, & Subdiaconis dicta obligatio, quamvis nullum Ecclesiasticum Beneficium fuerint affecti. Cohæret enim Ordini Sacro diurnum pensum Horarum Canonicarum; Illudque veteri traditione acceptum, & immemorabili consuetudine in more positum fuisse, docet communior Theologorum opinio.

36 §. 44. Quantum assequi potuimus conjectura, & testimonio Monachorum Ritus Copti in Urbe degentium, quos ea de re percunctari non prætermisimus, Diaconi, Subdiaconi, & Presbyteri Ecclesiæ Orientis nulla lege expressa, Canone, aut Concilii Decreto adiguntur ad recitationem Officii Divini; quia verò positi in hujusmodi ministerii gradibus tenentur Omnipotenti Deo orationes, & sacrificium laudis offerre, etiam apud Orientales laudabilis invaluit consuetudo recitandi Divinum Officium. §. 45. Memoria proditum est, Patriarcham Maronitarum plura proposuisse Dubia Prædecessori nostro Gregorio XIII. A.V. ut supremo illius, & Apostolicae Sedis judicio definirentur. Qua de re, si Disciplina Ecclesiae Orientalis subjicit obligationi & præcepto recitandi Officium Divinum more Nationis generatim omnes in Sacro Ordine constitutos; Eadem sane obligatio, idemque præceptum persolvendi Horas Canonicas more suæ Nationis afficiet Diaconos Coptos, qui per solemнем ratificationem tempore habili emisfam denuo assensum præstitere Ordini Sacro in infantili ætate fuscepto. §. 46. Satis hæc videri possunt pro examine tertii, & quarti Dubii, semper tamen præ oculis habitæ firmiterque retenta hypothesi, quod quæstio usque modo instituta referenda sit ad Diaconos ordinatos in prima ætate Ritu Copto inter Schismaticos, qui post reditum ad Orthodoxam Ecclesiam, & post ratihabitionem Ordinis factam apud Catholicos in Statu coelibis, vindicent sibi possea legitimis Jura Conjugii. §. 47. At fupicari Nobis non temerè licet, crebrius in praxi alium dari casum a præmissa hypothesi longè diversum. Sæpissime etenim contingit, a Diaconis apud Schismaticos in ætate infantili ordinatis, ubi ætas adolevit, ratam haberì apud eosdem Schismaticos Ordinationem, si non expresse, saltem tacite, v. g. ministrando in Ordine fuscepto; & ab ipfis subinde contrahi Matrimonium. Demum ab erroribus, in quibus versantur, quærunt in sinu Catholicæ Ecclesiae salutare perfugium, sub spe tamen obtinendæ Dispensationis super Matrimonio jam inito, ut in statu conjugali legitime perseverent. §. 48. §. 50. §. 51. Cæterum, ut mox innuimus, induciis Ecclesiasticæ Historiæ monumentis edocemur, alias dispensatum fuisse, ut Orientales ad Unitatem redeuntes perseverarent in foedere Matrimonii post Sacros Ordines contracti. Exemplum hujusmodi Dispensationis exhibent Apostolica Literæ fel: rec: Innocentii IV. Prædecessoris Nostri Anno 1244. datæ ad Magistrum & Priorem Fratrum Prædicatorum Terræ Sanctæ, quibus idem Pontifex inter alia indulget, ut per Fratres dicti Vuu OrdiOrdinis, qui depuntantur ad predicandum Jacobitis, Neofritis, Giorgianis, Græcis, Armenis, Maronitis, Mossolinis, aliisque Nationibus in Partibus Orientalibus constitutis &c. dispensari valeat, ut illi ex Nationibus numeratis, qui post susceptionem Sacrorum Ordinum, vel in gradibus, & casibus a Divina minimè Lege prohibitís, Matrimonia contraxerunt, remaneant in eisdem. Extat dictarum literarum Exemplar authenticum Romæ in Archivo Ordinis, exscriptum ad fidem Autographi asservati in Cœnobio Viterbiensi, ut videre est in novissimo Bullario Dominica-no, edito & illustrato ab Antonino Bremond dicti Ordinis Alumno tom. I. pag. 136. §. 52. 1 To Our Beloved Sons, Justus Maraghi, Vicar General throughout all Egypt, and James of Cremifir of the Order of Friars Minor of St. Francis of the Stricter Observance, Prefect of the Apostolic Mission in Egypt, and the other Missionaries of the Coptic Mission.

POPE BENEDICT XIV.

2 Beloved Sons, greetings and Apostolic Blessing.

3 Although at a time when, burdened with the charge of Apostolic service committed to Us, We are encompassed by so many and such great cares that We are almost overwhelmed, certain Petitions have been brought to Us by the Religious Man James of Cremifir of the Order of Friars Minor of St. Francis of the Stricter Observance, and Prefect of the Apostolic Missions in Egypt: Nevertheless, trusting in Him who mercifully governs Our infirmity, We have willingly applied Our effort and diligence to unraveling the proposed doubts, for the spiritual consolation of that chosen Flock, which, though separated from Us by a great distance of lands, is nevertheless made near to Our Paternal Heart by charity.

4 § 1. Those parts indeed of Pontifical solicitude and providence, which We permit to be desired by no one who acknowledges the true God through true faith; the illustrious Coptic Nation claims for itself by a peculiar right, having shown not once but repeatedly clear and worthy of perpetual praise examples of the principal worship and filial obedience with which it pursues the Roman Church, the Mother and Teacher of all others; especially in the Sacred Ecumenical Council of Florence, in which our predecessor of happy memory, Pope Eugene IV, promoting the long-desired Union of the Greek and Latin Churches, was seen to be animated by the ancient desire of that same Union, and openly taught that the members must remain undivided under one Head on earth. The same thing was also testified to Our Roman Predecessors Pius IV and Gregory XIII, striving with all effort toward the aforesaid goal of Union; and even more openly to Clement VIII, to whom the Coptic Nation exhibited by a solemn and honorific Legation public testimonies of obedient mind and devoted will toward the Roman Church. This same excellent inclination to adhere to the Roman Church was fully perceived by another of Our Predecessors, Pope Urban VIII, who with equal zeal and diligence applied himself especially to this, that the aforesaid Union of Churches might be strengthened as far as possible by the indissoluble bond of charity. § 2. Yet We have been moved more eagerly than by all other considerations to execute this part of Pastoral Office by a hope long since conceived and deeply fixed in Our heart of greater increase of the Catholic Religion and gain of souls, for the instruction of which in Upper and Lower Egypt, and in the principal city Cairo, the Apostolic Missionaries, drawn chiefly from the Franciscan Family, labor with strenuous and unconquerable effort, who, terrified by no aspect of labors, but clothed with strength from on high, in the utmost difficulty of affairs and times, instruct that Nation, once celebrated throughout the whole world, now worn down and almost exhausted by continual hardships, with the word of life, and labor vigilantly that new branches may be daily brought into the Vineyard of the Lord. § 3. Having therefore taken counsel with certain Venerable Brethren of Ours, Cardinals of the Holy Roman Church, and Beloved Sons, Confessors in the Congregation of the Supreme and Universal Inquisition against heretical depravity, and having sought out, that We might deliberate more maturely, the suffrage also of other men distinguished in learning and prudence, and especially of those to whom the customs, Rites, and Institutions of the Orientals were known and fully perceived by long use and experience, by the addition of Our private labor We have weighed and balanced the opinions of individuals delivered in writing. Since, however, in defining the individual Doubts at present very many things are desired; for this reason We have ordered these Apostolic writings to be exhibited to the Missionaries, that they, which can in some way provide a light for the definitive judgment of the remaining doubts, may be brought to the hearing of Our Apostolate as soon as possible. DUB. I. Since the Faithful Copts professing the Catholic Religion abhor Baptism conferred by the Rite of the Latin Church chiefly on this account, that the Sacrament of Confirmation is not conferred at the same time upon those Baptized: It is asked, whether in the case in which a Priest of the Coptic Rite cannot conveniently be approached, it is permitted to the Missionary Fathers to confer Confirmation immediately after Baptism?

5 DUB. II. Whether to Pastors of the Coptic Rite, who return from Schism to the Unity of the Catholic Church, the faculty of administering the Sacraments to Catholics as Pastors, which they previously possessed among the Schismatics, should be granted; although the same administration, with no Catholic Pastor existing, has been entrusted to the Missionary Fathers?

6 DUB. III. Whether it is lawful for Copts of their own Rite promoted to the Diaconate in childhood, when the lawful age for contracting Matrimony has arrived, to enter not only the first but also a second Marriage, by virtue of a dispensation obtained from the Missionary Fathers.

7 PONT. A. V. To the Missionaries without any special Apostolic Indult.

8 DUB. IV. Whether the said Deacons are bound to recite the Divine Office.

9 §. 4. As to the first matter, it is fully established to Us that among the Copts, by ancient custom and discipline, it has been the practice that those washed in the Sacred Laver of Regeneration are immediately anointed with Sacred Chrism by the same Priest after the Ceremonies of Baptism are completed, as Thomas a Jesu testifies among others in his Treatise on the Conversion of the Gentiles, book 7, chapter 7. Concerning the simultaneous administration of both Sacraments, however, the manner of proceeding was not the same among the Greeks dwelling in the Oriental Churches and those who dwell in Italy and the Islands adjacent to it. For just as the Greek inhabitants of Italy were expressly forbidden the administration of both Sacraments by the same Minister at the same time; so by a certain patience and facility of the Apostolic See it came to pass that both Sacraments were conferred by the same Priest upon the Greeks in the East; nor were there lacking Theologians who would clothe such tolerance with the garment and image of tacit Dispensation. §. 5. This being appropriately premised, two extremes flowing from this are to be properly distinguished and judged by different law: For it is one thing that the Copts assert to themselves from the Indulgence of the Apostolic See the licit conferral of both Sacraments, observing the Rite of the Oriental Church, not expressly forbidden by the same Apostolic See, but tolerated: but it is far otherwise that, perverting tolerance to the worse part, they abhor Baptism conferred in the Latin Rite, chiefly on this account, that it is administered separately from Confirmation. Therefore, just as it may seem consonant with the gentleness and patience of the Apostolic See that the Copts persevere in their long-received use and tolerated by the same See; so it is not to be borne that they abhor Baptism conferred in the Latin Rite and separately from Confirmation with bitter and alien spirit. §. 6. Moreover, although the simultaneous conferral of Baptism and Confirmation was sometimes placed in custom even among the Western Churches, and this joined practice prevailed in some Dioceses in former times, according to examples related by Viscount in his Treatise on Confirmation, chapter 14, and by Martene on the Antiquities of Ecclesiastical Rites, book 1, chapter 2, article 1; nevertheless, this custom having been entirely abrogated by the Roman Church, the Mother and Teacher of others, by the most prudent Decrees of the Supreme Pontiffs it has been providently ordained that to those reborn in the Font of Baptism the Sacrament of Confirmation should be conferred only at that age in which the Faithful, having put away what they were as infants, might understand how much Baptism and Confirmation differ from each other, as in natural life generation differs from growth; it follows that by Baptism they were indeed received into the militia, but by Confirmation they were strengthened for battle, and instructed by Grace to endure contests. From which it comes to pass that those must be strictly observed who perchance refuse or despise the institutions of this discipline; and every care must be taken that they be withdrawn from an error and blindness so injurious to the Latin Church. §. 7. But truly, the faculty having been attributed to Latin Priests, according to the proposed theme, of conferring Confirmation immediately after Baptism, so far is it from being able to captivate the Orientals into obedience to the truth, that rather with ever more steadfast mind they would adhere to their opinion, toward which the Apostolic See would show itself easy and inclined. Moreover, Heretics and Schismatics, who for the most part interpret the deeds of Catholics with wicked and perverse ingenuity, would either brand the Latins with a note of inconstancy, departing from a discipline once undertaken and approved; or would proudly claim that by their example they had moved them and drawn them to their side, rashly turning the very offices of piety into an argument of pride. §. 8. If therefore the condition of the Coptic Nation be such that Confirmation cannot be administered to the Faithful People by Bishops, to whom the ordinary power of administering this Sacrament has been committed; it is not hidden from Us that the same power of administering Confirmation can sometimes be conferred by Apostolic Indult upon a Priest or Missionary, according to the measure of necessity. Such delegation ought not to appear new or unusual, since it imitates the most holy examples of St. Gregory the Great and our other Roman Pontiff Predecessors. For since it has often happened that the Faithful have been destitute of the solace of their Pastor, and it has been impossible or very difficult for Bishops, on account of the distance of places, to be present to the needs of the People; Priests have been called to this office of Episcopal Ministry, provided they use Chrism duly blessed and consecrated by the Bishop: lest otherwise it should happen that the Faithful, by delaying, neglect a matter full of holiness, or depart this life without this Sacrament, filled with Divine gifts and instituted for our sanctification. §. 9. The Apostolic Missionaries, therefore, not seeking the increase of their own authority, but only the gain of Souls, with the diligence and care that is fitting, shall inquire whether the Catholic Flock, over which they keep watch, lacks the presence of a Pastor; whether his frequent access be difficult or impossible; whether the faithful People be in a case of necessity; and whether finally the circumstances collected together conform to the aforesaid examples and demand equal providence. Moreover, with entire and sincere faith let them report all these things as soon as possible to the Holy See, so that, the whole matter having been carefully known and intimately perceived, it may be able to deliberate whether, and to which Presbyter especially, as an extraordinary Minister, this authority of confirming and of performing this Episcopal office should be granted. §. 10. Let the Missionaries themselves, to whom it has been given to exhort in sound Doctrine and to reprove those who contradict, strive that the faithful People be brought back from error to truth, from hatred to obedience toward Baptism of the Latin Church, and that that Nation at length may recognize that by pious and holy ordinance it has been disposed that the Sacrament of Confirmation should be conferred separately from Baptism upon those who should be of more advanced age and accommodated to receive the virtue of the Sacrament. §. 11. This concerning the first Doubt. But as to the second, although in its first beginning the Catholic Church showed herself harsh to those abjuring heresy, so as to give them to drink the wine of compunction; and therefore wished those promoted to Sacred Orders to be partakers of the Laity's Communion only; nevertheless from this severity of judgment temperance has been introduced in successive times, and the Fathers of the Council of Nicæa themselves in Canon 8 readily confessed that the Novatians constituted in Sacred Orders, being brought back from error to the path of truth, not only remained permanently in the Clerical Order, but also enjoyed the honor of the Dignities obtained (with prudent laws attached, however). The Donatists also experienced this gentleness of the pious Mother Church in the embrace of her Children coming to her. For the Catholic Bishops, who, supported by the twofold Edict of Marcellinus the Proconsul, had summoned them to that Ecclesiastical Convention so celebrated in monuments, for the sake of conducting Religion, in order more easily to allure them to the worship and unity of the true Faith, deliberately offered to them the retention of the rank of Bishop previously obtained, as a kind of preliminary for conciliating peace. §. 12. Repeating these splendid examples of gentleness with attentive mind together with Us, it seemed just that Pastors of the Coptic Rite, validly and rightly ordained, who from the dark darkness of errors in which they were involved emerge into the light of Catholic truth, should be capable also among Catholics of the Administration of Parochial Sacraments, which they previously enjoyed in Schism, although this same spiritual authority, no Catholic Pastor existing, has been granted also to the Missionary Fathers and is exercised by them. But We decree that this capacity, which is inherent in each, should be so tempered that not all indiscriminately assume this Pastoral office to themselves, but only those whom the Vicar General has placed over the Lord's Flock; who are conspicuous for piety and chaste morals; who shine forth by the example of good works; and in whose return to the Church nothing feigned or simulated, but a certain sure sign of sincere Conversion is discerned.

10 §. 13. Furthermore, those who have been selected by the Vicar General among others shall refrain from the exercise of the said authority, until they shall have obtained the necessary absolution in both forums, rehabilitation, and also dispensation from Irregularity, Censures, and penalties inflicted on those who have fallen into Heresy canonically. Moreover, let them administer the Sacraments according to the Catholic Rite. Let there be no communion with Schismatics in Divine matters, from which suspicion of heresy and perverse mind might arise; but with a wall interposed between themselves and the Schismatics, with a pure heart, a good conscience, with faith not feigned, let them inviolably keep the precepts of the Mother Church, which has newly brought them forth in Christ. §. 14. From this indulgence, moreover, we expect a rich harvest of spiritual joys to increase daily; namely, the gain of Souls to the bosom of the Church for redemption: for they shall well understand that We, holding the place of the Shepherd Jesus Christ on Earth, seek only, and wish to save, that which was lost; and the Sheep found, not with the rod of fear, but with the office of charity, to gather into the Fold.

11 §. 15. Nor can the Missionaries justly complain that their authority is thus seen to be diminished, if they have opportunely recalled to memory what is read in the Testament of their Father and Founder St. Francis: And if I had as much wisdom as Solomon had, and should find poor Priests in the Parishes in which they dwell, I would wish to preach against their will: To which sentence are consonant the teachings of St. Bonaventure in his Treatise, Why the Friars Minor Preach: Most temperately, says the holy Doctor, did divine Wisdom dispose, and the Apostolic See institute, that through the aforesaid Orders in preaching and Confession the defects of the Clergy should be supplied, and Souls saved, and that neither in spiritual nor in temporal matters should the authority of the Clergy be diminished in any way. And by like judgment, in a similar matter discussed with the Greek Melchites recently, it has been defined by Us: That it is permitted only to the Friars of the Order of the Friars Minor of St. Francis of the Custody of the Holy Land to perform parochial duties among the Greek Melchites, and to administer the Sacraments to them in those circumstances of place and time in which there is absolutely lacking the means of having a Parochial Priest, or another Bishop of the Greek Rite.

12 §. 16. Nor should the Missionaries wrongly fear that in the Vineyard of the Lord, as Laborers idle all day and sluggish from good work, no opportunity or scant opportunity of expending labor has been left to them. The holy Gospel of Christ must be preached by them, and the Mysteries necessary for a Christian man unto eternal salvation must be taught; vices which ought to be avoided must be explained, virtues which ought to be followed; healing must be applied to the wounded through the Sacrament of Penance; then also the other Sacraments must be administered in aid of the Priests of the Coptic Rite; finally, nothing must be left undone which can pertain to the salvation of Souls and the increase of Religion. The chief solicitude, however, must be directed to this, that Coptic Priests deviating from the unity of Faith and the right path, the darkness of error being dispelled, may be recalled to the union and embrace of the Catholic Church, and their number increased; for in this way the Vineyard of the Lord of Hosts shall flourish again, and shall give the desired fruit of salvation, the Lord blessing, in its season.

13 §. 17. Proceeding to the third and fourth Doubt, it is helpful for easier and more accurate examination of them to premise that it is verified practically and in the concrete among the Copts, what in the abstract, and according to their manner Latin Theologians and Canonists dispute among themselves, concerning Sacred Order conferred on an Infant before the use of reason, or before puberty. That such premature Ordination has prevailed among the Copts by ancient custom and discipline is attested by Father Thomas a Jesu, in his Oper. de Conversion. Gent. lib. 7. pag. 361.: Orders, he says, are conferred, except the Priesthood, on every age, even immediately after Baptism on Infants, and at the same time Tonsure and the four Grades, and the Diaconate, and the Subdiaconate are given; nor are particular intervals or times determined for conferring these. When they receive Sacred Orders, they promise chastity and abstinence, namely to fast on Wednesdays and Fridays, and in the time of Advent and Lent, etc. Moreover also in the Lents of the Apostles Peter and Paul, and of the Assumption. When, however, Sacred Orders are conferred on Infants or Boys, their Parents stand surety for them, and observe these vows until they shall have reached the sixteenth year of age, or thereabouts. De codem.

14 §. 18. This custom also, which is in force among the Copts, of admitting those constituted in the Order of Deacons in infancy, is confirmed by the testimony of Charles Francis of Breno in Manuali Mission. Oriental. tom. 1. lib. 3. cap. 2. num. 5.; and the same practice is evidenced in the Letters of P. Bernard, Missionary of the Society of Jesus, given in the Year 1706 at Cairo to P. Solerius, a man of great renown and proven learning, a Bollandist: in those same letters, noting the customs and institutions of the Copts, or Jacobites, he observes that Deacons promoted in the age of six or seven years have exercised an immense number, otherwise necessary, lest the Church be defrauded of its due services; and lest the Divine Mysteries be celebrated without the decent worship and frequency of Ministers, as may be seen in the continuation of Bolland tom. 5. Mens. Jun. pag. 132.

15 §. 19. No one is so ignorant as not to know that in the Western Church diverse Orders and Grades of Ministers have been instituted and arranged in their proper times. For by the First Tonsure those to be initiated must be endowed with the use of reason; which is presumed in the seventh year of age. For the Minor Orders, although a determined age prescribed by the Sacred Canons is not fixed, they are nevertheless customarily conferred from the seventh to the fourteenth year, provided that the desired qualities concur in the one to be ordained, as required by the Council of Trent sess. 23. de Reform. cap. 5. & 11. Furthermore, by the law of the same Tridentine Synod it is provided that for the Subdiaconate the age of the twenty-second year, for the Diaconate the twenty-third, for the Presbyterate the twenty-fifth, for the Episcopate the thirtieth year is necessary; with this alone being the distinction between the Sacred Orders and the Episcopate, that for the Sacred Orders the beginning of one or the other year respectively is fixed, but for the Episcopate the completion of the thirtieth year is required.

16 §. 20. If, however, it should happen that in contempt of such providently instituted Laws, an Infant should receive not only Minor Orders but also Sacred Orders from a Bishop supported by legitimate authority; it has been defined by the unanimous suffrage of Theologians and Canonists that this Ordination is to be considered valid, but illicit, provided there is no substantial defect in matter, form, and intention in the Bishop ordaining; the contrary opinion not being regarded, which has few adherents and which has never been approved by the supreme Tribunals and Congregations of the City. Yet it is equally certain and established that by this conferral of Orders the Promoted are not subjected to the obligation of observing Chastity, nor to other burdens imposed by the Church; since the choice of state depends upon the free will of each, and we are bound to render our vows, not those of another, to the Most High.

17 §. 21. For that true Discipline of the Church has become obsolete, which forcibly or by violence subjected those promoted to the Priesthood and Episcopate to the harsh yoke of servitude and the burden of observances and laws imposed upon each Order, disregarding any protestation of the Ordained or Promoted against the violence inflicted, and disregarding any declaration of mind abhorring the Order undertaken. Moreover, although until the twelfth century Parents were accustomed to devote their Sons placed in infancy in the sacred Monasteries of Monks and to consecrate them to Divine Service, with perpetual vow and without exit from the enclosure of the Monks; nevertheless, by the milder Decrees of Clement III, Celestine III, and the Tridentine Synod, that Law was abrogated, against which the rights of nature and free will seemed to cry out.

18 §. 22. There are not lacking, however, grave Theologians who examine the matter more carefully and in depth: they say, namely, that Infants promoted to the Sacred Orders, when they have come to the use of reason, ought to be questioned concerning their intention of remaining or not in the Order conferred upon them. If they have openly assented with firm and deliberate mind; in that case they consider them bound by the vow of Chastity; if not, it is permitted to the same to pass to secular vows, with the exercise of the Order suspended.

19 §. 23. Theologians consider another case, of an Order undertaken after the use of reason but before puberty. They affirm that one so ordained is then bound by the vow of observing Chastity only when he has expressly ratified the Ordination, or tacitly by some external sign, for instance because he has ministered in the Order undertaken, or because he has completed the daily office of Canonical Hours in the manner of others: until such ratification supervenes, the same Theologians impose upon the Ordained no obligation of reciting the Divine Office; indeed they consider the exercise of the Order undertaken to be forbidden, so long as the Ordained remains in an age before puberty until he reaches another age properly prescribed by the Sacred Canons for those to be promoted.

20 §. 24. Having examined thus far in the abstract according to the paths of the Canonical Laws by which the Western Church is governed, the way is now paved for the resolution not only of the third Doubt, in which it is asked: Whether first and subsequent Marriages are lawful for Deacons of the Coptic Rite; but also of the fourth, in which it is asked: Whether the said Deacons are bound to recite the Divine Office.

21 §. 25. And indeed if the Missionaries who propose the Doubts willingly consent that among the Copts the Ecclesiastical Hierarchy persevere in their Orders and grades aptly disposed; if those sacred Ordinations labour under no substantial defect on the part of matter or form; if finally, the conflict of dissenting opinions which once existed being removed, there is no one who today does not acknowledge valid Ordination made even by a Schismatic Minister: it necessarily follows that, just as in the Western Church Sacred Orders are validly conferred even upon Infants; so the Order of Diaconate may be validly conferred upon Copts in infancy.

22 §. 26. Moreover if in the Western Church, as has been stated, there are exempted from the obligation of reciting the Divine Office not only Boys, but also Impubescent persons assumed to Sacred Order, unless having reached confirmed age they have expressly or tacitly ratified their Ordination: By parity of reasoning the same judgment must be rendered in this matter also concerning Deacons of the Coptic Rite ordained in tender age, the defect of free assent, necessary to each for the election and profession of state, occurring in one case and the other.

23 §. 27. In the Council of Toledo II, related in Can. de iis, dist. 28, where discourse is instituted concerning those whom the will of Parents from the earliest years of Infancy bound to the Office of the Clerical state, this discipline is opportunely prescribed by rule: When they shall have completed the eighteenth year of their age, in the sight of the assembly of Clergy and People their will regarding the desire of Marriage shall be examined by the Bishop, to whom if the grace of Chastity shall have pleased God to inspire, let them undertake the Ministry of Subdeacon, having had proof of their Profession, from the twentieth year and so forth. But to those to whom the will, at the proper time of questioning, shall have persuaded the desire of marrying, we cannot take away the licence granted by the Apostle. The letter of this canonical sanction openly teaches that Infants dedicated by Parents to Ecclesiastical Ministries ought to be questioned by the Bishop, the eighteenth year being completed, whether they wish to persevere in the holy purpose or to enter into temporal Marriage. Let not the Prefect of the Mission depart from this path of rightly acting; but let him openly question the Deacons ordained in early age through himself, if it can conveniently be done; if not, through another deputed by him, and let him diligently explore what is their mind and will.

24 §. 28. This moreover questioning and inquiry shall be made after the Deacons shall have exceeded the sixteenth year of their age; for it is fitting that Deacons deliberate at that time when, according to the Decrees of Trent, in any Religion both of Men and of Women the solemn vows of Celibacy, Poverty, and Obedience are emitted through Regular Profession. If upon the completion of the sixteenth year they shall have answered the one questioning that they do not wish to persevere longer in the Diaconal Office; let it be lawful for them first, and that being legitimately dissolved, to enter also into a second Marriage. Let them moreover be assured that by no Ecclesiastical law or precept are they compelled to recite the Divine Office or the prayers used by the Coptic Clergy.

25 §. 29. Nor should it seem base or unbecoming that an entrance to repeated Marriages be opened to Deacons released from any Ecclesiastical Law. For the liberty of a second Marriage the Sacred Scriptures cry out, and the most wholesome counsels of the Doctor of the Gentiles. Addressing discourse to Women the Apostle in the Epistle to the Romans cap. 7 says: But if her husband be dead, she is delivered from the law of her husband; so that she is not an adulteress, if she be with another man: And in II to the Corinthians cap. 7: But I say to the unmarried and to the widows: It is good for them if they so remain, even as I also: But if they do not contain themselves, let them marry; for it is better to marry than to be burnt. Finally in Ep. I to Timothy cap. 5 he exhorts widows of flourishing age again to Marriage and to the procreation of offspring, lest perchance they fall into contempt of Chastity and be defiled by the filth of incontinence. Relying on which authority the Fathers of the Eastern Church gravely accuse of error, and condemn as heretics, those who think that after the death of the first Wife it is unlawful to pass to a second vow, as may be seen in Peter Arcudius on the Concordia Ecclef. Occident. & Orient. lib. 7. cap. 27.

26 §. 30. On the contrary if the Deacons of the Coptic Rite, upon the completion of the sixteenth year, shall have answered seriously and deliberately the one questioning and inquiring into their will, that they wish to persevere in the Order obtained and to be engaged in Ecclesiastical duties; in that case under the strictness of severe judgment Second Marriages are openly forbidden to them, the Apostle crying out, Ep. I to Timothy cap. 3: Let Deacons be the husbands of one wife.

27 §. 31. Furthermore, since persons consecrated to God ought especially to be marked by purity and sanctity, the Apostolic Canons 17 and 18, which the Church pursues with principal veneration and honor, prudently prohibit Bishops, Presbyters, and Deacons not only from bigamy of their own, which arose from a second Marriage, but also from a similar union arising from a first Marriage contracted with a Widow, or a Corrupted woman. The dispositions renewed by the Apostolic Canons were innovated in Canon 3 of the Council of Trullo; whose authority, although not received in the Western Church, is nevertheless accepted and venerated by the Eastern Church. Alexius Aristenus (an author of great repute among the Orientals, as Balsamon and Zonaras are to be cited below) the Glossator of the aforesaid Canon of Trullo, thus writes: "He who is entangled in two Marriages after Baptism, or retains a Concubine, or marries a Widow, or one dismissed by another, or a Harlot, or a Slave, or an Actress, cannot become a Bishop, or Presbyter, or Deacon, or Subdeacon, according to the seventeenth and eighteenth Canons of the Apostles, they decree."

28 §. 32. P. Bernard among the Bollandists, in the place cited, approaching more closely to the matter, testifies that Deacons of the Copts bound by the bond of a second Marriage fall from their grade and are suspended from the ministry of the Order previously conferred. Nor indeed is there lacking to this Discipline a sufficiently firm support of reason. For since Deacons, interrogated at an opportune time, have by a free and deliberate act of will ratified the Ordination, and by ratifying have chosen a new kind of life, and have professed it; they are to be considered by a like deliberate act of will to have subjected themselves to the Laws connected necessarily with the ratified Order and the life instituted by it, and especially to the Law prohibiting second Marriages and Bigamy, so that it is unlawful to withdraw from the purpose.

Concerning the Marriage of Deacons.

29 §. 33. We have thus far been entirely occupied in the examination of second Marriages: Now indeed some things concerning first Marriages must be touched upon, so that satisfaction may be given to all parts of the proposed Doubt.

The Discipline of the Western and Eastern Church regarding the Celibacy of Sacred Ministers.

30 §. 34. Although from the most ancient time, to increase the Sanctity of the Clerical Militia, both the Western Church and the Eastern Church equally prescribed that not only Presbyters, but also others constituted in the Sacred Orders ought to live in perpetual Celibacy, and the Roman Church, the Mother and Teacher of others, has never remitted this obligation of guarding Chastity: Yet otherwise it came to pass in the course of time in the Eastern Church, as is plainly evident from Canon alter. diffinit. To these dispositions consonant are the Apostolic Letters of Gregory XIII, of happy memory, Our Predecessor, given to the Patriarch of the Maronites, to be read in Thomas a Jesu in the aforesaid Work page 490, there: "Since Pope Stephen relates that it is an ancient tradition of the Orientals that their Priests are joined in Marriage, and since the Church has never forbidden this to them, nor does it seem it should be forbidden to the Maronites; for the Law of Celibacy has always seemed burdensome to the Greeks, therefore Marriage was permitted to them, etc. It seems therefore that this ought to be permitted to the Maronites, provided that those who wish to be celibates are not compelled to Marriage, but are rather induced to it by pious exhortations. What among the Greeks."

31 §. 35. The Greeks join in Marriage while constituted in the Minor Orders, and retaining a Wife, are duly promoted to the Major Orders and to the grade of Priesthood: But when it happens that they are marked with Sacred Orders in a State of Celibacy, they are cast down from any hope of contracting Marriage, as the Gloss in Canon. Diaconi. diffinit. 28. teaches at length.

Marriages after receiving the Diaconate uncertain.

32 §. 36. Nor does the declaration and protestation concerning the seeking of Marriage issued in the very reception of Sacred Order by a Deacon stand in the way; which concurring, Marriages seem compatible with the simultaneous Ministry of the Diaconate, according to the prescription of Canon 10 of the Council of Ancyra, related in Canon. Diaconi. diff. 28.: "Whoever Deacons constituted, in the very ordination protested and said that they ought to take Wives, since they could not so remain, if they afterwards took a Wife, they remained in the ministry, because this was conceded to them by the Bishop; but if any, this being passed over in silence, and in the Ordination were received so as to remain thus, afterwards however came to Marriage, they ceased from the Diaconate: For indeed Balsamon, who carefully weighed that Canon, expressly rejects the dispositions in it, saying: Do not follow this Canon; and innocent of the more solid doctrine of the Sixth Canon of the Synod of Trullo, he concludes that the assent given in any way to the said protestation by the Ordaining Bishop is inefficacious: For the Sixth Canon (are his words) of the Synod in Trullo decrees that Presbyters and Deacons who contracted Marriage after Ordination are to be deposed. But what is done against the Canons, neither from the permission of the Bishop, nor from the fact alone that they were silent, will it be granted that what cannot consist. It is confirmed."

33 §. 37. The same is also the opinion of Zonaras concerning the Canon of the Council of Ancyra mentioned above; indeed, to remove the conflict between two Canons, namely that of Ancyra and that of Trullo, which are opposed to each other, he proposes that the Decrees of the sixth Synod should be followed: Since therefore these Canons are manifestly contrary to each other, the Canon of the sixth Synod, which was also later and agrees more with the Apostolic Canon, ought to be observed: Nor does Aristenius think differently, who in this conflict of authorities adheres to the side of the Council of Trullo; for he says: But to this Canon is opposed the sixth Canon of the sixth Synod, not entirely denying to him who comes as a celibate to the rank of Hypodeacon, or Deacon, or Presbyter, the right to join a woman to himself in matrimony, but commanding that he who dares to do this be deposed. And that Canon retains its force; but this one has fallen into disuse. §. 38. For a long

34 §. 38. For a long time and greatly has that controversy been agitated among theologians, full of dispute and disagreement: Whether matrimony contracted in the Eastern Church after the conferral of Sacred Orders should be reputed only illicit, or rather both illicit and invalid, as it is reputed null and void in the Western Church. It pleased many indeed that such matrimony should be judged valid but illicit, both because the Canonical Sanctions and Decrees of the Western Church rendering it null cannot by their nature extend to the Eastern Church; and because the Canons of the Synod of Trullo, whose authority has always been commended by the Greeks, nowhere expressly annul and render void matrimony contracted after Sacred Orders. Others strenuously fought against this for complete invalidity: and certainly with sounder counsel; as defending the opinion supported by the greater number of votes and consonant with the mind of the Congregations of the City. They judged that the nullity of matrimony could be sufficiently drawn from Canon 3 itself of the Council of Trullo in these words: That nefarious marriage being dissolved. §. 39. The authority of the Emperor Justinian also favors this same opinion, who in the Code illustrated by Gothofredus, book 1, concerning Bishops and Clerics, Novella 45, calls such nuptials nefarious and incestuous; and brands the offspring born therefrom with the mark of illegitimacy and the foul stain of paternal incontinence. And although in Ecclesiastical Laws the power of commanding has been left to the Lay Authority alone, not the authority of commanding; nevertheless in the subject case the Emperor speaks relative to the Holy Canons, there: which also seemed good to the Sacred Canons. §. 40. Therefore, drawing all things together into one, if, from what has been said hitherto, the Greeks already promoted to Sacred Orders are expressly forbidden not only second but also first nuptials; by equal right certainly in the proposed theme the celebration of any nuptials whatsoever is to be prohibited to Deacons ordained in tender age, after they themselves in confirmed age, with deliberate mind have consented to the Ordination long since received, and have ratified it by public declaration; and therefore all power of dispensing in this matter is taken away from the Missionary Fathers. §. 41. Nor can it in any way help the Copts in the salutary purpose of abjuring the errors of schismatics and devoting themselves wholeheartedly to union with the Catholic Roman Church. For if, with only the Divine breath inspiring, and no human counsel impelling, they have received themselves into the bosom of the pious Mother, and have fled to Us; they will easily also understand that they ought to conform themselves to the Discipline and observances of that same Catholic Church; and therefore to be subject to the law of celibacy, which those promoted to Sacred Orders, whether they be Latin or Greek, in the Roman Church keep sacredly and inviolably. §. 42. There also impends upon Deacons having their Ordination a burden of daily reciting the Divine Office; concerning which a question is raised in the fourth Doubt.

35 §. 43. In the Church of the West this obligation has been imposed on Presbyters, Deacons, and Subdeacons, even though they have been affected by no Ecclesiastical Benefice. For the daily task of Canonical Hours is inherent to Sacred Order; and that this was received from ancient tradition and established in custom by immemorial usage, the more common opinion of theologians teaches.

36 §. 44. As far as we have been able to ascertain by conjecture and by the testimony of the Monks of the Coptic Rite dwelling in the City, whom we did not omit to question on this matter, Deacons, Subdeacons, and Priests of the Eastern Church are bound by no express law, Canon, or Decree of a Council to the recitation of the Divine Office; yet because those placed in the grades of such ministry are held to offer prayers and a sacrifice of praise to Almighty God, even among the Orientals a praiseworthy custom has prevailed of reciting the Divine Office. §. 45. It is recorded in memory that the Patriarch of the Maronites proposed several Doubts to Our Predecessor Gregory XIII of happy memory, so that they might be defined by his supreme judgment and that of the Apostolic See. It is read in § 6 especially: We ordain, says the Patriarch, Boys of five or six Years as Subdeacons, without the obligation of reading the Canonical Hours: Behold an Apostolic Definition related in the frequently mentioned Work of P. Thomas of Jesus: All the Ordained are held also to the Canonical Hours, at least those customary to that Nation and recognized by learned Men, not only the Beneficed, but also those in Holy Orders without a Benefice. Wherefore, if the Discipline of the Eastern Church subjects to the obligation and precept of reciting the Divine Office according to the custom of the Nation generally all those constituted in Sacred Order; that same obligation and that same precept of performing the Canonical Hours according to the custom of their Nation will affect the Coptic Deacons, who by solemn ratification made at a suitable time have again given their assent to the Sacred Order received in infancy. §. 46. These things may suffice for the examination of the third and fourth Doubt, always nevertheless keeping before our eyes and firmly retaining the hypothesis that the question instituted up to now is to be referred to Deacons ordained in early age according to the Coptic Rite among the Schismatics, who after their return to the Orthodox Church, and after ratification of the Order made among the Catholics in the state of celibacy, may afterwards claim for themselves the legitimate rights of Marriage. §. 47. But it is not rashly permitted Us to suspect that more frequently in practice another case occurs far different from the aforesaid hypothesis. For very often it happens that from Deacons ordained among the Schismatics in infancy, when age has advanced, the Ordination is held as ratified among those same Schismatics, if not expressly, at least tacitly, for example by ministering in the Order received; and by them subsequently Marriage is contracted. Finally, fleeing from the errors in which they are engaged, they seek a saving refuge in the bosom of the Catholic Church, under the hope nevertheless of obtaining a Dispensation over the Marriage already entered into, so that they may legitimately persevere in the conjugal state. §. 48. This case, the more frequent it is, is also the more difficult to explain. For if, according to the course of the reasons already expounded, Marriages contracted after Sacred Order are by the law itself null; it necessarily follows that Deacons on their return from schism to the unity of the Church cannot stand with feet in two different states, one in divine matters, the other in carnal matters, but must immediately be separated from any association with a Wife. Yet who will there be who does not acknowledge and confess that this separation places a grave obstacle before those hastening in the way of salvation, and greatly hinders that plans begun concerning Conversion be brought to completion? §. 49. On the other hand, if it were easy to dispense with Deacons in a Marriage contracted after Sacred Order (which nevertheless would not be altogether new and unaccustomed, as some wrongly suppose), inescapable difficulties present themselves in that Dispensation being committed to execution. For since among the Faithful, even of the Eastern Church, there are no and null Marriages celebrated after Sacred Orders; the dispensation will bring grave scandal to them, and they will complain bitterly that a most serious wound is inflicted on Ecclesiastical Discipline. §. 50. Moreover, since the matter concerns a Marriage null in its root; the Dispensation could not avail unless the consent be renewed and again duly given in the face of the Church by the Spouse. But the Copts would think this renewal of consent altogether new, or perhaps would refuse it, as full of risk; well understanding that one and the other Spouse can at will refrain from giving consent, indeed can seize the faculty of vindicating themselves into freedom. §. 51. Furthermore, as we have just indicated, we are taught by the monuments of Ecclesiastical History that dispensation was otherwise granted, so that Orientals returning to Unity might persevere in the bond of Marriage contracted after Sacred Orders. An example of such a Dispensation is exhibited by the Apostolic Letters of Our Predecessor Innocent IV of happy memory, given in the year 1244 to the Master and Prior of the Friars Preachers of the Holy Land, by which the same Pontiff among other things grants that through the Friars of the said Order, who are appointed to preach to the Jacobites, Nestorians, Georgians, Greeks, Armenians, Maronites, Moslems, and other Nations established in the Eastern Parts, etc., dispensation may be granted so that those from the Nations enumerated, who after the reception of Sacred Orders, or in grades and cases not prohibited by Divine Law, contracted Marriages, may remain in the same. There exists an authentic copy of the said letters at Rome in the Archive of the Order, transcribed in accordance with the Autograph preserved in the Monastery of Viterbo, as may be seen in the most recent Bullarium Dominicanum, edited and illustrated by Antoninus Bremond, an Alumnus of the said Order, vol. I, p. 136. §. 52. But these examples are not of such weight that We immediately wish to follow them. In this grave matter, in which much is lacking that is worthy of knowledge, we still hesitate; and we understand that the principal duty of Pontifical solicitude is to leave nothing unattempted that can pertain to ascertaining each circumstance distinctly.

37 § 53. It shall therefore be the duty of the Vicar General and the Prefect of the Mission, and of the other Missionaries, to whom We wish this Instruction to be brought, to furnish a suitable and clear response to the Articles set forth below, and to make Us certain as soon as possible, so that at length We may deliberate with firm step, as they say.

38 I. Whether any hope shines forth of the speedy return of some Bishop to sincere unity with the Catholic Church.

39 II. Whether, with matters remaining in the state in which they are today, it be expedient to grant to one or more Priests an extraordinary faculty of administering the Sacrament of Confirmation: To whom or to which it may be safely delegated, so that the Sons born of Catholic Parents after abjuring heresy, and washed in Holy Baptism, at least by a Latin Priest, may be anointed chiefly with Sacred Chrism.

40 III. Whether in the case of the granting of such a faculty, it be expedient to admonish the Priests not to use it in administering Confirmation to Infants immediately after Baptism (unless in case of necessity), but only at that age at which the one to be confirmed may be able to perceive the virtue of the Sacrament with his mind.

41 IV. Whether the Deacons of the Coptic Rite today attain that excellent number which is preferred by the Scriptures. Whether Deacons ordained in childhood minister as adults in the Order received, and in the state of celibacy, so that it may be inferred that they hold their Ordination as ratified before Marriage; since it is ascertained, as testified by Fr. Benart, that they accustom themselves from boyhood to Ecclesiastical functions, and are ordained in great number, lest at any time there be lacking those who may apply themselves to the Ministries of the Church.

42 V. Whether and how the abuse of conferring Orders before the legitimate time may be removed and utterly eradicated, and observance of the Decrees of the Council of Trent be induced regarding the age of those to be ordained, which Gregory XIII, for the safeguard of the Catholic Faith and the increase of Ecclesiastical Discipline, greatly commended to the Patriarch of the Maronites in these words: The Maronites are to be induced to observe the Decrees of the Council of Trent, sess. 23, cap. 12.

43 VI. Whether more advantage and utility, or rather scandal and detriment, is brought to the cause of the Faith by Dispensation over Matrimony entered into after Sacred Orders, having weighed on both sides all the weight of reasons and circumstances.

44 § 54. Finally, We earnestly desire all things which the Preachers of the Gospel shall have recognized to be opportune for the salvation of souls, for the propagation of the Catholic Faith, and for the spiritual consolation of that Nation, which We embrace with intimate charity. Meanwhile, earnestly beseeching God, from whom holy desires, right counsels, and just works proceed, that He multiply the gifts of His charisms to His Sheep and Shepherds, with the auspice of the desired outcome, We impart Our Apostolic Blessing from Our heart. Given at Rome at St. Mary Major on 4 May 1765, in the fifth year of Our Pontificate.
